Justice Department Hits Google With Antitrust Lawsuit
"Few weeks ago we were all on pins and needles expecting a lawsuit from the US federal government against Google and on Tuesday after a fourteen month. Long investigation that lawsuit arrived the US Department. Of Justice and eleven states have filed suit against Google arguing that the company has used unfair practices to preserve its search and search advertising monopoly. Here to break all the details down with me, records Peter Kafka Hey Peter hit Teddy. So how a deal is this is a very big deal. This is the most consequential antitrust action against a big Tech Company that we've seen since nineteen ninety, eight I don't know what you are doing in one thousand, nine, hundred, eight I was actually still falling technology news back. Then that's when that's when the US government sued. And we've gone twenty plus years, and now we've got the government's suing Google and we knew that this was coming for a while right and we talked about on the show with Shrink Afari a few weeks ago we didn't have specifics we didn't exactly know. What the lawsuit was going to allege that Google's done you've spent the morning digging in talking to a bunch of parties reading the suit tell me what the main argument, the US federal government is making. So I'm going to caveat this. This is the beginning of a process that's going to take years, and so the initial complaint from from the US government. Is the initial complaint it is going to change over time through discovery. Okay. people are going to add to this. It's going to be a living document as we say, but the big picture here is is this to start with the US government saying Google has an illegal monopoly and search that it maintains it focuses mostly on the idea of Google paying. Mobile, phone manufacturers like apple like Samsung fees, either directly or indirectly to give it pole position for its for search engine which then makes it search engine dominant, and then it gives it a an unfair advantage in search ads. So it starting with search and adding on search ads in it is mostly focused on the idea of Google spending billions of dollars a year to give itself, prime? Placement. Your phone and yeah and to the average person of sitting here thinking what does this case kind of boil down to it's basically that Not just that Google is too big right but that Google has unfairly made itself. So essential in all of our lives. That's the overall thrust of all the antitrust and all the tech reform conversations we're having, which is all of these tech companies, Google and facebook, and Amazon, and apple are have gotten so big and they're not really restrained by government in any way, and this has been going on for years and decades and someone should should do something about it, and this is really the first. Concrete who've we've seen from the government in sort of the modern Internet era trying to rein in these big tech companies. All right. So I'm guessing Google to not throw them a big hug. What's their response to this Google response is, Hey, we have an awesome search engine. What's your problem with this by the way it's free so we're not harming any consumers with their awesome Search engine by the way when we spend billions of dollars and give that money to apple and Samsung or do people who use our android software for free, they get to deliver awesome phones to you for less money than they would have normally because we're helping to subsidize that what's your problem by the way? The idea of giving people money to get better placement is not. A new idea it happens all the time. When you go to your grocery store, your target or Walmart people have paid to have their products on the shelf or on an end cap they pay different prices depending on where they get placed. This is not a new idea, and by the way we've done all this in the open for years. Yeah. You get the sense that Google. Sees this as an existential threat at all I mean. I. Wonder to what extent This is a financial risk for Google. Stock Market said no big deal Google share prices trading higher than it was Google has faced these kinds of accusations and lawsuits in Europe for years there is definitely a possibility the the US wins a lawsuit and there are structural a reform is made in. Google. was forced to do something drastic like split it's android business from its search business. We're not sure as possible. This could be a way to break it up. Yeah. It's it is possible. There is a wedge here that you could use to break it up. There's also the possibility that. Spends years fighting the DOJ and it gets it takes its eye on the ball and or it doesn't make moves that it would want to make because it's in a lawsuit and it has one upset the government anymore, and this is what people at Microsoft said happened at Microsoft when they were fighting the US government twenty years ago. Microsoft ended up winning that because sort of there was going to break up settlement for for Microsoft and ended up not happening in Microsoft kind of got away with punishment except that Microsoft ended up missing out entirely on the mobile business and there are Microsoft people who say we did that because we we took our eye off the ball and There's an argument that just bringing the