It's a long shot to get this and so a lot of people weren't sure if the ftc would even bring this kind of charge that they might go after a smaller remedy but they're basically accusing facebook of buying instagram to neutralize a direct threat in instagram and make it more difficult for other social networks to compete. Kind of the same thing with what's up. They they wanted to neutralize. Whatsapp is a threat to facebook and make it harder for other messaging apps to get in there that was gonna be real hard to to prove though because we have a lot of competitive messaging apps out there so it doesn't seem like they've really suppressed the the market for that and then the the i think where i think you have the most fertile ground to get a court to agree which is the restrictions they put on third party developers on on what they can and can't do not only on facebook but if they use the api for example. The ftc uses this in their press. Release in two thousand thirteen twitter launched vine which let users shooting share short video segments and in response facebook shutdown the api that would have allowed vine to access friends through facebook. Is going to be tied up in court for another few years probably But does it set a standard for how facebook and any company that would dare to get his anywhere as big as facebook in the future to not be able to gobble up. you know. i don't know. What did they pay one billion for instagram back in the day when thirteen people working at instagram. Kind of thing because instagram was big and facebook has a history of replicating kinda cool trendy stuff that that works. I mean look at real on instagram right. Now it's tiktok competitors you know it's all it's all kind of the same thing just to see what sticks and has had a oftentimes not a lot of success. Buying the company works for facebook a lot better than trying to replicate some sort of cool feature that then people have to learn to use now. You could argue. That is why the big weather big targets on this because what's app and instagram are notably gigantic runaway successes than. They were already heading that way when they were acquired. And you could also argue that. Got him at a bargain basement price. But maybe that's why they're being targeted decide with facebook. And i'm not really doing that. But for devil. Devil's advocate reasons. I would say yeah. This is a huge target. They have billions of users on their main service and then these secondary products are huge for them and they would be standalone gigantic companies on their own. That we would talk about individually if there weren't already owned by them so it makes sense that they're the target but the idea of buying up your competition to limit their impact on your business and grow it out. Separately isn't new and they're not the only ones doing this but maybe they're doing it. The most successfully and the question isn't just as a monopoly. It's not enough to save face because of anomaly you have to say it is a monopoly and it abused its position as a monopoly to reduce competition. Sometimes of an -opoly is perfectly legal. It's not illegal in the united states and most countries to be a monopoly. It's usually illegal to cause harm because you are a monopoly. And that's where. I think they're gonna have a problem showing harm yes. There isn't another few. No flicker is not doing well. And when they bought instagram that sort of dominated the image market. But to your point. Sarah the reason they keep adding stories and then reels is instagram is trying to fend off competition from snapchat and tick tick tock so there is competition. There is competition pushing instagram to change. And i think facebook can demonstrate that. Yeah maybe maybe zuckerberg said something unwise in an email once but there is competition out there. Same what's up there's telegram and signal and we chat and and how many other messaging services out there so i think it's hard to show that they are reducing competition in the marketplaces for those two. That's why i'm less bullish on the idea of them winning over a court to make them get rid of them on the other hand the developers stuff like they essentially killed vine. And i think they're they might have a better chance of getting facebook on that one do you do you think the Slack is worth twenty. Seven instagram's just to put it in numbers slack. Yes this lack. Twenty seven billion dollars as opposed to a billion. That's what i'm saying. Everything's billions and billions of dollars now. Yeah five star wars. Anyway i would love for there to be some sort of okay. Let's say we go forward and maybe facebook is find which is likely And is it sort of said going forward. He can't just gobble up companies that That you deem as a future competitor mall and then make it your own and then you reap the reward. So what what do we get to is if you have this x. amount of users you can't buy a company that has x. amount of users that is on the up and up or it has to be for not too much of a certain price so that the company doesn't willingly to you there so many factors in play i i i do wonder how this goes. There are laws. These laws will be tested in court. Now which is you can't buy a thing when the only reason you're buying it is to put the competitor out of business. It you there has to be a valid business reason for buying it and i think facebook can show that i you know. I look back at the microsoft case where they wanted to break up microsoft. They never broke up microsoft. They just put in some remedies. And i think yeah. That's courts are very reluctant to break up a company. You have to really show that it caused harm. And i just don't see it there

