"Katie Hobbs, the governor of Arizona is now disregarding the death penalty sentences that have been handed down for someone for folks in Arizona because she has a problem with the death penalty. If you have a problem with the death penalty governor Hobbes, you go to the legislature and say, we need to modify or do away with our death in it. You got to do your job. We're seeing this with DAs all over the country, James. What is it that why have we gotten away from, you know, and I may be an old funny duddy here or something. I don't know, but the three branches, the two branch government system is what made us what is good as we are today. Why are we going away from it? That's a loaded question, isn't it? Yeah. But you see it all. Democrats. Republicans. Specifically about this situation. She's okay, this is the governor of Arizona. Yep. Making the decision to remove the death penalty from all of the inmates in their state. She's not going to care the executive branch will not carry out a death penalty center. Here's my question. The power. He could commute them. Okay, this is a question that I have because when you brought this up to me earlier, made me think of this and it's sort of terrifying. Okay? Yeah. She has the right to say, okay, everybody who's currently in prison right now, she can just say, and during her term, those people will not get the death penalty. Correct. Okay, let's say she loses the next election. Yep. Do those people, are they, are they pardoned or governor just say they get the death penalty? Yeah. If she doesn't change their sentence, and again, I said something wrong. Let me be very careful here. Some sites allow the governor to commute or pardon, okay? Some sites don't. I'll be Frank. I'm not sure about Arizona. So what I do know now is that she doesn't have that power. Frankly, it's even worse.

What the Silvergate Death Spiral Means for the Crypto Industry
"So today we're going to dig into not only why silvergate is crashing, but how it got to this point, and what its death spiral means for the industry. Let's start at the beginning. Silvergate bank is a medium sized crypto friendly bank based in California. For most of its 30 year history, silvergate was a tiny community bank focused on financing smaller real estate deals. It had only three branches and less than $1 billion in bank assets. In 2016, under the leadership of CEO Alan lane, the bank pivoted to providing banking services to crypto firms. Ben Reynolds silvergate president, who is hired to oversee this change in business strategy said, we need to deposit an Allen started seeing that companies like coinbase were getting kicked out of banks. So the idea was, if we can bank coinbase, we can find deposits. Allen went to the Federal Reserve and said we want to provide basic banking services to Bitcoin companies and they said okay. Over the next 6 years, silvergate downsized its existing business banking and real estate teams to lean heavily into crypto. In 2016, the bank had only 20 crypto clients, including paxos and bit fury, but this number grew to over 1000. This rapid expansion in dealing with the early crypto industry came with a large increase in compliance risk and overhead. According to anonymous sources speaking with Financial Times, silvergate had to hire twice as many compliance staff as comparable banks of its size. Waiting times for compliance checks on new customers ballooned out to 6 months. One of FT's sources said quote, when they got into it, crypto was this little new thing, and I think they didn't realize it would take off as fast as it did. So then they put all their chips in that direction, it ran away from them, it got very big very quickly. Now part of the reason that silvergate were able to achieve such a prominent position in the crypto ecosystem was the launch of their silvergate exchange network or sen in 2017. Said enabled crypto firms to immediately transfer U.S. dollars to other account holders at silvergate, 24 hours a day, every day of the year. Funds would be cleared near instantly and could be used immediately. While this feature might not have an obvious use case for the average retail trader, for large crypto funds this opened up the possibility of conducting arbitrage trades across exchanges at a much faster speed, while also allowing funds held on exchanges to be topped up after hours or on weekends.

His orientation, the idea that there is a fundamental threat to human individual rights that comes from the private sector. And of course, always there's been crime in America and we punish trying. But now the view is, it's not enough to punish crime. It's not enough to prevent people from harming each other. And it also necessary to organize and regulate their lives step by step so that they will not have views of other people build that are disapproved of by the federal government. And for the state government, as far as that's concerned, happens that state levels as well.

