"Follow. 1 40 tomorrow. Reading from The New York Times. What we should know about the shooting of Jacob Blake will visit with his attorney here in just 60 seconds, but I mean, just kind of remind everybody about where we are on this story. Jacob Blake is that 29 year old black man and reading from The New York Times left, partly paralyzed after a white police officer shot him seven times. And the back outside an apartment complex in Kenosha, Wisconsin. That happened last August. The shooting, which happened in front of three of Mr Blakes Children, was captured by a neighbor in a video circulated widely. And rapidly on social Media. Outrage spread quickly. Protesters poured into Kenosha in the days after the shooting, as did counter protesters in Illinois teenager that would be our Kyle Rittenhouse. Was charged with intentional homicide in the shooting death of two demonstrators, professional athletes and several leagues, led by the Milwaukee Bucks of the embassy joined the protests by refusing to play games. Four months after the shooting of Mr Blake, the Kenosha County district attorney, Michael gravely. Announced on January 5th of the officers involved in the shooting would not be charged. Mr Blake is 29. He's a father of six grew up in Evanston moved to Kenosha few years ago, said the Tribune to find work and raise his family. He was training to become a Mechanic, they say at the time and Kenosha on August 25th two people fatally shot a third wounded. Protesters clashed with counter protesters. Kyle Rittenhouse Then 17, who's white, was arrested at his home in Illinois and charged with six criminal counts. On November 6th. Prosecutors in Kenosha County Circuit Court dropped one count of third degree sexual assault. And agree to drop one count of criminal trespass if Mr Blake played it guilty to two counts of disorderly conduct, according to court records, and Mr Blakes lawyer, Patrick Cafferty, another one of his lawyers on the phone line. Be ivory. Lamar is an attorney for Jacob Blake on the lawsuit filed, so let's pick the story up there be ivory, Iran, WGN in Chicago. Thanks for joining us. How are you? I'm doing Well, I'm happy to be here. That's the summary as theater times just kind of caught us up on the 411 of that anything else you would add or stood out to you and that sort of description of where we are today. Yeah, You know, it's It's definitely been a long road. I think the facts as you put it, where pretty pretty Factual on Jacob Lakes legal team. I work alongside attorney Ben Crump, and it's also attorney Patrick Selvi. Um and there's been a lot of work and that has been put in over the last several months here. So where are we today, then? Today is about kind of accountability. I think as we look in last year, rather it be George Floyd Jacob Blake. It was a year of social awareness of the social justice issues. And I think that here in 2021 It's about accountability. We've seen the city of Minneapolis. Step up and, you know, kind of make an effort to make things right with the Floyd family. And now the Blake family. Um, you know Jacob Blake. Is now seeking justice himself. And we've done so yesterday with filing the lawsuit against the officer that was involved in his incident on August 23rd. This is just the officer or is there anybody else named in that suit? I'm right now. It's Officer Cesky, who was the director actor of shooting the seven shots. I'm at Jacob Lake. Are you encouraged? That is Do you like your chances Given what happened to Minneapolis? You know, we we think that it's pretty evident. We think we're lucky to have the bystanders have a video that was available for us to actually see what actually did occur on August 23rd, the city of Kenosha Police department did not have body cams. So there's a lot of, he said. She said that at stake when we have these issues, but luckily we did have that video footage available on and we think that from what we've seen with the outpouring Of support across the country in response to this shooting that we think it's pretty straightforward. I'm not think that without question Officers. Chayefsky's actions were excessive. I mean, any shooting any human being who's walking away seven times with their back? I'm saving you. Think is in, agree direct, and I think that We do feel very confident, moving forward. A lot of us are confused, right? I mean, if, though it was determined that there was no criminal action, then how is it that you should win civilly, right, And I know they're different thresholds, but Would it have helped your case if they had decided to prosecute criminally? You know, I think you know, As you pointed out, there are definitely two different dress shows, you know, obviously in the criminal system of the analysis by the local district attorney, um he's viewing it as far as determining criminal and tit. On day again. We might differ on on our stance on that again. But that's his evaluation in that system, as we look at his actions on the civil basis Um, where were solely looking at whether his