lawsuit and just occupying Google. Is Sort of a punishment in and of itself Peter you mentioned your story which talked about the fact that there's a lot of people on both the left and the right who've been calling to break up big tech. He's going after Google. Specifically, you made a great point which is that you had this sort of unlikely alliance between the trump justice department, which is bringing this lawsuit and folks on the Left like Elizabeth Warren who are. Glad. That Google is getting some skirting for the first time in a while. They're very glad and to be clear you know it's not just that it's a left right thing. I mean, the Lisbeth Warren Detests Bill. Burr she calls him a corrupt trump crony who should resign. And then literally, in the next sentence in a statement, they gave to me said and he should go ahead and pursue this lawsuit. And you know it's as basic as as anime enemy is my friend. The slightly more sophisticated argument is we can't wait to work with the DOJ that we love. We need to work with the DOJ we have. We've been waiting to restrain google for a decade or more, and we can't wait on this. It's gotta go. I want to ask about the timing of this. there. have been reports that this was sort of sped out right that there's an election coming up once every possible accomplishment that he can talk about to happen before Election Day. Do you see any evidence that this was rushed at all or what do you make of kind of reporting that? This is politically motivated to at least begin to unfold before Election Day there was a report from the New York Times in particular said. There's dissension within the DOJ career staff wanted to go slower and that bar was moving to make this go faster and he wanted to happen this fall. The intimation is this would be sort of a political action. It's possible. We certainly have seen Donald Trump rail against big tech companies especially in the last couple of weeks, he has to set anything about this suit today and and to be fair this is a little a little abstract I think for people to sorta understand and you know. I'm not a political expert, but it doesn't seem like this is going to move a vote. That said, you know it's Donald Trump era everything's very weird and and it's To ask questions about something like like the timing on this right? I mean. The timing is step back. Though as you mentioned earlier, this is a years long game. You know he trump I get to say he's begun the lawsuit, but obviously, this is not happening. Yeah. A more practical way of thinking about or another another way of thinking about it that folks have suggested to me is this is likely the biggest case in bill bars career and that if he doesn't file it now or at least before. He may not get a chance to file it because Donald Trump may not be president come January. So the rushes for Bill Bar to get this thing through and have his stamp on it. This a lawsuit that is gonNA live for a long time. Right it could live in Abidin Justice Department right and that he wanted to be the one to bring yes it may sir it is very likely to continue a Biden Justice Department and that bill bars looking at this sort of with a historical frame like this will be my contribution to antitrust.

'Saturday Night Live' is back in studio
"SNL is starting back up. which is still weird to me. Again, this is weird to me but they've announced the first two host. They're going to have bill burr and Easter Ray hosting on the tenth October tenth and October Seventeenth, and the fact that they're going to be back in studio with all like. Like is there going to be an audience? There's absolutely no way that can be an audience. How does live sketch comedy? Work without an audience it's very strange So we'll see what it is but. If it's me I'd be telling everyone why aren't you still shooting from the attic shoot from your house is how I feel about it. Lessons Learned From The Iowa Caucuses, And Danger Signs Ahead
"I'm encouraging everyone to get out and give a separate the clapper Joe Biden I don't know the results and I with the I know we got rolled over last night he lost the lot he lost third fourth or fifth place we'll figure it out in the course of the day I'm joined by Byron York of the Washington examiner to talk about three things is state of the union tonight the impeachment acquittal tomorrow and the Iowa fiasco last like good morning Byron good morning June which order and were you up all night no I wasn't actually I actually I will I will tell you on our caucus story which is as you know there are a few journalists here in the morning and and all all of them were covering the democratic caucuses so I thought to myself I get here on Thursday in time to go to the president's rally it was clear the president I had a pretty large operation in Iowa and it was not because he was terrified of Joe Walsh or bill weld it was because he was trying to win the general election to get it in the bag while Democrats were still struggling to find their candidate now we didn't know how much how struggling they work so what I did was I went to a Republican caucus last night in Ames Iowa but forty minutes north of the mind and if they did this radical they voted once they counted the votes and I reported the results all my gosh you're kidding