Glenn Kirschner Sheds Some Light on Special Counsel Jack Smith
"So let's get to the big question. Because we've been flailing without you as you know. Ever since the appointment of Jack Smith, who apparently is not the guy in the matrix, he puts on sunglasses. I think he is. But no, it's a different guy. Different guy. Okay. But Glenn, I think it was Barbara mcquaid, I saw on TV first that said, you know, the Justice Department wouldn't be doing a special prosecutor if they weren't going to indict. If they were going to decline. So, you know, and then everyone from tally nostalgia was like, this is no Jill wine banks initially said this is a waste of time and money. And you and I have been obviously impatient for justice for a long time and my first thought is, why isn't an indictment? Why is it, you know, yet another step. But, you know, it takes me a second to calm down. But just a little. But I think we all have Mueller fatigue, right? We think, oh God, are we starting all over again, blah, blah, blah. And a lot of people have pointed out how Lawrence tribe and others that they think this will speed it up and not slow it down. Dying to get your take on it because I do get that it's different a bill Barr's not in charge, it's not Trump's Justice Department. He is not starting from scratch, but give us your whole overview on this. Yes, Steph, I wish we had an hour. There's so much to unpack. And we do have, we have superhero fatigue. We thought bob Mueller was going to come in and take Trump out. His report did take Trump out the problem is Congress and the Department of Justice didn't act on the crimes that bob Mueller documented in volume two of the Trump Russia report. We thought Merrick Garland was going to come in and do what was necessary. It turns out in hindsight, Merrick Garland turned out to be too much judge and not enough prosecutors. So I am not prepared to say Jack Smith is galloping in on the white horse and he's going to take care of all this. However, first thing I did was I talked to all my Friends and former colleagues who worked with or for Jack Smith. I don't know Jack personally, to a person, they can not speak highly enough of his determination to hold criminal politicians accountable. Without regard to politics or criticism or fear of failure, here's why I really like the appointment of Jack Smith. We can do an autopsy on whether Merrick Garland should have appointed a special counsel. There are good arguments on both sides, but I think the bottom at the bottom of it all wants Trump announced he was a candidate. Let's face it, Merrick Garland is Joe Biden's attorney general. So to have Joe Biden's attorney general going after Joe Biden's only announced political opponent in the 2024 election, I believe, left Merrick Garland, no other choice but to appoint a special counsel.

"We're in for June grosso. We've been talking with Neil wearer of equally American about a case pending before the U.S. Supreme Court. Before we left, we were talking about the cases that you're asking the justices to overturn. Now, tell us a little bit about the lobbying effort to get the U.S. on your side in this case. What does that look like? What steps are being taken and by which groups? Yes. So the question for the Department of Justice and the Biden administration to decide is whether to support or oppose calls to overrule the insular cases. And so just a few months ago, just this course and justice Sotomayor, both agreed that it was time for the United States Supreme Court to overrule the insular cases. And echoing their views have been a broad array of civil rights organizations like the American civil liberties union, Latino justice, probe app, the legal defense fund and others who have called upon the Biden administration to jettison these archaic racist Supreme Court decisions. At the same time, a number of bar associations have also taken a stand calling on the Biden administration to support rather than oppose calls to overall the insta cases. The American bar association, just a couple of weeks ago, passed a resolution, supporting calls to turn the page on the insert cases in the colonial claymore fay established. The New York State bar association has passed a similar resolution with bar associations in the U.S. Virgin Islands and Guam being very active and seeking to advance equality and overruling the insta cases. And we shall soon hear what the Biden administration position is in these cases. Their set to file their deadline is August 29th. So we'll soon know what they've decided, then we'll look beyond that to see what the Supreme Court has to say. So there was a case last term involving social security benefits and the island of Puerto Rico, in which the Biden administration did not ask the court to overturn the insular cases. Is there something about your case that gives you reason to hope that the administration may come out differently? Yes, the case last term United States versus BioMed with the application of the fecal protection clause to federal laws that deny federal benefits to residents of certain territories while extending them to others. And all throughout the case, while the insular cases kind of hung in the background, they weren't central to the actual holdings of the lower courts. And the United States had not relied on them to advance the argument that residents of Puerto Rico had indeed denied non supplemental security income benefits. Instead of semi versus United States, the department of justices argument really begins and ends with the insert cases. So unlike prior cases where the insular cases were in the background, they really are front and center in the 53 minus case. And in our petition, we expressly ask the Supreme Court to consider whether or not to overrule the answer cases. No, I remembering back under president Obama where the Justice Department did in fact change the positions on the defense against marriage act and the same sex marriage context. And just wondering, how unusual is it for an administration to kind of do a one 80? At the beginning of Biden's term, the Justice Department did change a number of its positions from what the Trump Justice Department had been litigating. But in fact, probably the more apt precedent to look at in terms of the Justice Department is former acting solicitor general Neil katyal and the Obama administration issued a confession of error with respect to the core matsu case. That's the Japanese internment case. Saying that the United States had been wrong to argue in favor of Japanese internment and really condemning those cases. Even as they remained, quote unquote, good law under Supreme Court precedent. And that's really what all that we're asking the Switzer general to do here. We wrote her a letter claiming that the Justice Department simply don't rely on these racist cases. If they want to continue defending the discriminatory statute, that's up to them. They do have some other arguments. But what they shouldn't do is rely on cases that fit in the same class as possible versus Ferguson, dred Scott and korematsu. So that's what arguments the Department of Justice makes to advance their cases completely within their discretion. And it's actually a much less of a lift for them to decide to stop relying on racist Supreme Court cases than other examples like Dilma where they actually change their litigating position to support the other side than they had been supporting in the case. Remind us just exactly where this case stands. This is not a case that the justices have agreed to consider yet, right? Yeah, we're still at the review stage. And so at the district court, the district court judge ruled in favor of mister fitty Simon who recognizing that under constitution he had the right to citizenship at the circuit court stage. That decision was reversed two to one with three separate opinions being written by the judges at the tenth circuit. We appealed for review by the full tenth circuit, weren't successful, but two judges did write a very long and scholarly opinion dissenting to the denial of that review. And so now we've asked the court to take up the case, 8 amicus briefs have been filed in support of Supreme Court review and now we will hear from the United States Department of Justice and the closer general on whether they will support or oppose the calls to overrule the info cases in this case. Neil, one final question, you know, we've been talking about how these cases have been criticized sort of across the board, including from the justices themselves, across the ideological spectrum. Why is it that these cases are still on the books and still considered good law? What work are they doing now that might make the justices hesitate to take them off of the books? It's really not clear and that's been one that challenges in overruling them over the last 5 years. There's been three or four big Supreme Court cases involving Puerto Rico where, again, the insular cases kind of hung in the background, but as the Supreme Court says they should be held to their facts and narrows them that limit situations where they necessarily arise and are central to the disposition of the case. So ours is one of perhaps the only situations where lower courts would squarely rely on the insert cases to reach the legal results in a case. The Department of Justice has been hesitant to call on the Supreme Court to overrule them even when pressed by justice course. That's three or four separate times and the argument last term. And the justices themselves until recently have been hesitant to, so not kind of reaching out to the side these issues even when it's been in the mix. And that's problematic because the Supreme Court itself is responsible for the development of this doctrine. The Supreme Court and the court cases reach well beyond the issues in the case to establish this colonial framework. So just as the Supreme Court and the death of his who sit on it were themselves responsible for the insert cases, they also need to be responsible for some of the solution and addressing the harms that have sunk in that over the last more than a 120 years. Well, thanks so much to our guests nowhere. You're listening to Bloomberg

