"Right and you're only as strong as your weakest link that old phrase and the complexity of trying to build in protections best practices understanding who to go to building the scaffolding so the blessing and the curse piece of this i think ads the department defense at one point had twenty thousand sub networks inside our enterprise network that's not good for security anyone who tells you that you have security by complexity because it's a mess and no one will be able to figure out they really don't know what they're talking so one point for the journalists who may have that thrown out sometime this idea of info ops is actually from my perspective the most fear inducing right because the the states they're more buttondown and protecting from hacks than people think but infiltrates or are hard so for example in this hearing a couple of weeks ago senator rubio laid out this mariam which there actually was not a single successful hack of any system however the russians or as you know it can be the north koreans or the your own ins conducted a huge info ops exercise that said actually we did hack all these things none of the results that you see are legit it's all just a lie and they do that very effectively how how nervous are you about that and what would we do if that were the case how the us respond to something like this is the most complex thing right how do you particularly in a climate of distrust distrust of institutions whether it's those administering the elections whether it's the press who has to report on the elections that is the nightmare scenario the other i think this was senator rubio's hypothetical in the hearing which was actually my nightmare scenario leading up to the twenty sixteen election and that was sowing chaos at the actual physical polling places by having eric rosenbach show up and say i'm here to vote and i live at smith street and the election officials saying well i'm sorry i have eric rosen back at whatever brown street and you know there's questions about what they're.

"Voluntariness as as you set right the where the government we're here to help you know great great words that you never really want here then the you know the states have to be willing to accept voluntarily that assistance from dhs and if you don't have that trust relationship will that's not that's not gonna i think that is an important part of it and that involves states being willing to cooperate it involves dhs and you've you've seen more of that i think as time goes forward and those that infrastructure that scaffolding develops that type of relationship that you see i think more closely in traditional law enforcement where it's it's not shocking that the fbi cooperates with local sheriff's department but that hasn't been the case store the elections area and so it's it's been a new process for some of my colleagues to work through and both ad in the local states and then we of course at the states deal with us on a regular basis because in most states elections are actually a local government function and so while the help america vote act and others have kind of centralized some of that most of us deal with individually selected local lecture officials over whom we have no direct control so in colorado i have sixty four county clerk sixty three of them were elected ones appointed by a city and so i can't control them so we're used to this tension and now we add the state to the federal tension as well and it creates takes some time to work through that but it's critical that we do because of that information isn't shared if if we don't have the ability to work together to dress issues then we're vulnerable there's there's a lot of trust that needs to be built in all those relationships and i have to say i've been working on national security stuff for almost twenty years now this issue trying to protect the election infrastructure and democracy is the most complicated thing i've ever worked on if you think about the threat the technology the politics the federalism you know all these things info ops it is really complicated building trusted relationships i think are important parliament and let me add one other part.

"Who actually knows how the process works we saw that in february when our national association of secretaries of state had a meeting classified briefing from homeland security they're actually able to share with us information and they took the step of giving it one day security clearance for those didn't have it so they they've been much more flexible and much more communicated to give us the information we need to make decisions info from them we did there's there's always you always want more times but certainly it's much better those of us in the leadership of the national association secretary of state had you know a small sitdown meeting with sector nelson and so we first time that's been able to occur and that we've actually met with homeland security so we feel like we're getting much better response we're getting more communication they're in the process of approving security clearances for it and other folks at our respective states we've always had a good relationship with the field people of homeland security they've always been very helpful in my state we've actually had the national guard present in the last two elections november there with us as part of monitoring issues that came that come up we just had a deep dive by team of five people spent a couple of weeks with us trying to penetrators systems and then we let them in to see if they got in what they could get to if they got in and so we got a great report from them so we've been very proactive in seeking that out not every secretary has had that same type of relationship with homeland security but in colorado we've kind of taken the approach that if someone's willing to offer some how we wanna get it and you know will look at all of it but we we know that we've got some good systems in place and i think some of the nation's best but the bad guys are continuing to work on things so we need to continue to work.

"We found out the number twenty one eight months or so after it occurred so three or four months of the vob administration three or four months of the trump administration they then when when we're questioning them how could you not tell us the response i got from homeland security was we didn't know who to tell now finding the chief election officer to state is not hard not only that there's at least two federal laws specifically say who that individual is so even if you couldn't use google or some other search engine i don't i don't want til one way or the other depending on who's here but even without a search engine you could find out who it is so there was some initial very strong feeling of upset from the the elections community because security didn't really seem to know what they were doing the elections area that has improved over time according to council exists now my elections director was one of the first people on the executive committee for the hiring of matt masterson left the by homeland security to me as one of the most significant things that has happened in homeland security i recognize there's all these other things that are important but for those of us in the elections community knowing someone who used to be partially in charge in ohio is one of the deputy secretary states there and then wasn't election assistance commission did outstanding job in that position by all accounts and having him hired by home security now gives us some confidence there's someone there.

