"The July Sun rose over the Great Smoky Mountains National Park? The beams of light illuminated more than half a million acres of trees. Underbrush an animals. The mountain is part that straddle the border between Tennessee and North Carolina was teeming with life. Don had barely broken and the forest was already inundated with more than a thousand people. They weren't the usual scores of tourists and campers who visited on a daily basis. Now in the summer of nineteen sixty nine. These people were on a mission to find a missing child. Dennis Lloyd Martin. They combed the wilderness and slowly pushed their way through the brush. The Hot Summer Sun beat down on them as they looked for any sign of the lost boy. They'd been searching for days. They were growing desperate suddenly. A cry rose out. The searchers turned their heads was that him was their search finally done. They hurried through the brush to catch up to a member of their party. Who stood looking at the ground? He'd found the first piece of evidence in weeks a series of footprints clearly visible in the underbrush the same size as the missing boys reinvigorated. The searchers followed the trail to the banks of a nearby stream where it stopped. The dead end was the perfect metaphor for a hunt that would stymie investigators and the park service for decades. Who went missing on a camping trip in nineteen sixty nine? He was only out of his parents eyesight for a few minutes before they noticed he was gone. But that was long enough to vanish without a trace. The abrupt and inexplicable disappearance has led some to suspect nefarious forces where play on June fourteenth nineteen. Sixty-nine the Martin family from Knoxville Tennessee suffered every parent's worst fear losing a child during a camping trip. Their son Dennis leftist father's side ever so briefly but in a matter of minutes he was gone and extensive search was swiftly launched more than a thousand Park Rangers Boy Scouts Soldiers Emergency Service workers and even volunteers combed the area for months. In spite of all their efforts. No trace of Dennis was ever found some believe Dennis was kidnapped by a Predator looking in the woods. Others thought that more mysterious forces were at work. Some have claimed Dennis might have been the victim of bigfoot attack. Even more troubling some have suspected the government may dennis disappear then covered it up but nobody was debating conspiracy theories on father's Day weekend nineteen sixty-nine just like most families the Martins had a holiday tradition. The men always went on a long hike in the smokey Mountain National Park. They're favored three point. Three Mile loop took the whole weekend. Trekking through creeks fields and even part of the Appalachian trail. It was the first year six year old. Dennis would becoming on the trip. He joined his DAD BILL HIS GRANDFATHER. Clyde and his nine year old brother Doug according to his family. Dennis was quiet but it was still very energetic. He took his enthusiasm with him wherever he went. Including the hike starting point cades cove and even though he was young he was able to keep up with the ambitious pace on the first day. They conquered an impressive six miles that night. They camped at a landmark known as the Russell field shelter. It was as simple stone hut but it provided a roof and protection from the elements. The family woke up the next day and got back on the trail the ever enthusiastic. Dennis strode at the front of the group setting the pace for the rest of his family. The four Martins had to cover two point seven miles to reach their next stop spence field. This was a grassy clearing on the border between Tennessee and North Carolina. Along the way the Martin's ran into another family. Walking along the same route coincidentally their last name was also Martin Carter Martin and his two sons were from Alabama. It seemed serendipitous. Carter's boys were about the same age as Denis's brother Doug. The kids all got along as they continued hiking around four o'clock in the afternoon the adults called a halt and they all sat down to rest near Spence field. The dagon Dennis continued to play with the two other boys. They read off and out of earshot from the adults hatched a scheme. The mischievous kids wanted to play a little prank when the hike resumed. They'd split up hide in the woods and jump out surprising their parents doug and the two older boys would go off in one direction and Dennis would have the other way it would be a fun way to keep their parents on their toes from their seats at the other end of the field the adults could immediately tell what their kids were planning after all they knew their sense of humor but in the spirit of good natured fun they let the boys go ahead with their plan at four thirty pm the group got up to leave and the kids ran off setting their prank into motion as the adult started down the trail. The first group of boys only hid for a few moments in no time at all. They leaped out of the woods. Xiaoning Boo the. Grownups pretended to be surprised laughing at their Wiley children. However it wasn't long before they realized something was wrong. Dennis was nowhere to be seen his father bill and grandfather Clyde didn't panic. The boy had only been out of sight for about three minutes. He couldn't have gone far. He was also wearing a bright red t shirt so he'd be easy to spot amongst the foliage unconcerned began calling his name. The ever present wind at spins field carried. Their unanswered shouts far and wide but didn't offer response as the minutes past. They grew more worried. The adults decided to split up and search the surrounding area. Bill hurried along the path calling his son's name to no avail a mile down. The trail. Bill decided Dennis couldn't possibly have made it this far after all bill was fit adult spurred by fear and adrenaline. Dennis was only six. He couldn't have gone a full mile in the half hour. They'd been searching empty-handed. Bill retraced his steps back to the others when they reunited the group told him that they hadn't found Dennis either. Bills Breath quickened. He turned around and went West Toward Russell field shelter. Where they'd last camped. Maybe Dennis had gotten lost and hiked in the wrong direction. Bill scoured the two and a half mile trail when the search proved fruitless. The determined father returned to spence field to keep looking. Meanwhile Clyde Martin searched the entire seven Mile Path back to cades cove with a family had set out the day before it was absolutely no sign of Dennis when Clyde reached the trail head. He notified the Park Rangers of his grandsons. Disappearance with the Rangers help the family canvas the area surrounding the trail on foot and in jeeps they searched every possible place. They thought he could be increasingly distraught. They pulled aside every hiker and fishermen they encountered asking if they'd come across Dennis. No one had seen the missing boy by that time. Dennis had been gone for nearly four hours and it was starting to get dark. Bill told the Rangers that Dennis was quiet so he wouldn't necessarily cry out for help however he was friendly and would respond if strangers called his name. The Rangers and family members continued searching but as night fell and new obstacle appeared a storm torrential rain and bolts of lightening rage. That night almost as if specifically cute to interrupt the search. The ground became muddy and difficult to traverse nearby. Streams overflowed the already difficult task of finding a child in the woods was now seemingly impossible. Nevertheless the group continued their hunt. Throughout the night they wouldn't let darkness floods screaming rain and booming thunders stand in their way as the rain continued to pour. Bill grew more desperate. His boy was out here. Somewhere was cold and probably lost or injured. They were all doing the best they could but the efforts felt utterly hopeless and every hour that passed made it less likely. They'd finding Dennis Alive when we return the hunt for Dennis. Lloyd Martin grows and now back to the story. Sometimes a harmless prank turns tragic. That's what happened on June fourteenth nineteen sixty nine when six year old. Dennis Lloyd Martin disappeared. He'd intended to surprise as family by jumping out of the woods with the other kids on a father's day camping trip but he never popped out from the trees. The Martin family quickly began to search coming through the grand smoky. Mountains National Park on the border of Tennessee and North Carolina in spite of terrible weather conditions. The National Park Service swiftly organized a massive search and rescue operation by the next morning chief ranger lease sneddon had a plan. He contacted several groups including the park staff and several volunteer organizations. They were all instructed to be on site by five. Am as dawn broke on Sunday. June fifteenth nineteen sixty. Nine the Organiz search for Dennis Lloyd. Martin was about to begin but the team was unsure of where to start about. Two and a half inches of rain had fallen the night before any tracks. Sneddon had helicopters fly equipment to spence field which became their basecamp. Rangers examined the various trails in the area of the nearby paths. Only one hadn't been investigated the previous day so arranger was rapidly dispatched to search it in the midst of all the commotion. Dennis's mother violet. Martin joined the hunt for her son. Her heart was in her mouth as she saw the dozens of people all pulling together to rescue her. It was encouraging to see how many people cared but the clock was ticking and she feared they were running out of time. She wasn't alone in her worries as the Rangers called for more volunteers. Local news stations caught wind of the story. They sent out bulletins to amplify the simple terrifying message. A six year old boy was missing. Send help the call was widely received the assistance they'd requested soon arrived in droves. Everyone from local firefighters to boy scouts showed up all determined to put the Martin's nightmare to an end. The rescue team flew helicopters overhead scouring the area from an aerial perspective. Gps crisscrossed mountain trails and campgrounds. Volunteers tramp through the woods on foot. The Park Rangers even contacted a United States Special Forces unit. That was stationed in the area. The commanding officer Colonel Howard Kinney ordered forty soldiers to join the hunt bill. Violet Martin took comfort