"I'm Taylor van Cise among the headlines that we're following today. President Trump calling a New York Times story that he inquired about changing prosecutors in the Michael Cohen case in his words, fake news. The times story said that the president asked acting attorney general the acting attorney general Matthew Whitaker. If Jeffrey Berman could lead the investigation instead Berman Trump ally who had recused himself from the Cohen prosecution and former acting FBI director Andrew McCabe, claiming that he notified congressional leaders, including Republicans after he opened an investigation into President Trump MC McCabe on the today show on NBC this morning. He said he ordered the pro because he was worried that the president was working on behalf of Russia. All indications are that deputy attorney general rod Rosenstein will leave the Justice department next month. Just as a new attorney general takes over Washington Post national security reporter, Matt Zappa task is following it. All he spoke with komo's Rick van Cise. Matt what does this mean first of all for the Muller investigation, which of course, Rosenstein initiated any potential impact now that William bars taking the reins of because William bar is taking the reins rod Rosenstein, isn't technically the guy who can veto decisions and Wrigley. He wasn't even before in the immediate months before William bar took over because Matt Whitaker the acting attorney general had refused to recuse himself. So he was technically in charge. Now that said rod Rosenstein is the number two official at the Justice department kind of like the COO he's sort of got his hands more on the pulse of the operation than the attorney general, and he has all the institutional knowledge about Muller's probe. So if he leaves before it's done, and he's got some weeks left at presumably could wrap before then. But if he leaves before it's done, the Muller pro would lose that kind of institutional knowledge, and that certainly could have some. Impact? Oh, he's not the guy technically in charge. Now Bill bar is Matt wise Rosenstein, leaving this has everything to do. With the recent interviews and claims by former FBI deputy director, Andrew McCabe. Does it? No, I don't believe. So I mean, look he's been in hot seat pretty much from the moment. He took the job definitely since he appointed Robert Mueller special counsel, and he's ready to go. He's been ready to go last month. We and others were boarded that he was telling people. Hey once Bill bar is confirmed. I you know, I wanna I don't wanna leave the department. I want to go out and make money. That's totally understandable, given that he's had to exist. Kind of the last two years in the hot seat, the new detail. Now, Bill bar is confirmed. He's kind of putting a little bit more firm time line on it saying, hey in mid March. I don't see any connection to the McCabe interviews that have been going on certainly those are unflattering revelations for Rosenstein, and they work the president at Rosenstein. But if those are related, I don't think rod Rosenstein would have kind of a three week runway to get his affairs. In order. The president would move on him, much sooner. This is just all normal and expected a real news here, we just sort of know a more definitive time line. We're talking with Washington Post national security reporter Mads Pitofsky Matt who's on the short list to replace Rosenstein. Do we know why didn't get the shortlist of one a guy named Jeff Rosen who is the deputy secretary of transportation. Now, he's not a guy with Jeep Justice department knowledge his connection to Bill bar seems to be that they both were at the Kirkland Alice law firm, perhaps no one another through that. Now that said Bill bar has plenty of Justice department experience, and you have to have Justice department experience to be the deputy attorney general, but we expect Jeff Rosen will be, you know, don't make an announcement that he's going to be the guy to replace rod Rosenstein in the coming weeks. He'll still need to be Senate confirmed in President Trump, of course, is the one who has to nominate him though, we understand this has gotta bars pick as a condition of taking the attorney general job bar wanted to pick his own guy and Rosen is his guy. All right. Do you can read more online? On all of this at washingtonpost dot com. Of course from Washington Post national security reporter Matt's up task. That's komo's Rick.

"These stories Taylor van Cise at the editor's desk. I'm Tom hutler. Virginia democratic governor out north of needs more time to decide is future. As a fallout from a racist. Picture continues to grow NBC says that's what northern told his staff during a meeting today amid calls for him to resign. After a photo surfaced from his nineteen Eighty-four medical school yearbook showing men in black face and a Ku Klux Klan robe, Northam apologized, Friday and said he was one of the people in the photo Saturday. You said he doesn't think he is actually in the picture. President Trump dealing with a variety of his who's getting ready for due to liver. His state of the union address tomorrow night, a quarter of the federal government is going to run out of money again February fifteenth with another partial shutdown looming. Meanwhile, House Democrats planning a number of investigations of the president and his administration, the president confronting a variety of problems as he prepares to deliver his state of the union address tomorrow night, one quarter of the federal government runs out of money again. February fifteenth the specter of another partial shutdown is looming. And of course, he's talked about invoking a national emergency order to get his southern border wall built ABC's. Alec Rogan is in Washington. Take us through the development of the weekend understand the White House may have some concerns about set majority leader Mitch McConnell. Yeah. So the president has been hinting that he wants to declare a national emergency to allow the military to begin building his large scale wall on the southern border that he wants this is as the seventeen number congressional group is trying to negotiate a solution to that issue as well as a long term solution for funding the government. Now, what McConnell has reportedly were warned the president about is. It is. In fact, he does declare this national emergency. There are a lot of Senate Republicans who will side with Democrats and try to block him from doing this first of all in the house, obviously the chamber is now controlled by Democrats. So they will. Will do what they can to block him. And in the Senate. There are enough Republicans who opposed the notion of the president declaring national emergency such that they could band with the rest of the Senate Democrats to help the democrat controlled house block, the president from declaring a national emergency. They declared this they say this is an overreach of executive power that sets a dangerous precedent. Of course, he thinks he's well within his rights to do this bottom line. He is hell bent on getting the funding for this wall one way or the other absolutely is. And he's pretty much dismiss out of hand the results of this committee, which is he said happened till February fifteenth to find some way to keep the government open. Of course, if he does declared as national emergency, it will likely be immediately subject to all sorts of court challenges. So even if. The Republicans don't rebuke came in time, essentially, it's not as if this wall is going to be built immediately. I mean, it would be a way for the president to declare a political win in saying that he's doing everything he can to build this wall. But it's unlikely to begin construction right away. And as you mentioned there are enough concerns among Republicans that this is an overreach of power that perhaps this could become a question that goes to the supreme court, and is they're adjudicated as to whether or not this is inappropriate use of his executive power. Very interesting. The story has many more chapters to unfold alley. Thanks for sharing part of over this this morning. We'll talk to you soon. Thank you. Maybe sees Alex Ollie Rogan.

