"In prison That's the sentence for the three white man convicted in the murder of ahmaud Arbery in a Georgia neighborhood A troublesome development in the pandemic a record number of American kids under the age of 5 are in the hospital because of COVID Montgomery county residents can get free COVID test kits at libraries starting Monday I'm Kate Ryan Remembering Sidney Poitier the man they called mister tibbs I'm Jason freely It's a 31 A Georgia judge has sentenced the three man convicted of murdering ahmaud Arbery to life in prison and only one of the men will get a chance at parole Travis mcmichael and father Gregory mcmichael were sentenced to life in prison without the possibility of parole William roddy Bryan was sentenced to life in prison with the possibility of parole Here's CBSN legal contributor Rebecca Roy fee I thought the judge was incredibly careful and his words were well considered He didn't say anything that would rile up anybody or create more public upset and uproar over the case but he did point to several important moments in this trial and pieces of evidence that supported his ultimate sentence Brian's lawyer argued that he showed remorse and cooperated with the police Now back to the pandemic and a concerning development the number of American children under the age of 5 who have been hospitalized with COVID is at the highest level since the pandemic began New CDC data shows since early December the hospitalization rate in these youngest children too young for vaccination has surged to over four out of every 100,000 compares with a rate of one in a 100,000 for kids 5 to 17 years old Here's CBS News medical contributor doctor David agus When you look at the vaccine rates in the United States they are very good at the over 60 but very poor at the under 25 And young kids in a single digit years and teenage years there is significant hospitalization with omicron It is small when you look at percentage wise because there are tremendous numbers of cases and still as a percentage wise it is remarkably rare to be hospitalized But we're seeing record numbers of kids hospitalized across the country The director of the Centers for Disease Control and Prevention doctor Rochelle Walensky says this worrisome trend in these younger children underscores the need for older kids and adults to get their vaccinations in order to protect those younger children around them Right now Pfizer says early trials on young kids shows its vaccine does not work as well on them as they had hoped In Montgomery county free rapid COVID test kits will be distributed to residents at several libraries starting next week Look at the details from Kate Ryan 19 libraries for cross Montgomery county will have the rapid antigen COVID test kits that let you get results within 15 minutes The test kits will be given out on a first come first serve basis starting Monday Residents can get two kids per person per visit but they will have to provide proof of residency Now that could include driver's license or a copy of a bill showing that you do live in the county The rapid test kits are intended for people who are asymptomatic If you do have COVID-19 symptoms health officials say you should contact your healthcare provider and arrange to get a PCR test Kate Ryan Because of the armor surge the University of Virginia is moving up the February 1st deadline for the campus community to get a COVID booster shot The university leadership moved the deadline for students faculty and staff to show proof of a booster to January 15th It had been February 1st the university said moving the deadline is an alternative to delaying the in person semester until after the latest surge subsides Meanwhile the university of Maryland says the spring semester will start as planned and in person January 24th all faculty staff and students are required to have received a vaccine booster by that date or within 14 days of becoming eligible The university is also requiring everyone who returns to take a rapid antigen test no more than 48 hours before coming to campus on the 24th Just ahead the Supreme Court here's arguments against two big pieces.

