It's a good political talking point because they say we shouldn't bail out the mistakes of democratic run cities and states. But you know what the states are asking for is just to re re up the revenue. They lost because of covid. So it's going to be biden's gonna try it. Obviously it stands a much better chance if it is a democratic controlled senate. I mean the other thing is there's one hundred sixty million dollar proposal right now for state and local funding but got siphoned off the bill that washington lawmakers are look like they're on the verge of passing because it couldn't get enough support. It is important bill that that does look like it's going to pass is going to get money for transit agencies. it's going to get money for a airports. It's going to get money for education so it's not a complete loss but obviously it does not solve the ills of the city of chicago's a budget deficit in the state of illinois also in springfield a panel of lawmakers looking into corruption allegations tied to directly charging house speaker. Michael madigan wrapped up. Its work after just three hearings that sparked a back and forth between republicans on the panel and its democratic leader. Let's take a listen. The responsibility of this committee is to conduct a thorough investigation. Not simply to hear from a sole witness or just from voluntary witness. This is a political show that was concocted by minority leader. So i bet if you ask the republicans they'd say. Yeah well we didn't quite get and but it paid off nonetheless so we will have to wait and see if there are more developments or how the court cases now move through the system to really know what's next although of course madigan faces his biggest test in january after the holidays to see whether he'll retain his post as house speaker wall and on. That note amanda. You know matt currently doesn't have the votes to keep his post as speaker but they're a leading candidate to replace him. No there's certain answer. The long answer is that these are discussions that are happening behind closed. Doors madigan still looking to hold on. He does have the endorsement of the black caucus which really is crucial because they have the numbers to put somebody over the top or at least to help prevent a madigan opposition candidate from rising up to win the speakership. But it's very difficult. There is no one leading candidate. I expect that this is going to be quite a political soap opera in january. That's already been a soap opera. I don't know if this may be something that was missed. I don't know. We talked about the show yesterday, Senator Durbin came out Ah, Who's on W T T W a couple nights ago? And he came out pretty Strongly against Mike Madigan, House speaker and he said, I think we have some of the soundless blitz player because there's been some developers we'll get. We'll get that to you. But he said, basically that Mike Madigan should step down from the leader of the Democratic Party, he should no longer hold That role and we have you here. Did you have a lot on your plate looking at the national scene, But here in Illinois Democrats didn't exactly have a great night. You have the graduated tax amendment that failed. A lot of opponents sought to tie that to Mike Madigan State Supreme Court Justice Thomas Kilbride, a Democrat, lost retention opponents tied him speaker Mad Again. It looks like the Democrats going to use a lose a few seats in the State House. Kind of punted on this question before, but House Speaker Mike Madigan is he still the right person to be leading your party, the Democratic Party in Illinois. Well, I could tell you all across our state in the advertising told the story. We paid a heavy price for the speakers. Chairmanship of the Democratic Party. Candidates who have little or no connection with him whatsoever were being a tart is Madigan allies who behind corruption and so forth and so on. It is really disconcerting to see the price that we've paid on. Uh, I hope he takes that heart and understands that his presence is chairman of our party is not helped. That was Senator Durbin on W. T. T W Then the governor was asked about it yesterday. He said he agrees with Senator Durbin. He should step down is the head of the party. Ah, Senator Duck Worth has joined in as well. And your hearing sort of this growing chorus of top Democrats who are saying that it's time for step aside, Speaker Madigan did issue in response, saying, I'm not going anywhere. I'm saying where I am proud of my record. Let's talk to state. Rep. Stephanie Kivowitz because she has someone who quite a while ago before anybody was speaking up about this decided that she thought it would be a good idea for the party to for him to step down. In fact, you're running against him for House speaker is in that right. Stephanie. How you doing? Good. How are you doing? Thanks for having me. Thanks for coming back on. I mean, I don't know Are you sort of surprised? It's come to this When I've talked to you before about this. You've sort of said Look, I said, I think this is the