Suspect in killing of right-wing protester fatally shot during arrest

"Show the moments leading up to a shooting that killed a right wing demonstrator in Portland. The search for the shooter ended with the take down that left Antifa supporter dead near Lacey last night. Tonight. We're hearing from people who know both men call Miller is live tonight with new evidence that was just unsealed. Cole. I'm very impressed it. An arrest warrant reveals that Michael Rainelle was to be charged with second degree murder and unlawful use of a weapon in that Portland shooting. Both he and Aaron Jay Danielson came armed to those protests, and at least four witnesses told detectives they heard shouting. Followed by two gunshots as a pro Trump caravan made its way through downtown Portland last weekend. Counter protesters came out as well and hours later, a deadly shooting. Erin J. Danielson, a right wing activist and Patriot prayer supporter, was killed and a warrant for the alleged gunman Michael Rainelle and Antifa supporter was issued yesterday. And now, new court documents show the images leading up to the confrontation. Rainelle seen walking than inside that parking garage as Danielson walks by out of frame. Those shots are fired. Reynaud and another man seen running away Portland police now trying to track that person down. Detectives found a loaded handgun and three magazines on, Daniel said, along with Bear makes, witnesses say he sprayed it before the gunfire. And then last night outside of a lacy apartment complex. A fugitive task force tried arresting Rainelle. U. S marshals say he was armed. He was shot and killed. I wish people treated him is gonna be treated them like they always have nothing. But he was always pumped about. You know things were going to get better friends also remembering Danielson not going down there getting so crazy. I worry about you. And that was the last messages and a search warrant was also unsealed today and that showed that Rainelle lived at a Portland address. It's unclear if he had ties to the lacy area. Or why he may have been there, and we still don't know if he ever at any point fired at officers. Neighbors told me last night, they heard at least two dozen shots overall. To you.

Trump Defends Kenosha Shooting Suspect

"That was an interesting situation. You saw the same tape and he was trying to get away from them. I guess it looks like and he fell and then they very violently attacked him. And it was something that we're looking at right now, and it's under investigation, but I guess he was a very big trouble. He would have been probably would've been killed. It's under it's under investigation. Great Odin's raven, can you believe The president of the United States is defending 17 year old Kyle Riton house. He hasn't said a nice thing yet about Mr Blake. That's how the media is playing the story in Wisconsin. Here's the shocking headline here on this morning President Trump on Kyle Rittenhouse. Trump appears to back claim that suspected team gunman Acted in self defense rips left wing political violence. That's a Fox news headline. Now why are they all shocked? Because the media wants you to believe that Kyle Rittenhouse was some out of control crazed teenager. Running around on the streets and in Kenosha, Wisconsin, willy nilly looking for somebody to shoot. That was not the case at all. And I was wrong. About a post. I put up the other day about him that he didn't have a right to have the weapon, his attorney says. That's not the case. His attorney was on was on with Fox. With with Tucker last night. And he said that this was clearly a case of self defense. Listen. This is 100% self defense. Tucker Kyle. He's a good kid. He's a lifeguard. Kenosha was burning down. Actually, when he got done with work that day, hey, went to the high school with some friends to try to remove some graffiti. After that, they got a call from a local business person who owns three businesses in downtown Kenosha. Two of those three businesses have been burned to the ground in this business owner I simply wanted Teo desperately protect what was left of his life's work, So we asked for help. So, So that's that's bite number one. The second question for me, Wass. Was the gun legal. My thought was he's 17 years old. He lived in Illinois. He was in Wisconsin. He was carrying an air style rifle. If he transported the gun across state lines. That's a problem. So Tucker asked him that question last night that, by the way, was John Pierce, the attorney for Kyle Riton House. This was John Pierce's answer to that probing question. Listen, I have read that he brought a firearm as juvenile 17 across state lines. Lot of people that's incorrect. Tell us where the gun is incorrect that that is incorrect. That firearm never crossed state lines. That is a legal firearm in the state of Wisconsin. Wisconsin is an open carry state that charges incorrect. As a matter of state law, a 17 year old, he was legally entitled to have that firearm in his possession. Moreover, we're going to be arguing that the Second Amendment And Title 10 section 2 46 of nine States code renders that charge in any ordinance that that charge would be based on blatantly unconstitutional under these circum So It kind of puts a different light on it. I Here's what I think. My 17 year old tells me he's going to downtown ST Louis because there's a riot going on down there and he wants to go protect buildings. I'm locking him in his room. I don't think the kids I don't think the kid had any business going up there. Into the chaos of a riot where he had no, I your head has to be on a swivel. If you're going to carry a weapon in the situation like that, you need to be trained. But the failure here is on the officials in Kenosha, Wisconsin, the governor, the mayor, who who so let that situation get out of control that Citizens felt like they needed to take to the streets to defend businesses. Right back up. Don't ask a stupid question because I'm lost by the whole, the businessman calling 17 year olds to protect their building. That was my first question runs engineered. Apparently, the kid knew a lot of people and spend a lot of time in Kenosha and was up there helping remove Graffiti from a building when they get a phone call from business. There's wanting 17 year olds with guns to protect them. I don't know if they were all 17 years, people that called this kid to begin with an excellent question, and I think that all those air legitimate questions. But at the end of the day What? What you saw in the video was someone who was about to get his head bashed in with a skateboard and the second person that he shot Had a handgun pointed at him when he turned his rifle around and shot him. This is not some clear cut case where he murdered two people in cold blood. And yet the officials in Wisconsin have charged him with two counts of first degree murder. On assault for the third person that got wounded. And yet, the guy who got shot who had the gun in his hand, who is a convicted criminal? Has not been charged with anything yet. The guy that tried to bash him over the head with the skateboard has not been charged with anything yet.

