But what tish James did by being first one out there, she now has all of the documents, all of the proof she has forwarded the case to the southern district of New York for tax evasion, as well as to the IRS. So I do believe indictments will be coming. I believe that they will come before the end of the year. What bothers me again is this whole slow walk by our Justice Department. Oh, we can't do it now. Did you get to depose him personally? No, we didn't. We explored the possibility of doing so and the thought that we had in that matter was that we already had so much good material that we didn't really feel like it was worth it to engage in the food fight that it would have taken to get him to testify. As you saw with Tisch James, it took them 6, 7, 8 months of fighting to actually get the trumps to get deposed to testify. And I think that we thought that it wasn't really we already had enough of a case that had been really make sense to bring him in. I wanted to depose them. I really, really wanted to, but we already had him on a number of key things. He had been deposed, also this was key. He had been deposed in the kind of sibling case to ours that was and that became part of the settlement as well, was the private civil class action. Against Trump university, that was brought out in the federal district court in San Diego. And they had already managed to depose Trump and they got some really good testimony out of him. We felt like we weren't really going to get anything really could have gotten more material out of him, but it was like, we're good. We went way longer than we were good. We went way long. "What brought you to write the book and what are you trying to communicate in? Well, you're on judiciary, ranking members. So you know all about how we weaponize the bottles of the bureaucracy. And that hit me between the eyes in the 115th. I started thinking about this. And then just the craziness that was happening with the Trump, starting with the inauguration, and you were talking about people protesting. I had protesters on my front lawn. You and I were being demagogue over the American healthcare act, which was a good piece of legislation. And I thought, this is getting out of control. And I'm afraid that if you let the left right history, you're never going to learn from. And that's what was happening already with CNN going after every Republican and it was getting out of hand. But I think the epiphany for me was, you know, if you're not on the intelligence committee, you don't get to see the Intel until they say, okay, members can come over and view this. And it was when we did that and trudged over to the capitol visitor center and looked at this stuff and all I remember Doug is sitting there going, is this all there is. Is this? And we were consumed for two years. It was thwarting our ability to move legislation. The media were Gaga over this line. Just absolute line. Trump is going to be indicted tomorrow. He's a Russian asset. Now there was a Trump Tower meeting. All of which proved to be a lie. And I thought, okay, I'm going to start taking a journal. And so I started writing a journal. And what happened was that started to continue through three campaign cycles, 16, 18, and 20. Well, then 20 came around, I'm the Senate nominee, and we are locked down except for a rioters in Minneapolis. The third precinct was broke was burnt to the ground, talking about destroying government property, right? And it was so orwellian, I continued with these journals, and so now, in 2021, at this all these journals and you know what it's like to write a book, you got to put it in readable fashion. So I found a cabin in the Minnesota northwoods and for a year and a half, I just hunkered down and wrote basically a history of how we got to the point where we'd weaponize the government on behalf of one party.

"You have money that you do not have. Does not amount to the art of the deal. It's the art of the steal. And there can not be different rules for different people in this country or in this state. And former presidents are no different. New York attorney general letitia James sued former president Donald Trump and his company for fraud. Alleging they patted his net worth by billions of dollars by lying about the value of his prized real estate assets from golf courses and hotels to his homes at Trump Tower and Mar-a-Lago. Joining me is former federal prosecutor Robert mintz a partner mccarter in English. This is a 222 page complaint. You could say it's almost three years in the making, listing 200 plus times Trump allegedly lied about valuations of his assets over ten years. Tell us about the cause of action. This is a sweeping and detailed complaint not unexpected, by the way, something that everybody thought was going to come eventually out of the New York attorney general's office, but the details and the number of interviews and the number of documents that were reviewed in putting this complaint together is something that's certainly gets your attention. The leg is a widespread effort to manipulate