were the crimes that Michael Flynn committed as a starting point Michael Flynn lied to the FBI is when being questioned by the FBI and he admitted that so there's no dispute about that he lied he admitted that he pleaded guilty and now DOJ has proposed letting off the hook anyway my understanding is that he lied to the FBI about two things number one that he was in the employ the tech and a half million dollars from the government of Turkey for Mr erdo one to to make sure the Turkey's interests were well taken care of and the other was that he met with the surgery Kislyak the Russian ambassador the United States while president Obama was still president after Obama imposed sanctions on Russia for meddling in the election and told Kislyak don't worry you you know when trump comes in we got this under control and as a result of that Russia did not retaliate for those sanctions which was something that pretty much never happened before better write Paul yeah that's correct so why is this not a crime according to bill Barr according to the bill Barr it's not a crime because this things in that plan lied about according to bill barber not material to any legitimate investigation by the FBI or the department justice that was under way at the time he was questioned that materiality is part of the crime that's one of the elements of the crime to Richmond pleaded guilty you've got a guy who isn't who not does not have any federal office he's working for the trump campaign trump has not been sworn into office yet Barack Obama is president and this guy now has access to our most secret classified information because of because of the job that he's holding incoming national security adviser he is taking money taking a half million Bucks from Turkey on like on the down low nobody knows about it yet and he is he is telling Russia did well you know just ignore the policy of the president of the United States I mean I I would think that any other normal citizen who do who was doing those kinds of things and the kind of position he was in I sure as hell want the FBI took to be checking out somebody who is in the employee of a foreign government and who is B. train our government to it to another foreign government you know in that kind of a position I'll hire is that not something the FBI should be looking at yeah I think bill bars argument here is absurd so I want to be clear about that and yet early I was a spine your question what the bill bars argument I don't agree with that I agree with you Tom the argument as absurd but when many of our really has to do some mental gymnastics in order to reach the conclusion that the prosecution should be dropped and part of his story that he's trying to tell the court trying to convince the court here is that the original investigation into Flynn was over any involvement he may have had in Russia's interference in our twenty sixteen election and that investigation had pretty much wound down by the time the I became aware of Flynn's conversations with the Russian ambassador on a different topic so far says yeah even though this original investigation was legitimate and then independent inspector general within the department justice has concluded that that investigation original investigations related to Russian interference in our election was legitimate bar says so this interview didn't have to do it that original purpose for the investigation therefore the interview itself was illegitimate and anything he said any lies he told during that interview therefore should not be prosecuted but the crazy argument there's no precedent current argument a bit short being made by the department justice to my knowledge it's crazy and I hope judge so then rejects it at least in part and maybe you know if we have time we can get into a little bit about what the next steps are here well I yeah I let's let's do that right now a judge Emma Solomon has instead of saying to the justice department okay thank you very much you're dropping charges that's the end of that you know if Flynn has already pled guilty twice and my understanding is that a guilty plea is the same thing as a conviction in a court of law it's it's a it's a the end point of a process not the beginning of a process and therefore even if you say all you know we don't want to go to jail anymore we don't want to prosecute him anymore it's already a done deal is not and and opening this thing up to a third party comments yes a weird things were back in January with a plane without a way to sentencing he had pleaded guilty the judge has accepted that guilty plea also it's worth noting that part of that guilty plea it was probably a calculus by the FBI they they agreed to this guilty plea in exchange for Clint cooperation in the Russia investigation so he probably could have been perhaps should have been charged with other crimes but he got off the hook on those crimes only check charged with lying to the federal government he was on his way to sentencing in January he then asked the judge if he could he could withdraw his guilty plea and the judge said I'll think about it re scheduled sentencing for late February and then decided he wanted to hear some more from the DOJ and influence lawyers and requested another round of briefing on that question before sentencing so indefinitely postponed sentencing and it's in that context that the DOJ at that not only on the twenty third hour but at the twenty third hour and fifty ninth minute comes in and says wait a minute we're not gonna prosecute him so now what's before judge Solomon judge Solomon has a motion to dismiss he needs to rule on this motion to dismiss from the DOJ motion to dismiss the charges your chance asking him to do so with prejudice which would mean that the DOJ in the future say January February of next year there's a different energy I will go after Flynn for this again one option for and as you mentioned the judge element has at has now asked or invited amicus briefs and Nikki brings friends of the court to come in and say and it and to argue to the judge whether or not he should grant this motion to dismiss one option is to grant the motion to dismiss but to do it without prejudice leaving open the possibility that charges could be brought again next year with the new Attorney General yes I should I should also mention that we're safe one other possibility hairs judge how women could just reject deny this motion to dismiss and proceed to sentencing denied a motion to dismiss denied a request by Flynn to