But my colleagues on this side of the aisle are about to get played. And everybody back home is saying, what are you going to do to stop vaccine mandates? Nothing. What are you going to do to scare the border? And my colleagues on this side of the hour are going to say, oh, don't worry, we're going to give you more money fries. More money for border patrol. But you know what that does? It makes it worse. Because you're funding the processing of people at our border. Because that's all border patrol and I are doing. But my colleagues on this Sunday are going to say, oh, look at us. We did something for you for border security. It ain't true. It's going to make it worse. And anybody who's been to the border, anybody who talks to border patrol, anybody who talks to ice knows that's true. We're not going to get a vaccine mandate. We're not going to get a secure border, and we're not going to get more oil and gas being produced in America. And then we're going to say, great, let's have a vote and send more lethal aid to Ukraine. You have a situation where forty nine percent of voters in california. Say they wanna keep the person currently in office but that's not good enough so it's a no vote and then that incumbent is replaced by someone who got fifteen or twenty percent of the vote like you can get forty nine percent of the vote and lose to a person who gets twenty percent of the vote is the most insane anti-democratic procedure. I think i've ever seen. I can't believe it exists but it does. It's happening right now as you may have. Heard governor gavin newsom. A democrat is facing a recall election scheduled for september fourteen. There are forty six candidates running. Replace him yes. You're that correctly. "The united states supreme court took a radical turn. That shocked a lot of people pretty much anyone paying attention. We'll explain what is happening at the high court next. The supreme court of the united states under chief justice john roberts and stack now at six three with trump appointees being three of them. So far. that's bring in high profile. Cases has been at pains to not appear overly extreme for instance they did not gut the affordable care act on preposterous pretenses. They did not overturn the election. So good for them. On that school. And roberts has deftly cultivated an image of the court that has wanted a surprising degree of approval from democrats and liberals fact a recent marquette university law school poll found that fifty nine percent of democrats strongly or somewhat approved of how the court is doing which is kind of nuts. Actually it's two points higher than how republicans view the core. But i'm here to tell you. This image immoderate court is wildly deceiving because outside of the spotlight. The case election in a series of small paragraph long workers with justification. The court has issued a string of stunning extreme rulings upholding lower court extremists and last night after the close of business. They get it again. The court upheld a lower court. Orders lower court's order that the administration against his own wishes and policies must essentially restart from scratch a discontinued trump administration immigration policy that had caused widespread misery and harm for thousands of asylum-seekers legal observers called it unbelievable both procedurally and substantively and stunning radical and terrifying. In no miller who writes on the court said. I'm genuinely shocked. What the supreme court. Just did i thought they were better than this. I thought brett cavanaugh was better than this. We really don't even know who signed on to arts of the opinion unless the justices publicly signal their disagreement as was the case in last night's opinion but again these are not argued with full briefing and oral argument like regular cases on the merits docket. Lee truly are in the shadow and often escape our point of view except when situations like this arise where the decisions are actually quite extreme so the trump administration had something called a remain in mexico policy. Mpp was the way it was referred to technically shorthand and it essentially kinda got discontinued because of kobe. But basically what it was doing was taking people that were showing up at the border seeking asylum in saying you have to stay in mexico while this all adjudicated that was totally new. There was a huge humanitarian outcry. Because people were trapped in this horrible limbo. They're shelters warez. They're being preyed upon by kidnappers. Yada yada the biden administration. A certain point says we're reversing this policy. We don't wanna do this anymore. They get sued. I think by texas among other states. And what is a lower court district. Federal judge rule. So this is actually quite unusual so this as a trump appointee in texas. I'm mackinac has merrick. And he not only out said that the policy recision had been under explained by the administration. He actually ordered the administration to reinstate the policy. It's the appeal so the appeal is going on. But the gave the administration exactly a week in order to reinstate a policy so that object the emergency appeal to the supreme court so the warmer court opinion by itself is actually quite unusual requiring the industry to reinstate this policy in essentially negotiate with a foreign government over this policy right. That's the part of it too. There's a huge kind of implications both for the folks that are on the border and also american foreign policy. You lower court a lower district. Judge saying you joe biden. Go talk to the mexican president and get this started up again. Toot sweet which itself is wild and i think a lot of legal observers thought well the supreme court's not going to go for this. This oh this is so out of nowhere. This is so sort of poorly reason. Like they're not gonna okay this and then last night six to three supreme court was like yep listen to the good man. Listen the district court. Judge go start. This trump program discontinued and the court was very clear here. They relied on an earlier decision. Gotcha liberals had actually cheered the department of homeland security versus the university of california regions. Which was the daca decision from. Last term that said that the trump administration could not rescind the daca program awfully unless it provided adequate reasons which offense administration had failed to do liberals cheered that opinion but the supreme court give us an supreme court takes away and so in this particular decision it said that the biden administration had not provided adequate reasoning for why it wanted to end the remainder mexico policy. But is that true like it doesn't seem to me like there's a big difference here both in terms of the reliance interests like who's on the ground the fact that the programs essentially discontinued whereas daca was functioning and the lowering the biden administration did verse the trump administration. There are a lot of differences here so all the things that you suggested. The two programs were not in the same posture as they went up on. Appeal here the other thing. That's really different. Was that daca. Case was on the merits docket. So there was full briefing. There was full oral argument. In that case wasn't a shadow. Docket decision wasn't a decision where the court issued without giving any guidance and here a court really provided no information no guidance to the administration as to how to explain what was inadequate about its original explanation yes judicial activism is what liberals do judicial restraint is when a random district judge tells the united states to start negotiating with mexico and restart a program that had been discontinued in a week. Trump has signed phase one of a trade agreement with China but it seems like maybe they left the big stuff for phase two which depending on which day president trump is talking. Either they are going to begin negotiating on immediately or they may begin negotiating creating on after the election rubber lighthizer. The president's Trade Representative told reporters this week that they're certainly not going to begin. Negotiating phase two immediately for one thing. They they want to take some time and see how phase one is working if as one is Collapsing of its own weight. There's not much point in negotiating a face to on the other hand if China seems to be delivering on its commitments that that might build confidence and set the table for face to negotiation. So it's not going to be right away in any case it may or may not happen before November election so What's on the to do list list for face to the big issue is mar address? Earlier is the the subsidies that China provides for its state owned companies subsidies which the US believes Gives those was companies an unfair advantage in global markets and SORTA distorts trading patterns. This was at the heart of the steel and aluminum. Tariff the big oversupply of steel from subsidize that is companies in China for example. What is the incentive for China to do that and really you know since our economy we we believe that Free markets are a better way of allocating capital. But it's not a complete trade peace either this new phase one agreement. Let's just rewind about the last eighteen months I mean clearly. President trump ran on the idea. That China was not a good actor when it comes to trade And then he came into office and and then over the past eighteen months he's he's been imposing more and more tariffs on China designating it a currency manipulator all of these different things in theory to force. These negotiations have taken place. That's right and I it remains to be. He seen really how much the the White House has gotten in. Return for this for this phase. One agreement When the when the trade war began the White House that they were really concerned about the theft of intellectual property pretty for American companies and China's requiring US companies to share their technological know-how as a cost of doing business in China? This agreement does include provisions provision to stop both of those practices but China's made promises like that in the past so there's some skepticism whether they're actually going to follow through this time time we'll tell The other component opponent was sort of added because trump is always concerned about the trade deficit is a mandate that China by a whole lot.
