Enable a lot of people with more modest estate to do some creative tax planning as I as I tell people to seminar, and this is one of the things we go through if you if you can adopt a flexible tax plan, in many cases, we can focus not just on death tax, which may or may not affect us. We don't know the law keeps changing it's hard to tell but we can also focus on generating some income tax savings down the road in much more modest estates actually for our families after we're gone having to do with this adjustment of the basis that. We were talking about earlier. So again, look, I know it gets a little technical. But my point is the new tax law. Not only not only leaves most of us out of the death tax business at least for the time being. But if we're clever if we're flexible in our planning, we can take advantage of some income tax options that will help our families down the road. We didn't have in the past so word of the wise. Now, here's the other thing that I've got I I look at my notes, and I get questions during the week. We get questions from clients on a daily basis, we always get a lot of questions, and this is one of the advantages of our seminars we have extended question periods. So if you've got something on your mind that that hasn't been covered in the seminar that's been bugging you or the relates to your personal situa-. Get a chance to get an answer at the seminar and one of the most frequently asked questions, and so one I'm going to mention this morning of mentioned it before. But it's it applies to so many people one of the most frequently asked questions, we get is. Well, you know, what I've got everything I own in a PO D or t o d account with my Bank or with my broker with my mutual fund. Why do I need to have a will retract rainy? This other stuff. However, that's all it does it avoids probate. What did I say about tax planning, not the most important element of your plan? I don't care how wealthy you are not you know, what neither is avoiding probate the most important element of your plan worth doing in almost every case. Proceeds pain in the neck takes time costs money. Let's do it. Do you do that for you? But they do nothing for far more important elements of your plan the first one of which without any question. I don't care whether you're married single who you are in capacity planning. Who's gonna manage your affairs? If down the road, you're unable to do. So on your own. You're in a car accident. You're laid up in a hospital haven't just spent six or seven weeks on and off in hospitals. I know how awful it can be. What if you're permanently incapacitated dementia sets in you, just unable to manage your own affairs? Who's going to do that? Hey, you may say, well, I've got a power of attorney for their name. My name. My oldest daughter to do that. Well, good good step step in the right direction. But you know, what powers of attorney are frequently rejected not honored by banks and other financial institutions mutual funds. Why because the institution runs risk when it accepts a power of attorney, and I don't want to go into this at any link. This is just part of the way our law has developed your agent under a power of attorney get their thority from the law of agency. It's one of the least stable least predictable branches of our law, which means that from this point of the financial institution. They can't really be sure. And every case if your son or daughter, or whomever, your agent is really has the authority they claim to have. And so they take the conservative approach. They're very risk averse. And they say sorry, we're not going to honor that request from your power of attorney, and I could curl your hair with stories. That would infuriate you is. They've infuriated me about banks and other institutions that refuse to take. Pose attorney would they really weren't taking any risk. But that didn't seem to help the situation. So t o d account peo- de account does nothing nothing to help your family, your loved ones, whomever. It is deal with your situation if you're incapacitated. That's a major defect in new ease arrangements. It does nothing to protect whatever it is. You're leaving after you're gone. Do you want your two million dollars your legacy to him threatened by some creditor or a bankruptcy court or an ex daughter-in-law in your case? I didn't I didn't even know if this guy's son was married. I'm not picking on anybody in particular. I'm just saying that wouldn't it be nice? If we could have our cake and eat it to provide some financial benefit for our family member for our loved ones. And at the same time, build a build a wall around speaking of walls, it's called a moat. So we don't get political here. Build a mode around that inheritance. So that it makes it difficult if not impossible for. Outsiders. To threaten dean heritage you left to your loved one. Wouldn't it be good? Wouldn't that be a good idea? We can do the Eddie if we'd do the proper planning. You may have heard me talk about our reservoir trust that we use for this purpose. The T O D, your P O D account isn't going to do that.