Perhaps you've seen the news on Facebook or Twitter under certain conditions. People can hear what you're doing while calling your apple iphone? It's problem with the FaceTime. App. And following the fallout is ABC's Alec stone who joins me on the KOMO Newsline. Good afternoon. Alex. There taylor. Yeah. Pretty freaky. If you think about it that somebody could be calling you and without you knowing while your phone is ringing. They can hear everything you're saying and potentially in some cases, see video of whatever is in front of your phone. Your camera activates, and this has been going on a bear lay. For some time. There's a family in Arizona claiming the day notices problem. Their son fourteen year old son tried to do group chat on FaceTime and back ten days ago on January nineteenth. So he was playing four night wanted to chat with his buddies. And notice this happened and a day continually tried to notify apple this bug. But that apple wouldn't listen to them that they weren't responding. They tried writing them legal letters. They tried sending them notes on the the apple bug bounty program calling them, and they never got any response Intel nine to five MAC a blog and apple blog wrote this open yesterday. So it add apparently been going on for some time. But bottom line. Through a couple of different things that you had to do and in group chat of putting in your own phone number. But if you did it right pretty much everybody. We were at ABC able to replicate it yesterday and make the other person stow-n-go active without them knowing and you could listen in on what they were saying is this bugs still active today. Alex. No facetime. The group chat has been completely shut down that you can't use it right now. If you want to use it, it's not available to you. But there are a lot of people who are now shutting off FaceTime completely. You can go into the settings on your iphone and toggle off FaceTime. And even though there's no indication that one on one there's any threat there. Some people are saying, yeah. But until yesterday afternoon, there was no indication that there was this problem with group FaceTime. So they're turning FaceTime completely. But you can still use one on one apple says, this is not an issue there. This was a group FaceTime issue, and that they're dealing with it. They will have a patch out, hopefully, a fix later this week any government response to this. I'm thinking the FCC might be interested or the FBI maybe state agencies to. Yeah. They they no doubt. They're looking at it. We haven't heard anything official from them. They're looking at any kind of criminal aspect to this. There are bugs typically whether it be an apple or Android device in many of the devices that we have typically though, they are fixed quietly all of the security updates that you get this one became very well known, and it's a feature that so many people use that it's not, you know, some back door thing where you'd have to be a computer programmer to figure it out or a hacker to figure it out. This one was pretty easy to replicate. And that's why so quickly apple went in and shut it off ABC's Alec stone with us on KOMO news. And ABC crew is Alex was mentioning did try this out ABC's Brad milkey recorded it while he was trying to call his producer on hearing, not just my own voice back. But I'm also hearing anything that's going into David's microphone, and he doesn't even touch the screen you. He's not accepted the call. He's not declined. The call is just ringing on his desk. And yet I'm still hearing him and whatever is going on around his microphone. Komo news time to fifty. "Editor's desk. Taylor van Cise. Among the headlines we're following today. The government shutdown cost the US economy three billion dollars that won't be recovered. The nonpartisan Congressional Budget Office or CBO says eleven billion was lost during the shutdown, but eight billion will likely be recovered. The CBO also lowering the GDP for the first quarter of this year, which of course measures economic growth and President Trump. And Roger stone have not spoken about the possibility of a pardon in the Muller probe leading up to stone's arraignment in Washington tomorrow. Trump's attorney Rudy Giuliani told NBC news at the president has not discussed pardoning stone. Stone was arrested in Florida on Friday being charged with seven criminal counts, including obstruction witness tampering and making false statements in the Muller probe around Seattle. The name Howard Schultz is synonymous with both the Starbucks empire. And the loss of the Seattle SuperSonics. But at the national level, he's the latest billionaire hoping to shake up the twenty twenty presidential race. I will run as a centrist independent. So what would a well-funded third party candidate due to the twenty twenty picture for that? We're joined on the KOMO news line by Michael Scherer, a national political reporter with the Washington Post. Good afternoon. Thanks for having a third party billionaire seems to me we've seen something like this before nineteen Ninety-two with Ross Perot. Perhaps we asked before George Wallace me sixties ran a third party ticket. And there have been smaller candidates. Ralph Nader in two thousand was blamed for Al Gore's loss in Florida. Remember, usually these tickets to consequential at the end of the day, but shields has a theory of the case, and that is because more independence are registering in the country and because both parties going to their ideological corners in terms of policy. There's a new opportunity here to run down the middle. We don't know whether that case will prove out in his announcement yesterday which had been expected. Is causing a lot of concern. Among Democrats who worry that he will play the traditional spoiler role with these third party candidates tend to Washington state's Democratic Party is urging Schultz to not run as an independent because