And then just to get utterly destroyed by Joe Kernan in in a sentence was just in the all his only response is, uh, yeah, OK. And then, you know, on to the next. The last the very and here's the thing. This is why you have to watch the video. Because you can't just listen to the audio at the very end when they're talking about it. And Joe kind of is like, well, let's be pretty much everything on the one year, the five year and the 10 year. And then he kind of does this kind of like snarky, smirk, shrug thing that you have to see it to understand how trolly it is. It's it's the best. It's it's it is the classic. Later today, we have Eric Yeeks joining us. This is just my opinion. I feel like Eric is one of the deeper thinkers in Bitcoin, like talking to him, like hanging out with him. So looking forward to that part of the convo today. Let's roll with all the stuff. So apparently Mexico is unboxing aliens. You guys see that? Yeah, they're they're ET extras. Didn't you notice? Yeah, they're animatronic ET extras that they found somewhere in a warehouse. They got Spielberg on a hangover day that they should have got James Cameron or something because it's just it didn't have the effect I think they wanted. So they're a little they're like a little clay dolls of ET that they found in a warehouse in Spielberg's fucking storage area. They're just they're just little people. They're tiny little aliens. You guys don't think that's real? Does it matter? I mean, right? I mean, who cares? Who gives a fuck? I mean, look, dude, let's talk about Bitcoin. All right, let's let's get the let's get the Gensler video up and ready to roll. So Gensler, I guess he's what was he being used testifying before Congress or something like that? He seems to have taken a very kind of what's the name of the video? The word in this interview anyway, my take is he's he's pretty much standing his ground. He's like, screw you guys. This is what's going on. And this needs to stop. So let's roll it. Yeah, so it's a short clip, but I think you get the point. Get the feel there. I think I feel like Gensler has been on the back foot a lot lately. People have been getting after him, especially after FTX, et cetera, et cetera. But I don't know, it sounds to me like he's he's feeling pretty grounded there and just saying, hey, there's a lot of bullshit going on in crypto, which, by the way, I agree with. There is a lot of bullshit going on in crypto. Anybody have any thoughts on this? Yeah, I saw some of it, Alex. I don't know if it was in that clip or later when he talks about the spot ETFs. I'm a big fan of looking for the body language because these folks are always so nails when it comes to not showing any cards. But Gensler had a few like kind of, you know, when he started talking about all the the institute, all the different funds that have applications in, he almost got a little nervous, like, you know, like, like he showed a little bit of body language. I like that. I agree. I think body language, by the way, is super, super, super important in general, like you communicate, humans communicate way more with their body language than they do in any other way. So I agree with that. But the understand those are two different things, right? The one thing he was talking about was fraud, abuse and misconduct in crypto, which he seems pretty grounded on. I did not see the part about him talking about all of the different ETF applications, by the way, which is something I'd like to get into more here in a little bit. But it makes sense that he'd be nervous about that if the current plan is we're going to approve some of these and we're not going to approve others because then they're going to get their asses sued, I think. Peter. I have a completely different take. I think Gensler is becoming more and more inconsequential and not credible in this conversation. I think he's, I think he is, he has, I think he's being droned, droned out of the narrative. That's what I think. I'm not sure that's possible. I mean, he's literally the chairman of the SEC. So Bitcoin doesn't care. Tick tock. No, Bitcoin doesn't care. Fuck them all. No, no, I get what you're saying. Bitcoin doesn't care. But I think he's becoming inconsequential. I really do. I think that that that that three letter agency is becoming inconsequential. I really do. I don't think it has. I don't think it has the same power that it's had. And I think that the losses that they have have incurred in court over the last, their credibility is just going down the drain. That's that's how I feel about it. I just, I, I listen to him less and less. All I hear is a little, little, little mouth opening and closing in the background. Now, I really don't care what he's got to say. Yeah. Okay. I get your point. So that's your feeling about his level of credibility, but that's not a, that's not necessarily what's going to happen in a court of law. Right? So what really matters at the end of the day is what happens with the lawsuits. And they're, they're not doing great when it comes to, you know, the results for our GBDC. This is, and as, and as Terrence and Joe Carlessari will tell you, and as I know, you know, the court's move at a glacial pace. And so all of this stuff is going to be resolved in what, three years? And by that time, it doesn't matter. That's my point. Why wouldn't it matter when I, when I say, and I'm not talking about the ETFs, I'm talking about the shenanigans in crypto. Why