"Dot com and schedule your free estimate today It's four 11 A jury in southeast Georgia has found Travis mcmichael his father Greg mcmichael and their neighbor William roddy Bryan guilty of murdering ahmaud Arbery an unarmed black man who had been jogging through a neighborhood in Brunswick when he was chased and shot to death The defendants say they suspected Arbery of burglaries Travis mcmichael claimed he shot Arbery in self defense The trial became part of a larger national reckoning on racial injustice Veronica waters covered the trial from start to finish for WSB radio in Atlanta She spoke with WTF's Sean and Mike about the trial I think that the defense lawyers in this case did an amazing job I mean you had some really skilled defense attorneys here The prosecution though said listen jury this claim of citizens arrest in self defense This was all made up for trial And she pointed to the defendant's own words that day that no one ever said they were trying to arrest them on Arbery no one ever brought up a citizen's arrest or made a claim of self defense until these men were indicted I think that she did a good job in sort of painting a picture for the jury about why the defense arguments did not hold water You can't claim self defense if you're the initial unprovoked aggressor And there would be no struggle over a shotgun as the defense said that there was if these men hadn't chased Arbery around for 5 minutes before that moment happened And so I was a little surprised because I have never been able to really predict what a jury is going to do And I was curious to see what the mix might be of guilty and not guilty verdicts was going to be as you know the shooter Travis mcmichael was convicted on all of the counts His father Greg convicted on 8 of the 9 their neighbor roddy Bryan convicted on 6 of the 9 but neither one of those latter two men was convicted of the malice murder counts That was the only one that stuck to Travis mcmichael And that means here in Georgia automatic life sentences when you're convicted of murder when they are sentenced judge Timothy Wong's leg will decide whether or not they have the possibility for parole Can you talk a bit about how the city prepared for the verdict when it comes to maybe police presence and just around the heaping the security outside this courthouse What I know is that preparations had been put in place even before the trial started as we were on the eve of jury selection we knew that there had been a meeting in the city There were lots of officers on call We saw it outside the courthouse State patrol members out there Everybody ready to keep the peace of course they knew that something could happen although I do want to note that there had never been any violence or destruction in Glenn county since the killing of ahmaud Arbery demonstrations have been loud and forceful but they have not been destructive or violent But just in case there were preparations in Atlanta even as people prepared for whatever this verdict might bring But we did hear from a lawyer for the arbor family as well as from Arbery's father himself Marcus Arbery He said we want this jury to come back with a verdict in an honest way He was trying to say we don't want anybody to intimidate them as one of the defense attorneys kept saying about the black passage in the courtroom This might influence the jury to vote one way or the other We want them to go and convict based on the evidence which we believe that there is to convict these men And I think that's what happened The border of Veronica waters from WSB radio in Atlanta in conversation with WTF's Sean and Mike coming up on Public schools without librarians a problem the D.C. council's working on I'm Michelle marello Sports next Is always on even when your car isn't Download the app to listen live.

"Courtroom the three white men charged in the death of ahmaud Arbery were found guilty of murder After deliberating for about ten hours the nearly all white jury found Greg mcmichael his son Travis mcmichael and their neighbor William roddy Bryan guilty of nearly all the criminal counts they faced Civil rights attorney and former prosecutor Charles colman junior is here to talk more about it Welcome back to the program So glad to be here Thank you for having me Is this a case where people could see the verdict coming meaning what do we know about how the prosecutors laid things out that brought us to this point Well I don't think that we can ever see a verdict coming I don't want us to take for granted any verdict because everyone is always going to see some things differently And so the fact that they arrived at this verdict together was a testament to how clearly the prosecution was able to lay out their case to walk the jury through the charges one by one for east defendant and to connect each of the defendant's actions to the specific things that they were charged for and allow the jury to make a very pinpointed very clear decision which is what we saw and why we have the verdict that we do To get into the detail of that you have Greg mcmichael Travis mcmichael and roddy Bryan their neighbor who actually filmed this killing Can you talk about what their defense was that in a way has been rejected by the jury It was heavily on self defense That was the idea the idea was that this was something that they did out of fear for their lives For mister Brian the argument that his attorney attempted to advance was his client didn't have knowledge that the mcmichaels intended to do whatever it was that they intended to do But that his client should not have been held accountable because his role overall was minimal The jury did not buy either of those things I suspect with respect to the mcmichaels the provocation was just so great that it's very difficult to overcome it with a claim of self defense In the case of mister Bryan they did not convict him on the murder with malice basically They convicted William Ronny Bryant of what's called felony murder So what I see when I look at this verdict tells me that the jury was very careful to look at the specific charges and wanted to make sure that they got it right So the jury rejected the idea that their actions that day were somehow self defense and now I understand that the three still face federal hate crime charges So how does this set up that next case Well it's just up the basics I think this notion of a citizen's arrest which is also what the mcmichaels attempted to advance as part of their initial decision of defense before they switched gears Mid trial All of those things have been blown out of the water I think that we are likely going to hear during the federal civil rights prosecution of this case a greater deal around race I believe there was some conversation about the Internet search history of mister mister Bryan the use of the racial epithets as well as I think the presence of confederate flag on I believe the mcmichael's truck All of those are types of things that will add substance to some of the other elements of this crime but it remains to be seen what's going to happen once this interesting into the federal courts How do you think about this case in terms of its victim What does this moment mean to you as someone who watches these things closely Well I think if you're very important moment for about Aubrey I think it's important moment for his family and loved ones I do hope that they receive some sense of closure but in the larger scale of things it still is one that should cause concern And the reason why it should cause concern is because as that verdict was right today there were legions of Americans who held their breath We as a country can not rest until that feeling of needing to hold our breath to ensure that the justice system works as it is supposed to no longer exist And so it's important that we do not conflate the notion of justice for the accountability Justice unfortunately for our arbor he's out of reach because he's no longer with us and can never be made whole But accountability is what we saw today in that courtroom And I submit that that's a good first step That civil rights attorney and former prosecutor Charles Coleman thank you for your time Thank you so much.