Go to my website, be off to take them dot com. Download the podcast, the off center show podcast on our podcast and platforms. I was talking about the whole food CEO and conscious capitalism. And I'm glad to see him talking about socialism. And in a quote, in the podcast that I was speaking about, it's called magazine. He said my concern is that I feel that socialism are socialists are taking over. They march through the institutions, they're taking over education, it looks like they're taking over a lot of our corporations. It looks like they're taking over the military. And it just continues. And he said in additionally, in the interview, he said, you know, I'm a capitalist at heart, and I believe in liberty and capitalism. Those on my twin values. And I feel like, you know, with the way that freedom of speech is today, the moment the movement on gun control, a lot of the liberties that I've taken for granted, most of my life, I think, are under threat. He added. He had just, he has just become a bigger fan of mine, I wish I had an interview because I want to talk about him more, it's good to see people that got a lot of money that's very successful, actually have common sense and not completely stupid. And I wouldn't be surprised if some black person go into whole foods in a white person working in there. Somehow don't see them in the donut Al. And they gonna say they want $25 million for racial discrimination. I wouldn't be surprised if that doesn't happen. There's a lot of things going on in our country that's very troubling to me. Let's go with me to Fargo school board who they decided to drop the Pledge of Allegiance over the usage of the phrase under God. These people are going to hell. I just want to reiterate that real quick before I go into the next, if you are marking God, you are going to hell. And I don't understand the problem with saying under God. In the Pledge of Allegiance, what do you think we're under? Who wrote the Pledge of Allegiance? What do you think what do you think this is all made up of? What do you think our founding fathers believed in? And you're just going to change it because you a lunatic? I hope that I used to wonder. I'm like, God. You know, hell is final. Burning in here for eternity seems excessive to me. And I think to myself, how does somebody end up going to hell because God looks at your heart and, you know, you got to be saved, and all the stuff that those are simple things to accomplish. But I see how people go to hell. They don't just not like God or not understand God. They hate God. They absolutely hate God. They're in a constant state of rebellion against God. It says the North Dakota school board has nixed the recruiting let me see. I'm sorry. I'm reading wrong. They have next the reciting of the Pledge of Allegiance before each meeting. Deciding it didn't align with their district values. Really? The Pledge of Allegiance to the flag of the United States of America don't align with your values. What are your values? The satanic flag. The Fargo school board voted 7 to two. Tuesday to drop the players from the start of their biweekly meetings because members didn't feel it was inclusive apparently taking issue with the phrase under God. The board, one of the board members, board member, a self Holden, said that because the word God is in the text of the Pledge of Allegiance is capitalize, the Texas clearly referring to the judeo Christian God and therefore it does not include any other faith such as Islam, Hinduism, Buddhism, and all of which are practiced in all of them which are practiced by our staff and students. 'cause I may be wrong. Show me a country that you want to live in that was established by Hinduism. A Buddhism, Islam. Islamic country that you want to live in. Okay. This is my thing about people that come to America. We are a Christian nation. I think we're getting away from it. We are a Christian nation. When other countries out there view us, they don't view us like stupid people see us. Meaning black, white, racism, systemic slavery. They don't see us like that. They see us as a Christian nation that they hate, why do you think we have conflict with these Islamic nations? It's not just because they don't like us financially. They hate God. At least they hate our God. You know, I find it very interesting that people come to a Christian nation where they can express other religions and they crap on the Christian theology. You ain't gonna do this nowhere else. You can do this in a Christian nation. Hold

"She lost her gubernatorial Georgia gubernatorial race due to voter suppression. And then in her speech, after the election, she said that election was called after lecture was called for her opponent. She refused to concede. Three years later, she told CNN that her opponent won under the rule of the game at the time, but the game was rigged against the voters of Georgia. Vice president Al Gore in a Washington Post interview two years after his presidential defeat to George W. Bush, he said, I believe that if everyone in Florida who tried to vote had his or her vote counted properly, that I would have won. 2001, several House Democrats voted against certifying the election results in the year 2000. Representative Maxine waters of California, dead dirty dog, said in the joint session of Congress that the objection is in writing and I do not care that it is not signed by a member of the Senate as is necessary to force the Senate vote on the challenge. In 2004, a ghost of Democrat John Kerry would have become the president, they said, had Ohio, I'm sorry. Went to John Kerry in 2004, he'd become president. President George W. Bush carried it 51 to 49. One by a 100,000 votes that was pretty close. And you can go down the list. I mean, Hillary Clinton didn't concede these people are consistently saying the same thing that Trump is saying, but somehow he gets impeached. And somehow he's the evils man on Planet Earth and he's trying to turn the country down because nobody ever not concedes. Cry me a river. Carla's a calling in a four four 9 zero zero 7 two four three 8 four four 9 zero zero 7 two four three. Chris, from Rialto, California, welcome to the off state of show. Yeah, Brad, how are you doing, everybody? I'm blessed. Thank you for calling. How you doing? I'm doing great, buddy. I wanted to talk to you real quick about what you were speaking about with the IRS agent and the FBI. And what I don't think people realize is that history can definitely repeat itself and so much is going on. This is basically the same exact thing as what happened in 1930 Germany. When they took out their political opponents in the whole 9 yards. And RS agents, that's what this 87,000 RS agent did. I don't know if you saw the application, but it's the only application I've ever seen that said, you must be willing to if that doesn't tell you something I don't know what else will. It kind of didn't want to get your take on something like that. History can repeat itself. And if this is a proof that the Bible is real, I don't know what is. Thanks for the call. Hey, man, Chris, thank you so much for calling in. Yeah, it's weird. You know, I try to always take a deep breath and say if it sounds too juicy, maybe I should let it filter out before I make a statement. You know, I thought that was very bizarre. That IRS agents are having to be armed and stuff like that. But you know what's funny is that I've never looked at an IRS agent application before. You know, I don't know if this has always been common practice, and now we're bringing it to light because of what have happened recently. You know, I don't know if the IRS has a S.W.A.T. team. I never even thought of the, I have let me just say this. I know nothing about the IRS. I thought that the IRS was pencil pushers that look into an audit people and they make sure you pay taxes or they do whatever they got to do to make sure that you're compliant. I never thought of the IRS doing anything outside of that. So while Irish agents need to be armed, it's weird. And the interesting thing is that IRS agents don't really, they don't really need to arm them when they already have FBI S.W.A.T.. They have U.S. Marshall S.W.A.T.. They have border patrol S.W.A.T.. They have CIA, DEA, ATF, they got all these other agencies and bureaus that they have tactical teams on already. They can come and do damage to you or if they sold one to activate them. The National Guard. I mean, they have all these other, you know, and now I guess the National Guard is not federal, the National Guard is based on a state jurisdiction, but you know, they still got the U.S. Military. I mean, foreign and domestic is what it says. So or at least with their enforcement obligations are. So they have so many more people than the IRS being armed, but it's definitely interesting because, you know, just because they spent 80 billion on me, everything is going to what you think is going to. It's easy to fit in the final money into a particular agency and then use their agency and weaponize it to do some different stuff. Just like 87,000 IRS agents, they don't mean that they are going to be doing what you think they're going. They could be doing scheduled to do something different. So I'm hoping that we can get the House and Senate. This is the important thing for us, ladies and gentlemen, if we get the House and Senate, we can put a halt to some of this stuff that they're just forcing us through. If we at the House and Senate right now, there's no way they would have passed their spending bill. There's no way because no Republican voted for it. And in the 50 50 split, cackling Kamala gives the vote, the vice president can give the vote the break to the 50 50 split. And so if we had a majority in the Senate, we had a super majority in the House, we wouldn't even be, we wouldn't even be talking about this. They can do investigation after investigation after investigation and impeach Joe Biden. They can have a special counsel to intervene and do an investigation into Joe Biden. They can have hearings about CRT and all this other stuff that they want to do. If they have the House majority, and then the Speaker of the House will be a Republican. For some reason, you know, we need to make sure we focus on that. I want to highlight and I don't want