Now another legal story where watching Vanessa Bryant, the widow of basketball star Kobe Bryant is suing Los Angeles County, saying her privacy was invaded, when sheriff's deputies and firefighters shared photos of the crash side with their friends in college. The trial is expected to last about two weeks and witnesses will likely include Vanessa Bryant and LA county sheriff Alex villanueva. For more in the case, Bloomberg's doing grosso speaks to Warrington Parker, a partner at crowell and mooring. A primary issue in the case is whether she suffered emotional distress as a result of the county's actions. So Los Angeles County officials are arguing that she suffered emotional distress from the death of her husband and daughter. Rather than distress that the photos were leaked, how can a jury separate those? Well, emotional distress damages are always a very difficult thing, both to prove and to disprove, right? It's just how much are you hurt and there's no clear marker for that. However, I think the county has a difficult time with that argument made. Certainly, without any dispute, someone suffers emotional distress when a loved one died. But I think it is within the realm of experience and probability that you can exacerbate that emotional distress by mistreating the family of loved ones or taking photos. Really, according to appoint us at least, almost like it was a trophy hunting type of experience. And I think any rational person can separate out one trauma from another. Now, does that impact your damages perhaps? Yes. It doesn't make it impossible to conceive that she suffered additional emotional distress because of these photos. I don't think that's true. Which side do you think has the better case here? Right now, I like plaintiff's chances and let me tell you what I'm thinking. You have a case where word photos were taken. And there is a history of these photos being taken in a cool book. You have a case in which people have at least as pointless painted have lied outright lie about what they did with the photos and why. You have the defendant saying that these photos were taken and then distributed for the purposes of training. But you have them distributed at a bar, you have the distributed to a person playing a video game. You have a distributed and awards ceremony. That doesn't make sense. And I know that the defendants are saying that they immediately told people to remove it from their phone in order to mitigate any continuing. But there was no attempt to ensure that these photos were in fact destroyed. And it looks more like they were trying to cover up more than anything else to add the extra spice is you have at least one of the deputy saying, should we really do this? And so as an example, it's well known in the insurance world that if someone is claiming back injury and collecting insurance, they'll often be photos taken or video taken of that person lifting heavy boxes. And so on. And that's perfectly admissible. But merely to show someone has the ability to live in a rich lifestyle isn't sufficient to rebut a claim of emotional district. There is one photo of her on Halloween dressed as Cruella de Vil that talks about the stages of grief and she adds one called revenge. My fat have some bearing. Perhaps, but fairly minimal. The fact that she's seeking to vindicate her right, whether you call it revenge or you call it speaking to vindicate what you think is the wrongdoing is, I think, well within the norm. Which side do you think has the better case here? Right now, I like plaintiff's chances and let me tell you what I'm thinking. You have a case where word photos were taken. And it looks more like they were trying to cover up more than anything else, including though in that the extra spice is you have at least one of the deputy, a higher deputy saying, should we really do this, we've gotten in trouble before for this. And I'm paraphrasing. And so even at that time, there's a bit of dissension about this. I would have just two more points. First of all, you know, Kobe Bryant is a well-known figure in Los Angeles. His wife is a well-known figure in master Angeles and no one thinks anything bad about them. Contrast that to the Los Angeles Police department in the Los Angeles sheriff's office, where at least the sheriff's office has very recently been in the news for threatening a newspaper reporter. And otherwise, doesn't necessarily have the best PR campaign in the world. I think these are the things that will weigh in for the favor. How much money they collect much money is awarded as a completely different question. But on the issue of liability, if I were handicapping it, I would put my money on point. And what do you think the biggest legal hurdle is for Bryant? I think that the biggest legal hurdle will be whether or not what happened here is consistent with the viable crime under the law and defendants are certainly saying no exception that this is not cognizable under the law. That it does not fall within the scope of prior cases. The Los Angeles County agreed to pay two and a half $1 million to settle a similar case brought by two families whose relatives died in the crash. That indicate to you that Vanessa Bryant is asking for more than that or there were reports that she just didn't want to settle. I don't know the answer. At least believe that she must have been asking for more. Just finally, I'll ask you about the jury, the jury includes a nun, someone who works in TV production, a college student, a real estate investor, a pharmaceutical researcher, a computer professor, and a restaurant host, so a real cross section of LA. We were also granted of one on one with sheriff fiend away. But now he hasn't been speaking at all about any of this because He's being sued by Vanessa Bryant, and he's being sued because they're two lawsuits against him in the department over the crash site and over the pictures that the deputies took at the crash site. And I reached out to the department in my contacts there next to the list that I really would like to sit down with the sheriff. And I would like to talk to him about the events of the day. I said. I'm not. I don't want to ambush or anything like that, because it's all litigating units, all pending litigation. I know he's going to be able to talk about it. So let's just go past that. But I So we went back and forth. We had to negotiate this. We had to go through the county council. Believe it or not, just for the opportunity to talk with him about it. I didn't think it was gonna happen, and then I get a call from the last minute. One of the captains, and they said Okay, the sheriff, the sheriff's going to talk with you. But you know, we're gonna have some people in the room and I said, that's fine. I don't care. So he granted us an interview Now when the sheriff left captain came up to me and said, I just want you to know. 15 media outlets have requested to talk to him about the anniversary of Kobe Bryant's death. You're the only one that was branch of the interview. Spring. Impressive. It's actually no surprise. I am assuming that there was no great revelation that was given and the sheriff is being soon actually. Itwas wow, you'll have to lift you have to listen on Sunday. He was in Whittier the day of the crash when he got the call, and when he got the call and the White House and did you know it was Kobe said, Well, they didn't know They were just operating on speculation at that point that they said we need to let you know that it's possible. Kobe Bryant was on the helicopter. So the sheriff knew this was gonna be a mess in terms of paparazzi and everything else so he Is he high? Tailed it up from north wittier when he gets to the lost Hills substation and watched in one of the first people he meets us in after Bryant. And he talks about that exchange with her and the other families. When he gets in there something he's never talked about before. Now, it's important. We know what vilification is about. It's not that the sheriff's department was was in any way involved in the crash itself. No, no, nothing like that. What had happened with some deputies apparently took pictures of the crash site, including the remains, and that in itself is sort of morbid in the cob and But that's one thing. But the other thing was. Then you hear the story about the at least the one deputy who was showing the pictures off of the bar and the bartender overheard and oversaw what was going on the bartender's the one that reported it. When they looked into it. They found out that there were deputies that we're doing that on the crash site. So sheriff immediately took administrative action. But the losses feel a lot of with how he reacted what he did, and the allegations from Vanessa Bryant in the state. The emotional distress that that incident caused because now they know there are pictures out there floating around of dismembered bodies and you know and the remains if you will, and those that's why the lawsuits were filed. But from that the sheriff actually took that and made it into legislation. And that was a bill that was just recently signed that now make that a misdemeanor for anyone to take pictures at a crime scene or crash site specifically like that. It's a rule that has never been in law before. No other than I think the Web the investigators who are tasked with doing exactly that Also before we go, I know you have an interview with real FM is a big boy, and I didn't know he had that close relationship with Ryan.