wouldn't that matter? To me, that matters a good deal now. Well, it matters. It matters to the individuals that are, that are being impacted by it. But the reality is, is that even if, um, even if they become, um, unregistered securities and they all go away, what's the next iteration. There's always going to be another iteration of, of these scams. And, you know, that is just until Fiat goes away until Fiat virus and Fiat mentality goes away. That's, we can expect this to happen over and over again. That's what it's done. We've seen it. We've seen it in traditional markets since the, you know, since, since the Dow Jones was probably put in place, we've seen these scams. Let me ask you a question. Do you think humans eventually develop immunity versus certain types of scams? I think there will always be scams because there's always dumb humans, right? There's always some idiot who's going to fall for something or somebody who is gullible enough to fall for something. If that were not the case, you would not have like, you know, these Indian sweatshops where they're, where they're dialing for dollars. Right. So the question then becomes though, which scams are working on what percentage of the population. Are you going to fall for a Nigerian email scam at this point? Probably not. What's the percentage of the population that's going to fall for a Nigerian email scam right now? I feel like the human race has a, has like a way of self -inoculating against these things over time. Granted, there's always going to be some percentage that'll never go away that the, it becomes a math equation, right? Like how much effort is being expended, how much resources are being expended versus how much can be taken from people in scams is what it comes down to. Yeah, Alex, a lot of it.

We are joined now by a special guest to help us unpack the latest development and its significance. Joining us is Ira Lee Sorkin. He's the former attorney for Bernie Madoff and a current partner at Mintz & Gold. Ira, how are you today? Good. Thank you. So first of all, top, I just want a high level, informed perspective on this SPF thing. You've seen some major cases play out in your day. Is there anything that is especially striking or notable about the SPF case here and now? What are your high level thoughts? High level thoughts? The media interest. Next question. All right. Let's do it. All right. Next up. Next up. Media interests. All right. So he's in jail now. He's waiting for his October court date behind bars. You gave a similarly concise comment to CoinDesk back in December saying that Sam Bankman -Fried should quote, just shut up already. Sorry, I paraphrased you, but basically it was shut up. Those were the two words of advice that you provided to Sam Bankman -Fried. I don't think he took that because the judge said he was really pushing the envelope with his communications with various witnesses. Is that still the piece of advice that you would share to Sam Bankman -Fried if you were his counsel now? I mean, there's no need for him once he was made bail for him to discuss the case, to share his thoughts about the case with any party other than his counsel. And quite frankly, the amount of documents, and I say this with the understanding that Minson Gold does not represent anyone in this case. We certainly don't represent Mr. Bankman -Fried. We don't represent any witnesses. We are not involved in the case. But the standard conduct that every defendant who makes bail is told, do not discuss the case, don't discuss it with any potential witnesses, don't discuss it certainly with the press. The only person you should talk to is your counsel. And there are ways to deal with other witnesses in the case, such as through counsel and a process called a Joint Defense Agreement, where the lawyers can talk to one another pursuant to an agreement, and it protects the attorney -client privilege, and it gives the opportunity for all counsel in the case, whether they are defendants or unindicted co -conspirators or conspirators, to be able to share information amongst the lawyers without their clients being present. So those are the general rules. There's nothing unusual about this particular case. When Sam Blankman -Fried made bail, he was specifically instructed not to discuss it with anyone, discuss the case with anyone, don't discuss it with any potential witnesses, don't share what you are given in the way of the mandatory discovery that the government's required to give to all defendants. And, of course, we have another situation going on in Washington, D .C., and in the Southern District or the Middle District of Florida, I think it's the Southern District of Florida, where a rather prominent individual was given the same instruction by the judge. It's standard, and that's the way it's done. If you violate the bail conditions, which Mr. Blankman -Fried violated according to the judge, then he faces the consequences and the consequences are jail. My understanding is that he's going to appeal it. He's got a very good lawyer representing him, and they're going to appeal it, but the chances of him getting out pending the trial, I think, are very slim. These are decisions made by the district court judge, who happens to be a judge of many years, very well respected, very smart, and the court of appeals is not going to question, I believe, his decision because he knows the record, and he knows what the bail conditions are.

