What was the takeaway from the war room over there? Well, I think lane is, it's a little bit interesting trying to get used to Elaine kiffin dealing with this team as presently constructed. And I think you see reckoning with it in real time. They may not score a bevy of points. But as a welcome change from years past, you're probably not going to eat. They're going to protect them well, and I think that's something that is unique to laying kippens resume at the moment. He has a long history of teams that move up and down the field at will, but he does not have a track record of defensive excellence, and that is something that I think is a sign of his maturation as a coach that they haven't forced anything this year as far as I can see either in Jackson darts development or in terms of what he is. Like this may just be what this version of Jackson dart the 2022 version is. So like, congratulations to him for being a slow hand at how he handles this team right now. It's winning. It's weird to hear, but it also looks real nice on the scorecard. Talking to Richard and of course, let's switch to a couple of other more pressing matters and that's Georgia. What happened to them? I thought they were the best team of all time. I thought they were about to be awarded another national championship. Missouri is the second best team of all time. That's the only possible answer. That's the only thing we can say. Yeah. No, I think Missouri deserves a ton of credit in this game because this was not a fluke. This was not smoke and mirrors. Missouri came very close to winning this game and I understand you may say, well, yeah, they only lost by four points. There's ways you can lose by four points and it doesn't look that competitive. Missouri was competitive in this until the end. I think they will rue the fact that some 7s ended up turning into threes in this game. Harrison deserves to be lauded for his performance in this game, particularly after what happened at the end of the auburn game, but the problem is Harrison beavis had to kick 5 field goals. Yeah, they were one yard away from scoring on one of those and it was the difference in this game. It was four points. That's like literally what they did not get Georgia would have been going for OT on that final drive if they had made that and not had it called back as the penalty for what eventually turned into a field goal. If you ask them, what's wrong with George, they're a team. And they're a team that has to play on the road. Well, and they're a team without the defense that they had last year. Yeah. It was not a stretch of any amount of imagination. They know Georgia team that got gutted by the NFL on defense was going to step back on that side of the ball in some way, shape or form. They are obviously still probably the best defense in college football. It's not like Missouri scored 50 points. No, but it's also not like Missouri didn't have a good game plan, which was hymns, debts and Bennett in. Okay, pressure them up the middle. Keep them in, make them see if he can pass through his wide receivers and dare Georgia to run. Do all of those things, and you might stand a chance. Finally, Alabama. Goes into the epic showdown this week with a and M. I remember talking to you guys months ago about circle, October 8th on the calendar. My circle disappeared. What's wrong with this game? Nick sabre does not get enough credit for being exceedingly petty on the field with how those teams over the years have at times really dropped the hammer when there are some extra motivational factors during a race. I think Spencer, that there may be some extra motivational factors. "Claire, UW Green Bay, their budgets. UW whitewater stand up. Whitewater. Exactly. They have been cut for decades. Faculty are not replaced. There's more adjective to the faculty. And the budget cuts are now leading to the cutting of the very humanities programs that people who are setting up the university of the Austin world saying these are the types of programs we probably need to have to have a free and open inquiry. They're not going to be there anymore because there's very much a sense of that elite stuff of the liberal arts is fine for students at Harvard and yell, but students at UW whitewater don't need it, which is a horrible argument. So that's one point the other, though, on the admin. So this point comes up all the time. And this is, again, we're all pushed back as someone who's at the university of Wisconsin. A huge amount of the growth in admin over the last 30 years is because of obligations imposed by the university by the state and in particular by Republican state legislators here. Also about the Department of Education. So we now have a much more complicated burdensome post tenure review process. Every X number of years post tenure now there needs to be a formal review. It creates all kinds of paperwork. There are administrators that need to administer that. And so a lot of it's not that there isn't growth administration, and some of the arguments about to make very good points. But alongside the defunding is there's more and more rules you have to comply with that the state is imposing on you, therefore you need more administrators. And it's a zero sum with the money. The money is going to go to that, which means you're taking even more money away