"Really understood that what the founders had done and what we had in this country was just so extraordinary that the only way that it could be destroyed would be from within, which is, of course, where the attacks have come from and where they're coming from today. So eventually you and I want to go through them because in the article you mentioned, go ahead. Yeah, okay. So yes, we had this system of government set up with a three branches struggle against each other and the federal government struggles against the state government. They're all intentioned together. It's this real Goldberg apparatus set up intentionally to restrict the power of the state over individual Americans and their families and their churches. A magnificent rare, almost unique historical creation. The only presidents are things like Switzerland. And immediately, of course, fallen human nature starts to chafe against it, corrupt elite start to try to frustrate and corrupt and pervert the system. But the slave power between 1830 and 1860 the slave owning elites of the south were the first, I think, arguably the first elite conspiracy to corrupt the political system. They used their power in the Senate to frustrate all progress in terms of settling the west unless they could spread slavery and spread slavery further and further west, even though slavery was meant to die out. It was supposed to die out Jefferson, Washington, all thought it was an institution that would wither away. The slave power, the wealthiest elites of the southern states who owned a vast plantations worked by slaves. They insisted on extending slavery further and further to the west. They wanted it in California. And as we saw during the Civil War, they wanted to capture Cuba and conquer Mexico and reintroduce slavery. They wanted to go down to Brazil. They wanted a huge slave empire. So we had those elites of the south basically fool the people of the southern states into seceding from the union, and we had a Civil War.

"I used to manage work for a company here in Green Bay that was the second largest health information management company. And so we digitized medical records and the whole 9. There's a whole $1 billion business behind that. But I managed a collections department. And I learned early in my management life that the job of a manager, your real job is just to move away obstacles from people. So they can be successful. Yeah. Not you. You're not doing anything. You can't make the engine run. All you can do is spot things let me fix that before it breaks. Or let me remove that obstacle so that that person can continue success. And so I liken that a lot to my job as a high consulate. My job is to help them know that there are resources. When their leaf sidey president wants to speak with the stake relief site president council with them, I need to let to make sure that the third branch released by president knows that I'm available to translate because that person doesn't speak Spanish. Now we just have a brand new stake high councilman called for the young man's president. Speak Spanish. Super excited for that. But it's the whole thing of our Sunday school president from the state when he wants to meet with the GB for our third branch. Sunday school president, make sure we facilitate that communication. Make sure that when the new videos just came out about Sunday school for teaching in the savior's way, they have updated videos. I do my best to make sure that here's the Spanish versions. To make sure that because again, people, it is very easy for people to feel not apart when we forget little things like a link in Spanish. Because of the culture of the Spanish speaking culture, it is, we're at church, everyone says hi to everyone. We shake hands. We hug. It's full on love. Everyone knows that you are happy that you're there. That happens in the first ward as well, but with people I'm comfortable with. You don't do that with everybody. It's just different culture. And so it's very easy to make people feel like I just remember one time I mission I forgot to shake someone's hand. As a missionary in the elders quorum. And you would have thought that I said something super offensive. But I just forgot to shake his hand that day. And so that's kind of my, again, as I look at my job as a high councilman, it's to make sure that they are understanding that there's resources available for them. That we are available that I'm available specifically to them for any of their needs, and not get in their way. Yeah. Because I think sometimes we have a tendency to think, oh, they're a small branch. They don't have the resources. They don't have the longevity in the gospel. So how can they know how to run the gospel? Or read the handbook? Yeah. Love it. And I'm really passionate about that and serving in a certain Sacramento Spanish speaking.