Well, folks, I want to start off by giving you some perspective about all markets and bad actors and good actors. You know, quite often we hear Gary Gensler say there's a lot of scammers and hucksters and whatever else in the crypto market, right? He's painting the whole industry and asset class with broad strokes. But we know that's a lie and he's just gaslighting, right? But if you look at all markets, there are bad actors there. For example, UBS, one of the largest banks to pay $1 .4 billion for fraud in mortgage backed securities. So great example that even a established, fully regulated industry still has fraud happening, JP Morgan and all these banks, Wells Fargo, they all get billions of dollars in fines almost every year because they're doing something shady. And that is because in civilization and humanity, there are bad people looking to do bad things. So it's not that the technology or the asset class is bad, but rather there needs to be proper regulations and we have to weed out the bad actors. Now one could argue it's not possible to weed out every bad actor because we don't know what's happening in the minds of people. We're not mind readers, but we at least have to have proper regulations. So when you see the likes of Gary Gensler and others who are anti -crypto, gaslighting and putting out sensationalized headlines, don't be dismayed and realize what's happening. They're trying to put out a narrative. And we know crypto is here to stay. There are a lot of folks building with the technology. Are there bad actors? Of course, just look at Sandbank -Meerfried, right? But Sandbank -Meerfried is crypto's Bernie Madoff. So you just see these things when you line up all markets, you see the bad actors and of course the good actors. So a great example here. Now folks, Michael Burry, the big short Michael Burry, apparently he is running some shorts here and it's at a market value of $1 .6 billion. Apparently he bought $890 million of the SPY puts, bought $740 million of the QQQ puts Now, we don't know what the expiration dates are on these. So we don't know what the timeline is here, but he's looking to short the stock market and we'll see how that works out because look, he was right with the 2008 mortgage backed security situation and everything that took place there. He was absolutely right, but he hasn't been right every time. And we'll see where this goes. But I think he's seeing something on the horizon that what many of us have been tracking, many analysts is that the stock market is retracing. I don't know if this is a move to all time highs. I honestly don't know. I took some profits recently because I'm like, I don't know. I'll walk away with some money on my stocks, but we'll see what happens. And, you know, as far as the stock market and we know Bitcoin and crypto has been correlated to it, you know, Bitcoin is at a pivotal moment right now. So one of analysts tweeted out sideways at $29K has run its course. So it's decision time for Bitcoin this week. Is our next significant move up or down? You all know. I'm hoping it's upwards. Right. I've been sharing a chart with you guys for over a year now where we've been following Bitcoin's retracement. You know, certainly it's going to be a roller coaster ride upwards, just like it was in 2019. Nothing goes up in a straight line. But boy, I hope there's another leg up that takes us to, you know, 40K plus. And that will be a nice retracement move, at which point I'll take some profits. But there's no guarantee of that. And right now, Bitcoin is still holding support here with this trend line. But boy, like I said, guys, I'm hoping for another move up. We'll see what the catalyst may be, maybe some bullish news, some other big player entered in the crypto market. But let's keep our eyes on this. Hopefully it's not a dump. All right, folks, we got some very huge Hedera HBAR news. You all know I hold HBAR in my portfolio. I am bullish on it. I continue to dollar cost average, you know, not financial advice. Please do your own research. So here's the headline. FedNow showcases DLT powered payment system as service provider. The United States Federal Reserve's instant payment system FedNow has added a company powered by the distributed ledger technology platform Hedera Hashgraph to its showcasing service providers. On August 14, FedNow's official website added DROPP, a micro payments platform built on Hedera to its FedNow service provider showcase section. The section aims to connect financial institutions and businesses with service providers that can help them innovate and implement instant payment products using the FedNow service. Folks, this is really huge. I mean, the Fed endorsing micro payments provider that is built on the Hedera blockchain. That is huge news. If you hold HBAR, remember, they don't necessarily have to be using the HBAR token, but we're talking about Metcalfe's law, network effects, right? The more building on a network, the more adoption, the more participants, the stronger the network becomes, the