Patent Pending: How the UPTO Office is Expediting the Time From Submittal to Approval

"Welcome everyone to another episode of. It visionaries and today we have a new type of guest we have the cio of the us. Patent and trademark. Office jamie holcomb. Welcome to the show. Thanks a lot. I'm honored to be included on your podcast. I'm looking forward to our conversation. There you go in. You're a west point grad as well. I am nine hundred eighty five well the bringing that up because every time i talked to someone west point they're like the overly index successful. You know. I'm not from west point. But i i've met everyone i'm meeting west. Point overly index is accessible. So we're it's gonna be awesome to hear your career all the way from west point where you are today as cio of the us patent office. I'm looking forward to that journey because it certainly has been a hell of a ride so let's get into it right out the gate because typically most people don't i mean most people got outside of government work they don't think of government offices as forward thinking transformative you know. Most people think of the government offices. Slow moving stodgy. But you're trying to change the us patent office. Talk to me about what you've been up to. In the last few years since he took over as the cio there. Yeah thanks a lot. What were june at the us pto which is different from. Where else is trying to be as innovative as the applications that are coming in we should be known as the innovation and so because of that and because of that tagline. I'm really using that to transform the whole culture. From one of huge competence. That the first thing that happened. When i got into the us pto was. I realized that most people have an average tenure of around twenty years. And you're like wait a second that everybody's leaving nano people at the. Us patna final trademark office. They stay for thirty and thirty five years before they retire. And that's unheard of. So we're taking this workforce of thirteen thousand individuals who have a highly competent background and experience knowing exactly what they're doing and i'm trying to tell them. Wait a second. We need to do things differently. And they're like whoa wait a second. We've been doing this. Since the inception of our country in fact number one was for an agriculture compost and george washington actually signed it. So they've been doing this for a long time anyway. I am really asking them to get out of that. Government bureaucracy credentialing compliance and regulatory mode. What i'm asking them to do is think differently. Make your decisions and thought process about three different things how you can do them. Better cheaper and faster and so. That's really what i'm asking. That's the culture shift that were going for. Because in essence it requires that commercial mindset in order to change the way people do their business. And so what are the other things that unique about. The patent and trademark office is the fact that we are fee funded. We are not taxpayer-funded so we have an obligation to make sure that every penny of that and all those fees that are paid for both pads trae bar throughout a life of the patent trademark are used in squeezed so that the f. payers get the biggest bang for their buck

US army officers I've met in wars have told me they carry that code through life they've explained that will not lie includes with general Maxwell Taylor who was superintendent of west point called quibbling evasive statements for the use of technicalities an officer doesn't find clever ways to avoid telling the truth a soldier asks is the enemy behind that hill and an officer knows they've actually done again on top of that hill the officer shouldn't say not really a west point grad is supposed to answer with the truth they know is crucial not crippling evasive statements last Sunday when secretary Pompeii always asked by ABC's Martha Raddatz about the conversation between president trump and president Solange give Ukraine and the report of an intelligence community whistle blower about that conversation the secretary said so you just gave me a report about an icy whistle blower complaint none of which I've seen the secretary told the state department briefing I haven't had a chance to actually read the whistle blower complaint yet I read the first couple of paragraphs and then got busy today. it wasn't until Wednesday after report in the Wall Street journal that he'd been on that phone call my secretary Pompeii finally said at a press conference in Italy the entire truth about that conversation you said I was on that phone call. most politicians can be a vase it's part of the parlance of politics but Mike Pompeii always a trained soldier who conducts the foreign policy of the United States secretary Pompey was been asked to comply with subpoenas request for records you may wonder if he will use his skills to dance slide and Mr wrecked or be as honest and direct just the west point honor code he knows my heart..

