How and when to remove children from their homes? A federal lawsuit raises thorny questions
"A former Massachusetts family is hoping that a lawsuit will set a precedent for state child welfare agencies that want to remove children from their homes. Sarah Perkins says when she lived in Waltham Massachusetts last year, she took her three month old to a hospital emergency room for a high fever. She says when x-rays were done, doctors found a rib fracture and days later. We heard a knock at the door and it was armed police officers with several people from the department of children and families there to take our kids. Perkins says her son likely sustained the injury weeks earlier when her mother removed the baby from a car seat, he slipped and her mom caught him by grabbing one of his arms, still Perkins says it took her and her partner three months in about $50,000 in attorney's fees to have parental custody fully restored. Perkins and her partner are plaintiffs and a lawsuit alleging constitutional violations, including deprivation of parental rights without due process. I'm Donna water

"Okay? Second of all, you look at the year on year numbers on a bunch of different things. Obviously, energy and food. You're more likely to go down than up simply on a comparison basis. And since they're also dropping on an absolute basis, that gives us a little bit more cushion. And the real question is, are things getting better or worse? And I would say they're getting better. And what you'll get on the other side is, yeah, but shelter inflation, and that's true, but if we drop late to 5, I call that a wet. So what do you like right now? Where do you put your money, especially if you have any cash that you may have built up from sales in the first half? Well, let's take a look at let's put that in the context of what I was talking about about valuations in about earnings. Where are the earnings going to come from? Well, I think it's going to come from people spending more money. So I like consumer discretionary. As inflation goes down, consumer confidence is going to come back. You're going to see real wage growth pick back up. I think people are going to go out there and shop some more. And I think the Walmart data that you just referenced is something that says, yeah, that may be starting to happen. The other thing that I think is out there is we saw tech reprice down dramatically. We saw evaluations drop significantly. And there's still not cheap, but if interest rates have stabilized and if companies want growth and by the way, companies can't really hire, there's still a labor shortage so tech investment is going to have that tailwind. I think tech is also a good place going forward. Plenty of growth play on the consumer. All right, good stuff there, Brad, we appreciate you taking the time. Brad McMillan. markets are out ready to wrap it up We're seeing you know a little bit of a rally today Yeah rally for the week overall Let's get to it Let's drive to the close of Brad McMillan He's chief investment officer managing principal at Commonwealth financial network on the phone from Waltham Massachusetts Brad How are you happy Friday I am warm I am dry and I'm calling that away I know how you feel And how you feel We're going to end up it looks like the week with some gains overall Yeah 2.6% on the NASDAQ for the last 5 days 1.8% on the S&P 500 Carol Which is fairly decent I know we're still down A lot from the record highs How do you come to conclusions after a week of trading like this week Well I think the fed came out and said yes we are going to raise rates and the market reacted And then the market took a step back and said but wait a minute the economy is really doing well So earnings are going to be fine valuations are a little bit lower but on the whole onward network And I think that's where we're going So where does the fed come into this And we had a little debate earlier with our friends at Bloomberg TV about what the jobs report means for what the Federal Reserve does with interest rates this year How are you anticipating the fed raising rates by or after the March meeting Well I think that that is going to start raising rates at March I mean they pretty much telegraphed that I think they're going to do it a quarter point And then we're probably looking at May and probably three or four during the course of the year And the reason I say three or four is the fed is actually on record as saying I want to taper policy but they don't want to shock the markets And right now they're trying to talk to markets back from what they're saying I expect more action on the balance sheet because even as sir George a perma hawk has been saying that's really where we need to make some moves So I think the market is probably saying it's too much in terms of the rate increases And I think the fact is lessening What does it mean now for how we manage our portfolios right now Honestly not much Okay When you look at where stock prices come from It's earnings in its valuations Earnings are going to do fine as we talked about In fact the one message of the jobs report this morning is people are working They're going to be spending So it's all about valuations And we've seen valuations adjust but most of that adjustment is done I think right now if you haven't done anything you should type What about when it comes to asset allocation Brad There I think you need to take a close look at where you are I mean