"So let's get to the big question. Because we've been flailing without you as you know. Ever since the appointment of Jack Smith, who apparently is not the guy in the matrix, he puts on sunglasses. I think he is. But no, it's a different guy. Different guy. Okay. But Glenn, I think it was Barbara mcquaid, I saw on TV first that said, you know, the Justice Department wouldn't be doing a special prosecutor if they weren't going to indict. If they were going to decline. So, you know, and then everyone from tally nostalgia was like, this is no Jill wine banks initially said this is a waste of time and money. And you and I have been obviously impatient for justice for a long time and my first thought is, why isn't an indictment? Why is it, you know, yet another step. But, you know, it takes me a second to calm down. But just a little. But I think we all have Mueller fatigue, right? We think, oh God, are we starting all over again, blah, blah, blah. And a lot of people have pointed out how Lawrence tribe and others that they think this will speed it up and not slow it down. Dying to get your take on it because I do get that it's different a bill Barr's not in charge, it's not Trump's Justice Department. He is not starting from scratch, but give us your whole overview on this. Yes, Steph, I wish we had an hour. There's so much to unpack. And we do have, we have superhero fatigue. We thought bob Mueller was going to come in and take Trump out. His report did take Trump out the problem is Congress and the Department of Justice didn't act on the crimes that bob Mueller documented in volume two of the Trump Russia report. We thought Merrick Garland was going to come in and do what was necessary. It turns out in hindsight, Merrick Garland turned out to be too much judge and not enough prosecutors. So I am not prepared to say Jack Smith is galloping in on the white horse and he's going to take care of all this. However, first thing I did was I talked to all my Friends and former colleagues who worked with or for Jack Smith. I don't know Jack personally, to a person, they can not speak highly enough of his determination to hold criminal politicians accountable. Without regard to politics or criticism or fear of failure, here's why I really like the appointment of Jack Smith. We can do an autopsy on whether Merrick Garland should have appointed a special counsel. There are good arguments on both sides, but I think the bottom at the bottom of it all wants Trump announced he was a candidate. Let's face it, Merrick Garland is Joe Biden's attorney general. So to have Joe Biden's attorney general going after Joe Biden's only announced political opponent in the 2024 election, I believe, left Merrick Garland, no other choice but to appoint a special counsel.

"We're in for June grosso. We've been talking with Neil wearer of equally American about a case pending before the U.S. Supreme Court. Before we left, we were talking about the cases that you're asking the justices to overturn. Now, tell us a little bit about the lobbying effort to get the U.S. on your side in this case. What does that look like? What steps are being taken and by which groups? Yes. So the question for the Department of Justice and the Biden administration to decide is whether to support or oppose calls to overrule the insular cases. And so just a few months ago, just this course and justice Sotomayor, both agreed that it was time for the United States Supreme Court to overrule the insular cases. And echoing their views have been a broad array of civil rights organizations like the American civil liberties union, Latino justice, probe app, the legal defense fund and others who have called upon the Biden administration to jettison these archaic racist Supreme Court decisions. At the same time, a number of bar associations have also taken a stand calling on the Biden administration to support rather than oppose calls to overall the insta cases. The American bar association, just a couple of weeks ago, passed a resolution, supporting calls to turn the page on the insert cases in the colonial claymore fay established. The New York State bar association has passed a similar resolution with bar associations in the U.S. Virgin Islands and Guam being very active and seeking to advance equality and overruling the insta cases. And we shall soon hear what the Biden administration position is in these cases. Their set to file their deadline is August 29th. So we'll soon know what they've decided, then we'll look beyond that to see what the Supreme Court has to say. So there was a case last term involving social security benefits and the island of Puerto Rico, in which the Biden administration did not ask the court to overturn the insular cases. Is there something about your case that gives you reason to hope that the administration may come out differently? Yes, the case last term United States versus BioMed with the application of the fecal protection clause to federal laws that deny federal benefits to residents of certain territories while extending them to others. And all throughout the case, while the insular cases kind of hung in the background, they weren't central to the actual holdings of the lower courts. And the United States had not relied on them to advance the argument that residents of Puerto Rico had indeed denied non supplemental security income benefits. Instead of semi versus United States, the department of justices argument really begins and ends with the insert cases. So unlike prior cases where the