me and so it what was interesting you know AT and another thing I did years I I also went to a campaign event from Joe walls the former Republican congressman who is challenging the president does want to see how how this worked out and I don't know if you've seen the results but statewide from one ninety seven point one nine percent of the vote and walls one one point zero eight percent and bill weld on last year's governor one one point two seven percent so so Joe bill Burr Joe beat Bill Joe Walsh rebel our world no no no no bill weld bead Walsall world world up one point two seven percent to Walsh's one point zero eight percent that's got a first test for never come Republican challenges and it did not go well that's got a thing to lose to Bill well I'm sorry Joe Joe used to be on the Salem radio network and and it and so sorry Joe our condolences Byron let's talk a little bit about the hunter gatherer aspect of the trump campaign when it comes to data because I believe that's what the rallies are about I believe that with the caucuses were about the president's gathering that you attended on Tuesday night they are looking for the data they are and and they're also looking to make an impression the for people who might not remember in nineteen eighty four in February of nineteen eighty four Ronald Reagan as president he's headed to a huge reelection he certainly has no we nomination worries and he comes to the moment and that's the point in Waterloo used to rallies on caucus day when the Democrats are trying to choose their candidate and the Democrats are outraged the service is done it is not worthy of a president but Reagan did it and he really kind of took some of the oxygen out of the room for Democrats now Jeff Kaufmann who is the chairman of the Republican Party here and I was set back in June he told president trump about this and you know Mister president and Ronald Reagan did this in the end if growth Democrats not now I think other people probably recommend this as well but sure no problem was here and got in about seven to eight thousand people it great university and would that was far greater than any other Democrat in the event that any Democrat had plus trump brought a long list of circuits his his family cabinet members members of Congress Republican governors I was that the the caucus where Donald Trump junior spoke and they stepped up their social media and as you say they got all the information everybody came to the rally and then of course you have the information for value comes to the to the caucus and by the way they registered to vote a bunch of new people last night as well now they will move on I think yeah election effort but I think that circus will move on to New Hampshire even as the zombie campaign of Biden struggles forward the president tweeted thirty seven minutes ago by right New York the democratic caucus is an unmitigated disaster nothing works just like they ran the country remember the five billion dollars obamacare website that should have cost two percent of that the only person that can claim a very big victory in Iowa last night is quote trump close quote I don't think the president's going to allow this to pass I'm remarked upon all day long any may even bring up the state of the union Byron York I would think I would think and and by the way it it does appear that that vice president Biden did not do so well and I did go to his last event in here in deadline before the caucus and I will I will say though just a few things one the the questions about whether he has the vigor required for a long hard campaign those are really open questions that really he's not a high energy campaigner at this point he brought circuit like Chris Dodd and John Kerry which really gave the impression that he is a man of the past not really electrify anybody from the stage with use the most important thing was really interesting you spoke for more than twenty minutes and did not mention any of the Democrats most important issues no healthcare no climate change no gun violence no tops Isshin it was really extraordinary all he talked about without terrible crumple as any displayed no vision for the future beyond bringing things back to how they were when Joe Biden was in office so I you know I think a lot of Democrats look at that campaign is that this is just not working and when we do finally get results from last night we'll probably gonna see that the team by noon put out at five hours ago by bill Russo any campaign saying they wanted putting out in completing numbers is contributing to the chaos and misinformation they would like very much to move on before a fourth or fifth place finish is finalized I don't think they can escape that Byron but let's turn to impeachment I believe there will be an acquittal I don't know if it will be bipartisan do you have any reporting on that I don't I do not have any insight I I do know that efforts to try to censure the president I think you're completely doomed if you remember in nineteen ninety eight there were some Democrats in the Clinton impeachment nine nine or some Democrats who wanted to censure the president and not not impeach him but house Republicans went ahead and impeach the president of course they had a trial and a lot of Democrats who waited he's just been impeached and he had a trial that's a pretty big censure right there so I do not see any Republicans in the Republican supporting the center specially wanted strongly worded as Joe mentioned was circulating yesterday now I also want to make sure I get your reaction Byron I The Mandalorian Deep Dive