to go to that article. I was going to talk about whole foods, CEO, you know, because when I was in my master's degree class business leadership is what I went to school to get my master's degree in, now let me make this clear, people are going to be saying, Brandon, a lot of the city had a master's degree. Now I just didn't finish it because there's no need for me to pay another $22,000 for a degree that I don't need to be on the radio. So, I mean, I do own a few businesses, which will help if I had it, but I don't want to invest $22,000 doing more work than I have to do already preparing for this radio show. But the whole foods, founder and CEO, John Mackey, he complained that socialists are taking over the United States of America in a podcast that he was just recently on. And I love the fact that I hear of him saying things that are reasonable because I really like whole foods and in my class we learned about what we consider to be conscious capitalism. And there's a difference between in theory, right? There's a difference between capitalism and conscious capitalism. And in effect, what I learned from the class was that conscious capitalism is you focusing more on the people. And not the bottom line. Your consciously aware that if you treat your customers well and your employees will, that then let me give you a stands. If you go to whole foods, I don't know if any of you shop at Whole Foods. You go to whole foods. For the most part, the customer service is really good. They have good package deals for their employees. They pay them well. They treat them well. And the employees are happy. They're happy to serve you. They're not walking through the aisle, hoping they can avoid as many people as they can. And then if the employees are happy and they make the customer happy, the customer is more likely to spend. And if the customer is spending in the customer's happy employees are happy, the shareholders become happy because you make a lot of money. That's why whole foods does better than some other places that you see in the grocery store industry. Same thing with Costco, Costco has a have a wonderful compensation plan. If it ever hit the fan, I go work at Costco. They got benefit packages of that. They got retirement. They got tuition reimbursement. They pay really good salaries. You could work for a company like that. That's why when you go to Costco, they're happy. They can't wait to come say hi, what can I do for you? They can pay well. You go to some other places. They want to jump off a cliff. Versus going to work. The biggest example of that in the state of Arizona for people that know about Arizona is circle K versus quick trip. That's the difference between capitalism and conscious

"All right, ladies and gentlemen, welcome back to the officer Tatum show. I want to play these clips real quick because people may not believe you, they may not believe me. Maybe it is a liberal listening to this and saying I hate this black man talking about the Democrat party, but I don't need you to believe me. Listen to the evidence. Hillary Clinton said a thousand times. I'm exaggerating one a thousand. She said a lot of times. That Donald Trump was an illegitimate illegitimately. The president. She said he stole the election. Don't listen to me. Roll the clip of Hillary. Trump knows he's an illegitimate president who got illegitimate foreign help. He knows he's an illegitimate president. He knows that there were a bunch of different reasons why the election turned out the way it did. You can run the best campaign. You can even become the nominee, and you can have the election stolen from you. I know that he knows that this wasn't on the level. Why do you think the president is going to such great lengths to essentially prove that he beat you? Because he knows he didn't. He knows he's an illegitimate president. I do think that he knows that he's an illegitimate president. Now, riddle me this Batman, she said the lecture was stolen from her. Did she or did she not? And then Trump says the election was stolen from him and everybody's in the middle of the street gagging and passing out. The double standards, man. The double standards. And you know, liberals probably never heard those clips. 'cause they're not gonna play it on CNN that Hillary Clinton was also claiming that the election was illegitimate, and that the lecture was stolen from her. Ladies and gentlemen, they did an investigation into Trump. Of his illegitimacy and election. They thought he colluded with Putin to steal the election. It's no different than Trump saying that China and the Democrats and whoever was working together to steal the election. It's the same thing. He got impeached. They're saying he's a terrorist. They're busting in his doors in his house. They're not looking for national archive. They're trying to find indicia evidence of a crime. Pertaining to Janie 6th. They don't care nothing about nothing else. Don't believe the lies. These people are evil, they're fraudulent. All they do is make up lies and Bologna. "I want to play the devil's advocate real quick. Again, the cigar lounge is my sanctuary sometimes. So a guy in the cigar lounge made this comparison. He said, aren't you against defining the police? When the police are defined, there's not a sufficient amount of police, things slip through the crack, right? Criminals and doing Coke on the side of the road or whatever the case may be is not enough cops to enforce it. So crime gets out of control. And then you know you got the DA that's absolutely out of there out of control. So when they do arrest them, nothing happens. So he said, well, compare that to the IRS agents, right? If you have a deficient amount of IRS agents, a lot of people who are doing fraud, meaning that they are defrauding the government and invading taxes, those people will now be brought to justice with an influx of numbers. And I said, um, I can see where you're coming from. Now, if this was a reasonable administration, I'd say yeah, that makes sense. Because it's the Biden administration. I feel like they're going to weaponize it and use it against their political enemies. We've already seen old girl do it. She had to resign because she was at their cutting up. Targeting political the Tea Party and conservative groups. But I'm not opposed to it if people were doing it in good faith. I think we all are. If you're doing it in a good faith, yeah, I pay taxes every year. And I hate it. I absolutely hate paying taxes. But you know what? If I got a pay, your dog won't butt gotta pay it too. That's how I feel. And there's people who are probably breaking the law and diverting from taxes and they ain't pay taxes and ten years. Al sharpton, and maybe the 87,000 people can get out sharp and finally pay his taxes. I don't know how that guy's diverted taxes this long. He owed millions of dollars in taxes and nobody said anything. However, if they are going to go after people who are doing crimes, as a former law enforcement officer, I'm okay with that. I'm not mad at the FBI. And the totality of FBI's functionality, right? FBI do go after pedophiles. FBI do raids, they don't do do during the raids. They just do raise. So I said, do do raids? There's no such thing as a duty rate. As I'll do the raids, I don't think. But they conduct raids against pedophiles. I was a part of one of the rage in Tucson, whether, you know, I just did traffic control for them, all the FBI agents S.W.A.T. team, they conduct a raid, and I watched it unfold and I was very pleased with the fact that a pedophile was sharing child pornography. I think he was like ranked number three in the nation. They blew his house up and got him out of there. No knock warrant. So the FBI. Does more than just raid Donald Trump. So we have to put this in perspective, right? Every police officer isn't violating somebody's constitutional rights and arresting people for no reason. There's a segment of policing that does that. There's the weaponization of policing just like they do FBI. At most FBI agents are probably normal people like you and I are just trying to do their job. But I think political parties and heads of the FBI who are appointed bureaucrats, they are the ones who weaponized to go after certain group of people. And then you have some nut jobs in the FBI who are political bias, politically biased as well. So I want to make sure that we are on par with that. You know, that's why I was thinking about making a shirt. If the FBI, something like that. And then I said, you know what, I really don't want people saying if the police either. Because a few knuckleheads and some police departments are being used to do things they shouldn't do. I don't think that we should, you know, demonize the entire force. We'll talk about that more.

When you used to live in LA and you didn't remember it being as bad as it is today, when you were in San Francisco and you remember how beautiful San Francisco used to be. And now as homeless people pooping in front of your business, I think people are starting to wake up to this stuff. And if you ask me, I think Trump wanted a landslide in 2020 and that was a result of people waking up. So now I think people are waking up even more. They're even more awakened. Because the stuff is at their doorstep, and we talk about money being diverted. Like think about this. Which is more important to you guys. What do y'all think? The IRS getting $80 billion over ten years in hiring 87,000 new agents. Or what do you think it would be reasonable that the federal government will help protect our schools? Remember when that was a big issue? Of gun violence. In the Second Amendment and kids getting killed in schools, what are we going to do about it? The government can allot money to protect the schools and give funding to local agencies and school districts to hire on police officers to help combat violence in the schools. But our government, they're not doing that. They're going to spend a $100 billion on clean energy. And let me tell you this ladies and gentlemen, if China and India don't do nothing, what are we doing? They account for over 80% of all the carbon emissions. Our country going to be dead and we're going to spend a $100 trillion and we only make up like 5%.