more valuable it also becomes. And of course, in this digital realm that we live in, in the token economy, the native token will increase in value, folks, because the tokens grease the blockchain, right, help to process and fund the blockchain. So this is huge news. I'm very, very bullish on HBAR. Once again, not financial advice. Please do your own research. According to the FedNow site, DROPP is a digital solution that was made so that merchants can accept payments at low cost. The company uses DLT and regulated banking tech to build its solution that allows merchants to accept payments without paying huge transaction fees. While the new updates seem like the Federal Reserve is warming up to the DLTs, the FedNow service also wrote on its website that materials are only presented as convenience to potential FedNow service participants. So huge news, folks. And remember, the folks who are part of the governing council for Hedera, their global governing council includes Boeing, Dell, Google, IBM, LG, ServiceNow, Standard Bank, much more huge, huge brands. This is one of the projects I think will come out of the whole speculation bubble and enter the utility phase and be one of the crypto blockchains that have lasting potential. So I'm very bullish on this. All right, let's move ahead. We got some updates here from Eric Balcones of Bloomberg around Cathie Wood's ARK Invest crypto ETFs. So he said new filing from ARK for a digital asset and blockchain thematic ETF will hold equities. So this is interesting. Cathie, we know she's trying to get a Bitcoin spot ETF. She's in line with BlackRock and the others, but they're also looking to build new ETFs, too. So here, Nate Geraci of the ETF store said, odd filing, given how saturated this space is. He's talking about the equity ETFs. Wonder if there is anything to read into here regarding ARK's confidence around spot Bitcoin approval, which if it happens, these blockchain ETFs would face an additional headwind in terms of competition. So maybe ARK is not that confident. So we shall see. Look, I think it's certainly almost guaranteed that BlackRock is going to get approved because of their record and because they pretty much run the world for the most part. But let's see what happens. There's no guarantees here, folks. And look, there could be a buy the rumor, sell the news event around these ETF approvals. So just be prepared for that. If an ETF is approved, that doesn't mean billions of dollars are coming in overnight. They have to set up the marketing, the structures. They have to get the RIA's onboarded, right? It doesn't happen overnight. They'll probably need a few months. If you look at the when the gold ETFs were approved, it didn't pump instantaneously. It pumped maybe like six months later the gold market. So something to keep in mind, folks, and, you know, know how to strategize. All right, folks, let's move ahead because we got Jay Coward Clayton. Yes, former SEC chairman that I call a coward because he's the one who filed a lawsuit against Ripple and ran out the door the next day. He did not approve a Bitcoin spot ETF. And of course, we know he was doing some corruption in the back room with Bill Hinman and Ethereum to get them the free pass, nothing against Ethereum, but rather the SEC corruption, because guess what? These are the people who are supposed to have integrity. They're funded off our tax dollars and they're supposed to be stopping the bad guys, but they themselves are the bad guys doing fishy corruption in the back room, getting paid millions of dollars. So Jay, of course, making his biweekly appearance on CNBC Squawk Box this time, he was talking about Sandbag Refreed and of course, the Bitcoin spot ETF. And of course, the Joe Kernen, Becky Quick, Andrew Ross Sorkin and these folks failed to do their job. No questions about the Ripple ruling. Of course, there was no question when he came on the show, I think last week or the week before, because they're clearly and probably Jay doesn't want to answer anything and they're kowtowing to that. So it's pathetic. It is not how a journalist does their job trying to bury a story when the man who filed a lawsuit is sitting right in front of you. Right. And this ruling, we know how huge it is. Members of Congress are using it as a president to push their crypto bills through and much more so pathetic. Jay's a coward. And of course, he doesn't want to talk about it. Pathetic. They won't even ask him the question. It's not like they ask him the question. He's like, you know what? Good for Ripple, but I don't want to talk anymore. You know, it could have been that much. But guess what? No questions. Zero, zero questions. So, you know, there's a big cover up. There's a big Jay is just a coward. Like, don't even ask me that question. So screw Jay Clayton. He's a coward. Let's move ahead. Coinbase launches nonprofit to advance crypto legislation to stand with Crypto Alliance will prioritize supporting and advancing legislation in the US that supports the industry and