"Banner at my website. Okay, everybody Dennis prager here. Another case of liberty, individual liberty, religious liberty, in Colorado a case of a woman who tell me what is her profession exactly Jake Warner, senior counsel for AVF, what is her what is her profession? Sure, Lori Smith owned 38 three creative and she is a website designer. So she creates custom websites that express messages for people. So she was asked if I understand this correctly to make a website a celebrating same sex marriage and she is a believer in the biblical view of marriage does not support that, and so she has been what find? Well, not yet, thankfully, Laurie is one of those who saw what her state was doing to Jack Phillips, punishing him for declining to create cakes that express messages that go against his faith and she wondered, hey, I wonder how this law applies to me. So instead of waiting for the government to come punish her, she decided to proactively find out her constitutional rights before that happened. So she sued the state to see if the First Amendment would protect her expressive choices in her website design company. And that did not work. So far, it has not. The tenth circuit Court of Appeals ruled that the Colorado state government could force her to create websites with messages that go against her deeply held religious beliefs. And we believe that's wrong. And that's why we've asked the U.S. Supreme Court to weigh in on that. Out of curiosity, this is truly out of curiosity. Could she be compelled by a couple or actually a threesome that was practicing polygamy would she be compelled to make a website for them? It's possible we haven't seen the state enforce the law in that way before, but that would be consistent with how the state has applied the law in the past. So the cause that's a view of marriage that the state could compel someone to create website celebrating that view of marriage if they create websites celebrating a biblical view of marriage. Unbelievable. Finally, I want to get clear on the gag part because that troubles me the most. First of all, maybe you can explain this to me. I hear all the time judges imposing gag orders on defendants. Since when does a court have the right to say to an American you can not speak? Yes. And that's a totally different situation. Typically in the courtroom, you have the court trying to preserve someone's right to a fair hearing or a fair trial. But the court doesn't have the power to force ordinary Americans to express messages that go against their deeply held beliefs. And that's exactly what Colorado officials are trying to do in Colorado. We've seen it in the case of Jack Phillips and we've seen it in the case of Rory Smith. In fact, many of your viewers around the country might live in jurisdictions where officials could use similar laws to compel them to speak or to punish their desires speech, simply because the government doesn't agree with their faith. California Has Become Ungovernable Under Democrats
"The reason you have these horrific wildfires. Is again because of the failure of the state government to control your forests. They'll call it climate change because they blame other people for their own failures. And I could go on and on and on California, starting to depopulate. Who Is Gavin Newsom?
"Newsome. Now who's news? Newsom violated the Constitution was busy shutting down churches, the Supreme Court more than once, twice, maybe even three times had intervened in time to cut it out. He's bankrupt estate. He lived a free life with his family with his kids while he was imposing draconian shutdowns and rules and the rest of the citizenry. Spending is out of control taxes out of control. Not enough water, not enough electricity. Wildfires like we've never seen in California before, not because of climate change, but because of Newsome change. And yet there is a built in Democrat fusion. With government, state government and federal government. And so the teachers union is a perfect example. They don't care about any of that stuff. It is in their personal best interests. Graham made power perspective any monetary perspective. For Newsome to win. They want to control the schools. They want to control the budgets. They want to control their pensions, their medical care their salaries. They don't want to be held to account. They want tenure broadly and early as possible. Tom Newsom is the guy. The environmental groups. They like the confiscatory taxes on the private sector. They don't care how many I believe the state That leaves more for them. They're all in. The mess of welfare state. "For the time this redistricting process is underway. The new york state senate has some of the worst gerrymandered districts Anywhere as you. Well know yet. There's a independent body. That that's crafting maps we've been covering this very closely got Of course but i'm wondering if you as a as a senate leader and having been through what you've been through seeing gerrymandering trying to keep you out of power. Are you looking at this. As an opportunity for the senate to secure and strengthen its democratic majority how are you thinking about the redistricting process. that's underway ker. And when i first ran for senate in two thousand four there was sixty two senators iran against the republican incumbent and the district that i ran for the thirty. Fifth district was a rectangle. It made sense now. Especially after the last redistricting effort that the republicans were able to do after the twenty ten election. My thirty fifth senate district lit is these smiling profile of an old man with the scraggly beard. I named him. Oscar white rock green. I share with senator shelley mayer of most of westchester. But we have three cities between us and it's become kind of laughable. What's happened. They also added a a seat again. There are now sixty three senators. So obviously you know. People have played lots of games and lots of things in order to keep power. Frankly we don't believe we need to do that again. I think if we do the right thing in the right way the right thing will happen with all of those machinations. I have a super majority of forty three members. I have no reason to think that if we just did the right thing in the right way Because of the that new york being new york because we are good at governing and because we have a statewide approach we will continue to grow our majority. So that's my prediction and we will be able to do it in a way. That is respectful of our voters. "And to the extent we can legislate we do and again. We do a lot of work with the assembly. Clearly we've been able to pass more bills together on a variety of things over the past few years the mean usually between eight hundred thousand bills that we agree on. So it's not like we're not talking and we're not on the same page for a lot of things