"You're listening to Brandon Tatum. The off to Tatum show. I'm a finish the list of people who play at the 5th. We can go back through Obama's boy. Ben Rhodes, you know, after he, you know, the Iran deal went south, Congress wanted answers. He sent his buddy Ben roe, a rose. I said, Ben roe, Ben Rhodes. To testify, he played the 5th the whole time. Brian pagliano, the one that was the IT person that with no security clearance was the IT person of Hillary Clinton's private server in our House who got exposed to classified information and all kinds of other stuff. All the government secret everything. This guy didn't work for the government. Anyway, when he had to testify, he evoked the Fifth Amendment a 125 times. Then you had a similar person, similar to Brian, because they were both associated with this private server. And Paul, he was a part of, I think it's called plate. River network, I could be saying it wrong, God forgive me. He was the person responsible of wiping Hillary Clinton's private server with bleach bit. He also refused to testify before the House oversight committee and played the 5th. Let's go to more people. Remember the former national security adviser Susan Rice, Susan Rice did the same thing. She was involved in a high level discussion amongst Obama administration officials to spy on Trump, then in coming national security adviser Michael Flynn. And who else is on this list? Lloyd Austin and an aftermath of Joe Biden's botched withdrawal from Afghanistan, he played the 5th. Lois Lerner, remember Lois larner, the director of the exempt organization unit of the IRS, and we know that they targeted conservatives. It says they were inappropriately targeting conservatives and Tea Party groups. She refused to appear before Congress. A former attorney general, which a lot of people know, Eric holder, investigation of the fast and the furious operations, he refused and played the fit. So I don't want to hear nobody talking about nobody pleading the 5th. It don't mean you're guilty. That's why we have the Fifth Amendment. For you to exercise your rights. So they don't get you into some trickery. But I do wonder what's going to be revealed on that search warrant. Because I'm interested to know, however, unless he's going to prison for life, he still get my vote. Why mister Tatum? Because I feel like Donald Trump was in such a weird situation. If they would have just let him be the president and do his thing, do his thug dizzle. We wouldn't even be in a situation we're in and out. He would be the president for two terms. We would have a flourishing country even more so than we've ever had in the history of our country. But they couldn't just do that. Every 5 minutes, he's a racist. His tax returns. I don't care if the man ain't paying no taxes. Matter of fact, he's a genius. If he can get away with paying no taxes, he is a genius, show me line me up with the people that can help me not pay no taxes. Lining it up. I wouldn't even be mad at Biden and pay taxes. You just throwing your money to the government. Then they say he said Mexicans are bad. He said black people are bad. And you got Joe Biden saying if you don't know, you don't know who you want to vote for me or Trump. You ain't black. Can you imagine? Any white person saying that? To a black man, Charlemagne, on his show, Joe Biden stumbled in there and said that, and he didn't even give no backlash. And you ain't. If Donald Trump said that lord Jesus help us all. They would still be talking about that today. And you ain't black. They were still. Biden you better get out of my ear for you have some problems. They would have steal. Been talking about Donald Trump. And his racism towards black America, not to mention that Donald Trump had the lowest unemployment ever in history for black Americans in this country. Not to mention his efforts in HBCUs, giving him more money than Obama did, not to mention the urban revitalization coalition that he started. Not to mention the first step act that was passed under his leadership. We ain't even talking about all the things that he did that benefited black people. They'll be saying that he's a racist and black people should never vote for him because he said you ain't black. But then Biden said in his fine. Clinton called black people super predators and it's fine. The 94 crime bill that was passed under at least Joe Biden bragged about authoring the 94 crime Bill, which incarcerated the disproportionate amount of black men in this country. And I'm not saying they didn't deserve. They didn't deserve to go to jail, 'cause selling drugs was illegal, and they knew it was illegal, they were doing it anyway. However, it did disproportionately affect black men. They ain't racist. They're doing things that disproportionately affect black people and nobody cares. Robert Byrd was a former klansman member. I don't care if he changed his life. If there was somebody associated with Trump that changed his life, nobody would care. Robert bird was a clans member. Joe Biden did the eulogy at his funeral. Hillary Clinton was there, Barack Obama was there. But they don't care. Margaret Sanger, Planned Parenthood, eugenicist. She practiced eugenics. She wanted black people who she considered black people to undesirables. And nobody said anything about that.

Don't Be Too Hasty Judging the Raid
"It looks like, and this is something a report that I was checking out before I got here to DoJ wants them to release the or unseal the documents contained or the documents related to the raid into Donald Trump's personal home. Two things that we are going to take away from this situation. It's only two ways it can go, right? In theory. One is that when the information is released, we will see that this is a witch hunt like never before. Just like Russia Russia Russia and all the other crap that they doing. We'll see that this is bull crap and that people should go to jail even though they probably won't. Or or which is the latter, which is what I don't expect, but I'm gonna call it out if I see it or that there's something a lot more sinister going on and Donald Trump is a culprit and violating the law.

"They go in the first time. He cooperates. They snoop around. They try to find anything that they can related to what January 6th, but when you get a warrant, and this is something that people may not know, when you get a warrant, you have to be very specific. As to what you've seen or know what you're going to extract and the areas in which you're going to pursue in the warrant. For instance, if a police agency got a warrant because they were looking for drugs, our money at your house is not the movies. They can't kick your door down and go through your whole house, toilets, everything to look for money and drugs. They have to be specific on a warrant as to the places and locations that they want to go and search and those locations have to be reasonable.

work parts based the race Those are the work parts to the thing It's been a while All right let's just say good morning Alan Grayson Cameron future congressman Alan Grayson It was just kidding I liked your listening It's fine You could tell me what's going on in your life You were referencing about the network on that as hell and I'm not going to take it anymore Sound bite I want you to get up right now and go to the window open it and stick your head out and yell I am as mad as hell and I'm not going to take this anymore All right we're going to talk about your Senate run but you're a fancy lawyer And we have a DoJ press conference today to talk about this among other things this bombshell from The New York Times about the Trump and bar spying on congressman Schiff and swalwell colleagues your former colleagues their families their staff including minors I mean what congressman there's got to be consequences for all this right Right right Impeachment And the Republicans need to wake up and understand that just because somebody's president of the United States doesn't mean he's dictator king or anything even like a Pope They've got to understand that there have to be consequences for this That was clearly a violation of constitutional rights There are laws If anybody up to and including the president violates your constitutional rights writes they are held accountable in a court of law That needs to happen Yeah Well I mean it was frustrating wasn't it between yesterday and Chris ray I mean I have to hope they are going all the way to the top and up to Trump for the capital for the insurrection That's just one thing But now yesterday we learn again about the criminality and corruption in the Trump Justice Department Correct And really they were just following the Nixon playbook That was the very last thing to check off on Nixon checklist Go ahead and spy on your enemies Right But not even Nixon didn't go that far right Well he went pretty far The FBI was buying wiretapping people Martin Luther King and so on Right right Well so now let's talk about you are you are running for against Marco Rubio for the Senate in your home state of Florida Because you know I've had a love affair You and I had a love affair that involves peer honesty I am already admitting to you I've been cheated on you several times with bell demings So I just want you to know I'm also very excited about Val demings run I mean Marco Rubio's got to go That's the main thing right I mean he really is such a political wind sock Isn't he It's worse than that He is the victim of the Stockholm syndrome You know during the campaign Trump called him out and spent $20 million on advertising in Florida and basically pummeled him with ads saying that Marco Rubio is corrupt which he is And Marco Rubio is a truant a no show He had the worst attendance record in the Senate And little Marco having absorbed all of that battering from Trump turned her out and did want to became one of his biggest fans As did many in the Republican Party he's lost his consciousness lost any sort of tether to what's right and what's wrong And that's what Donald Trump did to people but we don't need somebody like that as a senator I go around and ask people what has Marco Rubio done for you Dead silence That's been an office and years You said what has he done for you You should even the Orlando sentinel can't stand him They say Rubio's a Stockholm syndrome Republican held hostage by Trump for so long that all you can do is make pathetic convoluted political calculations that all come down to how best to kiss Trump's butt This is pathetic what's become of this party isn't it And yeah It's beyond belief I mean the Republican Party was always bad but not this bad You know years ago a writer said I thank God for one thing that I'm a Democrat I mean that's never been more true now that has there been more true than it is today Yeah See this is the thing You've been commenting on just the basic decency of this party You're talking about Marjorie Taylor Greene You said not wearing a mask during a pandemic when you're around people in their late 80s like representative Don Yang and Eddie Bernice Johnson is reckless endangerment People like Marjorie Taylor green may enjoy the taste of blood but aren't 500,000 corpses enough I mean they're just and they're fighting us at every turn whether it's you know desantis down there in Florida threatening to sue is he suing cruise companies if they ask if people are vaccinated to get on cruise ships I mean is he trying to kill him He did one of his patented executive orders saying that the cruise ships were forbidden as if the governor made the law all by himself And we see that over and over and over again He did an executive order that prohibited local cities and counties from requiring people to wear masks during the pandemic It's been just shockingly irresponsible By the way in that clip that you just ran the Peter Finch clip from the network He.

