"And vaginal or anal penetration is sexual assault or rape talking with me about consent this week is Dr Dr Laura McGuire and she's a nationally recognized sexologist and consultant she has worked as an instructor presenter educator and trainer on topics including in consent education and sexual harassment prevention in two thousand fifteen laura served as the first sexual violence prevention and Education Program Manager at the University of Houston and in two thousand seventeen she became the first victim advocate prevention educator at the US Merchant Marine Academy. Welcome Laura aw thank you so much for having me on so excited to be here. Oh me too. It's so timely and you've done so much work around this and I want my podcast to include this as as much as I can and I thought we could just start with. Can you clarify consent in the era of me to what that means not only and I think this is this is one of the central questions and is your consent and a lot of people have different concepts. Just let that might not be for me. Consent is really a holistic approach to interpersonal dynamics bodily autonomy and a respect for the dignity of every person I love that and so and what that means is individualized to every person French went right for themselves right exactly and and miss by team and everyone get interactive right not just somebody where in bed with but anybody that you're connecting with and respecting their own boundaries their own needs and not projecting what we think they're okay with onto them. Maybe this is too big to go into right away but it's on my mind. I wanted to ask you about this. I have had clients. It's and just people in my life where they have an interaction. I'm talking about a heterosexual male female interaction and he goes was to make a move that may that and she pulls away at first but then she goes along with it and she says you know I'm GonNa do this and so then they do they they engage in whatever that is and then afterwards. She says you know I didn't a consent to that and that was not okay. I did pull back and then he says but then you pull back in and then I thought that was your way of saying it's okay. How do you address those kinds of you. Know non verbal able behaviors definitely so this is this is a huge issue and it's a huge issue cut previously previously for many many many generations as a world. We generally thought if someone isn't citing off somebody and saying saying no stop then well even if it's a gray area. It's a baby then it's okay you know and I remember very even as a teenager reading an article in Cosmo and it was about something they called quote unquote gray rate and it was essentially about that concept right well. I didn't take no and they didn't you know slap the person away then. Could you really and Whoa what a difference twenty years makes all right. We are now looking at this very very differently and I think that's a good thing but it's it's what makes it hard for people right because just like you're saying in that example a guy might say well. I have been socialized that sometimes women you know maybe they're frigid their coal barren comfortable but you know you convince convince them and and they into it and really for the first time in our world. We're saying you know as especially as women will so that wasn't okay. You know I felt pressured or I even felt afraid what you might do if I outwardly straight up rejected you so I went along with it but it wasn't happy about it and I think right and so that's where we are evolving to say. It's not no means no. Uh Consent is not the absence of you know a no. It is the presence of a clear yes right so if someone's in a situation where they're not a hundred percent sure this persons being chew it and and completely agreeing to what's going on. They need me to get comfortable enough to ask them and and what I was so especially. Young people is if you're not comfortable enough past you know how are you feeling. Is this something you want to make sure you're comfortable and on the same page then you're not ready to have sex love them that goes if you're older now to right this way well. It's time to reevaluate now. Some people said to me well. It's just not sexy to say well. Can I do this. This can do that. Do I have your permission to do that and then I I say not love to hear your answer my answer is you have those sexual health conversations before you start making moves like what's what's on limits what's off limits and then you start to engage but do you have a different answer for that. Yeah no no very similarly it is about having having a conversation ahead of time but then of course checking in and making sure the person's okay right and you have to have that emotional intelligence to to read re read their cues. Somebody's testing and you just you have to be able to say you know. Just you seem that. Maybe something's office off. This isn't exactly what you want anymore. You know let me know and having that open communication but it is really a conversation that you have before and you say you know what you like. What don't you like you know. What kind of things would you like to do with me today. If you know if the moments rate and we were feeling it and it's interesting because if you look at the history of affirmative consent in the Western world right because there's there's also the coach cross cultural analysis of how other cultures have normalized this and been deemed anthropologist the scrape free which we can talk about later but but if you look at as a western North American society founded this even get started it started in the Tin Community in the nineteen eighties and because of what they call scenes right where they interact with each other in some kind of interpersonal or sexual play that they could get very intense. and people could be physically emotionally hurt. They really put that early. You know it's on we have to have a conversation upfront. It's about what is going to look like how we're going to communicate with each other. It's okay. It's not okay and and that way it's it's not constantly saying like do this. Can you do that. one of one of the people. I interviewed for Book. I'm writing on on title nine a guidebook books for schools around this