Despite repeated assertions from Mayor Muriel Bowser, her attorneys and some DC council members that Falcicchio's conduct was fireable but not criminal, both the FBI and Justice Department are reportedly involved. A man remains in critical condition tonight after being shot by DC police in Northwest earlier today. It was around 10 this morning when police say they first got a potential domestic violence call involving a man with a gun inside an apartment building on Georgia Avenue near Geranium Street. But DC police say officers couldn't get into the building or find a suspect, but then they were called to back the area 30 minutes later following a report of gunshots. Acting DC Police Chief Paula Smith. While officers were responding, they were flagged by an individual that gave a description of the person who fired shots. Officers located an individual matching the description and began giving verbal commands in English and Spanish. The suspect produced a firearm and then fired shots. An MPD officer engaged the suspect discharging their firearm and striking the individual. Smith says a gun was recovered at the scene. No one else was hurt. We were unable to obtain entry into the apartment and we were unsuccessful in determining as to call what that was about. We received a second call of a man who fired a weapon. And that second call came in around 1030 and police say officers responded to the same location and they found a man fitting the description of the person who was reported firing shots. Now according to police the man pulled out a gun and started shooting when officers tried speaking to him. That's when one DC police officer shot the man. So the number one thing is if you're getting the claim through an email address that you can not verify, most police departments have tools to look up your Google address or something like that, which is a whole privacy discussion. We can have, but ultimately your Google like a Gmail account is tied to a database and they can get a sense of who you are. Often for swatting, they use anonymous services like proton mate. So if this happens, that's pretty much a giveaway, isn't it? Yeah. Right. You should be very suspicious about that. And I would say if you're a major target out there, like I was unsurprised, I got swatted. Yeah, I had reached out to the police chief in town and had talked to them about some of the threats I had ahead of time, which I don't know if it made a difference but certainly more on your behalf. Just be proactive in police departments. They really need training about frankly being more skeptical in these situations. We don't exist in humans and we are just seeing this expendable within society from the standpoint from police officers sometimes and i think this broader narrative that what sort of relationships should exist between the police and the community and doesn't have to be antagonistic or when we see examples of gilani we see examples of dave robinson. "Some of the software is in in. How can be used I think that there are definitely concerns. About how data will be shared in between law enforcement agencies. So the service. If it's if the city doesn't purchasing the software it will be primarily used by the eno pd however you will be available to any law enforcement agency in the parish y that gives pause some advocates that there are certain surveillance provisions that certain surveillance restrictions that recent past that apply to the pd. But don't necessarily apply to other police departments in the city so think about university police departments or the levee district police department or the housing authority of new orleans. Has its own police department. So suddenly these very powerful analytic tools and in all of this data will now be available to all these smaller police departments that aren't necessarily under a federal consent decree in have all those activities watched or have these regulations asked by the city council. So the way that that data is utilized by some of these other secondary police departments i think is some concern and this is something we just recently saw right michael. In another example the nfl pd had been in the city of been saying for years that they don't use facial recognition software and what that turned out to mean was that they didn't use their own facial recognition. Software didn't have their own they were asking federal and state partners to perform facial recognition or them so any any situation where there is you know there were. There is an interdepartmental sharing of data. These other departments could be performing the sort of intelligence and analysis on on this data n. These records that the nfl would be unable to because of city regulations or the federal consent decree or other things. I think that's a lot of the privacy concern. I think another. I think another privacy concern and michael. Maybe you can talk about this. A little bit is just the city's past experience with this sort of a data analysis. Software like we had for example with cowan. Tear a few years back under the under the landrieu administration. Yeah tell anyone who doesn't know the penalty history. Here here's c. Funded tech company that produces alive law enforcement software in for a while. The city was using a form of you know some. There's some argument whether it's the technically predictive policing but but it was an analytic tool that looks through data city data to try and figure out who was like most likely to be involved in future gun crime and that kind of went fairly unnoticed. I mean there's also argument about whether you know the city was intentionally keeping it a secret or whether people just didn't notice it was happening. But i think from a privacy advocates perspective. It was something that was kept from the public that we didn't know you was going on. And i want to kind of draw a line to a broader surveillance concern that that connects pounder with what we're looking at now. And that's the data that the police and the city have always collected for decades. And it's something that you know. We as side have agreed that will hand over to the city in the police so that our government can function in a certain way however using that data and compiling that data and using that data to to try and make conclusions about people if it was difficult to try and get all that together because these debt databases were so massive and it would have just taken a lot of man hours to go through all of those pieces of paper but now it's changing because you have software like pounds here like this powerful software. We're adding now that can make use of this data in ways that we've never been able to before so data collection that the government has always participated and has never necessarily pose a surveillance Concern in the past are now being used in new ways in utilized by berry very powerful ayla dick artificial intelligence back software you to make new conclusions and so we're that goes from here. I think that there's absolutely no concern among the advocates. That so i would add that that a lot of the concern comes from what is unknown and this and part of the reason that a lot of this is unknown. We didn't even know about any of this until they were already to make this purchase with this particular contractor and part of the reason that it's known as was the case with talent here is that it didn't go through the normal sort of procurement. Annals that happened with talent here because pailin tier. If i remember correctly was a service that was provided for and it didn't go through the normal procurement channels in this case because otc d the orleans parish. Communication district is making the purchase essentially on the city's behalf which is another issue with this particular purchase. This is kind of a strange way that the to do this but like we talked about. This software is primarily for the nlp now without getting into kind of all the details of state and local law. I'll say that if the nfl pd had purchased this directly if the city of the pd had gone out and tried to buy this software they would have been required to go through a competitive selection process. Right go through that process where you post. We're looking for services. Send us proposals or whatever it might be. However the the software is being procured by a semi independent state created agency called the parish communication district so orleans parish communications district our opec de runs. The city's nine one one and three one one systems and it's it's a state created agency so it's not beholden to that two city law that would have required nypd to go through that competitive selection process so opec has been able to go through this whole process. You know behind the scenes did they did do actual search but it was informal. It wasn't public on and you know how they made. This determination ultimately is not known to us so d- plans to purchase this and pay the upfront initial two point. Two million dollars installation cost after that the five hundred thousand dollar annual maintenance charge will be paid for by the pd so the big question now is how the city and the pd are going to enter a maintenance contract with this company without going through a competitive selection process. We were able to get answers to that. But we talk to one Political science professor at dillard university who said that he didn't see a way that the city could get around a competitive selection process for the maintenance contract. Now that would open up a really weird scenario where we installed this new system. The city goes through competitive selection process in in somehow picks a different contractor. So it's going to be very strange. The city tries to enter this contract How they're gonna do that so Obviously will keep our eye on. I have a theory as to how that's gonna happen. This is sorta get around the law yet again which is rather than entering into purchasing contract. The city would be likely to enter into a cooperative. Endeavor agreement with otc d.