in the ever-growing hunt for their little boy. The number of volunteers was ballooning wildly. Surely they find something soon. But by the end of the first day they hadn't uncovered a shred of evidence all the additional eyes and ears hadn't seemed to accomplish anything. The Martin's spark of hope began to turn into dread even with all of their resources at their disposal. Their search team didn't find their first clue until the fourth day on Tuesday June seventeenth of volunteer search parties spotted a small set of footprints about the size. A six year old would leave. The trail vanished into a stream. One of the prince was barefoot and the other left by shoe when he'd gone missing. Dennis had been wearing Oxford's but the team couldn't tell if the print matched that of an Oxford or a more generic sneaker. The volunteers hastily reported their findings hoping that the more seasoned professionals could take over but their hopes it turned out were for nothing the green berets. Who are assisting with the search. Said they'd already been through that area. They argued that the prince had likely been left by the boy scouts who are accompanying the search parties but none of the boy scouts were barefoot and there was only one set of tracks while the scouts were traveling in groups. Some of the searchers thought they should keep looking near the footprints but they couldn't find any other sign of Dennis with this potential lead ruled a dead end. The search teams abandoned. That clue an looked elsewhere on June twentieth. Nineteen Sixty Nine. Dennis's seventh birthday passed with no sign of him. The rescuers were getting discouraged. That Day sneddon gave his team new instructions procedures to follow if they found Dennis dead. Dennis had been gone too long and there was no sign that he was still alive. No one could say what had happened to him. But the prevailing theory was that he'd gotten lost and was killed by wild animals after all the park was home to boars bears and other creatures that could make quick work of his small child moreover it would explain how he disappeared so quickly. Predators are expert at stalking and striking in silence. If Dennis had stumbled upon a hungry bear or Mountain Lion. He wouldn't have stood a chance in light of this possibility. The park Rangers adjusted their tactics. Every piece of animals Scott they found within the vicinity was scoured for human remains. But once again there was no sign of Dennis but not everyone had given up. Hope of finding him alive. Many so-called psychics called the National Park Service to offer tips several reported visions and dreams of finding Dennis. One of these mediums was Jean Dixon of Washington. Dc who alleged she previously predicted the assassination of John F Kennedy while no one was able to verify her claims. She still liked to weigh in on well-publicized mysteries when she called the National Park Service. Dixon said that she'd had a vision. Dennis still breathing. The search party would find the lost boy a waterfall. The searchers investigated the dubious lead in the hope. It could lead to something. And fortunately for the Martin's it didn't others. Psychics kept calling in or even showing up at the park but they only provided marginal insight for instance one medium claimed that the searchers should stop looking at the ground and instead look in the trees. The Rangers didn't find any of these tips helpful but bill violent Martin insisted they. At least here's amount. Surely any lead was better than nothing at all and since the parents were taking them seriously the authorities did as well. Every lead was another spark of hope. They'd kept the family optimistic but none yielded any results. At least not until the second week of the search on June twenty-fourth young boy was spotted on a trail by some hikers. He was in a bright red t shirts and green shorts. Just like what? Dennis had been wearing when he disappeared. The park service leapt into action. Maybe Dennis was alive and well after all but after a short investigation they determined. This was another young boy out on the hike with his own parents as the disappointments in red herrings kept mounting motivation waned on June twenty-first fourteen hundred ball in tears participated in the search by June. Twenty six that number had dwindled to sixty eight three days. Later on June twenty-ninth the formal search finally came to an end while some volunteers chose to stick around. The Rangers packed up their base at Spence field and the bulk of the search party was sent home. Dennis's family didn't give up hope though under advice from the FBI. They posted a five thousand dollar reward for any information that would lead to their son's safe return. A small search persisted for months Rangers. Continue to investigate every tip or a potential clue. Maybe something had alluded the thousands of volunteers but as the summer ended so did any hope of finding the boy with heavy hearts. The Rangers finally closed the case in September nineteen. Sixty-nine the hunt for Dennis. Lloyd Martin head involved more than fifty agencies and cost an estimated two hundred ninety thousand dollars worth roughly two million dollars today but although the search was over the mystery endured since Dennis's disappearance rumors and theories of cropped up all trying to explain what happened to the boy some like the Martin's insisted that Dennis had survived somehow. His parents founded to think about that. Their child could die without them knowing instead. Bill and violet began to argue that their son had been kidnapped. The FBI investigated throughout the summer of Nineteen. Sixty-nine they made inquiries in the Great Smoky Mountains area then in July. A man named Harold Key from Carthage Tennessee contacted the National Park Service with a major tip. He claimed he and his family were camping in the park. On the same day the Dennis went missing and they saw something suspicious as they set off for their trek they noticed only a few other cars in the parking lot including a white Chevrolet. Hopefully this meant there wouldn't be too many people on the trail. Sure enough key and his family found the woods quiet and peaceful at least at first then. They heard a blood curdling scream from the trees. It sounded like a child keys sprinted in the direction the cry had come from often the distance. He barely caught a glimpse of a tall unkempt man moving through the underbrush. The man looked like he was trying to hide. He ducked down low hunching behind plants and bushes but although key didn't get a good look at the man he could tell. There was something slung over his shoulder. Something about the size of a small child key didn't confront the man. It seemed too risky after all. He was with his family but he waited for what felt like a safe amount of time then walked over to where the man had been. He found a crude map on the ground. But no other sign of what he'd been up to. It was definitely an unnerving experience but odd things happened in these woods. All the time key shrugged the encounter off and tried to put it behind him when they finally made it back from the hike. The White Chevy in the parking lot was gone key. Claimed he initially thought the figure was a moon shiner or someone smuggling and after all the Martin's hadn't reported their son missing yet so he couldn't imagine what else the strange figure had been hiding. It was only later when he heard the story of Dennis Martin. The key began to suspect something more nefarious. The Rangers took this report seriously. But it didn't quite fit with the events as they understood them. The suspicious citing had occurred six miles away from where the Martin's lost their son. There were no trails connecting the two locations so if someone had traveled those six miles he would have had to do so cross. Country on top of that key. Couldn't remember what time his family had encountered the suspicious figure so the investigators couldn't establish a clear timeline or reconcile it with Dennis's possible movements and worse still the area where Herald keys spotted. The mystery man had already been picked clean by search parties. Any clues that may have been left. There were either already found or inadvertently destroyed. Nevertheless the Rangers couldn't rule out keys testimony entirely. Especially because the timeline was so fuzzy and impossible to disprove they relate his report to the FBI but the bureau didn't have enough evidence to conduct a full scale investigation with no information apart from a compelling story. The team deemed it an unrelated incident yet. This wouldn't be the last time the FBI received a tip related to kidnapping nearly a year later. In July nineteen seventy chief wells of the Greenville Tennessee. Police Department received an unexpected phone call. It was an anonymous tip from a woman who claimed she'd seen something related to Dennis. Lloyd Martin. She'd seen a child poking his head out of the window of a car. The anonymous woman said this happened in the Martin's home town of Knoxville. Only fifty minutes north of the park and there was another kid in the car with him. The car was driven by a balding man who looked to be between thirty eight to forty five years of age. The vehicle had Tennessee license plates but the caller couldn't remember the number. She didn't know the or model of the car either but she did mention that it was white white just like the. Chevy the key had seen. Unfortunately the report gave the police practically nothing to work off of the chief passed the information onto the national park service but the tip didn't go any further. The kidnapping investigation never developed beyond a handful of questionable reports and speculation. But it does make some sense. A kidnapping could explain the lack of evidence that a six year old would otherwise leave had been lost in the woods but the biggest problem is the timeframe. Dennis had only been out of sight for three to five minutes before the adults noticed he was gone and abductor would need to have nearly superhuman precision to strike within such a tight window after all he didn't snatch Dennis from a crowded public place. The boy went missing from a remote trail. Far from civilization. This theory would require kidnapper to just happen to be in precisely the right place at exactly the right time to grab Dennis and run. That possibility seems incredibly unlikely. But even if Dennis wasn't kidnapped his disappearance was still