"Those who missed our chat on my newsmax show recently in the last time you were on the show, just give us a little crazy little summary of why you went to war with the local authorities in Pennsylvania and who ended up winning eventually. Yeah, right. Well, the local school board in Pennsylvania a bunch of 9 left wing radical liberals were silencing people at public comments, three citizens before me got silenced. That's why I showed up in Malibu. They weren't allowed to speak. Exactly. They showed up a public comment to criticize the critical race theory program and they were basically told to shut up, sit down and be quiet. And it was all on videotape. So I found out about it. And I'm like, right, well, you're going to get a piece of my mind. And they tried to shut me up as you saw. And so the four of us sued them in federal court for First Amendment violations. And we won an injunctive order against the district saying you're not allowed to enforce this piece of garbage unconstitutional speech policy. And then they ended up selling the case for $300,000. Paid to the lawyers, of course, because the lawyers make the money. And for my trouble as a plaintiff, I got the grand total of $17 91 cents. Now you tell me Sebastian, 1791. Does that ring a bell to you? I love it. I just want to know, how did you engineer that your reward was $70 and 91 cents? Well, here's the thing. When you file a First Amendment lawsuit, you can only get what's called nominal damages because it's not like you're claiming you broke your back or anything like that. And so you have to put a figure in for the court and I said, well, I will update it. It means something. I want the year the Bill of Rights as enacted. I want those suds to send a British citizen a check for 1791 and don't mess with it, but a citizen's First Amendment rights again or I'll get 1791 from you.

Trump lawyer in court after being forced before grand jury
"A lawyer for Donald Trump at no comment after leaving a Washington D.C. federal court, where he was ordered to appear before a grand jury investigating the handling of classified documents. Attorney Evan corcoran's appearance stems from an order from a federal judge who ruled in favor of a Justice Department request that corcoran answer questions before the grand jury. In a previous appearance he had invoked attorney client privilege to decline answering certain questions. But prosecutors can get around that. If they can show the client is using the lawyer in furtherance of a crime. Corcoran had drafted a letter last June, asserting that a diligent search for classified documents had been done and said all records had been provided. Well, there's got to be analysis look as a former federal public defender who challenged the DoJ out DoJ on so many cases in federal court about what we call Brady violations, violations by the DoJ prosecutors for failing to intentionally disclose exculpatory evidence and evidence of impeachment. So it's called Brady and giglio. Let's put the legal parlance aside. What due process the constitution the Supreme Court demand prosecutors in the DoJ must turn over all evidence that even might be evidence of innocence and evidence of impeachment. And they won the day. Look at what's happening right over at Stanford University. We talked about this a few days ago. Where a federal court judge was heckled and shouted down what he called for help the administrator came, the dean of the diversity equity and inclusion division showed up and began lecturing the judge. After the university apologized, the students rose up and now they're protesting the dean of the law school. And here's what needs to happen there. Every single student protesting, they're all law students. So these are individuals who have graduate degrees already. They've already got their bachelors. They're getting their law degree. Every single one of them should be expelled from Stanford law school, because we don't need ilk like that in our courtrooms.

"A victory for the Justice Department and connection with the FBI seizure of documents to Donald Trump's Florida home, Mar-a-Lago. Federal appeals court this week halting an independent review of those documents by a so called special master. In the end he removes a hurdle, the Justice Department said had delayed its criminal investigation into the former president's possession of top secret government information. This morning Perry Stein, who covers the Justice Department for The Washington Post joins the conversation. So essentially the panel said that they agreed with the Justice Department arguments that a special master and that's this third party arbiter that was initially appointed to sift through all the seeds, documents from Mar-a-Lago to determine if any should be shielded. So if criminal investigations should be barred from looking at them in their investigation because Trump had certain privileges over them. So essentially the appeals court ruled in the Justice Department's favor and said, this special master, this third party arbiter should never have been appointed. Was there a scolding if you will of the Trump aligned judge in this case who put the special master into this whole deal? I mean, look, it was very clear that they felt she was wrong, that they felt that this was a bad decision on her part. I mean, they did not get personal in this, but yes, it was very clear that they felt that there was no legal basis that the arguments that Trump presented did not match up did not align with the legal precedent and what the law. These judges said they were very nervous about what it would mean to create this precedent in which anyone who is lawfully searched by the federal government can request a special master to intervene in this to foreign indictment served. But yes, you brought up that the judge that appointed the special master in Florida that was the lower court judge. That was a Trump appointee, but also three of the appeals court judges