"Let's take a look at I. Guess the mandatory series win. You got done watching it. I guess. How overall satisfied were you with it up and down for you like this episode was good? But this episode is kind of a Dud. What what was your first impression as a whole I think I'd dug the whole the whole series whole a few more times? I really dug it from beginning to end when it was down it was still great. Its lowest points were still pretty high points. Okay overall. I really dug it but I also have like a huge love of Westerns and Samurai movies. And this kind of felt like it kind of felt like a way for star wars to play in a new sandbox. It felt very reminiscent of the original trilogy while also managing to kind of have its identity. Yes okay segues is into a good point. I noticed right away on the series the simple things like the fades from scene to scene. Where the same little you'll circular fades aides or sideswipe fades from? Yeah from you hope. You cannot do that when I graduated from film school. One of one of the things they told us in in film school is don't ever do that. It looks it looks amateur. It looks bad. Really for whatever reason star wars can do it and the reason they the reason they can do it is because they just kind of did it at a time when they were defining what Star Wars. This is so when episode four came out or Star Wars or the original movie nineteen seventy seven when that came out already visually. It was so distinct and so oh very specifically star wars that it can incorporate silly things like a like a cross dissolve across fade or a circle Michael Fade or whatever you wanNA call them It can do that because it is star wars and and if you saw that if you went to go watch the avengers and and you see that really slow white from the right side of the screen to the left side of the screen to transition. It would look very out of place in Lynn very artificial because because that's not part of cinema language but it is a part of Star Wars language and incorporating that into the man. delorean was something. I've thought was incredibly smart. Yes you actually see that in things like Djeddai Fallen Order And a lot of video games as well. Okay we'll incorporate that in the cut scenes it just it's A. It's an easy visual indicator that this is star wars I love that when I saw that on the very episode. That was one of the simple simple fan services that the what other fans services or things did you see that Cairo. I the main thing. The first first thing I saw for sure was was the rifle and everybody talks about the right okay but it deserves to be talked about talking about man. Does the knife owned the mandatory rifle. Yeah it's It's it's kind of like a long rifle with a tuning fork. Yes that was Boba Fett rifle in the holiday special which is the infamous holiday special which I've seen and it is as bad as everybody says and it's not like it's not like a challenge to go watch it do do not watch it. Don't and watch it. It's not it's not even worth laughing at. It's it's so hard to watch but In the BLU ray release of the Star Wars The star awards box set episodes one through six on the bonus disc. There's actually an Easter egg on their. That has the entire animated segment from the holiday special. Yes so you can actually see that and it's really cool but in that segment it's very much like a Ralph Bakshi inspired character design. It's really Kinda cool but you do see Z.. BOBA FETT teaming up with Luke at first and then he betrays him but he's got this weird rifle that should never ever work and everybody thought it was a cool looking rifle. I never thought we'd seen it and live action. Let alone we would disintegrate people. Yes that was another little throwback to empire pyre when vader tells Boba Fett notice integration. Yes because he had that rifle and rifle disintegrates. Yes it does look a little bulky on him but they still make it work. It works completely nothing about again. That goes back to what I was saying before about the visual language of star wars and again in the empire strikes rex back in the original theatrical cut. There's a shot on cloud city of a guy running through running through cloud city as it's being attacked by the empire but he's holding. What's supposed to look like a futuristic device but even in the eighties? Everybody was like that is an ice cream maker. Awesome husband was just running with an ice cream maker but they brought that back And so the the client played by Verna Herzog. He actually carrying all of his best car in one of those ice cream. Oh and so. That is another throwback that I really so when he opens up the best guard the open up that containers just the ice cream maker and it's the same kind of ice cream maker that that that extra was carrying awesome and it's Super Fund. It has no bearing on anything. If you didn't know that it's it doesn't take away or add anything to it except for the factory like I know that the super fans hansel catch it. Sure