"Knew that today would come Sarah how was it that one of the men was given an opportunity for parole but two of the others weren't What was different about his case Right so two of the three men Travis mcmichael and his father Greg mcmichael were sentenced to life without possibility of parole The third William roddy Bryan was also sentenced to life but with the possibility of parole Now prosecutor Linda described the mcmichaels the father and son as lacking remorse and she told the judge that Greg mcmichaels was involved in a Lee last year of a video documenting the killing He believed that that video showed he and his son were not guilty of anything That's two months afterwards The state's position is he hasn't changed his mind The state's position is he and his son still believe they didn't do anything wrong And that is a lack of remorse or empathy Ultimately the judge granted the state's request no possibility of parole for the Michaels but for Brian the judge said he believed some of the evidence suggests that Brian was in a slightly different category perhaps understood what he'd done was wrong So he will have a chance for parole in 30 years even so Brian is in his 50s so he could still be in prison for the rest of his life In this case All three men have a right to appeal the verdict and the sentence Brian's attorney for example has already signaled early in the hearing yesterday that he's preparing one and this case will come before another court soon the federal government is bringing hate crime charges against these men That trial is scheduled to begin next month A civil rights activists are promising to keep pressure on authorities to hold these men fully accountable for ahmaud.

"Dot com and schedule your free estimate today It's four 11 A jury in southeast Georgia has found Travis mcmichael his father Greg mcmichael and their neighbor William roddy Bryan guilty of murdering ahmaud Arbery an unarmed black man who had been jogging through a neighborhood in Brunswick when he was chased and shot to death The defendants say they suspected Arbery of burglaries Travis mcmichael claimed he shot Arbery in self defense The trial became part of a larger national reckoning on racial injustice Veronica waters covered the trial from start to finish for WSB radio in Atlanta She spoke with WTF's Sean and Mike about the trial I think that the defense lawyers in this case did an amazing job I mean you had some really skilled defense attorneys here The prosecution though said listen jury this claim of citizens arrest in self defense This was all made up for trial And she pointed to the defendant's own words that day that no one ever said they were trying to arrest them on Arbery no one ever brought up a citizen's arrest or made a claim of self defense until these men were indicted I think that she did a good job in sort of painting a picture for the jury about why the defense arguments did not hold water You can't claim self defense if you're the initial unprovoked aggressor And there would be no struggle over a shotgun as the defense said that there was if these men hadn't chased Arbery around for 5 minutes before that moment happened And so I was a little surprised because I have never been able to really predict what a jury is going to do And I was curious to see what the mix might be of guilty and not guilty verdicts was going to be as you know the shooter Travis mcmichael was convicted on all of the counts His father Greg convicted on 8 of the 9 their neighbor roddy Bryan convicted on 6 of the 9 but neither one of those latter two men was convicted of the malice murder counts That was the only one that stuck to Travis mcmichael And that means here in Georgia automatic life sentences when you're convicted of murder when they are sentenced judge Timothy Wong's leg will decide whether or not they have the possibility for parole Can you talk a bit about how the city prepared for the verdict when it comes to maybe police presence and just around the heaping the security outside this courthouse What I know is that preparations had been put in place even before the trial started as we were on the eve of jury selection we knew that there had been a meeting in the city There were lots of officers on call We saw it outside the courthouse State patrol members out there Everybody ready to keep the peace of course they knew that something could happen although I do want to note that there had never been any violence or destruction in Glenn county since the killing of ahmaud Arbery demonstrations have been loud and forceful but they have not been destructive or violent But just in case there were preparations in Atlanta even as people prepared for whatever this verdict might bring But we did hear from a lawyer for the arbor family as well as from Arbery's father himself Marcus Arbery He said we want this jury to come back with a verdict in an honest way He was trying to say we don't want anybody to intimidate them as one of the defense attorneys kept saying about the black passage in the courtroom This might influence the jury to vote one way or the other We want them to go and convict based on the evidence which we believe that there is to convict these men And I think that's what happened The border of Veronica waters from WSB radio in Atlanta in conversation with WTF's Sean and Mike coming up on Public schools without librarians a problem the D.C. council's working on I'm Michelle marello Sports next Is always on even when your car isn't Download the app to listen live.

