"Some people will be outside all day on the fourth of July grilling out watching fireworks others will be locked in a dark room all day in front of the TV injecting season three of stranger things straight into their veins the whole season drops tomorrow on Netflix and that means you're gonna be hearing a lot about it in the ensuing days the next segment is for those who want to fake their way through those conversations we have ATV cheat sheet with Hillary Kelly she writes about books and TV for vulture welcome to the program thanks for having me on so first of all this conversation is by definition going to have some spoilers should know that you can turn down your radio for the next four minutes ready okay so if someone hasn't heard anything about stranger things give me the kind of you know previously on basically what's the show about so if you haven't heard of stranger things I'm really wondering what you've been doing for the past years but it is basically a show set in the early eighties in a small town called Hawkins Indiana and it follows a group of four young boys in a sort of stand by me type adventure as they discover that their perfectly boring small town actually harbors a lot of really dark secrets there's a lab on the edge of town called Hawkins lab and it turns out that the man running that lab has been trying to turn some children into secret weapons for the US government we meet one of those kids her name is eleven she becomes sort of our super power favorite character and the boys and their family members embark on an adventure when they discover that there is a portal to another world called the upside down very nice I feel like someone should pay you for this this is yeah and it's it's a little bit like ET but with a little girl instead of an alien right if you've seen each he any Spielberg from early from the eighties super eight yeah like a lot of super eight vibe to it kids out on an adventure with adults who sort of don't believe them and then are sucked into this crazy alternate world all right so I'm standing at a party someone starts talking to me about stranger things if I haven't seen the show how can I cheat my way through that conversation probably by referencing all of the great memes that have come out of the show one of them is eleven has this fondness for eating frozen echo waffle so you could just brought a like hope we see a lot more and awful this year another one is there were these infamous Christmas lights in the first season that Winona Ryder's character choice was using to communicate with her son in the upside down and so you know throwing out any reference to flashing Christmas lights would probably get you there and probably Winona Ryder right yeah it's always good to say isn't it great to see you in on a rock and if you need it a good sort of topic to send everybody off just say that you do or don't think that Joyce and hopper who's the town police chief are going to get together now we know that they had a little romance in high school and that they've grown apart since then but it's one of the big topics that a lot of people are asking you alluded to the nostalgia of the show which is in part what made it such a phenomenon right everyone got to re live all of those great Spielberg type films from the early eighties and and starring young people but it also means there's an insane amount of cross **** right I mean is it in my head or they're just like a lot of stranger things pseudo March right I mean it has it doesn't help I would say that stranger things takes from so many other categories that you yeah the snake is eating it's pop culture tale that you can see it's not just that you're seeing references to stranger things everywhere it's that you're noticing that stranger things was referencing everything else all along we eat out there working as an upside down what a looting to the show I mean they're literally flipping over a sandwich telling you what the thing I just find it to be very strange do you could do on your own right yeah if you drop it I mean so tomorrow is the big drop are you going to be in are you going to ration it out an old style TV watching session I am a Binger one hundred percent mostly because a lot of the fun it's July fourth Hillary it's still live I know it's going to do you hate America is going like America hi I adore America okay going to be hot so I'm going to be damaging one hundred percent secret I'm a critic so I actually have to see but are we in for something good or not I think we are I mean especially if you want to watch these characters grow up you know in the in the Harry potter sense where it got more and more fun to watch who these young people were turning into they're gonna be teenagers this season and so all of the accompanying fun of a teenage show is now kicking him all right that's Hillary Kelly she writes for vulture

But there's an exception to that general right to publicity, which is that in cases in which the situation is news worthy or involves a matter of public interest. Now, you can argue is a sure sign of the apocalypse when tabloid celebrities who are mostly famous for being famous or considered newsworthy for eating ice cream or wearing a new outfit. But that's how it's been interpreted which by the way GTE had deep new because she was sued for doing exactly the same thing. Two years ago. You think the paparazzi will win this case? Yeah. Most of these types of cases are settled out of court before they ever get to trial, which is likely to happen here. But if you'll. Like a photo that was taken by anyone else. Everyone famous or not. My question is regarding if Chris flowers. Is pre court does rule to overturn his conviction and Curtis is released number one. Would he return to win ONA and number two is so would he or should he have any fear for his personal safety if he returns, thanks a lot that I? So haven't talked to Curtis about this. So I don't know what he would say. But his family is told me that they don't think Curtis would return to Mississippi if he got out of prison, and that the reason for that is that they just don't think Curtis would be safe there. And you know, in the podcast, we get into the fact that the family's house has already