issue and and confront you know she says when you constantly ask somebody in moment what kind of what you talked about in that scenario earlier he's actually of manipulation right because in the moment I might be like I guess it's okay worry thing and down. We feel uncomfortable and then they get him by versus. I'm close you know what I mean. I have personal space and I can say generally okay with this and I would like to do this with you. Nothing is that's actually I think so how'd -solutely and I think if people okay just not sexy 'cause they're not used to that makes sense. And what about the idea of like what you're saying. I've heard people say well okay. I'm I'M GONNA I'M GONNA do my best to be emotionally attuned but I might not be and I may not totally get it and so where's the responsibility of the person to say what what's going on without me having to read that person. What about that right well and you know you just have to ask right? You have to be able to say. Is that feel good good. How are you stealing you like this. You know that's not had I can I can I if it's just having that constant Oakland Communication and checking in right and so if you're not sure you do just have to ask and again. I really do think when people get used to that they find that they have way more satisfying sexual interactions they lenient feeling more emotionally satisfying night because you know oh you were with someone who was one hundred ten percent into you know what was going on and loved it. That's really hot. It's always the same like I I don't know maybe they were okay with it. We'll see right because allowed a lot of men feel really like you know that the metoo movement doesn't speak to them because most of the men in my practice in my own social social circles say if a woman's not into it then I'm not into it. I'm completely turned off. These are really only certain kind of men that are doing this against women's wills but then there's a covert ways that men are doing it that they don't even know right. It's a continuum right right right and absolutely and we WANNA make I'm sure that you're not saying that people who are predatory in nature right if you get off on the power dynamic assaulting somebody great because they're not they're not interested in sex. They're interested in power to ensure that. We're not connecting that to again. These these shifts that were going through where people are still adjusting and they might be doing problematic thing that they can say well you know before. This was okay well. It wasn't really okay the society let it slide right and we're we're changing how he approached that but I I have worked with the number of offenders in in campus title nine cases and and worked on restorative practices with them and one of the the things that they tell me you know 'cause these are the people who are on that spectrum of problematic behaviors not being able to reach us. you know kind of toxic mask ways scenarios they tell me you know. I feel rejected. I don't have the interaction with people that I WANNA have. It's in a sexual context. I leave wondering if they actually like to me or they're actually into it right so it's just not having real little true. Consent isn't satisfying for anybody and so we'd actually benefits men. Women Trans on binary people everybody benefits et changing perspective and I have to be honest before the me too movement. There was a a year before when the come out that trump Donald Donald trump had said they had caught a tape that about him grabbing women's genitals and but he had also said and I do sexualize women when I'm talking to them. I'm thinking about being sexual on dressing them and just became a topic in Yoga Group. I was in was like a meditation Slash Yoga Group and it came up and then one of the men in the group said you know I. I don't grab women. I would never do that but I do think about undressing women when I was about to say the same thing in my mind with other men when I'm with them when I and before I could do that this woman very impassively but strongly and vulnerably started to talk about how she's grabbed every day in different places in different ways by men in different settings and then other women in the group said same here. I go out and people feel I was pregnant. People feel they can touch my body. They can touch my stomach and went on and on and I was so glad I didn't say anything and the guy. That spoke felt so bad about what he said. I think the men in the room including me had no idea I mean I really had no idea how many times women are disrespected disrespected in a day until she spoke and then the metoo movement raised my awareness even more. I don't know if men admit that kind of thing but I am overwhelmed by sometimes yes I. I think that that brings up a couple of really important points right is we don't often understand and especially if you belong to socially privileged group what other people are experiencing right and we see this with racism sexism homophobia able able is right where we think oh you know. I think it's generally okay for those people that and then they tell us you've no idea. I I can't even imagine but I think that's a really good point the green up it's not just in a sexual context right and that's why I just like consent as interpersonal personal dynamic because someone's touching your belly. You're pregnant or demanding hug from you as a child. You know there's so many anyway so we are told these messages that you know you don't have a right to say no. You don't have a right to your body that someone with a title or position. Shen can can just take that away from you and decide that they just wanted to do what they wanna do in and that's ultimately the problem is that we have to stop the way we think about respecting other people's bodily and emotional timing. I love that you brought up the thing with children because the new thing that I learned this year was if a child says I don't want to hug grandma I don't WanNa hug grandpa then don't force the child to hug grandma GRANDPA or whomever that there may be the reason and even if just the reason is I want a authority or autonomy over my body then that should be okay right right exactly and you know oh I grew up in in the deep..