"On the third day of deliberations as the first of the 27 verdicts were read and the judge said guilty Arbery's father Marcus loudly cheered in the courtroom CBS News special reports I'm Steve futterman Glenn ivy is a former prince Georges county state's attorney He's also been a defense attorney He spoke with W TOP's Dmitri and Dell about the verdicts what surprised him and what he expected It's fairly thoughtful verdict I thought So they didn't just convict on all things or acquit on all things They convicted on all 9 counts for Travis mcmichael who was the shooter But they also differentiated between that mcmichael and his father They didn't convict him of the malice murder charge And then for the individual that had the camera they acquitted him on four counts but convicted him on the other So it looked like they put a lot of time and effort into sorting through the evidence and applying the law You talked about roddy Bryan the man who made the video of the episode did you think that perhaps he would not serve any prison time or be convicted on fewer counts Well I did think he would be convicted on fewer counts I was concerned frankly that he might be acquitted entirely I was pleasantly surprised to see that he was convicted But I think you raised a good point sentencing still coming And I do think mister Brian's attorneys are going to make a strong pits that he should be sentenced in a much more lenient way certainly than Travis mcmichael who was the shooter Lots of people trying to make sense of this case just a pose against the case of teen Kyle rittenhouse and Wisconsin your thoughts Yeah I mean it's been a whip saw week from the standpoint of those two cases and you throw in the Charlottesville civil case against the neo Nazis as well but you know I think the point here was the jury felt that there was strong evidence that these three men with two firearms chasing one man who was unarmed And it's hard to make a self defense claim that's viable out of that So I thought the jury came out right here I had some differences with the rittenhouse verdict especially with some of the judges rulings but the concern I have out of the two of these cases combined Let me say it this way is that I'm worried about whether the country is on the right track with respect to finding justice in these cases I'm pleased with this case The harbor case certainly Derek Chauvin over the summer But you're really kind of come down to do you have to have video of clearer evidence of guilt in order to get a conviction in these cases I think that's a concern we're going to have going forward If George Floyd was about serious problems in American policing what about this case in terms of a person of color going about his life still being in danger for doing what we would call routine things That's the tossed up between this case and written house You know sort of the vigilante approach that many citizens seem to want to take especially with respect to black males but not solely is one of the challenges The other issue that came up in the rittenhouse case I thought was if you're in a situation where there's an active shooter what are you supposed to do Because the two people who were shot second after the first individual that's what they thought was happening They thought this was an active shooter case We've been telling people to try and defend yourselves and disarm the shooter But one of those men was killed another one was injured trying to do that So you know we've got unclear messages coming out of this week We've got a lot of work to do in this country but hopefully we can move it in the right direction Former prince George's county state's attorney Glenn ivy coming up on Public schools without librarians a problem that D.C. councils working on I'm Michelle Morello sports next to 14 WTO P and silver diner now bring you free lunch Friday for friends and family to thank you for listening to three winners every Friday Good for dine in carry out a curbside pickup Your choice Enter today at WTO P dot com search free lunch Sports at 15 and 45 powered by Red River technology decisions aren't black and white Think red Mount a rob wood for the capitals had a triumphant return home from their West Coast road trip scoring early and often to beat the Montreal Canadiens 6 to three coach Peter lavia led sums it up We got it out got it through and got it in and if that meant wouldn't it behind him in four check and that worked really well I thought we got away from him a little bit in the second period and if you come through the neutral zone you're not taking care of the pocket comes back pretty quick for the first period was excellent And I thought we got back to it a little bit in the third period and able to push more but the second period was just you know we just kind of shot ourselves in.

