"I'm Noel King in Washington, D C and I'm David Greene in Los Angeles. Good morning, the Justice Department is taking on one of the world's biggest companies. WalMart. A civil suit alleges that the retail giant sold huge quantities of highly addictive opioid medications and if they did so, in a way that violated federal law. NPR's addiction correspondent Brian Mann has been investigating Wal Mart and is with me this morning. Hi there. Brian. Morning, David. So let's start with exactly what the DOJ is alleging here about Wal Mart. S O. Federal data shows Wal Marts, pharmacies dispensed billions of opioid pills over the years, often in rural communities that have been devastated by this addiction crisis. What the DOJ says. Now David is the company executives failed to stop a lot of suspicious opioid orders hundreds of thousands of them. Wal Mart also allegedly failed to report potentially illegal opioid orders to the Drug Enforcement Administration. During an online regulatory conference last week, Deputy Assistant Attorney General Daniel five signal that this kind of lawsuit was coming. Honesty's are the last line of defense against prescription opioid diversion, but too many pharmacies for too long abdicated that responsibility. So now the DOJ says it plans to hold WalMart accountable for allegedly contributing to this addiction crisis that's killed hundreds of thousands of Americans. Do we know more about these allegedly illegal drug sales at Wal Mart, how they sort of play down? Yeah, I've been looking at this. And I spoke with the Swanee sheer and who worked for Wal Mart is a pharmacist in rural Michigan and 2012. When the opioid epidemic there was exploding. And he says he quickly encountered red flags patients who would come in with suspicious prescriptions for huge doses of opioids some huge doses of opioids. Sometimes he saw patients traveling long distances to fill their opioid prescriptions. And also he talked to patients who couldn't explain why they needed these powerful, highly addictive painkillers, which he did at it indication that those prescriptions are not for Any genuine medical purpose instead or being abused by the patient and being distributed on the street. Shirin alleges that Wal Mart regularly ignored these warning signs and just went ahead and dispense the opioids anyway. And the Justice Department now alleges Wal Mart did this all over the country, knowingly filling prescriptions that weren't for any legitimate medical need. I mean such serious allegations suggesting that a major company like this contributed to such a deadly crisis. What What is Walmart saying? What is the response here? Yeah, they're pushing back hard. They say that they tried in good faith over the years to comply with conflicting, confusing laws that regulate opioid prescribing. Walmarts attorneys also argued that the Justice Department has been trying to embarrass the company allegedly part of an effort to squeeze and leverage a big financial settlement. I should say the DOJ says that they've handled this investigation by the book. I mean, I suppose this is a serious moment for Wal Mart in terms of both legal risk and potentially financial risk. Yeah, Yesterday's federal suit, David really upped the ante. But Wal Mart was already being sued by a bunch of state and local governments that alleged the company's opioid sales were irresponsible and dangerous. Cases are moving forward in Ohio and West Virginia, and on top of the legal claims that could run into the billions of dollars WalMart faces months maybe years now have headlines and disclosures about these opioids sales..

"NPR ADDICTION correspondent Brian Mann is here. Hi, Brian. Hi, Ari. Tell us more about what the Justice Department alleges. Wal Mart did wrong. Yes. Oh, WalMart runs one of the biggest pharmacy chains in the country, a lot of those pharmacies in rural towns that have been devastated by this opioid crisis. Federal law requires companies that sell opioids like OxyContin to do so, really carefully monitoring for signs that pills might be used improperly or sold on the black market. And reporting any possible problems to the Drug Enforcement Administration. Now, according to the DOJ, Wal Mart did exactly the opposite, filling huge numbers of unsafe and illegal prescriptions allegedly doing so for years without alerting the government. We're talking about one of the biggest companies in the world. Here was this Justice Department suit against Wal Mart Unexpected Actually, this legal fight has been brewing for a long time. Back. In October, WalMart filed a preemptive lawsuit against the Justice Department, essentially trying to head off his case, and at the time, Walmarts attorneys acknowledged they might face civil and also criminal charges. Since then, NPR has been looking into this, and we found that some of the company's own former pharmacists tried for years to raise the alarm about allegedly illegal activity. Swanny. Shirin is a pharmacist who worked for Wal Mart in rural Michigan. He told NPR, he saw real red flags, pill mill doctors and people addicted to opioids who were allegedly using Wal Mart as a drug source. I start my job at eight, and I see that patients 15 to 20 are already lined up get their prescriptions filled morphine sulfate, oxycodone and other straight narcotic, which are from the schedule took a degree. Now here and work for Wal Mart in 2012 in 2013. When the prescription opioid epidemic, Ari was raging, killing tens of thousands of people a year, and he alleges that when he told Wal Mart managers that opioids were being sold inappropriately they told him, he says, to keep quiet. They told me do not reach out to the DEA, or do not call the police. If you're going to do so, your employment going to be terminated immediately. Now she runs not alone. Making this allegation. In addition to the federal lawsuit that was filed today are a WalMart faces a wave of opioid related lawsuits from local and state governments all over these opioids sales and you said Wal Mart has also filed a countersuit against the Justice Department. What is the allegation there? Yeah, This is really interesting. Wal Mart. First of all, denies any wrongdoing. And in that lawsuit filed in October, they alleged the DOJ and the Drug Enforcement Administration are trying to embarrass the company trying to squeeze it for a big civil settlement. WalMart says it tried to sell opioid safely, but was stymied by conflicting state and federal regulations. In a statement this afternoon, WalMart again accused federal agents of ethics violations. And they said they only filled legal prescriptions issued by licensed doctors. Just briefly. What's at stake here? What could the penalties be of Wal Mart loses? Yeah, this could run into the billions of dollars are the money could be significant, much smaller firms like produce farmer that have been caught up in the opioid crisis have settled for billions. But there's another potential cost here and that's reputation. Wal Mart is just the latest name brand American company to find itself entangled in the legal and public relations backlash from opioids. I don't know anybody that ran out of anything, disinfectant wipes and hand sanitizer. I bought The gigantic things of pan sanitizer with the pump on top of the big, big giant ones, and my wife works in the school system, and we knew something was going on. We knew there was a riot going on. But that point we didn't think things were gonna shut down. In fact, I think that they could have been mentioned really yet, But people were hoarding stuff already. So I went to the Wal Mart near my house and They had the giant things they were right out there said about five of them. I wasn't trying to hoard. I gave him to my wife because she's a speech pathologist and she goes from school to school and bounces around. So I wanted her to have one at every school she goes to, so it's really, really about five them. My bottom and I went in, and I rang up a form left didn't think anything of it and then the next day She was told to prepare everything and start working on a plan for remote being a speech pathologist. I don't know what that would called speech Pathologize ng. I don't know, but she had to go out and get her gifts a home and prepare all that kind of stuff because they knew they were going to shut things down. They shut him down. And the Clorox disinfectant wife wife's people ran out of that stuff, too. Andre couldn't get that. But I never went to the store. I did see people buying one right because you could buy one They would buy one and they would have their kids with them. And they would give like these little kids like 56 years old. They would give nothing of toilet paper and have them hold it while they were waiting in line and they would finish their order. And then their kid would walk up and deep it not know what the hell was going on and do that side that side that going out but the other day when I was looking in the stores Now I've seen nothing. It was horribly convenient. A lot of stuff in the strip mall over there gone. And last night I'm driving down. Ah. Ah Michigan Avenue and I go buy one another another and then another buildings that are banks. Credit unions, whatever. Obviously designated for some type of a specific business number is just going to buy this place. And they all have for sale. Signs out in front of the windows are blacked out.
