College football: Georgia beats Cincinnati in Peach Bowl
"Tim. Brando has returned and we are always excited to welcome. Tim brando back to our show and tim. Thank you for the time. Happy new year and man. Is there a lot to talk about. Yeah and even some of it is in sports too. You know a little bit of it has to do with sports up. And i've never been happier to be involved in sports right now. I can tell you that this is a this is a good day to cure about a college football game because otherwise you might need. You might shift drink. But let's keep it on college football before we get to monday night because certainly there's plenty of analysis. I couldn't help but think of you. On on friday as cincinnati was holding on dearly and ultimately lost to georgia in the peach bowl just You had been way out front arguing for others to be included in the party and they certainly acquitted themselves quite well. Yeah unfortunately you know this. Perception is reality. But sometimes the realities are when you wind up. Paul with A magnificent championship match up. And i will concede that that's what we have. I mean let's face it. We're talking about the two premier programs with the two largest brands from the two cities that get the highest ratings in sports television columbus. Ohio being second in birmingham alabama. Being one we're talking about the the the cfp really getting very fortunate. I mean really really fortunate. Because you know i certainly didn't believe in ohio state To be clemson the way they did. And i saw enough of ohio state during the regular season to know that they did not perform anywhere. Close to that Until that game was played. Which i think gives you know you have to give a lot of credit ryan day for having his staff and really his own gain planning so schematically superior to davos sweeney and clubs. That's you know brent. Venables is an outstanding defensive coordinator arguably considered maybe with dave aranda. Now is the head coach the best in the country and they were absolutely woodshed. It by ohio state and they did it. Schematically with two tight ends what they call twelve personnel football speak and utilizing the tied in and other receivers in a way that they have not done all season long. certainly they didn't do any of that against northwestern football team that defensively had the their team in a position to possibly beat ohio state in the big ten championship. I mean if it weren't for trae sermons Who had an unbelievable record breaking performance rushing the football. You know ohio state. Does it win that game against pets. It's gerald steam. So i think it was a legitimate by most of that cover football on a regular basis that simpson. Just add way. Too much ammunition and from a defensive standpoint would be able to handle what Been a relatively Understandable offense to defend. You know if you take care of justin feels and you double alava at wide receiver. You should be able to handle them well. That certainly was not the case in this game. So the cfp gets break with this matchup but that doesn't stop the thought process that that cincinnati gave everyone a reason to understand my point of view on this and so many others feel similarly that this is a team deserves to be playing for something a lot more than they were against georgia. They were two yards away all on third into and really didn't have to convert the third to if all they had done is just run the football as opposed to pass it Georgia would have had twenty five thirty thirty five fewer seconds to work with to get the ball to field goal range for fifty three yarder to win it. So i would contend that cincinnati's not just not getting the two yards but just deciding to throw the football rather than run. It was the difference in winning and losing. And and i think if that had happened the narrative wouldn't just be all my god. How great a matchup we have. We know how state alabama the narrative would also be. God did you see cincinnati. You know i mean did you. And they put iowa state with two losses above them. They they they dropped them to spots. I mean cincinnati's case would have been so much different. Had they been able to pull that off against georgia. But but i think people that are smart enough. That really understand the grander landscape of college. Football get the point and that is teams like cincinnati belong the ratings. Prove it too by the way. The highest rated new year's six game on your employers air by far was the cincinnati georgia game that means the game against north carolina and by the way eight. Mp team's gonna wind up at the top four right but you know it was that was a glorified exhibition. It did not rate the way cincinnati's game rating with georgia. It just didn't so imagine if that game was cincinnati were game. That mattered. That really matter. i dare say it would make a huge difference in the mindset of so many people as it relates to expansion of college football. Football's player
Thirty-two NFL Awards
"Every week on this podcast given out. Nfl awards app. The week is over. This could be a bit ambitious but thirty two teams thirty two awards. Let's go we're gonna call this one the best six and ten team of all time award but the washington football team stepped up so now he renamed it already way to change the word on the fly in the moment with breaking news the best seven and nine team of all time award the washington football team now can we say that definitively it may be too early to say last year tampa atlanta both went seventy nine. Those teams didn't even make the playoffs so the early lean is that washington could be the great one of all time. But we don't know yet. Speaking of that game. The clockwork orange award goes to the new york giants because they had to watch i at one point. This season banned myself from nfc east games. I said i wouldn't watch any until the teams are over five hundred. I watch step drop sixty two instead of being super locked into washington philadelphia. And i don't feel like i miss much. I know there's a lot of controversy would get that. Maybe a little bit later but imagine having your eyeballs taped open like clockwork orange and being a member of the giants having to watch that game. Nate sub-field now. Look we can sit here and be upset about it but you could have gone seven nine and got into the playoffs. So how sorry. Can you really feel for the giants the skeletons on the zahara award. Yes some of these awards. We referenced. his some won't get boy when you do get a weird one. You're gonna go man. I get that all right. That award goes to the. Las vegas raiders. Because at the beginning it looked promising. Nice little boat trip trade. Some spices await were crashing into rocks. Not a big deal here. Some locals gathering on the beach here to help nope now. We're marching to our own death in africa so it was very pro gruden. Hey maybe this gruden guy knows what he's doing and then you're like wait. Does this actually suck again. The drought continues. The raiders have not won a playoff game. Since two thousand to the notre dame award that goes to the green bay packers great record high green. Bay's really good. They're thirteen three though the one seat but nobody outside of their own fan base is rooting for this team. Not only because of the history of hatred. Although i imagine there's way more anti notre dame stuff out there than it is anti green bay but no one trusts you. Yes you're thirteen and three but that's three. Nfc conference championship game losses in the six seasons. A couple down years. They've turned this thing around. They are the one seed. But everybody's kind of overt already before. It's even started the parent's weekend award that goes to the new orleans saints. You guys know the deal parents weekend. There's a dad he wants to stay out with you guys. And he's older he's a little beat up and you're like i don't know like we're going to go out. We can't say no. We respect him too much. It doesn't look great. Doesn't make a ton of sense on paper there's some bad stats in there. But you have to let them do it. You have to let them try and the thing is is you and your buddies like there's no way does this is going to end well. The iceman award that goes to the dallas cowboys man and dangerous. What is with this jolt. A don't let us get hot. This is insanity when this was part of the story lines throughout the cowboys broadcast. Yes you on three in a row. Cincinnati san francisco and philadelphia yay. Then you lost the giants at home. You came in eleventh in the nfc but if you were to get in look out. This is now. It's our time you were eleventh in your own conference dangerous. You had sixteen games to prove that you're only dangerous to your fan. Base is or perhaps the understanding of what the word danger beans the g. league award san francisco forty niners. They had twenty eight players. At one point on i r or another injury cova list which was most in the league. They use the most. I are slots. They lost the most games to injury in the nfl. And even with losing record my coach. kyle shanahan. i can't believe how competitive they were. All season law the dabble award. That goes to kirk cousins in the vikings bike. He's gonna win. Nah no one really cares are one in five star people already over this team so their disappointing season was so disappointing so early that it was just all of a sudden just completely off the radar even though they turn some things around there a bit in the middle of the season with dalvin cook but watching cousins dance reminded me of daboh announcing his tiktok account hickory vickery dot mouse ran up the clock coast. Sweeney's got that drill and now he's on tiktok.