"To the Friday edition of game has conduct. I down like record. I'm coming to you live from the Meadowlands the fan sports book or could be doing the Michael cassio. And we were doing the podcast from here as well. So flee everybody is going to have a great weekend. And let's get you started with a podcast kind of a continuation from yesterday after I had finished, my podcast and give my opinion on Pierre. Mcguire. NBC reached out to me via Email to say that Pierre McGuire had responded, and unfortunately, the podcast was already up. So I wanted to take this time here to at least give Pierre McGuire statement and his apology for what had happened back on Wednesday during the lightning penguins game that we discussed on the podcast yesterday. And I defended Pierre at the same time criticized him for the words that he used and here's the statement from Kierra I've known KENDALL for years and have had the privilege of covering her. As a member of team USA of patch. Two Winter Olympic. We were all thrilled to have her. Join our coverage last night. But at times my excitement got the better of me. And I should have chosen my words better. I've the utmost respect for KENDALL as a world class player analyst of the game and role models. So clearly I figured that's exactly what he would do. And that was the right thing to do. All right. He's a good guy. He just misspoke. And I think he did the right thing by having the apology. And there was a long statement made by KENDALL Coyne Scofield and give the gist of it. She had no problem with it. Because she's known Pierre for a long time, and she completely got it. So as far as everybody being offended demanding a firing demanding this that and the other thing I felt both parties handled it well because here too here's how I feel about offense. The person that needed to be offended the most or should have been offended. The most was KENDALL. And she didn't have a problem with it. But you also understood that he misspoke. I thought it was important that you put that understatement statement as well. Because of the fact, you know, what I? I should just read it for you. Anyway, and you you can make your own determination from here. And but I'll give you kind of the gist here. As far as PR is concerned, I've known Pierre McGuire for years, I know respects me as a hockey player a woman, and a friend, and that is why I didn't think twice about our on air exchange when it happened. I didn't give it a second thought until after the game when I received countless messages, I went back and looked at the video I understand why people would think it was inappropriate. If you were watching it at home and saw a man say, this to a woman athlete would have been offended. But what I also know is how excited here was to me. And to be a part of the moment while I wish it came out differently. I know PR doesn't question my hockey knowledge. But to be honest, that's not what's important. So I both of them handle it very well..

"And I think he means well, and I've never sent him to be sexist, and I think the condescending part of it was probably an accident. But as I said, you have to be held responsible for what you say. And to look at her as anything other than a player would be wrong because I think the NHL I think NBC you've seen it up in the CBC to with Cassie Campbell Pasco getting opportunities to to analyze games not just as a host. But also as a color commentator with the play by play boys, either in the booth between the benches these networks have done a great job of allowing women to break down that wall of not just being a host. But also getting a chance to analyze the game because of all the sports hockey is right up there where there's not that big of a difference between playing. Hockey on the Olympic level as a woman in playing NHL hockey, especially where the NHL physicality is changed quite a bit. I mean, there's no fighting in the Olympics. There's no checking in the Olympic game in the women's game. The way it is at the NHL level. But certainly she know what it's it's like the play on the power play to kill a penalty to complete a pass to take a shot to fly down the ice at twenty miles per hour with skates on so she can analyze that. I think she can actually analyze the game just as well as anybody else can analyze the game. I mean, Jessica Mendoza does a great job at ESPN on Sunday night baseball having never played baseball. She played softball. But she understands the game the fundamental aspects of the game and she's done a great job. So I think a lot of these networks need to be applauded for breaking down that wall and men have to get used to that. And I know they're very protective of their space. And I do have conversations with women quite a bit about what is uncomfortable. The fact that men look do women belong here or. So the aspect of well, you never played in the NHL a lot of times when I try to analyze the game as a play by play voice or as a talk show host. Sometimes I feel like a player can say well done, you shouldn't have that opinion. Never