Long Haul Trucking Means Better Prices For Consumers, But Drivers Suffer Low Wages

"The stuff that you buy in stores, close food electronics almost all of it got there on a truck long haul trucking is getting cheaper and that's good for consumers. It means stuff is cheaper, but it's not so good for truck drivers because this is happening at their expense. Here's Keith Romer from planet money. In two thousand, seventeen Kimberly Sikorski decided she was going to become a trucker she called Prime Inc. no relation to Amazon prime because they offered free training prime seemed eager to have her literally I think I called on Thursday night and they were ready to buy me a greyhound ticket for Sunday to start on Monday Sikorsky took classes and drove with a trainer for three months. But before she could go out on her own, she had a choice to make your given the option to either be accompanied driver or a lease operator option one she's a regular old. Employees. Paid based on how many miles she drives option to. She gets to be her own boss. She'd have to lease a truck through prime but then after expenses she would share of whatever her loads brought in in the form of a weekly check from prime. They say if you're not stupid and you're not lazy then you make a lot more money being released operator and you're Kinda dumb if you pass that up. So Secorski chose option to she picked out her truck finance through prime a brand new blue freightliner that she named Sapphire. Then she hit the road. But when she started receiving her weekly checks, something didn't seem right a lot of times when I'm expecting to see a check for a couple of thousand dollars, I'm getting a bill for like two hundred dollars or five hundred dollars or fifteen hundred dollars a bill before Secorski got her cut prime deducted truck payment's insurance equipment cost and primes percentage as a broker also for an independent contractor it sure felt like she worked for prime. So they say that you're not their employees but you're. Completely bound to them. You're not allowed to take loads from anyone else. You're not allowed to ask for different loads than what they're giving you. Secorski works seventy hour weeks for six months at the end of it. She had earned just nine thousand dollars. It got to the point where I would be sitting in my truck crying because I'd be afraid to buy a hotdog when it gets to the point of your electricity being shut off and your grocery bill not being able to be paid. There has to be something better finally she quit. Steve Sally a sociologist at the University of Pennsylvania specializes in the industry. He says that four higher long haul trucking has become a commodity and customers only really care about price. The way that the market has been constructed requires that you compete on the cost of labor getting Sikorsky to lease a truck from prime and then work as an independent contractor. That's a standard part of the business model for a lot of trucking companies. Now, like having a, you know a truck for free an paying the driver less than you would have to pay an employee. Some of those drivers though have started to push back in recent years there's been a wave of class actions lawsuits against some of the. Biggest long-haul companies in July Kimberly Sikorsky's old company prime settled a lawsuit in which it was accused of Miss classifying its employees and violating minimum wage laws. Prime did not admit wrongdoing as part of its settlement and they declined to be interviewed for this story. But in an emailed statement, a lawyer for prime wrote quote, we have thousands of highly successful independent contractors and company drivers who thrive within our business model. The class action that was settled is completely unrelated to Miss Sikorsky's allegations. The litigation was seemingly endless and was best resolved as part of that settlement forty thousand former drivers for prime are eligible for a share of twenty, eight, million dollars, which means it's like seven hundred dollars a person. She has never heard of Wigs and looks over all this stuff and she just knows something here isn't right today the untold story of our high ranking. That's not what he does know. Jeff David starts to do something really interesting. Rather than billing sponsors answers that he gets to by signing edge in the arena through the traditional Sacramento Kings accounting he has them pay Sacramento sports partners. Which looks like if you're getting an invoice at this company that is just bought this linage? It seems perfectly appropriate. Seems like exactly the kind of entity you would pay if you're writing a check to the Sacramento Kings. UNBEKNOWNST to the company it's actually an entity owned by Jeff David that sounds like some subsidiary of the Sacramento Kings. How many retirement he did about three deals totaling a little around thirty thousand dollars to what happens next so it really starts ramping up? Two Thousand Fifteen. Two Thousand Sixteen in the Kings were moving from they're really old arena to this brand new sparkling downtown jewel box. He is the point person for the naming rights both for the Rena and the practice facility in the kings identify really David identifies to sponsors that are relatively local. One is golden one which is a credit union in California and the others. Kaiser Permanente healthcare provider Divider well-known in California kice negotiates a really good deal for both sides. I mean it's it's going to be one hundred ten million dollars over twenty years with golden old in one. They're going to have their name in lights. This is the