The College Football Champion Not in the Title Game
"How impressed for instance, were you With the way Ohio State showed up in the second semi final, especially given how they had looked throughout the season. Yeah, I was blown away. Jim. I just really was. I thought that I didn't think they could win, And I thought they may even get trucked a bit by Clemson just because I thought Clemson was playing in a much higher level and then Ohio State just stepped it up three levels, you know, and the way they X executed the way they performed Justin Fields, really One of the great performances I've seen from a quarterback, especially after nearly having his rib cage split in half. You know, just just courageous and brilliant. Um and Their defense played better trace sermon has been a monster. Lately. Their receivers are excellent. Their offensive line is excellent. S so they've got the ports and I think it's gonna be a real shootout in the final with Alabama at 40 My guest. I mean, amazing win for Ohio State an amazing performance. What about clumps? And what about the flipside? How bad of a loss was that for Clemson? It was bad. It was especially bad for Davos, Sweeney. You know who ran his mouth a bit. And you know, if you if you hand out that bulletin board material of putting Ohio State 11th and no that's gonna be public on then you you go out and get run over. That's a bad look and Davros had a great great run and it's it's going to continue. They've got really good players. You lose Trevor Moritz on even though the rest the next quarterback is really talented. He may not be Trevor Laurence. Yeah, You know, it's just a situation where They had a great as I said, a great run. But you may have missed a little bit of a window here with Trevor. They may still be a top. They should probably still be a top five program. They may eventually be a national champion again. Like you wonder if the last two years if they may be Mr Chance to add a second or third national title under travel on it before asking about the final really quickly when you look

Happy comes across really comes across a good good good both of like pigs and shit like oh my god. We're we're in the same. I'm in the same room with another person. Yeah yeah even though he's feet away. Yeah yeah no. That's that's great. Do you have any. Do you have any any future sort of outside. Like is there a screen play. You wanna right does your you know your what your wife is very successful author debris sweeney and yes you just wrote her second book and in april six. Do you get good company. Does that give you any en. Vdi author envy. I am so no. I'm so excited and happy for her. Because yeah i again. In in terms of being lucky i realized being selfish asshole like now. I understand that for years. She was like basically raising our kids. While i was at work every like a we were there till midnight. It could be a very consuming job. Yeah yes and she was a very selfless about it and really generous and so when when she wrote her she went when we moved to la she went back to school and got her mfa in fiction writing and then for her Senior thesis her professor. Said you know what i think. This could be an awful. It started out as a short story. And she just said okay and she just kept writing and writing and after two years was a novel and she sold it and then she's going to book tours. And i i got to go on book tour with her l. I mean that's that's another reason. I i stopped being a head writer. 'cause i this book was coming out and i thought oh it would be really nice for me now to kind of be her wing man or support her in any way i can and so for me. It's it's been great. I loved it. And i love being. I feel like. I'm giving back a bit all the portuguese me. I'm trying to give it back to her. That's good yeah. That's what do you have any outside like missouri screen player dying to ride. No i again. We talked to her comes and tells me i have to write a screenplay writer screen. I'm serious somebody as someone give me an assignment and albright. Yeah and you know. Supposedly i again at show business and i never believe anything til happens. But you know they're going to be more travel shows so yeah in the future but You know i mean with the world the way it is and and covert and now there's new.

"Hey we found out. Our cameraman had knee surgery. So we couldn't do this part bait. Yeah yeah but yeah that was. That was the one thing. I really pull from that remembering that one because yeah because they and i don't even think it's a i think they do it for fun. I think that they just get all the elephants off. Its ringling brothers. They walk them through Is it the lincoln tunnel on that. The mid tanta mid downtown. They walk them through the midtown tunnel. And so there's a bunch of people standing at the entrance to the midtown tunnel with about a you know. Probably a quarter of a mile between us and the actual mouth of the tunnel from where you are stand and you see the elephants come out and there's a single file and then when it come through the tunnel they line them up and then they give them a command which they must. Have this be able to do this on command right and every single elephant shits and pisses simultaneously and so there's all these people standing there waiting and i knew it was going to and they get the elephants all lined up and you think there's gonna be some presentation thing and it's just like boom and the wave of stench that hit people. I don't know if we had an on camera but it was just like whoa like just a wall of a elephant shit and pissed inc yet. I think we shot it yet. We shot anyone's reaction to. I think we're to the cameraman shopped. Also he wasn't able.