insular cases were in the background, they really are front and center in the 53 minus case. And in our petition, we expressly ask the Supreme Court to consider whether or not to overrule the answer cases. No, I remembering back under president Obama where the Justice Department did in fact change the positions on the defense against marriage act and the same sex marriage context. And just wondering, how unusual is it for an administration to kind of do a one 80? At the beginning of Biden's term, the Justice Department did change a number of its positions from what the Trump Justice Department had been litigating. But in fact, probably the more apt precedent to look at in terms of the Justice Department is former acting solicitor general Neil katyal and the Obama administration issued a confession of error with respect to the core matsu case. That's the Japanese internment case. Saying that the United States had been wrong to argue in favor of Japanese internment and really condemning those cases. Even as they remained, quote unquote, good law under Supreme Court precedent. And that's really what all that we're asking the Switzer general to do here. We wrote her a letter claiming that the Justice Department simply don't rely on these racist cases. If they want to continue defending the discriminatory statute, that's up to them. They do have some other arguments. But what they shouldn't do is rely on cases that fit in the same class as possible versus Ferguson, dred Scott and korematsu. So that's what arguments the Department of Justice makes to advance their cases completely within their discretion. And it's actually a much less of a lift for them to decide to stop relying on racist Supreme Court cases than other examples like Dilma where they actually change their litigating position to support the other side than they had been supporting in the case. Remind us just exactly where this case stands. This is not a case that the justices have agreed to consider yet, right? Yeah, we're still at the review stage. And so at the district court, the district court judge ruled in favor of mister fitty Simon who recognizing that under constitution he had the right to citizenship at the circuit court stage. That decision was reversed two to one with three separate opinions being written by the judges at the tenth circuit. We appealed for review by the full tenth circuit, weren't successful, but two judges did write a very long and scholarly opinion dissenting to the denial of that review. And so now we've asked the court to take up the case, 8 amicus briefs have been filed in support of Supreme Court review and now we will hear from the United States Department of Justice and the closer general on whether they will support or oppose the calls to overrule the info cases in this case. Neil, one final question, you know, we've been talking about how these cases have been criticized sort of across the board, including from the justices themselves, across the ideological spectrum. Why is it that these cases are still on the books and still considered good law? What work are they doing now that might make the justices hesitate to take them off of the books? It's really not clear and that's been one that challenges in overruling them over the last 5 years. There's been three or four big Supreme Court cases involving Puerto Rico where, again, the insular cases kind of hung in the background, but as the Supreme Court says they should be held to their facts and narrows them that limit situations where they necessarily arise and are central to the disposition of the case. So ours is one of perhaps the only situations where lower courts would squarely rely on the insert cases to reach the legal results in a case. The Department of Justice has been hesitant to call on the Supreme Court to overrule them even when pressed by justice course. That's three or four separate times and the argument last term. And the justices themselves until recently have been hesitant to, so not kind of reaching out to the side these issues even when it's been in the mix. And that's problematic because the Supreme Court itself is responsible for the development of this doctrine. The Supreme Court and the court cases reach well beyond the issues in the case to establish this colonial framework. So just as the Supreme Court and the death of his who sit on it were themselves responsible for the insert cases, they also need to be responsible for some of the solution and addressing the harms that have sunk in that over the last more than a 120 years. And I feel like, you know, with the way that freedom of speech is today, the moment the movement on gun control, a lot of the liberties that I've taken for granted, most of my life, I think, are under threat. He added. He had just, he has just become a bigger fan of mine, I wish I had an interview because I want to talk about him more, it's good to see people that got a lot of money that's very successful, actually have common sense and not completely stupid. And I wouldn't be surprised if some black person go into whole foods in a white person working in there. Somehow don't see them in the donut Al. And they gonna say they want $25 million for racial discrimination. I wouldn't be surprised if that doesn't happen. There's a lot of things going on in our country that's very troubling to me. Let's go with me to Fargo school board who they decided to drop the Pledge of Allegiance over the usage of the phrase under God. These people are going to hell. I just want to