biggest deal of Jeff. David's career and Kaiser Permanente is going to pay twenty eight million dollars over ten years to have their name on the practice facility ability. Everyone is thrilled is bosses are happy. The sponsors couldn't be happier especially golden one. Is this little credit union. They're gonNA have their name on an NBA arena. It's all really great. And then he gets creative. Has That for whatever reason David decides that he wants them for himself at a certain point. During that negotiation nation there was conversations golden one in the kings that look. If you guys ever need more cash up front were credit union. We can help. We can't keep cash on hand so whether it's finishing the arena or whatever we could possibly service Jeff David file that away and then in two thousand sixteen. After the deals completed he comes to golden one and says hey remember of those conversations. What if we did that would if you sent nine million dollars our way in an exchange will knock off some money off the later payments down in the deal? The old past two thousand twenty six down the road. Golden One couldn't be happier to help. They're thrilled with the partnership. And they wire nine million dollars to Sacramento remigio sports and then he does it again with another deal. Jeff David does something very similar with Kaiser Permanente the training facility naming sponsored Kaiser Permanente ten years twenty eight million dollars. It's now a lot of these deals. That teams do with these kinds of sponsors. They have what's called an escalator was just a fancy. See Way of saying that there's an inflationary adjustment each annual payment so jeff. David goes to Kaiser Permanent Day and says hey rather than put escalators for each of the payments. Why don't you just give us four point four million dollars up front and we'll go without escalators? Kaiser says absolutely that's absolutely fine. They send four point. Arbitrator issues stunning 'Bones' decision, calls Fox "reprehensible"

"I'm Kim masters, and this is the Hollywood breakdown joining me Matt Bellamy of the Hollywood reporter, and Matt we've talked to the past about this giant merger of Disney the Quiring FOX or most of FOX that is about to close simultaneously too. Big lawsuits are going on that one involving profits from the series bones, which ran from two thousand five to two thousand seventeen on the FOX network, and the other has to do with poaching people in whether their contracts are enforceable. But the bones thing is really explosive. This was an arbitrator's decision. And the decision was that FOX executives. Lied cheated and committed fraud at the expense of the show's stars and executive producer. And this was an award of almost two hundred million dollars, which is the second largest in television industry history. This is a staggering ruling, and this is coming from someone I used to practice law, and I practiced law in this very area hand. Alling prophets cases. And I have never seen language from a judge or arbitrator that approaches what this arbitrator said the top executives at FOX did they basically perjured themselves, according to this arbitrator, and we're talking about Peter rice Dana Walden. Gary Numan, the top leaders at FOX two of whom rice and Walden are going over to Disney in this transaction, and essentially they said that they lied to the creators of bones told them that they were getting fair market value when they licensed the show to various distributors in the FOX family. So the the FOX network and Hulu which is thirty percent owned by FOX and lied said that they were not getting said that they were getting the fair market value. And they weren't in one case which was particularly damning the same person at FOX signed the license agreement for both the studio and Hulu. Yes. Time being on. Size of a deal. That's not the definition of self dealing. I don't know. What is well. Bob Eiger, the head of Disney promptly said we have great confidence in Peter rice and Dana Walden, which is good thing because they put them in very high level jobs. Of course, they'll continue to fight this out. They say they did nothing wrong. But FOX has been down this road before with other shows X-Files Stephen Bochco, the late Stephen Bochco on a huge decision settlement from them. We had him on the show at one and the business talking about this before obviously before he died, and so this is the kind of thing that really could change the way, particularly Hulu this idea that they didn't go to Hulu with an arm's length thing and say how much is our show worth. But just kind of wink, wink, and made a deal that benefited FOX as opposed to the people who were the actors in creators, the show that is a big deal for Hulu because if who then people start looking at the other deals that Hulu made and who is being asked to pay up, basically. I don't know. What happens right? And if I'm a creator or an agent for a creator, I'm going to say, hey, wait, a second. Where's my Hulu money? And that's a big problem. And the interesting thing is FOX is going to appeal and one hundred twenty eight million dollars of this one hundred seventy eight million dollar judgment is punitive damages that the arbitrator applied because of what he said was fraud. So they're going to try to overturn the punitive stuff, but they're not even appealing the fifty million dollars that they say that the bones creators are owed. Yeah. Which a sense of signal and that is a big punitive damage award. Then shows that the arbitrator was thoroughly and his language if they're early disgusted. Thank you. Matt. Thank you.