highly suspicious to this day. It's hard to explain how he slipped away from his family in a matter of minutes or how he avoided leaving a shred of evidence that leads some to wonder if someone intentionally hid the truth about Dennis someone or something like a secret government program up next we'll explore whether clandestine military operation may Dennis Lloyd Martin Disappear now back to the story six year old. Dennis Lloyd Martin Vanished Une June fourteenth in sixty nine in the great smoky. Mountains National Park. Even after the most hunt in the park's history no trace of him was found over fifty years later. People still don't know what happened. Something he was eaten by a bear others believe he could have been kidnapped and still others. Think that there's something more conspiratorial at play. Dentists disappearance became a sensation in two thousand twelve when retired police inspector and bigfoot truth is David Politis published his book missing. Four one one. This work detailed the stories of people who'd seemingly vanished including Dennis Politis highlighted the peculiar fact that special forces were dispatched for the hunt. The official story is that the Green Berets were coincidentally training in the mountains at the time after a request from the Rangers there. Colonel dispatched forty men to aid in the search but Politis argued there was no reason for the US army to become involved with a search for civilian child unless this will something bigger than a normal disappearance as further evidence that something nefarious was going on. He cited an interview with retired. Great Smoky Mountains Park Ranger. Dwight mccarter mccarter stated. The Special Forces members were distant and uncommunicative. It was like they were keeping something from the other volunteers. Maybe they even had goals that. Were at odds with the larger search efforts in addition in missing for one one. Politis reported that the special forces rescuers were armed with machine-guns made no sense. Why would they need weapons to search for Missing Child? What were they expecting to find? And why wouldn't they discuss? Whatever was really going on. Politis suggested that there was something in those woods that the government had to keep secret. The Green Berets weren't really looking for Dennis. They were destroying incriminating evidence. He's less clear about what secret? The Green Berets were trying to hide. It could have been in Cold War military operation or it could have been bigfoot. Police didn't seem to have any specific theory. Just something suspicious was going on. That vagueness makes difficult to assess. But what really dooms that? Theory of a government conspiracy is Politis himself. Many of the claims in his book were factually inaccurate. For example he argued that search dogs had refused to for the boy. This wasn't true. The official Park report said they didn't even have dog scouring the area they knew it would be too difficult to follow a scent after a rainstorm. Moreover his assertion that rescuers were carrying machine guns was false. The Green Berets were either unarmed. Or had their standard issue sidearms on them but is still reached. An audience in his book sparked countless online conspiracy theories something about his arguments. Head struck a nerve. The disappearance of Dennis Martin was so confusing so tragic so frustrating that people had to craft some story to make sense of a senseless event over the years. Many have come forward with potential solutions. The case in one thousand nine hundred eighty five. A ginseng Hunter reported that he'd found a child sized skeleton under a tree years before thirty. Men searched the location he reference but found nothing however by the time they carried out. The sweep weather and animals could have had more than enough time to destroy the remains. This tip proved to just be another dead end with no solid breaks. All we have left are guesses and the National Park Service. Sticks to the likeliest story that Dennis Martin's simply got lost then. He was alone without shelter when a vicious storm struck. It's likely that Dennis Lloyd Martin passed away from Hypothermia. After all the temperature drops steeply that first night in the torrential rain. The poor boy's clothes would have been soaked in frigid water. He wouldn't have been able to keep his footing in the slippery muddy darkness. The idea of this wet cold child. Dying alone in the wilderness is a horrible thought but even more unpleasant is what became. Dennis's body it could easily have been washed down river or buried in the mud. We can only guess as to what wild animals might have done to it. In the subsequent days now fifty years later there's too much topsoil for even the remains of his remains to be found and nature wasn't the only factor that destroyed evidence at its peak the hunt for Dennis involved fourteen hundred people with varying levels of training background and experience. After they spent two weeks canvassing the area all the clues could easily have been trampled or destroyed if the search had been smaller and more focused. They could've avoided sloppy mistakes. For instance there would be less ambiguity around the child's footprints leading into the stream instead the what if S- remained for years after Dennis went missing his father. Bill Martin passed away in two thousand fourteen. He never learned what became of his lost boy. And it's almost certain no one ever well but this tale of tragic loss does have a silver lining. The search for Dennis Martin ended so anti-climactic -ly it weighed heavily on the park. Service's collective conscience. It's burdensome them to re evaluate how they handled missing persons cases back in nineteen sixty nine the customary way to conduct a search wis to throw volunteers into the area. They play the numbers game until eventually someone found something since the Dennis Martin case this method is no longer considered. Reliable teams are trained to focus on looking for clues first before searching for the missing person. The Rangers describe it as working smarter rather than harder and importantly they know not to flood the scene with hundreds of good hearted people who might not have the experience to pick up a trail after half a century. Dennis Lloyd Martin is presumed dead but his legacy is a positive one. His story has helped other loss. Children find their parents though. Kids still get lost in the woods. Trained professionals are better at making sure. They don't stay that way and reunited families can thank Dennis and the lessons. The National Park Service learned from him for their happy endings. "Folks welcome to first Thursday the monthly podcast from the Labor Relations information system. My name is Willie Aitchison. I'll be your host for the next 45 minutes or so while we talk over recent developments in the world of Public Safety labor and employment relations. I want to start with a few housekeeping items. First of all, we've released our first complete webinar series 1 on Grievances and arbitration you can find it on the Elder is website. We recorded them live with people participating using the chat feature on our meeting software, but you can still download them and listen to them and of course, we'll answer any questions you might have about those webinars off in the middle of a week and which were doing a six-part webinar on the rights of Law Enforcement Officers. It's in conjunction with the release of the 8th edition of my book off. The rights of Law Enforcement Officers. I have recorded webinar so far this week on the police Reform movement the Garrity Rule The Wine Garden Rule and 1 a.m. On the increasingly important issue of the sources of the law where law enforcement officers and by extension firefighters and all public safety employees where they are turning to find law that they think is more to their benefit and there's some very surprising developments there tomorrow and the webinar. I'll be talking about the right to privacy constitutional right to privacy and in the afternoon, the always-popular fair labor standards act also on a more personal I hate to report this but last Thursday, our office was attacked again, you may remember that about two months ago. Some people came by and birth Bricks Through the plate-glass Windows of our office and spray painted on the walls and actually on a garage doors in large red letters backwards k k o p lawyer scum. I had happened a couple of months ago last Thursday, they came by and broke all the windows. They hadn't broken the first time and they've also threw a smoke bombs at the office one of them made it into the office through a broken window. Thankfully it it landed in a cast iron tub. So it didn't catch the office on fire. Although it charged the windowsill and the light that's all of course deeply deeply disappointing that this is Jose where we are in the world today, but even beyond that what what's been demoralizing to me as I went on social media and saw, Need an Engaged with some people on social media and it's frightening to me that there are people who are out there who otherwise might be reasonable human beings thousand. Thanks that attacking my office is perfectly permissible because of who I represent. I wonder how I feel about criminal defense lawyers who represent people charged with murder. This is I don't mean to elevate the word Too High by comparing what is going on here to other uses of the word volt but attacking our office and making it clear that you're doing so because we represent police Unions that's an act of terrorism right? It's meant to use fear to drive us out of the business of what we do and I find that absolutely repulsive and the notion that this is where we are in our society off. Very deeply disturbing anywhere. Just wanted to share those thoughts with you. Obviously, it's just not going to they can attack this office as much as they want. They can burn it down not going to change what what we do and what we dedicated Our Lives to do but it is something that it may put a little bit of a somber tenor on this podcast that I'm not normally have before I get into the cases. The last thing I wanted to talk about was a feature of yes, I'm recording this on Wednesday yesterday's election at the time. I'm recording this. We don't know who the next president is going to be. Although it seems to be the votes seem to be shifting as they're counted. In fact sconsin and in Pennsylvania and several States still