After hours of arguments from both sides, judge Edward davila, delivered a sentence of more than 11 years for Elizabeth Holmes, it comes about one year after she was convicted for defrauding investors with outsized claims about the technology, developed by her blood testing company, theranos. During the hearing, prosecutors argued a strong sentence would help deter similar fraud. While the defense made the case for leniency on the grounds that Holmes had been motivated by a genuine desire to help the world through her company. Legal analyst Stephen Clark says this sentence will come as a major disappointment for Holmes legal team. Not just with this sentence, but the fact that miss Holmes was only convicted of four charges, not all of the charges she faced. So they were hoping for a much better outcome and I think the prosecution feels very good that they got close to what they asked for. Holmes is expected to report for her prison term in April, though an appeal is expected. In the wake of the high profile failure of theranos and the conviction of Elizabeth Holmes, many venture capitalists are asking tougher questions of startup companies and cough sill, who's worked in BioTech and followed the Holmes case closely, says more VCs are requiring that CEOs signed documents guaranteeing that their technology actually works. Sentencing is underway for former theranos CEO Elizabeth Holmes, case CBS Keith manconi has been in court this morning and joins us now live with the latest keep. Yeah, good afternoon. Well, once a tech industry icon, Elizabeth Holmes, now faces up to 20 years in prison for defrauding investors with outsized claims about the technology, developed by her blood testing company, theranos, the proceedings began at 10 a.m.. We're getting a little bit of a break right now. So far we've been hearing a series of objections raised by the defense. There are aiming to convince the judge to lay down a relatively lenient sentence of only a year and a half. In some ways, the arguments today are a rehash of the key points of the case with lawyers arguing over just how much homes did to address problems that emerged with the theranos blood tests. Going over to what happened in court, a homes demeanor in the courtroom has been plastered so far. She's sitting straight upright as the arguments are being deliberated. It has emerged in recent months that she is now pregnant and the judge offered to allow her to remain seated throughout the proceedings. Also in court today, dozens of supporters for homes, in fact, the judge has received well over a hundred letters in support of her speaking to her character and also arguing for leniency. We don't know exactly when the sentence could come down, but we're going to be in court all this afternoon and we'll bring you the latest as soon as we have it, reporting live in San Jose, Keith manconi, thank you, Keith, governor Newsom will be meeting with local leaders, including the mayors from 13 big California cities to coordinate a statewide approach to deliver more substantial results on homelessness. Margie schafer reports, this meeting follows the freezing of $1 billion in state funding for homelessness just weeks ago. Governor Newsom earmarked $15.3 billion to address the homelessness crisis and unprecedented amount, but according to the governor's office, the 75 plan submitted to the state would collectively reduce homelessness on California streets from the baseline of 2019 to 2024 by just 2%. It's not an indictment of any individual plan. Some plans were extraordinary, some plans were disappointing rather than cast blame pointing fingers. I decided to take different approach. The approach is to meet with leaders from up and down the state. I'm deeply appreciative of the hard work. And the responsibility. But I'm also mindful that we can't continue down the path we've been on. We've got to do more. We've got to do better. There are expected to be several meetings to address the homelessness crisis, local officials say shutting off expected state funding will severely hamper their ability to open shelters and get people off the streets. Margie schaeffer Casey BS, the contra Costa county sheriff's office says it's been overwhelmed by concealed weapon permit applications ever since a key U.S. Supreme Court ruling on gun rights in June. As Jeffrey shell reports, the backlog is so large, the department has had to increase personnel. First, some background. In June, the court justices struck down a provision in New York State's gun law that required applicants for concealed weapon permits to show good cause, a ruling that also impacts California. Contra Costa county sheriff's office spokesperson Jimmy Lee says since then as a point of reference before the Supreme Court ruling on average the sheriff's office would receive about 20 CCW applications per month and after the Supreme Court ruling that number dramatically increased to the point where we sometimes perceive several hundred a month. The backlog so large the county has agreed to let the sheriffs hire extra personnel. I think we were really surprised at the number of applications. Lee says no matter the number his department bus go through an exhaustive multi step process, including background checks and personal interviews before anyone is allowed to carry a concealed weapon. "We're learning more about what led up to a shooting that left a dog dead in Centreville. Police say it started with a fight between two men at an apartment complex yesterday morning. It appears that it was an attack from one person to another dog. Lieutenant dance petal of fairfax county police says the two men both had dogs with them inside that complex on Conner drive, but there was no sign that the dogs were being aggressive towards each other. He says this was an argument between the two dog owners. Where one of the men ended up pulling out a gun from his waistband and discharged several rounds, aiming for the dog and shot the dog. what that does to them as human beings The reason interesting point your interpretation is that they believed in the mission of what they were doing what kinds of assumptions what kinds of decisions did you and Amanda Seyfried reach in order to figure out how to play their relationship and what they did at that company We had to make a decision fairly early on from our first day of filming together About the depth and the intensity of their relationship What was it that actually bound them together And we were the strange situation where events were happening to the characters we were playing in real time As regards the trial And you know you'd be like shooting a scene and then running over to find out what had happened in the trial which is a unique and very odd position to be in but it worked to our advantage In that text were released between the pair that Liz merriweather incorporated into the text Elizabeth merriweather she's the showrunner for the dropout And I think we breathed a collective cyber relief when we realized that we might have been in the right ballpark in terms of those decisions that we made This is a gamble when you're doing that During the trial the actual trial the real-life Elizabeth Holmes alleged that sunny balwani had been abusive to her which he has publicly denied How did the show deal with those allegations I think we accepted that Sonny would have his day in court And those allegations would be addressed If at all by sunny himself but I think anyone who's seen the show will be aware that there's a certain well if your relationship is imbalanced the drawer is open for all sorts of toxic behaviors that can be practiced by one partner on another and these things can switch You know it's a kind of dance that these people do And I think you can see that in the show absolutely Elizabeth Holmes graced the covers of many magazines There's so much information out there about her much less about balwani What did you know about him And how did you use that to build a performance of a textured character Well the one thing I could empathize with personally was the fact that he was born in the Sindh province of what is now Pakistan To be born a Hindu in a country that suddenly regards you as other than And the sense of displacement having to move To India a sense of rootlessness a questioning of one's identity I felt I could get into that Did you feel that similar sense of displacement was that something that spoke to something in you Yes absolutely I mean obviously I was born in Europe I was born in London So the way I think is is European And he was born in the subcontinent and I know from my family in India that way of thinking and being is completely different So there had to be a shift But I felt that there was a deep insecurity behind what he presented publicly And both of them were quite presentational You've described him in some ways as a lady Macbeth figure Yes Why does he evoke that Because it seemed to me that he was desperately in love with her Even and it became there was a romantic aspect of the story It was how far will you go For the person that you love you know what are you prepared to do And it seemed to me that he kind of went all the way The stakes were very high And just in his support of her it's almost unwavering unquestioning There was very little room for doubt or even self doubt I think maybe that came at the end How invested are you in the story of sunny balwani Are you going to how closely are you going to be following his trial that's coming up and coming weeks Well both Amanda and I felt rightly or wrongly that we become emotionally invested In these people I can't pretend that I'm not going to be watching this trial avidly And that comes from having to inhabit these characters No other reason But just because of having to sort of dwell in that universe of it's so restrictive and tight and like you can't breathe it stifling So just to have that break after you've finished filming and you can think about those broader questions You think to yourself how credulous are people That's what this seems to be about fake it till you make it I think it's more than that