if you know the chance that it could erode democratic candidate to unseat President Trump, but I wonder what would Scholtz sand for as a candidate. He's he truly a centrist. It depends. How you define centers. Everybody has their own do that term. But but he clearly is somewhat between the parties socially. He's well to the liberal. He's got a lot of work on racial relations. For instance. He's. Given his employees education credits work at Starbucks. He's objected to President Trump leaving the Paris climate accord's. He's worked on convenience in the past as well. Cisco though, he's he said that he's a moderate Asian pretty critical of Democrats for promising free things free healthcare free education, and and he can very critical both parties for building up the budget deficit in the in the US debt and says we're going to have to go after entitlements. Which is which is not a message that tends to appeal to Democrats is the road toward the White House tougher for a billionaire like Scholtz if you were to go through a major party's primary process rather than pushing forward as an independent, and by that I mean could Scholtz be competitive if he were to run as a democrat. We don't know the answer to that, you know, obviously, no one saw Donald Trump coming or very few people thought Donald Trump coming in two thousand fifteen and he was able to take over the Republican party and win the presidency. It's possible that a billionaire can do that it looks like Michael Bloomberg the former New York there who's worth something. Like fifty billion dollars is looking very seriously at a democratic presidential run the cycle, and he may have some success. I think what is certainly true is Howard Schultz is taking a lane that is far more open. There's little to prevent him. If he's willing to spend the money from getting on the ballot and these fifty stage, and if he's able to pull something fifteen percent or roughly there in national polls before the general election debates he will get into the debate. And that could be very disruptive for the party. His people say there is a pass to winning a majority of electoral college votes. But even if people short of that he has the potential of really affecting the outcome of the race or in what would get confusing outcome. Throwing the decision over the next president to your house representatives, if no candidate gets to Chevy electoral votes from the state in two thousand twenty the house will decide who the next president will be Michael Scherer with us on KOMO news. "Taylor van Cise, and among the stories, we're following this hour, the partial shutdown of the federal government will precede the Senate failed to pass pair of competing bills. The first Bill involved the president's compromise proposal for temporary protections for dreamers and nearly six billion dollars for border wall funding, Democrats put forth a second measure, which would extend funding for affected government agencies and departments on a short-term basis until February eighth, but again, both failed and secretary of state Mike Pompeo says former Venezuelan President Nicolas Maduro can't break diplomatic relations, noting that he doesn't have the legal authority to do. So more on that in a moment with the fight over the border wall. Still continuing we're getting some new numbers of activity along the border from the federal government US customs and border protection says it has seen a dramatic increase in the number of large groups of. That what they're probably gonna do is let them get convicted. And then maybe it'll be some exchange for some Russian in American custody. There's not a lot of progress on this case. And in fact, the lawyer said it may take several months for Wieland's case to be processed maybe even half the year. So in the meantime, he sits in a rather notorious Moscow prison, the lawyer and his family along with the US ambassador. Jon Huntsman of all said he's doing fine though. The family is understandably concerned for his well-being. Okay. When you say a possible exchange, I think a lot of bells go off in our heads about Maria, Boutin, a- sure and a lot of speculation has fallen onto Tina, and whether this is a tit-for-tat response, which wouldn't necessarily be surprising tactic used by the Russians. Boutin has pleaded guilty to conspiring to be an unregistered foreign aid. Of Russia in the United States and infiltrating conservative political circles, she is due to be sentenced soon and expected to serve about six months. So the lawyer said it may not necessarily be Boutin ah in the exchange, but he did seem to confirm the suspicions that this was all kind of a ploy to to to get some Russian released from American custody and still the question remains why wheelin what about him was so attractive to be picked up by the Russian government. Well, he may have been an easy Mark because he had been to Russia a number of times called himself. Larussa file had a social media presence in Russia. And was there. This time his family says for a wedding the Russians have either trumped up or not said that he is in possession of a list of classified Russian operatives and was in Moscow to try and recruit Russians to the American cause people that he first met online that he then came to Russia to meet now during the run-up to Maria tina's court appearances, we were seeing all kinds of things from American news outlets as well as the US government being pretty transparent about where she's been over the past years, and what she allegedly had been doing any sort of reciprocity from the Russian government. Are they being specific or pretty vague here? No, they have not been specific. And and the only inkling about the espionage charge. We've had comes from the this Russian news sites that reported he was in possession of classified list, but beyond that the Russians haven't said, the the lawyer said it will all come out in court.