reiterate that real quick before I go into the next, if you are marking God, you are going to hell. And I don't understand the problem with saying under God. In the Pledge of Allegiance, what do you think we're under? Who wrote the Pledge of Allegiance? What do you think what do you think this is all made up of? What do you think our founding fathers believed in? And you're just going to change it because you a lunatic? I hope that I used to wonder. I'm like, God. You know, hell is final. Burning in here for eternity seems excessive to me. And I think to myself, how does somebody end up going to hell because God looks at your heart and, you know, you got to be saved, and all the stuff that those are simple things to accomplish. Deciding it didn't align with their district values. Really? The Pledge of Allegiance to the flag of the United States of America don't align with your values. What are your values? The satanic flag. The Fargo school board voted 7 to two. Tuesday to drop the players from the start of their biweekly meetings because members didn't feel it was inclusive apparently taking issue with the phrase under God. The board, one of the board members, board member, a self Holden, said that because the word God is in the text of the Pledge of Allegiance is capitalize, the Texas clearly referring to the judeo Christian God and therefore it does not include any other faith such as Islam, Hinduism, Buddhism, and all of which are practiced in all of them which are practiced by our staff and students. 'cause I may be wrong. Show me a country that you want to live in that was established by Hinduism. A Buddhism, Islam. Islamic country that you want to live in. Okay. This is my thing about people that come to America. We are a Christian nation. I think we're getting away from it. We are a Christian nation. When other countries out there view us, they don't view us like stupid people see us. Meaning black, white, racism, systemic slavery. They don't see us like that. And then in her speech, after the election, she said that election was called after lecture was called for her opponent. She refused to concede. Three years later, she told CNN that her opponent won under the rule of the game at the time, but the game was rigged against the voters of Georgia. Vice president Al Gore in a Washington Post interview two years after his presidential defeat to George W. Bush, he said, I believe that if everyone in Florida who tried to vote had his or her vote counted properly, that I would have won. 2001, several House Democrats voted against certifying the election results in the year 2000. Representative Maxine waters of California, dead dirty dog, said in the joint session of Congress that the objection is in writing and I do not care that it is not signed by a member of the Senate as is necessary to force the Senate vote on the challenge. In 2004, a ghost of Democrat John Kerry would have become the president, they said, had Ohio, I'm sorry. Went to John Kerry in 2004, he'd become president. President George W. Bush carried it 51 to 49. One by a 100,000 votes that was pretty close. And you can go down the list. I mean, Hillary Clinton didn't concede these people are consistently saying the same thing that Trump is saying, but somehow he gets impeached. And somehow he's the evils man on Planet Earth and he's trying to turn the country down because nobody ever not concedes. Cry me a river. I wanted to talk to you real quick about what you were speaking about with the IRS agent and the FBI. And what I don't think people realize is that history can definitely repeat itself and so much is going on. This is basically the same exact thing as what happened in 1930 Germany. When they took out their political opponents in the whole 9 yards. And RS agents, that's what this 87,000 RS agent did. I don't know if you saw the application, but it's the only application I've ever seen that said, you must be willing to if that doesn't tell you something I don't know what else will. It kind of didn't want to get your take on something like that. History can repeat itself. And if this is a proof that the Bible is real, I don't know what is. Thanks for the call. You know, I try to always take a deep breath and say if it sounds too juicy, maybe I should let it filter out before I make a statement. You know, I thought that was very bizarre. That IRS agents are having to be armed and stuff like that. But you know what's funny is that I've never looked at an IRS agent application before. You know, I don't know if this has always been common practice, and now we're bringing it to light because of what have happened recently. You know, I don't know if the IRS has a S.W.A.T. team. I never even thought of the, I have let me just say this. I know nothing about the IRS. I thought that the IRS was pencil pushers that look into an audit people and they make sure you pay taxes or they do whatever they got to do to make sure that you're compliant. I never thought of the IRS doing anything outside of that. So while Irish agents need to be armed, it's weird. And the interesting thing is that IRS agents don't really, they don't really need to arm them when they already have FBI S.W.A.T.. They have U.S. Marshall S.W.A.T.. They have border patrol S.W.A.T.. They have CIA, DEA, ATF, they got all these other agencies and bureaus that they have tactical teams on already. They can come and do damage to you or if they sold one to activate them. The National Guard. I mean, they have all these other, you know, and now