"Courtroom the three white men charged in the death of ahmaud Arbery were found guilty of murder After deliberating for about ten hours the nearly all white jury found Greg mcmichael his son Travis mcmichael and their neighbor William roddy Bryan guilty of nearly all the criminal counts they faced Civil rights attorney and former prosecutor Charles colman junior is here to talk more about it Welcome back to the program So glad to be here Thank you for having me Is this a case where people could see the verdict coming meaning what do we know about how the prosecutors laid things out that brought us to this point Well I don't think that we can ever see a verdict coming I don't want us to take for granted any verdict because everyone is always going to see some things differently And so the fact that they arrived at this verdict together was a testament to how clearly the prosecution was able to lay out their case to walk the jury through the charges one by one for east defendant and to connect each of the defendant's actions to the specific things that they were charged for and allow the jury to make a very pinpointed very clear decision which is what we saw and why we have the verdict that we do To get into the detail of that you have Greg mcmichael Travis mcmichael and roddy Bryan their neighbor who actually filmed this killing Can you talk about what their defense was that in a way has been rejected by the jury It was heavily on self defense That was the idea the idea was that this was something that they did out of fear for their lives For mister Brian the argument that his attorney attempted to advance was his client didn't have knowledge that the mcmichaels intended to do whatever it was that they intended to do But that his client should not have been held accountable because his role overall was minimal The jury did not buy either of those things I suspect with respect to the mcmichaels the provocation was just so great that it's very difficult to overcome it with a claim of self defense In the case of mister Bryan they did not convict him on the murder with malice basically They convicted William Ronny Bryant of what's called felony murder So what I see when I look at this verdict tells me that the jury was very careful to look at the specific charges and wanted to make sure that they got it right So the jury rejected the idea that their actions that day were somehow self defense and now I understand that the three still face federal hate crime charges So how does this set up that next case Well it's just up the basics I think this notion of a citizen's arrest which is also what the mcmichaels attempted to advance as part of their initial decision of defense before they switched gears Mid trial All of those things have been blown out of the water I think that we are likely going to hear during the federal civil rights prosecution of this case a greater deal around race I believe there was some conversation about the Internet search history of mister mister Bryan the use of the racial epithets as well as I think the presence of confederate flag on I believe the mcmichael's truck All of those are types of things that will add substance to some of the other elements of this crime but it remains to be seen what's going to happen once this interesting into the federal courts How do you think about this case in terms of its victim What does this moment mean to you as someone who watches these things closely Well I think if you're very important moment for about Aubrey I think it's important moment for his family and loved ones I do hope that they receive some sense of closure but in the larger scale of things it still is one that should cause concern And the reason why it should cause concern is because as that verdict was right today there were legions of Americans who held their breath We as a country can not rest until that feeling of needing to hold our breath to ensure that the justice system works as it is supposed to no longer exist And so it's important that we do not conflate the notion of justice for the accountability Justice unfortunately for our arbor he's out of reach because he's no longer with us and can never be made whole But accountability is what we saw today in that courtroom And I submit that that's a good first step That civil rights attorney and former prosecutor Charles Coleman thank you for your time Thank you so much.

"You are one of these people who just some of these people Nick they didn't even really know what was going on did they just sort of the gates open The doors were open They're like cool we get to go into the capitol and now they're sitting in prison cells for it It is grossly offensive and you're right It is chilling You compare this to how the FBI and the DOJ is labeling angry parents as domestic terrorists and you're absolutely right Their goal is to chill our opposition to what they're doing Yeah and you know sadly it is working up to this point I mean I don't know how many people that we contacted who said you know I'm afraid to talk I don't want to tell my story because I'm afraid of repercussions And even in some cases we did interviews with people who didn't afterwards called us up and said in my lawyer said take me out So they were afraid to stand up to the government because the government has them over a barrel Most of these people are middle class people who own their own businesses who don't have a $100,000 to mount a vigorous legal defense So they wind up with these court appointed attorneys out of Washington D.C. who are basically working for the government They're not working for their clients They're trying to get their clients to cop to a plea deal by telling them look if you go to a jury trial you might get 30 years But if you clean guilty this one little felony You can do 6 months and you can get on with your life even though you've been won't be able to vote or ever own a firearm but still And see that's what that's what's happening to these people They are being railroaded by the FBI and the Department of Justice because they don't have the means to fight back