investors. The stand with Crypto Alliance is something Coinbase obviously is trying to get going and they want you to participate and sign up. This is great, guys. We need need more of this, more advocacy, more education, more getting the word out there so that we can bring more folks together and unite against folks like Gary Gensler and corrupt bureaucrats and regulators like Gary Gensler. So the alliance is a 501 C for organization under the internal revenue service, meaning it is an exempt social welfare group. The current discussion around crypto policy in Washington, D .C., between centralized players and other big groups. Kara Calvert, Coinbase's head of US policy, said Monday during a Twitter Spaces event, but the stand with Crypto Alliance hopes to bring new voices into the picture. Here's a quote. The alliance completely embodies exactly what the crypto industry is all about. Calvert said it's all about decentralized efforts, decentralized power, decentralized access. And that's, I think, really what the stand with crypto movement is about. So this is great. I love it. I wish more crypto companies would unite and do this. And get the once again, the word out there. Education is a big key in D .C., getting our representatives educated about blockchain and crypto. We're seeing more and more bipartisan support for crypto. So our efforts are paying off, but we need to do more, of course. Now, folks, there's some interesting news coming out of Argentina. So pro Bitcoin candidate Triumph sees Bitcoin reach historic high against Argentinian peso. So we got a presidential candidate. I honestly don't know much about this person, but, you know, a lot of people are bullish on this because his name is Javier Mele, if I'm saying that right, won the country's primary presidential race. He's pro Bitcoin. And we know the folks there are dealing with insane inflation. Many have been moving to Bitcoin as a store of value, as well as stable coins. So hopefully, you know, some things could happen here where they can maybe make Bitcoin a legal tender, something along those lines like El Salvador. But there is something else happening in the mix here. So Mele's unexpected triumph is seen as a rejection of Argentina's entrenched political establishment. The pro Bitcoin candidate became anti establishment after proposing the dollarization of the economy and call for the abolishment of the central bank due to the country's economic woes. So they want to certainly use the US dollar over the Argentinian peso. And I don't blame them. So this could be a really big move. And once again, this guy's pro Bitcoin. So let's see where it goes. Moving ahead, new indictment alleges Sam Bankman -Fried gave more than $100 million to politicians. Bankman -Fried and his associates donated across party lines to various candidates and political action committees. Boy, look, I am not a conspiracy theorist, but man, this guy donated a lot of money and it's probably why he's been getting the easy path, right? Being able to stay at home in his parents' house. And obviously recently they were like, no, dude, you're trying to, you know, game the system. He released Caroline Ellison's diary. So witness tampering and all that. And they were like, all right, we're going to put you in jail. So that's a good thing. He's in jail. But look, there are some people saying he could have an Jeffrey Epstein situation, if you know what I mean. And that wouldn't surprise me, folks. This man has a lot of dirt on politicians. He made them all look like fools, right? And that's, I've often talked about it. Optics is a big thing in politics. It's narratives and optics. So right now he's not making a lot of people look good and they want him gone. As you can imagine, like get the hell out of here, whether it be in jail or you know what else. So it looks like they may try to bring back some of the campaigns, finance charges that had been previously dropped, but we shall see what happens. And hopefully, you know, he sits in jail for a long time because he committed the crime folks. He's the one that was committing fraud. He's the one that was okaying funds, leaving FTX and going to Alameda, which was his firm. They were trading that money and losing it. So straight up fraud, as I said earlier in the podcast, he's the Bernie Madoff of crypto. But let's hope justice is served here and we'll follow this as it continues. Now, here's some not so good news. Coindesk lays off 45 % of editorial staff as an eyes deal to sell company. Look, it's not so much that they laid people off, but it's in conjunction with what else has been happening with Digital Currency Group. So Digital Currency Group owns Grayscale, Coindesk, Genesis Trading and much more. And we all know what has been happening with the Genesis Trading and Gemini situation. So Barry Silbert and these guys, it's not looking good. And I would not be invested or involved in anything Digital Currency Group, guys. If you're holding Grayscale shares, just be careful. I don't know what's happening