a lot of people have gotten enhanced hard on some of the growth stocks especially if you look at Facebook for example or Netflix You want to start putting money into stocks that are poised to position from growth but aren't necessarily as pricey as some of the poster children are And I think because I think there's a lot of risk there as we saw So go stay with growth stay modestly overweight growth but don't commit to the highest profile how highest valued stocks Is it hard to predict how the year will play out I mean we've done a lot of reporting Brad I'm sure your team and your researchers have taken a look at what happens early on in a rate hiking cycle It tends to be good for the equity markets But this is a year we're coming off of a couple of years in a year and a pandemic that we really don't have the playbook for something we can draw upon to kind of understand maybe what the trajectory is So how do you think about it How do you predict it Because you got to make decisions You do right Managing money or advising others Absolutely Carol And you're absolutely right And I think one of the things people get caught up in is trying to predict some of the individual events which I don't think we can do That's a fools game but if you just take a step back and you look at the biggest picture again where are earnings reasonably going to go Right now we're expecting them to go up to ten or 15% So okay we can expect earnings to go up We're evaluations going to go Okay If we go back to the pre-pandemic probably the bottom is going to be somewhere about 16 times forward earnings which is about 15 to 20% So that kind of says the market is going to be somewhere plus or -5% from where we started the year And it's probably more upside risk than down So that's kind of what we're looking at as we think about the future What would you say to somebody with trying to time the market right now I know it's not something that many people advise doing But is there going to be a better opportunity to get in Are we have we hit the bottom yet I think there's a reasonable chance we go down a little bit further but I also think there's a reasonable chance we bounce So I think it makes sense to wait if you're going to make that bet But it is a bet By far I think the better option is to say okay I'm going to dollar cost average in I'm going to put some money in in case I'm wrong but I'm also going to save some money to put in later on a regular basis if in fact the market does go down Where don't you want to be though Stay away from I think the most highly hyped and price stocks are the ones that are most vulnerable to disappointment I believe in growth but I suspect there's probably another Facebook working out there Another Netflix where we could see a significant drop down So I would be very careful with stocks that are priced for perfection That's interesting It's not alphabet It's not Microsoft We saw that through earnings Fair to say it's not Amazon What is it It's about growth When you look at Amazon as an example everybody's going to go to Amazon They can bake in growth by upping their prime costs which is what they've done When you look at Netflix for example when you look at Facebook they are all about the growth in the number of users And when that soften so to their prospects So I think that's the big difference Is it a different Are they selling eyeballs Are they actually minting money And that's the question All right we gotta run Hey have a good weekend Take "It takes a while to build your nest egg up big enough to to basically self insure you've got i. It's a big gap especially when you're in that messy middle of your late twenties early thirties even forties you have all these commitments but your assets just haven't reached that critical mass to the point. This just makes sense go. Buy insurance especially like term. Insurance is so cheap for a few hundred dollars a year. You can typically by yourself five hundred thousand to a million dollars of coverage for just not that much cost permit. Insurance is a little different than term because as the name implies permanent in theory is supposed to last forever whereas term you either by ten year you by fifteen you by twenty year but at the end of that term. It doesn't mean the insurance goes away but it means that that set premium at a lower cost is going to go away. You go truly start paying the cost of insurance right now. That's where it gets really where it's not cost effective whereas permanent they they flip the script upside down. They say. Look while you're young we're gonna make you overpay your premiums. So that what caused the the difference between what you're paying premium versus what the true cost of insurance. We'll keep the difference you know. We'll pay some fees to but we'll keep the difference. Then let that build up in the background. So that as you get older in the cost of insurance is super expensive you have enough that kinda mitigates that cost over the long term so with this insurance can be permanent. Here's the catch though. Permanent insurance costs twenty to twenty five times. What term insurance costs. And look when you're in your twenties and thirties every dollar you. Save and invest has the potential to grow twenty three times. If you're under you know if you're under twenty five ing you're between twenty and twenty five. I mean it's somewhere between it's a could grow eighty-eight time so you can see. Every