Why Ken Paxton Set Up Texas's Cold Case and Missing Persons Unit
"I'm back with attorney general of Texas, Ken Paxton. Ken, let's pivot to this new project or new thing you've set up. It's the cold case and missing persons unit. Talk about why you set it up and then let's talk about a specific case in which which I think is really quite remarkable and also quite moving. But talk about first, why did you set up this unit? Yeah, so I set this up because I had heard from people around the state. They were frustrated, particular cases I could name of cases just not being solved. People not having the resources to solve and there's really no repository for these cases. And so we had a prosecutor leaving the Travis county DA's office who was going to be allowed to stay there anymore in prosecute because that's not what they do in Travis county anymore. So I hired her and I said, look, I don't have any real resources, the legislature and provide a, I want you to start this cold case unit. You have a passion for it. You know how to do it. Use the resources that we have existing and hopefully if you're successful and we can start solving some of these cases to provide justice for people, then we can have an opportunity maybe to increase the size and give you some more resources because there's literally thousands of unsolved cases in

Do we know you? You probably do. I recently retired for the Travis County Sheriff's Office just under two months ago. Gotcha. Yeah, that was terrible Supervisor. On the busiest shift the the Sheriff's Department has We respond to the progress calls quite frequently. As you can imagine the high priority calls like Homicide, the sexual assault the home break in that sort of thing, right and You know, it's incredibly frustrating for the troops on the street. Um, what we're seeing now. Are the consequences of the elections when you have a city council but often have like right now that people like Greg's are and all that kind of stuff from the council when you vote, Dia's and county attorneys in the office. To push their ideological mandates on law enforcement under the guise of holding law enforcement accountable. It's ridiculous. It's getting incredibly frustrating for the troops that are out there them extremely professional men and women. How long were you on the job? Darryl? How long were you on the job? I started my law enforcement career in 1990. Wow. Wow. Wow. And And why did you decide to retire? Well, when we start seeing Officers being indicted and criminally charged. For something like murder. In a justifiable law enforcement line of duty. Shoot him. Mhm. You have to know as a as a prosecutor. You have to know that many of these cases do not meet the elements of the offence like we're seeing most recently in a PD officer that was invited for two different murders. It doesn't meet the elements of the offense and the prosecutor has to know that going into it absolutely honest. I only believe that It's a targeted approach to killing Morales and law enforcement. When you know that there's a very high probability that a jury is not going to convict this officer. But yet a lot of folks still like, well if he didn't do anything wrong If it's not illegal, he'll be found not guilty. The trial no harm, no foul. That's incredibly not accurate. Um, I spent a couple years as a homicide detective. I've presented cases the grand jury's on sexual assaults, homicides, all kinds of felony offenses. And you've heard the old adage You can indict a ham sandwich? Yes, and it's absolutely true. The grand jury is going to come back with an indictment, whether it's a true bill or a no bill based on the information that's presented to them. But when they when that indictment comes down a high profile case, like an officer involved shooting where the officer has been indicted for murder. I can guarantee you that That's Going to probably run in the neighborhood of a quarter million dollars or more to defend himself to keep him from going to prison. Win, lose or draw That attorney bill comes due. And when you indict an officer knowing you have not met the elements of the offence for the offense, you're charging and and you're going to end up. You know, with a guilty verdict later on. The damage done to that officer for his life savings that he has saved up for his retirement. Um, my God, The damage is done. Not only did that officer and his family's financial future goodness, but the impact on morale for all those officers that worked with him who have mad even responded to the same call or similar calls with that same officer. Holy smokes. Can you imagine how many officers are not going to be running? Balls to the wall. To get to your call, knowing that that violent encounter that you're involved with some thug on the street. Could likely end up with that officer either being hurt or killed in the line of duty or worse yet being indicted Daryl, You're absolutely right. That the cases that you reference there. You're absolutely right. I've talked to people in the D A s office and they know they can't win these cases. They're just appeasing the voters of of our district attorney. This was a campaign promise. And basically what? Basically what? What The D A is saying he's more concerned about his votes, and he's willing to sacrifice the morale of public safety and is willing to destroy a few families lives along the journey as well. Absolutely, because there's no bigger feather in his cap. In my opinion, then then what he's doing right now there. Yeah, It's very tragic. It's affecting our public safety. Of course it is, well worse than that. It's infecting you. You feed you people who are or relying on those professional men and women to respond to your potential. Worst day of your life. Yeah. No, you're right is not improving the public safety about doing this for the law enforcement officer..