actions were excessive. And I believe that Hey, definitely exerted excessive force by shooting a human being seven times. I think that when you look at the video, uh, there was no pause after the first shot, even see if the first shot would have stopped. What thing Officer might claim that be, um, imminent threat. S so when you look at that many shots within that short time, Frank. I think it's pretty evident that You know his actions were excesses. So if you see the police officer, though he doesn't have millions and millions of dollars That's why I wondered if maybe the department toward the city if you would go for a deeper pocket, right? Can you talk a little bit about the strategy on that? Well, I I can't say that in many in many occasions, um by him being an employee in acting in the course of his duty as they couldn't Canosa police officer that The city of Canosa will likely indemnify him for any suit brought against him. S o again. That is, you know, left to be determined. But we do believe that without question, That officer said he was the primary actor s so at this time, That's who the action anybody every in a case like this, Do you seek an amount or do you just wait for the jury to determine an amount? You know, there's you know, it is unspecified. At this point. We can't say that. You know, Jacob's Welsh recovery is long. I mean, he has permanent injuries from the waist down, obviously magically. We all know how how substantial medical costs can be. Especially here in 2021. I would like to mention that you know, Jacob has around the clock here. He's getting 24 hour assistance. You not able to Um, it actually size a lot of his bodily functions s..

"Yesterday, Democrats were appealing to senators as witnesses who actually experienced the day of the attack rather than just as jurors. How did they approach today? You know, that still came up quite a lot. They brought it up again and again, how any one of the people in that room could have been killed by this mom. They talked about rioters calling for blood to stream from the capital. He said. It wasn't just about targeting Democrats. They said it writers themselves wanted to kill vice president Pence, They said they would have killed any lawmaker they could find, and Democrats also talked about the harm two police officers and staff and as evidence that this wasn't just about targeting Democrats or just about Republicans, it was about more than that. And who will we hear from tomorrow we're gonna be hearing from Trump's lawyers were. We've already had some preview of that David shown. One of his attorneys was on Fox News, saying that Democrats have ignored the part of the speech on January 6th, where Trump called for peaceful protest, Even though Democrats did sort of acknowledge that, he said the video's on Democrats played take things out of context. We'll be hearing a lot about that. That's NPR congressional correspondent Kelsey Snell. Thank you for your reporting. Thanks for having me to Utah now where the divisions in the GOP over former president Trump are exemplified by the state's two Republican senators. I voted for my clean How he supported our president, and he also works under the Constitution. It's these flip flopping all around the Constitution that I can't stand. Henry, who's sixties, says Romney supports impeachment to boost his own profile and goes against the wishes of voters in heavily Republican Utah. Its thoughts was on Lee for his Glorification and not for the people of Utah. Still, Romney remains relatively popular here. Despite that vote, Romney defended his decision, saying he made a promise before God to apply impartial justice at the trial. That plays well here. Utah is a very religious place. 60% of the population, including Romney are Mormon. Romney supporters like Shelly Clough say they appreciate how he used his faith to guide him. But critics like 74 year old Mary Beth Burton, say he used religion as a shield for a selfish vote. Martin says Romney's words during this impeachment or even more insulting to their shared religion. Most of us believe at least in the Bible. Where it says we don't judge. His statement is what we saw. Automatically. Indicates the president did initiate an insurrection. This is what he said before any evidence has been presented. So he's already just one judgment. Romney won't face very soon is that of the voters? He isn't up for re election until 2024 For NPR News. "Had I still some respect for, but I believe that she kind of goes the way of who was in power. She was much more complimentary about Trump. The last four or five times that we had around the show because he was president of states. Now she has kind of flipped the flip the script on to Biden because now he isn't but I think she kind of goes with the way that they think her. I think her loyalty kind of goes with the way of the power. I don't think that that's my new assessment after after that, last time, I think she's going with the news that took place last week in the way Donald Trump handled it. That's