"Welcome back, America. I'm guilty here and thank you for joining me this morning. Now I'm about to talk about Chevron deference and my steeler fans friends think that means there's a line at the gas station like under Jimmy Carter. That's not what it is, but you need to understand Chevron deference and you and to understand why a new court filing in loper bright enterprises versus raimondo may finally lead to what we need in this country, which is a checking in of the administrative state. It's been filed by the former solicitor general of the United States. Paul Clement, who joins me now. General Clement, welcome to the Hugh Hewitt show. Great to talk to you. It's great to be with you. You know, I'm very happy to talk about that. You are a friend of Carol plant lebao and she'd been telling me for years. How can you not know Paul Clement? You know, ruxley, you know, Ted Olson, you knew chuck Cooper and, you know, ten stars. I just never run across and he's too young. So am I correct you've argued more than a hundred Supreme Court's arguments thus far? That's right here. I have argued more than a hundred cases, quite amazing to me. That is so fabulous. And I have personally recommended this man to people when they are looking for Supreme Court litigators because you don't want to send in the local council actually to target before the Supreme Court. This case of loper bright though, caught my eye, Paul Clement, because I teach con law and I try and explain Chevron deference and even law students eyes glaze over, but it can't be an issue for the administrative conference. It can't be an issue for administrative lawyers and professors. It matters to every small business in American carrying great burdens of regulation. Will you explain what Chevron deference is and then what loper bright is going to try and do I delight it to. So the thing about Chevron at least that makes me so kind of concerned about it is you and I have a lawsuit and we disagree about the meaning of a statute. The court is ultimately going to have to figure out which one of us is right. And there's no tie breaker. They have to do all the work and they have to get to a point where they just give their best impression as to what the statute means. But if instead of having a legal dispute with you, I have a legal dispute with a federal government agency, then instead of the courts having to get the statute just right. And figure out what's the best reading of the statute. They essentially get to look at it and unless the statute is clearly in my favor. Then basically the courts will defer to the government.

The Bengals Buccaneers game in Tampa matched two division leaders led by two marquee quarterbacks, Tom Brady and Joe burrow. Early on, this was dominated by Brady and the bucks who jumped out to a 17 and nothing lead, but as Bengals wide receiver Tyler Boyd said, his team didn't panic and capitalized on four Tampa turnovers. "Like i said all they need is one more point than their opponent but what are some things they can do to help. Get there so we're going to look at first. We'll look at that. We'll look at the offense and what i basically was. I looked at twenty twenty trends for both the steelers and the bills. Say if your odds are gonna increase for success if you can do this so let let's kick it off here you go. Let's look at the steelers. let's look rushing yards. I'm gonna give you a number and you're going to be like really. That's all and then i'm going to remind you why now disclaimer. I didn't do passing your words or passing attempts. I did at least two rushing yards because we have to remember the steelers offense although they still have some similar terminology. It's a new offense. It's new offensive coordinator and hopefully more than anything. It's a new offensive philosophy that's ultimately what we want to see steeler fans because that was what was frustrating at times in twenty twenty so this one is a little bit tough it might not fit as much. But i'm going to do this. One based on twenty twenty because the numbers were neat. How about the number of ninety if the steelers can rush for ninety yards or more in this game it will help. Increase their odds of being victorious. Now part of that is that doesn't just been gone. Just run run. Run run run. You want to run effectively but if they get that number it's probably because they're still in a game it's close enough that they can keep running the ball if you if that makes sense to you but your prostate. Why did you come up with a number of ninety in twenty twenty when the steelers rushed for ninety yards or more they were seven no seven times. They rushed the ball ninety yards or more they were seven and oh so and this included the postseason. So if you're looking at a total of seventeen games that means in the other ted that the steelers were five and five ultimately so you're saying wow they were five hundred if they were under ninety yards but they won every game where they went any. Yeah doesn't mean that'll hold true to twenty twenty one but it's a number to start with to say. Hey get that ninety yards rushing and you might have a better chance to win this game okay. So that's one okay. Here's another one. Here's zero zero turnovers for the steelers. I'm not even talking about yet. Turnover margin we'll get there but let's just as the number zero zero turnovers because when you look at that turnover margin okay. Buffalo was six last year when they had a positive turnover margin. Okay if the steelers turn the ball over at all did can't have a positive turnover margin. The best you can do is even so if you hold onto the ball. Then you're taking that a big thing from there away from them the steelers when they had zero turnovers or or was more or less or if they had a turnover margin of zero or more were eleven one k. There are eleven when they were one in four with a negative turnover margin and the only the only game that was was against tennessee. They were i think minus three and they still managed to plus that game which was in tennessee which was crazy so the point is you can't have a negative turnover margin if you don't turn the ball over at all so if the offense takes care of the ball and doesn't have any turnovers you've already done your part so then it's on the defense to to get take away so then you're getting into that positive in that positive turnover margin area area. So you're the thing is is when you're in that negative which means the offense is turning the ball over. That's when you're in trouble so don't turn the ball over game..

