Last week is on the way. It's called the american rescue plan. How big is it. Thur americans the plan itself is huge in scale and scope. it's one point nine trillion dollars. Which even. I sort of have to take a moment realize how massive this bill is. It's being billed as one of the biggest pieces of legislation. Congress passed in possibly generation. Many of the big measures are temporary. They're set to last for a year or just for the next few months but there are pushes already by democrats to make some of these provisions permanent that would mean pretty significant changes in the american social safety net. Can you give me some examples of ice measures. The moose well known piece of this bill is the fourteen hundred dollar checks to individuals. So if you're someone who makes below seventy five thousand dollars a year or you're a couple who makes less than one hundred and fifty thousand dollars a year you will receive these fourteen hundred dollar checks that will come in addition to the other provisions which provide housing assistance assistance for food assistance for healthcare. Then there's this other big precision. It's called the child tax credit it's existed for a while now but this bill dramatically expands the credit and it also expanded eligibility for it so that more. Low income families qualify. What's novel is at. Its affectively of form of guaranteed income. The payments will be made monthly to these families rather than qualifying only for the credit during tax season. And that's a huge change both financially and philosophically in the way americans dole-outs welfare in this country. And so this is a provision that some policy experts have forecast would cut child poverty in half in america especially for black families and latino families. So this could have a huge huge impact on low income americans who've been especially hurt by the job losses. This is the one piece that democrats believe once it's been enacted through this legislation that they will have some success making permanent and indeed if they do it would completely restructure how we look at child welfare this country and as you said the title bell is in the trillions and when we start talking in trillions he basically leaves me but i found it something like a tenth of gdp so as you say huge how significant is for biden. And for setting out. Biden's agenda anyway. You look at it. It's a big political victory for joe biden. He came in saying he was going to do this. Part of his victory is certainly attributable to donald trump's mismanagement of the coronavirus pandemic and this was his promise not to mention a few months later when the senate was still in the balance to georgia senate candidates both democrats promised georgia voters that they would be sending them two thousand dollar checks if they win their races in georgia and democrats control the senate so this is seen as making good on that. Promise the the difference. The two thousand dollar checks are now fourteen hundred dollars but the democrats make the case that they said six hundred dollar checks to americans in december and so this brings up the total to two thousand. Yeah politicians always find ways to add up the numbers. Now as you said and the democrats have a slim majority in the house and a wafer thin majority in the senate because of those georgia senators a majority of one with comma harris. How difficult was this to pass. This was a big political. Lift for joe biden. And what's interesting is that it was so difficult given how popular the legislation was with the american people. Cbs news poll. Seventy five percent of americans say they support the measure including almost half of republicans in most well-known provisions of the bill pulled even higher than the entire bill itself and even then joe biden wasn't able to bring along any republicans you know. He came into office. One of his big promises was that he would be able to work across the aisle and bridge the gaps. They called this the most progressive piece of legislation in history. That absolutely did not happen for those who watching progressive means socialism. And then you have with his razor thin margins. You have a lot of factions within the democratic party. That were jostling for control. And he really had to contend with some objections from moderate democrats particularly in the senate where one senator can blow up the entire negotiation. He was able to do this this time. But i think this sets up a lot of questions about what comes

"Yesterday we told you That the parliamentarian head ruled that the dollar minimum wage does not pass muster for reconciliation and must be taken out of a covid relief. Bill now We clarified unlike most of the media. That the parliamentary and actually has no power whatsoever It is just give an advisory opinion is not an actual ruling. The person who does the ruling is actually the presiding chair of the senate was normally is the vice president so comma. Harris is going to have a huge part in this conversation now wants the parliamentarian gave her so called ruling. All the democrats immediately gave up on fifteen dollars minimum wage as things stand now they are going to be taking that provision is going to be taken out of the bill and we will not get fifteen dollar minimum wage for at least four years now. There is a way to prevent it. There are four steps here. I'm going to walk through all four steps and you will see that if we do this. It's actually very doable. To keep it in the bill and to actually win on this issue but it requires courage from progressives and then Requires us to put public pressure on some of our allies and then eventually to the biden administration and sure so step one is unfortunately right now the most important step and where we're going to have to call out bernie sanders bernie sanders. Is the chair of the budget committee. The chair of the budget committee the signs. What is in the kobe. Relief bill bernie sanders. Current plan is to take fifteen dollars