"News now let's turn to one of the members of Congress who question Mahler tomorrow California congresswoman Karen bass is a Democrat and serves on the house Judiciary Committee she is also chair of the congressional black caucus and joins us from hell welcome thank you given that he said he won't stray from the public information in the report and the justice department reiterated that warning him yesterday to stick to what's in the report are you actually hoping to elicit new information from Miller tomorrow we we actually are and I think that it was unfortunate what came from the justice department yesterday because that to me I viewed it as just an attempt to intimidate Muller he doesn't even work for the justice department anymore so what was the point what could be the purpose of a memo like that a request in that time I mean he said he wanted guidance from the justice department and the memo said it was in response to his request yes but I do believe that that's where they are coming from and I think the president has been pretty clear about that as well but let me just tell you that I am hoping that he provides a little more context to the report but even if he just confirms what is in the report I think the charges of obstruction of justice are devastating in and of themselves and then our concern has been that the American public probably has not read the report especially because you had Attorney General Barr come out and sent the signal to the American public that there's no reason to read this report because the report completely exonerates the president which is a complete lie this is interesting so what I hear you saying is that even if Miller doesn't go beyond what's in the report there is value just in getting kind of the TV moments where he will reiterate and say on camera what he's already said in writing yeah and I mean I don't see it so much as a TV moment but I do think that the American public needs to hear from his voice what is in this report so I think what you'll find from the Democrats that we will be very disciplined very organized we're clear about what it is we're doing in terms of volume two and obstruction of justice I don't know what my Republican colleagues will do but I won't be surprised to see a little bit of theater coming from their side I just want to be clear because you've referred to volume two if listeners have not read them all the report volume one is about collusion volume two is about obstruction of justice you're gonna be asking about obstruction of justice what specifically are you going to ask Robert Muller well we're going to have a a meeting of judiciary today and will be given our parts as to what we will focus on I will tell you that my particular interest is on hearing what the White House counsel McGann has to say in the report and to have Muller confirm or deny or correct to provide context essentially the White House counsel McCann was told to fire Muller and then he was told to cover it up and so I think that type of information really has not gotten out in the public space and knowing that this is exactly what is in the Muller reporting having him confirm it I do think there's a lot of value to that you said that you do not as of now support an impeachment inquiry into the president is there anything you might hear tomorrow that you think might change your mind I'm hoping that he will provide additional information that might bring better clarity but let me just say that I would love to see the president impeached and I would love to see him the victim if we move toward impeachment I believe that the Democrats all need to be on the same page and at this point in time we have for five committees that are all involved in either investigation or oversight and when that process has been completed when our leadership is on the same page and the committee chairs are on the same page if the decision is to move forward with impeachment I will be there one hundred percent but as of right now I believe this is too early in the process all of us want this to be over I'd like it to be over to but I wanted to be successful do you think that with four or five committees digging into this it's a misplaced focus by the Democrats you know the fact of the matter is the Democrats have been focused on multiple issues unfortunately trump and Muller the investigation has sucked up all the oxygen in is certainly dominating the Airways but if you want to look and see what we did we passed minimum wage we raise the minimum wage for the American public of course it's still has to go through the Senate we have passed gun reform so Democrats are well equipped to do multiple things at the same time congresswoman Karen bass thank you for joining us thank you she's a Democrat from southern California and chair of the congressional black

We have now spent considerable time talking about multiple clusters of false or misleading or incomplete or needed to be prodded by council statements, all of which center around the defendants relationship or. Communications with Mr. Kalinic. The judge continues, quote, this is a topic at the undisputed core of the office of special counsel's investigation as paragraph b of the appointment order put it she's quoting the appointment. Order that established the special counsel's office with Robert Muller at its helm. She quotes that appointment order where Muller is assigned to look into quote, any links and or coordination between the Russian government and individuals associated with the Trump campaign. Joining us now is Barbara mcquade. Former US attorney from the great state of Michigan. Barb. Thank you so much for being here. I have a lot of things I want to talk to you about. Yeah. Thanks for each busy day. Yeah. Man. It all happens. All at once in the Manafort transcript that we got today out of DC, the recurring themes like a seventy page transcript is that Manafort lied a lot to the government. The judge finds that he did breach. His cooperation deal he did it on purpose, and she really hones in on him lying about his communications with this. Guy Kalinic who the government says is tied to Russian intelligence. You were talking the other night about the the importance of why Manafort might have lied, and what specifically he was lying about. Now that we see the judge spell it out. What do you make of this? He will as you pointed out, he went took on great risk by lying knowing that he was risking this substantial prison term to lie, and we see in this transcript that more than half of it relates to his his statements about his contacts with