What were you told about the character of Laura? Just that she was going to be a wife, a television wife, and that really had its classical parameters and dimensions that they were established. The Public Square would quickly revert to the law of the jungle. Brutish power would prevail the week. The unborn, the elderly, the gravely ill could be quietly terminated. Plenty of heartbreaking losses to end seasons as well but this is the first time time he's ever felt like he can't even play the game he loves and to someone as obsessed with the game as he is. That's terrifying as the X.. Hails through another few reps on the bench. Payton is replaying in his mind. The colts last matchup against Tom Brady and the pats in November another loss. He's now four and eight against Brady. The record motivates him but more than anything. It pisses him off off as he adds a little more weight to the bench. He hears his phone chime. These types of texts have been coming in regularly this off season from the Patriots. He's met let with each of them and has felt like he's made an impression but they won't commit to choosing him atop the draft and now it's eating at him. Peyton is sure he should be the number one pick. He's the no brainer safer smarter selection. He was a heisman. Finalists the son of an NFL fell legend. And he's proven his acumen an ability over and over. Meanwhile the other quarterback that the colts are considering is a fiery big big armed Washington State quarterback named Ryan Leaf Leaf is definitely a wild card and certainly not football royalty like manning but for reasons Peyton can't even fathom the entire sports world thinks it's a coin flip for the colts manning or leaf leaf or manning as peyton paces outside the GM's office. He practices under his breath. What he'll say when he goes in he first met Polian at the draft scouting scouting? Combine here in Indianapolis in February. Manning left an impression on Polian and the head coach Mora by coming prepared with a long list of questions in in his notebook. peyton thoughtfully asked about offensive scheme. They they sat through a season of losing to land Payton in the draft. A few years later the losing paid off as Peyton turned around the team now. The colts are consistent winners and the fans are as loyal am loud as any fan base in the league all athletes spew cliches jays about their love for their fans but Payton seems to really feel it. They call this loud stadium. The House that Payton built. It's a huge which compliment but it comes with huge pressure as well especially on days like today the dome is packed. With more than fifty seven thousand crazed crazed m a little nervous fans today including Payton's famous retired. NFL quarterback Father Archie Manning who descended on the Dome to take in in the AFC championship. Game the winner punches their ticket to the Super Bowl a game in which Payton has still not played today though could be his chance hands to take the next step in his career to get there though he needs to go through the New England patriots and his biggest rival. Their quarterback. Tom Brady Payton can see Brady across the field right now. Working with his receivers his eyes are stealing. His mechanics are perfect even in warm ups. He's a perfectionist and Peyton respects that as Brady works. Through his warmup routine Payton makes eye contact and they meet at Midfield to chat for a few brief minutes for men so linked as rivals in so intent on bearing each other. There's a surprising comfort level level when they interact not ton of in jokes but an abundance of respect and similar experiences navigating the NFL. "Know how to look at this like i don't have enough context to know if what she's doing makes sense and says a protest or is just kind of weird and maybe she should just testify. Get over with yeah i. I think that this is a much a harder question than folks on either side want to admit so. Let me give the pro chelsea manning side. I the pro chelsea manning side begins. I think the strongest argument is not an argument at all in a legal sense but an argument in fairness fairness sense and it says barack obama commuted her sentence she has been court-martialed her debt to society a <hes> <hes> to whatever extent that it is has has been repaid and it seems not just weird but totally unfair that chelsea manning has been consistently in prison and julian assange isn't right and particularly the first count on on the indictment. <hes> you know carries a maximum five year prison term right that was so until the superseding indictment came out <hes> and after right zubin remember. Let's go back to the time line. Chelsea manning was held in contempt on may sixteenth. The superseding indictment against assange didn't come out until may twenty third right so at the time that the court issued this order chelsea manning was and very likely will serve eighteen months in jail bill and julian assange was only charged with a single count of conspiracy to commit computer intrusion which was going to carry probably probably zero jail time <hes> so that seems wrong right that that we shall see manning's motive is it. It's not like chelsea. Manning is like hey julian. Assange should have gotten worse. I don't know but but if you think about it it it. I think there is kind of even inherent unfairness in if what you want to do is make the best case possible against somebody that you think is guilty of a single criminal offence offence that carries minimal jail time the idea that you would jail collateral witness for way longer seems to at least to me offends my sense of