"The closing arguments today wrapped up kind of what stuck out with you What was a message to jurors Prosecutor Linda Dana koski delivered a very forceful rebuttal Some of the strongest language that she's really used talking about the credibility of some of the witnesses from the defense especially Travis mcmichael himself making the point that Travis mcmichael has changed his story from day one None of the mcmichaels or roddy Bryan used words like you know we were trying to effectuate a citizen's arrest that day in their first statements to police now that's not legally required They have formed a very compelling legal argument since acting rashly on the day in question I understand too there were some moments that really especially got to ahmaud Arbery's mother Yeah I think this mother more than a mods mother but she did in fact leave the courtroom during defense attorney Laura hopes statement yesterday She said basically over and over again that Ahmad Arbery was in fact committing burglary on the occasions that he had stopped by the House under construction and satilla shores And as she's describing that she sort of chooses to describe a mods long legs and long dirty toenails And it was a moment that like I said I think more than just a mod's mother heard and sort of felt was a line too far Any idea of the effect of those closing arguments when you think about situations like that and then you think about what the prosecution said today do you think any of that is mind changing see if you were a juror I think that for whoever wanted to hear a sympathetic argument for the mcmichaels and roddy Bryan That was there That was displayed So if anyone finds those defendants stories to be credible I mean we will see we'll see some acquittals potentially There is a lot of talk that especially for William roddy Bryan that murder charge may be hard to stick on Because of you know if you believe him he was late to the scene so to speak he did not know as he claims that the mcmichaels were armed and that he would even be part of this in the way that he was Your sense of what the feeling is in Brunswick if one or all of the defendants is acquitted That's a good question I don't think we've heard much from the family members about how would you feel if roddy Bryan were to get off and maybe the Michaels didn't What I know is that the prosecutor's argument in this case has been that all three elements from all three of the defendants were necessary in order to get to the place where ahmaud Arbery got shot What that means is that without roddy Bryant's truck sort of blocking the path and some say forcing ahmaud Arbery into a ditch off of the road without that he wouldn't have turned back around and headed in the direction where Travis mcmichael and his father were on Outside of the courtroom Melissa in Brunswick what was the mood today as those arguments wrapped up and the case went to the jury I think the mood today was very quiet I think there's a sense that everything that has been done and everything that could have been brought up has been brought up and you know we asked Arbery's family about did they feel like the prosecutor did her best work today And they felt confident that we're going to have a guilty verdict We shall see We shall W a belisa Hagen in Brunswick for us Lisa thank you so much for the update Thanks Jim And an update now on the traffic.

Our george gregory mcmichael travis mcmichael and william bryan bryan is a guy who joined in the chase and filled it halfway through the charges that are being charged with our malice murder felony murder two counts of aggravated assault and one count of false imprisonment more on that in a moment that the defense is arguing that the mcmichael thought that aubrey was responsible for a series of burglaries. That had occurred in the neighborhood and they were trying to detain are under georgia's citizens arrest lol and only resorted to violence. When aubrey fought over the possession of the gun georgia's since repealed that citizens wrestle and the prosecution is basically arguing that aubrey was jogging had no connection to the burglaries and at the killings. Were racially motivated. Now to that point about it being racially motivated the there is a federal charge that all three have been indicted force. Federal hate crime interference with the rights with his rights which is specifically claiming that the defendants use force and threats of force to intimidate and interfere with aubrey's rights to use a public street because of his race. And i think that is why this story is going to be probably one of the biggest most vices stories that we have seen in cases trials and stories that we've seen in a very long time because they have been wanting to kind of code of codify hate crimes koto fai hate in a specific language specific profile. We see it on facebook. They want to regulate the ai to track down. What specifically hate is on facebook. We see it with this new framing of what a domestic terrorist is which is basically somebody who might have gone to the capital on january six. Everything that's been going on the past couple of years has had that hate theme woven into it and this case right here they have a winner. I think they they have what public relations wise can be easily portrayed as three dudes who may very well be racist driving around the neighborhood and then ultimately killing a black guy. Who was they say just jogging. Now there's a lot of complex said this thing about the stories is very complicated but it won't be presented as very complicated a lot of the complicated stuff. They're trying to get removed from the trial..