I mean, they just destroyed everybody that they played like the games weren't even that competitive, a lot of them. The Denver game. The New England game. The San Francisco game are the three that I think of the most for this. The sealer game again was was was was not quite that, but Um I just don't I think they're like the perfect opponent right? Because what will one there the Steelers just on their brand alone like they're gonna rate but it's not like you're playing Houston Week one. Like the result is still somewhat in doubt. Like it would not be. Oh my God, the the boat is sinking if they lose in week one to the Steelers if it's a close game or not, if they did that to Houston. Or if they did that to the Jets, like there are other teams where it would be very different, and you're going into the game, not even thinking about the possibility they could lose. So like Pittsburgh being that team where You know, like you should. Maybe it's not a blowout. But maybe you're ahead by 10 the whole day, and it's one of those games like they had last year where the score doesn't look like it was a blow out. But you really felt like they had it the whole day and like there was never in doubt. If that's what you get on Sunday and going into it, you think OK, Well, it is the Steeler. Still, it's still Roethlisberger. It's still Tomlin like, Let's see what happens like the result is somewhat in doubt. I think you want that for the hype of the game. Yeah, that's why that's why I did say at some point here. I think they're they're They're a perfect opponent for this. You should feel good about beating if you beat them. And then we'll take a look at the players at the steelers are likely to use in two thousand twenty one to defend one of the most valuable roles in the nfl offense. I'm your host jeffrey benedict. This past friday the steelers played their last preseason game and the only thing that remains of the twenty twenty one off season is a few practices and then the final cut down to the fifty three man roster. Almost all of the starting positions are have been taken. Almost every roster battle has been resolved with one major exception. And that is the nickelback before we get into to foreign nickelback. Bring i'm talking about what a nickel is some. Some people may find this interesting. Other people are going to be like. Why are you talking about this. But i just want to really quickly cover the history of the nickelback because i think it makes a lot of sense and it really helps inform what the steelers want in this position and the people that they choose to play if you look at a nickel package even steelers who run a traditional who traditionally run a three four defense with three defensive lineman and four linebackers when they do a seven man defensive front when they switched to the nickle package and six man defensive front. They put four men on the defensive line with two linebackers. That's because the modern nickel defense is based off of the four three defense. It is not a three four style of defense. You may hear. Some people will talk about the three three defense. Where instead of going to form and defensive line in two linebackers you keep the three-man defensive line and do three linebackers behind them which people have constantly and continuously touted as something. The steelers could play for their nickle package because it is a three man front much like you know the steelers reform package but the steelers go to a four two when they go to nickel and that's the basis of the nickel if you go back in time to the steel curtain when the steelers ran a four three defense and you take their linebackers back when they had. Let's say andy russell. Jack lambert and jack ham. If jack was on was assigned to cover a running back or tight end and that player that he was assigned to cover moved. Off the line of scrimmage and out towards the wide receiver right. If he moved out there jackass just move out and cover him. And if you take if you can take that in your head and get the idea of it and you see how you know andy russell jack lambert would have kinda slid over to cover the fact that only two linebackers were in the box. Now you have a modern day nickel packet. Basically what happened is teams. That could not could not put a linebacker outside of the box and put them in coverage like the steelers could with jack ham. Or even in the andy russell and jack lambert they could do with any of their linebackers. Back then teams. That couldn't do that. Would have would have a mismatch if i can take a player and send him out there and your linebacker has to cover him out there..