We are learning. Are we not Andy a whole lot about the United States Constitution. And the thing that I think strikes us the most. Is how brilliant the founding fathers were at determined all the things that could potentially happen and go wrong with the U. S electoral process. Way back in 17 70 whatever. It's just amazing. I said, Well, what's really amazing is how we've devised a system that we can nearly divide the country and I'm 50 50, even in 2000. And now, here in 2020. It just keeps happening. And it just shows that How our system does work. And I also think that yeah, we need to do everything we can to exhaust every remedy. They gave us to count every single vote. You know, it has gone beyond just Ah, vote between Donald Trump and Joe Biden. It's really become ah, whole character ex exercise on our system. Will the republic stand or will it fall? Yeah, well, I think we would have to take a lot more hits for the Republican actually fall. Although I do think this is ah, major major issue. Um, Also, before I say anything about Trump having a hard road ahead, I think again, every vote should be counted. But it is gonna be hard for an elephant to make the case. But what this has done is shown that republic isn't just, um, Federal Union and a bunch of a sub divisions we call states. It's a union of states and by carrying the votes. We found problems in every state and every county, and it's changed the outcome of congressional elections and a lot of local elections, so Spotlight on our whole electoral system has been great for our country. Do you think that's the hope right now is that we at least get to the bottom of you know where these problems exist and finally get them fixed is that Is that what we're going to try to do that? If nothing else out of all this Certainly here in Travis County, You know, normally we've got to beg and plead our faithful Toby, poll watchers or show up to central counting on Election night and during canvassing. It's a hard, hard pitch, but this year people were lining up to count. And what happened. Travis County is that we were about to sue the can. Travis County Elections division because they were not letting our counters actually watch the counting. We were stuck behind in an old break room behind the glass pane unable to communicate. I am unable to see the screen that the counters were looking at, and we sue Tioga get access to that. Fortunately, we reached an agreement and we were able to the Travis County Republican Party, too. Make sure that our counters air there to observe the entire process. That's a victory and, um, by way of a side note. Our electoral season ended on last Tuesday, and we got one conservative member on the Austin City Council now. I saw that, you know, and you had another one come fairly close. You had another Republican who lost by a couple 100 votes that was like the earth shaking there in Travis County, wasn't it? Now that's right. And you know, we can't be sure if they were enough irregularities going on to shift the election that we may have fixed that agreement, but one way or the other, the voters have greater confidence. That their vote counted and make no mistake. I got a lot of questions about people that live especially of the E T. J of the city that we're thinking. Well, they're not sure if I'm actually eligible to vote in District six or not. Our district tinnitus weren't sure. And I said, Well, test that provisional ballot and we've got people on the ground, watching to make sure that your provisional ballot is verified. And if you're eligible, your vote will be counted. And this is really the first time of able to say that with a lot of confidence because we actually have a fair number of people watching the system. Houston's Harris county first day of early voting sees massive turnout
"This year, there are a ton of registered voters in and around Austin this year just about every single person who is eligible to vote in Travis County where Austin has has registered to vote. County announced today that of the over eight hundred and fifty thousand eligible voters in that county ninety seven percent of them are now registered to vote ninety, seven percent registration. Of eligible voters. That's Austin Texas. Then there's Texas's largest city Houston. Harris County is home to Houston and they had absolutely massive turnout today for their first day of early voting. For years ago in two thousand Sixteen Harris. County had forty early voting sites. Texas counties still limited to one ballot drop-off spot for now, court says
"The battle of boxes were in the news this weekend, right here in the state of Texas as thie ongoing court battle continues this weekend over how many of these valid boxes per county Should be available. Texas Gov. Greg Abbott restricts mail-in ballot drop-off locations