from hiring faculty. And so I sort of just want to push back on that a little bit because those things go together. And the growth of the administration is not just bureaucratic inefficiency or universities deciding we need to police speech and stuff like that. At a lot of schools, and especially at public universities, it's coming because of political pressure of you now need to do this and we need to report on that and you need to investigate that and you can administrators to do that. That some of why, as we were talking about at the beginning, I'm really skeptical that the people founding the university of Austin want to do that sort of work that administrators have to do to actually run a real university on a day to today basis. I just don't see these people as being invested in that project. When the drive for censorship is coming from other students, whether it's students who are trying to get a professor removed or students trying to get another student removed, how do you think universities can and should respond? And how do you think students can respond as well? I think that freedom of speech is hard. I think it's counterintuitive. I think that everybody gets that they should have free speech, but they don't get to the other person over there should, because that person's gonna be a blast femur. That person's gonna say something offensive. And that's why I try to refer to freedom of speech as the eternally radical idea because in every generation somebody rises up to oppose freedom speech. And usually freedom of speech is on the failing side of it. What you need is an education and you need to start this early and often about some of the habits of freedom of speech. So like when we were younger, there was more of a you can see a cultural values a lot of times in their idioms. So when I was younger, you know, it's a free country. Everyone's entitled to their opinion. Walk a mile on a man's shoes. All of these kind of idioms that kind of undergirded the idea that were supposed to at least hear people out. For that matter, even none of your business was part of that. I fear without active teaching about freedom of speech without actually inspiring people about this larger eternally radical idea. It will start to just naturally erode. So I'm hoping to do more public education from K through 12 on I'm even working on a comic book about freedom of speech, for example, because I'm a comic book nerd. To try to explain some of these really deep and quite sophisticated principles that we were lucky enough to take for granted in the 1980s and 90s, in part because we had a decent free speech culture and also the law is quite protective. The situation that I feel like we're in now and I think this is contributed to by the right left and middle, is that we have very strong free speech laws under the First Amendment in the U.S., but our free speech culture has been in serious decline in recent years. It's our job as faculty and the job of people at universities to inculcate this kind of discussion and be able to show people this is what we're trying to do at a university is here arguments from all sides and learn to actually do the sorts of things he Greg was talking about with the idiom. But it's incredibly hard. I think the thing is useful to keep our eyes on is universities do that better than any other set of institutions in the country. So yes, these problems exist. And it's not that they're not problems. But again, what institutions in American society are better at having a wide range of ideas and debate and free inquiry and protecting free speech. I'm pretty sure it's not private corporations. I'm pretty sure it's not individual religious organizations. So to some extent, the problem I think is never going to go away because the very nature of what Greg said we're trying to do as being universities. And the project of liberal arts education makes lots of people uncomfortable. Back to what I said earlier about you asked me how many conversations have you had with students? And I said, almost none. I mean, there's nothing that makes you feel better about the future of the country than spending your day with 18 and 19 year olds. They want to know about things they're deeply interested. I don't have to justify why things in international relations are interesting anymore or Wi-Fi financial crises are interesting anymore, given just like look around at politics, right? Right. But again, the overwhelming majority of them, they want to have these debates. They want to test drive ideas. They actually want to interact with each other and hear opposing viewpoints. And that's what some of them are there for. Again, I don't have any solutions, but I think I cultivating that for me is the way that I as a professor on a campus, like try and cater to that because that's more of what we need in American society. "August as i'm really awesome. Your thanks so much really glad to be with and so with us. Today are two guys. I'm proud to call my friends. Both of whom were wrongfully convicted of a crime. It never happened. So first of all. Jared adams your journey post exoneration has been nothing short of remarkable. Jared has been an attorney with the innocence project. He's now at private practice. He's author he's been on. Tv a bunch of times jarrett. I'm so sorry for what you went