I guess the National Guard is not federal, the National Guard is based on a state jurisdiction, but you know, they still got the U.S. Military. I mean, foreign and domestic is what it says. So or at least with their enforcement obligations are. So they have so many more people than the IRS being armed, but it's definitely interesting because, you know, just because they spent 80 billion on me, everything is going to what you think is going to. It's easy to fit in the final money into a particular agency and then use their agency and weaponize it to do some different stuff. Just like 87,000 IRS agents, they don't mean that they are going to be doing what you think they're going. They could be doing scheduled to do something different. So I'm hoping that we can get the House and Senate. This is the important thing for us, ladies and gentlemen, if we get the House and Senate, we can put a halt to some of this stuff that they're just forcing us through. If we at the House and Senate right now, there's no way they would have passed their spending bill. There's no way because no Republican voted for it. And in the 50 50 split, cackling Kamala gives the vote, the vice president can give the vote the break to the 50 50 split. And so if we had a majority in the Senate, we had a super majority in the House, we wouldn't even be, we wouldn't even be talking about this. They can do investigation after investigation after investigation and impeach Joe Biden. They can have a special counsel to intervene and do an investigation into Joe Biden. They can have hearings about CRT and all this other stuff that they want to do. If they have the House majority, and then the Speaker of the House will be a Republican. For some reason, you know, we need to make sure we focus on that. I want to highlight and I don't want to go to that article. I was going to talk about whole foods, CEO, you know, because when I was in my master's degree class business leadership is what I went to school to get my master's degree in, now let me make this clear, people are going to be saying, Brandon, a lot of the city had a master's degree. Now I just didn't finish it because there's no need for me to pay another $22,000 for a degree that I don't need to be on the radio. So, I mean, I do own a few businesses, which will help if I had it, but I don't want to invest $22,000 doing more work than I have to do already preparing for this radio show. But the whole foods, founder and CEO, John Mackey, he complained that socialists are taking over the United States of America in a podcast that he was just recently on. And I love the fact that I hear of him saying things that are reasonable because I really like whole foods and in my class we learned about what we consider to be conscious capitalism. And there's a difference between in theory, right? There's a difference between capitalism and conscious capitalism. And in effect, what I learned from the class was that conscious capitalism is you focusing more on the people. And not the bottom line. Your consciously aware that if you treat your customers well and your employees will, that then let me give you a stands. If you go to whole foods, I don't know if any of you shop at Whole Foods. You go to whole foods. For the most part, the customer service is really good. They have good package deals for their employees. They pay them well. They treat them well. And the employees are happy. They're happy to serve you. They're not walking through the aisle, hoping they can avoid as many people as they can. And then if the employees are happy and they make the customer happy, the customer is more likely to spend. And if the customer is spending in the customer's happy employees are happy, the shareholders become happy because you make a lot of money. That's why whole foods does better than some other places that you see in the grocery store industry. Same thing with Costco, Costco has a have a wonderful compensation plan. If it ever hit the fan, I go work at Costco. They got benefit packages of that. They got retirement. They got tuition reimbursement. They pay really good salaries. You could work for a company like that. That's why when you go to Costco, they're happy. They can't wait to come say hi, what can I do for you? They can pay well. You go to some other places. They want to jump off a cliff. Versus going to work. The biggest example of that in the state of Arizona for people that know about Arizona is circle K versus quick trip. So we have to put this in perspective, right? Every police officer isn't violating somebody's constitutional rights and arresting people for no reason. There's a segment of policing that does that. There's the weaponization of policing just like they do FBI. At most FBI agents are probably normal people like you and I are just trying to do their job. But I think political parties and heads of the FBI who are appointed bureaucrats, they are the ones who weaponized to go after certain group of people. And then you have some nut jobs in the FBI who are political bias, politically biased as well. So I want to make sure that we are on par with that. This is a party who they had the incumbent president and when he ran for reelection they didn't even put out a new platform for twenty twenty a party platform. It's like standard operating procedure. Republican platform was something along the lines of paraphrasing. Obviously i don't have it in front of me but but it said we will unseat the current administration who at the time when they wrote.
