See if we can make heads or tails of it for you. I want to touch on a couple of things I've talked about on and off over the last few weeks in one case, I'll give you an update on something in another. I just want to give you a reminder on this. But. Two things as it relates to your credit history. One as it relates to a rental. If you are someone who has tried to rent an apartment and has been denied and after that denial. You were never sent a report as to where the rental company that you were trying to read from got the information about you. Came from a credit report or rental report. And the reasons why. Those folks are ripe to get sued. Because even though it's not technically the rental reports, not technically a credit report. And that's kind of what I'm going force looking for these rental reports because they don't always pull your credit for rentals. Look at rental report to make sure that you haven't had any evictions in that. You don't owe anybody any money. But rarely do they ever send the letters out that are required indicating that you were denied, and you were denied for the following reasons. And they got the information. That allowed them to make that decision on the denial by looking at the following document. The following report. If they don't provide that for you. They can be sued under the fair credit reporting act is a violation. Failure to provide that is a violation. The other one that's a great one. And especially here. It happens frequently because a lot of people deal with cash, obviously with the casinos, the background check denial. If you were denied employment. Because there's something in your background. And you didn't get a copy of that report. Didn't get a letter in the mail. Indicating where the company that provided the the background check. Got their information. You are someone that we want to speak with in. Both of those cases the Reynolds in the background check. If you had either one of those happened, and you haven't done the information in the mail from either company, we would like to chat with you in alternately will end up taking you want at no cost to help you get squared away. And and get that back on track and find out where that information. Exists, but they don't play by the rules often. And that's one of the reasons I'm here talking about playing by the rules. For debt collectors and credit reports. And and the like. I shared a story with you. I suspect the week before last. About a client of ours who had a debt that was sold four different times. It went from one from a credit card company to multiple debt buyers. And when we took a look at the lawsuit, we realized, you know, it's gone up a bunch of different places. And it also appeared pretty clear to us that the probably wouldn't have the data. We're we may or may not be within the statute of limitations on. So we took this on we we called the new the newest debt buyer, the one that suing our client. So listen, we would like what's called account level data. They are required to provide that data. And the company said it will send you validation on the debt of the debt. Couple of days later, we got a document in the mail, which was a statement from four months after the account had been close. And we call them back and said, listen what we need is a year of pay history. We need to see how you got from. You know, the seven thousand dollars you think that she owed at that time. To that number from the sixty five hundred dollars or whatever that number was. We wanted to see the entire pay history is her right as a consumer to get that debt validated. Her right? Certainly when they go to court if they are going to move forward and Suber. So I I knew because of the statement we got the only one thing we had that. There was no way they were going to be able to get that information from the by the way, this was a Bank credit card one of the one of the big five banks, and they had they sold thousands of of these debts. But the bottom line is that after a week and a half of this. It was clear that they didn't have that documentation rice said listen, our clients going to go to court and demanded or you can just take a couple of thousand bucks to go away. Because there's no way I'm going to instruct you to pay seven thousand dollars on a debt that we think is nearly out of statute. And you guys can't provide all the background for and the biggest part of this. And you know from listening to my show if you've listened for any period of time regathered says if you owe the money pay the money. But in this case when you're dealing with the debt buyer, the debt buyer isn't do seven thousand dollars they bought that seven thousand dollar debt for. A couple hundred bucks. Probably right. That's what it boils down to the fourth sale. It's nothing. It's pennies on the dollar. Do they still have the right to go after you for sure, but they must provide account level data. If they can't do that. Then when it comes time to go to court. They're screwed. We ask them for because the judge is going to say to the debt buyer. Where's the information? You're supposed to have the information. You know ninety percent of these given the statistic in the past a number of occasions. Ninety percent of lawsuits. Between a collection agency or a debt buyer or credit card company and a consumer are lost in what is called a default judgment. And that's basically the forfeit think about you know, the little league games when you were kid. You know, one team shows up with six players one has has their nine and then some. Well, the team with six players has to forfeit because I'm having a players. So so that's what happens because consumers are afraid because they know they owe the money. So in this case, I said, listen, Pam something. My suggestion to the client. Pam something. Be prepared to go to court, and it will be intimidating.