You know i guess Rand rand names. Their kid rand Anyway rand he with the hair is You know with so. I guess taken aback by dr fao. Chee not taking any more of his shit rand. Paul is one of those people who just doles it out. Doles it out and doles it out but can't take it when it comes back at him. Obviously 'cause he's gonna file with the doj now. I guess if there ever were an attorney general who would do something stupid like go to bat for rand. Paul garland. And i know you don't have to tell me. It wasn't merrick garland. Who put the kabosh on Holding wilbur ross accountable for lying to congress it that was the trump justice department which is kind of an oxymoron because there was no justice in the trump administration But i you know. I'm not overly impressed with the justice department in the in the biden administration either. Although the news the official news did come down. That joe biden is nominating. And of course like his name escapes me. I wanna say like jason candor or something like that But the the guy that everyone's been talking about who should lead the antitrust division at the department of justice that to biden is nominating. My response was when i read it. That biden's going to nominate him. What are you waiting for. do it already. This should have already happened. But that is the pratt randall. Whose name is randall. Okay thank you see. Fields has name. Is randall all right Oh rand paul ran. No a well seafield says. His name is randall. And then diane russell says what i had heard was that you know. He was named Or called rand for on rand one of the most You know sickening authors. I'll never forget you know my kid. Allison it was never much of a reader. She didn't like reading she don't like school. She's bright she just was not a good student and so when she did bring home a book to read. I was always excited. I'll never forget the first book. I remember getting really excited about was one called gifted hands. And she's telling me about it and she's like mom this guy. He grew up like in the projects and he became this amazing brain surgeon and he's separated come conjoined twins and it's ben carson. Oh my god and then and then one day she had a One of the fountainhead or something. I'm like really you're gonna read. Don't read that shit. I'll give you a really good book to read. But you know you can't. You can't reason with kids. They're going to do what they're gonna do rand whether it's the line Variety or the paul variety. Either way rand no we. Don't go there all right so more happened today. So we heard of it took kevin mccarthy. The house minority leader Forever to name his five members to sit on the house. Select committee to investigate. What happened on january six. You may recall. Nancy pelosi the speaker of the house. Said there will be a twelve was at twelve Members and she would put forth eight and he would get five right so i think my numbers are skirt. I'm the worst at math. So you know with me and numbers. I need to write those things down anyway She was going to get the you know the majority as she should because first of all let's back up second. This was the second choice. The i was going to be an independent bipartisan commission. On sitting along the lines of the nine eleven commission there would not be any sitting members of congress on this commission they would bring in people from the outside and both parties would get to You know at least suggest participants to sit on the panel right well. No the republicans didn't want that. Why because that would be to fair so the next step was to create a select house committee. And that's what nancy pelosi did and obviously she's going to have more Members than the republicans simply because her parties in the majority. That's how it works or how it's supposed to work in washington. Dc majority rules is not like one of the first rules of democracy so anyway So she named her. Was it six seven. She got seven and he got five. That's the way it works to twelve. And as one of her seven. She named liz. Cheney liz cheney a republican a conservative and in this day and age so many of these right wingers aronie asli call themselves conservatives. They're not conservative at all. They're right wingers. they're hard call hardcore crazy right wingers. i'm so sick of being called a radical leftist. I'm a liberal. I'm a progressive liberal democrat. But i i prefer the progressive in the liberal more than the democrat label. Because frankly i'm not thrilled with that party and unfortunately as much as we want to maybe deny it. We live in a two party system which we do. That's how it works. This is not a parliamentarian Parliamentary system of government where we have a number of different parties if you go the route of a third party. You're basically saying. I give up as much as i would have liked to have seen say the green party come up and make some change. Make some noise make a difference. It's never gonna happen. The main reason. I've been saying this for years is because they come out of the woodworks every four years like the year before presidential election and they'll put up a candidate and they'll make a little bit annoys but then they disappear. They are not a force to be reckoned now. I'm more surprised than anybody else that we haven't that. During the trump years we didn't see the rise of a third and even a fourth party because frankly both of our major political parties the democratic party and the republican party. They're both really trying to watch my language lately but there's really no other way to put it. They're both fucked up the republicans. We know they totally jumped the shark. This is a party who they had the incumbent president and when he ran for reelection they didn't even put out a new platform for twenty twenty a party platform. It's like standard operating procedure. And they didn't do it. What they did was they took the twenty sixteen platform and said we're just going to go with this one again. Well written into the two thousand sixteen. Republican platform was something along the lines of paraphrasing. Obviously i don't have it in front of me but but it said we will unseat the current administration who at the time when they wrote. That was barack obama right. They didn't even fix that language. That's how lazy they are and they're just like we're the party of trump. We're not gonna we're not gonna put out any work. They did nothing to make. Lives better for americans right. They do nothing. They've all embraced.

