Owns a home as an individual, and he's contemplating selling the home and using the equity to purchase a new home in conjunction with his girlfriend. They would both be on the mortgage and presumably on the title. My question is what what should he do to address this issue? Does it need to take any particular proactive entrance? Well, I mean, the whole notion is has a certain amount of risk involved in it. Because of the fact that there he's she is a girlfriend, not a wife, and so they're getting on deed and taking on a financial responsibility. Together that is not in a sense anticipated by Florida law, and so once she gets on the deed. If things go sour, and that sometimes happens, we now have a situation where she's on the deed, and she's also on the mortgage, and assuming that that people are not cooperating at that point. We have a problem. I don't know how you can potentially. Do anything about that problem except to recommend caution in in setting it up that way, I a document or anything that that will solve that problem in part because his a third party involved, which is the mortgage company as far as they're concerned. They now have to people that are responsible for the mortgage. They're not going to be that willing to let park person number two off the mortgage. The mortgage company is not going engage in any preliminary discussions about things that could get you out of this relationship, and it all working out. So I think caution should be discussed, and maybe it should be in your son's name. If that's how it's working. And of course, getting alone might necessitate putting her on the mortgage as well. The first of all I want to put a plug in for your landlord tenant workshops, isn't that? Nice. Thank you. Well, they're just so helpful. And and you told me before in the phone as well. So I tell everybody to call you. Okay. Good enough. What can I do for you? Okay. I live in east Orlando tenants next door using our front yard as a driveway. So we started getting some quotes to have a sense put in okay, and because the landlord doesn't return my calls or emails. So my question has to do with what's my responsibility to inform the landlord number one that we're gonna put a fence. And then number two is we've found when we're doing the fence quotes that the the boundary survey that I had done when I moved into the house show defense on the property line. But when the sense people came out to measure, it it actually is on our property, so who's landlords. They want to get in touch with you. Are you a renter or? Or an owner. No, no, no, the pe- on the owner. But the people next door, the tenants, they they hustle the people that come for the fence quotes. Okay. Okay. We're having to deal with the fact that you would put up would be on your side of the property line. Correct. Yes, sir. So in effect. I mean, not that I'm being too naive about this because I'm sure people have to straddle the line to do certain things, but pretty much this is a problem that's contained within your own property. And so that contacting the owner next store mostly is not a requirement. Okay. There's no requirement that you did because you're doing something on your own property. Now, I say I'm not being naive because in a sense when people are working on something close to a property line. It might be nice to contact the person next door, and let them know that that's what's going on. So I'm not undervaluing that. But I don't think I don't think that you have to get their approval or anything like that to do something on your on your own side of the property line. Right. I was just thinking about setting a certified letter return receipt explaining to them that what we're going to do. And and if the tenants there wanna get out things like campers or things like that the existing gates is we'll be is is is bigger than it should be in other words on their side. Okay. Well, so I don't know if they're using your front lawn because there's an easement to it or anything like that. So I'm taking this question sort of at its most fundamental level, which is almost zooming that. They don't have any of those rights that for some reason they're just parking on your front lawn because it's easiest to do that. And it's very nice of you to send letters and to notify and I'm not I think you should do that. I think that's great. But in the end, you have the right to do on your side of the property lies one you need all of the code enforcement stuff. Thank you have a right to do that. So I don't think you ought to necessarily. Feel an obligation to contact them. I have to take a break right now. "Eight, Mike. We'd love to help you get your state planning done. That's what we do on a day-to-day basis, and we'd love to assist you and other listeners out there. Let's go to Jim in something or county. Jim you're on news ninety six five. Go ahead. Thanks for taking my call. I have a neighbor that decided to landscape about three feet onto my property unaware of where the property line was do I need to be concerned about that. When I either go to sell or he goes to sell is it a flower bed, or is it hard scaping like a fence or a wall? No stones and landscaping block. Okay. So the bottom line, Jim is I don't appreciate your neighbor doing that. Without looking at a survey. I but at the end of the day, it's not going to hurt you necessarily. And this is why people are always concerned. Well, my neighbour put his fence on my property or stonewall my property will buy property become my neighbor's property someday. The answer is no. For adverse possession here in the state of Florida. They would have to be paying he would have to be paying your real estate taxes on that three feet of property, Jim, and that's never gonna happen. So that property will never be his Jim what this may be create an issue is this is that when you go to sell your house and your new buyer gets us survey and sees at your neighbors walls on your property. Hey, it may be an issue for your buyer. So Jim, here's how I usually resolve that I usually resolve it by doing an agreement that signed by you and your neighbor where your neighbor acknowledges that this wall. And this landscaping is on your property, you both agree that you're gonna leave it as is no problem. But if you ever want to remove it, your neighbors, giving you the permission to remove it. And that's gonna give your new buyer comfort level down the road. Jim does that make sense? It does. Thank you very much. I really appreciate it. You're welcome. If you want some help with that agreement you let me know, and you know, as it happens. I built a stone wall had paid somebody to build stonewaller winter over my neighbor's property a little bit. We didn't