"Com now he was the man who's been recognized that the recipient of the one but two stages Marconi awards for his broadcast the one in the old the old coming joining us now is army captain **** Tyler merit is a west point grad army veteran CO veteran apparel company called nine align apparel and he's posted a few comments about the Mr piano and others and first of all captain Tylor merit welcome to the bill Cunningham show and I am very thankful if your service to this nation welcome thank you for a Mister all right done recently Megan Rapinoe now there is one of the most disgusting things I saw among many was the behavior of the women's soccer team in the locker room after the game did you see the you tube of that one I'm glad that I did not don't know you're talking about thank god you didn't see a dot right after the game the women who just beat the Netherlands last weekend what two to one our Tuesday Tuesday up I'm sorry in the locker room alcohol twerking simulated sexual acts dropping the F. bomb and I thought well consider me old fashioned but I open doors for women I pull out the chairs are my wife I think women are special different than men and it is there something that I person male or female should do one representing the United States of America I know David Ortiz with the red Sox used the F. bomb after the Boston bombing but that was the red Sox but what when I think of the flag that you wore in your uniform and west point in services country as a captain and I think about US Olympic teams other men's or women's soccer team when you represent represent the United States of America is our special behavioral norms that should be followed yeah he hit the nail on the head and I think that's what rolls back to what we consider common sense you are representative of the country are presented of the military and you want to put our best foot forward that's the whole idea of teacher to them right it's it's a love of one country and countrymen and it's supposed to be demonstrated for acts of kindness and concern for well being not out of the self centered I want to get a ton of internet popularity whether it's the right intention or the wrong intention I I teach my children you know there's good attention and that attention and this is the pure definition of bad attention you're distracting from your team and your teammates because not everyone of them hold your exact same beliefs I guarantee you the individual picked up the flag and proudly displayed it did not have the same beliefs as you and she went on to go and say that she's not a visit with the president the office of the press the United States but she's gonna instead to see the people that she believes has the country's best interest at heart which is turning off they want to watch sports and look at these athletes and say well you're an incredible athlete but you probably no offense to her don't know what you're talking about when it comes to politics no question now and another issue she was our with Anderson Cooper several nights ago and she's done many interviews sense and I have difficulty with politicizing the United States of America soccer team because I like to watch women play soccer and when I watch women play soccer I look where the ball is a position I think now about politics whenever I see a Nike swoosh what I think about is the Betsy Ross flag I don't have but they're in a commercial enterprise that's completely different Hey as far as the numerous interviews she's given saying she she said at the New York City big rally that we got a hate lasting love more we got to come together then she tells Anderson Cooper repeatedly slamming the White House they're very divisive policies of president trump she won't go to the White House which is giving a shout out the Nancy boys in a see explain to me how thats not more hate and not less what she's saying one thing and doing another or if you actually listen to all the things you're saying that all in generalities there's no specifics of president is a hateful man he hates gays and lesbians but the less than thirty days ago he posted a tweet during the gay pride month saying that there's a trusted these occurring all around the world towards gay and lesbians get the in seventy three countries homosexuality is illegal in thirteen of those countries if the death penalty she had that world these platforms and she's a lesbian self proclaimed very adamant I'm I'm a lesbian and I'm here to protect other lesbian than Donald Trump is not helping well he put on an olive branch if you really want to use your platform for the good of other lesbians like you say then why not join the presence you know what in Nigeria yeah my my wife is actually are Nigerian if I want to go back there and see my kids became how lesbians you know they could be killed here that that's horrible you shouldn't kill anyone for any reason and I come from a place of four measures that's not a reason for it so if you want to use our platform for something why not that because she doesn't care it just like happening all they care about is the five second stand at the eagle check from Nike is gonna capitalize on the on the controversy and it's just gonna repeat itself until the United States get smarter when you were serving did you serve in Iraq and Afghanistan or just one of other than Iraq Afghanistan South America the Redington into all around to the most horrible places in the world not tell you from first hand knowledge that we live in the greatest country in the world hands down well we're not perfect but we're far ahead of every other country and so was there in your city parade for the veterans that came back in in two or three pieces was there a parade for captain Tylor merit was there