"Things considered from NPR news I'm ayesha rascoe and Washington and I'm Elsa Chang in Los Angeles The government won a guilty verdict today in a federal hate crimes case considered a touch point for racial justice Three white men were convicted of violating ahmaud Arbery's civil rights two years ago when they chased him down with a pickup trucks on a residential street outside Brunswick Georgia and murdered him Attorney general Merrick Garland said the defendant's actions and the racism that fueled them inflicted enduring trauma No one should fear that if they go out for a run They will be targeted and killed because of the color of their skin And Pierre's Debbie Elliott joins us now and just a note that her reporting contains details of racist actions hi Debbie Hi there So can you just first tell us exactly what today's conviction was for It was for the racist motivation behind this crime you know the jury found the defendant's father and son Gregg and Travis mcmichael and their neighbor William roddy Brian guilty of all of the hate crime charges they faced including violating ahmaud Arbery's right to use a public street because of his race and attempted kidnapping they were convicted on state murder charges last year but this trial that trial did not get into any evidence of racial animosity and this one did and very ugly detail I might add Federal prosecutors showed how these men harbored racial resentment for years and how they acted on these vile racist beliefs when they chased mod Arbery with their pickup trucks as he tried to evade them for 5 full minutes and killed him once he was trapped prosecutors say they never looked at ahmaud Arbery as a fellow human A fellow human Well what has been the reaction so far too this verdict today You know outside the courthouse Arbery's mother Juan de Cooper jam said she was thankful that the jurors were willing to consider all the offensive evidence I do appreciate.

"Its morning edition from NPR news I'm Leila folded and I'm Rachel Martin there's a federal hate crimes trial underway in Georgia related to the murder of ahmaud Arbery The central question is whether the three white men who killed Arbery were motivated by racism Benjamin paine from Georgia public broadcasting joins us from Brunswick Georgia where the trial is taking place Thanks so much for being here Thanks Rachel So Benjamin let's just start with what arguments the prosecutors plan to make Sure prosecutors say that three defendants Travis mcmichael Greg mcmichael and William roddy Brian held deeply racist worldviews especially against African Americans and that because of their views they wrongly suspected that Arbery had committed a crime when he was running through their neighborhood In terms of proof prosecutors say they plan to introduce social media posts from the man as well as sworn testimony from people who knew them and interacted with them For example prosecutor Bobby Bernstein said during opening statements yesterday that they plan to call up a person who they say brought up the NAACP in a conversation with Greg mcmichael at which point the witness says mcmichael went off on a racist tirade Bernstein also said that his son Travis mcmichael told some on the reason he enjoyed his job as a defense contractor so much was that there were zero African Americans who worked there but that he didn't say African Americans who used the N word What about the attorneys for the defendants What do they plan to argue here Basically their argument is this the Michaels had a legitimate reason to chase Arbery when they saw him in the neighborhood because they recognized him from surveillance video inside a house that was under construction As for roddy Bryan who tagged along his attorney said in opening statements yesterday his client was just trying to document the incident on video even though that also meant joining in on the chase Now what's interesting here is that none of the defense attorneys denied that the men have expressed racist fuse For example Greg mcmichael's attorney told the jury that his client quote said the types of things that would make people cringe and feel disgusted The defense just argues these racist expressions were not motivating factors So I mean all this must be incredibly difficult for ahmaud Arbery's family to go through they've already been through the criminal trial and now they're coming up on the two year anniversary of ahmaud Arbery's murder Yeah ahmaud Arbery's mother Wanda Cooper Jones said yesterday outside the federal courthouse that she's ready I think it's gonna be a long long haunt round a whole lot of hard evidence is gonna come into play So I gotta be prepared for that But I'm grateful that we're here that we made it this far and I think we're gonna give victory as well Arbery's father Marcus Arbery also said he was looking forward to a second victory The state murder trial was televised right many Americans saw the guilty verdicts being read on television but I understand there will not be cameras in the courtroom this time Is that right That's correct This is a federal courtroom with rules that prevent that I spoke with Samantha guilder She's with community activist group that was formed after Arbery's murder And she's frustrated This trial isn't more open to the public I think without that level of visibility that there was with the state trial Once you remove that the only thing you're left with is you have to be able to trust the process And so trusting the process and lately is a determined upon having a diverse jury that can hear this trial And the jury in this case is more diverse than the first trial That one had only one black juror to 11 white jurors This federal trial has three black jurors one Hispanic juror and 8 white jurors But it's interesting what you pointed out earlier There is a high bar to clear here right Even though the defendants are known to have uttered racist phrases they have to draw connection to the murder of Arbery Correct That's basically they killed Arbery because he was black That's a much higher legal hurdle to clear than in the state murder trial since it now involves motive Benjamin Payne from Georgia public broadcasting we appreciate your reporting on this thank you Thank you Rachel Families in Colorado are still looking to rebuild their lives after the Marshall fire incinerated parts of boulder county at the end of December Over 500 homes in the city of Louisville were destroyed Those looking to rebuild face a new set of green building codes and to some they're an expensive obstacle Sam brash of Colorado public radio reports Release two trees is what was our House It's a frigid morning when sulu and her husband take me to see what's left of their two story Louisville home It's not much.