the casual fan okay. Whatever you know they won't even notice it but still get to enjoy it absolutely? Yeah and the show is filled with stuff like that. There is an episode where the episode with Bill Burr where they go to like a heist episode. Yes super the prison ship. Yeah there is one on living person on that ship. That person was played by Matt. Land Her who was the voice of anecdotes skywalker in the clone wars. Yeah and a whole bunch of other stuff but it's cool to have that clancy brown played a de Veroni wasn't Ronin. He was different. He was a different species. He was the red guy the horn. Yeah but The Big Guy. Yeah but that was clancy Brown. who was the voice of sabotage press and a bunch of other true in the rebels? Yeah and and Star Wars rebels he was sabotage press. It was really cool to see people from the animation side of things being incorporated into the live action. which is the kinds of stuff? I want to see moving forward with specific characters. Sure On the inverse of that you know we're we're getting to see live action or we're getting see animation people in live action and on the mandatory and then also in Rizal Skywalker. We got sorry guys. I'm talking about it. We got to hear. Canaan from rebels was one of the voices. You heard you heard Soka. You heard every you know people who were doing voices specifically for the cartoons in for for super fans you know which if I may indulge myself they already introduced you as a superfan. Oh good good a resident expert. Sorry whatever is just whatever cooler than I actually am but it was really fun to be able to to see those things. And if let's say I'm talking to you Leigh and you have no idea who Canaan is and we see rise skywalker you're thinking it's super cool because you're seeing this really cool scene. I think it's super cool because I'm seeing is really cool scene and also Kanaan's yeah and so it's just kind of another little the thing and and the reason I bring rays of Skywalker with this is because it's all happening right now right now You know we can. We can talk about this next year when you know when I owned the box set of the man delorean and I own the skywalker. Saga and I can watch those at the same time and and it doesn't necessarily have the same effect because we can watch it whenever this is something unique to December of two thousand nineteen this is as we're experiencing the lore. which again there are some of us like like you and I who will watch the cartoons and the TV shows and read the books and read the comments but there are are some people who only will take the movies or now the TV shows as that's all they know about wars and that's totally cool but at this point you know we saw in the Manda Laurean the child the baby iota used the force to heal somebody and a week later? We're watching the rise of skywalker skywalker. And we're seeing those same force. Power is being used and just from a serial point of view for storytelling. I I'm completely fascinated by. I'm really really excited that I can experience it this way and nobody else was going to experience it this way in now even now. We're we're staring at the New Year here in the next couple of days. People aren't going to be able to experience it that way anymore. Because it's already happened past and it's kind of a lightning in a bottle

You WanNa let him get his his opinions out in the most efficient way possible as interviewer. I think he's very convicted. And because of that it's it's almost not worth engaging on a back and forth. I mean maybe I'm making excuses for myself not being able to also in your defense. It wasn't so much of a dialogue as some of the other yet interviews have been I. I mean that's a nice taste of what his show is about to. It's basically like if you listen back to the show and you mute out every time the yeah pretty much vill show doc you add some hockey and yeah but that's why it's so fun watching listening to neon his wife because she can actually she actually challenges right because she well knows me better than me but also is very smart herself and quick and funny near as real real funny. I never understood or never appreciated did that transactional nature of stand up comedy. I never he talks about that a bit but yeah When he feels it from the on yeah that that it's it's the audience and ideally gets to laugh and gets distracted from their lives but the comedian get so much to do? They get so much validation joy and the way you feel I can imagine I can only imagine when a whole audience full of people are like the laughing so hard they can't roll. I'm literally mouth-watering now. I would take your flood and my rule was first thing I would I would i. Would you know I was really into the reading. The whole thing like we don't want the ice cube to drip into the Bourbon too much because you changing the flavor. It's like those people who like light a Cuban Cigar Little Cedar fucking thing because you know what the chemicals the lighter and I was really getting into all of these all the more knowledge. You have the more you can disguise that your shits a little out of control and they're basically your trip a tour of the Oreo cookie cookie factory and that they have this. Okay the whole glass including the ice cube. It looked like an ice