So many had a question about the unanimous jury verdict, and they misunderstood I think what Robert Travis Scott was saying as it stands. Now. The only charge that requires a unanimous verdict is capital murder. And that's where the death penalty is involved. Second degree manslaughter does not require unanimous. Verdict. Ten out of twelve will suffice between man, second degree murder, manslaughter, second degree, murder and capital murder. There have to be extenuating circumstances for capital punishment, even come into play, and ASEC's example, I can make of this is Vince Maranello who is still in jail. Right. So make sure you're saying anything. He stalked and killed his wife. Who's premeditated? Had he tried to make it look like a robbery and robbed her took her purse a personal possessions. Whatever then it would have been a capital case. But people in wonder if it's premeditated why it's not capital murder. That's the reason according to Louisiana law, but as it stands now, it does not take a unanimous verdict to send somebody to jail for the rest of their life. "That's one thing that's all I know about the law when you were when you were the prosecutor former. So we were. Trying to eliminate malice had the testimony of the expert and sure enough. The jury came back so they were hung. They wanted further and the judge said, well, what can I do to help? And they said, well, we're stuck analysis, which I, you know, I felt good about that meant that it was between a. manslaughter in a second-degree murder. So he then decides to give him the mouse instruction. Missa judge, you can't do that. The mouse instruction, you're giving them for malicious mischief. Not for malice of murder. Melissa malicious mischief is to vex annoy or harass. Obviously she was vex annoyed in harassing, so that would show malice your gain. By the way back then it was called Cal GIC jury instruction. The use though, said, do not give this in a murder case, but in the judge did it anyway, they came back with a second degree murder, so-. I briefed at sentencing, tell him, okay, you screwed up. You gave the wrong instruction and he basically conceited, but he said something that I'll never forget. He says, Mr Garriga if I grant a new. Trial, they can retry the case as a first degree murder, and I said, oh, whoa, judge you. Just you just really showed the your time has passed you by. She was acquitted of the first degree murder. They convicted her of the second. You can't retry somebody on the first and he still wouldn't do it. So we had to go up the court of appeal. I never forget. I was there with Dennis Fisher who's one of the great appellate lawyers about time, and I got up to argue and judge. Paul turn who just passed away Justice, Paul Turner, I case, I thought I had upward uphill battle because he's the bragging, never river, stay criminal conviction. I said what we says sit down 'cause I'm the appellant I've gotta go any tells the g. says, we're going to reverse this the this case, we don't need a whole lot of argument. This is pretty much a slam dunk. The only question I've got is, do you disagree with the judge that that she can be retried on the first degree murder and the attorney general to his credit or her credit says, though we agreed. He was acquitted that there is called double jeopardy, still the law. So we go back to the trial court. They reversed the murder conviction. I work out a deal for voluntary manslaughter time serve..