Moments are bits or things That you look back on with like more pride than you do of other things like. What are your proudest things that you can think of that. You a well. You know what i liked. When i was a writer because the great thing about the show is if you wrote something you produced it and and you know you were responsible for creating it a bit from soup to nuts so you really would feel and i you know. They're they're allowed different things. I did that. Yes i was proud of in. They did well and and you know you know know. The writers liked it. That's all that's all you really cared about like other writers new and conan mike. Something i didn't. I didn't even care if you guys like something rehearsal. I didn't even care if it didn't do well do. Can you do care. You want thoughts like right because then you know but but that was a hard thing about being the head writer to is that like you know like you'd add little bits two pieces on the show but you never had that sense of ownership now.

Wow and they put her on all these medicines and they worked heard the last two years of her life. She was just the the good mother the whole time. Wow and i would talk to her on the phone and have a great conversation with her. And i would hang up and i would literally be stunned for five minutes after each phone call in total. He was director of research for pharmaceutical company. And he was the mayor of our tau. What yeah. I didn't know that. Yeah it's like a part time job like small town so You know he's supposed to be the memorial day parade the next day and he's sleeping out in the car in the driveway because he got kicked out of the house. Yea so did. Did the police have to get called from time to time or the police came some time as i would like gotta go out to the mayor's house again you know. Yeah no. it was Gab you know. I was brought up that you didn't talk about it so i never told anyone about any of this stuff 'til i was like i. I ended up living at home taking care of her till i was twenty six. Oh my god yeah no is bad. I mean i think about 'cause i e e i lived through like a there was a period of major dysfunction in violence in my childhood but it was not was like within a certain set of amount of time right but what i think back on is just and something that i've thought about. You know when you hear about kids living in a situation like that or just in a situation with an unreliable parent who can explode right. Just the sense of never never being able to be relaxed to always always feel uptight going into the place where you're supposed to feel most secure and most safe and that's got you know i mean. Did you feel that. Was it like times where you felt on egg shells because you didn't know when this person might go crazy all the time. Yeah all the time and and We were all like that and it's and it was hard to predict what would trigger It was literally like setting a lighting. A fuse along really long fuse and you knew and it was lit.

Clemson Coach Dabo Swinney Ranks Ohio State at No. 11 in Final Coaches Poll
"Davos, Sweeney can do whatever he wants with his pole. It's kind of why nobody pays attention to the coachespoll anymore. Now that we have the playoff committee rankings, we don't need it. Because when dabble places Ohio State number 11 Hello, Florida and Oklahoma and Georgia, Cincinnati and Coastal Carolina as well. It clearly was just to make a point that Ohio State did not play enough games in his mind. Not that there's 10 teams. Actually could beat the buck up the same way no power. Five coaches put Cincinnati in their top four. But seven group of five coaches did see the coaches are always acting in their own self interests. Politicking for their own schools for playoff spots, Bull Biggs and then their conferences to get more respect and when they can propping up those that help them while tearing down those that don't
How The Rat Blew Up
"Were not union workers so the union to me represents was staging a protest. We're on the public sidewalk outside the property. We were very careful not to block any traffic not to block pedestrians. We had the rat there. So you're out there you got. How big how big the rat. You gotta staten island. I think we had a medium size one out there. It didn't look to you to enormous but definitely follow the me. There are videos of this protests that were submitted in court in you see a group of about fifteen or twenty people. They're standing on the sidewalk between a small fence and a highway and they actually have to inflatables up. There is the rat and giant cockroach and the protesters are yelling into bullhorns. Not surprisingly the owners of that shoprite did not like having the union and a giant rat protesting outside their store. They did not like it so much. They complained to their lawyer. Their lawyer complained to the federal government and the federal government brought a case against the rat. This is one of several rod cases. The government is working on right now. Could this offseason be pivotal for Don Sweeney?
"Could be like if we want to go there this could be the second most pivotal offseason. Don Sweeney's tenure is Jim Morrison would be I mean, yeah, we obviously know what the the first one was some hits some misses I'll defend on Thursday and say people forget the meal music trade was was very solid but should it be his want this could be kind of the offseason wear off he shakes it up and there's been there's been little shit shaking in the Don Sweeney tenure really other than that 2015 offseason where he kind of came in and moved Hamilton moved Lucic got the Draft Picks 6 in the first two rounds. We all know the story there but dead. This could be like the next kind of version of that obviously not as big but like if you look at where the Bruins are, I mean what happens with Krug? What happens with Chara those to move up itself are pretty franchised altering. And then from there there's obviously been the the Rask rumors. I I wouldn't be surprised if something happened with Rask because we we should never be surprised by anything that happens with Rask anymore. And this point that's the case. This was like a weird enough year and obviously with it happened in the the postseason like There's so much uncertainty surrounding that player that that nothing that happens with him with surprise me. So yeah between Krug we think departing who knows what happens with Chara. I think the flu tone made a really great point that was sort of an obvious point that we've all been kind of sleeping on like it is possible that Chara reaches free agency and who knows if the Bruins have or anything with him maybe a team jumps in and they're like, hey, man, you're the missing piece like this is your what what we need and maybe yeah, maybe he just maybe he departs so possibilities are plentiful and I haven't even gotten to the Do they make like a real hockey trade? Do they trade Jake debrusk? They trade Brandon Carlo. My pie-in-the-sky thing that will never happen is like they find a way to make Carlos the centerpiece of a Patrick line a deal which financially and for other reasons just does not seem like something they would do but oh my God, I have been banging the table to get more scores on this team and if they found a way even if it's losing Carlo in an offseason where you also lose Krug, like imagine if I thought they had Patrick lyonnet David pastrnak and like imagine having three of the best goal scorers in the planet on your team

"US Government is taking aim at ten cents, gaming operations I'm Madrid and the sports minute presented by you sports network according to a Bloomberg report, which I will link below the trump administration has asked gaming companies related to ten cents to provide their information on security protocols when it comes to the Chinese Mega Company, the Committee of foreign investment in the US which is chaired by the. Treasury Department sent letters to major game companies including riot games and epic games. The trump administration is taking a much closer look at security concerns as regards to use your data with Chinese companies popular in America primarily that attention has been on Tiktok but ten has also seen plenty of attention as well. Particularly, it forced the sale of the companies US operations to Oracle earlier this week. EPA gains would likely welcomed the freedom from ten set. If we're going to be honest, the company only owns a minority share albeit forty percent of the company. But Tim Sweeney Fico has publicly stated that tencent doesn't control the decision making within the company that also makes it incredibly unlikely Sweeney's handing over user data in droves to. Epic Games of the success of fortnight is a much different company now than it was when tencent. Of It. Right Games on the other hand is in a bit of a tougher situation. tencent owns the entire company and losing North America operations would be pretty brutal for riot well, leagues. Popular, globally riot was still found in the US and is based in La. Now maybe getting ahead of myself here all that's happened today is letters went out regarding personal security of users if epic had proved that that data is all Safin contained, that could well be the end of it. But. There's an inkling, some of the same security concerns present with Tiktok or President Ryan epic that would be a pretty big issue. We'll be sure to update you further on any developments that arise from his inquiry.