proportionality right. That's kind of point one point. Two is a a and we we discussed this already chelsea. Manning the information to be gained to the grand jury is of appears to be of marginal value at this point and i i do not know what an i. It seems like kiss. She was in prison at the time. I cannot imagine how chelsea elsie manning would know of any relevant information between assange wikileaks and the russian efforts to hack the two thousand sixteen election right that she's not going to have valuable information on that so the only possible information that she could have that would come to bear on any pending grand jury investigation would be processed based stuff right would be maybe she. He knows specific things about how assange back channels his information right. Maybe she knows his habits and practices practices and that's what would be valuable to a grand jury again a lot of speculation here and and i think when you sort of wrap wrap that all up and and by the way that's how chelsea manning had to plead in in in her own motion to quash right her lawyer say the gr- injury defining feature is secrecy and the subject of this investigation has not been publicly disclosed now we have been told that they're interested in inconsistencies in her statements blah blah blah but but even chelsea manning herself and her lawyers do not know why the government wants her testimony and the government doesn't isn't half to tell her so right so there's a level of speculation so that's what you sort of put on the one hand is <hes> this this unfairness <hes>. It seems like it's politically motivated. It seems like gets in we know the superseding indictment was in connection with whistle blowing and and we don't want to go after people who expose the u._s..

"Only after an indictment was obtained council was informed explicitly that the government wishes to inquire into alleged inconsistencies between statements manning made to an informant in two thousand and nine and statements made at her court martial in two thousand thirteen and further that they were interested in enquiring into manning's activities during a certain time period prior to her twenty ten disclosures the matters which could be inquired into should as expected ms manning be called at trial as a witness either by the prosecution or the defense the government's sixties the power of the grand jury subpoenas to prepare for a trial witness and because ms manning has already given exhaustive testimony at her court martial and given the government it has access to thousands of pages of military forensic reports. It doesn't need her testimony. Quash the subpoena. Don't make her testify the court dan. That's sounds convincing to me but i don't and basically said look <hes> grand. Juries are entitled to a broad range range of of evidence. You know whatever the prosecutor wants to bring before them and if the prosecutor thinks that the <hes> reliability of manning's testimony is significant piece of information than they're entitled to that information and we want to hear you're the grand jury is entitled to hear from chelsea manning and she is therefore required to testify and so the specific order again this order order was then oh and i should add by the way the the court after ordering her <hes> to comply with the subpoena then held an oral argument. That transcript is sealed. I can't get access to it but the court's order has been unsealed right so parts of this have been unredacted parts of this have have been released <hes> the documents that are available like i said i'm going to link in the show notes on may sixteenth the court said in open open court it why not an open enclosed court in a in a in a closed courtroom <hes> but before the judge <hes> chelsea manning said that she was going to quote persist in the refusal to comply with this court order to testify and <hes> and the court said okay well. You've you've told us you're not going to comply <hes>. We don't think that you have just cause to to disobey the subpoena we want you to comply and so this court is going to hold you in civil contempt and here's the text of the order and again this will help make it make it make sense <hes> she is remanded to the custody of the attorney general that is to say she is in jail until such time as she purchase herself of contempt right pitches his which means this is before the grand jury old timey stuff like she's a witch or something kind of as well. That's what that so. That's language means to purchase off of contempt to do the thing that will bring you into compliance that makes you no longer in contempt so until she either testifies vice before the grand jury quote or for the life of the grand jury but in no event longer than eighteen months and of quote so again again if and when this grand jury concludes that will also terminate chelsea manning's stay in prison it will not terminate germinate this civil it will it will terminate the civil sanctions <hes> which i'm about to explain <hes> they will stop running but she is also being fined. She is being fined five hundred dollars a day for the first sixty days and two thousand dollars a day for everyday free day thereafter. That's pretty extensive it. I have seen civil contempt sanctions that are that high. I was involved in a case in which a witness who refused to show up for deposition <hes> was was <hes> held in civil contempt and was fined two thousand dollars a day <hes> until he showed up but <hes> but that's gonna start running <hes> it is not clear to me whether that will run retroactively to may sixteenth sixteenth or whether.