Constantine Kalinic much of it is redacted. So we don't know exactly what it was. He was obscuring. But she does say that the FBI has that Constantine Kalinic was connected to Russian intelligence, and that was what he went out of his way to lie about she also points out these were not lapses of memory or failures to recollect. He created false narratives about matters that he was asked about Constantine Kalinic. And so he certainly was very deliberate. In line about Constantine Kalinic. And so there's still some mystery there for us, but those redacted bars may reveal the rest of the story and bar when you see this. Prosecutors ask for nineteen and a half to twenty four and a half years for Manafort just in Virginia that judge that ruled that he deliberately lied about. All those communications with Kalinic that judge is yet to start the sentencing process with him that sentencing won't happen until next month. But this recommendation from prosecutors that in the Virginia case alone should be looking at nineteen to twenty four years. Does that mean we should expect that he will get nineteen to twenty four years? Well, the that's the sentencing guidelines, it's sort of a starting point where judges are supposed to look to calculate a sentence. And it has a very numerical score. You mentioned some of the things that go into that cystic, aided means and leadership role all these kinds of things and you come up with kind of a math score, and you go to a table. And that's where you get that range of nineteen to twenty four. And then the judge is allowed to consider midday. Gating factors and aggravating factors to decide whether the Senate should be a little bit below that or a little bit above that. Based on this filing. They can't think of any mitigating factors. And in fact, there are aggravating factors for someone who is very wealthy who is highly educated and yet based solely on greed decides to commit these crimes. The defense will file something certainly that tries to point out some mitigating factors. But I can't imagine they're going to say things that convince the judge to go substantially below that range. Wow. Barbecue could stick with us for a second. There's one other matter that I wanted to ask you about which was actually matter raised by congress today to more lawyers associated with the president now being accused by congress of lying to officials lying to federal officials about that hush money. Crime for which Michael Cohen is going to prison next month..

"Congressman Cummings continues, quote, it now appears that President Trump's other attorneys at the White House and in private practice may have provided false information about these payments to federal officials. This raises significant questions about why some of the president's closest advisers made these false claims and the extent to which they too were acting at the direction of or in coordination with the president. One of the president's lawyers is already going to prison for his role in covering up those hush money payments. Here's a couple more who Elijah Cummings says are potentially on the hook related to those payments as well and not just the payments in their case, but the cover up of the payments. So the Cohen prosecution on the hush money payments Coen being prosecuted for those campaign finance felonies him being prosecuted for this campaign, finance felonies and naming the president is the person who directed him to commit those felonies that is dramatic enough on its own terms. But that case is turning out to be a legal nightmare for lots of other individuals and entities that surround the president from his business life from his political life before he got elected and even now from his life as president. This is all today. Dramatic developments today on the Roger stone case on the Michael Cohen case and related cases. But as I mentioned, the the really big Kahuna tonight is what just happened to the president's campaign chair Paul Manafort with prosecutors telling one of the two federal judges who is due to sentence him soon that they want a nineteen to twenty four year prison term for him, plus potentially tens of millions of dollars in fines and restitution, the implications of this are not just bad for Paul Manafort, in some cases, they are revelatory. And that story is next stay with us. As the new Torney general William bar today. Started his first day on the job as the head of the Justice department leading the husband of one senior White House staffer to proclaim online that William bar starting as a g means quote Muller will soon be gone as William bar took the reins at the Justice department for his first day today. This is what prosecutors in Robert Muller's office told a federal judge tonight who is starting the sentencing process for President Trump's campaign chairman, Paul j Manafort, this is what they told the judge quote, the United States of America by and through special counsel, Robert S Mueller files this submission to address the sentencing of defendant, Paul j Manafort junior as an initial matter. The government agrees with the guidelines analysis and the pre sentence investigation report and its calculation of the defendants total offense level as thirty eight with a corresponding range of imprisonment of two hundred and thirty five to two. One hundred ninety three months that's nineteen and a half years to twenty four and a half years in prison, a fine range of fifty thousand dollars to twenty four point four million dollars. Restitution in the amount of twenty four point eight million dollars and forfeiture in the amount of four point four million dollars. The defendant stands convicted of the serious crimes of tax fraud, Bank fraud and failing to file a foreign Bank account report. Manafort was the lead perpetrator and a direct beneficiary of each offense. And while some of these offenses are commonly prosecuted. There was nothing ordinary about the millions of dollars involved in the defendants crimes the duration of his criminal conduct or the sophistication of his schemes footnote one footnote one reads, quote Manafort was being investigated prior to the may twenty seventeen appointment of the special counsel by prosecutors in this district, meaning in the eastern district of Virginia. And by prosecutors in the criminal division of depart. Of justice. Oh, they were already pursuing Manafort before Muller was ever appointed. Quote Manafort, committed these crimes over an extended period of time from at least twenty ten to twenty sixteen is criminal decisions were not momentary are limited in time..