a parade in New York City for your platoon because you gave so much and sacrificed so much blood sweat toil or that the you're you're the real hero Megan Rapinoe is not a hero of mine but none of she is not at your own she's not brave I know brave men and women and a and I know that the ones that I care about and the one that I I call my friend they're extremely humble you know the ones that are missing their lands the one that had metal honors on their on their chest you know it's not about them it's about what they represent in when they accept awards or when they're there to be celebrated they always tell people that it helped the people who never able to come home that's the should be celebrating I was lucky to be able to come home to this awesome country and this person comes back in and just immediately starts spewing hatred as opposed to saying Hey you know what Mister president that's your big be Frank I would love to sit down and have a dialogue with you the people don't wanna dialogues with individuals of different opinions because they get frustrated and they get loud and they think they win the argument they just got louder in in in I'll never win that argument you'll never went naked sacks no longer become part of the equation you said on this posting captain that she quote she's a tremendous athlete with a huge platform and instead of using it to divide Americans and tear down American values she should be using it to help repair our sense of patriotism and our national identity and of course that's exactly what's happening on Oscars and Grammys at Tony's universities colleges late night television the view morning television CNN MSNBC it's all about one thing which is saying that trump whatever it is because of tribes out of office then the world changes fundamentally to their way of thinking and I think not so much better and one other old fashioned concept at the New York City rally there were literally tens of thousands of individuals in front of Megan Rapinoe in the U. S. women's soccer team and she talked about coming together as one and we need more conversations which is an opportunity to have a conversation with the most powerful man in the world to refuses to do so so she has no desire she wants to say things but not do things but one thing that really offended me and said she use the M. F. the two words shouting into the microphone and this is in front of I don't know several thousand girls there were soccer teams all over Connecticut New Jersey New York they came in for that parade and she's shouting MF and the microphone and being applauded by the fellow members of the soccer do you find that someone in appropriate but I absolutely disgusting hi I have two young women that my house two young girls it and I'm reading in the very strong women you know through education and my wife he did then we keep them about that words we teach them about you know could be easier and I hope that they find role models other than these individuals which have no respect for for for anything instant so now he's he's not a hero the speech was ridiculous and I don't even know why people want to continue to talk about her of the fact that she did not like Donald Trump and that gives you apparently a or world stage you don't like Donald Trump you can talk the blue in the face and you become a subject matter expert Colin Kaepernick is the moral compass of Nike I why not let let this person the the the the voice of the downtrodden as well in a bunch of privileged individuals who never wanted for anything never needed for anything and all they care about it themselves now lastly captain merit there was a posting on some websites about those not chosen to be on the women's soccer team and which I think is quite sad I would think the soccer team would like to have the best female soccer players in the world play but it's been reported on fox news and elsewhere that a soccer female who's a Christian who would not wear gay pride Jersey in Portland Oregon during the match was kicked off the team her name is Joe lean Hankel twenty six years old a native of Colorado who by the way is African American and she was on the NWSL which is the national women's soccer league championship team she's been called by objective observers as the best offensive soccer female player in the world and she said in a posting after she was before she was booed in Portland court I believe with every fiber in my body that what was written two thousand years ago in the Bible is undoubtedly true S. world may change but Christ and his word will not world whenever Christ and his word will never change and when she posted that when she was introduced in Portland she received thousands and thousands of booze she played very well but after the game she was gonna released and it was pointed out that the the problem was she didn't fit the culture of the team now the head coach of the team is a lesbian a self professed married and most of the team I'm told are lesbians were frankly I don't care about that I just play soccer but it looks as if a African America talk about diversity an African American Christian was kicked off the team for professing Christian beliefs and that's not well covered in the media isn't absolutely not and and that's what we're talking about is the is a major shift right so there was a time when gay and lesbians are persecuted and killed and that's just wrong and and I I go to church and I try to listen to what is being said and I think our pastors at the best a year ago I want to talk about this issue and he said it's not our place to judge and very clear heads that is in many different religious texts that's not our job if your religion and to Beijing you believe in a higher power it is.

