And we just kept waiting to see what was going to happen. Ultimately, it was a tie vote on the W. E C not to change the manual, which means the manual will stay the same. But this is the kind of crap That that the partisans on the W. A meeting that had 24 hours notice they gave the recount manual to the commissioner's just three or four hours. 38 page manual. No red line. Why would you do that? We should change the manual to undo the Trump petition and the Republicans on I I imagine it was somewhat difficult for some of them to reach the conclusion, saying, I think we should probably keep it the same. They were going to just do these changes, but the commissioner's insisted that they have a meeting. They imagine that they just done the changes and we didn't have a meeting. "The Vicki McKenna show I do want to just point out in there now, a couple of articles news articles written about this but as the day ticks by additional law enforcement agencies are announcing that they are not going to be enforcing governor either is latest emergency declaration and Masks Mandate i. saw one about an hour ago from the Brown County Sheriff's department. Here is the Mo Managua Police Department I'm GonNa read just a portion of an aqua police department statement just because it's funny. The monopoly police department lacks the resources needed to enforce governor. Order, mandating the wearing of masks and ton. Of Managua. Taking this into consideration, we will not enforcing the governor's order that mandates the wearing of masks starting August, first two, thousand twenty nor will we be responding to complaints about mask violations? What would you do if you see someone not wearing a mask? Even if you think they should be nothing some people. Have conditions or circumstances that would make a cloth face mask covering difficult or dangerous just where your mask and stay six feet away from them. I have rick asked some Bergen from Wisconsin, Institute for Law and Liberty to talk about the actual order itself not the details of the order. So it seems in the last time we talked about this, which was a bit of time ago that if Tony wanted to extend his emergency order which expired in sixty days beyond sixty days, he needs approval from the legislature. He did not seek approval from the legislature. It seems if you read the order that it seems like this is an extension just simply. Portions of the other order tweet So this does look like an extension and furthermore whether he you know he got permission from the legislature to do this or not. It does seem like the legislature can pretty easily dispatched with this if they want to. Yeah. Both of those things are true I. You know the governor has the ability to a public health emergency under our law. But that ability is strictly time limited. You can declare this emergency for sixty days. The legislature can resend it during the sixty days if he wants, but you can only declare for sixty days as governor. Legislature. Extended for another sixty days but they did not do that in this case, and so he declared a public health emergency, the public health emergency expires. He's now operating under the fiction that he can declare a new public health emergency but. If. The courts were allowed to allow him to do that. They would in effect read the time limit out of the statue. Because he's declaring his public health emergency in July based upon an outbreak of cold, he declared his public health emergency in March based in a break of Kobe, cove it never went away You know the infections went up went down went up went down as one might expect to happen. But to say that this isn't essentially dealing with the same crisis that we've been dealing with the last four months it seems to me as just a fiction it's I made up and and I don't think anybody ought to take. That seriously. All right except that it's being treated as if it should be taken seriously and you have one house, the Senate saying we're ready to call a special session and pass a joint resolution rescinding Iverson Authority, which is also empowered under statute three, twenty, three, dot ten. The legislature can reject this overtly without requiring the governor's signature, but you have the other house saying we think citizens groups are going to be suing over this. It seems to me that one takes a lot longer than another although perhaps both of them. Might be useful. So I I mean to have the verse administration slapped back by the courts could be useful. But at the same time, as that goes forward, the legislature is going would then wait on a special session to rescind the order. Well you know I. I can't believe I'm saying this is public interest litigator but I have to say it in that is that The you know the outcome of the lawsuit is always very unclear in very indefinite I've been doing this long enough that I don't guarantee predict any outcome even if I'm fairly certain of it because I know it can always go the other way. But if the legislature was sins, this public health emergency if they vote I joined revolutionary, send it. It's rescinded. There's no question about that. And at that point, if the governor wants to have masks mandate, then he's got to work with the legislature he has to propose. To propose something that they would pass into wall or he has to, you know proposed rule that JC are would allow to go through He can't act unilaterally and you know what the outcome is. That would be I can't say at this point, but the outcome of litigation is uncertain. The outcome of legislation is certain and to be honest you know there are there could be some judges who would say, well, you know we we we kind of think the legislature should act on this and so. I you know as as as much as I have respect for those guys to simply say, well, we're not gonNA do anything is a private citizen might bring a lawsuit I. I don't think in this instance that That's the best way for them to about about this. If they think that the governor has overreached them, they need to take a vote and face. Yeah and we have God multiple press releases. So we've got the Senate Senate Majority Leader Fitzgerald, saying my caucuses ready to do this we are ready to call a session gavel in PASA joint resolution. We're