being counted in Georgia and North Carolina, Arizona, Nevada and all of those wage And determining who our president is it's looking increasingly like it's going to be President Biden, but we already know that President Trump is now to challenge that election. So we talked for quite a bit of turmoil. I don't want to talk about any of that. I had said want to talk about the ballot measures that were out there on police issues and I'm not going to talk about all of them because there were dozens of them around the country, but I do want to talk about the theme and the theme is that these ballot measures are passing. Let me give you some examples and California is like the biggest one is a move to partially defund the Los Angeles County Sheriff's Department by transferring money essentially from the sheriff's department off to require investments in housing mental health Alternatives and and all sorts of people who are going to be creating these businesses to help in those areas wage. It's a huge transfer. It's a transfer of at least tens of millions of dollars if not hundreds of millions of dollars in a past in Los Angeles County by a 57 243. Margin. That's a massive Los Angeles County while it was up decided to elect a reform district attorney prosecution. So that's a life is going to be different there and across California. He saw similar results Oakland passed a ballot measure to strengthen its already existing a billion Review Board San Jose expanded the authority of an auditor that they already have giving subpoena authority to an oversight board and the leg off and and and it's not just California. It's all over the country in Columbus. The voters passed a measure to create a civilian review board and the position of Inspector General. Here in Oregon in Portland, but voters overwhelmingly passed a city Charter amendment that would create a new citizens review board that would have the authority to discipline and fire officers. The night is young on that because there's of course very likely to be challenges to that. I'm not going to disclose any more about that obviously off even down in Texas the small City. It doesn't have fifty thousand people of Kyle Texas voted to create a civilian review board by a 90-10 marja and then up in King County, which is Seattle's county in California a very striking vote to change the office of the sheriff from being an elected Sheriff got appointed sheriff with the notion being you have more control over an appointed Sheriff try to wrap your brain around that for a moment. We want to deprive ourselves of the ability wage. To elect a sheriff so that we can get more control over a sheriff who other people are point what's going on is is very clear to me. And that is that if you put something that is labeled police reform on the ballot in many parts of the country. It's going to pass and it does not matter what the contents of it are it is going to pass. It could be illegal and some of these clearly I think are illegal to think the Los Angeles County measure ballot measure off illegal. It doesn't matter if it's well-written doesn't matter if it's good policy, but the words police were formed it's going to pass and this is a hard bringer of what I bought a 2021 is going to look like speaking now just to the police unions you need to be out there and you need to be changing the way you're doing business wage. To be engaging and all levels of the community need to be engaging with people. You don't agree with people. You may dislike and you need to be engaged in politics at the state level in your legislators so that you can deal with police reform issues in the legislature some of which are introduced and passed on the same day. You need to be there in advance preparing yourself for this sort of thing happening and you need to be engaged with your local politicians. If you are a police Union in this country and you are not meeting with everyone of your city council members multiple times a year, you are not doing your job. This doesn't mean you sit down you talk to him about Police business police were form or any of that sort of thing. You can just go down to the local socially distant Starbucks or wherever you might go and just sit down and talk about what Lewis Carroll used to call log. Which is in Kings you need to build a relationship because without those relationships these sorts of things that passed yesterday are going to be done to you. You need to be a participant in the discussion. It is no longer good enough to stand off to the side to emulate what you see from some Bank City police unions who were yelling and protesting and saying all of the politicians all of the people in this area of town hate us some working and we are saying fundamental changes in law enforcement. A lot of these changes are terrible. A lot of them are going to drive good people out of law enforcement. I need to make sure that the changes that happen in the future are not just labels that are put on things that are substantively positive and sound off. Okay little bit of our rant over there. Now. Let's turn to the cases. I want to start with a couple of breeding cases that have come out there a little bit off different and some Brady cases that we say certainly the first one of them has and the first one comes out of Massachusetts. And this is a big decision in Massachusetts comes out of a quart that's known as the Massachusetts Supreme Judicial Court. That's the Massachusetts Supreme Court and here's what's going on. In this case. It involves the city of Fall River, Massachusetts. And in particular two officers are not named in the Court's opinion. I'll just call them the officers. They were present back on another police officer Michael pessoa used Force to arrest an individual in February of 2019 pasilla submitted an arrest report concerning off. Rest, but the other officers did not not a few hours after the arrest the officers were ordered by their supervisors to complete a standard form that the police department uses. It's called the use of Defense tactics report and why because when the recipe was being booked at the police station, he had a bloody lip while each of these officers created this firm, they wrote out the form and they in essence adopted pasillas version of the events as set forth in his incident off and what Priscilla said was that the arrestee was non-compliant threatened to punch the officers and then was taken to the ground by pasilla and making the arrest and that sell to cut left happened off the arrestee ended up getting charged with a variety of offenses including resisting arrest and in the course of preparing for trial the defense attorney came up with a video game. Shape up surveillance footage that showed the arrest and bacillus use of force. The defense attorney gave that to the district attorney who look at the video and said, we've got a problem the footage of the incident was completely inconsistent with the description given both by Priscilla and the officers home in their various reports and what they showed was that the arrestee was completely compliant when when one of the officers were moved his handcuffs, but I was struck the arrestee on the left side of his head and shoulder area which caused the arrestee to be taken to the ground in a violent manner. So what does the DEA do the DEA initiates a criminal investigation into pasilla and that investigation culminates with the grand jury and a grand jury in Chicago Heights puts AR-15 separate counts in the indictment for conduct involving four separate arrestees and a charges range things like assault and battery by means of a dangerous weapon civil rights violation witness intimidation the list kind of goes on and on during the grand jury the district attorney subpoena see officers to testify and both of them came in and they asserted their rights for self-incrimination and the DEA is not going to let Founders lie there what it does is he files a couple of motions and trial court. It's called Superior Court in Massachusetts. And in the first motion the DEA asked Authority from birth. For it to disclose information from the grand jury testimony to defense counsel. In other cases where either pessoa off or the officers would be potential Witnesses and the cases and you can imagine what the DEA said in the motion. They said look I'm obligated to make these disclosures under Brady wage. I got this information in Grand Jury and grand jury proceedings are secret. So I need you Court to authorize me to make this disclosure and in the second motion district attorney asked for an order authorizing the disclosure of the information to the police chief in Fall River and that results in litigation and the whole cable ends up before The Supreme Judicial Court, and the the the court ends up saying the D A should make these disclosures and you know, what the dog? It doesn't even really need to ask us the court says we're prosecutor determines that a police witness lied to conceal another officers, exclusive use of force. The prosecutor has an obligation under Brady to disclose that information to defense counsel. In any case where the officer is a potential witness or prepared even prepare to report in the criminal investigation and the court goes on to say if you're going to make this disclosure to defense counsel. Obviously, you can make it to the police chief or the police department. Why here's what the court says the consequence of such disclosure is to jeopardize or at a minimum complicating a successful prosecution of any criminal case where the officer played a significant role it would make no sense. The court says for the prosecutor and defense counsel to possess off. Misinformation and for the police chief to be deprived of the same information, of course goes on to say that the chief needs this information to decide whether to discipline side of the officer, but they officer on desk Duty maybe take other steps to preserve the Integrity of the department and it's very clear that disclosure is permitted off the court concludes by saying because the disclosure arises from the prosecutors Brady obligation and I'm quoting here. No prior judicial approval is required to make this disclosure, even if it arises from immunized Grand Jury testimony. So what you're saying from this cord is the sense that and it's prompted by of course terrible facts in this case apparently obvious dishonesty on the part of three officers if in fact that video, Tape showed what the Court's