property valuations by former president Trump and three of his children and the Trump organization and some of the Trump executives and is asking for $250 million in penalties and an end to their operations in the state of New York. It specifically accuses former president Trump, his son Donald Trump Jr., his daughter, Ivanka Trump, his other son, Eric Trump, another Trump company executive of engaging in a years long scheme to enrich themselves by inflating the values of a wide variety of properties both within the United States and internationally. And just explain how inflating the values help Trump. Sure. Well, this probe was launched back in 2019 and it came as a result of testimony that Michael Cohen, who was former president Trump's lawyer previously, he testified before Congress and said that the Trump organization had regularly engaged in a pattern of fraudulent financial statements. And by that he meant that the Trump organization would inflate the valuation of assets in certain circumstances, for example, when seeking loans and for insurance coverage purposes, but at the same time deflate the value of those very same assets in order to reduce their tax liability. During the press conference, the AG gave some examples, for example, the Trump triplex apartment in Trump Tower. He represented that it was more than 30,000 ft². In reality, it was less than 11,000 ft², which increased the value by about $200 million. And James said that, you know, this wasn't an honest mistake. It was deliberate fraud because he knew about the layout of the apartment in the building. He personally overseeing the construction. Well, what the attorney general was trying to do here was to get out in front of an argument that these valuations are by definition somewhat subjective. In other words, in order to try to put a valuation on commercial property in Manhattan, for example, there is somewhat of a subjective element to coming up with a number of what that property is worth based upon other commercial properties. So what the AG here was attempting to do was to give examples that did not involve any of that subjectivity. So as an example, the complaint alleges that the triplex apartment at Trump Tower was 30,000 ft² in certain documents and then was listed as only 11,000 ft² in others. That is something that is clearly not subjective, but is simply an objective fact. It's either 30,000 or 11,000 ft². Other examples that were specifically included in the complaint include adding more floors and square footage to buildings and actually exist claiming more residential lots than we're actually zoned for on certain golf courses and listing values beyond what the appraisers had valued those properties at. Again, all of these are attempts by the attorney general's office to show that these were not mistakes. These were not differences between two asset values in terms of what the subjective valuation of a property is worth. But these were simply facts that were misstated on according to the attorney general's office, were in misstated intentionally by Donald Trump and by others in the Trump organization when they knew in fact that these facts were wrong. She said that many of these alleged evaluations were quote greatly exaggerated, grossly inflated, objectively false. For example, he overestimated the value of Mar-a-Lago by almost ten times. And I think that's what the attorney general's office has to do here because of the subjective nature and valuing these properties. These have to be examples that are so extreme that they can point out that nobody could have really believed that these valuations were true. And so the AG has found certain examples where she believes that these valuations are so exaggerated that it can not be an innocent mistake. The other thing we're seeing throughout this complaint is the attempt by the attorney general's office to show that this is a pattern in practice. In other words, it's not an isolated example. It's not a situation in which the Trump organization can say that they may have made a mistake or they may have relied on evaluation that was improper, but they're showing that this is a pattern in practice. "Here's what I think needs to happen. I think that we need to completely defund and dismantle the FBI. The rot is so deep, the FBI has gone so rogue, it can not be salvaged. Now you think about this for a moment. President Trump was in New York City. He was staying at his apartment in Trump Tower. He was not at home. Had the president Bennett home, there would have been video cameras of the FBI dragging the president out of the home so they could conduct their investigation. And you would have seen the coverage. They would have had CNN there. And it would have been broadcast live on national television, president Trump and his pajamas, standing on the front lawn of bara laco. Now you just think about this. It's not over. There's still coming for this president. And ultimately, they want to drag this man out of his home in handcuffs and shackles and throw him in jail. That's the end goal here.