"Go back to the founding fathers, they were very clear about separation of powers and consent to the governed and checks and balances. Three branches equal any fourth grader that's taught civics of which they're increasingly not taught civics could tell you exactly the moral premise behind separation of powers. Starting in the 1920s, simultaneous, by the way, with kind of the regime of scientists and scientism is there was this fourth branch of government, where Woodrow Wilson, one of the worst presidents in American history, basically made an argument that the kind of founding fathers and what they said and what they did, that's old, that's outdated. We got to turn our back on that a new era is here. We have technology and we can govern men through different ideas and practices. Now, the implications of that is that an entire new regime, if you will, of governmental power and control was ushered in, that does not really fit into those checks and balances. For example, the power is no longer in Congress or in the executive branch, the power is in the deepest kind of chasms of the Department of Justice, the FBI, the Internal Revenue Service, the EPA, and you have this unregulated regulatory agencies that are unchecked largely unknown with unlimited power. And it's very hard to then check and balance it, and then you all of a sudden have very bad things happen. And you ask yourself, who actually voted for this? So for example, Congress should say, if you're funding gain of function research at Boston University, not only should he lose your funding, like you should be arrested. This is insane.

"Sometimes they are positive, but it is just that the rules can change, unilaterally based on those in power. And there's unpredictability. The difference is, if you showed up to play that backyard football, and they had basically a granite tablet. And they had chiseled the rules in. And these are the rules. If you play the game, these are the rules we play by. Yes. And now there is no debate. Yes. It is, there are the rules and no one's gonna walk over even with a racer on a marker. And let me erase rule number three and write a different one. They are literally chiseled into granite. That is two different environments. And that's, I think, ultimately what we're talking about is this analogous situation where you can not change the monetary policy. And it does not matter how many people you get that want to do that. Because there have been people who have wanted to change, whether it's monetary policy, technical components, whatever. been able to loosely coordinate with more than 50% of the hash rate in the miners. Still can not do it. And this idea, which I haven't heard a lot of people explore, is that in the United States government, which I think most people would look at and point say, this is a democratic government. And it's the best that we've seen so far. Can somebody come up with a better solution? Maybe. I don't know what's going to happen in the future. But right now this seems to be the best way of governance that the world has ever seen. We have three branches of government. And those three branches of government provide checks and balances on each other. In the Bitcoin ecosystem, we also have three branches. You have the developers. You have the nodes and you have the miners. And those three branches of Bitcoin end up providing checks and balances on each other.

"My book, especially one section in the middle, is a look at American history and our founding principles of civil government. And you have to realize people that are very influenced by critical race theory and Black Lives Matter think that America has to be fundamentally transformed to hearken back to a well-known phrase by Barack Obama. Who really set the stage for a lot of this. I go into that in the book to some extent. But it's not true. We don't need to transform America. We need to hold America accountable to its highest ideals. And one thing I'm very concerned about is the fundamental distrust or the fundamental hatred for basic American institutions. I mean, we have a very brilliant form of civil government based on the view that human beings are not perfectible. We're fallen. Therefore, you don't concentrate government in a king or in an autocrat. You have the three branches of government. They have specific duties, and so what I see with a lot of people on the far left is they'll say, well, if the Supreme Court doesn't give us what we want, then we say it's illegitimate. The whole thing is a legitimate why, because we didn't get what we want.

"On a case that is not getting frankly as much in is because it takes a little bit more to discuss, but it's pretty plain and simple. The EPA court, I was excited as much about the West Virginia case, is any of the other case believe me, I was excited about the Dobbs case and others. But this EPA case is something you saw firsthand dealing in the administration level that executive branches have believed that they can have more power than Congress gives them to give us your thoughts on that. Well, I think there's always been an unholy alliance between the administrative state, the ABC admin, you know, unelected bureaucrats and the Congress who don't have to make the tough choices of what they're actually going to regulate. And so they've offloaded in very vague statutes. Some of these powers, whether it's to regulate water, regulate air, quality, regulate all these issues, and of course the administrative state has picked up the baton and run as far as they possibly can. This West Virginia case, I think you're right. I think it's a very important case. Probably not the most important because Dobbs, you know, certainly. Was revolutionary in its restoring the balance of power in the constitution between three branches in the states, but ultimately this West Virginia case versus the EPA is puts the administrative Genie back in the bottle. Makes Congress pass specific legislation to address these issues that are determined to be important. And again, a restores power to the people and takes it out of Washington, D.C., and out of these unelected bureaucrats. So