"second degree murder" Discussed on WGN Radio

"And it's Pete McMurray in for John Williamson Rokon just walked in the studio while. Knowing that this came back pretty quickly. Did you anticipate that he was guilty? Yes. Second-degree? I this is a proximity. What I thought it was going to happen. The issue here believe it or not is not in the second degree murder. The issue. Here is the aggravated battery charges and convictions because sixteen aggravated battery convictions each aggravated battery conviction actually is a bigger time spent in prison than the second degree murder. Second degree murder is a minimum of four years and probational you're getting at fifty percent of the time serve. Okay, judge. If you just been convicted of second degree murder, the judge gonna say. We're not putting in prison. The the minimum the minimum for each count of aggravated battery is six years at eighty five percent. So he's going to have to do at least five years and some change in jail on on the and that charge now the idea is some people will say sixteen charges. So it sixteen times six years, right? It won't be. It's one act. So they the unlikely the judge will will make that anything. But concurrent. Okay. But it depends on what he gives them because they parameter allows it to be up to thirty years six to thirty years. So the judge could give him six years on that. And in fifteen years on the second degree murder. This is what I'm getting now from canvassing some judges is it it's like you'd be fifteen years, which you'd serve it at fifty percent, which would be about seven and a half years. So he'll be it's likely that he will spend somewhere around seven years in prison state prison for this. Now does he keep his pension? How does that work? Do they have to rule on that too? I it depends. The union will have to answer that. I'm pretty sure that he does not get his pension here. But I will I will want to see and right now he was taken into custody immediately. The his defense asked you didn't find it very hard though, that that he'd be allowed to come back next week to discuss bail and bond and all that I think is almost everybody's best interest. And he go in tonight for his maybe the safety of his family. There have been a lot of rumors right about what people wanna do. Here doesn't at this moment. And it's very early. This is just happened within the last half an hour that that the guilty second-degree murder and in the sixteen aggravated battery guilty charges that it seems to me that. We're not seeing a whole lot of action yet or anger yet. We'll have to see what happens throughout the evening though, there were a number of threats against the family. Oh, yeah. So we're going to hear from the attorneys coming up soon as they walk out of the courthouse that we're going to have his defense attorney Dan Herbert on at three ten at three ten. Yeah. He's going to call the show. Yes. Okay. It's it's strange coming. Downtown today. Wasn't it? Did you get here before the verdict? Yeah. Okay. People were getting out people were really getting out in the police presence downtown yesterday was crazy. I just drove straight to the station parked in the garage and came upstairs by today. I'm sure it's off the charts. Yeah. There's a lot of police police on every corner downtown. And you know, you just don't know you don't know what's going to happen in this in a situation like this. I don't know if this verdict is going to quell, civil unrest or exacerbated. I mean who knows you never know and some people protest because I wanted to give Vanja things it has nothing to do want to protest protest. Yes. So Jason Van Dyke found guilty of second degree murder. Found guilty on sixteen counts of aggravated battery with a firearm, and you're gonna have Dan Herbert on in a little less than an hour. And we're going to hear from him at his press conference when he walks out. Thank you for coming in. Thanks. That's real Khan. He's coming up at three o'clock with Anna at seven twenty WGN. Whether.