"travis mcmichael" Discussed on Buried Truths
"Is being able to admit he won't call it evidence or information about a aubrey's pass and it was ruled that that cannot play a role in this trial. What was the defense hoping to be able to garner with that. If it would have been allowed well. I think a couple of things rose i think number one. They wanted to let the jury had the impression that may be ahmad. Armory was not just innocently out for a jog that day that he was a perhaps going to get into some trouble. He was trying to break into this house under construction. The idea is to suggest to the jury. He's not squeaky clean. And you shouldn't treat him as somebody who's completely innocent in any of this. The second issue of course and even more importantly is to suggest that there was a legitimate reason for the mcmichael's to pursue him a aubrey and to try to detain him. That day i mean that's going to be the entire defense. I've heard their lawyers speaking the media. I know their lawyers well. And they're going to rely on the defense of citizens arrest in this case and for them to do that. They have to be able to suggest to the jury. There was a need for an arrest and so his past from the defense side is relevant to show that he could have been engaged in criminal activity at that time. Hank what do you want to follow up with. What pay just talked about unless something happens in the court in which the judge himself says you know he knows the statute and the the the statute says that the people who are imposing the citizens arrest have to actually witness the the felonious activity and that there's been no suggestion that the mcmichael's or roddy. Brian saw anything that went on inside the house. And unless he throws it out. That'll become an argument for the lawyers during during the trial rose. I'd like to go back on one thing for my having to do with the fact that the defense cannot now bring in ahmad arbor's pass record. Not only does it take out a huge you know the the fangs from their defense. I think but it. It shifts their responsibility. Now to elevate the people who are on trial and to overcome what we know will be. The prosecution claim that they act with racist intent and they we know from the preliminary hearing. They have several examples. Particularly of travis mcmichael and roddy brian using racist terminology semi racist text messages or instagram postings and things such as that but we also know from the motions that they filed at the bond hearing that is they being the defense attorneys that they have a case they want to make. These guys are not racist and they have commendations from people that which they tried to save the life of a black man or they have One of travis mcmichael's coastguard roommates Who is african american saying. He is a fine person. he's a good guy. I've never seen that kind of behavior or heard that kind of language from him. So that's gonna be a point of contention. I think at trial particularly now that they cannot elevate the the ahmad arbor's past and i say they can't they will be able to and page knows is better than i should the prosecution slip up and some way and open the door to that. Correct me if i'm wrong. Gentlemen there are reports. That one of the mcmichael's used the inward either directly after the shooting or as aubrey was or was is that hearsay. No that's it was roddy. Brian apparently said that however That that he heard. Travis mcmichael say it as a moderate is lying on the ground and frankly he could've even still been alive and and he uses the n..

that video that just horrific video that shows him being shot and killed the moment that doomed the guy who did the shooting I think was the father of whom is actually did the the shot yeah Obree it was that he didn't turn around and look back shoots in that final shot if you've seen the video you can see it Akhmed then takes a couple of steps and collapses and the guy never turns around looks at him like oh my god what just happened right I just do right what what have I done I just took a man's life right there's no at least on the radio livor there's no indication while United that didn't occur to me when I saw that he knew that that was the fatal shot wow and that does that mean those guys plus this it turns out that the the guy who was a DA investigator the father of the father and son duo was the DA's office investigator for sometime and I'm assuming in Georgia that still means what it what it would mean here in in California is a sworn peace officers sworn law enforcement officer and that he had dealt with that kid before when he was a high school student and then some other case later on so I don't know if there was enough for him to recognize Akhmed armory as he ran down the street like he knew who that was or if it was just that that could match the description of a burglar suspect burglary suspect in the area yeah all right well it looks like Hollywood as the LA times put it has been preparing us for this moment for decades they talk about all of the movies slight gap Pacific liner from nineteen thirty nine about the chaos that ensues when a cholera infected man stows away on a cruise ship bound for San Francisco that sounds familiar doesn't it as the disease spreads among the working man in the boiler room the paying passengers party on as usual tough guy refuses to believe that anything that he can't see can't hurt him by the time the doctor is proven right it is almost too late so in other words all of these debates that were having they've been having since nineteen thirty nine well it isn't a part part of the story telling like this is that we want to see who's going to emerge as the sort of unknown hero or the the unexpected hero in a story like this we see it play out in regular everyday life I mean the the people that we would take for granted doctors and nurses paramedics first responders are being considered the heroes for deep you know rushing headlong into this end of this pandemic to take care of other people in nineteen seventy one audiences went to see the Andromeda strain Andromeda Andromeda skews me an adaptation of a that was the Ebola one yeah back based on the nonfiction bestseller the hot zone again we're seeing big hit best seller we have this appetite for these stories that we thought would never happen right