minimum wage out of the covid relief. Bill that is a terrible idea. He should not do that. If corporate democrats are going to vote against let them vote against it but doing it on their behalf. i cannot overstate. What a bad idea that is in that scenario that right now is what is going to happen unless we change it together bernie would kill the fifteen dollar minimum wage on behalf of joe manchin and joe by. He should not do that. So that's this is step one. I'm going to get to the other steps in a second guys. I need you to immediately participate. We've got a campaign we've got a partition and and we've got hashtags. We must do all of the above and the campaign is called. Don't kill it bernie because yes step one indisputably. It is a matter of fact. Is that the budget chair decides if it goes in the bill that is bernie sanders. That was the whole point of him being budget share. If he's going to take out. Fifteen dollar minimum wage will take out every provision the joe manchin and joe biden are opposed to that means we will get no progressive priorities past none. The fifteen dollars. Minimum wage was literally the bare minimum. It was the first ask of progressives so bernie. You've got to keep it in the bill because if he does not keep it in the bill. It's over that hashtag fight for fifteen. There is no more fight. That means progressive surrender. I'm being honest with you. Guys our job is to do the news. Those are the facts of how this process works so go to the petition. All right and here. Let's put it up for you guys and it's simply called. Don't kill it bernie. And what is saying is we don. T have a clear message. Don't take it out of the bill. It's one hundred percent your call on whether you keep it in the bill or take it out of the bill. Do not do that because if you take it out of the bill and you kill it then we will not be able to get back to it for four long years and there's no reason for it so and and if you're tweeting about this at all please use hashtag. Don't kill it bernie. Because we must get senator sanders to turn around. There are no other steps if he takes it out of the bill now if he keeps it in the bill now let me walk you through how we could actually win on this step two would be since it's in the bill. The presiding officer of the senate would have to rule to take it out of the bill. So kamala harris who in her role as the vp would normally be the presiding officer. The senate would have to actively vote with republicans or side with republicans the and the parliamentarian for what it's worth again. The parliamentarian has no vote. No power just gave a rando opinion on what they think they should do it. The republicans would never care about it. It it has no force of law at all. in fact it's being used as an excuse by kamla harris show schumer and the others to kill a provision. They were never in favor of so. Then we have to put pressure on comma harris to not side with mitch mcconnell. Can we do that. Yes yes we can definitely do that. If chuck schumer wants to protect com la- harris and he puts another senator in as the presiding officer. Will they will put pressure on chuck schumer. Would you like to continue to be the senator from new york. There are a lot of progressives in new york very very strong. Progressives in new york that could easily take that seat not easily but that could certainly have a shot at taking that seat. They would need sixty votes to overrule the chair. So that means they need to break our filibuster to overrule the ruling of the chair. They're not gonna get sixty votes. We win okay. So what are they going to. Now turn around just to make sure you don't get higher wages and they're gonna vote to kill the filibuster in this regard. I mean you would be the most spectacularly hypocritical thing they have ever done and they've done some pretty hypocritical fix so you put them in an near impossible situation and it is incredibly doable but step one is do not surrender. Guys one last thing before we go to john and jordan. There's ninety two billion dollars online. This would be a pay raise for about thirty million americans and to the tune of ninety two billion dollars every single year the reason why biden mansion and the republicans don't want to do it is because the chamber of commerce is dead set against it they are those business interests are giant donors to both the republican party and the democratic party. And those donors are saying. I wanna keep the ninety two billion dollars. I want to give it to my workers. I want to keep their wages incredibly low now go do my bidding. And they do now. "With all the big crises facing america. It's surprising to privacy. So high on president biden's agenda but in his first week in office he already appointed someone to negotiate with the european union on how personal information is moved between europe and the us last summer that you said the way data was being sent to. The us was insecure. In august ireland's data regulators told facebook. Stop transferring its citizens data out of europe. The issue is with the irish high court now. In december facebook argued that court that to stop data transfers would have quote devastating and irreversible consequences for its business and this rule would obviously impact all kinds of commercial data and companies. It's also obviously a big deal for the new administration. Jessica a partner with the law firm loeb and loeb prior to twenty twenty. Let's say we had something called the privacy shield in effect and that helped us transfer data from the eu to the us and then over the summer. July twenty twenty. That was struck down. It was found that because of some of the surveillance operations of the us certain executive orders and laws we have in place that the data of eu individuals when it comes here essentially is it held to the same privacy standards as they are in the eu and the privacy. Shield wasn't adequate enough to protect it so that left a lot of us in the privacy community scrambling toward the