just my opinion. I just really think she's very good at what I had. One more question I didn't get asked was gonna be about Cavanaugh in the 3000 feminists. That storm the capital and banged on the Supreme Court doors to protest Brett Kavanaugh didn't get asked for the record for the record. I'm glad you didn't ask that question. Okay, So let's move on now, Um Number we talked about Kalle Rittenhouse. If you don't know who call Rittenhouse is. He's the man who's facing or, you know, facing homicide charges in the death of two men during protests last August, according to emotion that was followed by the Kenosha County district attorney's office. It was during a black lives matter. Protests out there and There are some not all but there are some people on the right. That have painted this kid out to be some sort of hero. She's not and I went on the air, and I said, Listen, we'll see how things play out. He should've never been there. He was breaking the law to begin there with the gun to begin with, and the mother is extremely ignorant as well. And now he's facing some very, very serious legal troubles. Now he was able to reach bond. And he's able to be out there in public, but I've said it from the beginning. Even if one of the shootings wasn't self defense. He should've never been there to begin with. He should've never been holding that gun there, and it was a very dangerous situation room to be there to begin with. So anyway, that being said, we're not here to debate what took they were self defense. The first one he was chasing. I said, I don't wanna get second when the guy walked up to him had a gun in his right hand. Okay, So, as I said, he's facing very serious charges. You're entitled your opinions, JD. If you think you see here. Oh, that's fine. Well, that is a hero. Okay, well, he should have been there to begin with. And you know, that's not up for debate. He broked along with the gun that he was carrying. That's not up for debate. What his mother did was irresponsible. That's not up for what is up for debate is the fact that Wisconsin Governor Tony Evers did not give The Kenosha Police Department. The National Guard support that they requested, and that's what Rittenhouse protected business. OK, so that's that they had He done that a coward, as would have been there. All right. So let me just explain to you about the kid who you've defended over the course of the last several months. Let me give you a little bit of character traits that this kid and what he's been up to the last couple days because I don't think you're aware, but you've defended him as many of them. I've seen a lot of people. On Social. I haven't actually seen him as I haven't looked into, but I've seen active on social media. I guess he's wearing a T shirt. He's going to a bar. Give me a chance. He's doing things that people do when they get out of jail. No, he's not. You have no idea what you're saying. And I know it looks like okay, well. Let me explain you What? Actually, That's not what it looked like to you because I actually researched the story and I'm reading actual facts of what took place He's seen in a bar. With members of the proud boys This happened a few days ago. Wearing a T shirt that says, I'm effing free. And here's where it gets really interesting and disgusting. Okay. First of all, he's hanging out with the proud boys. That's a wonderful group of people that he was hanging out with. And then he's taking several pictures with people. In the bar while drinking and and using the white supremacy white power symbol that so many in the proud boys have used for so long. Now. After you were seen at a black lives matter protest. Two people are dead. And you're you have homicide charges. How stupid can you be? You used the white power sign in pictures, By the way, Which one of them I posted on social media. I'm not making this stuff up. And have contact With any known militia members. Like the proud boys. This 17 year old now is out on $2 million bail. And this is going to affect him. I promise you that it already has. Because now the Kenosha County Circuit Court. Is going to be modifying the bond conditions of Kyle Rittenhouse. He's out on $2 million bail. I find it very interesting that he's seen in a black lives matter. Protest with a gun. And now all of a sudden he's hanging out with the proud boys and using white power cells in pictures. Proud boys. The leader of the proud boys is Afro Cuban. If they are a hate group, their hate group against anti from they've been open about that. Okay, So they like calling, Okay? Yeah, there's sure there's Several and why they used my past there several black members in the proud boys chapter of Las Vegas, So you're defending the problem. I'm not defending the problems. Understand? They're not anti black. So why would they be using the white hours and if they are a hate group their hate group again towards Antifa, So they're they're only hatred towards I've seen Joe Bright. Biden used that side on multiple occasions. I don't know what you're talking