"Man. I'm all pissed off. I am a pistol. Hey I've been touched off from the beginning. Willy when the emperor and the empress that's what they're call started these edicts. I got three things run by a first off this so called opening businesses and restaurants. I WanNa go anywhere where there's only thirty percent capacity can't be around more than ten people. How can a restaurant stay open under those conditions? And if they do they're going to jack the prices up so much you realize I don't think the American people realize what kind of inflation's coming down the pike here. It's GONNA kill us. You know what I'm saying but my God been in the restaurant business and they generally make less than ten percent profit. If you're packed there is no business successful or otherwise. That can stay in business with these government. Rules and regulations government oppression. And if you'd like to go to Montgomery in if you like to go to Jeff. Ruby's find steakhouse. Go to Silver Spring House and you go in there as a free American and you understand that it would be better not to communicate not to kiss each other not to hug a high five. But that's that's up to you you're in charge of your health is not up to government to tell Joe Smith at the Silver Spring House and Joe Kendall guess what guys you can open but you're going to have fifty percent occupancy. You can't have a table more than six. You gotta be six feet apart and if you stand up to get a beer. We may arrest. Joe Smith is that the government you wanna live in Willie. It is out of control two more points. How big a problem. How big a thing do you think this would be? If it wasn't for the magnitude so called in New York. I bet if New York had nothing going on Like here that this wouldn't be such a big deal around this country right now. Do you understand where I'm coming from? I understand completely at this crisis. Happened IN CLEVELAND. Collect Covington or Cincinnati and the media didn't pick it up. We gave a pandemic and nobody came to it when the Governor says. We have to flatten the curve. We never had a curve in the first place. Where's the curve? I WANNA see about big big big line going up. The hospitals were empty. They weren't empty. And so if you're if you have a licensed to operate the government can crack down on your liquor license your food service licence. They can crack down on your vendor's license. They have the power to shut you down. Know your role and shut. Your mouth is what the government is saying to Silver Spring House. And I'm not mentioning names but I know that the great restaurant tours in the tri-state are scared. That guess what we had better not talk. We better not speak because if they come in here and shut me down. I'm out of business if silver spring. Didn't ever liquor license. They'd probably be out of business. And you know all the numbers to me are like the Vietnam War. Body counts are so inflated. It's unbelievable one last thing advertising even on your station every commercial talking about clothing art crisis this that and everything else. I am so sick and tired of it. I think after a week we understood that there was the virus out there. But here's the question. Willie I wait for the day when this is over so that domino's can start putting their hands over my pizzas again. You understand what I'm saying there. There's people out there listening to that crap. They're doing us a favor. So that means they put their hands all visas until this came up. You have to sell them saying one of what I'm saying. Is this after two months of carpet coverage from pillar to post I I understand. I'm an American. I am not an assault. I'm not an infant. I'm not a farm animal. I know what I have to do. Government protects my liberty and. I protect my health. I know what not to do every now and then I'll have a hot fudge sundae. I probably shouldn't do that but that's my choice. Five hundred thousand. Americans die every year of smoking related issues but we sell cigarettes everywhere you know. What the risk might be engage in the behavior or not? There's people drowning in swimming poles but the open up immoral day. There's people drowning all the time in the Ohio River but I see boats going hither and fro government protects my liberty. I look after my health. And when government says when government says to you you know what if you stand and drink a beer? We're going to arrest you or the holder of that license. That is a bridge way too far for me about last night and Mike we gotta go. Thanks for your call. Lastly I'll say this none of this would be happening if they did not have an eighty percent approval rating. None of it. If they had twenty percent approval ratings the state would have been open a month. Ago would no difference. Can Somebody at these stupid news conferences. Would no bulls hold on? Wait a minute. We Got Jack. Windsor Windsor. Wf MD. Jack how are you Bill Cunningham? I am well sir. How are you today? You're the only one in the media that ask a question. I won't ask if you're embarrassed by your brothers and sisters. Put you in a bad position. What does this mean when the governor shows up tomorrow and when you read this ruling which is quite good? What does this mean for the governor continuing to sell us on the idea that we're in a crisis when a court has ruled that he's acting unconstitutionally? Well for folks who are really digging into the data. I talked a little bit about this yesterday in my question. And we see what's really going on who's really affected who's dying from this You know it makes sense to use a scalpel. Instead of a wrecking ball. And I think that What we heard about what? You broke today That ruling is Is probably going to gain momentum and you know what we heard. Yesterday was that he's going to revise orders anyway And there was a lot of confusion. There's an order slash advisory coming out That will deal with business. Regulations large gatherings and social distancing. My understanding is those will still be orders but travel to and from the state and the stay at home suggestion or order that will that will disappear and that will become an advisory but look I two weeks ago. I think we heard based on Baldwin Wallace University. Study that approval ratings for for the governor worried about eight percent There was an online Newspoll yesterday and it looks like it's about thirty percent now. Sixty percent are not in favor of the direction in two weeks. That's a mighty big swing and so I think what this will do is it will embolden people to continue to speak out and probably take action as they feel that. They've been violated now. We had on the attorney Marie Thompson a couple of hours ago. Who made the implication and or the statement that it was a pay to play scheme and Columbus John Usta looked over list of individuals who had contributed or will contribute and put together August panels of experts to make sure their business has got open and when other businesses were sitting at the table. They were not open. Can someone look into the fact of WHO contributed the money? And who got on the panel? That's something that.