"Here host and creator this amazing program known as the takeout. Welcome to the takeout cable this week. We have Jack Reed Senator from Rhode Island democrat. He is the ranking member of the Armed Services Committee spends a lot of time traveling to learning about Afghanistan and Iraq, he has been doing that since those conflicts began interestingly, one of the few senators to vote against the authorisation use of force in Iraq. We'll get to that and terrorism and counterterrorism related issues. We're at district taco right near Capitol Hill through many people here this morning. So it's going to be kind of silent not as much restaurant noise that you might be accustomed to. But maybe they'll show up once they know Jack Reed readers. Here. You know, the crowds will begin to form Senator. It's great thanks for joining. Thank you great to be here. So a bit of your biography, West Point grad army, active duty, paratrooper nineteen seventy one to seventy nine where does that take you? When I graduated West Point they had a program where they five percent of the class could go to graduate school. So I went to the Kennedy School at Harvard and then two years later, I was done at Fort Benning for airborne ranger in schools. And then I had my command time in the eighty one division. I commanded Bravo companies like five oh four th parachute. Infantry regiment. I learned a lot about being soldier and paying attention to your subordinates who usually knew more about the topic than I did. So and that was invaluable lesson. And then I finished my assignment at Bryant went back bedding for a little bit more training and then finished my career at West Point as an instructor in the social sciences teaching at no time. Did you go to Vietnam? No. This was one of those. Issues of timing really in sixty seven when I joined the army started at West Point. We all well, my classmates, we'd be in Vietnam. We were building out. We were with the significance of commitment, then in nineteen sixty eight president Nixon was elected sixty nine to begin the process to shift the responsibility to be at the maze of forces and the class of seven eight before me could choose a unit in the way. We did it back. Then was you chose a branch I chose hypocrite. Then you choose a unit. My classes essentially told that no the units won't be there. When you're able to go which would mean about six or eight months after graduation when you've had your training. And I feel my classmates did go over problem saying somewhere between ten and twenty but the class did not go over. However, those that stayed in my classmates were Lieutenant colonels visit storm and general offices in operation Iraqi, freedom and operation, Enduring Freedom. They did it spur job. What was the shape of the army at that time that because I've referred to this on the ship before my oldest cousin buried at Arlington. National cemetery was in the artillery, the tours volunteered both times and Vietnam made a life decision in a courtesy to stay in the army after Vietnam because he thought the army was a mess. And he thought that the junior grade officers needed to stay who were disciplined and who cared about the army to try to see it through this very difficult period. Well, he deserves. Craze beyond praise because frankly, the army was a mess. I was at brag we were the elite of the military you had to volunteer to be a paratrooper. So this was not just people who drag in they volunteered in many cases to join the army, then the second volunteer to become a paratrooper and still we had problems with our just our ability to fight our equipment, techniques and train. We was plenty of discipline was significant problem, we had problems with then with alcoholism and other than drug abuse, etc. And as I said, I was fortunate to eighty was probably the best resource unit in the army at that time. If you went out to other posts, it was even worse when I was a cadet I actually was doing some training in Panama, and I was assigned to the fourth tenth infantry. And I was I was. Sort of acting tune leader. And the union was understaffed that our company commander was a corps of engineers Lieutenant because we didn't have enough infantry officers. This is nineteen sixty nine Panama. But it was it was an army disarray. And there were people like your relative and others. Got people like Barry McCaffrey on the two young Kenner colonels who decided that you know, they were going to dedicate themselves and.

I got a couple more things to get one about the molar probe which is completely falling apart right now, which is great news. Folks, we the people holsters finest custom-made holsters out to they sent me a sample early in the game and the people who sell my aunt said you interested. I said this holder, his holster his awesome. I love it. We the people holsters designs their own holsters in house. They don't use third party molds. They design them right here in the United States in Las Vegas. They cut every mold to fit each firearm with precision, they update their designs constantly, they have the constitution design on their the thin red line Cam o- one these are beautifully designed holsters, wait till you get it. You're going to be like bam. This thing is nice. It has an adjustable can't and adjustable ride that way, you know, when you put the independence holsters in those cheapo ones, you give them the story. You can't adjust them rides up on that hip bone. You like this is uncomfortable. Not we the people holsters you can adjust it beautiful. You can