"On most of the charges I should correct myself there I think I said that initially but it was most of the charges And the message is very clear that the jury completely rejected the claims of citizens arrest and self defense from Travis mcmichael his father Greg they along with their neighbor William roddy Bryan were convicted of murder aggravated assault and false imprisonment for chasing ahmaud Arbery with pickup trucks on February 23rd 2020 They cornered him and Travis mcmichael shot him at close range with the shotgun Brian recorded the confrontation on his cell phone which became a damning piece of evidence in this trial After the verdict today prosecutor Linda donakowski said the jury did its job And when you present the truth to people and they can see it They will do the right thing And that's what this jury did today And getting justice for ahmaud Arbery What was the reaction from Arbery's family They've been in the court daily for this trial Right both of his parents were very emotional as the verdict was read in the courtroom And then afterwards they came out and talked with people about what it meant to them Here's Wanda Cooper Jones I never thought this day would come But God is good Yes he is Thank you Thank you For those who marched those who prayed most of the ones who prayed Yes Laura Thank you guys Thank you And now quiz which you know him as a mind I know him as quiz He will now rest in hey man So Cooper Jones and Marcus Arbery his father had been fighting for justice for their son since the killing if you recall.

"And the jury now has the case and is weighing the fate of the three men accused of murdering ahmaud Arbery You the jury must determine whether the state has proven the guilt of each defendant beyond a reasonable doubt as to each count Derek Dennis is in Brunswick Georgia watching it all for ABC News and he spoke with como's Bill O'Neil Derek took 13 days for us to get to this point prosecutors getting the final word this morning Absolutely done Basically laying out the main point of her defense that being or her prosecution I should say that being that the defendant Travis and Gregory mcmichael along with William roddy Bryan instigated this whole thing And if not for them we may not be here at this trial ahmaud Arbery might still be alive She also pointed out the fact that they were in fear of a monarchy Didn't make sense because he was running away He was jogging through the neighborhood and then after being pursued by them he was running away from them And so she discredited that claim that testimony from the defendants as well What did the judge have to say to the jury before sending them off to deliberate Well he charged them with very detailed instructions They were pretty clear that it was up to them to weigh the evidence to talk amongst themselves really have a spirited debate about the facts of the case the evidence involved and then to be truth seekers Facts finders in the case So he really gave them that charge And he also added some extra charges lesser charges that they could consider against the neighbor William Ronnie Bryan considering him potentially less liable than the other two the father and son Travis and Gregory mcmichaels So the jury can consider lesser charges against the neighbor but for now they're all facing equal charges of felony murder malice murder those are the most serious charges which could get them life in prison As we wait for the verdict Derek what can you tell us first hand about that mood in the Brunswick area It's very somber actually This is a quiet coastal community on the coast of Georgia really sandwiched between Savannah Georgia and Jacksonville Florida about an hour from each north and south And so it's not a big urban center There's a lot of land separating these communities And so we haven't seen a big contingent of activists or protesters It's been really a small group of new Black Panther Party activists who've been here support house every day They've been peaceful They've been chanting ahmaud Arbery's name So much so that the judge earlier asked that the jury will be moved to an interior part of the courthouse that they would be able to hear the tanning from outside But other than that a very quiet theme here as everyone really awaits this verdict ABC's Derek Dennis with us from Brunswick Georgia on the Komodo line That's como's Bill O'Neill This year's Thanksgiving won't be immune to the supply chain issues roiling the nation for the Turkey supply is strong Mike bower has the.