burned down once during one of the in the in the middle of the trials happening and more than that though. You know, everywhere I went in Winona, whether I was talking to white people thought Curtis was killed to your black people who thought he was innocent. Everybody shared this one belief, which was the Curtis is not safe in Winona, Mississippi, and because people would want to kill him. If he was out we also know that one of the victim's family members, the father Randy Stuart, the father of Bobo, Stuart the youngest victim had plotted to kill Curtis before and told us that. At one of the people who told me that Curtis wouldn't be safe. There is the current elected constable, so member of elected law enforcement, a guy named Jerry bridges, basically said something like, well, if he gets out will have another murder just it's to him. It's that certain. And so it it does not seem like a safe situation for Curtis. Of course, who knows if that would actually happen. But that is absolutely the feeling in. We know that it's it would not make any sense for him to stay there on the other hand. That's that's the only, you know. That's where he lived most of his life. But yeah. So a genre of messages that we've gotten a lot of have to do with people wanting to help Curtis and I'll play you just one example of this. Here we go. Can we do to make sure that that's a fair trial? Who do we wrote a letter to where's our time Buston from various you now where that energy should be channel? And. So we've done this question a lot these types of questions, and I think it's important to point out that our job as reporters is to be reporters. And so we are not activists for one side or another. We're not involved in protests or anything like that. It's really important the way that we look at our job for reporter to be independent. And so we report the facts, and what happens with those facts in democracy after that what people decide to do what the governor decides to do with the defense. What people listening decide to do is up to those people to decide..

"Do are you aware of either anything on either of those fronts, so he's going to be up for re election in twenty nineteen so next year, and so far there's no indication that he's going to retire. I mean, he's even given a public statement about maybe a year or so ago saying that he has no plans to retire. And so there's there's no indication that he's not going to run again. And of course in the past every time he's run except for once whenever he's run for reelection. He's run unopposed. And so there's also so far no indication no one step forward to say they're running against him. And so we'll have to see what happens there, but but right now. Yeah, there's no indication that that anything will happen other than he'll run for reelection. I have a tweet from Sean p Conley. He writes, do you expect Doug Evans to be reprimanded or punished in any way? He says the gentlemen in charge of the bar complaints. That was interviewed in update podcast. Used the phrase quote trust the process, but confidence in the process doesn't seem to work for Curtis. Yes. So the question right now is whether or not the bar association is looking at all at Doug Evans, and we do now know the answer to that question because we know now from one listener that has gone through. Now, the process of filing of our complaint against Doug Evans, which has not been decided on or ruled on in any way, but has been filed and the bar complaint process is somewhat, you know, it's not entirely public the bar association. Does not comment on that. And so they don't come on anything that they are currently investigating or even if they are currently investigating anything. But we do know we've seen documents from one listener whose filed a complaint that one has been filed and that Doug Evans has responded to that bar complaint. The lawyer that he now has in Grenada, Mississippi and so. We will continue to monitor that. And so the bar association can take a couple of steps if it finds that a lawyer has engage in conduct that is not allowed and one of them is a private reprimand where lawyer basically gets a private letter from the bar association saying this is not allowed. He could be publicly reprimanded a lawyer. That would perhaps look like a, you know, even being called before a judge and being read a reprimand. It's very rare for a lawyer to be disbarred. And so we'll just have to see what what happens with that. We have had people wonder as well, if if the feds would ever get involved, so if if anyone's looking into the possibility that there may have been civil rights violations here that the federal government might take an interest in right? Like, we think about that. For example, when you think about Ferguson where the federal government did intervene in Ferguson. There's no indication that that's happening here. So we did reach out to the Justice depart. -ment? And we asked them are you looking at anything in Winona, Mississippi, or in this judicial district, and they responded, and they said, we don't come to comment on that. We don't come. And basically, we don't comment on that kind of thing. But there's no indication, you know, just having been in Winona a lot since podcast came out and talking to a lot of people there that there is Justice department involvement in the case. So some people have ridden and s specifically about what's called the Brady violation wondering why people aren't investigating Doug Evans for potential Brady violations. So a Brady violation is when a prosecutor fails to turn over required material to the defense, and we talked about this in one of our episodes when we were talking about Willie James Hempel. Right. So this is material that could tend to show that the defendant is not guilty. Right. So very critical information. And so typically the way that this works is even if a court were define that. Yes. A prosecutor did not turn over Brady material. Something required a turnover that there's really no consequences for that outside of what happens in the courtroom in that particular case. And so the way that the system is set up right now if you commit a Brady violation what that means often the conviction gets overturned..