played. You don't understand what it's like to be a player? I think there's always gonna be that awkwardness. Because because I'm a man I might be able to get away with analyzing the game because there could be that thought. Well, maybe Don did play. But you know, that a woman never played in the NHL because no woman has ever played in the NHL before. So is there is that barrier to try to overcome sometimes for women? But I think it's incumbent on us as men to be more open and to talk more as equals not just to say there my equal, but actually treat. Hey, they are equal Pierre. Mcguire. Analyze the game is a former coach in this league. And she can analyze the game as a player on the women's level playing at a high level the Olympics exactly the same. So. So you can't just can't be lip service. Yeah. She's my equal. No. She is equal. All right. She may be going out about it at a different way. She may have taken a different path to the booth and a lot of men did. But doesn't mean that her value and her analysis is any different. So I think we all have to kind of get over that. Because more of that's coming in. I think it's great. And it should be applauded for. Sure, it shouldn't just be. We should try to do it. We should actually do it. So don't let what happened last night. I think stumbling block for that to continue to progress. I think it was a mystic by Pierre. Having known him. I I also understand that I follow this sport. And I understand I follow sports social media that he's not the most popular cat among hockey fans for sure so it's probably very difficult for hockey fans to give him the benefit of the Dow one something like this happens because I think they take great pleasure in him dropping the ball because they don't like him. But as somebody that's neutral bordering on knowing him. I will. Give him the benefit of that..
" mcguire" Discussed on Hockey Today
"With Pierre McGuire between the benches for the game. Of course, she almost one speed competition and the all star game. She's a gold medal a great hockey player h twenty six and she's definitely made her dues knows understands the game. And NBC I think did a great job to give her the opportunity to share. That real estate with Pierre McGuire. And before the game started this the exchange that caused a lot of controversy in angst. Among a lot of sports fans specifically hockey fans before the game between the lightning and the penguins. Soil. Tampa is going to be on your lap going to be on your right? What do you expect out of this game? Pay me at bien analyst not to be a fan tonight. All for heaven had a game on the other hand had a tough loss on Monday. Got a little bit of the water by do jersey. Devils so exciting to see the start tonight Trouble blouse. blouse back to all right here. We go. I know Pierre McGuire fairly, well, I wouldn't say we're friends, but we've definitely crossed paths beginning with the Stanley Cup final that I covered in two thousand six between the hurricanes and the Edmonton Oilers. So we traveled a little bit got to know each other. I worked at NHL live. He used to do weekly with us. So I I certainly know appear McGuire. And I know he's a good guy. And I also know that he's an arrogant guy. I mean, this is someone that does have a bit of a chip on his shoulder. And I think he'd be the first to tell you that he looks at that real estate between the benches as his turf, and I think he does kind of perform and announce with bit of a chip on his shoulder. Maybe it comes from the fact he didn't play in the NHL and sometimes that's a little bit of a discomfort among other analysts who all played the game. He did coach, of course with Hartford and with Pittsburgh. And I think he belongs there. There's no question about it. But I wonder if there may be a little bit of sensitivity to the fact that he feels like he has to be a little bit more over. The top because he did not play the game the way a lot of other guys in that situation, especially on the national platform have. But that's just the way he is. And he's very protective of space. And I think sometimes that may come across as him being sexist or him being a little bit in the wrong in this particular situation. I don't think he meant anything negative. I don't think he was looking down at Kendal at all. I just think he misspoke, and where I believe he misspoke the most of it because I'm not even going to get into you know, Tampa will be here. Pittsburgh would be there because they weren't at the respective benches. And I'm sure he knows that she knows the difference between Tampa Bay Lightning in Pittsburgh penguin. I think he was just trying to be a little bit understanding of that. This is the first time that she was doing this. Maybe he was a little condescending at the fact that he is a pro at this, and she has never done it before. So maybe he was a little over the top when that came to fruition. But we're I think he misspoke was when he said now, you're. You're being paid as an analyst. Now, you're not a fan. We'll fans never on the table..