withdraw his guilty plea and just sentence plan I think that the less likely than the dismissal so without prejudice that would leave the door open for future prosecutions right although there's gonna be some strong from the corporation makers briefs arguing just that point on we've seen now today we saw up Paul mana for getting out of jail on a compassionate release and Michael Cohen the the the good the prisons wanted to let him out because it was just you know of fit within the guidelines but apparently trump said now and so Michael Cohen gets to stay in jail it seems to me like what we have here is you know between Manafort and Flynn a cover up on behalf of Donald Trump I mean they these guys committed their crimes on behalf of true to some extent on behalf of Donald Trump what Mike Flynn be covering up that trump doesn't want known that he's been dangling this pardon overflow and all this all these so you know for a year and a half two years basically keep him quiet a lot that's unknown today about the full extent of president trump's relationship with Russia with Vladimir Putin and other Russian agents with Russian tanks Russian financing for trump's businesses over the in recent decades so it's hard to say but Flynn might be covering up but the other thing I want to mention here is that in any other administration bill bar would be on the chopping block for impeachment here you know bill bart this isn't bars first outrageous move you've got a lot of crazy unacceptable things including meddling in the Russia investigation including meddling in the Ukraine during investigation I'm calling because last year called for bill Barton peach that removal from office and I think it went down trump in the White House drawing all the attention with even crazier less appropriate or I should be more inappropriate and potentially illegal behavior we'll be talking about impeachment bill bar but it's not getting should absolutely not be a barrier getting one voting in fact if anything it should make you want to get out all the more so that we can have our boats out there it's been a big reason why the Democrats and I've been especially strong advocate for having a paper receipt every electronic voting machine that we actually have a way to recounts that even if they tried to do something we have a way to get around anything they would do many the machines do you have that but not all machines and that should be an absolute requirements that we have a verifiable auditable way to make sure that votes are counted so I think those are some good strategies if your local community state doesn't have try to advocate for but so far I have not seen something from our intelligence briefing they're that when you started earning over about three million dollars a year in today's money your top tax rate went up to around ninety percent and of course I'll be J. drop that down to sixty seven down to seventy to seventy four percent in sixty seven but still the enemy top tax rate went up to seventy four percent when you start earning over three million dollars a year and so as a result of that prior to Reagan your average C. You you hear about these people where you're like. Oh my God. You're a drummer to I. Had No idea Especially with drumming. It feels like yeah more than more than a guitarist or bassist especially but Yeah man so Why don't you just Take it away and Kinda give us the spiel about how far it goes back like wh. What do you got for us? It was around. The jazz was starting to boom. I always look at it as the twenties was when you had a lot of people breakthrough for their whether it was Al Jolson or the Marx brothers music was becoming something. That was a part of the common life. People loved it back that and they do today. But you had specifically with drummers I think they they didn't really get there do because it was always about. It still feels like it's about the lead singers and guitarists because you think Mick Jagger and Richards Joe Perry Steven Tyler Yup with drummers you have to fast forward to the days of when you had somebody like a buddy rich or when you had a how Blaine breaking through for people on television audiences. They were more mesmerized. I feel like by the playing. But there's so much more to people because it's kept going to where you have a Neil peart. Everybody looks at it because he's an introvert. They don't realize he was. One of the two bandmates were quoted. As saying is the funniest person I ever met flew under the radar and you didn't realize how complex drumming really is. It's just I feel like as a whole even outside of combat it's never gotten it's do and precautions a very key thing to finding a musical basis even if you don't play something like if you play the guitar or whatever the Banja that of course you would you have to start with rhythm and there has to be a foundation exactly and I think Just you saying that it makes me think that like obviously comedy is a lot about timing. Drumming is all timing and again going off what you said that that twenties thirties forties Drummers we've talked about this on the show before but drummers were the stars I feel like that was like an era of lead men drummers like You Got Gene Croup your buddy rich All these people and I actually I just discovered guy named rain McKinley Who I'm sure. Many many people know about but he was a bandleader drummer. forties fifties sixties and. Just that band leaders who were drummers and he also sang but You just don't see that as much anymore. It's really it's really interesting It was a very special place in history but but one thing I like to is. There's like I think Sammy Davis junior mass. He was a great drummer but he was also on with drumming in having a conversation without his name. Coming up somewhere. Exactly I mean what a phenomenal musician. across the board and also a tap dancer. I think that is also something that corresponds with. A lot of these guys is the amazing ability to tap dance. Like buddy rich. Steve Gadd all these guys were tap dancers. So a lot of truth. Who are some of the The Marx Brothers. I mean now. When we say drummers are we talking about like Obviously in the twenties the drum set was just getting started but Is this like okay? They like to play at home kind of thing for fun or are they performing on stage or in the films as drummers. It's interesting that you mentioned the those days of people like Sammy junior when they had their time. Onscreen at that was. It's what I start to think about. When I think