Well, I mean, so you're running the Department of Justice and the Mueller investigation is already going and you're trying to get it landed. You know, this kind of this original sin is so far away and there's people that know it and nobody is telling you the truth. "This is fresh air, let's get back to my interview with Shane goldmacher, a national political correspondent for The New York Times. So you've been writing about ways that Trump is cashing in on his post presidency. What are some of the ways he's doing that? Oh, I mean, he's just count the ways. It's a long list, no truthfully. I mean, one of the ones that's most interesting to me, and this is not, this is not the big money. The biggest money way is this spac. This effort to create a social media company called truth social that has lured in a $1 billion of outside investments and has the potential to be a huge cash cow for Trump. It also has lots of signs of failure, this app that wants to compete with Twitter launched a month ago and there were weeks of people being on wait list, Trump himself is only sent one quote unquote truth instead of a tweet, they call it truths. There has not been the download charts have been dropping and dropping. There's been a lot of signs of lack of success. But that's the big money. But the little money stuff is the stuff that really fascinates me. He's been doing everything from holding an event last December that looked like a political fundraiser, but in which the money went in part directly to him. He gave a speech, people came. There was a lectern, all that stuff, and instead of paying $10,000 to his political account, it just went to entity that was paying him directly. He's published a coffee table book, a $75 coffee table book, self published through a new company that his son has cofounded with another former aide selling it directly to his supporters and my colleagues have since reported that there was actually a different photo book that had been planned by his White House photographer that he basically ran that book and got his own book out because photographs of The White House are public domain from The White House photographer, they're put on the flicker page and they're public documents. So there's just a number of ways in which he is Tapping almost as direct to consumer base and continuing to bring in money in his post presidency. Trump Tower remodeled the bar in the lobby. I've been down there. It looks very sort of what you would imagine presidential. And they were able to do this as part of a sensitive arrangement by which this private company controlled the servers for The White House. Is this, I mean, this doesn't make the Watergate scandal look like an irrelevance? Well, I would say this, the Russia hoax and its entirety before these revelations was already a hundred times worse than Watergate wasn't even comparable. The only thing that has not happened yet is people haven't paid the price like they should. I mean, so many laws were broke here and the spine started way before. I mean, let's not forget. We had the unmaskings that we uncovered where they were essentially using the intelligence services to target the Trump campaign. We know that they went to the fisa court. They used that to spy on the Trump campaign. And so this went on and on. They had the Steele dossier that the Clinton spotted all of that in its entirety is much bigger than Watergate, you know, whatever imagine to be. But this that came last weekend, not only are they new revelations, but you can imagine where I sit, why didn't I get this information when I had subpoenas to all these agencies? How many times was I guaranteed? Oh, we've given you everything. Well, the fact is they didn't give me everything. So there are people now. Well, you know, Mike, years ago, when I was a young reporter traveling in Eastern Europe, there are trees or decked out with tinsel from top to bottom. I mean, it looks like the front of a Trump Tower or something. You know, it's old glitter and tinsel. And if you look in the bows of those trees, there are little spider ornaments jeweled spiders. And I couldn't figure every house I went to every business. They had this same setup. Well, I guess I didn't pay much attention to it. I thought they were recycling stuff from Halloween or I didn't know what they were doing. Years later, I came across a footnote during research for another book. And it says there is a legend from the second century of Mary Joseph and Jesus running into a cave on their way to Egypt. And they meet a spider who performs a special service for them. Well, it turns out that spider and this story is the origin of tinsel. I always thought tinsel was to replicate bicycles on a tree. No, it is a testament and a homage to this tale of a spider who spun a web perform this amazing service for the holy family. And you know, at the heart of the story, and the reason I think it's resonated with people so deeply in the last year and again this year is because as Mary says of the spider at one point in all of us, all are here for a reason. "And in the eyes of the American people. Well, I mean, there were 35 Republican members of Congress, who voted along with Democrats to create a nonpartisan commission. So I mean, when you think about that, that's remarkable. I don't know what other situation which you've seen 35 Republicans cross the aisle. So there's obviously a desire by some in Washington. Now they suffered repercussions. When that was killed in the Senate, what happened was Nancy Pelosi said, okay, well form a select committee and they appointed 7 Democrats and 5 Republicans and only two Republicans representative Cheney and representative Adam Sierra said they would participate. So we now have the select committee, which, you know, I think, from the start, doesn't have the sort of nonpartisan credibility that non partisan commission would have liked the 9 11 commission. However, that said, it has subpoena power. It's moving aggressively. It's speaking to witnesses. And it's gathering documents. So there is an investigation occurring. And I think that is important to realize in light of the brouhaha around Steve Bannon, is that so far Bannon is the exception. So far, other witnesses are participating. And so far, there does seem to be some promise that the select committee will offer a greater understanding of what happened in the days and weeks leading up to January 6. But will he be able to outmaneuver this investigation as he has many investigations before? I mean, for a dude who's been impeached twice, he sure seems to get away with a lot. Can you wait this out until the midterms or maybe even until he who knows runs again in 2024? Well, you know, in every case that I've ever covered, which is almost all of them involving Donald Trump, the party investigating Donald Trump says it is Donald Trump's strategy to run out the clock. And in some cases, he has succeeded. But not in all of them. It's worth pointing out that after a protracted battle to try to keep his tax returns away from the Manhattan district attorney Trump lost, his company has been charged with fraud, his chief financial officer has been charged with fraud. There is a trial date set for the August or September of 2022 in that case. There are other civil actions. The former president himself had to this week participate in testimony in a civil trial brought by activists protesting outside of Trump Tower who said Trump was responsible when a security guard punched one of them in the head. And that case is going to go to trial. So, while these things have been delayed, he has not in all cases succeeded in derailing justice entirely. And I think in this committee, too, it's not like everybody's saying we're not going to participate. So it does seem like we may get some answers. Will we end up with some questions? The president may succeed in running out the clock so that all of the committees questions are not answered,.