but this has always been our priority. And i think we've made a clinton continues to be especially since in so many ways. The ethics of of people in government is being questioned the challenge. Had the scandals that have occurred You know put that bill which in chambre believe as senator Higher on your on your to do list at all have been any discussions around that you know Instead there's always discussions about making sure that the human rights laws and the protections wherever they way with sexual harassment toxic workplaces. That there's always the conversation about how to make sure that people are respected in the workplace and protected in the workplace. Exactly what to do and where to go so they feel that this is not happening for them and so i can assure you that we will continue to look at that any other Appropriate legislation that continues to underscore that we value people's work we value workplace that allows for you to do your best work and when you do your best work and when you were regardless of a of who you are you will be protected so yes there will be continued conversations on that and we're obviously talking just after as you mentioned very early in this conversation the devastation from hurricane ida that new york There's there's been talk for either of course about next steps on climate policy resiliency questions about following up the Landmark climate leadership and community protection. "And so i am looking at the the j. cole and and whether or not it should remain and and you know how how it agency quote unquote like or how a body like. That should really work in. Serve the public in the best possible way. Is i on our list of priorities. So yes sir. That has has really continued to be something that we are focused on. And i think you're going to see changes. I mean you've already seen changes in terms of j. cole roof alarm and and you know member appointments. And we're we're we're really really very very much interested in making sure that people trust government man. I believe our behavior around these issues will make a difference and as the result of these these other investigations. As you said. There's the book deal there. The the bridge deal is the priorities in terms of testing. There's all these other things that are out there now. Of course the attorney general is looking into his still other jay talking so we will continue to monitor these findings. And to the extent that legislatively we can put forward some solutions and some safeguards and and and guardrails. We will continue to do that. I think people have come to to find the senate. Is that body that that does it and we do earrings along the way right you. Just a hearing jacob the joint commission on public ethics that you mention and what you just said actually ties into my next question on the subject which is state senate majority did pass. Major jacob performs this past session. The assembly did not. There was no Legislative you know agreement on that and then there was obviously no three way agreement with the executive branch. What are you know. And this seems to be a pattern where the state senate is a little ahead or a a lot of head of the assembly on on ethics and other reform issues. How do you get the assembly You know sort of up to speed more on on some of these issues. Well you know. I mean i have enough to get the Work that we have to get done done. I believe that the speaker is You know working with the assembly in order to get what what they feel our priorities. I really suspect band that you be having this conversation with the speaker you can so that if you wanted an answer to that question you would be able to get that but for me again. We were well together Our our senate even when we were in the minority remember have always certain things that we that really is our brand and these kind of transparency issues the ethics reform me when you talk about hearings and sexual harassment. I mean when we looked at the fact that nobody even done any earrings like learning decades. "A time that you in your district listening to your constituents going to events responding to their emergencies on the ground where you continue to have hearings and by the way our senate majority has had more hearings in the time that we have been in are probably The previous senate majority had in its history. I mean we are well over on your hearings. we're having hearings continually on the things that are most important to new yorker. It's all over the state. So i don't think anyone should think that because we are not in albany. We're not working. And i do believe it's important. That we do have a protracted amount of time in our district in order to really be connected to the people that we are representing any issue with governor. Hoke not getting to have senate confirmation of of the nominations that she needs for you know for her administration and you know certain boards in such to move forward until january. She's going to be putting some names forward of course She's already announced to. She'll be nominating for the department of financial services. There had been some some criticism on the left foot about her nominee there but Any issue in your mind about about that lag on the confirmation process for certain appointees lets you see. We were able to move to confirm the the nominations to the cannabis control board. We knew how important that was because we waited a long time. The previous governor had an opportunity to make those nominations did not make them and this is a brand new industry that really requires the positioning of the leadership so that we could get the industry underway so as you can see we were able to to make those confirmations and get it done for the remaining Appointments that she will we have. I think she herself said that. She wanted about a forty five day period because she wanted to assess the talent that is currently in place. She's got to figure out whether or not the the way things are running are are running the way she would have them ron. She's gotta figure out who she would want in these positions so she herself is. I'm i'm very clear about needing an appropriate amount of time in order to make these assessments in the intervening days weeks months. Go she has the ability to make people acting they can act in many cases were months at a time and we certainly will be able to Pick up the nominations when we come back. But i think for her. It gives her an opportunity to take a look at at what she needs. Who has Make sure she's fielding of the appropriate candidates for the appropriate jobs. Have nothing lost. I said in the case of marijuana because of the whole new industry all new department. It's not like all these other agencies and frankly have been running and and will continue to run while the leadership is being assembled right right..