"It might. It depends on what the sanctions mean. And again, I think we just lack enough information from treasury to know whether this is the type of action that will infringe on the right of free speech and the right to free expression. Code is speech. There's no question about that. And that's been well established for a number of decades in case law from U.S. federal courts. The thing is just because code is speech doesn't mean that it can't be regulated or is always immune from any type of sanction in every circumstance. Specifically, although code itself can be expressive. And so the engineers who are writing this code are expressing themselves when they write the code. They're sending a message they're conveying information. They're providing their viewpoint to the public. That is First Amendment protected activity. However, when someone uses code to achieve some type of activity or conduct, if you use code to send a payment or to trade an asset or something of that nature, then courts might say your use of the code is functional, not expressive. In other words, your engaged in conduct, not in speech. And in that case, your use of the code, even though it itself is speech, your use of the code may not be protected by the First Amendment. And I think there's an open question here as to whether the sanctions on tornado cache are restricting speech or if they're only restricting conduct. If the sanctions mean that you are not allowed to publish the code that comprises the tornado cache more contracts, I would say absolutely that is a violation of the First Amendment. I think if the sanction is only to say, you are not allowed to interact with a tornado cache pool, which is comprised largely of North Korean assets, I think the argument is at least harder to make under the First Amendment. But there are other constitutional rights that might come into play them, right? There's the Fourth Amendment right to privacy. There's the Fifth Amendment right to due process. So just because free speech may not be infringed in that instance, doesn't mean that there isn't

"Now you mentioned that the U.S. and the UK central banks, what about the European Central Bank, which seems to be having a harder time than most. It appears to be more cautious than most other banks. It is far more cautious than other central banks. This goes to, in a way, what I did in a previous life as well because in a way the situation hasn't changed and that's part of the problem. The European Central Bank and many people living in Europe will understand this has really been dealing with crisis after crisis after crisis after crisis. Since really the financial crisis of 2007 2008, if you will, we had that, then we had the European debt crisis of 2011. We then had obviously the pandemic before that you also had the refugee crisis. Now you have war in Ukraine. And so part of the challenge for the European Central Bank as a result of that compared to others is that they have kept interest rates extremely low record lows for ten to 15 years. One economist that I spoke to ahead of this pointed out that the decision makers currently on the Central Bank, the board, the governing council. None of them have been in power at a point where interest rates were ever raised in Europe because the last time that interest rates were raised was in 2011, so they don't even know what it's like to raise interest rates because they have been crisis fighting this whole time and therefore have wanted to keep people spending money forcing people if you will to spend money instead of saving and they've had no chance to exit from that. And so that is now the key question there is therefore a caution but also a fear have they missed the boat. They don't really have the options in many other central banks have to kind of play around depending on what happens in the next few months the next year. The U.S. can sort of look at prices and it can look at its economy and it can say, well, prices are rising, we need to raise interest rates or look now the economy is doing badly as a result. So let's lower interest rates again. The European Central Bank doesn't have any of that wiggle room. And so what you saw yesterday on Thursday at the meeting was a very vague statement from Christine Lagarde, the president of the European Central Bank. She just said that interest rates would be raised at some point in future. But she could not really give anything more than that. Currently, the Central Bank is actually buying assets as well, the kind of even keep interest rates lower than almost negative essentially a negative territory in Europe at the moment. They have to end that first and they said they would end that in the third quarter and then she just gave this comment that sometimes after they end asset purchases interest rates could rise. She said sometime after can be anywhere between a week to several months. This is very vague language for a central banker to offer, but it just shows how much of a challenge there is right now. Absolutely. How is it being handled by inflation where Germany? Inflationary Germany is among the most concerned this was something when I lived there that was always one of the biggest issues Germany has a history of inflation. It remembers the Weimar Republic Weimar Republic back in the 20s. It remembers what hyperinflation looks like and it's something that's very much kept alive if you will in the German psyche, even though it is so many decades after that now. And as a result of that, Germany more than other countries has a tradition of worrying about inflation, if you will worrying about the impact of inflation. So they are leading, if you will, a group within the Central Bank within the European Central Bank, known as hawks. There's always this fight between hawks and doves as it's known in Central Bank terminology, saying we need to do something about this and getting concerned saying the European Central Bank has lost control a former Central European Central Bank recently gave an interview where he said that the European Central Bank is living in a fake reality that they're not responding to the rise in prices. So the Germans among the others are among other northern nations, particularly are the most worried about this and are just trying to pressure the European Central Bank to act faster. variant have been detected in New York City and one was found on Long Island One of the people had traveled to South Africa recently but was vaccinated and had mild symptoms Officials were working to find out more information about the other cases They add that it's likely the new variant is already circulating in the state but that's not cause for alarm Scientists are racing to determine whether the new variant is more transmissible whether it causes more severe illness and whether existing treatments and vaccinations will help combat it The MTA is about to be flooded with money from the new federal infrastructure law but a new report from the state controller's office says the agency typically has a hard time getting money for projects out the door doubling NYC Stephen Nelson reports When it comes to how it'll spend the infusion of federal money the MTA talks of big projects like phase two of the second avenue subway but the new report says it still hasn't completed many previous projects already underway For example in 2013 the MTA said it needed $8 billion for signal upgrades but it spent less than a $1 billion and only the 7 and L lines have fully electronic signals The agency's also only completed half of the more than $7 billion worth of repairs from hurricane sandy The MTA says many of the projects are still under construction and that its construction department was recently reorganized to be more efficient The federal government has granted their last permits needed to pave the way for the gateway tunnel project to break ground and Jay advance media reporter Larry Higgs says now the federal government New York and New Jersey still need to find the funding for the project and the more time goes by the more expensive it gets This is now a $12.3 billion project The gateway development corporation has said that the costs are increasing roughly a $1 million a day due to inflation The gateway project will create two new train tunnels connecting New Jersey to midtown Manhattan under the Hudson River as well as repair the existing century old.