"The closing arguments today wrapped up kind of what stuck out with you What was a message to jurors Prosecutor Linda Dana koski delivered a very forceful rebuttal Some of the strongest language that she's really used talking about the credibility of some of the witnesses from the defense especially Travis mcmichael himself making the point that Travis mcmichael has changed his story from day one None of the mcmichaels or roddy Bryan used words like you know we were trying to effectuate a citizen's arrest that day in their first statements to police now that's not legally required They have formed a very compelling legal argument since acting rashly on the day in question I understand too there were some moments that really especially got to ahmaud Arbery's mother Yeah I think this mother more than a mods mother but she did in fact leave the courtroom during defense attorney Laura hopes statement yesterday She said basically over and over again that Ahmad Arbery was in fact committing burglary on the occasions that he had stopped by the House under construction and satilla shores And as she's describing that she sort of chooses to describe a mods long legs and long dirty toenails And it was a moment that like I said I think more than just a mod's mother heard and sort of felt was a line too far Any idea of the effect of those closing arguments when you think about situations like that and then you think about what the prosecution said today do you think any of that is mind changing see if you were a juror I think that for whoever wanted to hear a sympathetic argument for the mcmichaels and roddy Bryan That was there That was displayed So if anyone finds those defendants stories to be credible I mean we will see we'll see some acquittals potentially There is a lot of talk that especially for William roddy Bryan that murder charge may be hard to stick on Because of you know if you believe him he was late to the scene so to speak he did not know as he claims that the mcmichaels were armed and that he would even be part of this in the way that he was Your sense of what the feeling is in Brunswick if one or all of the defendants is acquitted That's a good question I don't think we've heard much from the family members about how would you feel if roddy Bryan were to get off and maybe the Michaels didn't What I know is that the prosecutor's argument in this case has been that all three elements from all three of the defendants were necessary in order to get to the place where ahmaud Arbery got shot What that means is that without roddy Bryant's truck sort of blocking the path and some say forcing ahmaud Arbery into a ditch off of the road without that he wouldn't have turned back around and headed in the direction where Travis mcmichael and his father were on Outside of the courtroom Melissa in Brunswick what was the mood today as those arguments wrapped up and the case went to the jury I think the mood today was very quiet I think there's a sense that everything that has been done and everything that could have been brought up has been brought up and you know we asked Arbery's family about did they feel like the prosecutor did her best work today And they felt confident that we're going to have a guilty verdict We shall see We shall W a belisa Hagen in Brunswick for us Lisa thank you so much for the update Thanks Jim And an update now on the traffic.

"The Georgia murder trial of three white men accused in the killing of ahmaud Arbery Arbery who was black was shot to death last year while he was running down a residential street outside the city of Brunswick The case has drawn attention from racial justice advocates who have maintained a presence at the Glen county courthouse since the trial began a little over a month ago NPR's Debbie Elliott joins us now from Brunswick high Deby Hi there are To start with what's actually in front of this jury walk us through the charges and the defense's response Well Travis mcmichael his father Greg and a neighbor William roddy Bryan are charged with murder aggravated assault and faults imprisonment for chasing him on Arbery and pickup trucks and then killing him But Michael say they were trying to make a citizen's arrest when they went in armed pursuit after Greg mcmichael saw Arbery running down their street They say they thought he might be responsible for neighborhood break ins Brian joined in that chase and then recorded the killing on his cell phone Travis mcmichael the one who killed artery with his shotgun at close range he's claiming self defense because ahmaud Arbery fought back So the jury started its deliberations just before noon local time today after they heard final closing rebuttal from the prosecution what was the state's final message for the jurors Prosecutor Linda donakowski sort of ran down all of the choices that the defendants made leading up to this tragic outcome She talked about how these strangers chose to go after ahmaud Arbery even though they had no knowledge that he'd done anything wrong other than being a black man running down the street She said he had no weapon but they chose to arm themselves They chose to run down a pedestrian with a truck She urged the jury to reject Travis and Michael's argument of self defense given that he's the one who drew the shotgun You can't find self.