Mr brian is the one armed with a cell phone. Not guns mr. Brian didn't shoot anybody. So you know. I understand that there are people out there pursuing their own agendas outside of this criminal case For their own reasons but again when you can find and look at the actual evidence a jury is going to here. It's pretty clear that mr brian is a is a very different position We would submit than than the mcmichael's And that's not to say that the mcmichael's don't have a strong defense. We believe they do and certainly defense keys in many ways off of theirs. But if you put aside the high and the spin and you actually sit down and look at the evidence and the video is just one part of the evidence in this case that mr brian has no criminal responsibility in this shooting whatsoever again. That's kevin goff the attorney. For william roddy brian. He's the third defendant in the case. He's the one who recorded the video. He doesn't have a gun okay. In the in the beginning people were talking about. Oh maybe he's got a gun on the video you hear clicking There's no evidence that he had a gun. No indication no allegations that he had a gun. Clicking very well could have been his seat buckle but it's clear that he's recording the whole thing and matt johnson still with us matt. You know. I look at rodney bryan. And i do see him differently now. I don't know if that if that makes a difference for criminal responsibility but in what happened that day. Well i think there's a whole big question about vigilante ism and what his intentions were. And i think that that is going to play into why he's sitting there with the two other men but i do think that we have to look at him a little bit differently because after all he is the reason why this is actually going to trial right because he shot the video. He drove dangerously shooting cell phone driving a a heavy truck at the same time. There should be criminal charges against that. But you know he. Data video went viral. And that is the reason why there was eventually charges in this case it was passed from d. a. ada because of the dad. greg mcmichael tasked with law enforcement. But that's the reason why we're here right. It is and kevin gospel saying from the beginning. He says my client shouldn't be defending. Should be the star witness in in all of this but that aside and i understand why people see them all together as one. Because you've got to trucks chasing someone three men to trucks. I get it all. But i see some some distinct differences and there's some questions that i need answered at the trial and the first one. I've tried to get kevin golf to answer several times. But he always says. I can't speak for roddy. Brian While you're his attorney you can speak form but is why. Why was he recording. The video to me. That unlocks everything. If we get the truth and again you know you have to decide what the truth is. But why is he shooting that video. Why is he recording that video. And my initial approach to it is people who are committing crimes for the most part who have the intent to commit a crime don't record themselves committing the crime and then when police come they don't tell police. I've got a recording of the crime. I just committed. And that's what happened in this case matt. He records it. Nobody in the world knows that he has recorded. Except for roddy brian as soon as police respond one of the first things he tells them is. Yeah i've got the whole thing on video and gives the video police at the scene to me and again. I don't know what the criminal responsibility is going to be. I don't know what the answer to the question is but to me. There's a great argument that kevin gov could make that there's no consciousness of guilt for roddy bryant. Even if what he's doing was wrong he has no consciousness of guilt which to me says there was no intent to commit a crime no acknowledgement in his mind that he thought he was committing a crime because he recorded it and then the first thing he does when police respond is he gives it to them when they have no idea to even exists and no acknowledgement that they committed. Any crimes charged for like they're sitting there in court and they're like why are we even here. That's a great point. You just made because he was just basically saying here. Look you know we were doing something in our is that we thought was helpful. And i'm reporting this because we were doing something good so i mean but yet at the day they're sitting out on a defense table looking at twenty twenty. Hindsight is like doesn't look that good roddy now. The other part of the video is that the video was leaked by someone connected to the defense. And i think it was. One of the mcmichael's leaked the video believing that that would clear everything up for them. And that's the part that is always taken me aback for a second. And i'm like even at the point. That d'amato aubrey is dead. There's an investigation. All the controversy with the different. Da's involved in the but before this becomes a national an viral hit that the video has to be released. It's leaked by someone connected to these defendants. it's not leaked by prosecutors to me. That is unbelievable that they believe that video is great evidence that nothing illegal happened that day.