Donald trump on behalf of the united arab emirates prosecutors in the eastern district york today. Unsealing a huge seven count. Forty six page. Indictment go through it. We've got a reporter. Who's reporting on this. But this is a very important development a bunch of reasons not the least of which because when we last met here at this desk last night we were talking about the fate of the rule of law in the air of donald trump and particularly in the period where the justice department changed hands from attorney general in bar and then the final days of the trump administration. The lackey jeff rosen to joe. Biden's new attorney. General merrick garland last night. Here on this program. We were critical of the fact that justice department had according to reporting declined to prosecute trump's secretary of commerce wilbur. Ross that was according to reporting from both the associated press and government executive. Now that decision not to prosecute a came after the commerce department's own inspector general found at loss had lied to congress about a citizenship question that he wanted to add to the twenty twenty cents. We have an important update to that story. The government executive have both issued corrections. Clarifying that in fact it was the trump justice department that made the decision not to prosecute. I'm gonna ride the tram back and forth to the parking lot until you're done. I like looking at the cars. That's my cut biden's message at these. Meetings has been simple america's back them mcgrigor marika's back for a limited time only offer not valid in florida. Although if i were a foreign leader wouldn't take it with a grain of salt. I mean yes. Biden is president but america definitely has a split personality. And who knows how long this one's gonna last if dr. Jekyll said i'm back. It would be fair to ask if he threw away the serum that turned him into mr hyde and if he responded the important thing is i'm back relax. I'm not sure you would relax. Still vines message seems to be working. French president emmanuel macron for example seemed very excited to have an american president willing to work with european allies to solve common problems. We have to deal with this pandemic to covid nineteen. We have to face it off. Kansas crisis climate change and and for all these issues what we need is corporation. And i think it's great to have the us president part of the club and very willing to to to call parades. And i think that what you what you demonstrated. Leadership is partnership. It's nice to hear some optimism for change. Usually when you hear a french guy say americans back. It's because he's watching someone. Take a picture of the mona lisa with an ipad. Great milk is beck was clocks and zeal but simpson digits. You is is it. See i colombo to this also watching this to pal around must be a real burn for trump. He was so desperate to be friends with macaroni. He brushed dandruff off his shoulder. You have a booger in your nose. Might if i get that for you guys. Can you bring us your smallest boone. Now kazbek men. That said biden's trip has had its moments two for one. There was that awkward. Socially distanced pictured of the g seven leaders where they look like street fighter characters. No one wants to pick should all be doing that video game character thing where they bounce plays and they're seeing depose buying just standing there with dukes up and every time you hover over. He says catch phrase come on man man. There was an odd moment where reporter asked by about some trump era trade policies has enrolled back yet and biden. Willie seemed a little irked. Heatedly that america is back at the same time you've kept in place. Some trump era steel and aluminum sanctions. And i wanted to ask you. When you're having these conversations with european allies who are very concerned about these sanctions. How do you justify that. And what are your plans to twenty days. Give me a break time. why does he sound like superman. Holding a rod of kryptonite must bring america back. The point is biden's trying to leave the trump era behind on the world stage even as the gop tries to keep it alive here at home either by recommitting themselves to trumpism trying to whitewash the many lies that abuse of power trump's former press secretary kayleigh mcenany for example said this on sunday and then there was the question. Will you ever lied to us and said without hesitation. No and i never did. I never lied. I source information but that will never stop the press from calling you a liar impressive to lie about lying. It's like stabbing a witness during your murder trial. We shouldn't care. Would a proven liar has to say about anything especially the question of whether she lied or not. I mean no one asks vanilla ice to come up with an original beat anymore lissi. Mcenany explain how she didn't lies like listening to ice. Explain how his song was different from under pressure of like he goes ding ding ding ding ding ding ding ding ding ding. That's the way there's goes. If you ask me she should be the one doing a weekly digital segment called corrections where she has to defend herself from hordes of internet jackals critiquing her every utterance oh and as a reminder don't miss corrections available every friday morning online corrections it's a massive waste of time mcenany and the rest of the term crowder eager to rewrite the history trump whether it's cove it or the two thousand and twenty election or the january sixth sense direction. And that's because it's still very much trump's party in fact one thing that's become clear about the post. Trump era is that if the gop gets their way. There won't beep oppose trump era. The republican party remains deeply committed both the ideology and the cult of personality that is trump is last week for example the number three house republican two phonic who just replaced liz. Cheney after cheney criticized trump for inciting an insurrection posted a photo of herself with trump and the caption save. America save america. I wouldn't count on trump to save a drowning man if he was standing in a lifeboat filled with booties their one hundred bucks each or two for two hundred. That's a great deal. What's i can't hear you with all that water and your mouth. It's not encouraging sign for the health of our democracy that you appease biggest names and rising stars are happily posing for photos with deeply unpopular autocrat. Who's still lying about the election and soda. Violent insurrections empower. It's like the captain of your cruise ship posing for a pick with an iceberg in the caption. Great running into you and it's not like they're just winking and trying to be settled about it. The gop has been explicit that the twice impeach trump who never once won the popular vote and continues to be deeply unpopular and polls is the leader of their party and they've made it clear they don't want him to go away. We are a pro america. Populous party rooted in conservative principle with donald trump as our leader is impossible for this party to move forward without president trump being its leader they look at donald j trump and they look at the millions and millions of people inspired who went to battle fighting alongside president trump and. They're terrified and they want him to go away. Let me tell you this right now. Donald j trump is going anywhere. Ted cruz normal voices deeply grading but when he tries to fire a crowd. It's like watching an accordion player. Bust out kazoo. If ted cruz had given the speech at the end of braveheart the scottish would just lay down their arms and gun home. Don't care if humans all like that. Lloyd that's how it's supposed to sound. The republican party has made clear that if it gets back into power and twenty twenty two or twenty twenty four. They'll follow in trump's footsteps which is terrifying. And why it's all the more important for us to take a thorough accounting of trump's many abuse of power last week for example we learned to be yet another shocking scandal that trump. doj's sought the private communication records of democrats. Who are investigating the president. This is the headline tonight and the new york times hunting leaks. Trump officials focused on democrats in congress meaning members of congress who are democrats quote as the justice department investigated who was behind leaks of classified information early. In the trump administration. It took a highly unusual step. Prosecutors subpoenaed apple company apple for data from the accounts of at least two democratic members of congress on the house intelligence committee and staffers and family members. One of those family members was a child a minor according to committee officials and two other people briefed on the inquiry all told the records of at least a dozen people tied to the intelligence committee were seized in two thousand seventeen in early twenty eighteen including the records of congressman. Adam schiff of california. Who was then the top democrat on the house intelligence committee who is now the chairman of that committee prosecutors under the beleaguered trump attorney general. Jeff sessions were hunting for the sources behind news media reports about contacts between trump associates and russia. Every time you think we're done with trump scandals there's a new bombshell forty years from now it'll be sitting at this desk with long grey hair tied back and one of those cool old man buns of cataract glasses and don't cushion talking about the latest trump scandal. Like how cnn is reporting the president trump or the space force to nuke every dog in the country and then for the rest of the show in. I'll just play backgammon. While he holds up a cue card reading is the. I'm boiling and yet somehow. All of the major justice department leaders during trump's tenure are now claiming they had no idea any of this was happening. Trump's department of justice asked the company for data about democrats reporters and now we have these details about members of his own administration but the people in charge at the time. Bill barr jeff sessions and rod rosenstein all reportedly say it didn't know about it. Sure guys none you know about it. They're talking about the united states department of justice which they ran lay. Cvs employees when you ask if they sell claritin and never heard of it. But you work here right. I'm in maybe it says. Cvs