opinion says it showed but you're saying the court react to those terrible facts by saying you can disclose without even being involved and the significance of that is that if a court is not involved then the officers whose testimony is going to be disclosed may not even know that their testimony is being disclosed. I think of this I think the whole issue of Brady and we case law is developing under Brady think of this as maybe extension of the police Reform movement. We are going to say we are going to say brady disclosures expand not contract in the future home and in some places we're going to see the police reform statutes that are being considered by and pass by state legislatures. We're going to see them include man dead. Or A disclosures him perhaps even we've seen it with some of them public disclosures Brady type material. For next case is another Brady case that deals with prosecutorial immunity in on Brady issues. And I think it's the same theme and the theme is Thursday. We want more not less in the way of Brady disclosure. It's because when you read the Court's opinion in this case, it looks like some pretty clear overreaching by a prosecutor. Let's see what you're saying can just a moment and the court nonetheless. The prosecutor is immune from loss of so what's this case all about? This comes out of Tennessee. And this is by the way a federal court of appeals opinion. So it's pretty significant working for the Fairview Tennessee Police Department is Latoya. Dale and Lieutenant Softail becomes concerned about the Department's relationship with a couple of private security firms and in particular he suspected Thursday. Armed officers had falsified documents to obtain secondary employment with these private security outfits. He related these concerns to Kim help her home. She's the district attorney for Williamson County in Tennessee, and he he told Ms. Helper that the wrongdoing had reached a whole new level and asked help her to refer the matter to the state to the state Bureau of Investigation. Well two weeks later the police chief announces his retirement age help her decide. She wants to get involved in who the successor is going to be to the chief even though she's a County employee and we're talking about the city police department her thoughts about who should be Chiefs did not achieve did not include Stockdale or a fellow Lieutenant a new tab by the name of Shan Dong. Both of whom she described as quote want to be Chiefs unquote. She sent a text to an associate offering to go to bat for her candidate and texted me that God help us if it's Dunning or stop tail a few weeks later the city of Fairview Board of Commissioners holds a meeting and the city manager requested off the meeting that the Williamson County Sheriff investigate the police department. And in fact, what what the city manager wants is an investigation turns out of Stockdale and Dunning because he plays his stopped Dale and Dunning the two lieutenants on administrative leave. This is a little complicated stay with me trying to get the ball on this one. I had to read this opinion a couple of times for I figured out what was going on. So the setting manager but stopped Dale and Dunning to the DA doesn't like on administrative leave off. Why don't they just call her the DEA the DEA tells a colleague of hers that her candidate now has a better shot and the sheriff's department ends up issuing a report that image is allegations of criminal conduct the criminal conduct that Stockdale used a credit card to break into a building and then assaulted someone that's what the sheriff's department reports. However, the DEA doesn't bring any charges against anybody stop tail and Dunning the two lieutenants and see the city and several other people and they are essentially off a legend was so blowing because here they say look we reported this problem with the falsified documents and the private security outfit and we been retaliated against we've been placed on administrative leave because of this and in the interim while this lawsuit is pending old city manager goes away, New City, New Jersey. Major is hired a new city manager looks at the sheriff's department report and says unsubstantiated and that the report did not justify taking any action against either of the lieutenants. So the lieutenants are then reinstated by the city manager now kind of in the background the detective the sheriff's detective who led the investigation is texting and with the DEA. This is really small town. And and I'm I'm guessing a Small Town Tennessee, maybe really small town right and detective texts the DEA saying hat and shame that the two lieutenants will get dollars the DHS. How are they getting dollars? They've been on paid leave and the detective explained that the lawsuit had been off. Don't help her d a response. Thanks. I still won't take their cases. So not sure how that getting the dollars will help them and not only that writes the city manager a new city manager and says, you know, we have concerns about the reports of of lieutenants of dining and stay off them to officers in her message. So we're going to be required to turn over that Sheriff's investigation. The one that you've concluded is unsubscribe unsubstantiated. We're going to turn that over to any criminal defense counsel in a case where the lieutenants are involved and without corroboration from another law enforcement officer. Their testimony could be impeached the new city manager showing his spine or lack there of birth. Says look I disagree with your assessment. But if you're not going to withdraw. I'm going to fire the two lieutenants any does any explains the email is the sole reason so the two lieutenants then sue the DEA and the city they settled their claims against the city. They probably got more dollars. I would think and that left a First Amendment claim and various state law claims against the district attorney the First Amendment claim if she's retaliating against again because they are whistleblowing little bit of a problem with that lawsuit because she's not the employer and usually only employers are responsible for damages for whistleblowing but never mind that the case ends up at the 6th Circuit Court of Appeals and it has to decide is the DEA. Mm. Yep. From Lawson for placing the two lieutenants on her Brady list and the DEA says number one. I'm entitled to Absolute immunity because prosecutorial immunity immunity given to prosecutors for decisions. They make in their role as prosecutor that is absolute immunity. That means are emotionally our immunity is prosecutors can't be lost. Even if we act maliciously even if we do things that are dishonest we still have absolute immunity and the court says too far the key to prosecutorial immunity. The court says is advocacy whether or not the prosecutor is taking actions and question as those of an advocate and that means it has to be connected with the conduct of a trial or administrative conduct that is leading up. Like trial and the court says and I'm quoting because with Grant absolute immunity only sparingly officials seeking its iron-clad protection bear the burden of showing that qualified immunity does not suffice and then in a line This is a bizarrely written Court opinion. It's almost colloquial and the way it is written down. Here's the next line You'll see what I mean. The court says and I'm quoting this is a direct quote think of qualified immunity as a face mask and absolute emotionally acid vaccine with the presumption that qualified immunity is fit for the job. So the court says no absolute immunity for UDA. Now, let's turn off qualified immunity. This is the same qualified immunity. That is the subject of all the police reform discussions around the country and the Defence of qualified immunity dog. I see if you have a Public Employee the DA's a Public Employee violated constitutional guarantees that were clearly established at the time the public employee wage active. So the court says question here is when the DEA put these two lieutenants on her Brady list and communicated that fact out to their employer in seemingly, a deliberate attempt to get them fired. Was she acting on the basis or did she violate constitutional guarantees that were established and the court said no, she did she is shielded by by qualified immunity. Why even though the same thing happened to look at the law before she did what she did what she would have seen had she looked at the law is a quote off. Angle of cases about absolute immunity most of which favored the prosecutor that it is taken us numerous pages in the federal reporter to make sense out of the issue sends a signal that liability is far from clearly established. Ask then says the court what the DEA would have seen when it comes to retaliate she claims and the liability of decision-makers city manager versus non decision-makers the d a recall that she did not have the authority to fire the Lieutenant's she was not the decision-maker that matters and the court says she shielded by qualified immunity off there for the Lieutenant's lose their lawsuit against the district attorney. It's a pretty over over eating Behavior by the district attorney right off. This is the sort of stuff that you would think would be the basis of a lawsuit but it's not and as I keep returning to the exact same where I think going to see more and more of this more Brady disclosures and more protections given prosecutors for making Brady disclosures, even when the prosecutors are behaving badly as in this case. I just realized I don't have any firefighter cases for you this month. It's a couple of reasons for that. First of all, the flow of Court opinions has significantly slowed down and I think that's an impact of the pandemic I think courts are just simply greatly greatly backlogged and they're not getting to their opinions and second life firefighters are just you know, increasingly a much less litigious than law enforcement officer. So just not that many cases when I say the flow hedge has has slowed down normally on any given day through search strings that we have created on Westlaw, which is our legal research service off any given day. I might have to read as many as 15 20 25 Court opinions 7 days a week fifty-two weeks a year off. I mean they just the opinions just keep on coming but the word read and quotes because many of them you can scam and decide whether or not they're useful or not useful now. I'm I'm down to 5 to 10 opinions in a day and