"But the defense makes he and if you do look at the record of the of the past six trials Curtis filers has actually been more successful in trials that have. Been held among them recounting. So he's had to hung juries in Montgomery County right compared to the first two trials which were both convictions. Right. So yeah. I mean, there is this question of which one is the better option. I mean, I think that the other thing to consider that we didn't point out in the podcast. But I think about sometimes is win courtesy case was tried locally to get down to twelve jurors. They had to start with hundreds of potential jurors. So this point there are so many people in that area who have been called to jury duty in this case and have gone through jury selection. So I don't even know about the chances of finding people who haven't gone through jury, selection, and the other thing that I think is interesting to think about this is if you have a trial in the big city, like high profile trial, of course, the jurors get scrutinized for their verdict, especially the public largely disagrees with the verdict, but it's not as personal right? So in Winona, if you're one of the twelve jurors who find her guilty or not guilty or can't decide? Everyone knows that you're going to be the juror that let Curtis go or the juror that made sure he was executed or the jurors couldn't make up their mind. And you know, you're going to go to the Bank, and you're gonna see someone related to one of the victims families or you're gonna go to the basketball game. And you're gonna see Curtis's family or whatever it is. And so I think that does make being a juror in this case really difficult because you are so public, and so that I think is another thing that that I know just from talking to people in Winona. Has made some people sort of wary of of wanting to be on the story, of course, which is very understandable. So one person we've had a lot of questions about you might not be surprised to hear is that the Doug Evans. So the first thing people want to know is whether we've heard from him since the podcast is come out. We have not no we've not which is we'd be happy to talk to him. I mean, we would you know, I have reached out to him since the podcast has come out. We would still like to continue to talk with him. We did talk with them. Of course as people heard. I mean -cluded that in the podcast, and especially going forward, you know, this is a case that is by no means over yet. And so as the elected district attorney he has still a lot of involvement in this case going forward. So I do hope that he continues to talk to the public about the case to explain some of his decisions and the case, and we'll certainly continue to reach out to him and hope that he he does talk to us again. So I have a tweet here from probably gonna. Get this wrong. Sorry, Heather ca tapa. So there could happen tweeted with multiple rulings of prosecutorial misconduct. How does Doug Evans remain assigned to subsequent trials? Yes. So Doug Evans, really is his own boss. And so he doesn't even need to get a signed to a trial. So he just is the district attorney. And so, you know, in the federal system, for example, he would have a supervisor who might say to him. You know, you did a really good job. I, you know, I think you should try to get or wanting to try again or I don't think he's tried again. But Doug Evans as a district attorney as the top prosecutor in that area gets it aside that the court could say you are not allowed to try this case again or something along those lines. But that has not happened in this case and not for lack of trying by the defense. So Curtis's lawyers. Have they tried to get him removed from the case they have they have tried to get him removed from the. Case. They've also tried more than once to convince the court to not allow Doug Evans to have any preemptory strikes. Mrs injury selection. Right. So, you know, curses defense have pointed to the record of Doug Evans, using a lot of his strikes to remove people from the jury pool, and if said to the court look in light of that.

Controversial Enbridge Line 3 Oil Pipeline Approved in Minnesota