"We did know that the abortion case was taken up by the United States Supreme Court, the third branch of government article three, 9 justice on the Supreme Court in that way for a 150 years, the current regime wants to change it. And they want so essentially the issue is this is that Mississippi has passed a law that outlaws abortion at 15 weeks. The Mississippi solicitor general has decided to take that law and defend it through court, the pro abortionists, the people that are on the side that it's not a human life, it's just something else called the cells, the center for reproductive rights, they're arguing out in front of the Supreme Court. Now, I'll be very honest. My expectations were low. I'm a very pro life individual. I speak out about the scourge of abortion. We've done that on many different occasions here on this program and on our podcast. In fact, I encourage you to check out the Seth Gruber conversation from this last weekend. Connor, what great timing that we posted Seth Gruber when we did? We were holding on to that sets of dear friend. He is one of the most articulate pro life activists. I encourage you to check out that podcast, the best case against abortion you will hear. And I did not expect to have much action. I expected the justices actually Alito and Thomas I expected to probably draw a line. I didn't expect some of the middle justices like Gorsuch or Kavanaugh or Amy Coney Barrett to start to signal that they were somewhat sympathetic with the Mississippi abortion law. Now we have a lot of sound that I want to get to here. We have a lot of different kind of cuts that I want to get and the name of the case because you're going to be hearing this time and time again is Dobbs versus Jackson's women's health organization. Dobbs V Jackson and it's looking like for just kind of a bystander that roe versus wade might be on the ropes.

I believe I love this headline from study finds dot org. Always find a bunch of great Obscure studies study finds that drinking two cups of coffee instead of one better for your heart, you know stuff like that. But this one's amazing. I'm going to read you the headline and take you through the emotional roller coaster of it. Just 56% of Americans can name all three branches of government. A 15 year high. That's the headline. So you read the headline and, according to this study, Which is a poll by the Pennsylvania's Annenberg Public Policy Center. Just over half of us can say legislative executive and judicial branch. But apparently 15 years ago, it was significantly lower 15 years ago. Get this. 33% of Americans could say what are the three branches of government and answer it correctly? This isn't my favorite story because of how, uh, uninformed. We are as Americans and I know you listening aren't because you're listening to the news Right now. You're listening to us, Therefore you are informed, but there are so many people. In this country. Who just I don't know if it's going to be if it's ignorance or blissful ignorance or just plain. This is an indictment on our education system in the civics, part of high school and all that. That were 56% of Americans can name the three branches of government and that's at a 15 year high. That's crazy. I mean good on Americans getting better at it, and I think it's probably because of how divisive and crazy pop the political scene has been for the last 34 years. I'm sure that has to do with it. Impeachment and Supreme Court justices going through the ringer and what not But still that's that's pretty crazy. And here's my second favorite story of the day. We haven't done this yet. There is a company Called colossal. It's a Biosciences and genetics company. Comprised of scientists and entrepreneurs. They have announced they're moving forward with a plan to bring back the woolly mammoth from extinction. Boys and girls. I've seen this movie before. It's called Jurassic Park. We know how this goes. It's not a good idea, Colossal says they're able to resurrect the woolly mammoth. Or similar cold resistant elephant with quote all of the core biological traits of the woolly mammoth. Here's where it gets crazier. They say it's also about reviving a healthier ecosystem. Colossal, says the mammoths natural environment, which is the Arctic tundra. Was in much better condition when the furry giant Rome did, they say by resurrecting the wooly mammoth they can help curb climate change. I mean, This is crazy. They're saying that the Arctic been stripped of grasslands, which offense efficiently absorbs carbon and by bringing the mammoth back that the once against graze in the fields and and eat grad. Again. I've seen this movie. We know how it ends. Jurassic Park is not a good idea. I mean, ask anyone who has seen those movies. But I mean good on you, I guess Colossal wanting to bring back uh, woolly mammoth. I'm waiting for the day where they try to bring back the Velociraptor and God help us all. It's 8 55. "When you're thinking about current events. We don't really know for sure how everything is going to play out at this point. Yeah, I think there's a lot of interesting is going on. Obviously a couple, you know, obviously what goes on in D. C. It's very disturbing, I guess, And it's easy for people get caught up in the noise and feel unsettled, right and the reality. It does build anxiety. And as things seem unsettled, so you know, I want to try to put some things in perspective because What I talk about with my clients and what I see happening, what's important to focus on But the reality is is Yeah. What do we know? Well, the Democrats have the majority and all three branches. But what's important, understand about all this is the market's care about policy, not party. It always has. And so when it comes to policy, bad policy is bad policy but is gonna wait and see what happens. We don't know what policies they're gonna roll out. Now. Our fear is that we'll get we'll swing way too far one way to the left for people and create some bad policies. Whatever. But the reality is is that's probably not going to happen. I mean, we are in the middle of a pandemic. Mark, you know, so Realities is what's happening now on what we see is because of that. What's going to be coming for sure is more stimulus. So we are going to have more stimulus. We're gonna have more checks. We're gonna have some stimulus on infrastructure spending and no tie those type of things. And so that's something that the market actually likes. Because in the pandemic We've created a You know, a situation where the government has to step in and you know, create the stimulus. So the markets waiting for that, But we're definitely going to see more

