Shelby county sheriff Floyd Weiner says they each violated multiple policies by failing to keep their body cameras activated after they went to the location where Tyree Nichols had been beaten by 5 Memphis police officers. Police video and other documents show Nichols had fled a traffic stop, but was caught near his home by the officers. They punched Nichols kicked him and hit him with a baton. Nichols died three days later. Banner says the sheriff's office does not believe the deputies will face criminal charges. I'm Mike Hempen. Kentucky's highest court has allowed a near total abortion ban to remain in effect. Correspondent Norman hall reports. The Kentucky Supreme Court has refused to halt the state ban that has largely been in place since roe versus wade was overturned. The court was weighing challenges to the band and a separate one that outlaws abortion after the 6th week of pregnancy. Abortion rights groups responded to the court's ruling by saying the fight over the issue is far from over the court itself made that clear. It ordered a lower court to consider constitutional issues and the court's deputy chief wrote that Thursday's ruling doesn't settle the issue or bar future litigation. The justices ruled on narrow legal issues that left unanswered the larger constitutional questions about whether access to abortion should be legal in the bluegrass state. The brutal police beating of Tyree Nichols has resulted in the firings of several law enforcement officers and federal charges filed, including second degree murder against the police seen on that body cam video, kicking and punching Tyree nickels in Memphis. It's rare, however, for charges to be handed down so quickly in many of these cases, but why is that? And why do these things just keep happening? UCLA law professor Joanna Schwartz has researched the subject of police misconduct and is out with a new book that will be published next week. It's called shielded how police became untouchable when we talk to her about it this week. So let's talk a little bit about your book, shielded how the police became untouchable. It's out on February 14th, and it looks into the breakdown in accountability for police misconduct cases. We have had so many of these instances, Tyree Nichols and Memphis, just the latest one. What happened there was you saw the officers lose their jobs immediately. And they were slapped with charges within a week after this video surfaced. The race of the officers has also been called into account as a possibility of that happening. This is the blueprint. Going forward. For any time, any officers, whether they be black or white, will be hella accountable when it's white officers. We think it's also important to the community that there are swift action. And that we move swiftly to justice. Is race something that plays into what we're seeing in these cases? Obviously, it is, but in this case, how things were different. I think that race is intrinsically tied to policing and police misconduct. Police forces in the south were an outgrowth of slave patrols. So policing as an institution that is from the ground up based in race and racism is impossible to ignore all of the research and studies that have looked at the racial effects of policing have found that it's not really the race of the officer, but it's the race of the victim that really matters. Black people and indigenous people, Latino people are more often stopped, searched, arrested, assaulted, and killed as compared to white people. The fact that the officers are black and were quickly charged, may have some relation one to the other. There has been research indicating that officers of color are quicker to be disciplined or charged. I also think, though, that the quickness of the response to Tyree Nichols murder is a product of a lot of organizing in Memphis around

CBS senior investigative correspondent Catherine herridge explains how these controversial task forces have become part of big city policing. The Memphis police department scorpion unit was intended to be an elite specialized unit in response to the city's high violent crime and homicide rate. But the 5 Memphis police officers charged in Tyree Nichols death were new to the force. And a former Memphis police officer tells CBS News, the scorpion unit training consisted of just three days of PowerPoint presentations. One day of suspect apprehension training, and one day at the firing range, the department did not immediately respond to CBS News questions. These units require significant supervision, something that was apparently missing in the scorpion unit. Former NYPD commissioner Bill Bratton says there appear to be many missteps. You want more seasoned offices, three, four, 5, 6 years on the job, so you can look at the track record. And you want to select them carefully. While there's no official data on the number of anti crime units nationwide, similar issues have played police departments in other major cities. Also to ratchet up attention to this issue, he invited the parents of Tyree Nichols to come here to Washington for next week's State of the Union address by the president, and we understand that they have accepted. So this issue is going to be highlighted in the days and week to come at the very least. Niche, there was a strong push a few years ago for police reform after the death of George Floyd. Where does all of that stand now and can there be a fresh look at it? Right, there was a lot of talk as you'll recall a couple of years ago and it involved New Jersey democratic senator Cory Booker and South Carolina Republican senator Tim Scott. They worked long and hard on trying to come to an agreement on the legislation, which is actually named after George Floyd. It would ban choke holds so called no knock warrants and step up federal tracking statistics designed to provide more oversight of law enforcement. But Republicans sought more narrow legislation and they've had concerns about lifting qualified immunity protection for police officers and departments still Booker and Scott have vowed to keep on trying this weekend. Senator Durbin is urging the Senate talks to resume, but there's still a lot of hurdles to overcome on this issue. Well, of course, Republicans now control the house, the head of the house judiciary committee, Jim Jordan, appears to be skeptical about police reform legislation. What's he saying? Right. The Ohio Republican is wary of passing federal legislation on an issue that he and many other GOP lawmakers say should be one for state and local governments. Why don't know that there's any law that can stop that evil that we saw that is just difficult to watch. That was Jordan speaking on NBC's meet the press. Now Democrats did pass the George Floyd legislation when they controlled the House, but while President Biden has also said he supports it, it just seems hard to see that the legislation is going to get through the house any time soon unless a lot of changes occur under Republican control. An extremist who killed 8 people in a bike path in New York City back in 2017 has been convicted of federal charges and could now face the death penalty. Prosecutors say he was inspired by ISIS. Police officers hit the stand in Alex Murdoch's murder trial today in South Carolina. The former attorneys accused of killing his wife and 22 year old son. CBS's Nikki Batista is outside the courthouse in Walter burrough. Alex was pretty quick to give an alibi. He said, you know, a couple of minutes after the first responder arrived, I was visiting in my sick mother. I came back, they weren't answering their phones. I came down here. I found them dead. I wanted to get a shotgun. I came back. And he did have a shotgun on him when they arrived. That is not the murder weapon. And then lastly, the prosecution repeatedly asked the sergeant.