it seems to be staying at that level. So we just don't have as many decisions coming down as we used to get ready wants the Dam breaks for just an overwhelming number of cases. So with that my next case is another police case and how long I realized in picking the cases. I want to talk about this month. I realized that have been a long time since I talked to you about Garcetti vs. Ceballos and amazing case that the Supreme Court decided more than a decade ago an amazing case that pretty much says that public employees wage. Have no free speech rights associated with their jobs for speech that is related to their jobs. It's not quite that broad but it is fairly broad. The specific holding in Garcetti is that if a Public Employee engages in speech that arises out of their job that speech is not protected by the First Amendment without regard to the content. It doesn't matter if that speech is of the utmost public importance wage does not matter if that speech is true. It does not matter if that speech is about corruption or is it the nature of whistleblowing off now First Amendment the Supreme Court told us does not provide employees protection if the speech arises out of the job. Now Garcetti is a court opinion. It's going to be with us for a long time. It was a 5-4 decision when it was issued with the five conservatives on the Supreme Court aligning of the majority. And today. We have a 6 to 3 conservative majority on the Spring Court. So expect Garcetti to be with us for a long time particularly since June of the members of that six person Court majority are very young. So what is what what is this new case that's come down. But I want to use straight to the scope of the Garcetti decision. This comes out of Michigan comes out of Saginaw County and Michigan and it involves a detective who sees a used $22,583 in cash detective John Butcher sees that much money in cash during a Narcotics investigation off. Suspect agreed to Forfeit the money seized from him in lieu of formal civil forfeiture proceedings of the detective detective butcher deliver. The money to Garrett device and device is going to be the plaintiff in this case is a deputy sheriff who is the Department's property and evidence office manager. So the wise takes the 23,000 or $22,583 in cash and he books it as evidence or somewhere. He made them logs inappropriate like a few weeks later butcher comes to device and says look, I'd like $2,000 for that money to pay for confidential and informants and controlled substance buys the wise refused. He said this not what this money is for. I think this uses improper, but then all the tenant intervenes and orders to wise dead. The undersheriff Who would have normally prepared that report was out sick. So the wise had to go around and get some in fact Relating to the prior years forfeiture and communicate with the state about that issue when compiling the information to wise. Once again off the whole issue of the forfeiture money and decided that it had been mishandled and he did his own research and he determined that civil forfeiture funds had to be deposit with the treasurer or with the county itself, but the funds from the the bus that that butcher deposited off, we're off the books to his mind meaning they wouldn't be accounted for in the annual report device became afraid that this was going to reflect poorly on him because the report wouldn't balance off with the forfeiture data and it became to believe that butchers actions were illegal so twice then meets with the finance director and during the meeting. The wise talks about these forfeiture monies and and in response to that meeting the department emotes you waiting for me to save your Archer. They demote the wives from his role in the property room. The device eventually leaves the department for a position with a different police agency and files First Amendment retaliation claim against accounting and the question for the federal sixth Circuit Court of Appeals under Garcetti vs. Ceballos. It is a pretty straightforward one. When do eyes met with the finance director and disclose all of his concerns about the use of the forfeiture money. And that's the meeting that often appears to a prompted his demotion were his statements made in the course of his job as a deputy sheriff if they were under Garcetti job. Statements would be unprotected by the First Amendment. And and now I'm going to quote to you from Garcetti. So you know how broad this is Jose under Garcetti quote when public employees make statements pursuant to their official duties. The employees are not speaking as Citizens for First Amendment purposes and get ready and the Constitution does not insulate their Communications from employer discipline the 6th Circuit Court of Appeals looking at that says, you know, you got to consider all the factors of the speech you got to look at what the motivation was for the speech what the setting was what the subject matter was who the audience was your the motivation was device was concerned with his professional reputation and whether he was doing his job and that means his speech was quoting animated birth. Are more biased role as an employee than a member of the public at large. The setting was a meeting to discuss the financial practices the sheriff's department and the audience the finance director both of those suggest that this was part of the wisest job to be sure the meeting the finance director was not one of these devices direct supervisors and the court admits that speed us at speech outside. The chain of command is less likely to be protected but the court says the most important thing here is that he communicated this information pursuant to his official job duties and because he did The speech is unprotected by the First Amendment and it was perfectly permissible from the perspective of the First Amendment to demote the wise now might do eyes have had other job protections. Maybe the opinion doesn't indicate whether it's covered by a collective bargaining agreement nor does it indicate of whether he was covered by Civil Service. He might have had some other job Productions. What he does not have is a First Amendment law suit and the court ends its opinion with something and forgive me if I'm being cynical, but what I think is a cynical comment and I'm going to quote from the Court's opinion in reaching the outcome. We do not question devices motivation nor do we condone disciplining public employees for raising concerns about government mismanagement or corruption? But in this public employment setting laudable intent alone is not enough to secure first amendment protection. And of course, right that's what our society versus ceballos says. Want to close this podcast with a case another case that comes to us from Michigan and it deals with a question that you said arising a lot in discrimination lawsuits race discrimination gender discrimination, whatever they form of discrimination might be under discrimination statutes, whether it's title 7 of the Civil Rights Act or whether it's a state anti-discrimination law, one of the things that he bought a plaintiff someone is complaining of discrimination must prove is that they suffered adverse employment action or suffered from an adverse employment action and a question that you see come up with a great deal of frequency in these cases is what is an adverse action. What is the Efficiently adverse to support a discrimination lawsuit, in this case, which comes out of the Detroit Police Department wage raises the question of whether a reprimand a written reprimand is enough to base a discrimination lawsuit upon is it sufficiently an first so what's going on here this case involves a police officer by the name of a dealer green green is African-American. She supervised by Lieutenant James cashen home who is white on April 16th of 2016 green and her partner were dispatched to address debris that was falling from an abandoned building somewhere off in Detroit. And that was great and got traffic Hazard kasham gets to the same first. He deploys barricades to block a lane on Michigan Avenue in Detroit wage. Big big thoroughfare and according to his activity law cashen has a conversation with green and her partner when they show up about taking too long time to block traffic when a better course of action could have been taken well in that interaction. They there are different versions of the interaction with green says cash and grabbed her arm and berated her that she broke loose from his grip ran around to her police car and sat inside that cash followed her to the police car squatted down grabbed her by her thigh and her arm and began violently shaking her as if he was trying to pull her out of the police car back later on not at the moment, but actually some time afterward green expands on this and characterizes the incident as cash and touching her quotes. Inappropriately on my upper thigh and my vagina greens police partner who was sitting at the car at the time largely corroborated woodgrain had to say so an internal affairs investigation has cranked up and after interviewing everybody and looking at a number of documents and the the internal affairs investigation concluded that green not cashing should be disciplined that the charges against a cash and should be dismissed off and green should be disciplined for exhibiting insubordination and disrespect to our ranking officer when she walked away from cashing at the saying telling him. She didn't have to listen to him and a family to truthfully answer all questions when being interviewed by is a part of the problem was of course the greens description of what physical job Happen would pretty much have been impossible given the police car in question cash and wouldn't have been able to reach in in the way that she claimed green initially get sort of five days suspension. I looked at that and I thought wow that's interesting insubordination, disrespect and untruthfulness. And you get a five-day suspension wage at five days suspension was reduced to a written reprimand solely for the issue of insubordination. They do things differently in Detroit, but I'll tell you I've been the Pacific Northwest your insubordinate you probably getting something north of a written reprimand. Well green is not happy with her written down a man and she files a lawsuit not under title seven, but under Michigan's anti-discrimination law and she alleges in part. She had a lot of claims in this lawsuit that are wrong. Man