With Prop. 22, Uber and Lyft hope to keep drivers as contractors in California
"Proposition. Twenty two is on the ballot in California right now, it's an initiative sponsored by Uber Lift Jordache and other Gig work platforms that would exempt at based ride hailing companies, Uber and lift basically and food delivery companies from a new state law that requires them to classify drivers as employees. Instead of independent contractors give companies have poured nearly two hundred million dollars into the yes on prop twenty. Two campaign that makes it the most expensive ballot initiative in state history they also threatened to leave California or dramatically raise prices. If it doesn't pass a loss loss, though could embolden other states to insist that APP companies hire their drivers. So let's dig into this fight in quality assurance. The good companies are saying if this doesn't pass, we're going to have to potentially suspend service in California and if it passes Uber lift and the rest of the companies will be able to continue operating. The way they were we're operating before their workers would be contractors that means they wouldn't have basic employee protections, unemployment shirts, workers, compensation, and the way this proposition is written, that will be pretty much locked in. There's this seven eighths provisions, which means if it takes seven days of the Senate and assembly in California to make any changes to this proposition and local jurisdictions, cities and counties couldn't make any changes to give gig workers more benefits. Do these sort of same restrictions. This kind of like overturn ability does that apply even if the companies are forced to classify their workers as employees? Well, if you know if proposition twenty, two dozen pass workers will become employees but you know these companies still have billions of dollars and they're gonNA, keep fighting this to claw I mean they see this as an existential threat to their business model so on the one side, if prop twenty passes, the gig model looks pretty solid I mean maybe something federally could lead to a change maybe there could be a lawsuit over procedurally in in the proposition like maybe that seven as provision I mentioned. But it's going to be there on the flip side. If proposition twenty, two dozen pass, you can expect another self of the GIG. Companies. Pretty Pretty. quickly I mean. This is a California ballot proposition but I wonder what implications could it have if it doesn't pass for the GIG, economy nationally Oh huge. I think everybody nationally and internationally is looking at this case you know over the last couple years, you've seen the California Supreme Court the California legislature, and now the attorney general go after these companies and tell them that you know your workers are actually employees and they need basic protections, and if the GIG companies are successful and using the ballot box to defy the three branches of government and maintain their business model I, think a lot of other states and a lot of other countries are going to see that as well the companies they want right