second half of the year trying to figure out. How do we keep data flowing across the border right and that was a big deal to american tech companies right. I mean they were saying okay. Well look if we can't share data back and forth. We're not going to be able to operate in some of these countries right right. Exactly and so yeah. We've been looking for two things. So one is standard contractual clauses of companies have kind of defaulted to that but even those shaky ground and are being revised so. I think everyone was hoping that we'd find some solution. Some post privacy shield path forward with the eu. But that was difficult. I think what the previous administration will and so now we actually have someone in this role early. What does that signal to the rest of the world about the position. The us might take on privacy. I mean i think it signals a couple of things. I on privacy. I think it it signals that the biden administration understands the importance and the significance of the issue. And the need to kind of have these kind of crossborder cooperation In place and so. I think having someone christopher hoffa was appointed to this position really signals at. They're going to take the seriously and then take the steps that might be needed on the side of the us to make the comfortable with these data transfers. More broadly what sort of issues around. Privacy and surveillance do we expect. The biden administration tackle. Is there a chance for federal privacy legislation at long last. I've said that. I have moved from just mostly pessimistic to now moderately optimistic and that was really push forward by what happened in georgia so now with one party control all houses i think the path forward seems a little bit more clear and you know to keep in mind that biden and then we also have comma harris. Who formerly was attorney. General in california where she pushed forward a lot of significant privacy legislation. That's still impacts a lot of us today. So you know between the two of them i think this is an administration that has a background and understanding of the importance of privacy. And you know we have to deal with the pandemic. I but i anticipate privacy being a priority for them. Yeah i mean as a you mentioned by president. Kamala harris as a presidential candidate. She said that her first priority with tech companies is to ensure that consumer privacy remains uncompromised. Like is it. Is this an administration. You think that will try to find a better line between a business friendly approach and a consumer friendly approach whereas now it seems to be all business i do i do. I think i think that'd be really sensitive to the consumer issues. And if we think about it. When i look at what's going on in terms of trying to regulate privacy and then more broadly the tech companies it it feels like regulators are trying to chase a ball down a hill. You know it's just like oh. Do we do antitrust. Do we do section to thirty. Can we get some kind of federal privacy. And i think they'll try to take a pragmatic approach that will bridge the gap between the business and the consumer advocates. And from where. I said i think they're really sticking issues with federal privacy. That are left. It's will there be a private right of action meaning well individual consumers be able to sue companies directly. And then we'll they'll be preemption. Meaning that will this federal bill preempt any state laws which is really what business wants because business doesn't want to have to comply with fifty different state privacy laws on top federal privacy. So i think if we can get a path forward on those to all the other points of privacy laws are consumers get writes a lot of companies are already complying with that because of gdp pr see cpa. "It's official donald. Trump is no longer the president of the united states. As i speak. Joe biden and kamala harris are being inaugurated are being sworn in to their positions and we are about to enter a very new era of national politics of federal politics. I don't expect that it will be easy. In any way we have over-simplified our problems in the sense that we have blamed many of our deep systemic problems that predated trump. We have blamed many of those things on him including police. Brutality mass incarceration when those things were fully entrenched before he ever took office. But i want to say. And i want to talk about this this one thing today. I wanna say the one reason why. I'm going to have a serious degree of grace and patients with both joe biden and kamala harris. That i think a year ago. I probably would not have offered. Had the two of them been sworn in but a lot has happened over the past year. Let me tell you why. I'm going to have grace as they began this extremely difficult journey. Let me unpack and explain it. This is shaun king. You're listening to the breakdown. The breakdown the breakdown. If you've ever listened to this podcast or if you follow me on social media you've ever seen or heard me on the campaign trail for bernie sanders you know that. I've been a huge huge critic of joe biden and in particular. I've been a huge critic of his is policies and history and and kind of problematic past on issues of mass incarceration the war on drugs and policing and win this presidential campaign particularly we go all the way back almost two years now on the democratic primaries i started there was no coronavirus pandemic. There had been no attack on the american capital and the four hundred thousand plus people who've now died over the past nine months they were they were all alive and what has happened to our nation over the past year truly makes it arguably one of the most difficult years in modern american history of certainly over the past few generations at the very least. It's just been an unspeakably difficult year. And the truth. Is that all of the things that made twenty twenty so hard as we saw just continued into twenty twenty one now with trump out of office and with him off of