not getting that commitment at least not yet from assembly however, Multiple Assembly. People have put out statements saying that this is this mandate is wrong. This is this is an overreach Some of them are hinting that they believe it is not lawful. So the assembly needs to simply declare that it is willing to go into session as well. Instead of dancing around and hoping it could smack it and wait for somebody to contact Wisconsin Institute for Law and Liberty and file a lawsuit because that will take a long time you and I've talked about this a a rapid turnaround for a court. Can still take a month people complain about it, and then I'll bring you on the program and you'll say, well, actually Vicki that's really fast for the court, but still you're talking about weeks at a minimum. Right, and the other thing to keep in mind is that it is quite possible that the legislature would find itself in the same position. If a court rules that the governor cannot declare public health emergencies in series arising from the same underlying which I think it should I think that that would be an important principle to establish There are the things that governor might try to do the governor might try for example to promulgate a rule requires a mask requirement in the State of Wisconsin at that point the ball with Dan, and again be the legislatures court to For JC are to decide whether it wanted to insist on modification of the role when wanted to block will going into effect in. So we're back where we started again, and although you know there's always a possibility litigate over the extended rule. You know we're we essentially you know. The issue still remains open and so you know as much as I'd like to think that you know public interest law can be the savior of you know all of us and maybe sometimes it can help in this instance I think the first the first responsibility does why with the legislature something else I thought was interesting and that is the exam salaciously in the judiciary. Why do you think the ramifications for that? You know the the PC movement has expanded to just more than verbal abuse. You can actually get physical abuse. You can lose your tab. All kinds of things can happen. So a lot of people have decided that it's much easier just to to cower in the corner and hoping alone, 'cause you a bad man, you know that's true and let the people who are doing this and willing to get you fired and willing to attack you in your car. If you make the mistake of driving, you know into one of the occupied anarchy events that are going on. They don't even understand what they're doing here in Wisconsin. You're right and they've got the education system and they've got the media, and in many respects, they've got the courts, and they are beginning to convince people that it doesn't work because we're seeing an unequal application of the law, we're seeing a breakdown of peace and order a breakdown of the rule of law. We're seeing an assault on our story. The American store if you don't understand the American story than what is this nation anything more than just a place where you live, and if it's just a place where you live, and there's nothing special about. About it, then why not change and that's working I mean we've had forty years of indoctrination in the public school system with social media. Now you have the mainstream press able to have a much broader reach an radicals from the university able to also have a much broader reach to control the Narrative I. Mean Our folks look at this stuff? And they think that if they speak out, then the and I think they're in the minority, and they speak out that it's it. It's actually potentially dangerous for them. Madison you've got the Milwaukee Police is tough, and and he's saying well. Okay. We'll let me sit down and help you find ways to cut our police force back. So. There's not. There's nothing that anyone we'll do. That morality have put for. You? Want to look for some money. Look at the Milwaukee. Public School budget one point two billion dollars a year for all of that. You know your. Why don't we cut the budget of the Milwaukee? Public schools and fund all these other folly, said you wanna you wanNA chase after and leave the police along. He should not say well. While in hospice, there are many assisted living facilities were not allowing hospice nurses and aides in unless the person is very close to death, chaplains or social workers, either so really. What's use of hospice right now here? Is David? Thank you for all you do. Our Father passed away on March ninth. Not of the virus. He was ninety six year old World War Two veteran as a large family. He had seven children. We've not been able to gather as A. A family to mourn his passing, no funeral was allowed. His wake was limited to ten people in the funeral home at the time, which meant as a family, we still could not be together. We gathered small group of the family's spread out at Union Grove for his burial and had a twenty one gun salute. We know we are not the only ones feeling loss and confusion at this time, but we're happy that our father who fought major battles in Europe for this country is now in heaven with mom and not able to see this great country. Lose itself. And then here is I'm a flip at one of the freighter clinics, not going to say the name of this person. Obviously my hours along with everyone else's have been cut in half now. A lot of employees are not even getting their unemployment. We're not sure on the unemployment side or the freighter side. Awful bottom is that came in to take the other half of my hours. Today told me she got thirteen weeks last. Thirteen hours last week is a single mom. Wow now. No unemployment, check. What's going on is ridiculous. There is no reason why we we all can't be wearing peas and see patients we get fitted for. All the time when it comes time to use them, we're not allowed. These stories. And you want interested. I am. It's not just about Cova nineteen confirmation numbers. It's not just about you know data on unemployment. It's not just about taught vague talk of problems in the economy and the potential for depression. Is a real people. Through your neighbors. Your kids your friends. That's who they are.