right reason for the party. But I don't know how many other people are going to stand up to him and say this, And now you are seeing that you're seeing Some of the top Democrats in the state say just that. Oh, and and I think that it's you know, it's a growing chorus side. I stood up against it. There's been several of my colleagues that have said that he should step down a speaker. We had a letter in August signed by, I believe 53 local elected Democrats say should speak down and now We have our leaders in in the federal government did say that he should step down and the bottom line is it is about the public, and it is clear that the public trust in Springfield has been compromised. And we as elected officials have to do all we can restore the public trust. And the integrity of our government in Springfield so that the people can look to us with favorable views and not look to us under the lens of corruption, or, um, you know, nefarious are a scandal and you know the list goes on and on. We just need to work to correct What has been brewing for so many years so and also something that brood for years was this kind of comment. Bribery scheme. The federal indictment laid that out over the course of years and years and years. There's a lot of stuff going on in Springfield that was criminal. And they brought comment into this and they're they're They're paying a major fine and they're cooperating with authorities in exchange for leniency. Public official A in that document in that indictment is Mike Madigan. He hasn't been accused of any crime. But there are a lot of paths in that that lead to him, and certainly a lot of questions. That should be asked. I just wonder what took so long for folks within the Democratic Party to say not to be able to say, Hey, this is a very least kind of a distraction for us. And this is a problem. I think I know the answer to this, but I want to hear your answer. Well, I think as things brew you want you hold out and give individuals the benefit of the doubt. And over the years Ah, you know, there's been now scandal. Then there's been Ah ah accusations on the political side. But this is you know, a concrete FBI document of which Michael Madigan is labeled public official, eh? It's no longer inferred it no longer Um, you know, just accusations. It is a serious issue. And and I think the public is looking at that fain. We don't want A leader. He even have the perception of impropriety. We don't even wantto have any kind of inkling of impropriety, much less being labeled public official a an FBI documents. There's a different standard. I understand that you know there's a legal standard. But there's also the public standard and the public standard is a higher standard than just within an action was within the confines of the law. Um and and I think that people have said enough is enough. And I think when you first launched this bid, people think a long shot of big deals going have you were, you know, and you were streaming a strong, independent voice and just said You know what? This is? What's right. I'm gonna do it anyway. Do you feel like you're going to grow support in this environment? It feels as if you may be looking for a new speaker. At some point. It seems certainly more plausible today than it did the last time I spoke to you. It does. And I am, even though there are people that are criticizing individuals for standing up. I think that's what the public expects of us to stand up when we see things that are not right. And when we see things That are compromising the integrity of the institution of which were elected to its about the voters and in the statement, as as you paraphrase released from Mike Madigan, he says he's not going anywhere. But I think I would. Myself and other elected officials are saying is that the voters would like you to go. And they're the ones that we listened to. And I think the voters want change in Springfield and new direction and To be able to trust and have faith in their government again. I think they're really longing for that. Well, the voters in his district have re elected him time and time again. You He's in that area from Midway airport, and it's been working well for him. But I think that there is a reed and you point that out accurately that there's a read from this election. That's certainly Senator Durbin's pointing out to say. You cause losses up and down the ticket for Democrats, four of his House Democrats appeared there re election bids lost his effort to oust the Republican Steve Stevens was he didn't he was put a million bucks in that race didn't work out, either. You can go through more and more Kilbride. He gave him half a million bucks that the links to him alone seem to be enough to sink his retention as a judge. First time a Supreme Court judge has been, you know, kind of ousted in the history of the state. And so I guess Democrats are looking at that and saying, Well, wait a minute. She worked for the board of Elections, She moved heaven and Earth. Whenever my husband, I, even though we're under a cold in quarantine