about. He's done. He's done this on multiple occasions. The racist he uses the white power by that logic. Anyone who uses that okay, sign is a racist, right. Okay, so I'm sure President elect has used that same old self so defend. Probably can't go one way and not go the other way. Please show me a picture. Where Joe Biden he's using a white supremacist sign of love. I'd love to see that I have no idea what you're talking about. Here is what I do know. Proud boys were not up just for an teeth. In fact, there are proud boys that have committed acts against African Americans. Actually violent acts on there, hanging out with Kyle Rittenhouse, who's Who's accused of murder of killing two people. The Black lives matter Protests. He's out on $2 million bond, facing very serious charges, and he's using the white power white supremacy sign with members of the proud boys and make no mistake about it. It was not The OK sign. Okay, we know as human beings. What is the okay sign first or what is a white supremacist trying to right? We know we know the difference. So you think Joe Biden in that picture is using the white supremacist horses? Okay, Jamie, So we're gonna use it equivalent if he's doing the okay. So they were in the white shirt, missus. I'm sure that the problem is sure that the proud boys if that's our work, sure that if I could please finish my sons. I'm sure that the proud boys In Carl Rittenhouse. We're using the exact same gesture that Joe Biden was using. JD. I believe you, 100% that makes complete sense to me. But anyway, here's what we do know for sure. This young buffoon, which is called Rittenhouse. I think he's a murderer. Quite frankly, who is facing very serious murder homicide charges is now in a lot of trouble for what he did in that bar, and what we know is the prosecutors are going to use that against him. And remember what I said about his mother, who was a dumb bell. For dropping off her son in that very volatile, dangerous situation with a gun to begin with. How does his parents knowing that he's out on $2 million bond? How do they even allow him to be hanging out with the proud boys and taking these types of pictures and wearing the shirt that he was wearing? So I'm gonna open up the phone lines to you, but I'll tell you what, man. Think I was right when I talked about Rittenhouse many months ago, so there's a lot of people on hold. I want to try to get to all of you if we can try to stand topic. I know we just did an interview with Debra Saunders, and we touched a lot of topics there as well. But I also want to get your opinions on Cal Rittenhouse. Do you think it's appropriate for somebody that's not on $2 million bail? That is facing very serious homicide. "Have found the tide of Don Mike Huckabee on Fox calling for Austin Mayor Steve Ballard to resign. That's pretty big. Right? I think Collectively, a lot of people even Democrat socialist want this mayor gone. I mean, I saw the tweets overnight from the D s. A. That's the Democrats Socialist Party of Austin. They endorsed. Correct. It's our mayor Steve Adler. I don't know how I mean, whatever I say that phrase. I kind of expect people to get mad and upset, but they never do the fact that we have a Democrat Socialist Party of Austin. It doesn't bother anybody. It's extraordinary. It does tend to get out of my skin Does it had just does it? Yeah, heck of a lot doesn't mean does it? Really? Of course. OK, course it does. Because they've taken over your city. I know. No. I see that very public. It makes you mad enough. Listen, I'm not gonna live every day miserable, but believe it does. Believe me. It does make me mad. I'm really not welcome here anymore. What point does longtime Austinites long time Austin business owners actually step up and say something about it? Well, I have been Right here on the microphone. I've been screaming about it, but it's for a bit, But as far as collectively Yeah, I know. And I think that's starting that happen. I do. I don't think I'm gonna happen overnight. I don't think it's starting to happen. I really don't. I don't think people are mad enough yet. I really don't. Yeah, I really don't because there's a real good possibility. These incumbents are gonna win a district six and district 10. Well, I'm wondering if the D s a is is you said they're very upset with the mayor. Well, I wonder if they want to see cause are in there. Probably so maybe, you know, probably. So they want him out of your concern. Yeah. Great star tweeted out something that was actually took a screenshot of it and put it on the tide of Don show Facebook page. Did you see this last night? Let me find it. It was a pretty lengthy tweet that he sent out and even made a reference to, uh Ronald Reagan. It's pretty interesting. Let me find it here. It's on the tide of Don Shall Facebook page where he was talking about some vouchers and things like that, that they've been able to secure and we'll jump in here at 51283605 90 toll Free eight here, he says. Here it is. Greg Austin City Council just voted for the first