How can a restaurant stay open under those conditions and if they do, they're going to jack the prices up so much. You realize I don't think the American people realize what kind of inflation's coming down the pike here. It's GONNA kill us. You know what I'm saying, but. My God been in the restaurant business, and they generally make less than ten percent profit. If you're packed, there is no business successful or otherwise that can stay in business with these government rules and regulations, government oppression, and if you'd like to go to Montgomery in if you like to go to Jeff Ruby's find steakhouse, go to Silver Spring House and you go in there as a free American, and you understand that it would be better not to communicate. Communicate not to kiss each other not to hug a high five, but that's that's up to you. You're in charge of your health is not up to government to tell Joe Smith at the Silver Spring. House and Joe Kendall Guess what guys you can open, but you're going to have fifty percent occupancy. You can't have a table more than six. You gotta be six feet apart, and if you stand up to get a beer, we may arrest Joe Smith. The. Is that the government you WanNa live in. Willie it is out of control two more points. How big a problem! How big a thing do you think this would be if it wasn't for the magnitude, so called in New York I bet if New York had nothing going on like here that this wouldn't be such a big deal around this country right now. Do you understand where I'm coming from I understand? Completely at this crisis happened in Cleveland Collect COVINGTON OR CINCINNATI and the media didn't pick it up we. gave a pandemic nobody came to it. When the Governor says, we have to flatten the curve. occurred in the first place. Where's the curve? I WANNA see about big big big line going up. The hospitals were empty. They weren't empty and so if you're if you have a licensed to operate, the government can crack down on your liquor license your food service licence. They can crack down on your vendor's license. They have the power to shut you down. Know your role and shut. Your mouth is what the government is saying to Silver Spring House and I'm not mentioning names but I know that the great restaurant tours in the tri-state are scared that guess what we had better not talk. We better not speak because if they come in here and shut me down. I'm out of business. If Silver Spring, didn't ever liquor license. They'd probably be out of business. and. You know all the numbers to me are like the Vietnam War body are so inflated. It's unbelievable one last thing. Advertising even on your station, every commercial talking about clothing art crisis this that and everything else I am so sick and tired of it I think after a week. We understood that there was the virus out there, but here's the question Willie. I wait for the day when this is over, so that domino's can start putting their hands over my pizzas again. You understand what I'm saying. there. There's people out there listening to that. They're doing us a favor, so that means they put their hands all visas until this came up. You have to sell them. Saying one of what I'm saying is this. After two months of carpet coverage from pillar to post I I understand I'm an American. I am not an assault. I'm not an infant. I'm not a farm animal I know what I have to do. Government protects my liberty and I protect my health. I know what not to do every now and then I'll have a hot fudge sundae. I probably shouldn't do that, but that's my choice. Five hundred thousand Americans die every year of smoking related issues, but we sell cigarettes everywhere. You know what the risk might be. Engage in the behavior or not. There's people drowning in swimming poles. Poles but the open up immoral day there's people drowning all the time in the Ohio. River, but I see boats going hither and fro. Government protects my liberty. I look after my health and when government says when government says to you, you know what if you stand and drink a beer? We're going to arrest you or the holder of that license. That is a bridge way too far for me about last night and Mike. We gotta go. Thanks for your call. Lastly I'll say this. None of this would be happening if they did not have an eighty percent approval rating. None of it! If, they had twenty percent approval ratings. The state would have been open a month ago. Would no difference? Can Somebody at the stupid news conferences would no bulls. Hold on, wait a minute. We Got Jack. Windsor Jack Windsurf WF MD Jack. How are you? Bill Cunningham I am well sir. How are you today? You're the only one in the media that ask a question. I won't ask if you're embarrassed by your brothers and sisters that put you in a bad position. What does this mean when the governor shows up tomorrow? And when you read this ruling, which is quite good. What does this mean for the governor continuing to sell us on the idea that we're in a crisis when a court has ruled that he's acting unconstitutionally..