to vote in person at our polling place, the Beverly Center in Beverly, How Nice is that? What did she do Go? We could not we found out That possibly we've been exposed and we had missed the deadline for a male and my husband was actually supposed to work. As you know, Cole worker and I was going to go and help him set up. And then we were both gonna vote in person yesterday. Cancel. We couldn't find anyone who could help us. Figure out how to go to the point place and vote in person. She Got ahold of the polling place arranged for a people per paper ballots to be sent there because it was all electronic. That polling site, Um the judges came out. And my husband and I literally voted on the hood of our car well, filled it out and took it back in and I said, I have to get my sticker and he said, I will be back with your sticker and also to Dave. I think he was the chief judge is our polling sites, But the two of them were just went above and beyond. It was so important to us to be able to vote yesterday and they made it happened. They made it possible. So I just wanted to say a big thank you to them. Both of them. The Beverly art centers where you voted Jane and Dave, You're awesome. And, Captain. You guys OK? You and your husband. Are you okay? So far, Everything's fine. We want God taps were just waiting for the results. But we're laying low and keep it safe, and but we were able to vote good. Rick Pearson joins us now, Um Rick, Rick, what is top of mind for you right now? I'm just trying to digest everything going on all the moving parts and Ah, you know what? What? What's in yur? What's on your mind right now? One. I'm going to be cooking for Thanksgiving. Oh, come on. You can't get your mind upon six. I think that Thanksgiving is a time like this way. Oh, what's on the top of my mind? Just having taken a look at the Illinois result. I mean, I know we still have the presidency in flux. But the Illinois results are show a very interesting kind of Spark of a rebirth of a Republican party in Illinois. And you see that see in a lot of ways I see it in the defeat of Governor Kristers Income Tax amendment. I see it in the rejection first time ever rejection of Illinois Supreme Court Justice Thomas Kilbride, whose district includes world County and stretches all the way. West to the quad cities. I see it in the fact that there wasn't a huge blue wave that had been anticipated that would have resulted in Massive Republican losses from the General Assembly instead of looks like Republicans actually may have picked up a couple of seats from Democrats and the only house I've seen the closeness of the Congressional races where you build first term Democrat Lauren Underwood and state Senator Jim over wastes are in the too close to call ways. I see it in the congressional race. Closer in the sixth District in DuPage and the north suburbs were Sean cast and won a closer than expected victory. I even see it in the congressional district. Down in Springfield, the 13th Industrial Ghost Workup rematch between Republican Congressman Rodney Davis and Democrats that see Turks in laundered and that waste Republican one by fewer than 2100 votes. Two years ago, he won by 10% this time. I see it out in the congressional race out in the Quad Cities area. Where you have the sherry boost. Those who would be national head of the Democratic Congressional Campaign Committee was able to come up with a 12,000 vote win after a very close contest throughout the night. So I see these sparks of Ah, Republican turnout and, ah, it's It's I think very, very big combination of factors. Yeah, I mean, you laid that out really well, that very understandably, and I think that there's you know, you do see that. I wonder when it comes specifically to the fair tax or the progressive tax. Whatever you want to call it. How much of that was more moderates and people who are even not Republicans. That just sort of want to send a message to Springfield. Our elected officials that weren't were not happy with the way things are going right now, the way you're doing things, and so we're not going to keep sending good money After bad to try to fix a broken system. We need more from you. First. I kept hearing that from our listeners. I heard that from people who came on who weren't Really in the R category, or in that one Republican necessarily mean they're in there, too. But you do You heard that from so many different people and for it to be defeated this way, unexpected and sort of shocking, I guess. Well, I leave thee here. You have this. This race $124 million split between almost equally between the two sides on this And what the anti amendment side did very effectively was make it somewhat confusing and the problem and inside never really made it easy to understand. And when there's confusion, and you're talking about reason taxes, even though it may not be your tax or my tax, but maybe a wealthy person's tax If you talk about reason, if you make it about raising taxes, that's that's almost like an immediate no vote. And so yes, I agree. There is