one who gets to make the final decision on what to do it was a lawyer can give him his best recommendations but at the end of the day Michael and I you will decide how the defense will proceed looking at the whole set of circumstances here is the case tougher for the prosecution or the defense or the highly unusual case because the way this case played out it began as a civil case it began as a whistleblower case for Michael the ninety was representing this client sitting down with Nike's outside counsel and with Nike and having what the defense claimed were reasonable and typical helmet He said he looks forward to a jury hearing all the evidence into judging his conduct. You know, it's going to be interesting for the prosecutors in going forward with this, if he does actually go to trial is to use this same, sort of pattern of behavior as to show common schemes common purpose to jury they can use one scheme and another scheme in another scheme.