Which one would you trade. Well i would probably trade Rudolph so i think haskins has higher upside I want to and he's a restricted free agent next year. So he's going to be here again next year so i know that actually until recently. They're both pretty. They're has route up went under contract so if they can get a third round pick form. That'd be great but i wouldn't actively shop either one of those guys that keep more on the roster because i think you have to if rudolph ceiling as a backup then he wouldn't be a bad backup to have next year provided benz gone. And you have to go with the younger quarterback like like a rookie or if you decide to go with haskins we should have rudolph. Art rooney the second talked about it in the off season before the draft. You knew stuff was coming while part of it is that you wanna see the steelers with improved run blocking the steelers have for the for the two thousand twenty one. Preseason i remember this preseason this have two players in the top fifty when it comes to run blocking grades not only. They have three players in the top fifty two players in the top six. They have the number six and the number one run blocking offensive lineman for the preseason going into the last week who are those two linemen. I'm going to guess of the top. One would be kevin dodson. You are correct with the name but not the position. Kevin dotson is number six in the nfl in run blocking right now. He's he's one of her all but he's number six and run blocking okay. I'm gonna guess. Joe hague that would be correct. Johannesburg is the number one. Run blocking offensive lineman in the two thousand twenty one. Nfl preseason according to pro football focus and that's crazy. because i was reading the comments on articles. Today he might see me actually say that because because someone brought up to like. Oh yeah hey grades. Terrible he just needs to be cut. That's that's not true. You know his pass blocking is not good. He's given up four pressures so far but that was in. Bff pressures in. How many snap in seventy one snaps and out of those past forty pass blocking snaps. He's giving it four pressure so if you think about that. That's that's not really what what what you really want. That's that's that's ten percent of the offensive pass blocking that. He's going to give a pressure which isn't good now no sacks they've all been hurries and he hasn't given up a hit either but i just found that very interesting that that joe hegg did that. Which kind of when you go to make the team. I think that's kind of solidifies that he's probably going to be. Although i can't tell you which that's why kept head offensive lineman with this one. It was lazy. Because i couldn't tell you which one they're not cookie and if it's a weakness of the team why not keep an extra one but that was kind of interesting with joe hague especially if even though we're talking about them or junior being the swing tackle it might be. The johannesburg could be jumbo tight end if they do that just because of his excellent run blocking grade. I don't know how they're going to do stuff. But i just found that very interesting but yeah out of out of everyone. When i said given dots was number one the nfl that was actually incorrect. He is number one of everyone that has had the i. Think the minimum supposed to be forty snaps. There's some guy in miami that only has twelve snaps. That's barely graded ahead of kevin dotson. So i don't know if you really even count them or not but Yeah dotson is. He's turned up in the preseason. All right does good stuff attributed so we have about five minutes left. I don't want to screw people out of five minutes of awesomeness before we do a final thoughts. I wanna ask you all question. You guys have been to a lot of steeler games in your opinion. What happens in a few spots on the offensive line. Who's there. And i really think you're going to say goodbye to somebody that you don't expect. I think there's going to be one or two trades this weekend. I think kevin colbert is going to be busy coming up on. I would not just this weekend. "The steelers second team players. If you think about it like the eagles defensive line they want series. That's what they got. The the eagles offense like with their with their young quarterback jalen hurts. He had two series Things like that so the steelers even had their. They're more starting caliber players out there a little bit longer but it was in that first half and that's where the steelers were not well. Let's just say they didn't win the game in the first half so that's something this week i would like to see. I wanna see the steelers win the first half hour him. Go out there with with the players that are going to be out there. Their best offense their best defense. I don't wanna see when the first half. I wanna see it when the first quarter. I don't know how many of these players are gonna play beyond the first. I'd like to see him get a little bit. I just don't know but let's see the steelers get going early. I talked about this with my brother on the scarborough show that. How much time is ben. Rothlisberger gonna play. And i think it's more about the number snaps than it is the number series. Because if he if he has a fifteen play series in the first quarter and goes down scores touchdown that might be it because the number snaps if they have you know a three out that another drive that after one first down stalls you might seem out there for a third series just to get the number of place. I'm hoping it's less series. I really am. Because i want to see the steelers. Do well in those series. I want to see the steelers win. The first half the i am fine with them winning the second half because what that's showing is some of these things that we were concerned about. The steelers might have more depth than what we realized it could like. Is it that their depth. That good is it that the these players have been coached up better things like that. Who cares i mean. It's nice to know these answers. But ultimately they're still good things for the steelers. I mean the fact that they're out there looking at the. Pf grades just you know. Lafayette pits played seven snaps. He played seven snaps on defense but he had a score of ninety seven point two which which was absolutely crazy. If you think about that. I would like to see a bigger sample size but really don't because i love the fact that the defense is getting off the field you know you also have to look at how. The steelers played out their offensive line. The last game they had rashad coward out there for the first fifteen snaps. And then kevin dotson for the next fifty That's going to be switched now. I mean i don't think there's any way they can deny kevin dotson run with the ones and the steelers. This week finally had the five players. Who many believe are lined up to be the starters for week one of the regular season together for the first time in training camp. This week those players are just in case. There's any question. Chew chor. Four kevin dotson kevin greene trae turner and zach banner. Those are the those are the five you're looking at but the fact that you're getting great play from someone like dan moore junior. You're actually getting improved play from jc hassen. Our you're getting quality play from. I think i've really have to say. Chaz green has been someone that has really surprised me is when he was out there playing tackle that he's giving some some still some statute that wasn't that great but a lot of good quality play..