The days of unlimited pandemic internet are over

"The days of pandemic related unlimited Internet access are apparently over. From American public media, this is marketplace tech I'm Ali would. We've been looking on our show lately. At how amidst this pandemic? The Internet is everything access and cost our problems for many people, but what about data lots of broadband providers limit how much data users can use each month go over, and there are extra fees some lifted these caps at the start of the pandemic, but as of July first comcast at and T. and T. mobile have brought back some of their data caps Tom Merritt host. The Daily Tech News Show podcast I asked him. What was the argument for data caps? If you ask the marketing departments of ISP's. They'll tell you that data caps make it a fair playing ground for everyone so that all the bits don't get used up by really really greedy people and there is a very slight truth that if a lot of people were using a lot of the Internet at the same time, it can cause some congestion, but it's not like there's a limited amount of bits the. The real justification is that they want ways to price things to encourage people to want to pay more and data caps are a way that people can understand. Oh, if I use more data I, pay more okay. I get it on some level. I can see that being a slightly reasonable argument like there is no other service. Where if you use more, you don't pay more right, or is this true lease artificial? I think the disconnect. Because even though the government assures us, it's not a utility. People think of the Internet is a utility. The the difference comes in the justification. If as just said yeah, we're just like that. I think fewer people would have an issue, but the ISP trying to argue that they're fighting congestion just really doesn't hold water. When you do examinations of congestion, they generally happen at peak use times whether there are data caps are not data kept supply all day long, so they don't really. Encourage people not to use data at the times were congestion might be caused and they don't. It sounds like you're also saying they don't improve service for everyone. The congestion still occurs. It's just that some people have to pay correct. Yeah, that that that prime time congestion anybody especially on cable ISP has run into it when everybody gets home specially at a time when everybody is home and fires up there video APPs data caps. Don't matter data caps. Don't keep people from. From doing things at the same time they keep people from using their data at other times. When congestion is less likely to occur, we're also at a time. When the pandemic is not over, and in fact, people need arguably unfettered. Internet access more than ever. Is this just bad timing I? Think probably what's happening is the companies are feeling a bottom line pinch as well and all of their business models are based on charging. People for more data. Use so giving away. Service without a data cap means there's less reason for somebody to upgrade to a larger package if that's how their business is created. If your ISP is built on this, you're making less money at a time. When the economy's bad, probably more people are canceling service, and you're looking for ways to bring in that money, so if they can quietly just let the data caps kick back in then that might help them whether the storm. We should say that at least you know. Comcast's CAP is one point two terabytes, which is a lot right. What would you have to do as a household to hit that cap? I don't have numbers. At the ready but you have to have a lot of people downloading A lot of things were streaming. A lot of you know high definition. Four K. video and honestly data caps. It's always in the best interests of ISP's to have data caps Behi- enough that they only affect a certain number of people. You want them to be high. Because you don't want to have people suddenly decide will. This is unusable right and you don't want to have public backlash saying I keep running into this data cap I can't even use it to watch Netflix. Et Cetera, because he is, he's no that that people are using their internet to to watch streaming video to do high bandwidth applications so you WanNa? Keep it just high. High enough that you get the users that might be willing to pay to to pay for that. It also does have some uses in making it easier to go after the folks who do abuse the network and and run things on the network that it's not designed to do. like massive bitor and operations or or or cryptocurrency stuff without having to define them it makes it easier for enforcement, so so those two things are probably what's driving this and keeping folks happy means that that data cap needs to apply only to a minority of your customers.

So those modules are I'm kind of up and down on those on the one hand. I'm like yes finally. These are some reasonable ways to keep your notebook Or your laptop choice in you know somewhat upgradable condition but on the other hand as we've learned here these new modules aren't going to work with the old no books maybe the old modules will with the new ones we. Imelda verify that But if you WANNA be a game or on the go and don't want to worry so much about you know having a desktop rigged worry about. This seems all right and at that price. Thirty fifty at with those specs. It's not bad considering what's inside that. Yeah the the modular. Gpa is best for like. I WANNA I WANNA get in on the ground floor with this. But I want the option to upgrade that. Gpo later once. I've saved up. But I'm going to keep this laptop for a while right. That's the module isn't like I will now be future-proof forever because I can just keep swapping out because we can see the are. One can't get the newer radio or the artifacts that are offered for the are too but yeah. Nice Nice specs. What could you possibly run? There's the bargain we thought we were making which was giving some data in exchange for free services. And then I think there was this realization that oh, wow. We thought we gave our data to once. I turned out. We gave it to everyone. And it turned out they printed money off of it. Do you agree? Do you think that case to change it a lot for how we think about privacy? Yeah. No it up -solutely. Did you're absolutely right. I I find the case odd. But as most things are it's not the best example of this. A lot of the people reporting on it were shocked shocked to find that this kind of practice is going. Right. It wasn't new it hadn't not been reported on. And this actually wasn't the most aggressive example we've ever seen, but because of the nexus of events regarding attitudes towards Facebook and attitudes towards politics, it blew up and became the poster story for this issue. Yeah. All right. Well, so what do you think though? I mean, this wasn't the only thing that it was actually quite a momentous year. You could argue in tech avent's what what's a big one for you. You know, I think the other thing we're seeing trend wise this year is the eruption of streaming video as a battleground for companies who want to be in it before it really does overtake cable the writings on the wall. Everyone knows that streaming videos overtaking traditional cable service and everyone's getting into position the biggest example of that is Disney fighting off Comcast to buy a large majority of FOX in order to get a back catalog of television from FX FX x. And FOX studios to put in streaming services. But also it looks like they're going to get full control of Hulu after that. So Disney will be in good position to continue to compete with Netflixing prime video after that acquisition.