through when i'm glad you're here. Thank you jason. I appreciate you having me on and with him is dimitri hanley. Dmitri was convicted of the same crime. The jarrett was convicted of again is a crime that didn't happen and dmitry still has not gotten justice. And we're going to get into that. So i appreciate you being here dimitri avenue. So before we get into the story jared and dmitry where did you grow up and how is your life in a nutshell before this. This insane saga began so we grew up south side of chicago in attended the same high school a little bit outside of chicago in the suburbs. And you know we met through passing but we knew each other any working at the same summer job started to hang out together. So jared take us back to the day in question is september six nine hundred ninety eight. You dimitrios third friend rove on hill. You guys headed up to the university of wisconsin whitewater. Go to a party. You know. Just doing normal stuff. The kids all over the country doing basically every day right. Yeah so. I mean that's the neighborhoods in which we need to meet you. Grew up in are extremely rough. And you know. We weren't in games during drive-by shooting each that's were into each one of us came from backgrounds and families where our families were active in our lives. Going what you're doing so how we got there was this. We each told our parents. We were spending the night over each other's house and we all three went to go to this party and pool. What is known is like a all night. We will go up to the party party all night. And then afterwards we would hit a waffle house and be back home about seven eight in the morning right. We had done it before no issues. No problems at all and so we go to this party and we're looking for the main central party room but when we got to this campus. It was parties in every dorm room. You can go to this dorm room beer pong dorm room people smoking weed and drinking and so we were kids. Escaping the violence in chicago go wanted to a party on a college campus. Like so many other kids do each and every day in america yes mean i think a lot of people are listening now and going. Hey reminds me. One time. I went out. I told my parents and then i snuck in and you know so. Who is sean domain. 'cause you ended up going to his room to use the phone right. How does that play into any of this. So charlemagne actually saved. My life is who he is because he was the person who you know unbiased in support our version of events the truth and so when we go to this college campus again. That's parties everywhere. But we're looking for specific party. So we talk to sean domain. Who was outside in like smoking area and disorder to our understanding. This is nineteen ninety eight so this is before everyone has cell phones pagers so we went to use his phone but what we were doing it was like his room was like party central cecchi so it was several people who would come in and got guys doing. Hey we're getting ready to go here. You got a beer you know. Hey we'll be back downstairs a little later. We were all playing video games. The net so when we're playing a video gains is when these two young ladies come into the dorm room and we're flirting we're talking with laughing everybody's drinking and eventually we all make our way upstairs to our chooses dorm room and we did it like staggered first dmitri and von went up and i came up a few minutes later and we were there. We were in the room and we add consensual encounter and this young ladies roommate walked in on it and that's when the wheels of a false accusation started to turn so the roommate walks in on you in the midst of the sexual counter and caused the accuser slut and then runs down the hall to a friend's dorm room. Now at this point your accuser gets up goes after the roommate but doesn't say anything about being raped or salt or anything like that but simply knocks on the door and says are you mad at the roommate. Wouldn't open the door. And according to a sworn statement i have right here. The roommate said and this is a direct quote. I told her to go back to doing whatever she was doing. But not on my bed so it's probably fair to say that that might have been what made her mad so the accuser went back to the room they shared and continued the sexual encounter. So i mean. I don't think i'm alone here in being confused. Because if an actual assault was taking place as was alleged. Why does her roommate call her a slut instead of trying to do something to save her or summoned help after chasing her roommate down the hall. Why did she go back to her room. Instead of trying to escape or again trying to cry out to get someone to help her. It doesn't add up number one. The roommate walks into a room in sees the accuser on her bed engaging in what her looks like consensual sexual activity. That's why she calls her a slut and runs down the hall second point. If it's a rape are these guys going to let the victim get up and leave at her on her own free will yet. That's exactly what she did. Then if it's a rape is the victim going to say. Are you mad at me. Or she can say. Hello ma'am may but no she says. Are you mad at me now. The question you asked his. What's the explanation as to why she walked back to the room. The closest they came to an explanation was that she was going to leave