"The best state never in the nation and will mostly look forward here of course but in terms of any reflections. You've had about Governor cuomo leaving office his tenure at obviously coincided with you being the minority leader and then becoming the majority leader there were very tense relationships between governor cuomo and members of the legislature. It wasn't always that easy to get a real feel for your relationship with him. I mean i think that's impart due to how you carry yourself and try to not let any personal issues bleed into the public policy realm but have you had any reflections on how he approached. You treated you treated your your ascension to becoming majority leader now ben. I am really appreciative. Of the fact that you know how i carry myself because i always been very clear i am the first woman leader in the history of the state. I did not take that for granted. I feel you know a made in responsibility for doing and giving of my all to this job. And as i said i don't mind being the i i certainly don't want to be the last and so very very clear that this is the humbling position and i am happy to have it and i have an amazing amazing a senate of majority now but even when we were in the minority and amazing group of people who really understand public service. So i don't have a lot of reflections on how this journey went. I am happy that at least that part of it is is over. But i always considered my you working within the framework that i was working in a exercise in character-building. Shall we say that every every time there was an interaction. You have to be extremely clear on what you wanted to accomplish who you were dealing with. And what was most important so we really wasn't exercise a character building in and it's good. It's always good to build character especially when you are charged with something as important as is helping to run the state in terms of of running state. What are the either things that have already happened in terms of changes in terms of how the executive branch and the legislative branch are working together or interacting. Are there things that have already shifted under governor local that that new yorkers should know about. That are encouraging. Are there any hiccups that concern knew. How is the transition gone or their positive signs concerns as you mentioned. It's just been a couple of weeks but you know government has had to continue functioning as you also said and there's been emergencies to deal with though you know what should new yorkers know about how the transition is gone especially of that relationship between the executive and legislative branches. It's always easier when everybody sees the same reality. I think we're looking at a national level where it seems that some people are living in one world and other people living in other worlds very hard. When you're not inhabiting the same realities to get things done. It is good to have a governor a speaker. we're all on the same planet. We're all rolling in the same direction. I think the response to the eviction moratorium was extending the eviction. Moratorium is really emblematic of how important that it's been clearly. California Voters: Make Sure You Turn out for Larry Elder
"But there's probably more people than you think you are discussed with what's going on. I'm not talking about teachers, unions and all the rest of there's a lot of other people. If you don't encourage them the vote If you don't follow up with them, they're not going to vote. And by all means you got about. Make sure your family members vote if they're in California, and so forth is very, very important. Social media companies have a decision to make do facebook twitter and youtube ban the taliban because of its controversial past or do they let them run their self proclaimed more peaceful new government at the risk of legitimizing historically oppressive group joining us. They've been packing up and pulling out troops in preparing to leave but as that was happening the taliban was going on basically this route of afghanistan. They were taking over provincial. The taliban reached kabul the capital of afghanistan. Where the government is located and the afghan government claps. The president ashraf ghani fled and so essentially. The taliban became the new people in charge of afghanistan. And since that happened. It's been a chaotic and desperate rush to evacuate United states citizens and our afghan allies. Who helped us in the twenty year war in afghanistan. so it's been a mad rush mostly around the kaaba airport to get people out before this rapidly approaching august thirty first deadline

"Short time ago. The president of the united states came out and spoke about the horrific bombing which happened today in kabul. We don't know of course the exact death toll at the moment. But it seems like they're already thirteen American servicemen killed and the president's speech. I thought was one of the more bizarre speeches. I've ever seen by a president and i'm saying this in the year. Twenty twenty one so i want to get quick reaction. I'm assuming everyone had the opportunity to review the president's ben. he's not since he is not capable. He is not competent. He came out. He looked like a mental patient. I mean he really did he he. He looked like he was barely awake. He stumbled his way through a bizarre seven or eight minutes speech. That contract itself about seven different times. He tried to rely very heavily on the. I'm empathetic joe. Routine the but the minute. That questions began all that went out the window. And he became combative joe He had nothing of merit to say. Yes no defense for his policies because this policy garbage and most of all if you're an american enemy watching the president of the united states on the same day that thirteen american soldiers are killed twelve marines. And you're watching. As the united states turns tail and runs leaving a thousand plus american citizens behind in kabul plus an unspecified number of thousands of american green card holders plus hundreds of thousands of people who will immediately be slaughtered by the taliban and as it turns out the united states government handed a list to the taliban of all the people we wanted to evacuate in the know precisely who to kill five just in kabul. They're americans all throughout the country. Weren't even talking. Yeah that's right if you're watching this as an enemy of the united states and then you watch this adult old feeble minded man walk out and barely make it through sentence. You're thinking you're like homer simpson with a hamburger right now. The united states is dependent on the good graces of the taliban. It sounds insane to say that but we are dependent on the good graces of the taliban to get americans out american citizens american Not forces and those Afghans who aided the american military effort. So the the fact that you know. We're having meetings with the taliban. In which in this case i think has to be done. Underscores the dependence position that the president has put us in here now bar. Dr of course does not control al qaeda or isis or any of the other splinter groups. That are there. It is unclear to me whether or not we actually have operational security guarantees from the taliban.