cube but that was also glass. And then you took the glass and you put it in the freezer so then when you took it out you poured your booze in there and it got chilled and you had this being that was essentially working like an ice cube but there was no water. Oh that'll you were getting this season by looting straight booze and it was chilled in my thing. Thing was I would pour it up and over that glass thing that looked like an ice cube and I would drink three of them and I would watch like three episodes of Peter. Gunn maybe like seventy seven sunset strip and it was like all old school TV. So I didn't have to deal with global warming or any of this people screaming about trump or fucking hillary and I I would just sit there and watch this shit and everybody. In the shows I was watching was drinking and smoking. They wanted to kiss a woman. Only touch you know these big fucking gas guzzling cars. Ars there was no ramifications to any of the behavior the golden era and it made me feel like yeah man was born in the wrong era man fucking. That's it's always great to to to analyze with nobody else. I'm liking all these answers. Yeah compared to compare yourself to like movie stars come in and it also must be weird to be at all I the few times I've been like stoned or slightly drunk around like I don't do it often but if I around a kid kid there's always something a little weird about that but I only matches your well adjusted person. You don't have much of a temporary more. I will say but you had a really big temper as as a kid. You very competitive. I've done it. You also used to get really upset about your report card. Some you got PAT report card right. I remember you remember one time. We got a PAT report card and you came home and you you had in your hand. You're the paper pork on your hand and you're just coming around to the different parts of the house. Slamming a different wall's really of it with your hand. Remember it so clearly. I was so scared. Really Mania Devil. Yeah I would go berserk. I I was a very traumatic kid and then I would get very emotional There were many times I remember running away threatening that I was going to run away and then I didn't get the response I wanted so that made me more upset so I pack up a big bag. I'm making a big show on the cartoons like Wylie Coyote or bugs bunny they would always pack like a little sack. There was something very pathetic about it. He is so funny and actually is an incredible actor too. And I don't think it gets the credit for that He's been in a bunch of movies. the two of US are on show that bill created a Netflix called efforts for family. It's an animated show. Bill plays the father of this family in the early nineteen seventies. I play his son. I play the oldest of his kids. This very angsty teenager named Kevin with about temporary. Yeah yeah terrible temper and we talk a little bit about this but it's it's one of the great joys of my professional. Life is getting to do scenes with bill. Were just yelling at each other. We just like screaming at each other. I'm almost always yelling. or He's as a teen. He's a fourteen fifteen year old so he's either really horny or angry tap tap monopoly days. Yeah it didn't take much I did. Actually it's really fun to be able to do that now in a controlled environment and for for something positive anyway. He's he was kind enough to sit down. He also so as a podcast that. Maybe our favorite podcasts. You both of those same folks. It is definitely my favorite podcast. I would say it's the one podcast that I never ever missing episode. I listen I listen. Every we are very loyal follower. I don't listen to his podcast Monday. Morning podcast and there is no one better. In my opinion there is no one better at talking to himself. And that's mostly podcast is every once in a while he has guest or his wife near comes on. But it's mostly him just just ranting and. I don't think there's anyone better at doing that. And it's weird. I didn't I recently. Met Him for the first time and but it was strange to meet him in person because listening to his podcast. You feel like I feel like and I know you can say this about other podcasts. And and this isn't on communists communist -sarily but I- legitimately felt like I. I I knew so much about him and I was so familiar with him that it seemed weird that I didn't know well I don't know him. Well I mean I don't know That outside just working on that show and and doing an animated show. You don't often get to be around the person usually we record separately. So his wife Neo Christian. I've worked with we've cushion. I've done punches into shorts that you can see on the other cabin dot com but NIA is is very good actress. She was kind enough to be in some of those shorts end and they have such a great relationship comes on the podcast because they are often antagonistic towards each other but in a really fun loving way in such. It's real but it's so fun to listen to how they fight through that in a loving way again and it's funny we. I think we've just gotten lucky in that. We've had a lot of guests on the show. Who are in really good relationships? You know yeah ones that. Are Kevin Bacon Cure Sedgwick. That's true and Kobe smolders. And they're like aspirational relationships. Yeah you.