and she was walking towards the stairs which took her past the bedroom. There was a stairwell at the other end of the hall. She didn't go that way. She walked back towards her room and in the process she walked past a room of the ra who lived on the hall and didn't knock on that door. Ask for help. During the course of the encounter she got a phone call from somebody and she chatted on the phone and giggled. Never said anything about. I'm being raped. I mean it's just a head scratcher how anyone ever could have thought this was a sexual assault. And not only that. I actually copied her walkin down to the room at roommate went into and i was there with her. Washington was standard trying to talk to her door and when she could not even get any access and went back to the room. I stayed there because i tried to talk her roommate out of the room. Because we talked a little bit. Sean damage so i can actually hear them in a room. The roommate in the residents of that room having a conversation but they decided not to come out. So i went back to the room. We engaged in sexual acts and then we actually went downstairs to the smoking area and i thank god that we all did because when we went downstairs in the smoking area sean domain was outside and he was the one who created the time. Line of corroborating our innocence. It was so so crazy because this thing was out of embarrassment. You know this girl didn't go to the police or or anything. She went to a friend and said my roommate's making these accusations about me being slut saying i was sleeping with these black guys. That didn't happen so before you hear it. I was actually rape it. Was that friend who went to another friend. And that's how the rumors started the circulate in an investigation. Started this young lady through. The help of the police said that she walked up to her dorm room and was opening the door and before she knew it two to three black guys she didn't know was behind her and we just walked away until haroo cut the lights out and play music. The accusation wasn't that she newest or that she met us. We knew we have been invited up. We knew that after the room a walked into the room we it all went down in the smoking area. Where we were with sean domain again. And so if you're asking the questions about how on earth could incomplete in crazy story like this. Make his way to a conviction and resulting twenty eight and twenty years. It's because we were try as black men raping a white girl and did not matter if it made sense because of the historical depiction of black men and white accuses and we know how that can go. Three young black men from chicago visiting uw whitewater. It's a fairly rural community. That's very white and a lot of these sexual assault cases are difficult because he said she said but this one in so many respects wasn't even he said she said the accusers. Own version of events was actually in many respects in many important respects the same as dmitri and jared's version in that she candidly admitted on the stand that no one used force against you know one raised. Their voice no-win threatened her. And so when. I read the transcripts of this i was scratching my head and said we'll where's the sexual assault. All we see here is that she says they engaged in saxon. What made it a sexual assault in the prosecution is ending. This communities is was that she claimed despite the absence of any physical force despite the absence of any threats she went along with the sexual acts because she was frightened of these men will think about why in the world would she be frightened of them. If they're all at a college party together they'd been flirting and she invited them up to a room. You know nobody was doing anything. Unders writing the only thing that i can conjure up in my mind that explains this potential is that they were black men. You know why was struck. Also as i was reviewing aspects of this horrible story that there was a number of months went by before you arrested and of course i'm talking about december first nineteen ninety eight. But why was that. Elapsed time in their. This must have been all in just distant memory at this point right. Yeah yeah. I really can't answer what took so other than to suggest that i mean clearly. If it had been an open and shut case from the beginning wouldn't have taken so long clearly police and prosecutors recognized that there were problems with this story and they took some time to build the best case they would so unbeknownst to us shoddy main road. A three pays handwritten statement saying everything that we're saying right now on his podcast so the police had already had that statement in. Couldn't explain it in the end. They win did a check on the phone records. And during the time that we were up there in his young ladies roam. The phone was ringing. She was on the phone talking to france so dory's instead of allowing evidence to tell them the truth. They decided that they were gonna make a case in base it off of race in. Nothing was going to keep him from doing that. So lead up to the arrest I'm working as an assistant manager at this grocery store and my dad comes by the job and says hey you know. The police came by the house. Won't you come down to police station rule you out s a suspect in an armed robbery dead. This is absolutely nuts. I