staff on your shirt. Oh no it's a barbecue joint downtown. Which also do not work. This is why house. Democrats need to start issuing subpoenas and conducting a thorough investigation to find out who knew what when i mean how going to be possible that none of these guys were aware what was happening. Justice department spies on senior house. Democrats investigating the president. No one at the top knows about it. These guys are acting like park slope parents who let their kids lose to the playground without supervision. Excuse me your son just pushed my kid off a swing. Oh did he. Juniper juniper what do we say about physical aggression it's a manifestation of our subconscious impulses. Juniper juniper knock it off or i will take you out of this world so sorry i should not have had that second macho and look bark can say what he wants but we have no reason to believe him given that he's a proven liar. Covered up the muller report and clearly at something he was trying to high during this suspicious. Exchange then-senator kamala harris in two thousand nineteen. Has the president or anyone at the white house ever asked or suggested that you open an investigation of anyone. Yes or no police are the president or anybody else seems to remember something like that and be able to tell us. Yeah but i'm trying to grapple with the word suggest. I mean there have been discussions of matters out there that they have not asked me to an investigation. Perhaps they've suggested. I don't know i wouldn't say suggests. I dunno inferred based on those answers he'd make a hell of a cvs employ when someone like that. The answer is yes we ask. Your co workers. Seven eleven brad. Did you take the slashing machine. And he says mom. I'm trying to grapple with the word. Take then i gotta be honest. Even with the employee discount. I'd pass on getting that slushy. Also you can tell knew something was up. That whole exchange is like one of those viral videos or someone scolds a dog that just torso pieces there. Bubbling party is not only trying to rewrite the history of the trump era. They've made it clear that if they make it back into power they'll repeat it which is why it's all the more important to hold trump and his cronies accountable for the many abuses of power subpoenaed them put them under oath and grill them in full view of the public and just to make it clear that they're under pressure. "What an exhausting week. What an exhausting time. What an exhausting year. What exhausting five years. Wow willie a lot packed into that week a year ago. Gee there was there was but for all the horrors that were laid out there. The one that gets for president trump. The most is the ramp at west point. He will never let that go. He will never stop explaining what really happened that day. Cova did the rampant west point. That's the one that really gets them in that litany of awful moments last year boyd. There were alive. And what about joe biden's prediction that donald trump is you know tried to steal the election and then the shock outrage all my god. How dare he. He's lost his more wilson. of course. that's exactly what happened yeah. He predicted that. President biden did back in june as the as the soon to be nominee of the democratic party and unfortunately that all came to pass as we saw in the last clip from january. Six okay. I won't have anymore halting questions. You willie white up. Just bring in the. Bbc's katty kay meek as the morning off a lucky her and we're gonna be starting willie with this new report on just how four. The trump justice department went. And my god seems like they cross some real boundaries. Here right yes. This is an extraordinary story looking into leaks connected to the russia investigation from attorney general bar and the justice department. According to the new york. Times the justice department i under jeff sessions subpoenaed apple in two thousand seventeen in early twenty eighteen for the data of at least a dozen people tied to the house. Intelligence committee including the top democrat. Adam schiff democratic congressman. Eric swale will also confirms to. Nbc news his records were seized the times reports. The records of aids and family members of those connected to the committee also were collected including those of a minor. No evidence was ever found tying the committee to the leaks but that did not stop. Trump's next attorney general william barr from reviving the investigation year later the times citing three sources reports bar recruited about a half dozen investigators to work on that case after years of nothing to show for that investigation the times reports. Some in the department began to see it as politically motivated. You think bar declined to comment. As did the biden. Justice department congressman adam. Schiff now was calling on the agency's inspector general to investigate that is i think it terrible. Abuse of power. violates the separation of powers But it also makes the department of justice just a fully owned subsidiary of the president's personal legal interest and political interests Does such damage to the department. So it's extraordinary. Maybe unprecedented or the department to seek records like this of a member of congress or staff of a member of congress or staff of a committee to do so in a partisan way to do so when they're investigating him do so openly calling on his department. It's hard to express just how shocking an abuse of power. This really is so joe what you have here. And we're gonna talk to michael schmidt in just a moment one of the reporters for the new york times on. This is the former attorneys general. Jeff sessions and then william bar basically assembling a cavalry to go and look inside the intelligence to see who they thought might be leaking stories to outlets like the new york times and using subpoena power to do so. This seems awfully extraordinary. This news we're waking up to this morning and perhaps it's happened before. And maybe maybe those those examples just aren't coming to mind but here you have an administration and the parallel with the clip that we played coming in where you had people shocked and stunned. The joe biden suggested that donald trump is going to try to steal the election. If things didn't go his way of course that's exactly what happened here. You actually had donald trump and everybody around trump all of his defenders screaming and howling. About how the quote deep state had been spying on them during the transition at the same time. They're literally spying on members of the press they're spying on partisan political opponents and this is what this one seems seems new to me spying on political rivals in another branch of government. I mean there's a reason why we have three separate branches of government and and there are checks and balances and so you actually have donald trump's white house donald trump's justice department spying on a separate branch of government fed's conducting its oversight role in investigating the executive branch. And like. I said maybe this has happened before. I don't remember this ever happening. If it has happened it's we're we don't want to engage in and being too melodramatic here but my god. It just seems to me that this is an extraordinary breach it is it is a constitutional constitutionally challenging event again when an executive ranch spy on a legislative branch committee. That's doing investigations and oversight on that president. Let's bring in one of the reporters of this story new york times reporter and msnbc national security analyst. Michael smith he's the author of the great book. Donald trump versus united states inside the struggle to stop a president and we should note that michael was one of the several new york times reporters who had his own record subpoenaed by the trump justice department. So so michael. We obviously last week expressed concerns about you and other members of the press Having their record sifted through by government agencies on leak investigations that had happened before. It's happened before it happened. Also during the obama administration they were very aggressive. I'm trying to remember though whether we've ever had a president and his administration spy on members. I'm sure if nixon didn't do it he certainly thought about it specially spy and sees the records of opponents from another ranch. There was investigating that president and his administration. It seems like this extraordinarily dangerous. And i knew i again. I i'm sort of stammering around this morning because I think this is new territory. I think you're right. And as we found in our reporting we could not find a similar example of this in recent memory. Now this could have happened in a leak case that we don't know about. There are lots of leaks that are investigated and there are lots of tactics that are used in them so in an another matter. Sure maybe this did happen. But we certainly didn't find out about it. So that sets this apart you're right. It is different than the subpoenas that we've seen over the years for reporters phone records by the way a tactic. Now that the biden justice department says they will not follow even though they were following it up until about a week ago. The thing i think that also sets this apart certainly in terms of congress is that this is exactly what trump wanted. And this is exactly why presidents are counseled not to talk about ongoing investigations. Or about how. The powers of the justice department should be used. Because if something like this were to come out the first instinct of everyone is to say well. That's exactly what donald trump who was the president who was the person who could put whoever he wanted at the justice department. Who at the time was putting all of his pressure on that justice department. You have to remember. This is two thousand seventeen twenty. Eighteen trump is very angry about the muller investigation. Sessions and rosenstein are afraid. They're going to get fired at any turn. Because they're trying rosenstein and saying he's trying to protect muller muller investigation and it is in that atmosphere that this happens that the justice department takes his extraordinary action to pull the go to apple and get the records. The the data and information icloud information for one of the president's chief rivals the staff of that rival and a child for the for the for one of the staff members..