Epic wanted special treatment from Apple, according to new evidence
"Apple shoots a shot in court in epic focuses on public opinion on. The sports minute presented by East Sports. Network. You've probably seen the news about apple and epic gains very public spat. But if you need a full recap I covered what you need to know on the East sports minute last week here's the top level ballpoints before we jump into the new updates epic gains undercut apple and Google APP stores by shaving off the cut each company takes from in-app purchases in response both apple and Google pulled fortnight from their stores. EPIC game sued released in Nineteen eighty-four parody and the case went to the courts. Today apple released email showing epoch CEO Tim Sweeney had come to apple to ask for special treatment when it came to a percentage take of in-app purchases at least that's how apple is framing it. The actual statement by Sweeney argues it all developers should be able to receive this special treatment major corpse or getting as it stands apple and Google take thirty percent off the top for access the APP store and the fraud protection and marketing the come with. Apple has made a special exception in the past as sweeney a lunatic most notably with Amazon, but other fast food brands like McDonald's have also reportedly received. Special treatment. A link, the verge article containing the emails in the bio of this show. It's really interesting look at how billion dollar companies business especially when they have beef with each other from epic side while still fighting a legal battle, they're doing quite a bit of public facing pr as well. The company is pushing the Hash Tag free fortnight and positioning this fight as one for all developers not just epic. And while it's true breaking antitrust would help gives epic games of course, stands to benefit plenty to epic today announced the Free Fortnight Tournament centered around epochs fight against Apple. They're also selling merged with the Hash tag free fortnight and another apple parody. This time of the Classic Rainbow Apple logo the Llama instead of the apple in the email sent by Sweeney, he says apple should be prepared for A. Fight. The last year's so be interesting. See how this develops. We'll keep you up to date right here on the sports minute
Epic Games trolling their way to a win
"We were recording our podcast last week with Dan Rabin. Oh, we're talking about the surface duo. We ended the show with what's happening with the TIKTOK acquisition. Microsoft is pursuing tiktok Canada Australia, and New Zealand operations than they pivoted and said, no, we want the whole thing but as that was happening. EPIC Games had been kind of Going through some subterfuge earlier in the day, they launched it direct payments in fortnight for android and Ios it was a server side changed. So there were no updates to speak of the sudden. You pay less money for V bucks inside the game if you didn't want to go through apple and Google's own. In purchase mechanism. And then apple said nope that's not allowed and kicked the four-night APP off of the APP store a few hours later Google did the same thing then a very well coordinated media. Roll out of a an amazing video parenting apple's nineteen eighty-four. Macintosh at the most famous ad ever. Epic did the same thing they kind of? Made a shot for shot recreation of it. Basically calling out apple for its own monopolistic practices and then launched lawsuit and did the same for Google few hours. Later when Google kicked fortnight off the play store now Gul's Lawsuit Jerry is a little epochs. Lawsuit Against Google is a little different. But it does claim that Google uses the play store to suppress competition in particular because it makes side loading super super scary, and it also prevents companies like LG and one plus which were called out in particular inside the lawsuit. From making side deals with companies like epic in order to prevent. Third. Party APP stores from. Behaving like I party stores. So you know in particular, we have situations where. There's the play store preinstalled on a Samsung Phone and also the galaxy store and APP updates can happen in the background silently but for a company like one plus trying to install or pre installed the epic game store those. Silent updates are not possible because Google thinks. That they are a security risk. That's one element of a very, very long, very detailed lawsuit. So walk us through what your thoughts are about this Google lawsuit in particular first office is. I don't know it's it's epic is. Really just trying to troll its way to a win. A lot of what it saying. Takes a little bit of the truth and then stretching it out, making it worse I. Mean They they claim it takes you know dozens of clicks to side load an APP when it really only takes one. A day talk about how APPs are unable to send updates outside but facebook does it on every phone that's not a pixel. It's it's just. Stretching the truth a bit. I don't like that because it takes away from the an actual real issue that. Is thirty percent too much. I mean I think thirty percent is a bit much. I have to out and say that that Google takes too much money from developers. And we're losing sight of that simple fact because. EPIC. Is being epic and spending millions of dollars to make videos and stuff. Right but it's also not nearly as big a company and this has been this really been the the the sticking point for some people right? It's like to massive companies are battling it out and users are stuck in the middle right they can't install four night. But when you when you look at the scale of epoch, which is A. Seventeen billion dollar company not a small organization at all Tim Sweeney? Is a very wealthy man. He can fund this by himself if you wanted to But compared to apple and Google epic is a relatively company by degrees right and slaying that up a lot. They are no doubt about that. I mean there's there's absolutely no question that epic is is taking advantage of of these of big Tex size but there is also the argument that this company epic is perfectly suited to try to tackle big tech from a law perspective from A. From judicial perspective, trying to force the courts to take up the the call that these companies are too big and engage in anticompetitive practices. I just don't like the way it's being done. epic was fine with the agreements with Google and apple that it had made. Until it got enough users were it. Could you know? Cause trouble. And that's the what. In my opinion that's what happened they knew okay. We'll do it and eventually will get millions and millions of users on mobile like we have on you know consoles and PC, and once we have all those users will you know have leveraged to fight apple and Google? And all those users are being, you know they're like pawns being used as a bargaining chip and I just don't like that at all.