said i'm not going down there. Man because i don't know what they're due to knee. I heard stories. I didn't think it was to be a good dip. My dad was at an all. I think you should go so make a long story. Short at work with down there. My dad went along with me. He was did not lobby. So i'm talking to one of the text at the time. No we just wanna rule you out you know. We don't want you to get in trouble. We get done accident a few questions. Maybe we'll take you downstairs sticks pitchers so i said okay. Fine no problems that's happened. Same thing get to me. I come home one day in. There's a car to my door and his the police say robbery homicide. Yeah no they got the wrong guy. Let me let me call them before my crazy father cds and his door and just go nuts right so i called in. The guy was i. Hey you know this is the sector so and so you know we just want you to come down and take a picture so we can rule you out of his accusation. Because you know we know you've never been in trouble. We don't have a book vote or anything like that. Just come rule yourself out of mom. Wait so when i go down there. And they have an investigator from wisconsin and investigator is asking me all these questions about you know us going to the party. Did you go to the party that you have sex is party and i'm answering the question straightforward like doing. Now yeah you know. We had a crazy incident with this girl and her roommate were arguing so they come in arrest me for first degree sexual assault and i'm like sexual assault. When it is time. I was in disbelief. I couldn't believe and then a kid at the time thinking that going to rest me often Right here to prove my innocence. Nabi right.

"What the heck is going on here, Steve Yeah, that is probably the case today. Their leadership will have a letter from me today requesting that the committee. The Joint Committee and administrative Rules would like to proceed to court and it takes leadership to do that. To give the okay so we need to go to court. Um And the reason is it's about the rule of law. The joint committee administrative rules that the public knows is like the firewall. Administrative rules have the force of law and if we just step back and ignore what agencies are doing They will run roughshod over are and what's happening right now. Is there running roughshod the UW system over student And visitors. The students in particular that the hammer came down and they have to wear masks. They, uh, if they haven't been vaccinated, they have to get tested once a week, And the point is, it's not for me whether You are vaccinated or not, Uh, the mask point. It's about the rule a lot. The the UW system needs an emergency rule, and they need to come to the committee. The joint committee administrative rules. To have that we will reviewed you can't just go willy nilly and do whatever you want, even though the bureaucrats would like to do that. We are the guardians of The public liberty basically, And can you imagine what would happen if we just stood down? The committee stood down unless the agency's do whatever they want no revenue. We don't want you to do that. Because the rule making process the way we are protected from bureaucratic overreach. Is you and that particular committee That is one of the most important committees because it rains in the Wisconsin version of the Deep state and so to say that, Okay, well, if you're the University of Wisconsin because Tommy Thompson said, so because he's running the university Wisconsin system now We're not going to fight back on behalf of parents, students or anybody else who has to has to have access to those university Wisconsin system facilities. That's ridiculous. It's your job. To do this. And so if the UW is defying the Legislature, given that you are us go get them. Make them make them comply. Yes, And here's the contrast and I will. I should add that the whether it's a Republican or Democrat. The committee has acted in both ways was when Walker was governor. We did blocker rule on him to it. It's about the rule lot. Whether you're Republican or Democrat does not matter. It's about the rule of law. And so here we sit with if we back up to 2020 When Palm and Tony they were shutting down the economy, they were limiting restrictions telling churches even what What they had to do. But if you want to go to the bathroom or that's indoors, you gotta put slapped that mass back on. It's just crazy. What's going on in 90%? Why continue with the masking all of that, Because you have reached herd immunity. That is crazy that these are the kind of some of the professors the kind of nuts we have teaching students today. "Technically three Death taxes and Dan O Donnell taking off on his birthday, which is today. I'm Dave Michaels in for Dan. Yes, It's not just his birthday today, but a milestone birthday for Dan. Not to begin of turn when I say d. O d is turning 40 years old today. He's been very upfront and honest about this for weeks now on air. So basically, Dan is channeling his inner 24 year old woman and taking the day off. In fairness, he'll be back tomorrow. No, they get out of plane and they're going to Austin or Nashville. Or maybe even both to celebrate. Their weekend. Roughly that would be going to Chicago for a couple of days for for many in their mid 20, so no, Dan is not doing that.