very definitely a anti government. Sentiment that permeates through the results here on anti Stannis quo kind of result that permeates through here now, you know? Sure, Democrats are still going to be the party in controlled state government. They control the house. They control a son that they control it by supermajorities. But I do think there was a big amount of message. Sending here about people aren't happy with their government right now, and I think it extends more than just You know, my property taxes are high. I'm already paying too much in taxes. I think that unhappiness and government transcends to the restrictions about the pandemic that have been put on and people are just not happy with government right now. How much of a message do you think was sent there for Mike Madigan? You mentioned Justice Kilbride, the first Supreme Court justice to not be retained. He was that he took money from Mike Madigan. And I know that was part of the campaign against him. Tow link him directly to Mike Madigan. He's also he wanted to pick up more seats as you pointed out to secure his speakership. Those sorts of things are out there. How meaningful is it? Do you think for him there again that dovetails into that dissatisfaction with Springfield? I think I was talking to somebody earlier today, and I think For Republicans. This is fire man again. 7.0 is what they're on and that in kind of this world we're in right now that that Madigan anti Madigan message is resonating. Before it didn't always resonate. And in fact, when you look at the legislative races, Madigan by far had millions of millions of dollars to spend on Democratic candidates in these legislative races with very little to show in return..

"A day, The Dow is up 686 points. The NASDAQ is up 4%. That's 447 points and the S and P is up. 101 Oil up a little more than 3.5%. Voters in Illinois have turned down a referendum to change the state income tax from flat to graduated. Let's get the latest on some local elections. Greg Hines is here. Columnist did Crain's Chicago business Great good as always, too heavy on the show. Let's start with that amendment that graduated income tax amendment. It lost. What does this mean for the governor? What does this mean for taxes going forward? Well, it doesn't mean anything good for the governor and what it may well be in protective. There's an increase in the current flat income tax. Ah, but we don't know that for sure yet. And what we do know is that the state had been counting on the money from this. Ah, billion three next year Mourning and I and the in the being free this budget. You're more in the trend future years to help to fill holes in the budget, But that's not going to be there. On the sum of the ratings agencies already are out statements today saying, Hey, Ah, Ellen, I what you going to Dio Prisca had kind of suggested to that he would raise the flat tax more if need be to replace this. That's my butt. I'm not sure that's politically is possible. Now. That would have been a few days ago. The Democrats actually lost strength and strangulation. House prisoner certainly lost some prestige on this boat. Then there's certainly sure there's going to be a move to, you know, let's not raise taxes anymore. Let's cut. Let's Take another look at that pension amendment that we've been discussed not an offer Good 20 years. Let's do anything except raise taxes, whether he can muscled through and how he's going to get it. So it was really a pretty good question. Right now. We don't know really fascinating to see how his his hands were tied because as you've mentioned politically, really difficult to raise taxes in the midst of a pandemic really at all, but especially in the midst of a pandemic. But you have this issue of a widening budget gap because of the pandemic is like they have to do something. Yeah, I mean, there is one silver lining here for him, but it's it's not. It's not a silvery. That might have been if fighting pulls out the presidency, and I think that is the other well above the body even right now, But he's gonna win when we would get through all that, just looking at what's out in those states and who's ahead If he does that Ah, the ads of passing some kind of code rescue bill are probably increased. But I wouldn't go too far down that road because Republicans could gain control of the Senate. And a lot of Republicans don't want anybody at all anymore. At least not very much. So I think when the dust settles on that prescribe may get some money out of Washington. But that's the kind of big money he might have gotten. The Democrats had had taken control the Senate as well. Talk about the significance of the Supreme Court race here in Illinois, Thomas Kilbride. A lot of people saw the ads and heard the ads, but they didn't quite understand why it was such a big deal. Well in the short run. What it means is that that seat is vacant on the existing eight members of the card for Democrats for Republicans will pick an acting successor who will whole office until And acting until ah, a special election in 