Correct. They're usually not Abe. Able to do it. So it's either going to be a loved one like a child, which is the case we have here or it's going to be the child as a power of attorney or it's going to be the child as a healthcare proxy or it's going to be the child directed by the person being entered entered into the nursing. Yes. Which way is the best way to go or don't sign the arbitration agreement at all if you can. So these are really all the issues that are in the back of my mind when I read this case, but I wanted to now share with you the facts of this case, so where would you fit? So in this case, the individual sues this LLC nursing home for negligence and elder abuse. Which so it's it's not it's not a wrongful death claim. Okay. So it's the sun suing or it's the the actual resident I believe is probably the sun through the actual wrestling. So the actual resident is still you know, doing this. Well, the LLC nursing home said, you know, what fine you're suing us. We're gonna make you withdraw the case and go to arbitration because the sun on behalf of the resident had. Signed an arbitration agreement on the date of admission of the resident. Okay. And they're saying that the sun was authorized by the resident to sign the arbitration agreement. Okay. Couple of things here folks before just so you can put your hands around this. If the sun just signed it on his own without being directed by the father to sign it or the resident to sign it. Pretty sure he doesn't have the authority to do that. And if you don't have the authority to do it. It will not make the arbitration agreement that you signed binding, so he would have to actually be dad's power of attorney in sinus, his power of attorney to make that be binding, essentially. Yes. And no it depends. Attorney favorite attorney for as well. But we want to come to that. But so this case there's no power of attorney involved. But I do wanna come back to the power of attorney piece Susan, but this case it was only an individual. Okay. So then the the director of admissions at the nursing home said, I know he signed it on behalf of the resident because the resident directed him to sign it in front of me, the director. Well, turns out that the resident only speaks Farsi into the director. Unfortunately, the court said director, you don't speak Farsi, nor do you understand Farsi. So how do you know that the that the resident in Farsi directed the sun to sign that charades court said, I'm not sure we can get there. So at this point. The agreement will be void and will not be enforced, and they're going to allow the court to the court proceeding to continue, you know, there's a lot of things that keep track of when you're going through these big life events like that as well. So basically to say, okay can go away or we're only gonna make you pay the actual out of pocket expenses of the hospital and the actual bills. We're not going to deal with the rest. The supreme court of the state overruled saying no the statute itself. The wrongful death statute itself does not abate just because an individual died without any heirs or immediate next of kin. Now, I'm telling you this because obviously, I get it. That's that's the facts. And that's the case. And that's the decision. But what are some tips that we can learn from this case. And when I tell people, you know, planning is important, even if you're going to do no, no trust planning at least have a will. And that's what I want to explain to people. And you know, what folks but don't rely on just that will because one of Todd's mistakes, and here is relying on your well as you're only estate plan. That's a good point as well.
