"Never more than fifteen minutes away from today's top stories on every Jonuz news station. KTAR news. KTAR in-depth with that terrible news that ten year old girl has passed away as well this whole road rage incident. We're we're believing is that's what this is joining us on the KTAR. Newsmaker line is Phoenix police sergeant Vince Lewis Vince start with this. Do we know is the dad gonna make it do we have an update on his condition? Yes. So we do have a little bit more information. He will survive, he's recovering. I I just want to express my condolences. I thought the first with the the Brown family as we keep think about ten year olds summer Bill who was seated in. There. I think I've think we lost a sergeant Lewis cell signal. Get him back. Yeah. Was trying to get him back because you know, I wanna boy was Somerville. Yes, summer, I think, you know. It's just unbelievable that something like this can happen. I'm sorry. You were you were talking about about the little girl who passed away Vince when you cut off on the air. Hey, Jim, Jamie. Thanks for having me. Look definitely our thoughts and prayers are with the Brown family a ten year old summer Bill pass away from her injuries. She was seated in the seat behind her father when the suspect opened fire on their vehicle as they entered the driveway of their home on their way, home when what appears to be just really an, you know, an honest mistake on the driver's part when you're out and you're driving sometimes we make over. So we think we have enough time to do. So it it puts you in a precarious position. And it looks like that's what took place boy. And then for the for something like that and honest mistaken the road to lead to somebody being murdered in the back seat of your car your own daughter. That's just it's just it's so hard to swallow. I heard earlier that the shots were fired from a four door white pick-up. Do we know? Anything more about the suspect in this case, it, no, it's an unknown. Male suspect driving that Ford f one fifty four door pickup truck. Yeah. It was four by four model. Looks like it has a black or dark colored trim underneath it'd be like a two tone, look responsibility of this tragedy. Fall squarely on that suspect who made the decision to open fire on a family for what appears to be a traffic violation. If if if that unbelievable what what message you have we're talking with Phoenix police sergeant Vince Louis about this terrible story a little girl killed in west Phoenix probably over a road rage incident in her own driveway. Dad looks like it's gonna make it but he's critically injured as well. What message do you have for those who both make a mistake in traffic like this? Appears this this man made and those who get offended by other drivers. So we we have our personal space, and we take great care to to mind. Our personal space a lotta time. We'll extend that personal space vehicles. When driving should definitely be about the task of driving and avoiding collision. So we we have to just kind of put ourselves in the in the place of other drivers. And and brush it off if there was no question. No harm really just gave yourself enough space around your vehicle and drive defensively. This was a homicide. This was a crime that decision by suspect to use that deadly force for what appears to be an offense or being offended while they were driving to just those no excuse for whatsoever. All right. Thank you sergeant Lewis at sergeant Vint Lewis Vince Lewis of the Phoenix police department at seven forty eight now KTAR. Hey, let's head over to the valley. Chevy dealers. The only other service street wreck's, we've got cooking or at citrus and van Buren, fifty first avenue north of Thomas Watson road at Yuma road. "Now with these video doorbells, you can you can see who's at your your your door and up in anthem just north of the via on video was caught two people in a certain garb. I guess you would say costumes ringing a video doorbell. Yeah. So the homeowner has picture from his ring doorbell camera and the picture shows two people one is wearing a Ku Klux Klan hood and a swastika on it on the on the Klan hood. And another is kinda looks like it's out of the movie the purge. Okay. That crazy. Sick movie. Well, Phoenix police sergeant Vince Lewis talked a little bit more about about the situation that's unfolding up there and anthem bit concerning part of this is obviously the garb is historically symbols of eight the the white hood the swastika that whether or not they wear understands the meaning and message behind that. That is very obviously meant to threaten and intimidate. You say obviously, and it appears at Phoenix police are not investigating this as a hate crime good, and they should. But I wanna make the argument that they shouldn't investigate anything as a hate crime. You can have crime crimes. Greg grabs you're fine, somebody assaulted somebody. That's a crime somebody stole from somebody. That's a crime. Why do we need hate crimes? How do you use hate crimes and how do crimes make it any better? What do you mean better out? How do they how do they how do they solve crime more? How do they how do they discourage crime more because the argument is that if the guy wearing the Klan hood with a swastika on it now ringing, the doorbell isn't a crime, can we we don't think it might be a nuisance ding Dong ditch. But if he if the person in the Klan hood had. Destroyed the front door destroyed. The ring video doorbell. Well, that's that's property crime. Why is wearing a Klan hood? Why would that make it a hate crime? I don't know if wearing a Klan hood would necessarily make it a hate crime. But but you had just said why do we have hate crimes? They're not how how how is having the distinction of a hate crime going to solve more crimes or how's it going to discourage more crimes? I don't think. Having the aggravating factor of a hate crime is about solving or discouraging it. I think it's about punishing Ed at a higher level with the punishment is subjective. Because on some level, you have to assume what was in the criminals heart in their mind, what not necessarily what is in their heart harder was in their mind. I mean there are times where it is blatantly obvious. Why a certain individuals targeted and if they're targeted because of their race if they're targeted because of their sexual orientation, if they're targeted for, you know, gender identity then that could potentially arise with the aggravating factor of being. Hate crime. But