2022 in the long run, when it means that the Republicans maybe back in the game and down like politics in in in the in the sense that that the court is now is now well before Democrats. For Republicans. This is a district kill brides. It's mostly rural super areas. And that leans Republicans. So Republicans have a chance to take a 5 to 4 lead that could play out in in decisions affecting legislative reapportionment, although that may happen before this. It's certainly well affected issues of concern to the business community like tort reform and liability laws, and so forth a number thing. I mean, anything that comes before the Supreme Court. With 92% of precincts in 60% of the voters have said Yes, a margin of about 4000 votes that school district covers about 4000 students. But back in 2017, it had fallen into a $22 million budget hole. An outside management team cut the deficit to $6 million and now Intends to use the extra money approved by the hike to not only get out of the hole but to give teachers their first raises in a dozen years. Here in Arizona, it was thought to be a nail biter. It now looks like a solid Joe Biden win on the flipside, Florida thought to be close. In fact, polls show the president losing to Joe Biden in these last days in Florida. However, it appears as though the president is going to win Florida Craig will begin with you. I mean, kind of a challenge here in the polling in many respects is not able to really tell us what's going on. I know. I saw one comment on on Twitter earlier this evening That says that political polling is big is in the place where weather forecasting was 50 years ago, which is not very good. I think it has to do more with the fact that people don't talk first off the people don't talk to pollsters with his much honesty is they may have in the past. They people now have an agenda, but also that I don't think the pollsters get to all of the people that they need to. I don't think they are able to reach as many people with cell phones they want as many people who I just live different lifestyle. So if I don't think they are as good as they think they are, you know, a lot of the Poles were pretty pretty good. But if you look at the way things shake down at the end of the election, all eight of the battleground states to Trump won in 2016. Showed by leading in the polls in the last week, and North Carolina goes to Trump Florida goes to trump taxes goes to Trump. The point being that maybe he's right. Maybe the people came out today to vote came out in enormous numbers and eclipse the early voting. It's a little unclear because we have to come a lot of votes still in Pennsylvania, Michigan and Wisconsin love thee. Mail in ballots. But I think that Craig's got a point there. It's polling is getting complicated and you really need to discount with the polls say. When you're within a few points because all of those states showed by leading and he's gonna lose a big majority of them, and that's going to make this thing. A nail biter until all the votes accounted something, Craig, Where do we go then? Because polls on by many of you, me and they don't matter. The vote is all that matters. But we get that polling throughout the A year, and I think that often sue's people's minds. You know, they want to go with the winner. I think I think it does. But I think this goes back to what Carol Marines said to us earlier in the evening, and that is that we have to do better education for people to understand what really means something and what is frankly, you know, entertainment. Or at least informing but is not decisive. I think we just have to do a better job of reporting. These Poles of the people understand that this is a snapshot. "The latest tally in several key races in Chicago Land two congressional races. We've been keeping an eye on In the 14th congressional district. A real nail biter Republican Jim over Weiss's leading Democratic incumbent, Lauren Underwood, 50.4 to 49.6%. We have 83% of the precincts reporting in the sixth Congressional District Democratic incumbent Sean Cast in 52% Republican Jeannie Ives 46% with 47% of the vote in Graduated income tax amendments 74% of precincts around the state 54% No 46%. Yes, Opponents of the measure are saying it has lost. Cook County State's attorney Democratic incumbent, Kim Foxx, beaten Republican challenger Patrick O'Brien. Supreme Court Justice Thomas Kilbride appears to have lost his bid for retention, falling just short of the 60% of votes needed to keep his seat on the state's highest court.