was the product of race and sex discrimination and the case goes to the Michigan court of appeals and the court says we can toss this case out pretty often and the reason is because the reprimand is not sufficiently adverse to support a discrimination lawsuit off. The court said look it's possible a written reprimand could be sufficiently adverse. It depends upon what the consequences are. The collateral consequences are the written reprimand, but it's also possible that a written reprimand is not sufficiently adverse if there are no Cracker Barrel consequences. So I'm going to quote to you from the Court's opinion here. The court says look in order to be it doesn't say look, that's me, of course as in order to be actionable off. And employment action must be material adverse to the employee. That is it must be more than a mere inconvenience or minor alteration of job responsibilities. There must be an objective basis for demonstrating that the employment action is adverse and employees subjective impressions are not controlling here. There's no evidence to courts as the greens discipline altered the circumstances and conditions of greens employment at all. Let alone material she provided no evidence that she had been overlooked for denied a promotion or transfer no evidence that she'd been prevented from going back to the job duties. She had prior to the incident off now evidence of a loss of wages or salary or any other alteration of her employment that wouldn't have otherwise occurred and the coat the court ends off. Concluding quote green subjective belief that the disciplinary process was flawed or discriminatory was insufficient to demonstrate that it was an adverse reaction absent objective evidence demonstrating. This this case is not an outlier at all. I think this is the way pretty much every Court in the country would rule this one comment, but I do want to make about this case just in passing what's this case doing in State Court? Why is green not in federal court litigating this case and this is something you're going to see more and more of I think in the future, you know, as federal courts, it turns so conservative on employment issues and so conservative with you know cases coming out differently today than they would have been when I started doing this podcast several years ago asked the course of just gotten more off. Employer, I think what happened? I don't know. It's not my opinion. I think what happened is greens lawyer looked at the local federal court there in Detroit, but God judges research them looked at their track record on discrimination cases realized that there was a state law that was the functional equivalent of times seven looked at the judges in Michigan and said, I you know, I know where I'd rather be here. I'd rather be in State Court under this state statute page to see that decision made more and more over the course of the next few years. I'm sure I'll be dictating or podcast articles about that long, you know a wide variety of different circumstances. This Day and age, the squabbles and foibles of individuals turned into national stories, and in that situation there I can't help but think, but if the gentleman out there watching birds which sounds like a great activity, I'd like to go along with him. but I'm not exactly sure that we are one another's monitors and I don't really know if we ought to make a point of telling other people what to do. I think that when you speak to a stranger, it typically ought to be things like man. What a great day out here! Isn't it? Happy Memorial Day old up with whole covert thing you know jovial greetings of that sort, but when we make ourselves self appointed scolds of the other person whether it's blocking in traffic and getting out. Of Our car kicking on there're and waving sanitizer in their face, and shouting at him, or pointing out to somebody that their dog is supposed to be on a leash when it's not. I don't know if that's our business I. Don't know if that's polite and I think that we feel very empowered to be you know our neighbors judge and that we feel that it's socially acceptable to put our nose into other people's business. The lady with the dog. She clearly has a bit of a meltdown right, but the deal is that she's walking her dog and it's not a dog that looked like it was going to be any threat to anybody. It's a little foo foo dog, and maybe she just wanted her dog to be able to run. Run Free for a few minutes. I sort of think the dogs are hardwired to run free. It didn't seem to be barking at anybody or threatening anyone or crapping in the trail or anything else that you might consider negative and so really just let her be, and you know I. There's an increasing tendency in this covert era to sort of pass judgment on others who aren't doing just exactly the way we are doing it. Unfortunately I think that's encouraged by some public officials most notably the governor who would like you to call nine one one. But I think that keeping your nose in your own business is more often than not a pretty good policy, not that we should turn away when something truly bad or criminals happening, but if I don't like the way you're living your life. That doesn't empower me to protect your attention and maybe instead of looking around for other people that we can wag our finger at the world, and we ourselves would be better if we spent a little more effort. Just trying to be better people ourselves. If for whatever reason you think, everybody's gotTa. Wear a mask if that's your take on this then maybe what you should do. Do is redouble your efforts to wear a mask on the other hand, if you don't believe in the masks, and then maybe what you should do is focus on yourself and then not wear a mask, but scolding somebody because they don't have a mask on directly or in social media or scolding somebody because they do have a mask on a personally on social media is is rude. Rude and it's judgmental and it's really not the way we're supposed to I'm sorry Sir yeah well. Did you see the facebook post that the bird watching guy put up after this incident? No, sir, well in it. He recounts the conversation he had with the woman before he started recording the video, and he acknowledges that he deliberately carries dog treats just to deal with the tragedy of people. People who leave their dog off leash is he says to her. If you're going to what you want, I'm going to do what I want. But you're not gonNA like it. And she said what's that and I? Said come here, puppy. He won't come to you and he. I said we'll see about that and I pulled out. The dog treats I carry for just such an transients. intransigents. I can't even pronounce that I didn't even chest. Toss any trees to the push before Karen screamed and grabbed the dog. Hey, don't you touch my dog? And that's when I started the video recording. This encounter is so awful. I mean from all standpoints. These people were just incapable of shrugging their shoulders and ignoring each other. And and this guy you know. He wanted to make his point, and he was going to stop at nothing to make it, and then as the situation escalates, then he has to pull out his camera. He's already got handy. Dog Treats. this is this is ugly. It's really ugly and people have got to you know. Do better I just I. Don't understand the woman's crazy phone. Call was completely out of bounds, but but this this encounter should never have happened yeah. Green one hundred percent. Anyway, but I wanted to say is I'm seventy eight and I work at Walmart I've worked there for ten years. And I haven't missed a day of work and over a year I'm on my feet. Eight a day dealing with people that are in my face on a cash register and I love it I I sort of resented the fact that I didn't get a retirement from Xerox, but I took this job at Walmart, and I love Walmart. What I do. I love the people I work with. And you know I missed out on military service. My brothers all got called over to Vietnam I didn't get called up. So. This virus breaks out and here I am working at Walmart and people tell me I don't have to work because I'm seventy eight years old, and I'm vulnerable, and the thing of it is when I went to college I took A. Couple of courses, epidemiology in virology and I know enough to know how to deal with this virus I. Know what it does how it lives. Our generated how it's transmitted I know the whole nine yards of it and the thing of it is. This virus in all viruses cannot. Tolerate Sunlight. If you're a densely packed crowd. and. You're exposed to direct sunlight debt virus is killed instantly in the viruses that I'll go ahead. I appreciate that they can I'm glad that things are going well and I'm trying to imagine what college is like sixty years ago. probably the. Who's WHO's on the radio in nineteen sixty here? Here's the thing. sunlight is good in that it does kill some germs. It doesn't. It doesn't kill all, and of course you can transmit disease in the presence of sunlight. I think that our outdoor physical sunlight lifestyle is good for us. and it does offer. I think some protective to some degree of protection from variety of of things day. In the CETERA, the fellow was a bird watcher, and I guess he was interested in look at verge nest on the ground, and who run on the ground, and apparently his thought was, the dog was going to run around and chase away all the birds that he was there to watch that I. Don't know that that makes it right whatever he did or didn't do but. The dog's supposed to be on a leash. Then it should be on a leash and there's the man wants to watch the birds running underground. He should be able to do that, don't you think? I think that we should treat people the way we want to be treated I. think that we should have common courtesy and I think for example in the instance of a park. It belongs to us all. it. Does the park belong to birdwatchers? Sure I am a bird watcher. Does the park belong to dog owners? Sure I am a dog owner and you know he may have had a desire. What birds are nesting on the ground? Now kill deer. I mean that's that's I. Mean, but so maybe he's he's. He's scared. He's GonNa, Chase away the killed right, I that dog did not look to me like some ferocious beasts that was going to be out there chason. You know little birdies. But his desire does not trump her right, and and we ought to stop looking at life like it's a battle of my rights versus yours we need to bring back common courtesy, and I'm not being critical of him or defensive of