it's already a crime to attack them. And again, I I have a problem with the that you are living more punishment your, and you have to make some certain assumptions to now some of them may be obvious some of a may not. But again, if the person if you're wearing your clan hood with your Nazi swastika on it because you're in idiot and you're walking around anthem ringing doorbells. Let's take anthem out of it because anthem isn't a hate crime. If you're walking around ring doorbells, it's not a crime. But if you're wearing that thing, and you walk up, and you punch somebody who's at a hate crime because you were wearing a Nazi hood. No if you were targeting somebody because they're black how we knew they were targeting. What did they say? So what you're wearing? Or what you say is is definition of could make you could make an argument for that as well. I mean, we have rating factors for a variety of different things. Not just hate crimes in that aggravating factor levies upon it a higher punishment because of of the factors involving it. And so I mean under under that kind of argument. You know, I if you are preying on somebody who's vulnerable based upon their age, whether it is a child or the elderly you can have another aggravating factor punishment is more severe. So if someone is and we have this story what was a couple of weeks ago about people getting the phone calls a scam social security, your social security number have been hacked, or whatever the terminology that using my social security social security. Thank you very much. What do we know that in talking with people like attorney general brnovich it, you know, the elderly are targeted that is it hate crime. Chris retargeting peanuts on a hate crime. No, no. It could be an aggravating factor. There are different aspects of it. I mean, another aggravating factor because I think that that's what you're arguing here. A hate crime falls under the category of an aggravating factor. As does if you have prior convictions. So if you are a criminal a known criminal, and you commit another crime, your punishment can be more severe because. You have a history. We have these different aggravating factors. What you're arguing? We're going gonna talk about in the in the Justice Willett cases. But it appears that for me and the way I see hate crimes hate crimes are used. To go back and prove motive, and whether you're your motive to commit a crime, racial, hatred, or greed or Bure board. I don't know your victim. Who your victim is they can go back and retroactively tried to prove that that was a hate crime. Because of your victim. I find it difficult to glean the intent in someone's heart again, using this this doorbell incident. And the idea that some people think that there might be a hate crime wearing a plan hood is not a hate crime. I'm not I'm not saying I didn't say you were police did. So the idea that investigators a nuanced behavior. Symbols depicted in the video or clear historic symbols of eight at Phoenix police sergeant Vince Louis so the idea that that the wearing of a clan hood is in and of itself. Hatred. You can go back and again retroactively, everything you do while wearing your your clan hood is is a hate crime. And I have I have difficulty with that. Because I I think there's a better than better than not odds that the person wearing the Klan hood with the swastika is not a member of the clan, nor a member of the Nazi party. They're just wearing a stupid hood. And here's a little bit of more of what sergeant Vince Lewis told our KTAR news department. There's a difference between a hate crime and a and a bias incident. Clearly, the wearing of the garbage ringing the doorbell and running. It's it's it's more or less a bias incident at this point, we stopped established what the crime is if there if there is a crime, but because the symbol is being depicted there just the act of of. Concealing identity not wanting to be caught while they perform this, really. It's a nuisance behavior that is up concerns. Yeah. Bring ding ding Dong ditch or doorbell ditch whatever it's not a crime. I don't think it's a crime. I don't know if it is a lot of a center, it's annoying. Yeah. Every five minutes or something. I mean again, but, but the only reason we're talking about is because they were the Klan hood is the only reason I'm sure there are people that ring doorbells and run away all the time. But if you're not wearing a client hood, it's not a story. I wonder if we would be talking about it. If you had several people dressed up as characters from the movie purge ringing a doorbell and running away because I suppose need go. What Bhaskar they wear that would be disturbing too. I mean, I think we. We talked about the guy who who spent hours licking a doorbell. He didn't have a hood on. We saw his face. It was weird. It was disgusting. Police were looking to talk to him. But we talked about that. I think the whole idea as to whether or not this is a hate crime. And should we even have hate crimes? I mean that discussion better fits like the jussie smollet story out of Chicago than it does the Klan hood in the doorbell and anthem, but they both they both work in that world. And again, you know, the the whole idea that hate crimes in some way, shape or form are either discourage or which I don't think they do. But again, I think they're used improperly in many cases to go back and retroactively prove something. When maybe the victim was just a victim. I'm sure it's there there's sometimes that is the case. But I think there have been other instances that we've had where it's been abundantly clear why individual was targeted an thought just because they're a victim. It's because they were gay or they're black or they're Jewish. But you. And whoever attack them did whatever should be prosecuted the full extent of law. The hate part is the part I have a problem with because I could make an argument that any especially physical crime or assault or murder or rape, or whatever has an element of hate to it. So why is one more hateful than the other? Why is one that will that is a hate crime? Because that person was gay when you walk down the street and punch them. But when you punch the guy that's not gay that wasn't a hate crime. I'm not buying it should the Arizona schools, the entire public school system ban ban kids who haven't been vaccinated. There's an argument behind that. We'll tell you where the argument comes from right after Bob McClay checks in with our top stories..