of these performers was kind of the era of two of Gene Kelly movies in the fifties. You always thought of the the tap dancing. Sure that's where I think for a long time there. There wasn't there was a presence kind of underground with drummers and they went on the Could be on television. But they were. You had to be there in the moment to see the actual performance. Where yes somebody like Groucho Marx? I mean they made movies every three to five years. It felt like they were always seen with their instruments. But but drummers I if they didn't get to the public light really until yeah the forties and the fifties when musicals were just the the thing off Broadway. Everybody wanted to see. It's back in the day. All the way up through into the sixties because you know west side story was still winning Academy Awards back when they were something else that people cared to tune in for. But that's a lot of a lot of that came from that time of where they were just starting to be. Were tap dancing and these musicals were in. Yeah Yeah it's it's weird because So like I go on my nightly hunt to find drum videos to post on instagram and stuff and I always. I like to find that like the celebrity ones where I'm like Rosie O'Donnell playing the drums. There's Bob Crane from Hogan's heroes there's I just found one of Marlon. Brando plane Congas it's like. I think there's part of that's like it's a relaxing kind of like hobby to do so. I think there's a lot of secret drummers who just really enjoyed doing it As a hobby not like Sammy Davis where it's like. I'm GonNa Perform this at a USO show in Vietnam or whatever for the troops 'cause it's a relaxing way to kind of unwind but It's it's interesting too because now I don't think it's a good thing or a bad thing but like when you type in celebrity drummer usually the first thing that pops up nowadays is Justin Bieber so which again that's like he's a musician but It seems like it's less in the limelight of celebrities. Who are actually drummers? As well on the side. I don't know if you've noticed that like it's not as common quite as much anymore that you are very very on point with that. I think it's a lot of it. It's I don't know what it is but drumming today. Maybe it just has to do with the way. Marketing is going through the surge in technology. And we've had we've experienced in the last ten to fifteen years now. He even go further. But I think that's very true of you. Don't see it as much because it's all kind of clump together on instagram. Now you know if you follow the Hashtag base if he portrayed the base you'll see amazing videos of people but it. I don't know that that's one of those ones where you kind of have to pick and choose media. Yeah sure it's a ways you know. There's maybe people feel like they've their musical tastes start so but I've loved to do the same kind of thing where I will go. Listen to like the other night was just going through youtube for videos like you were talking about and I don't know why it surprised me but I found a video of Robert Plant and it's the led Zeppelin singer sitting there playing an acoustic guitar. It just it looked. It did not look natural in the slightest but I'm also like why would I be surprised by that? I mean you're sitting next to Jimmy page for over a decade or that. You're going to pick something up there. Something relaxing about it. But that's the beauty of technology to you kinda gotta dig in grinded your heels. Try and find something that's going to appeal to you because it's music is so out there. That's where I give the the tag to my new podcast. I'm actually debuted the first episode coming up. The wonders podcast. It's about one. Hit wonder specifically bulls if technology back in the day you had it existed in the sixties fifties. All the I mean it's like where would we be today? Would it have been the same decade? Not at all you would have not had a one hit wonder because everybody would add a platform for absolutely Yeah and everyone should check that out. Congrats on launching the new podcast. It's exciting appreciate it and I gotTa say before we go further with your show to its. I've had like I put in that post the other day when I went on Instagram to announce being on the show that I've had more than one person who's said that they just have come up on this show and next thing. They knew they didn't have netflix canceled. Subscriptions thanks because your Show is doing something that not enough. People are willing to not just take on the task of running something like this. But it's about the listening really. It's another way to bring us back together through the power sound. I mean it's a certain sound sure I've seen more than one person who's not a percussionist at a rate listens to this with joy. Thanks man. That's Awesome. It's it's a blast to do and And learning things especially from topics like this Where again it's just something you don't think of And I think it would be neat now. May maybe in like steer me back on track if you kind of have a plan. But I'd love to hear a little bit more about some of these. I think like like people. Don't think of as much like Chevy Chase. He was drummer. So why don't you just pick it up and just take us through what you what you were thinking here man. Yeah will vary I it's through the years I've done a lot of research to and it's you pick up especially when you work in radio there's always those fast facts that you get day to day. The common like you know whatever you can think of the top five. Us cities that kind of stuff. You pick up this knowledge but yeah like you mentioned a Chevy Chase. You know those kinds of its again coming back to. How much are you willing to research? Do you need to hear about certain outlets? That are out there to find these people because yeah all I did. I remember watching a Of all places. It was a steely Dan. Song I had on and I'm scrolling through the comments and I see somebody talking about how the two guys don't Fagin. Yeah Walter Regan. And they were both in college together. Their roommate was Chevy Chase so they had a comedic band that they put together. That soon turned into what we knew. Eventually be steely Dan. I've never seen or heard any audio or seen any video of Chevy chase playing the drums. Which is interesting Yes so much. So I've loved to have it on earth. I know there has to be somewhere but I can't remember the quote exactly but I remember hearing the Chevy Chase said like they were like a crappy jazz band or something like that..