Fortnite is Suing Google and Apple for YOUR Money
"Last week on August thirteenth epic games introduce a new way to make in-app purchases on the Version of fortinet and this was big because up until now the only way to buy more v Bucks or skins or hell even the battle pass itself was to pay through Apple's abstract, which is exactly how apple makes money off that APP store. See Apple is all about control and one of the ways they control. The financial side of things is taking a thirty percent cut of all op sold on the APP. Store and a thirty percent cut if all in-app purchases from any APP on the APP store that lets you buy shit basically every time you buy an APP or by something within an APP, apple takes thirty percent no negotiations. So not only did epic introduced this new way to pay as a way to get around to giving apple thirty percent but buying shit using epochs payment method was cheaper and it saves you money. Kind of giving a digital middle finger to apple and as you can imagine, as soon as apple realize that epic was trying to get around giving them that thirty percent cut they freaked out and kicked fortnight off the APP store, and that alone was big enough to make mainstream news the billion dollar battle over one of the most popular video games in the world, both apple and Google removing night from their respective APP stores. CEO Tim Sweeney has been this kind of a personal thing for him. He's been a huge advocate against apple's mobile APP store, and now he's mobilizing his company and the biggest game. They have fortnight to try to make things fair for what he says is all developers around the world but here's the thing from where I'm sitting getting fortnight kicked off the APP. Store is exactly what epic wanted because hours after the got kicked off the APP store epic Games filed at Sixty five page eighteen trust lawsuit against apple plus they launched an ad that rip off apple's iconic Nineteen eighty-four AD plus they lost the marketing campaign that Paints Apple as this big Evil Corporation. Now while epoch hasn't stated this publicly, the narrative online is that epic basically baited apple into kicking four off the APP store. So they had a very public excuse to file the lawsuit and kick start this marketing campaign in considering it takes months to organize a lawsuit and marketing push this size it's safe to say that epic would have planned this all way ahead of time after getting kicked off the APP store Google also removed fortnight from. Its play store prompting epic, Games, to file a lawsuit against Google as well. Imagine taking on apple and Google in the same weekend and while apple hasn't fired back publicly, they did file a temporary restraining order against epic on Monday August seventeenth that would ban all related products and development tools from apple's APP store. Quote it told epic that by August Twenty Eighth Apple will cut off epochs access to all development tools necessary to create software for. Apple's platforms including for the unreal engine epic offers to third party developers which apple has never claimed violated any apple policy and and that basically means is that any Africa game developed using unreal engine won't be allowed on Apple's APP store. If you didn't know epic owns unreal engine and everyone uses it to make their games from the biggest AAA studios to the smallest indies but apple won't let unreal made Games on the APP store developers could. Just switch to a different development tool and then epic would be in huge trouble. Okay. So that was the news and before I get into epochs manipulation MPR tactics I got a breakdown just what the hell an antitrust lawsuit is in y epic is targeting apple in the first place to put it. Simply antitrust laws developed back in the eighties to prevent companies from taking advantage of consumers and to allow for fair competition between companies and this is. Exactly what epic is accusing Apple of doing with its APP store taking advantage of both the consumer and the developer by essentially locking out all forms of competition. Here's a quote from the lawsuit quote fast forward to twenty twenty and apple has become what it was railed against the behemoth seeking to control markets, block competition and stifle innovation. Apple is bigger more powerful, more entrenched and more pernicious than the monopolises of yesteryear at a market cap of. Nearly two, trillion apple size and breach far exceeds that of any technology monopolist in history and quote, and this is the crucial part of the lawsuit at trying to wrestle way apple's control of the APP store market and make it so that their games are available more places. Therefore, they can make more money in epics is right now, the APP store is the only way to sell your product on IOS devices which according to ethic means that. Apple can make up whatever rules they want, and basically charge whatever they want because they're the only player in town. It means that if you're a developer, you have to give apple that thirty percent if you want your app to live on the APP store and it means if you're a consumer, you're forced to pay whatever apple charges because. Well, that's the only place. The APP is available epic seizes anti-competitive Anti Consumerist and monopolistic, which is now. WHY WE HAVE THE LAWSUIT FOR CONTEXT EPIC isn't the only one fighting apple over its alleged anti competitive policies. Apple is currently dealing with a government led antitrust investigation in the U. N., it's battling a massive antitrust class action lawsuit filed in the US back in two thousand and one thousand, nine, hundred Supreme Court is now allowing consumers to move forward with an antitrust lawsuit against the tech giant over the sale of iphone APPs, the suit maintains it. Has. Unfairly monopolize the market to set prices apple charges a thirty percent commission fee to developers. APPS are sold through the apple stores APP APPLE APP store iphone users must exclusively by their software there and the court did we jet a plea from apple to drop the seat now if you believe what epic