These nineteen pages of notes, some of them are typed. A lot of them are reducted. Some of them are hand scrawled and very hard to read. These are notes from the office of government ethics congressman Cummings has released these notes he has also released to the public a letter to Trump organization lawyer also released to the public another letter that he has sent to the new White House. Council. Those letters demand information related to those hush money payments, and those letters make the explosive allegation that it's not just Michael Cohen that two additional Trump lawyers one who worked in the White House and another lawyer who represents Trump in a personal capacity. She was actually the one who orchestrated that stunt during the transition where Trump sat there by the big piles of papers and supposedly handed over control of his business to his sons, the lawyer who orchestrated that in another lawyer who lurked worked in the White House, according to Elijah Cummings tonight, they may themselves be in trouble for making false statements about those hush money payments, quote, new documents obtained by the committee from the office of government ethics. Describe false information provided by the lawyers representing President Trump, including Sherry Dillon. President Trump's personal attorney and Steven pass Tino. Former deputy White House counsel for compliance and ethics who has now left the White House to represent the Trump. Organization. President Trump's former attorney Michael Cohen is now going to prison in part for his role in these hush money payments during his guilty plea. "The US attorney's office filed a response with court laying out why in fact, the Roger stone case and the case are all about the same thing. And in the course of making that argument to the court we learned from the special counsel's office today that some of the. Are you defendant? Some of these Russian military intelligence officers who have been charged by Muller for interfering in the election. Some of those defendants according to prosecutors quote interacted directly with Roger stone concerning stolen materials posted online. Prosecutors also explain how they ended up with evidence against Roger stone when they seized material for the Russian military intelligence case, quote as alleged in the indictment in two thousand sixteen the GRU defendants stole documents from the DNC the Democratic Party from the triple C, the democratic congressional campaign committee, and from the Clinton campaign chair those defendants than released many of the stolen documents, including through a website maintained by WikiLeaks in the course of investigating that activity. The government obtained an executed dozens of search warrants on various accounts used to facilitate the transfer of stolen documents for release as well as to discuss the timing and promotion of their release several of those search warrants executed on account. It's that contained Roger stone's communications is communications with goose for two point. Oh, a fictitious online persona created by the GRU. They said they also obtained stones communications with WikiLeaks, quote evidence obtained from those search warrants resulted in the allegations that the defendants hacked and stole documents for release through intermediaries including WikiLeaks. And that stone lied to a congressional committee investigating among other things the activities of WikiLeaks regarding those stolen documents. So the same search warrant turned up the evidence that led to the charges against these Russian military intelligence officers that they hacked and stole documents for release during the campaign they used WikiLeaks as part of their distribution channel for doing that that same search warrant. Also turned up the information that led to stone being charged for lying to congress about their investigation of among other things Wicky leaks. So. That's molars. Prosecutors today telling federal judge in Washington DC that they've got the communications between Roger stone and Russian military intelligence. They've also got the communication between Roger stone and WikiLeaks concerning these stolen democratic documents that the Russian hacked and then staged for distribution during the campaign in a way that was designed to cause maximum damage to Hillary Clinton and maximum benefit to Donald Trump. Upon getting that argument and those declarations from Robert Muller and the special counsel's office explaining all the links between Roger stone and Russian military intelligence that they turned up through their evidence -ciary searches..

"That means prosecutors are recommending what is in effect a natural life sentence for Paul Manafort. You will recall that there is no parole in the federal prison system. So nineteen to twenty four years. We're going to get to that Manafort situation in a little more detail in a second. But the sentencing recommendation from these prosecutors, it not only spells out what they're hoping to get from the judge in Virginia in terms of manafort's sentence. What's interesting about it? What's worth taking a closer look at in terms of the prosecutors memo tonight is that they also in making this case to the judge. They summarize what they believed to have been manafort's crimes and their seriousness, and whether or not he's done other things on top of those crimes that mean that he should have even more of the book thrown at him. So it is worth looking at that in detail. And we're going to get there in just a moment before we do that though, we shouldn't let the magnitude of what just happened with the president's campaign chair. We shouldn't let that push aside. A couple of other really important things that happened today before we got the Manafort sentencing memo, so there's a couple of things that basically got ripened fell off the tree today when it comes to two other cases that derive from Muller's investigation. And the first one is about Roger stone. President Trump's longtime adviser he was arrested at his home in Florida three weeks ago today, Mr. stone has pled not guilty to seven felony charges. He says he wants to go to trial. He says he is innocent of everything he has been charged with but one of the interesting things about Roger stone's indictment right from the get-go was that on the front page of that indictment. Prosecutors notified the court that they considered his case to have a sibling they considered his case to be formally legally related to this other case that has this case number that you see here. Eighteen CR two fifteen. That case is the molar indictment of dozen Russian military intelligence officers that case is the GRU indictment. One of the core. Indictments of Muller's investigation was that GRU indictment from last year in that indictment.