also just the tension. You like you're a little more secure in the holster fine. Just turned the screw like little looser. Just turn the screw. It's as simple as that. "We continue our midterm election coverage here on WMA L. I'm joined by Stephen Moore is with the Heritage Foundation economics guru and also a advisor to the Trump campaign and Trump administration. Steve good evening. Hi, Larry looks like it's going to be a ripple not a wave. Yeah. That's what. And again, we need to go back to what the definition of. I listen. There are some networks that are saying, well, we know for sure now that the Republicans will take the majority in the house, and the Democrats excuse me, and that could very well be right, again, the Democrats just need twenty four seats. That's right. Ronald Reagan his first mid term after his huge win in one thousand nine hundred eighty he lost twenty six seats in the house and he gained one seat in the river that race because the Konami that was November of nineteen Ninety-two for people to remember the economy was horrible ninety wasn't till nine hundred ninety three the big rig and boom began Reagan ran on stay the course. And and and the losses were not very significant. Democrats may not it'll be interesting to see whether they pick up twenty six seats in the house. They may not they may get the majority by less than five. They may all right now, the Republicans are up plus two I believe in the Senate in the Senate. They have picked up too big. Code right, coda, and Indiana and Indiana was one that Emma Kratz thought they had that one, and that's an incumbent democrat Donnelly loses. You don't to I was mentioning off the air you when you get a big wave election like the Republicans had in one thousand nine hundred four two thousand ten the comments of the party of the wave don't usually lose in those situations. You you hold all your seats in the box, and that's not happen tonight. Now, look it's still going to be it's not going to be a good night for Republicans. But it's not going to be the disaster that they bought well. And that's the thing. I mean, that's why I want to go back to this definition of success. You know, if if the if the Republicans pick up seats in the Senate, actually, actually grow their majority in the Senate, and they end up losing the house by a slim margin. But by the way, let's look at Florida. That's the one we'll go watching all night because of that could be another Senate pickup as governor Scott still up. He is up right now by less than one percentage point with ninety four percent of the precincts reporting but the governor's race which. Was something. Oh, the Democrats could taste. They're superstars and right now to Santa's is up by one full percentage point with ninety four percent of the precincts reporting. What is it about Florida? Hanging chads and probably gonna have to have a recount in Florida. And this is you know, we remember this, and and so many elections in Florida. It's such a it's such a divided state when it comes to these statewide elections, you're so right, though, in terms of what what is what how do you define this big momentum changing statement election that the American people are telling the party in power that they've had enough. I'm sorry. This is this is a mixed message. We're also seeing you know, I've just been, you know, obviously, folks, these we haven't even gotten the west coast state. So we don't know the half the country solo have. But it appears just in looking at what's happened so far as a lot of us predicted, the red states are red and the blue states are getting bluer. And the Democrats are picking up know, the Virginia's a problem for Republicans. Isn't it Larry because they've lost? Now, the governorship a number of years in a row now they've lost. They've there's two democratic senators Republicans have forgotten how to win in Virginia. Yeah. I'm I'm kinda tired of people saying that Virginia's this purple stains. It's blue. In virginia. When I came to Virginia was it was a red state, then intern turned purple now, it's unfortunately blue as of now, as you know, Barbara Comstock, you heard at the top of the hour news there. Barbara Comstock has lost her race. Dan brat. Dave brat in the seventh district of Virginia is still neck and neck ninety seven percent of the precincts reporting right now, it is Abigail span burger forty nine point seven day breath for nine point one. Now, here's what's interesting. It's at this point in the vote counts where you start going to the absentees in the military. You've got to think they've got a lot of military ballots. That's a millionaire district. It's a big military area. And generally, speaking military votes will go to the Republican, and certainly one that is been so strong for the military is Dave brat. We've put some feelers out to the brat campaign. We know them we've asked them some questions we want to know where they are right now. Whether they're looking at Virginia election law, what triggers a recount, if they have an idea of where those military ballots are, and I sure hope they've got plenty of lawyers who were watching every single precinct. I mean, we're we're watching so many racist tonight though. I mean, we're watching those to Florida races. We're watching Michigan. I I I'm that's my upset special that we may see James a African American West Point grad, maybe Beata lifetime. Debra. Incumbent and she'd been there since nineteen thirty absolutely nauseating, Baidoa workout so much press coverage as a democrat running