Interestingly, so we've had, we've had Christmas in California. We've had Christmas in Texas. This one, for the first time, we're doing Christmas in New York. Which we've talked about doing for about three years. For a long time since before COVID, but interestingly, things are going to be a little weird, a little wonky. Why? Because it's supposed to be colder here where we live in Texas, then in New York. And so I thought that we were going to have a white Christmas in New York and all that. Don't get me wrong, it's going to be frigid. It's going to be very, very cold. But it's supposed to go down to 15°F here where we live. So our plants are pipes. Our pipes are plants. We've replaced our palm trees. I can't tell you how many times. So I mean, the point is that Texas is not equipped. New York is equipped. They're ready for it. They can handle snow. They got the shovels. They got everything going. But here it's a calamity. And we're not going to have snow at all, but we are going to have very frigid temperatures. So it's going to be really fun. We actually have we have our three kids with us. We have my son in law, Brandon. We also have my business partner and friend Bruce Cooley and his mother. So we're going to be kind of like, what's the gang of 8 or a gang of 9 traipsing around New York City?

fatal mistake is outrageous Alan Dershowitz our guest professor Dershowitz at one point called the first degree manslaughter charge in the killing of Dante Wright a racist prosecution of a white woman professor Dershowitz joins us on the Jim bohannon show Professor welcome Good to have you on with us tonight Well thank you Merry Christmas and happy new year to everybody Happy Hanukkah asked for all those who celebrated konica but this is a very sad day Let me tell you The worst thing was not the jury verdict Jury verdicts are unpredictable jurors or 12 people They can do anything It was this judge this judge who through this officer in prison without bail that was lawless that was unconstitutional That was illegal and it was immoral What is she going to escape What is she going to do get another gun and kill another guy She has a very good appellate issue He had and the idea that the judge would lock her up pending appeal is an absolute outrage I would agree with you I'm glad you centered on that first That's a tell on this whole thing And again you and I have talked about this early on you've written about it You've been all over the place This is an egregious egregious thing that was done taking a man's life but the judge Ellison and the people outside professor two listeners may not know but I saw the prosecutors say 7 years is the usual sentence for this which would be outrageous But they want to seek a much higher sentence for this Look they want to please the crowd They want to make sure there are no riots or demonstrations This is not American justice This is Chinese Cuban Baylor Russian Iranian plead the crowd This has nothing to do with the constitution the Bill of Rights or the American system of justice or the rule of law This is lawlessness at its worst Everybody is at fault here The prosecution never should have brought this case The jury never should have convicted The judge never should have allowed the conviction to go forward and the judge never should have denied her bail Everything is wrong with this case And I hope it's reversed on appeal and I hope when the court reverses in an appeal that really sends a powerful message to all the participants in the case that they abuse their power and the abused the American system of justice I have to tell you I have been practicing and teaching criminal and have been nearly 60 years I don't think I've seen a worse abuse of the legal system than this one And remember to I'm a guy who constantly cross examines cops I take on the police I help put some corrupt policemen in jail I'm not kind of guy who's generally seen as supportive of anything the police do But in this case here you have a woman 27 years serving with distinction As far as I know she's never fired a gun while that's accurate For the first time in her life she's confronted with a life and death situation She could have made a mistake either way One mistake is she could have shot when she shouldn't have shot The other mistake is she didn't shoot when she should have what if she hadn't shot What if she hadn't tried to tase him And he had gotten into the car and he grabbed the gun and shot everybody or got in behind the wheel of the car and drove off killing the police officer who was on the other side of the car and three pedestrians Would they have indicted her also for making a mistake Was there no way that she could have done the right thing I mean how is this case different than the case of the shooting of the camera person in the filming of that movie with the actors Yes In this case different than the other Somebody's dead There was a mistake There is a big difference See how golden case is much much more criminal And the outboard in case somebody did something wrong somebody failed to check the gun somebody and it was real I mean there was a decision somehow somewhere not to check gun not to do the right thing Here there was an instantaneous decision that had to be made and I don't think anybody's going to be prosecuted in the Alex golden case because there's no racial element there No that's right And professor two Any kind of defense When we see the woman distraught immediately after what she has done immediately but both on a legal sense and on a quasi human sense if you're on a jury or if you're involved in this you got to look at a record the entirety of this and we have other remedies She's kicked off the force It's a Civil War There's other actions that will punish her for something where a man's life was taken away to your point maybe unnecessarily It's stunning Ellison in this though tonight have been brought him up I think the judge really is front and center here And that's probably why I agree.

So and I had that on my list. So this certain songs that I just kind of borderline songs, right? And some people like hallelujah is hallelujah. Now, I know it's a biblical song. And it basically is about Samson and Delilah. She puts him in the chair. She cuts his hair the whole thing. It's not a holiday song. So it's a biblical song, but it's not a house. I'm not even sure that I call it a biblical song. Well, it's basically a story is kind of like the Sampson and Delilah story in the Bible, right? But like they sang it at my daughter's Christmas recital tonight. Why Is Snow White?
"Brain stuff. Lauren bugaboo one of the reasons the people loved snow is that it coats everything in a blanket of as white whether reporters will say that we might be getting some of the white stuff and every december. You're likely to hear the song white christmas over and over again. But if you think about it. It seems weird. That snow is white at all since it's just a bunch of ice crystals stuck together. So where does it get. Its distinctive color to understand where this whiteness comes from. We need to back up and look at why different things have different colors in the first place. Visible light is made up of many different frequencies. Light our is detached different frequencies as different colors and different objects have different colors because the particles that make up the object. It's atoms and molecules react differently to different frequencies or colors of light. The molecules and atoms absorb certain amount of light energy depending on the frequency of the light and then emit this absorbed energy as heat. This means that any given object absorbs frequencies light more than other frequencies. A couple of different things can happen. The light frequencies that are not absorbed in some material when a particle remits the photons they continue to pass through to the next particle in this case. Light travels all the way through the material which means the material will appear to be clear. Oh like a flat piece of glass. However in most solid materials the particles recommit most of the unabsorbed photons back at the material so that no light or very little light passes through and object appears opaque the color of an opaque object is just the combination of the light frequencies that the objects particles did not absorb though the remitted light can be distorted on the way out and that is why although ice is mostly clear. Snow is mostly white. Let's back up again and look at an individual piece of ice. Ice is not transparent. It's actually translucent. This means that the light photons don't pass right through the material and a direct path of the materials particles. The lights direction. This happens because the distances between some atoms in that isis molecular structure are close to the height of light wavelengths which means the light photons will interact with those structures. The result is that the light photons path is altered and exits the from different direction than at entered. The ice snow is a whole bunch of individual. Ice crystals arranged together. One a light photon enters a layer of snow. It goes through an ice crystal on the top which changes its direction slightly and sends it onto a new ice crystal. Which does the same thing. Basically all of those crystals balanced the light all around that it