"Years ago. The steelers were playing. The titans on a saturday might have been three. Excuse me three years ago. They're playing them on saturday. And i'm driving back from vacation and i'm a. We are pulled into a restaurant. And i've like trying to see the game on my phone. And i caught a little bit of this game and i believe that i think it was landry. Jones a threw an interception to this guy. And i noticed player on the other team for the titans making this interception. And it was roberts belayneh steeler i for some reason i never forgot roberts lane and then when he ended up in pittsburgh. I'm like that guy is in helping. Make the titans. Oh no it didn't help them make the titans help to make the steelers. Probably yep there you go to the next thing you know. He's on the steelers the next year. So you pay attention to some of these guys. That's why when anybody says that preseason doesn't matter i think it matters because matters to these guys and they are. They're making their future. I mean duck. Hodges doesn't make the team and i don't buy. I don't spend money on his jersey for if he doesn't do well in that. Preseason game against the carolina panthers in so the the rest ends up being history for the. I mean there wasn't a long history with in pittsburgh but yet it definitely is definitely a big deal. We're able to us here on our podcast behind the curtain to make sure that you are checking out as many podcasts as you can we are bringing all kinds of you and when we're starting to implement some more as training camp gets going we're adding some some new podcast. They were outlined. That was last friday brian. Anthony davis was on with jeff hartmann on last. Friday's let's ride. They laid out. What's not going to be throwing so much more content. We're trying to bring something different with all of our shows. So that's that's the goal. And i it's funny because then it makes me sit back and think what what am i bringing. It's different with with my shows. Well you've got stabbed gigs. That kind of speaks for itself. We do a lot of numbers and we'll try to break things down there on for those of you. That have ever listened to me on on the scarborough. Show that i do with my brother. That's really a family show. It's about you know kind of being family how you would be with your family steeler fans things like that not that we talk about that but it's kind of the way that we run stuff and then i always have a blast on thursday nights doing a steelers preview with jeff hartmann. Brian anthony davis. That's just kind of like our flagship. Podcast of various things that we do. And of course during the season where we're previewing the upcoming najib so make sure you keep an eye out for these new podcast that we have coming out. I'm kind of excited to check them all out myself. So let's get back into our numbers we were looking at saks pressures hurries knockdowns blitz rate. All those things dealing with putting pressure on the quarterback by the defense we broke down the twenty twenty numbers the steelers. When it came to to blitzing they had the the third highest blitzing percentage. They're one of the one of three teams over forty percent. I did forget to say that. It didn't mean that they had they were that high with the actual blitzes that they did 'cause when it came to actual blitzes. They were seven because there were other teams. That were ahead of them But worked considered to have as many. Well they didn't see as many badging attempts. The steelers did some of these other teams like for example. The seattle seahawks. I'll just pull out a random one. They actually blitzed nine times more on the season. Nine times more on the season then the steelers did but they were a much lower percentage because they saw six hundred seventy four passing attempts where the steelers always saw five hundred twenty. Six passing attempts is. What is what we're looking at their. So that's kind of how those numbers go. But for the blitz percentage the steelers were third when it came to hurries and hurry percentage and steelers were second in the league when it came to quarterback knockdowns knocked down percentage. They were first in the nfl. They were first in sacks in the nfl and they were. I buy a ton when it came to pressure pressure rate. You know pressure percentage. So that's what they didn't twenty twenty. If you want to look back the twenty nineteen the steelers did not blitz nearly as much as they did in twenty twenty because in twenty twenty the steelers blitz two hundred and forty four times for a forty point. Three percentage in twenty nineteen they blitz two hundred eighteen times for a thirty six point. Nine percentage that percentage was significantly lower. That was seventh in the nfl seventh. Most and what's crazy is is the baltimore ravens they blitz three hundred twenty nine times in two thousand nineteen three three twenty nine. That's i mean that's more than they did in two thousand twenty or two ninety twenty twenty but that three twenty nine fifty four point nine percent blitz rate my goodness. That's an awful lot of blitzing and once again. It did not pay off hugely in the sack department. They were