He's this is a guy who pled guilty to a charge that he led a sports gambling ring, which investigators said had ties to Russian American organized crime fighters. You know, I swear to God was so much of Donald Trump you just every rock around him. You pick it up, and there's a Russian hiding under there. It's kind of astonishing. So, yeah, this is I think this is interesting. I don't think anything's gonna come of this. I mean, he has every right to pardon these individuals. There's a there was a bill that was introduced in 2017 by a Democrat, and this is in the House. Um, to force the White House to announce the recipients of presidential pardons because there was concern that Trump would quietly issue pardons to his aides and family members. Um, and it was never voted on it. Never actually made it to a vote. It was reintroduced in 2019. It still did not receive a vote. Um, but it sounds like maybe there can be some things. That can be done surrounding presidential pardons that might cause presidents to at least try not to be blatantly abusive of that power. What do you think? Well, you know the president his advisers, attorneys cannot sell a pardon. You know, we were joking that it was like selling indulgences by Popes in the Middle Ages, right, But you can't do that. You cannot sell it on a quid pro quo. Now you can wink. It's like any bribery. You know, Some bribery schemes are hard to prove by the feds because there's a wink and a nod and people don't put anything in writing or say something on a tape that can be used against them. It's just another case that's hard to prove them. Beyond a reasonable doubt, But it's totally illegal. The person who would pay a bribe or try to pay a bribe to get a pardon is guilty of bribery like if they paid to get any other official favor and the person who gives it the president. That's the issue. Can you give a quid pro quo? You can certainly be impeached and convicted for it. Um, that's been their theory of convictions. So In a part of the problem with reining in the pardon. Power completely is it has been used for good purposes without approach commission. It was fair to you know, dozens of those people who just got especially the computation, so they didn't have such long senses and he looked at President Carter. You know, we had all this division over the Vietnam War and the pardon power was used very well. By Carter to give the pardons two people thousands of people You can't say the exact number thousands was good. And Obama's computations were good because he had all those people who got the mandatory minimum sentences, and now they were serving 10 15 20 years and they just didn't deserve it. They've been rehabilitated and their sentences were too long to begin with. And that Z all good uses of the pardon power so and also take a constitutional amendment and I just don't see it happening We've got you know we're almost out of time. And so I'm going to instead of bringing our listener on. I want to just ask the question. I think it's a good one. Do you give up your Fifth Amendment rights when you're pardoned? That's a great question, And the answer is no, you don't. There's been a lot of speculation about that. And here's how it works out in the real world. The person is going to say You know what? I'm still facing state charges, so it's not like my answers can't be used to incriminate me. Yes, you can't help me into state into federal court. Let's say, had given himself a partner, giving his kids apart over federal tax evasion in New York. They could still be charged with state tax evasion in New York. They could still be charged with lying on loan applications or demanding insurance reimburses that we're much more than it actually lost. In whatever incident they were claiming that they lost. And so you would always say no with a good lawyer. You'd always say my client of searches rights under the Fifth Amendment to the Constitution because his answer her answer could tend to incriminate him or her because it could do so in state court, and the pardon doesn't affect state court matters. So You're not going to get any more information out of people, whether they do or don't have have apart now you could get the immunity and then you have all the kinds of homes that they have with Ollie North. After the immunity was so broad that you ended up giving them immunity for all of their prosecutions that would be federal and state. If you give somebody immunity, the immunity can cover both federal and state and you might want to have the state people participate. You might say my client will not talk to you with immunity unless you also give him immunity from state prosecution, but with immunity, compose state and federal prosecution.