"Millions of dollars the ruling of the judge today against Dr. Amy Acting Judge Eugene Lucci is incredible and its scope. How illegal her actions have been and continue to be illegal every hour they happen. She has no power a rational basis to order everyone. Who's healthy to stay in their homes? It made made out of whole cloth it doesn't exist and before I go back to the calls Mike and James and David. The other studies have been done. Ohio Kentucky Indiana largely unaffected by covid nineteen ten percent of all counties contain ninety five percent of covid nineteen deaths none. Ohio Kentucky or Indiana. Ten percent account is contained ninety five percent of the Cova deaths as a may eleven ten states accounted for seventy percent of all US cases and nearly seventy five percent of all deaths. Ohio Kentucky Indiana. Not In the top. Ten one percent of America's counties one percent representing fifteen percent of the. Us population has fifty percent of covid nineteen cases. None and Ohio Kentucky Indiana. What if they gave a pandemic a plan to make and one did not occur due act as if it still does keeping businesses like bowling alley? Shut do you tell Silver Spring House and and Joe Smith that you have to stay shutdown and someone cannot stand up to drink a beer. They have to sit down for what rational basis is that whereas the a C. L. U. Or do they care about liberals answer is all they care about are liberals not abortion is essential but cutting hair is not is. That is that true. Yes it is true in Dr. Amy. Acton isn't abortionist and she worked hard to elect Obama and she's the Ohio health director and she's claiming powers that do not exist if those powers can be granted needs to be through the legislature. But even then they could be illegal if there's no rational basis takeaway constitutional right no rational basis at all. Let's continue with calls and one other ruling from the judge this morning. Declaring amy words illegal and unconstitutional is very good. The general public would be harmed. If this injunction is not issued today there would be a diminishment of public morale and a feeling that one unelected person could exercise such fettered power before everyone do obey impermissible oppressive vague arbitrary and unreasonable rules. That the director. That's amy acton devised and revised and modified in reverse whenever she pleases without any legislative guidance. The public will be left with feelings that their government is not accountable to them. Prolonged shutdowns have deleterious effects upon the public psyche that we can't even vote. Nba Acting declared March sixteenth. That you and I can't vote to change leadership if we want to change then. She comes out at two o'clock every day but not today. Tomorrow issuing new pronouncements as to what businesses are essential what's businesses are not essential now as far as an American government is there to protect my liberty Bill Cunningham. I'm in charge of my health. I often will wear a mask I try. I don't shake hands. Many young women constantly want to hug me. I don't let them kiss me. I don't let that happen. I'm in charge of my health. Does she think I'm an imbecile an infant or farm animal that I have no free choice that I don't know what I'm doing now? I need her to tell me how to act. Wash my hands. Don't touch my face. My nose wear a mask. Those are my free choices. Government Guards my liberty. I look after my health. That's the way the system works. Misjudges is fantastic about the impermissible exercise. And by the way at five o'clock today Tanya works going to have on your nephew he's doing with the governor. I understand now between two and two thirty. He's going to say look. I thought I was right. We're going to appeal this thing. Who knows and the allegations made by the Attorney Marie Thompson? That's one of the prime requisites to get on one of these August panels was past present or future donations to the reelect campaign of Mike. Dewine and John. Houston so I'll say it again. I said in an hour and a half ago Mike. Dewine himself does not have a corrupt bone in his body. I've never met John. Houston never met amy. Acton there are those who believe it's a pay to play scheme and Columbus that the more money you contribute the more power you have to get your business open if you don't have the power you can't get your business open according to Maurice Thompson the attorney for the eighteen fifty one constitutional law and you can google his name Marie Thompson and get what's going on. Let's continue there was no curve to flatten. It never happened here. We were unaffected largely by covert nineteen except the media. Scared the hell out of everyone and by the way the only person asking questions that make any sense. These news conferences are Jack Windsor. Jack Windsor of Mansfield W. F. D. And if Jack is available he knows the hotline number he may call and I'll put him on the rest