And a long time professor of political science taking a closer look at this extraordinary election, Connie You think we're likely to see many results on a night like tonight? You know, I think we're gonna see some and this is you know one it certainly and start election, but it's like nothing we've ever seen. Before. We had an election where there's clear, not runner. We will get national polls. But it's still a hugely competitive election. I feel like we're somewhere between a lamplight in a nail biter. As I'm looking at some of the results coming in, I think it's leaning more towards me a biter. Connie, This is Craig del Amore. You know this country could if it goes, Biden's way, have its first female vice president ever. And for all the attention given to AH, Democrat Kamala Harris is about her races. Black and South Asian, You know, gender has been as much or even more of a hurdle in American politics, right? Absolutely. We've only had Two possible female vice presidential candidates before Geraldine Ferraro and Sarah Palin. Then, of course in 2016. We have Hillary Clinton at the top of the ticket, but When you look at the early polling, this election could result in the widest gender gap on record. Um, polls are showing, you know, 50 per cent of man are likely to vote to support President Trump versus 35% of women. Um, yes, the President, you know, and he knows he's in trouble with women stick police, suburban women as witnessed by, you know his appeal, you know, almost even bagging suburban women like him and vote for him. Fester. Andy Shaw here. One of the beauties of academia is that you can tell us what's right and wrong about the system without having to face the voters. And I'm just wondering when you see a campaign in which $100 million was spent on the Tax amendment fight, and the Kilbride race is probably going to be 10 million or more. I'm just wondering what your thoughts are about this kind of a campaign along with the incredible number of absentee and mail in ballots. Unprecedented numbers there. What does this leave us? As we move forward is just just anomaly. Because of the pandemic, or we we see. Are we seeing a sea change in the way politics has handled in Illinois and the rest of the country. So I think I think it's a sea change, but I think it's been a sea change. That's been a long time coming and you know, as you meant money and politics, the erosion of democratic norms and democratic institutions. They all Call into question the legitimacy of of our democracy. And you know you're right on the FairTax. We've got two billionaires Tio account for you know each side, you know massive amounts of fundraising. It's even gone in Teo. A retention election for Supreme Court justice that normally probably wouldn't get a whole heck of a lot of attention. But we have you know Ken Griffin. And how will this perhaps impact her decision making? And I wanted to get somebody who is right there. Who knows this kind of thing. And the best guest I could ever imagine. Is Justice. Thomas Kill bright, who is an Illinois Supreme Court justice? He's been one for 20 years. He served as the chief for a three year period. Ah, he has been a fabulous judge, and I've known him for years and followed his career. I think The best of him, and he's up for attention This November. 3rd welcome to the show. Justice Kilbride. How are you doing? Well, good afternoon here and I'm doing fine takes great, great to hear your voice. So let's talk about this issue. Tell us about the diversity. First of all, does diversity make a difference on the bench? Should we be looking for people from different walks of life and doesn't make a difference in how cases are decided? Well, Yes. Yes And no. Yes, we should look for diversity. On the bench. And no, I don't think it necessarily means diversity will give you different decisions. I served with three women on the corks on the Illinois Supreme Court initially One woman was Justice Mary Anne MacMorrow, then later Justice garment during the court in and Burke And Mary Jane tie, So actually, I've served with four different women on the Supreme Court on DH that this time we've got three women and I don't I don't see them all voting together all against the majority. The difference on the case and the issue. And so forth. And I'm not gonna go on and on when you take. You know, when you have an issue that comes to you up in the appellate court, we're going to talk a little bit about the mechanics of how the court works. In a minute, but e mean you just and again. I think I hear a lot of people say, Well, she's a Catholic, so she's definitely going to vote against Roe versus Wade. That's not how you look at a case is it? You look at you Look at it for from other purposes, right, like the law and like case president right? Absolutely. That's the first thing we look at his court precedent in the case precedent of the constitutional framework within Excuse me to set this straight and then the case law precedent. His career. And how important is precedent? Can you explain to our listeners what it means to follow case precedent? Wellit's very important can be very frustrating. Sometimes their hands are tied. In the context of the case that predates us. Our court has authority to set aside precedent, but it's extreme. Situation. When that happens, it's rare, and there's a whole protocol standards that have toe Be developed and writing of the opinion to be ableto step outside precedent, But that happens well and it makes one side but I suppose it makes sense that we had president because you don't want courts.
