"News now let's turn to one of the members of Congress who question Mahler tomorrow California congresswoman Karen bass is a Democrat and serves on the house Judiciary Committee she is also chair of the congressional black caucus and joins us from hell welcome thank you given that he said he won't stray from the public information in the report and the justice department reiterated that warning him yesterday to stick to what's in the report are you actually hoping to elicit new information from Miller tomorrow we we actually are and I think that it was unfortunate what came from the justice department yesterday because that to me I viewed it as just an attempt to intimidate Muller he doesn't even work for the justice department anymore so what was the point what could be the purpose of a memo like that a request in that time I mean he said he wanted guidance from the justice department and the memo said it was in response to his request yes but I do believe that that's where they are coming from and I think the president has been pretty clear about that as well but let me just tell you that I am hoping that he provides a little more context to the report but even if he just confirms what is in the report I think the charges of obstruction of justice are devastating in and of themselves and then our concern has been that the American public probably has not read the report especially because you had Attorney General Barr come out and sent the signal to the American public that there's no reason to read this report because the report completely exonerates the president which is a complete lie this is interesting so what I hear you saying is that even if Miller doesn't go beyond what's in the report there is value just in getting kind of the TV moments where he will reiterate and say on camera what he's already said in writing yeah and I mean I don't see it so much as a TV moment but I do think that the American public needs to hear from his voice what is in this report so I think what you'll find from the Democrats that we will be very disciplined very organized we're clear about what it is we're doing in terms of volume two and obstruction of justice I don't know what my Republican colleagues will do but I won't be surprised to see a little bit of theater coming from their side I just want to be clear because you've referred to volume two if listeners have not read them all the report volume one is about collusion volume two is about obstruction of justice you're gonna be asking about obstruction of justice what specifically are you going to ask Robert Muller well we're going to have a a meeting of judiciary today and will be given our parts as to what we will focus on I will tell you that my particular interest is on hearing what the White House counsel McGann has to say in the report and to have Muller confirm or deny or correct to provide context essentially the White House counsel McCann was told to fire Muller and then he was told to cover it up and so I think that type of information really has not gotten out in the public space and knowing that this is exactly what is in the Muller reporting having him confirm it I do think there's a lot of value to that you said that you do not as of now support an impeachment inquiry into the president is there anything you might hear tomorrow that you think might change your mind I'm hoping that he will provide additional information that might bring better clarity but let me just say that I would love to see the president impeached and I would love to see him the victim if we move toward impeachment I believe that the Democrats all need to be on the same page and at this point in time we have for five committees that are all involved in either investigation or oversight and when that process has been completed when our leadership is on the same page and the committee chairs are on the same page if the decision is to move forward with impeachment I will be there one hundred percent but as of right now I believe this is too early in the process all of us want this to be over I'd like it to be over to but I wanted to be successful do you think that with four or five committees digging into this it's a misplaced focus by the Democrats you know the fact of the matter is the Democrats have been focused on multiple issues unfortunately trump and Muller the investigation has sucked up all the oxygen in is certainly dominating the Airways but if you want to look and see what we did we passed minimum wage we raise the minimum wage for the American public of course it's still has to go through the Senate we have passed gun reform so Democrats are well equipped to do multiple things at the same time congresswoman Karen bass thank you for joining us thank you she's a Democrat from southern California and chair of the congressional black

Logic Cummings chairman of the oversight committee has released a whole bunch of documents tonight, and they're from the office of government ethics that some handwritten notes at some typewritten notes big big pieces of it appear to be redacted this that release from alleged Cummings looks like, but he says that what these documents show is that a couple of lawyers working for the president one who worked for the White House in one who worked for the president in a personal capacity gave false information to the office of government ethics about that hush money payment, the hush money payment that was the basis for the felony charges against Michael on the campaign finance felonies, he's going to prison for next month. Those are the campaign finance felonies is implicated the president is having directed into commit those felonies. Nell coming says that other lawyers so the president gave false statements about those payments to the office of government ethics when they were working on the president's sort of financial disclosure about these these matters is this something that is sort of slap on the wrist territory is this potentially illegal. Legal if they made false statements about those payments. Yes. A making a full statement to any one in government is a crime. It's the same statute eighteen USC sexual one thousand one full statements. It's the same crime. We've seen Robert Mueller charged many times for lying to the FBI or line to