of the media sits there and say how Dr Acton or so honored to have our and governor dewine. Thank you for holding these news conferences. Without you I would know how to wash my hands. May I ask a question sure? Go ahead Dr. Acton. How great are you how? How important are you who are lives here in Ohio Dr Acton? Can you respond to my quest to please? I'm in the news media. Yes let me rub my hands I and show you Petunia Guard and maybe four year old set of singing and with my name on it and did you see the New York Times article about me. How great I am. By the way I'll I'll ask him other reported. Ask another question but you please go ahead. If you're if you call yourself a journalist you are embarrassing the profession by what you do every day at these news conferences. It is embarrassing. And if you have nothing to add stay the hell out of the room. Don't bother attending because it's embarrassing as a journalist for you to ask those kind of silly questions. What if the White House news media was in front of those three every day? What would be going onto you think? Let's continue with Mike and James and we've scheduled the rock. The Rock schedule to be here in about twenty minutes. Mike you're on the bill Cunningham. Show Mike Houria Willie.

He's an electrician. He's out among the public. He has to come home. Put his clothes in a bag and put it in the Washer and stuff to sleep in a separate bedroom. I mean how many lawsuits are GONNA be piling up against to the anxiety of people because of what they are doing to our state. Domina read it to directly. I mean this is absolutely insane and speaking of that the healthcare workers if they wanna go out of town for something over the weekend they have to accept quarantine for two weeks. This is out the public. Nobody knows this. And I'm telling you the first time they have to quarantine for two weeks and then they have. "Your good friend of mine. Tanya aerobics going to interview the governor at two o'clock eastern time and then play. The results of that and the governor's going to say. Look I thought I had the authority I thought I had the power and secondly I have lawyers telling me something different. All of which is true the statute itself says and I had a person. Send me the fact that If someone has a community communicable disease you can be at that point. Corentin an isolated. Because you have it and through contact tracing if you say okay with these six people. Then the government's got the power to go to the six people and test them and if they test positive then they can be isolated in quarantine and that's what the law says. The law does not say that the Doctor Amy Acton can quarantine eleven point seven million healthy ohioans in quarantine them. That's what the law doesn't say. The law needs to be changed. The lawmakers are saying governor. Come to US House and the Senate. Open hearings debates fairly. We'll pass a law. Giving her fourteen more days. Whatever it is and then she can come back to this August panel of five to Democrats to Republicans and some independent appointed medical person. Then they can rule okay. You got fourteen more days. None of that happened. They took on themselves. The role of tyrants ruled. And how ridiculous isn't I gotTa get to marry my James? How ridiculous is it that we sit here at two o'clock everyday but not today two o'clock and wait for Dr Amy Acton? The governor and John used to come out on high from Star Chamber telling us the next ruling that you're allowed to leave your home you're allowed now to mow your grass. You're allowed now to open your business or to work at a job in a park. You can patronize a restaurant like Silver Spring House. But you're gonNA order a beer but if you stand up that means Joe Smith could go to jail for for seventy five to one hundred days. Put Him in jail. A customer stood up with a bear. Your under arrest. You're five feet apart not six. So the law doesn't say that it's arbitrary it's capricious and it's un-american and it's wrong. How do we get ourselves in this position when you're willing to submit to this without objection? Just tell me what I gotta do. Now if you're a private business owner and you WanNa make your patrons wear mask. You have the power to do. So that's not the government if Kroger says you gotTa have a mass come in. They got the power to do that. We don't live in the state of Kroger all then. Kroger would run the state a lot better than states being run right now. That's private business. We're talking about the state. The state the bill of rights applies the fourteenth amendment applies. High Constitution applies the state. I have no idea how we got ourselves in this position. The media loves it because it makes their job easy and many people buy into that, but now that we've got some arguments on the other side of the table. Hopefully can change that. By the way, the governor is not on today. He's I'm sure reviewing