They leaked it to the papers and as usual. They investigate adam schiff but leaking that information. He should not be leaked information. Out of a delicate data investigate added and they say trump was famous for projecting more on our breaking news tonight among the details. We are learning from this new york times re reporting on these secret subpoenas of congressional records by the trump doj quote prosecutors under the beleaguered attorney. General jeff sessions. I'm convinced that's now part of his title. Were hunting for the sources behind news media reports about contacts between trump associates and russia. Paper goes on to say by the way when sessions left bill barr revived the investigation. So lots to talk about. We've got the guys to do it back with us again tonight. James carville veteran democratic strategist who rose to national fame with the clinton presidential effort co host of the politics war room podcast and the most famous man in bay saint louis mississippi michael steele back with us former chairman of the republican national committee former lieutenant governor of the great state of maryland. Also the host of the michael steele podcast. Okay james your reaction to tonight's lead story. I was watching a basketball game so on your program to top of the hour. And when i saw it i couldn't believe i mean i just couldn't believe you know not saw and they were all knowledgeable and think everybody's liking in disbelief. That trump would do such a thing but that the justice department be involved up to the neck. And i touch the book a on time but i'm surprised analysts you digital approval for something like this. I mean comedies. To look at this this war it can go around. Willy nilly and subpoenaed phone records a members of congress. I'm just trying to digest and o'brien overwhelmed by. I'll be honest with you. I understand well. That's why you watch basketball games. Because sometimes the news is Overwhelming around here and michael. I want to ask what you expect to hear from republicans. After i say this i heard from a a prominent democrat tonight after this news broke. Who wanted me to say the democrats should expect nothing. Zero from this politically. Both lanes will stay as they are. They shouldn't play Vcu station They they shouldn't a look for sympathy. This is going to move no one though it will trigger hearings and probably dictate the next couple of months of our lives having said that. Should we expect that trump base to say well if our president or if if bar did it if sessions did it. It must have been justified. Well yeah they'll say that that's that's a given. They'll say that. What you will hear from mcconnell mccarthy i wish you had a cricket sound that you play right now because that's exactly what you hear crickets. They will have nothing to say about this. They will not have anything to opine on about the utter corruption of the justice department. The the the crap stain of trumpism that is infected every organ as we're going to find out it of government and so there is nothing they're going to say about it because they don't want to deal with it remember. This is the same crowd that said nothing about january. Six other except that it was a tourist attraction. So you don't expect them to come to the table the way my friend mr kabul has with the shock and it was like why are you kidding me this what but so. Yeah there will be investigations. And i think that democratic strategists is right this. There's no way for the democrats really play this. Let the process unfold. Let more information Revelatory information come out and and and the country will absorb it as they do everything else but to try to say something about it from the democratic side is just going to be you know. Pinned as a political and the republicans aren't going to say anything so it is very much sort of status quo and it will flow the way it will james carville because when you talk i listen i heard you on. Shall we say another network tonight talking about the mathematics in the us. Senate and during acquaint earlier time around like seven o'clock eastern time tonight. We thought we'd be talking mostly biden's overseas trip and infrastructure here tonight so i'll go there on infrastructure The point you make has no counterpoint. The math doesn't work out very well for the democrats and sixty votes senate but we did see these ten senators today from both parties including some steady and prominent names getting together on this democrats. No they don't have the mathematics. They know they don't have the noses but they also know states love infrastructure. Most of them by it's given name jobs programs. Everyone loves a job program. And the resulting better airport bridge and highway. That comes of it. Well first of all the public expects to try all right if it looks like. We're trying harder and they won't do anything. Didn't the public more water that there in kind of a tight spot too because you're right. He's infrastructure program. Jobs programs emma staying. How a system and olive right things that we did this country before popular very popular to public it so much tight spots and democrats in the had the by the republicans are in a tight spot also and too many democrats are carpeting. Not even five months. Remember what mitch. Mcconnell calls the long game will the democrats digitally trying to say why wouldn't do something yesterday. We're not setting us up for the long game long game right now. Setting this thing up with twenty twenty two and there will be consequences for the republicans if they don't appear to be trying to do something and i think we should play is. The politics of this is hard in his talk is we can possibly play at nasa special. The president biden's he's doing right now. Opiates michael steele wants. Potential fallout for joe biden and sixty seconds or less. Look doing nothing James's point this absolutely playing soft politics business hardball mcconnell and and the republicans are playing this to the edge. They they know at least they're calculation..

Judge Orders Release of DOJ Memo Justifying Not Prosecuting Trump
"Judge in dc ordered the justice department to release a document that they've been trying to keep secret for years. Now it's the document. The justice department drew up to justify not bringing criminal charges against then president donald trump for obstruction of justice. Judge amy berman jackson and her blistering ruling this week said that trump attorney general bill barr and other trump justice department officials had essentially lied to the public and lied to the court about bars decision. That trump wouldn't be prosecuted despite the muller investigation laying out more than ten potentially criminal instances in which the president acted to obstruct the investigation into russia. Interfering in the two thousand sixteen election to help trump win the presidency of the justice department is under very very very new management. It's going to be interesting to see if the justice department. Now under attorney-general merrick garland follows judge jackson's ruling and releases document about not prosecuting trump. Or will they appeal to continue the trump justice department's efforts to keep that documents secret. The clock is ticking. On that we've been watching this every day. Now because they've got less than two weeks to either file that appeal or let that document see the light of day and in either case it's to be a really big deal. If we do see that document and as the judge hinted in her ruling it turns out that bar and the trump justice department never substantively considered the evidence evidence against trump if it turns out the evidence that trump committed obstruction was just ignored. Well that puts a very hot potato. In the lap of the new justice department leadership under president biden as to whether they might pursue those charges against trump nail

Almost says state health officials complied with the federal probe, but he acknowledges the damage of keeping the data hidden. The void we created by not providing information was filled with skepticism and cynicism and conspiracy theories. Which furthered the confusion. And instead of the Lincoln Project, the new company is named Politic ology. So that's what these guys are doing. And that's what they're up to. Okay, let me grab that. Let me grab Paul here in Tucson, Arizona. Welcome, sir. Great to have you with us. Hi. They rush. Thanks for taking the call. Yeah. Prayers and appreciation for everything you do. Thank you, sir. You know, last week you were talking about Republicans not being able to are not knowing how to use power when they've got it. And now we see the Democrats. You're taking care of all these lawbreakers or participating in the coup. One thing I've been frustrated for four years about and I know you have two basic question. Why did Trump Allow that Trump FBI and the Trump Justice Department to go after Trump people and put Trump people in jail on B and therefore beyond the defensive. His entire administration in the media. I've tried to explain the details of the coup that you brought out other conservative talk, so people were brought out all the e mails. Everything. My my Democrat, friends and relatives even Respond by saying Well, if it's the Democrats sitter so corrupt, why are the Republicans of one's going to jail? I don't understand why Trump Allowed this to happen. The presidency. Control the in administration. Okay, I'm gonna tell you something. Let me answer your question. You may not believe the answer. Trump may have been the only one who didn't know And the reason that Trump didn't know is because he just couldn't Accepted. He it is your president, United States. You've offered administration jobs to a number of people. You can't You don't believe every damn one of them is corrupt and is working against you. But I'm telling you that he I think they mishandled this thing from the get go. I think it was illegitimate from the get go, but they didn't treat it that way. They treated it as a legitimate investigation. They allowed the premise of this to be set by Mueller and Comey and Obama and inviting and Brennan and Clapper and all that. And the premise was that Trump was a legitimate that he had stolen the election work for this. Oh, that's become what everybody discusses. Trump should never have allowed that. Become the premise but went once that happened, then the whole thing that nobody's arguing about is a is a gigantic hole in the wall. There's nothing there. And yet everybody is talking about it and trying to win points and persuade people based on that. Right. But the answer. It was never trumps FBI. It was the other FBI that was doing what they were doing. And Trump didn't didn't think that such a thing was possible. He didn't think that such an opposition Could be so massive and in scale. Right? No. Yeah, the whole time I watched I thought Could have turned it around me even used the phrase dirty cops and witch hunt. The only way he narrative around Was to have his people investigate the other side and actually But even even that investigator Durham Yeah, During knows every everybody involved in this new from the beginning that it was For lack of a better word. A hoax. It was all made up. Everybody involved knew it. Look, I've got I appreciate the call there. Two answers here. The first one is the answer. I just gave you About the competition in America. Today is the elites versus the middle class. Everybody has suspected for the life of America that the elites Welcome the middle class that the elites they might have made fun of him, and they might have scored in the minimum. But everybody understood that in the American economic system, you need a middle class. That's where the majority the money is in total. And and and the fact that everybody in the middle classes, starting small businesses and hiring people, that's good for the country. That's not the case anymore. The middle class is the target. And look at what? Look at what the deep state Has secured. They own the media. They own Hollywood. They own big tech. They own education. They own popular culture. In their view, they've won, in their view they own ever. There's no reason now to need the middle class. There's no reason to put on airs or to act like you care about people in the middle class because they think They've essentially Succeeded in controlling Everybody in the middle class. They think they've won. That's why they're going to do everything they can to make sure future elections are irrelevant. So the second answer to this Uh, is that everybody involved in this whole thing knew it was bogus and made up from the beginning..