"In the white house was really kind of take that framework particularly when it involved a domestic cyber incident bring all the stakeholders together around the situation room table and kind of work through that framework so from an intelligence perspective what is our common picture what information does the fbi have does the cia have does the nsa have does dhs have to understand the threat picture and the particular actions of the actor involved in that incident i bid of deviation from the framework i just laid out unlike in the terrorism context the government does not have near perfect information on who those actors are we have to rely in the cyber context on information from the private sector from states who have had an intrusion so that is a piece that's different right and so we would need to come around that table understand as much as we can pull that intel silence about the threat actors and then figure out how we can get more information in many instances that would involve the fbi or dhs going to that private sector victim going to that state and trying to figure out what they know about what has occurred so that's intelligence picture the attribution issue it is a challenge it is not as much of a challenge as it used to be but the issues here involve oftentimes real tradeoffs and real decisions about what we can say with what confidence we can say it about who did a particular militia cyber activity and in many instances the government may know who that actress may have a certain level of confidence but there has to be a discussion about can we lay out that full case if so what intelligence sources and methods does that implicate and what's the tradeoff do.

"Sure look i think you're quite right that we do not lack a framework let me step back a little bit you know i would come to these issues from the perspective of somebody who grew up in the justice department and grew up in our immediate pre and post and now more distant post nine eleven era right and my perspective was was one of taking a lot of learning and changes that we gained in looking at an addressing the terrorism threat and trying to apply that to addressing the cyber threat did that when i was chief of staff to bob muller at the fbi when i led the national security vision and created the first network of national security cyber prosecutors there to really much like we did in the wake of nine eleven creating terrorism prosecutors getting a framework for identifying this threat understanding it from an intelligence perspective first and foremost so we know as much as we can know about the threat the actors the tools tactics they're using and then applying a framework that said we will understand it we will attribute it where we can and lay that case out where we can and then impose costs but us all of the tools of national power to do that military intelligence diplomatic law enforcement financial sanctions that is the model that we approach it from that i approached it from now the that's the kind of that's the the broad framework and the role of the homeland security counterterrorism by.

"One hundred percent on the homeland security counter terrorism and cyber security issues but rather being subsumed within the national security council so that's more to come really on what that role looks like in the next generation but that was kind of my immediate reaction on cybersecurity my own perspective is there's been even with all the chaos that many of you have written about in terms of the first whatever fifteen sixteen months of the administration i think that there has been relative continuity on cyber security policy and i think some very good things a lot of focus on attribution and calling out bad cyber actors get wannacry not pecchia attribution imposing costs on cyber actors not across the board but that seems to have been the focus and there's nudie and keeping the executive order against militia side fiber activity so lots of points of continuity i worry that a change up in this role does not portend well for continued progress on things like developing a deterrence policy developing the framework that we talked about last night so if this halts progress or throws sand in the gears on what i think had been a pretty good start on the cyber security front that's concerning as well so about this panel as you have someone like lisa who's been at the height of the federal response to cyber homeland security things and they also have wayne it was a secretary of state and it's been interesting to me because i didn't know a lot about the secretary of state role before i started working on this project about trying to strengthen election systems but this is really the pointy tip of the spirit when it comes to defending election systems and so when your team colorado's very good essentially recognized as one of the best in nation can you explain for the reporters in particular this system of systems with elections because too often people focus just on the electronic voting machine and it was actually way more complex than that.

"Has happened already today is that tom bossert who is the homeland security adviser essentially had the role the lisa held when she was in there either resigned or looks like was pushed out and so just want to ask about that immediate reaction what what do you think about that tom leaving he's a good guy not super partisan very smart what do you make of it so literally woke up all of you did this news i i was very surprised to see it it's pretty stunning both because by all accounts you know he was taking a very increasingly active role in being a spokesman for the administration's policies done actually a lot more sunday shows in his short tenure than i did sorry to the to the pressing the audience but i think i have two actions one we don't know yet kind of what prompted the resignation it looks like it may be that john bolton came in and wanted to have a change i have reaction to that based from from the perspective of the role that that job plays but also from cybersecurity what does it mean for cyber security on the role front you know i think most of you may be aware this role this listened to the president for homeland security and counterterrorism was created after nine eleven created to be the president's chief adviser on homeland security and counterterrorism issues to encompass it has grown up over the years to encompass cybersecurity and it's supposed to have direct and immediate access to the president that person's supposed to focus twenty four seven and i know because i did the job for nearly four years twenty four seven on those issues organizationally it is nested within the national security council and also holds the title of deputy national security but really the job is to be the president's direct person on these issues so if in fact this is john bolton coming in and saying i want my guy in this role i think it is concerning because portends that that focus is not.