what happened with your lawsuit. Tamar two o'clock, or you're going to have a secret meeting. You're going to have Dr Amy Acton if she's feeling better Mike Dewine, and John Newstead conjuring up how to implement their pontificate and the state of Ohio, ignoring the will of the people don't go through hearing process. Don't pass a law. We have a rule and we're going to determine for you. What businesses can open? What cannot open and fact that they've issued rulings? Two days ago, the governor did wind did and which he says. You're going to order a beer from a bar. That's open, but you can't stand up. You got to sit down to drink it. What rational basis is there for that? Well. It's not just that if somebody stands up in your car and your the bar owner, you are liable for a second degree misdemeanor one hundred fifty days in jail, so we have vague again. We have vague criminal laws written behind the scenes and smoke filled room perhaps the behalf of certain lobbyists as well so that's just not going to work. We're going to be able to pin that issue down. Here, we've got two or three more cases like this in the shoot, and that is one of them. They will say anything that they can say to win their case against the people of Ohio, even though the people of Ohio pay their salaries so I, not procedural process case in federal court a month ago. Ago. They said that no procedural due process was do because amy was legislating and making policy and you don't get a hearing when there's legislation. That's system wide, so we said okay well, that's the separation of powers problem, but we actually can't enforced seperation powers against the state in federal court. We can only do it in State Court under the Eleventh Amendment, so we had to go to stay court win our separation of powers claim. So it's Kinda like tales I win, you lose. Yeah days then we had no way to catch them in the trap for zigging, so we had zagged by going to stay court. Under the fourteenth. Amendment doesn't per isn't any person in America entitled to due process. If one's properties taken away. Well, there's what we argued, but we encountered a very hyperbolic judge who was very afraid of the virus, and very disposed to the states way of thinking, and the state argued against the rights of the people you know here again, your taxpayer money working against you even for the idea that those businesses shutdown should be entitled to a hearing to prove that they were safe or essential. The state argued against even that, so we realized we were. We were not going to get anywhere. In Federal, court in that case, but we really use that case and what we learn from it to take to state court. And to get to an impartial judge, and that's what we found in. Judge Lucci County so when Judge Lucci ruled this morning nine twenty three am. This says every business in Ohio can open today. My.

"Depending on how he felt that morning so we can't live press conference the media loves it because it makes their job easy and many people buy into that but Now that we've got some arguments on the other side of the table hopefully can change that by the way the governor is not on today he's. I'm sure reviewing what happened with your lawsuit. Tamar two o'clock or you're going to have a secret meeting. You're going to have Dr Amy Acton. If she's feeling better Mike Dewine and John Newstead conjuring up how to implement their pontificate in the state of Ohio. Ignoring the will of the people don't go through hearing process. Don't pass a law. We have a rule and we're going to determine for you what businesses can open what cannot open and fact that they've issued rulings two days ago. The governor did wind did in which he says. You're going to order a beer from a Bar. That's open but you can't stand up you got to sit down to drink it. What rational basis is there for that? Well it's not just that if somebody stands up in your car and your the bar owner you are liable for a second degree misdemeanor. One hundred fifty days in jail so we have vague here again. We have vague criminal laws written behind the scenes and smoke filled room Perhaps the behalf of certain lobbyists as well So that's just not going to work. We're going to be able to pin that issue down here we've got two or three more cases like this in the shoot and that is one of them. What did you decide to go to state COURT INSTEAD OF FEDERAL COURT UNDER? Nineteen eighty-three jurisdiction. Well I'll tell you what happened and I think you're one of the few folks can explain this to The Ohio Department of Health and their Turni's in our corrupt attorney general's office Zig and Zag all over the place. "What we're really trying to indicate here is your right to do was peaceful any doesn't impose harm on others and there's insufficient evidence that you getting a haircut or a business being open without more is going to spread the virus and cause mass carnage in fact. The