twitter and i. That's no small thing. I i wasn't. I was on break from the podcast when he was booted from twitter and didn't get really didn't get a chance to really unpack it but having him off of twitter is damn near as big as having him out of the white house. Twitter was his superpower and with him no longer their misinformation and hate and so much other things so many other things just plummeted all over social media particularly on twitter. He he we now. Fully understand was the epicenter of hate and misinformation on that platform. And when you remove him all of a sudden so many other negative metrics plummeted as well now hate and racism and bigotry. Don't disappear when you remove him from twitter. But having trump out of office without the power of that position about the power to appoint judges and supreme court justices and cabinet members and white house staffers in without the power of executive actions without him and his incompetent team overseeing the a horrible response to the coronavirus pandemic a competent team can now be put in place and so a lot of the things that made twenty twenty difficult. Some of those things continue into twenty twenty one though with trump out of office his administration out of office and with him off of twitter. I think there are some things that will get better with that sale. Joe biden comma. Harris are literally about to begin. What i think will be the most difficult presidency in our lifetime

Donald trump made inroads among some communities within the latino community. Both things can be true. They didn't weighted equally in the way that we talked about it. But i also think most of the national media is based on the east coast. So there's a tendency to see things through that lens. Miami comes in first. Miami is wear people tend to think of a power center of latinos. Being latinos in miami are much more powerful than latinos elsewhere. But then when you step back is your sanely. The majority of latino voters are actually not for out there. They're all over the southwest. they're also in the in. The rust belt made a difference not only in pennsylvania. I think also maybe even in wisconsin and we tend to forget about those places where we tend to gloss over them really easily and i do think a lot of that has to do based on where the national media is based. Let's talk about what did happen in arizona because that story provides such a narrative counterweight to what we saw happening in florida. Especially because it was a story ten years in the making you have to go back to senate bill ten seventy which was known as this. Show me your papers law and came at the same time period. Sheriff joe arpaio Huge anti immigrant sentiment within the government of arizona and all these young people some undocumented themselves some not took to the streets they did tons of protests and they started to organize there. The florida story matters not for the national narrative this election but the fact that they were so off in what they thought was going to happen in florida from the democratic side that they lost so big to trump. So you understand what we're talking about. Then there is this from the spectator. Why it should matter to women that Camilla slept her way up. It's no secret But public knowledge that Kamala Harris slept her way up into California political life by being a very public escort and mattress for California Democrat kingmaker Willie Brown. Now some people run to start mattress, didn't he mean mistress? No. I think they meant mattress here that you might be asking. Why are we playing this? We're playing this because millions of people listen to Rush Limbaugh. And similar remarks were amplified by the president's own son. And we're also playing this because for many women in politics and for many people of color and political life, this type of treatment is not new. Kamala Harris, who is both a woman and a person of color. These types of personal attacks will most likely continue between now and November election and may, unfortunately, get worse. So we wanted to dig deeper into the history of women in political life and how they are perceived and treated and why it matters. And we also wanted to speak with a woman of color currently in office. So we've called Anthea Butler, who teaches Africana studies and religious studies at the University of Pennsylvania, and she studied the experiences of women of color and political life. And she wrote about those recently, professor. But thanks so much for joining us. Thank you, And we're also joined by Jolene Ivey, who's currently a council member in Prince George's County, Maryland. She previously served as a state representative in Maryland and was a candidate for Lieutenant governor. Angeline Ivy. Welcome to you as well. Thanks. Michelle's good to be here. So I was going to start with you, Jolene, because one of the reasons we called you is that you are also you're also identify as black like comma Harris. You are bi racial like Kamala Harris, and you've also been in public life for some time, and I just wanted to ask when you heard those remarks and similar remarks. What was your reaction? That man just really made me angry. You know what he's making it a big deal that she dated Willie Brown Ah, 100 years ago when he had been separated from his wife for over a decade at that time. And then he gave her some very unsexy appointments to a couple of boards that did not make her career. Anthea Butler, You've been writing about this. What have you noticed? In the last two weeks since comma Harris was announced as the vice presidential nominee on the Democratic ticket? I've noticed a couple of things. Michelle Rush Limbaugh. Statements about Kamala are just indicative of how black women you know, political or not are seeing a lot of times in this country. And that has the history and in slavery and racism in the kinds of ways in which at the turn of the 19th into the 20th century that black one more talked about one of the ways was to say a sapphire, a