here with this whole parent group and they could be in big trouble. So especially with the Genesis Trading situation and who knows if there's going to be cross contamination, the fact that Genesis Trading is in a hole and they are going to have to pull money and sell Coindesk and all these things, it's just a mess. So I don't think these guys are running the business well. Once again, it doesn't have anything specific to do with the blockchains or the crypto currencies, but rather, you know, the risks that you take and how you run your business. So we shall see. Friday, Sam Bankman Fried got his bail revoked and was shown to a jail cell. We are joined now by a special guest to help us unpack the latest development and its significance. Joining us is Ira Lee Sorkin. He's the former attorney for Bernie Madoff and a current partner at Mintz and Gold. Ira, how are you today? Thank you. So first of all, I just want a high level, informed perspective on this SPF thing. You've seen some major cases play out in your day. Is there anything that is especially striking or notable about the SPF case here and now? What are your high level thoughts? High level thoughts, immediate interest. Next question. All right. Let's do it. All right. Next up. Next up, immediate interest. All right. So he's in jail now. He's waiting for his October court date behind bars. You gave a similarly concise comment to CoinDesk back in December saying that Sam Bankman Fried should quote, just shut up already. Sorry, I paraphrased you, but basically it was shut up. Those were the two words of advice that you provided to Sam Bankman Fried. I don't think he took that because the judge said he was really pushing the envelope with his communications with various witnesses. Is that still the piece of advice that you would share to Sam Bankman Fried if you were his counsel now? I mean, there's no need for him once he was made bail for him to discuss the case, to share his thoughts about the case with any party other than his counsel. And quite frankly, the amount of documents, and I say this with the understanding that Vincent Gold does not represent anyone in this case. We certainly don't represent Mr. Bankman Fried. We don't represent any witnesses. We are not involved in the case, but the standard conduct that every defendant who makes bail is told, do not discuss the case. Don't discuss it with any potential witnesses. Don't discuss it certainly with the press. The only person you should talk to is your counsel. And there are ways to deal with other witnesses in the case, such as through counsel and a process called a joint defense agreement where the lawyers can talk to one another pursuant to an agreement, and it protects the attorney -client privilege, and it gives the opportunity for all counsel in the case, whether they are defendants or unindicted co -conspirators or conspirators, to be able to share information amongst the lawyers without their clients being present. So those are the general rules. There's nothing unusual about this particular case. When Sam Blankman Fried made bail, he was specifically instructed not to discuss it with anyone, discuss the case with anyone. Don't discuss it with any potential witnesses. Don't share what you are given in the way of the mandatory discovery that the government's required to give to all defendants. And, of course, we have another situation going on in Washington, D .C., and in the Southern District or the Middle District of Florida, I think it's the Southern District of Florida, where a rather prominent individual was given the same instruction by the judge. It's standard, and that's the way it's done. If you violate the bail conditions, which Mr. Blankman Fried violated according to the judge, then he faces the consequences and the consequences are jail. My understanding is that he's going to appeal it. He's got a very good lawyer representing him, and they're going to appeal it. But the chances of him getting out pending the trial, I think, are very slim. These are decisions made by the district court judge, who happens to be a judge of many years and he's very well respected, very smart. And the Court of Appeals is not going to question, I believe, his decision because he knows the record and he knows what the bail conditions are. Thanks again for joining us this morning. I wanted to ask about the significance of being able to prepare for what's coming in October while in jail. How difficult is it? How difficult is it to talk with your lawyer or with your client during that period? Is this a huge disadvantage now going into October? It is a huge disadvantage because there are, from what I've read and heard, there are innumerable documents, many, many, many, many, perhaps millions of documents that the government is required to turn over to Mr. Blankman Fried's counsel. And having had clients who are incarcerated and not being able to make bail, it is very difficult in a paper case such as this to prepare for trial. The facilities at the Metropolitan NBC