pandemic never happened in the tri-state. The governor talks about flattening the curve. Hell there was no curve. There was no curve and Ohio Kentucky. Indiana I on health officials at the time. Who said two weeks into this pandemic order? We're waiting for the patients to show up. They never showed up. Does that play into your thinking that there was never. They gave pandemic nobody arrived. It doesn't it doesn't I have to say even in times of gravest emergency so even even if this virus did present a grave emergency and I agree with you. I don't believe that it ever did. I never thought so. From the beginning. And the evidence is proven that true but even in times of gravest emergency in times of war and Times of disease. The constitution has to be paramount. And we have to protect rights. It's very easy for those rights to get squashed when when people are nervous and when their anxieties are high and ultimately the most important thing whether the pandemic is serious or not is limiting government and protecting folks rights from those who have untreated anxieties over and fears over. What may speculatively happened when really what they need is maybe it's go to church getting therapist. He's Thompson Attorney for the plaintiffs in this case. Rock House fitness etc. As far as what this means to other businesses there are millions listening around the tri-state. How does this affect other businesses like bowling alleys? I'm going to have on Madison Bowl. The proprietor bowl. I think tomorrow. How does this affect other businesses? They're open if they WANNA be look. The president is about Jim's because the case was filed by Jim's James Worthy only industry. Brave enough to organize organizing. Go to court. Okay so the order says you can't enforce these penalties against the gym but it says that because the governor and the director of health have no power to create these regulations in the first place and that conclusion applies to every industry. So my advice is you're free to open if you want to and you're you're free to be free from these penalties and sanctions that act and has created if you do open so call me. Who determines one of the things had on house speaker? Larry Householder and bill sites. Who urged the governor to come to the General Assembly who represents the people of Ohio to pass rose and regulations? Explain how you matriculated that issue? Well it's not just that but in many of these cases the General Assembly has already passed. Rules and regulations and the governor is outright defining those rules and regulations and making up his own. That are different in the case of daycares for example The Governor Director of health are just changing the ratios of the legislature has clearly written into the law. So not what you have. Here is a Governor Department of health or just pretending the legislature doesn't exist because the legislature is instead of serving their agenda when the General Assembly passes a law. The Governor Vetos it. They can't override the veto. It's like a self fulfilling prophecy so the governor can say sure go to the General Assembly. They pass a law and they don't have enough to overcome his veto. He says well. I'M GOING TO IGNORE THAT. I'm GONNA veto that. And I'm going to rely upon Dr Amy Act and the shutdown federal elections to shutdown daycare to shut down schools to shut down private businesses and eighty percent of the American people. Say That's okay. The approval ratings are through the roof. And I think Maurice. That's the most scary thing about this is that we accept it your comments. This has been if nothing else. The great reveal. I think that you see those who accept this authority. And those who are afraid of this virus and willing to go to all costs to punish others businesses others liberties others who wish to to carry about their lives peacefully free from government or fearance And it's been a great reveal learn. Who is willing to do that? And who's not if nothing else? This is a wakeup call to those of us who believe in limited government and who believe in in peace and freedom that we've got to work harder and you know what the legislature isn't perfect. It's not a great place to do all this stuff by any means to pass any public policy that sausage making processes ugly. But at least it's out in the open largely at least you can go and testify for against the bill Then hear the arguments on both sides of the table. We haven't had a chance to do that here. I think some of that polling is because there has been no open debate. There hasn't been open records and open meetings and procedural due process with hearings where the arguments for and against our mate instead. All you're hearing is a bureau type press conference once a day in the media eating out of the hands of these folks and then of course You have rules being made by press conference at each day the way that the are used to set the price of gold.