in Texas, John James, a just an incredible. By the way that Texas Senate race is with appoint isn't it? Yeah. Let let me give you the updates on these races right now in Michigan forty percent of the precincts reporting. And James, John James, the challenger Republican is up fifty point one to forty seven point eight over incumbent, Debbie stab? Wow. Swinging down to Texas all eyes on Texas. Seventy four percent of the precincts. Reporting for the Senate race there. Ted Cruz, the incumbent Republican is up fifty point four to Baidoa rooks. Forty nine percent. All my God. That's way, too. While the pollsters were saying it was about a four or five point race in favor of grew. So he's under pro, but we don't know again, folks when we when we say with sixty percent of the precincts. We don't know what precincts they're talking about. Right. And so that's always remember on election night two thousand sixteen and nine o'clock. Trump was losing North Carolina was losing Ohio, releasing Florida. District's game. So we don't know we don't know where those votes are coming. Here's what you need to know in the Senate right now in terms of totals as of this moment Republicans have gained two seats in the Senate Democrats have held the other seats that they were up where they have not gained any seats in the Senate. They thought they had a great chance of winning Tennessee. It looks like I don't think they've they have now officially call Marsha Blackburn held Marsha Blackburn and say, well, that's a hold a hold for Republicans that was breeding send versus right the incumbent who decided not to run co Coburn corker. Thank you very much. The man who brought us the Iran, but Democrats really great chance of winning that race they recruited Britain Sunday. Ronnie was a moderate democrat big it looks like it's about eight to ten point lead for. Yeah. Actually as of now, she's up by ten points in that race. Now, not so not here. This is what's important for everyone. As we follow the Senate, those two pickups, Indiana, North Dakota, very important for Republicans. One more pickup. It could be in the making in Florida. You're right. So that could be a plus three. Now, you got to look at the holds the you need in the holds you need our crews in Texas and in Arizona, that's an open seat that was flakes seat. And it'd be a pickup for the Democrats. If if if the Democrats were to win it, and that's a very tightly watched race as of now thirty eight percent of the precincts. Reporting in Arizona mix. Sally, the Republican is up forty nine point three to forty eight point five other nailbiter. But here this is part of my broader message here. This is not a Blue Wave. This is not as soon NAMI. When so many of these races are so incredibly close when they're so incredibly tight that means the next election cycle. They could go the other wet Democrats just picked up the Kansas governorship. So that was one co back was a big Trump supporter. He lost that race. So that's a big pickup. I mean cancer pretty red state for the governor's..

"I watched this documentary on the plane with bub. Miss is really, really good. I have no idea that people were protesting him. Oh, and stuff near the end. How do you protest Mr. Rogers your stand at all. But I love all the rumors. He was a marine sniper. Stuff like his arms or covered in tattoos. He's like. Like dude of all time. Yeah, it was a little store. Sweet guess now's bad time. Tell you we're very anti Mr.. Literally what we're all about. All right. So we're here with UFC champion, rainy Qatar, and also most people, I think most people know, but they don't realize how long you actually served in the army. Your army ranger you from eighty eight right to eight. Yeah, it was. I never went to raise your school though. That's a common misconception here that a lot. But like Like Mr.. Mr. sniper last duty station was one hundred. I with one hundred percents born, went to result school p. l. d. c. there and and all that stuff. But I spent most of of the six years that I was in a wrestling, representing the army, beaten up, marines, and navy, and air force guy with the interservice. We're both marines, but usually in wrestling and boxing 's the army. Whoops. The shit out of the Marine Corps nowadays back then the Marine Corps was the team to beat. They had an amazing number had a fulltime team in what you did back did. Yeah, they were all stationed at Quantico and Greg Gibson th the list of guys on that team were amazing and they, they had won the inter service championship for quite a while. And then finally by the end of mindless. But my my last year at the inter service championship, we beat them. That was the first time we lead in the Marine Corps team in the six years that I was in. We were going to now now we have w cap program. Sean Lewis. One of my old teammates runs the w cap program for wrestling progressive freestyle and women's freestyle, and and they literally win an army. Bad has absolute other things are other co as a West Point grad. And he was saying how everybody there goes through boxing school, which I think is something that every service should do period. I know that there was a bunch of people that were in the UFC mixed martial arts that really helped design the combatants for both the army and the marine. Do you have any role in any of? I've done a ton of seminars with both Marine Corps martial arts program and the army combat was program at a bunch of the various schools. The emphasis shifted. It used to be very Brazilian Jiu due to oriented..