beautiful woman, high, strong difficulty, all of those things, so that was one. The other one I think is a Jessica Trove, which is the biblical trump that she's a woman who controls men and she seductive and she does all these other kinds of, you know really bad things right? And so I think the ways in which Rush Limbaugh and others who are conservatives have used this to try to put it a sense of false morality up against her. So we need to really start to consider this election cycle that hopefully come on, can make a change in all of this. And that will start to think about her simply as more than just a pretty face. Where President Obama kind of put her. I'm going to ask you about that. And I want to talk about depictions of comma Harris that earth That might be seen as in good fun, and that includes Maya Rudolph's impression on Saturday night Live or she portrays Kamala Harris is this kind of sexy wine drinking seductress and a bit of a bubblehead, an attention seeking bubblehead. And, of course, you know, President Obama, as you alluded, famously called her the best looking attorney general in the country when she was serving in that role in California many years ago. He apologized subsequently because he was helped to understand that that was kind of diminishing of her authority and expertise and professionalism. What do you think? Professor Butler? It's amazing, actually that we're talking about, you know, a woman of South Asian and black dissent being beautiful because so many times we're not set that were beautiful. White beauty is the standard of beauty. Right. And so there's a certain kind of aesthetic that I'm hopeful that gets broken with this particular electoral cycle. First of all, but secondarily, I think that in some ways The intellect and accomplishments of Camilla Harris can be used by her in a really interesting way, because sometimes when you're pretty you can say things that Other people can't get away with. That's interesting because jelly neither you spoke about that. You said that being attractive is generally an asset in in public life because people People like you were seen as attractive. Is there a corollary to that? Where people somehow Sometimes he was less substantive. It's hard. I mean, on the one hand you do have the benefit of people notice you, and they tend to be drawn to you. On the other hand, there are some women who are going to be haters and some men who were going to be disrespectful like Rush Limbaugh, so they kind of put you in a tough place. I mean, Hillary was criticised for not being pretty enough. And Camilla has been criticized for being too pretty. What kind of sense does any of this make and what difference does any of it make when it comes to the what The job requirements are you know another epithet that's been directed at Senator Harris is that she's a phony. I mean, she's been accused or described in conservative media and by some conservative African Americans as phony. But I do wonder whether that phony label isn't apartment to raise doubts about the authenticity of her heritage and her true connection to the sort of the traditional story of African Americans. Professor. But what do you think about that? Well, I think it's it's on different levels. One level is is that they have to undercut her accomplishments. So if you call her a phony, then that means these things that she got are not real. She got them because she played a certain card. The race card, right? Second place about the funny thing is the nervousness. The demographics of this country is changing are changing. And the third thing is, is that this place into a birtherism argument, right? That's the one of the things that happened with that Newsweek article that.

Therefore, I'm just going to declare that all dreamers are here legally, and I'm gonna move forward as though everyone was fine with that. Because what the hell I'm gonna do what I wanna do. And then Donald Trump to the same exact thing with regard to appropriating money for his wall. He argued with congress government shutdown over it. He did not get his money. And now he says he's going to declare national emergency and shift the money from one area to another area. Well, we could have done that right away. Supposedly, according to Trump if you had the inherent authority to do. So he didn't really think he had the authority to do. So he expanded executive authority to do that. And as we said, if you're comma Harris or any other democrat, you feel there are no limits to executive power. The legislature has done has done a terrible terrible job of maintaining its own control of the purse strings of the power in America. Government. The way government is supposed to work is congress says no no is the answer. Government does not work like my five year old with me and my wife where you go to one. And you ask the question if they say, no, you go to the other and ask the question. They also say no legislation originates in congress. It originates in the legislature. That is their job is to legislated is filled with legislators, but according to Harris when she's president she's going to give congress one hundred days to act, and then she's just going to declare herself dictator and start declaring policy. Is that victim shaming? If you say that your daughter or is that actually being a good parent. Listen to this exchange now is said when having a conversation with Senator Ernst you said, quote, women's should take certain steps to avoid becoming a victim. What steps do you have in mind that women should take to avoid becoming a victim of sexual assault. Senator it's it's just sort of the common sense idea about for instance, excessive drinking, you know, that was advice that was given to me by my mother it. So that's one step. You believe women should take to avoid becoming a victim of it is it is just a way to make it less likely. It's not to blame the victim. Rape, and sexual assault are horrible crimes. But we're talking about. What can you do to keep yourself safe?