congress. It is similarly a crime to lie to a government agency about some matter that they are looking at within their jurisdiction. So if the office of government ethics is is looking into this and someone makes a false statement to them that is a prosecutable offense. And that this is one of those cases where there's a popular perception that it only matters. If you lied if you were under oath, but lawyers will tell you it doesn't matter if you're under oath, if you were lying to federal officials in that kind of a context it's a crime, regardless of whether or not you ever put your hand on a bible. Absolutely, right. It's a different crime. If you if you lie under oath, it's a crime of perjury, if you're not under oath, it's different crime crime of false statements, but they're both punishable by up to five. Five years in prison. The judge continues, quote, this is a topic at the undisputed core of the office of special counsel's investigation as paragraph b of the appointment order put it she's quoting the appointment. Order that established the special counsel's office with Robert Muller at its helm. She quotes that appointment order where Muller is assigned to look into quote, any links and or coordination between the Russian government and individuals associated with the Trump campaign. Joining us now is Barbara mcquade. Former US attorney from the great state of Michigan. Barb. Thank you so much for being here. I have a lot of things I want to talk to you about. Yeah. Thanks for each busy day. Yeah. Man. It all happens. All at once in the Manafort transcript that we got today out of DC, the recurring themes like a seventy page transcript is that Manafort lied a lot to the government. The judge finds that he did breach. His cooperation deal he did it on purpose, and she really hones in on him lying about his communications with this. Guy Kalinic who the government says is tied to Russian intelligence. You were talking the other night about the the importance of why Manafort might have lied, and what specifically he was lying about. Now that we see the judge spell it out. What do you make of this? He will as you pointed out, he went took on great risk by lying knowing that he was risking this substantial prison term to lie, and we see in this transcript that more than half of it relates to his his statements about his contacts with Constantine Kalinic much of it is redacted. So we don't know exactly what it was. He was obscuring. But she does say that the FBI has that Constantine Kalinic was connected to Russian intelligence, and that was what he went out of his way to lie about she also points out these were not lapses of memory or failures to recollect. He created false narratives about matters that he was asked about Constantine Kalinic. And so he certainly was very deliberate. In line about Constantine Kalinic. And so there's still some mystery there for us, but those redacted bars may reveal the rest of the story and bar when you see this. Prosecutors ask for nineteen and a half to twenty four and a half years for Manafort just in Virginia that judge that ruled that he deliberately lied about. All those communications with Kalinic that judge is yet to start the sentencing process with him that sentencing won't happen until next month. But this recommendation from prosecutors that in the Virginia case alone should be looking at nineteen to twenty four years. Does that mean we should expect that he will get nineteen to twenty four years? Well, the that's the sentencing guidelines, it's sort of a starting point where judges are supposed to look to calculate a sentence. And it has a very numerical score. You mentioned some of the things that go into that cystic, aided means and leadership role all these kinds of things and you come up with kind of a math score, and you go to a table. And that's where you get that range of nineteen to twenty four. And then the judge is allowed to consider midday. Gating factors and aggravating factors to decide whether the Senate should be a little bit below that or a little bit above that. Based on this filing. They can't think of any mitigating factors. And in fact, there are aggravating factors for someone who is very wealthy who is highly educated and yet based solely on greed decides to commit these crimes. The defense will file something certainly that tries to point out some mitigating factors. But I can't imagine they're going to say things that convince the judge to go substantially below that range. Wow. Barbecue could stick with us for a second. There's one other matter that I wanted to ask you about which was actually matter raised by congress today to more lawyers associated with the president now being accused by congress of lying to officials lying to federal officials about that hush money. "The US attorney's office filed a response with court laying out why in fact, the Roger stone case and the case are all about the same thing. And in the course of making that argument to the court we learned from the special counsel's office today that some of the. Are you defendant? Some of these Russian military intelligence officers who have been charged by Muller for interfering in the election. Some of those defendants according to prosecutors quote interacted directly with Roger stone concerning stolen materials posted online. Prosecutors also explain how they ended up with evidence against Roger stone when they seized material for the Russian military intelligence case, quote as alleged in the indictment in two thousand sixteen the GRU defendants stole documents from the DNC the Democratic Party from the triple C, the democratic congressional campaign committee, and from the Clinton campaign chair those defendants than released many of the stolen documents, including through a website maintained by WikiLeaks in the course of investigating that activity. The government obtained an executed dozens of search warrants on various accounts used to facilitate the transfer of stolen documents for release as well as to discuss the timing and promotion of their release several of those search warrants executed on account. It's that contained Roger stone's communications is communications with goose for two point. Oh, a fictitious online persona created by the GRU.