middle of the league when it came to sacks with thirty cents actually they were passed the league with thirty seven sacks so they're not as efficient with finishing off the quarterback as the steelers were but once again the steelers in two thousand hundred and twenty nineteen was much like twenty twenty. They lead the nfl in in pressures imprint. Pressure percentage not wasn't as much as twenty twenty They had one hundred eighty pressures for thirty point five percent and they were. The only team was over thirty percent but remember last year. They were thirty five percent. Thirty five point one so that was good in two thousand nine hundred and got even better in twenty twenty so they led the league in sacks the led the league and pressures when it came to hurries. They were they were top. They had seventy hurries. Which was very similar. You know a little bit less than that and twenty twenty. They had seventy seven. Hurries an ed. So in twenty twenty there were seventy seven hurries. Twelve point seven percent in twenty nineteen. They were seventy hurries. Eleven point eight percent so not not as much before but they were still getting the pressure and they were still getting the sax when you look at quarterback knockdowns. They were fourth in the nfl with fifty six and And a percentage of ten point nine percent which was actually second in the in the league by point one percent so there were still doing very well in the knockdown category in two thousand nineteen where they had fifty six..

He had a quarterback position is inflexible. All throughout the eighty-five campaign. And that's the problem. And you don't have stability at that position. It could really affect the franchise and as we were seeing up to this point in the season. So the steelers also came out with an all. Baylor backfield of walter abercrombie and frank pollard. And they combined for a first down on the initial three plays on the ground but on a third and seven near midfield the chiefs. Blitzed up the middle with greg hill and mark robinson who just subbed in as defensive backs and the league leader with five interceptions. A man named deron cherry number twenty. This guy was fantastic and pro. I have him in my sticker books. So i knew who this guy was. He stepped in front of john. Stallworth and what's he do tony. He picks it often takes it all the way. Back for a touchdown forty seven yards and just like that. The home team is up seven and talk about a stunner in the beginning. You're right to run cherry. He was one of the premier quarterbacks of his day so yeah he was no stranger to big place and they lost a guy named gary barbaro to the usfl. Gary barbara was a great defensive. Back forum and durant cherry comes in today. No problem guys. I've got this in the stands in a private booth. There were some guys celebrating guys at war. Royal blue hats. Light blue jerseys. The kansas city royals bret saberhagen. George brett guys like that. We're celebrating as the chiefs. Took a seven. Nothing lead on the steelers. It was the third interception return for a score against the steelers in one thousand nine hundred eighty five at that point. I said this was game number ten. So that's not too good after a todd. Spencer returned to the thirty yard. Line outcomes the steelers once again and they return to the ground but to not much avail on third down in a passing situation woodley through an absolute beautiful strike over the middle to the league leading receiver. And that was the john stallworth for thirty three yard gain in front of another very good chief. Defender albert lewis after completion for fifteen yards. Stallworth would li had the black and gold at the kansas city. Seventeen after running. Play the duo said. Hey guys we're not done woodley stallworth. Let's do it again and they absolutely did. It was another fifteen yarder to number eighty two to tie the score at seven but there was a nervous moment. John stallworth was lying on the field on the back of the endzone. Tony what happened. You said it was a beautiful play on both ends. A great pass by woodley and a great catch by star throughout stretched out and caught it and landed on his knee in the back of the end the problem was while ending on his knees sprained his knee and anxious moments to follow. The bluebirds came out as bill. Kenny continue to struggle and the chiefs punted again with good field position. The visitors came out with john. Stallworth injured knee and all coming out to play. And he would not take the rest of the day off. You'll find out what he did later on so he seemed to be okay but there was a problem. Another guy who had a injured knee all season long missed the first five games of the year. He was another former first round draft. Pick from nineteen seventy six. It was benny cunningham and he hobbled off the field and he was gone for the rest of the day. That's leaving the team with only one tighter now in preston gothard a guy who was not known much as a receiver so tony they were losing guys at the tight end position but they had some great receivers. They would pay dividends later on in this game. So here comes the steelers trying to get back on the board again.