mean to. But we did and my neighbor, and I we signed that same agreement by the way when you get that agreement done you record it in the public record. So it doesn't get lost in his picked up by all future owners of these two pieces of property. Hey, folks that opens up all of our lines for your legal questions right now. And I always think about college kids who are you're putting three or four them in a single apartments. And. I don't know you sometimes there's one listener all signing on one lease. Sometimes it got separate leases, and they have their own bedrooms. But they share a kitchen a living room house at shaken out for college kids are sharing not dormitories, but regular residential properties out there. Well, it is. I think you have put your finger on an interesting and recurring problem, which is how if you're a landlord. How do you want to enter into a lease with this group of people? And I'm not sure there's one way that's better than the other. Typically, it's done in a single lease. Typically, you have the however many people sign onto it. Sometimes you have their parents sign onto it as guarantors as well. But truthfully, even when you do that if you ever had to do an addiction or one person left, and the other people don't want to pay that person share it inevitably leads to problems. I'm not sure you can write out those problems. I think that's what happens when you have multiple people unrelated to each other sharing premises. So if you're a landlord from landlords perspec-. And you got three kids in your rental house. I suppose you'd probably want one Leeson, and they're all three of them are signing on a thing. They are in our joint what we call jointly and severally liable. So doesn't matter to the landlord that one of them left, even though to the other two students they're going. Why should I have to pay for that person? As far as the landlord is concerned. He's written the lease in such a way that the other two parties are responsible for the entire lease. And it's up to the other two parties to chase the third party whose left for some share of responsibility that they have walked away from you know, my son is going to Georgetown University law school this year. And when he moved up there, I was afraid that I might be asked to sign his lease. And thank goodness. It was not asked of me. So I I did want to do it. I'm not sure I would have done it. But thank goodness. He found a place that did not require me to do it. Yeah. Well, that's that's pretty good. Because in my experience, it's very often. The parents who are the last sort of hedge against liability for the landlord. Well, while we're on that point. I just want to make this all the listeners out there. And that is this folks never ever under any circumstances. Co-sign a loan for your boyfriend girlfriend, son daughter friend, do not do it. I had a poor lady. Let let's make clear the, bad news before we start anything else in terms of answering this which is in Florida there is no rent control. There is no limitation accept what the market will bear. On what a landlord who's free to contract you are free to contract or not contract as you see fit in terms. Of rent increases so we're talking about places, that are not government subsidized housing or anything like that would just talking. About places, that. You would in the. Normal course of events rent. From another individual and so there is no limit and so when one. Lease expires both parties are free to say I don't wanna do. This unless there's a rental crease I don't the, other, side can. Say, I, don't, wanna. Do this. Unless there's a rent. Increase or, let's just. Leave it the way it. Is any party the of the two parties can decide to. Do that and if they Can't reach an agreement then they are free to depart and if. They don't depart they would? Be, subject to an addiction so the sort of the tough answer to your question is you're thinking that there is an obligation. On the landlord's par to. Not increase the rent order increase it by a certain percentage only I think that would be a. Mistake in belief and from there I think you're going to have to weigh your options carefully. I guess how how you've discussed it with Tom so the the first thing that I would say about it is they are they essentially own those limbs under. Normal circumstances as they cross over the property line and so they have every right to take them down as they crossed, the property line not to go on your property not so they could take, them down and but that would be their decision their. Responsibility, and they would have to pay for it now the, only exception is one that may be applicable here. Which is you need to not do negligent things and so while we have a decided case of law that, they would have the right to take those down. Your tree is posing a hazard to their property and so we're going to get a, kind of clash of different theories going on here which is, that if you're being negligent and somebody gets hurt or somebody gets damage when you would have some pretty good reason to To know that this was. A high risk then as far as I'm concerned you would be taking a risk that somebody would ultimately think that you were negligent and try to to get. You to pay for damages now you're gonna defend by saying well he could've taken them down he owned them do I, want to be in that lawsuit in the first place I don't think I, do so I think that caution in that situation is. Merited, and I would be working with my neighbor to come, up with some kind of solution to make sure. Responsibility who who, who arranged that I okay so we have, a couple of issues here first of all if you look at a, home inspection contract it is full of small print enough to make a lawyer's is giddy and so make sure you look at it carefully because there are. Numerous. Exceptions to what they are required to inspect and inform you of So that's going to be the first thing and I think you you will find that there's. An awful lot that they they exempt self from that wouldn't be obvious on a first sighting so yeah they can see a broken window yes they can see places where waters enter but they, may not, see things that are behind walls or things like that so, that's number one and number two. We have the issue the statute of limitations of course this happened, quite a while, ago on the other hand the way statute of limitations work is they don't start, to run when you have a situation that you. Just recently discovered that you couldn't have discovered earlier so maybe that's applicable and that may in may? Keep. That. Claim alive so I'm not going to leap. In and say, that I'm sure that you have a cause, of action here I just know you have a couple of hurdles to.