Brooklyn Center, where he's being held, very, very difficult to prepare. But this is something that I have no doubt his lawyers spoke to him about and I'm just speculating and said, if you stay out, it'll be much easier to prepare for trial. If you're incarcerated, it's very difficult. The facilities are bad. There is privacy, but to load in all the documents and all the information that the government is required to turn over to his lawyers is going to make it very difficult for him to prepare. But it's done. There are a number of people who don't make bail, but it's done. It just makes it a lot more difficult to prepare. I want to talk about these diary entries. They feel like the straw that broke the camel's back here. Sam Bankman Fried's attorneys say that he wasn't trying to tamper with witnesses, that they confirmed he did leak a few pages of the diary to The New York Times. Could this come back? Could it be brought up again once this does go to trail in October? And how might it affect his case? It won't affect it at all. The fact that he disclosed information to The Times or to any media. Let's make it general media. It's not going to affect the trial at all. It affected his bail, obviously, but it's not going to affect the trial. What he turned over, we don't know. I don't know whether The Times has published it or intends to publish it, but there are First Amendment and some freedom of press issues involved in that. And I'm old enough to remember the Pentagon Papers case and Daniel Ellsberg. And that didn't stop the disclosure of information that came to the press. But it didn't affect the trial and it won't affect the trial here either. I have a question for you. Myself and a lot of other people are speculating that Sam will be given special treatment because he comes from a family with a lot of influence and money. Do you think that that is something that we will see play out that he will be segregated away from the other inmates and he will receive special treatment while incarcerated? The short answer is no. He may be segregated. Often defendants who have some notoriety are separated. But the short answer is no. I don't believe he's going to get any special treatment in jail. Jail is not a very nice place, particularly the Metropolitan Correctional Center in Manhattan, which is closed, and the Brooklyn Correctional Center, which is open. And he will not be given any special privileges. And certainly the facilities do not consider the success or wealth of the family or those who put out the help.

"Don't have a timeline of events. He had told Andrew Sorkin yesterday something very important. It was November 6th. Why is that important? November 6th is when he said he started to get worried about the company's finances. November 7th, he was tweeting to the world that everything was fine. So what did he know? We don't know what he knew. And Tom, I'm gonna, you know, probably annoy you a little bit, but I'm gonna call it Bitcoin here. It's at $17,000 per token. It's not zero. So, I mean, the crypto space in general is surviving just fine, thank you, but obviously the issue is there are a lot of customers on the FTX exchange that lost a lot of money. That's my problem. I looked it up and I think it's year to date or 12 months trailing. I'm sorry, I can't remember what I did. 47,000 to 17,000. Is the underlying. A lot of people have lost a lot of money in the last couple of years if they don't. Why Sorkin was great on this. I'll give a major credit. I mean, who's going to say no to doing the interview? But I am baffled by the response here versus other scandals we've reported over the years. Listen, it's so not over yet. To your point, he has not made it to the United States. The regulators and the lawmakers have not looked into this at length yet. We don't know what happened. Very simple. I read this morning every word of a report on kraken is it? Kraken. Okay, that's like real people losing real money losing real jobs, right? And BlockFi also has had to fire or save the fire two thirds of their workflow. How do those people respond to what they observed yesterday are in good quality? Furiously to your point here, they've lost their jobs, and by the way, remember, block five's relationship with FTX is what exacerbated their downfall as well. Don't be a stranger. Her name is Anna Delphi, or anisa Sorkin, no one's sure she's either a mega rich German heiress, or she's flat broke, and maybe she's Russian. Vivian. That's the point. No one knows. But everyone knows her now. And a soric and was a con artist with an extravagant lifestyle who convinced New York's elite that she was a German heiress, conning acquaintances, banks and realtors. So the unadulterated foundation is a private club, but it's also a dynamic visual on sector. I wanted to be a place for people with taste. The drama series inventing Anna was an instant hit for Netflix. But now it's turned into a legal headache, one of Anna's former friends is suing Netflix for portraying her as a backstabbing freeloader. Big