games CEO Tim Sweeney is saying online this lawsuit is a good thing that potentially opens up more APPs centric platforms for developers to sell their product on a potentially gives consumers more options as to who they give their money to, and if that's what ends up happening, that's great. No problem. What is a problem is the way epic has positioned this. Legal battle publicly by manipulating its audience into fighting it for them. Let's be honest here as much as epic wants more open platforms it's not because they care about you as a person they care about the money that you spend on its products namely four-night opening up markets and allowing for more places for APPs to live also allows epic to potentially make a shit ton more money. So by coming out with this ad that calls apple oppressive by calling on the millions of young impressionable kids who have no idea what the fuck is going on besides the fact that their hobby is now gone Epoca's position themselves as the good guy here and clearly epochs plan. is working just search Hash Tag free fortnight on twitter, and you'll find dozens and dozens of people backing ethic and saying how it's a good thing that they're trying to take down a greedy corporation like apple to which I say it's EPA Games. They're just another billion dollar company. They are absolutely no different from apple when it comes to making money, they just want you to think that they are epic is banking on the fact that either a its audience won't understand what it's doing or be won't give a fuck as long as they get to play fortnight and sadly epochs right? Because the truth is epic doesn't give a shit about you and this. Marketing, just a corporation's attempt to get the public on their side and to position the outcome as a win for the little guy
Epic Games' Fortnite is no longer available in the Apple App Store
"If you saw me tweeting last week, you know I have lots of things to say about this epic. Game store, but it's been really good that I've had a couple of days to sit on it and look at some other people's opinions and read a lot more about it, and so I think that it's it's going to be something that obviously is going to be drawn out because legal battles never move quickly especially ones of this nature but in case you happen to miss the news. Microsoft is no longer the only person with beef with apple facebook gaming is no longer the only person with beef with Apple. Now, epic Games decided to just take a can of gasoline and throw it on the beefy fire and it's like let's go sim is seven beefy Phya. Literally that's exactly what they're doing. All right. So let me catch you up here. So this right up comes from Games Industry Dot Biz fortnight developer epic Games seems to have a way of breaking with the rules in the face of fortnight success companies have ended a long standing practices hold on let me move these notes over some not looking so far off screen. There we go. Like Sony, which abandoned its fight against cross platform play back in two thousand eighteen after EPA Games forced the issue eventually leading cross to other games to fortnight size and popularity. Of course, gave EB Games the power to Ben Sony Nintendo's rules but we'll the tactic work with monolith like apple and Google. While the North Carolina, based company is trying on Thursday morning EPA Games updated fortnight with new options for payment processing providing a discounted price for players who chose to process payments through epic, not apple or Google epic circumvented the. Apples. storefront thirty percent cut on purchases by giving players a twenty percent discount on books. Fortnight's in game currency in response both apple and Google removed fortnight from the APP store and the Google play store respectively citing policy violations as it turns out. This is what epic Games was acting and it had a plan moments after the game was removed from Apple storefront EPA Games began its Hash Tag free fortnight campaign complete with a Hashtag in game propaganda video and a pair of lawsuits. So before I continue I'm GONNA. Go ahead and. Get this rolling freeze. You guys can take a look hold on Erica In those lawsuits games argues that Google and apple's policies are anti-competitive a violation of antitrust laws. EPA, game CEO Tim Sweeney said on twitter that his company was not looking for special treatment. It wants apple and Google to change its rules to create a truly open platform debate benefit all developers not just. It'll be a hell of a fight Sweeney said fortnight's removal from the APP store doesn't necessarily impact gamers too much at least not gamers on android Google's platform has more than apples and the game wasn't even available on the play until April instead, people had to download it directly from epic games and they can still do that including its updates. So. We all know that the legal process for anti-trust cases is devastatingly slow as came. Industry has pointed out and what they kind of continue to the story with and did cut up quite a bit of this. If you want to read the full article, you are welcome to go to that website and check it out but it is quite a lengthy one but I think. It's important to kind of look at the litigation impact and so what they write is this litigation has a much larger scope than any of the challenges that EPA Games his face like the Sony Faceoff EPA. Games is the underdog if you can call it that although it's valued at more than seventeen billion dollars that's still significantly overshadowed by the trillion dollar market capitalization of. Google's parent company and Apple epic isn't asking the court to rewrite antitrust laws as it stands instead, it's asking the judge to enforce the law as it currently exists. It's different in that way from the antitrust here in Congress last month where government officials discussed potential changes to market power rules. Epochs lawsuit however is still important. If epic wins, it will make it clear that apple and Google's practices are illegal, and then those companies will be forced to change their practices.