dollar that you overpaying an insurance could get very expensive. So i think for the lion share people term insurance what you ought to consider. Now i feel like i have an expert sitting damola and we have had cases where permanent does make sense. I feel like after. We've now poked a lot of holes in why majority of people should do term. Don't don't skip the steps of figuring out what you need but waltham through where permanent actually does make sense so there are times where maybe you are part of a family or or your circumstance put you. Initially we're going to have some state taxes. Maybe either in the state that you live in or federally based on the size of your portfolio. But a lot of your assets are maybe in a business that has illiquid or illiquid real estate holdings or. You don't have a lot of liquid capital but there are going to be taxes. Assess when you pass away. So one of the most common use we see for permanent insurance is to satisfy any outstanding liabilities tax liabilities. That might be present when you pass away so that your family doesn't have to liquidate illiquid assets or perhaps liquid assets that they don't want to have to sell otherwise that's a pretty limited case. Study right. I think one of the things. That really frustrates me when it comes to like the insurance industry is a lot of insurance salesman. Wanna make whole life. Permanent life insurance. Broadly applicable to the masses. And i just don't know that it is in our world. We like for investments to do the investing thing and we want for insurance the insurance thing and when you try to begin combining those two you actually end up of a sub optimal sub efficient mix of both. Now i can already feel the comments coming. You're like yeah but it's tax deferred growth. it's tax deferred growth. Yeah there is an option that you can defer taxes on growth inside of an insurance product policy. The problem is you have to take that money out and you wanna go use that. He has to borrow the money from yourself. You're nice you get to make a distribution you do make a distribution. The policy goes into laps. Well then it all becomes a taxable of anyway right so was that tax deferred growth really that valuable or did you just captivate your money forever to wear either. It will become taxable. Or you have to die. I i just don't love that. Mix of setting up insurance and investing to overlap. I think there should be two separate and distinct. Yeah i mean you just you hit on something. That's all the the life insurance brochures is that hey go borrow from yourself and you won't pay any income taxes. Masha but i don't like that. It takes away your ability to vote with your feet. Because i just shared with you guys you will reach a point. Let's just say you're in your seventies. The cost of insurance gets expensive. And what if you're sitting on multiple seven figures but you've got this premium because you took loans to put the kids through college because somebody commits you. Hey that'd be a great way to pay for college was just go borrow off of these permanent life insurance because you ate out part of the cash value. You brought it down to a point. Now you're still making premiums payments but you're like this is just i don't need to keep making these insurance payments but you have to. You are now married to this policy because if it lapses you have a huge tax bill. That's do so. It's just a weird situation because you can't vote with your feet no way you can get away from the liabilities to die with it so the it's not like your family gets the full death benefit part of that death benefit will be to pay down the loan that you took to pay for college..

Certain air shows with the b twenty five between nine and just raising awareness so this was one of the tours a couple years ago. I took this photo waltham over colorado. I think so when they're going out and doing these tours. What are some of the main education points or objectives that they have Well it's you know to Educate inspire Honor the veterans that flew these men and women that flew these and just teach everyone about You know world war two and the korean war and these these warbirds flu and we're trying to go out there and raise money to keep them flying definitely and that's very important of course and i imagine with this opportunity you've had some very unique experiences or stories you can share with us. Oh absolutely You know we provide free rides for war two veterans so those are always a treat when you you know. There's not many laughed when you get to meet one And you know. The men show their own body camera video in court as well, claiming they were on a peaceful journey to a training camp in Maine last Saturday, police arrested a told 11 males after more than nine hour standoff. Those suspects are facing an array of charges now, including illegal possession of firearms and ammunition. Boston police have arrested a suspect in connection with an attempted kidnapping in East Boston last week. 21 Year old David Corey is accused of grabbing a woman while she was walking to work early Wednesday morning. Police say he asked a woman for directions to a T station and then allegedly grabbed her amid a threatening statement. Corey is now charged with kidnapping and assault and battery. He is also awaiting a court appearance on Monday. A pretty big shift by the CDC, as the agency is urging schools to return to in person learning this fall.