her or vice versa. In this manner I'm just saying that we walk with a chip on our shoulder, like somehow were the center of the universe and everything about us, it's. It's not life fool, bring disappointments, large and small often they will come as a result of the choices, or whatever of others, if I'm in the park, and somebody's got their dog running loose and I. Don't like that then I will leave that park or that portion of that park, or I will adapt by figuring I, guess I'll just lump it. Sit here and eat my sandwich or watched my birds. My I don't really know if we walk around looking at life, like somebody stepped on my toes or finding some reason to be ticked off at somebody. I don't think that that's the noble or good way to live. It certainly won't bring much happiness because if you're looking for a situation where somebody is offended you, you're always going to find that situation and further, if it makes you prickly and confrontational to other people well, it doesn't do them any good, and it brings you the social. You know they'll shine you because you're a jerk. So courtesy which we used to have. The courtesy include self sacrifice where often you'll put your interest where it's acceptable inappropriate in a subordinate position to someone else's interest. Oh, please go ahead after you. Get a couple of hundred extra bucks a month for flying and you know. Some people thought it was for danger, but But really the air force really did it because They didn't WANNA lose to the airlines so that that was really sort of incentive pay to stay on. And you know about this hazard. Pay Like you've talked about it. You've got people in different jabs getting laid off the work for the government losing their jobs. did these people that are doing things. That's a great thing you're in healthcare. You're serving your community. It's a wonderful thing but to. But, but to honestly say you're fortunate that you've also got a job where so many people don't yeah I? States Air Force, God bless Ya but here's the deal to have bonuses and raises when unemployment is at twenty five percent when these same hospitals are furloughing large numbers of nurses and other health care providers when these same governments are are laying people off or Or not hiring, it doesn't make any sense, not do we know love and appreciate these folks, but there's a world of hurt going on right now in any extra pennies in anybody's budget needs to go towards those people who right now are out of work. She had a baby some a couple three or four months ago, Lou fell Nehmat. WHOSE DAD is already decided. He's going to play soccer for the Naval Academy someday, but A. Hannah has gone back to work. Only is she. went to them and said as her maternally was coming to an end. You know I wanna be away from my baby. I think I'm going to have to quit. And they said I wonder if you could work from home for us and so She last week began her work from home job, and she's got her workstation all set up and their at the floor beside her cooing and rolling and doing all. All the things, the such young babies new is young matthew, so it seems to be a pretty good deal over the weekend. SOFI member sees the one married to Austin. He one in the army now he's a in the police academy for the Nashville. Tennessee Police Department doing awfully well. He ends up right now leading the class both in physical fitness and in academics, so we're awful. Proud of him graduates in August I believe it is but they have two young sons, and we found out a couple of weeks ago a third baby on the way. The oldest of their children Austin junior is going to start kindergarten in the fall, and They're littlest boy, a turned to over the weekend and a good time as being had. They are coming along really well and the young kids at the House Jack and Elian Robby Scott and Sam with their dear mother are doing great. I'm so proud of them. It is challenging You know this being locked down stuff. It is very hard for them over this time to be away from their activities Jack Young Man Fifteen, who's very much into sports and finds a lot of his way to dissipate energy, and socialize and stuff like that you know being friends and playing sports, and you take those things out of people's lives, and there is a price to pay I'm not sure that you know sometimes the high mucky. Mucky mucks completely grasped the cost burden of what they've asked us to do. But and I recognize that you know disrupting the lives and education, and whatever like that of some youngsters, probably isn't all that big a deal in the scheme of things, but it's a challenge, and there's one other thing that's a come out of all this, for example, the shutdown of the schools at the end of this year. the school year just ending, but my my children I think are doing fine My wife is very conscientious. She. You know they've done all the stuff. The school has asked them to do and she's also found them additional You know like homeschooling online stuff and she does lessons with them, and you know to be honest with you. The two of them have worked well into next year and have almost completed that so I mean there are my. We're blessed because my wife. Our children are doing well. academically, but the deal is that you know a lot of. You know maybe mom's not at home or circumstances, just such that they don't have that you know opportunity or inclination and it is. You know I realize that sometimes you know you sit in class when you're a kid and you look out the window and you wonder what is this all about? Or what good is the do? But there are things you need to learn and at a certain stage and we have you know all the kids in America. All the kids in New York in. Who have lost the last three March April may June last four months of their academic extra instruction for this year, and so the question is. When are they going to learn the things that they didn't learn this year? Right I mean there are. Some districts were though they'll catch up on that. And and where they're you know doing some kind of at home. Learning now in that won't be a problem but there, of course ours are some situations many situations where it won't be like that at all where they're just gonNA, miss out and so if they're allowed to go to school in the fall, will those teachers have to remediate for the last third of the prior school year? I mean that's again when you're. The High Mucketty mucks Mr Governor are making their cavalier decisions about other people's. People's lives. You have to look it. this and and contemplate its its impact. You know I've I've I. Think I've mentioned the story, too many times of lay man I don't i. don't off talking about this. But like when I was in the fourth grade the year ended with us, not really having a a place to live right, it had been a very challenging economic time for our family, and through the course that year we move nine times I went to nine different schools meaning you know that so where you guys live anyway, the point is that. The upshot was I never got to finish the fourth grade and and you know in that little window is when everybody else learn how to do long division and you know we're the next couple of three years I. I had real problems with math, because I did not do long division and You know like an idiot I didn't just go back and ask somebody to teach me, and nobody quite caught onto the fact that that was my problem, but not. That's a big deal, but you just take that. That principle of okay, there are things you don't learn. If you're not in school and everything you're gonNA learn after that it's going to be built on that foundation. If you don't have that foundation, your little screwed so the challenge that our teachers and schools will have with the dawn of the new. Year is very significant. I can't fix or build things but I the one of the very few things that I am good at is fixing tires. I can plug a tire and I can break down tires and remount them and all of that stuff. My brother owned a filling station full service station when I was kid and that was my job as a teenager <hes> but these tires that I have are pretty new and they've got a warranty on them where they fixed that stuff free. They'll repair the tires so by the time I went and Oughta plugging kit and then got it home and you know did the whole thing it would be free. I would just take it to the to the tire place and let them fix so <hes> normally. If I'm not trying to self improve I would have have put that off because I don't feel like doing it today. I'll just go air up the tire. It'll be fine then in three days. I'd look and it'd be all I forgot. I got a nail in that tire low again and I would that cycle would go for about two weeks so getting your tire fixed immediately. Yes is a sign of self self improve right because I'm not putting it off. I'm not dealing with it and having to worry about it at awkward times and that sort of thing so I went straight to the tire fixing place while the tire fixing place was busy and for them to plug the tire meaning take the the nail out of it and put a plug in it that would have taken me at home five minutes. I sat in the tire place because they were busy for two hours and three minutes what <hes> but I got it done and it proves though that <hes> do you know doing things right away and taking care era of your business as my wife always says you take you business is not doesn't work for me. But what if he's not a working thing for me. What if you just made an appointment to come back tomorrow? At this time they'll take you right in or you can come back later in the day or something like that Ed rather than sit there all day. You know I would have gotten my mind focused on something else and I was. You know what <hes> not going to make that appointment today. I'll just take it in tomorrow when you're not as busy you know I would ended up. Doing I figured out a way to not do it so this is very positive. This is a great no because it was it was a waste of my time. I could have been watching T._v.. Or something but now it's done yeah but still took two hours and three minutes of sitting in a in a place where manual labor is going on and I I have to watch it grows and let's be honest with you. <hes> they have a window that looks into the little garage area where they're doing stuff. They weren't exactly a pit crew in their change tires and stuff. I mean there was a lot of guffaw in and and grocery going on that I could see more than just hey jack it up fix.