An Epic Fight: How the 'Fortnite' Creator is Taking on Apple, Google
"Thursday the video game maker epic introduced a new direct payment system for video game fortnight bypassing developer vs that apple and Google charge but that's against both APP stores rules. So apple and Google pulled fortnight making it impossible for people to download the game or updated if they already had it in response epic sued both apple and Google, taking on two of the most powerful companies in the world and setting up a high stakes legal battle over developer fees to break it down. There needle joins us once again, Sarah thanks for coming back. Great to be here. Okay. So what's the basis of their disagreement here? Eric Payments System basically skirted the three percent that developers are usually required to pay. Apple and Google for purchase. So epic believes that apple and Google are charging. An exorbitant amount of money for developers to accept payments from consumers inside their APPs. According to epic problem is that At least with the case of apple, it's not possible for accepting payments. Any other way with Google for I could appear on android devices just not in the Google play store could. Go to other at marketplaces, but that is not even option with apple. So epochs beef goes beyond just the thirty percent fee that developers charged. But. Also the company is unhappy about the fact that apple doesn't allow it to accept payments through any other means. And what apple and Google sanded out well, the source basically say that the thirty percent is justified because they provide services to their stores such as security and user privacy. So when you and I were playing game, we spend a dollar on virtual costume for our characters say and Google takes thirty percent of that dollar leaving only seventy percent for the developer apple and Google or saying well, we we use that money to make sure that the transaction is safe that hackers don't get. Intervene and to make sure your privacy is exposed as a consumer as a result of that transaction. Even. Style epic is arguing that's too much and they clearly knew what they were doing when they dropped this do payment system right? They were set up for the consequences. It was clear they're ready for a fight because soon as apple removed for night from it, store epic filed suit and You don't want battle suit very quickly. Especially one that's as detailed does this. Particular one, it's more than sixty pages long and for each one and also epic a put out a parody video of a nineteen eighty-four apple commercial. To make its point and also a social media campaign with a a trending or hopefully for them trending hashtag raising the point that they are going after apple and Google in this way. So this is clearly a planned move on behalf well before and also keep in mind that. Tim Sweeney has been very vocal, very critical of the. Thirty percent fees for a long time. Now, this goes back years. He's not been shy expressing his dissatisfaction with the. Quote. Unquote thirty percent tax that may people call it. So it's it's almost a personal vendetta at this point, and because he has a company with one of the most popular APPs in the world, he's in a strong position. And he's also able to because the stakes for epic. Aren't that high in the sense that four night is not just available on mobile devices you can play for night on consoles and computers, and probably is fair to say that the majority of the most hardcore gamers are playing on PC's and consoles less so than on. A mobile device and they're spending time in most of their dollars on the console and computer versions of the game. So for epic, this isn't Necessarily game over if we're night is permanently removed from the stores. So epic is uniquely positioned to kind of take these companies on on behalf of all after gallopers. That's true because it has the fame notoriety has the the fan base and it has other means of getting revenue in you look at some game developers or any APP developers thurn tire business model rests on the APP stores and they don't have anything else. That is really where their bread and butter lies, and that's not the case for epic because not only does it make video games, but it also makes some. So called the unreal engine, which is very popular software for developing games all sorts of studios use. The also use it for things for movie making in architecture. So it's a totally separate business line for ethics that's quite lucrative. EPIC also owns House Party, which is a popular video chat APP it owns other games of us like the one that makes rocket league, which is the pre popular video game and epic has its own computer game store in which by the way, it does take a cut from developers, but it's cut is only twelve percent that is significantly less than thirty percents, apple and Google take. So what's next in his legal battle between epic and these big companies? Well, we'll see how the companies respond. and. If they see to have the case thrown out whether or not a judge will say, no go ahead or move on but you know we have to keep in mind. When we make all the backdrop of what makes this so fascinating is that both Google and apple are facing scrutiny from the Justice Department over antitrust issues. This has been something that's been going on for a while it also involves. Amazon and facebook. But one of the talking points throughout the congressional hearings that have recently happened on antitrust did focus very specifically on the APP store fees that apple pays. Charges sorry. Especially, the fact that apple has this walled garden where you can't have any other payment options besides his own. So this is something that is already being looked at by a much bigger entity than just at the game we're talking about Congress here so and then there's also been. European. Antitrust. Regulars are also looking into this matter because. The spotify's complaints regarding apple as well. It goes beyond just at that. We also know that net flicks has butted heads with apple as well as match the dating service. So this is really Epochs taking the lead, but it's not a new issue and is definitely something that has drawn the attention of more than just other APP developers also Governmen anti-trust. Across the Globe

"Know in our so deep sleep so it's the best time to learn. It's also the best time to create than I am then. I'll do my I work out of the day in which is refused. Usually something aerobic so Kinda ease my body into it in cold shower so that's morning routine love the it's. It's a it's a work. So what do you do your breathing. You didn't give me the inside on yours sure yes so I wake up I start box breathing thing and then I do some journaling so that's the positive so first off. I drink a glass of fresh water and I begin a gratitude practice and then I began my box breathing and then and I will after the bucks breathing will go into a short meditation. I used to do forty five minute long meditations but I just have gotten to where I don't have the time and also you have gotten effective enough where I can do a series of like six or seven three to five minute meditation throughout the day and I find that I get more impact out of Mitsu saved time in my morning routine so short meditation I check in with the ethos so all this is like takes me about twenty minutes or half hour checking in my eighth. Oh sisters where I look at my reflect upon my purpose and my my mission and then I feel into the vision that I have for my future I becoming the kind of person that's worthy of fulfilling my mission and love all of that is kind of a static practice mini. They're sitting in bed or sitting on my my meditation bench. Yes yes then I go into my more deep breathing practice so I do. I do alternate nostril in I do breath of fire and then I do kind of our version of Wim. Whim offers we call warrior breathing which is main differences through the nostrils and we have both inhale in the next cell hold so I do three sets of that then. I'll go into my moving practice so that's either twice a week study Akito for two hours or the other days. It's three times a week. I do an hour of Yoga right either on my own on or or a local Yoga Studio Core Power Yoga Studio and that's not none of those. I consider to be my workout so that's basically my morning ritual and then later on on the day. I'll get my functional fitness workout in usually at the gym and then in the evening. I like to do something else as well a walk on the beach. Something kind of wind down ish yeah so but you about the morning ritual the point here for everyone listening. Is You know maybe maybe pat night are seem a little extreme stream but the power of doing this the the the psychological balance the physiological control the the energy management the positivity activity and optimism and sense of being in control that it brings and also constant refinement of the quality of your thinking right to to lead to better decisions decisions it saves so much time both in choices of what to do and avoidance of the things that slowest