ever local housing vouchers. This was yesterday. City Council meeting. Cultures will help 170 folks escape homelessness obtained housing and services in my district, and if we want to reduce homelessness, we must rebuild what was ripped apart in the Reagan era. Oh, was that 35 years ago? All right, 30 something years ago. 30 almost 40 years ago. That's what we're looking Something like that. Absolutely absolutely. Before. Greg Co star was born. I think so. What is he talking about? I have no idea. I have no idea what? What? Why she wanted to drag that up. What is support for it? What? Yeah. What is the point? Yeah, It's pretty interesting. Steve is calling on the tide of Don show this morning point. Stay. What do you What's going on My friend. Hey, how y'all doing this morning? I want to go back to what you were saying earlier, Todd when you're talking about Phone calls and texts. And you were state to don, that you don't want you think phone calls. Interrupt What? You're interrupt what you're doing in the attacks doesn't And you're under no obligation at all The answer a phone just because it rings. I know that it's no day without text, and that's why this is a silly argument. Silly argument coming. It's not a silly argument at all. That we live our life. I mean, it's it's how we relate to each other or don't relate to each other like it's an important conversation. Really. Okay, I do. Okay? Yeah, that it, Steve. That's it. You don't have pick up fun. Appreciate you don't help pick up. Thanks, man. Yeah, That's why none of us pick up the phone was still getting updates on Kyle, right in house 17 year old teenager that charged with fatally shooting two protesters in Kenosha. They also had weapons were trying to kill him by the way in Wisconsin, back in August. He's now been ordered to stand trial lawyers for right now, sir, arguing that he acted in self defense, but the judge said that will be determined in a trial. Writing house was freed on a $2 million bond last month, and he's due in court on January the fifth and so you know, some are asking the question should write in house stand trial as an adult. And Yeah, so there you go. Jump in here at 51283605, depending on which news outlet you go to you get a different spin or a different tone on this story. That's shocking. I got my opinion based on the video evidence of what I've seen watching that night. He has 17 years old charge, killing two people in Kenosha on after the shooting death of Jacob Blake will stand trial on charges of felony homicide and other crimes, according to the court commissioners. What I saw was someone that was being physically assaulted and whose whose life was being threatened clearly, and he was going to suffer physical harm, if not death, and he chose to protect himself. The two people that were shot and killed. They also had guns themselves. But it was very clear to me. Can we just chalk this up? As three people that had guns went to argue and fight with each other? That's it. Just never gonna have a good, good ending. Either way, I mean, But but but both sides have different agendas. Yeah, I was protecting a business and offering first aid to people. These other two people were trying to burn and destroy the city with weapons. That's right. So there's there is a different perspective on both sides of the story. My hunch is that it was not his goal to go down there and shoot and kill somebody. That was not. We know It was a possibility, though he knew is a possibility, because that's why you take a gun to that kind of thing. You may need it. And I think also, though, if you do take a gun to something like that, you better be ready for anything. Uh, you got you're gonna get yourself in a situation where the ending might not be good, but I think we have to look at just the incident itself. And it was clearly clearly given what was going on what he was facing. It was self defense. Well during the preliminary hearing in Kenosha County Circuit courts, which was held video via video Link Commissioner Loran Keating rule that there was enough evidence to send right in house to try alone. The August 25th killings of Joseph Rosenbaum, 36 Anthony Huber, each 26. Right now. It's also faces charges of possession of a dangerous weapon while under the age of 18 all weapons or dangerous in a family. An attempted homicide for injuring a third man shot his bicep. Because that guy was trying to attack him. Well, lawyers for writing house argue the teen who was has been praised by many people, eyes viewed being very sympathetic towards him, You know, acted in self defense when he opened fire. But Keating said those arguments were issues of the trial, not a preliminary hearing. Yeah, the team's lawyers also ask eating two dismissed two charges, including possession of a dangerous weapon, but the commissioner's declined, saying that was also an issue for the trial. Writing house of any of Illinois released on a $2 million bond last month and money mostly raised by, you know, Legal Defense fund if you will, so there you go..