"The. Billy Cunningham, the great American court rules at a twenty three am this morning, a judge in Lake County, says the Doctor Amy act and violated the constitutional rights, of Health Clubs and gyms, by shutting them down, and stranded preliminary injunction, blocking the Department of Health from taking any action against clubs which violate her order. Join now is the lawyer who filed the lawsuit a great. Great. American who understands what the rights are understand exactly where the law should remain, understands that the constitutions written regular slaps, and not for the rich, the powerful, not for the famous and of course Chris Vinnie came on earlier today to discuss what was going on now. Murray's Thompson is joining us and Maria Tomson welcome to the bill Cunningham, show and Marie. How are you? Still happy, do with you understand. Lake County kind of explain to the American people listening throughout the Mid West. What the judge ruled in Lake County. The court's ruling is consistent with our arguments and are arguments have been since the beginning, which is that one unelected individual doesn't have the power to pick and choose which businesses to close which to open how to regulate them, and perhaps most importantly that person cannot write her own criminal code. They cannot come up with criminal penalties at eleven fifty nine PM. That can put you in jail at twelve. Oh, or one am the next day through blindside, which has been going on here as well so basically it's been arguing for property rights and laws that are not vague for the separation of powers, and we've been able to win on all of those fronts. Gyms, but for all businesses in Ohio, so this also carries with a large damages that could run into hundreds of millions or billions of dollars part of this ruling of the Judge Lake County on page six, it says the director that Zambia Acton as corn, the entire people, the state of Ohio for much more than fourteen days. The director is no statutory authority to close all businesses, including the plaintiffs gems, which she deems not essential for a period of two months. She has acted in an impermissible unreasonable and oppressive manner, and without any procedural safeguards movements are the plaintiffs have shown a strong or substantial likelihood of probability of success on the merits, does this. Give all the businesses in Ohio and avenue to collect literally hundreds of millions of dollars in the state of Ohio. Who are the taxpayers? Bill I don't have dollar signs in my eyes, we run. A nonprofit were representing the gyms for free. We're not seeking damages. We seek to stop the bleeding by making bad laws. Go Away, and that is the goal here that we've been trying to do in this case I think we're going to accomplish that We don't know what the state sponsor they're going to be. They cannot appeal this order, so it won't. Won't be that, but the first thing we need to do is stop the bleeding and see this order through. Make sure it is enforced not just for gyms, but for all other businesses and stop these arbitrary closures, and these arbitrary regulations and others can worry about the money later. like I say we. We do this for free and we do this to make bad law school way so once. We accomplished that mission. The trial lawyers will swoop into whatever they're gonNA do on March. Twenty third doctor aiming acton ruled non essential businesses must cease. What was the basis for her determining? What is a non essential essential business? We're in discovery on that. On one of our earlier cases filed a Hartman Veal Department of Health against acting on behalf of a bridal shop about a month ago, and the state has been obstructing that discovery four a month bill. You know all about discovery. That's we basically ask questions and the state has to answer them, and we asked exactly that question and the state has no answer for it, so it has been obstructing that discovery very irresponsibly. You know in that that raises the point that really there's been unbelievable amount of irresponsibility and unaccountability in corruption I would say not just at the health department, but. Including the governor, the Ohio Attorney General's office and there are attorneys who had been obstructing all along. Defend Act, and because they know that these things cannot be justified, so we will get an answer to that eventually the re- The reality is totally arbitrary. It was picking and choosing. There was no standard. There was no metric just like there was no metric about one. This shutdown was going to end so we have to end it through the constitution. What a novel concept on March, Twenty third, twenty twenty. She ordered the quote. All persons are to stay at home or their place of residence, unless they're engaging essential activities, he central government functions, or operate essential businesses and operations as set forth this order. She declared that from an office and the city of Columbus, that applied to nearly twelve million Americans living in Ohio A. A person ordered that Americans. Stay in your home unless they're engaging essential activities. What the hell does that mean you know in our view? The fact of the matter is a couple of weeks ago. We ramped up because it got even more arbitrary. You almost wrap your head around the concept that necessary functions should continue during pandemic Orna -mergency, but all that essential non essential. Standards, and metrics that all went away April thirtieth when the new order came out, which just nakedly picked and chose which businesses could open and win without any explanation as to safety or any other justification just basically based on who had the best lobbyist and the most campaign contributions to the governor, and if you're in, you got open sooner, and did you gotTA open later? And that's how we get a situation where a week ago you go, get a tattoo of beer, a massage and a haircut, but you couldn't go to gym. One of the most absurd things couple weeks ago I I could not legally get my haircut, but I could legally go to my dentist. My teeth cleaned and I'm saying what's the basis for this? I will freely admit to humorous that I had bootleg haircut. By the wife of a police officer. was I liable to being imprisoned for having a bootleg haircut? No you're you're. Barber could have been under this law, and that's really the problem is eve. Again you've got the Department of Health. Running its own criminal code, determining what people are going to jail for and what people aren't going to jail, for which is an absurdity in the history of this nation. Really we've never seen anything quite like it, and we're seeing it state by state now and hopefully it stricken down in every state, so so yeah, you somebody could have been certainly penalized for that, even though it's a totally peaceful activity and.