down in life orangey agrees that points adding their commander number one is that it greatly increases your ability to connect with that that part of your brain the S. j. c. c. so the Nice Courage Party of brain. It also sets your day up on your terms so it's when I speak a lot. I ask people who rate who to raise your hand. If you pick up your phone first thing in the morning you're picking up your own first thing in the morning. You're living your life based on someone else's agenda because you're responding to things if east now it's it's affecting you mentally in physiologically because you see an email from your boss or from your investor whatever so I don't even I don't even get the near the computer or the phone for the first really two hours in the morning. The other thing you mentioned was gratitude practice which we do. I don't do it in the morning but we do every night at dinner. So we go around on ener table with the kids in no matter how bad your day is you have to find something just from today that you're thankful angel for in you know it's really a great way to bring a gratitude practice in the family in one thing we didn't mention the podcasting sure you get a lot of listeners who are or parents out there all of this stuff applies in and in fact some of it more as we talked about the development all of this applies to your kids and we especially especially because they're the generation that's going to change the world and we have a huge lack of of coming of age opportunities his goals taken out gym class. Asan in removing the the rope and my kids up for the death race in a little small version of the of the death rates for for kids death race and they all loved it in about themselves and they worked hard and so all of these practices can apply to kids and I'd make kids doing breathing every morning as well and it just it just sets them up for Great Day. That's awesome. I agree a hundred percent. You know you your whole work is is about fear and you know how much fear rules the world because it's infused into our media and politics and just persistent but are you optimistic. Stick for the future and you see a future where we can be more peaceful as a humor humanity. I definitely see our world changing changing in I would say from the perspective of mindfulness. I think they're going to be there. There's probably into camps that are GONNA develop. One is is going to be a really refined mindful. People like you mark who may have a warriors training background but have a very peaceful mindset because the Gandhi said it best that hate isn't the enemy it's fear in in so so people are afraid and and the reason we can get the politicians in that we have today is they're totally feeding on this fear frenzy in more we can become immune to that the more we can become courageous decision making the more parents can not be concerned whether or not other parents. I think they're being good parents and just do what they think is right for. Their kids. Were that that those people will lose their grip on power so Andrea I think having a mindful society having a society with the right motivation and if people can learn fear and learn to get comfortable worked with fewer than it can't use against you that's that's my mission is to teach millions of people to find more fear in and get comfortable with it. I think that helps lead to world peace for sure yeah I agree. We'll work together on that and our mission is to train and integrate one hundred million people to become world centric warriors and leaders which in compasses you know much of what we talked about today overcoming fear by staring down the fear Wolf Xing greater potential by being mindful and and balancing the body mind and spirit and aligning with your unique purpose in the world and then going out and crushing it but doing it in a way that's beneficial for all of humanity and not just your small ego or your ethnocentric tribe and I think it's GonNa take a generation you know yeah. I think so as well so I think our our kids are the hope and if we're if we're figuring out all the kinks out then they're gonNA lucky ones who benefit from we all will end whether Patrick you're awesome. I can't wait to meet you in person and do some work together. Maybe so let's consider those ideas is how how do we support each other. "sweeney" Discussed on WTF with Marc Maron Podcast
"This Sunday, June twenty third doing his one man show townie, and this is me talking to Steve Sweeney back in the house, back in the house, in California, Steve Sweeney and me. So it's good to see you really good to see you, Mark. I watched you and I watched Joe and I watch other people, it's such an interesting thing to come back here to Los Angeles because I lived here for eight years. Yeah. And I remember having all of these and I came back out for a few auditions and stuff. Yeah. And when I didn't get them I got flooded with those feelings. Like, why am I here and just? Terrible. Third world kind of four oh, five freeway kind of jumping out of my skin, loneliness, and pain experienced when he lived here from when you live. But see, when I come out, I actually have something I feel like a valid human being and I come out to this place. They get to watch guys like you and Joe Rogan and Bill burn all this, and I remember all of you guys, when, when we were kids, well, I remember a lot of you frigging open form. I tell people you wanna get successful in this business open from me, then I'll get to watch go by me. Come by. It's not a race. It's not a race..

"Okay, Travis before we Chris Farley Julia Sweeney on the happy hour. Remember that one time. The thing is Pat where you said. Remember the one time when Cameron Hughes was here set right here in this chair. I've and we did a wine tasting member. He opens your palate up to all these new things. I've been doing a little. Can you take out your organ for me? Sean police. Thank you as a former Catholic. Thank you. This is a sacramental wine Cameron? I will. I will confess to you. That's what the blood of price will not read that. Listen, I need to keep my business going and we love our sponsors. But when I heard about the wind, I'm like, this is going to be shit wine. What am I grasping wine? But I am going to say that I love it. Because all you need to keep Tony show and going, what do you remember the first you came up with the kitchen? I'm like, all right, guys, try this. It's not bad. No, not not bad. I was like, I know wine. This is testing click. I literally when we first got you, it was like, oh, that's great. You know, we were thinking we should have a one sponsor, but I was like going, oh, this isn't any anyone sponsor. This is like insulin. I tried it and I was really frayed I thought, oh God, this is gonna be shitty. But it was like I was like, this is like caramel apple pie with ice cream on top of Chardonnay. That sounds like there are sacred chart. Yes, but I was I was honestly shocked because I thought like I've been and you know you and I thought we were also smart like we know the best blues to get it. You know, wherever his like. Here's six bottles. I get thirty percent, but you realize like first of all, they're way over inflating the price. You see there, so you're not really getting..

"Shares of cbs they are down more than six percent after this ruling by the delaware judge a victory for shari redstone who happens to be cbs director and president of the of her family's movie theater operator national amusements of course they're pushing for merger with cbs and national amusements controls viacom here to tell us more about at all as paul sweeney director north american research for bloomberg intelligence and internet and media analyst for bloomberg intelligence paul is this the the conclusion de believe of leslie moonves his career at cbs well it it certainly could be i think we still have probably six months of litigation back and forth between the you know the all the parties here but this was a big blow for less and for the board that was trying to re assert some level of influence and versus its control shareholder national movement here and and that initial opportunity for them really took a big blow here so this is something that i think you know the neck the balls in the court of sherry redstone national amusements and what will they do with the board what will they do with management including less and i think what the stock down six percent at kind of tells you that investors think a deal is coming in mergers going to happen and it won't include les moonves so so basically shares down more than six percent on the expectation that les moonves will exit from the helm of cbs viacom and cbs will merge a lot of shareholders of cbs don't want just can you bring back the memory of y cbs so why cbs shareholders or against this merger at this point i think cbs shareholders view viacom is a flawed asset it's you know it's a company that's been struggling the cable networks are particularly prone to cord cutting because the the tv networks nickelodeon networks and all those they tend to.