night out? I was, um, I couldn't sleep. Living your best life. I see you, Rachel Williams. My guest is intellectual property litigator Terrence Ross, a partner at cat and nuch and rosenman. Terry, this was not a documentary, Netflix called it a drama inspired by a true story. And at the start of every episode, there was this disclaimer. This story is completely true, except for the parts that are totally made up. Does that protect Netflix in any way here? Not necessarily, June. In fact, I can't imagine a worse disclaimer being used. I really wonder about who came up with this. This story is completely true, except for the parts that are totally made up, but we don't tell you which parts those are. I mean, it's this bizarre. Indeed, I think, to a certain extent, by saying at the start of the disclaimer, this story is completely true. You were sort of reinforcing the view that people have that this is just a recitation of the actual events as they occurred. So the complaint says that it's going to show that Netflix made a deliberate decision for dramatic purposes basically to tell a better story to show Williams doing or saying things that portray her as greedy, snobbish, disloyal, dishonest, cowardly manipulative, and opportunistic. So is this false light invasion of privacy? It might be. It's certainly not as clear cut as the plaintiff seems to present it in the complaint. The core of false light invasion of privacy, which has elements very similar to defamation. So you got to show a false statement that somehow places the plaintiff in a false light. You have to show by clear and convincing evidence, actual malice. And then you have to show that it was highly offensive. The portrayal was highly offensive to a reasonable person. Some of these factual claims, even if accepted as true, I'm not sure that in this day and age that a jury would find them highly offensive. Now, I will set aside the parts about the purported false billing on her credit card back to her employer. But these comments greedy snobbish, manipulative, disloyal. Even if true, they don't really shock the conscience, given what goes on in the world nowadays. And so I think that's a big problem for the plaintiff here as to whether a jury in this day and age would find this to be quote unquote highly offensive. And a lot of those traits, like disloyal dishonest, cowardly manipulative opportunistic. Williams did work with police to get Sorkin arrested and testified against her and some people might view her. In that way. So that goes

"I mean, even though this couple was married, happily married. Kids are going to ask questions. It's like they're going to picture Ricky and Lucy doing it, you know? It's like, well, how the hell else do people think, babe, am I bringing this point up in the movie? I was like, where did you think babies are coming from? Yeah. But and I don't think they mentioned it in the movie, but it was like they ultimately Lucy was allowed to be pregnant. But they were not allowed to use the word pregnant. They say, with child, expecting. Okay. She's not pregnant. She's expecting, which they made jokes out of desi. He couldn't say that, so you just said spectrum. So I also like that they really shine a guy on the writing room and the intersection of the writing room with the actors and with the production. And with those sponsors and executives and on and on. And obviously and Lucy's instincts were right because of the birth of Ricky junior on I love Lucy was it was one of those moments where everybody was watching it, like it was nationwide. One of the most watched TV episodes of the 50s was when Ricky junior was born. And if they really depict that, but it's like, it shows you how to write they were and how in tune they were with what the public wanted. Yeah, and it seemed like Sorkin did a really good job of writing just enough of their history to kind of bring you up to speed. But not so much that it's a story of everything coming up to it. They really focused on this one week of production and then everything after that they just they only gave one epilogue note and I thought that was really cool. So the week of, I loved seeing and I don't know how accurate it is. I mean, this is they didn't even get those weren't even the real people that were interviewing. Those were actors portraying the people that they were pretending to be. Yeah. And I just thought it was so cool to see what the production process was like. They did the table read on Monday, and then there's just writing and tweaking and writing and tweaking. And there's still how it is. Yeah. Well, and seeing Lucille Ball's involvement with it, seeing how she would be in the writer's room, she would think, that doesn't make sense for my character. She was obviously very controlling of what makes sense for Lucy. Her instincts were the next level. Because it was like, you know, they're talking about the grape scene, which is maybe the most iconic scene that I love Lucy. Yeah. And it's, you know, she hears it and knows that when they're pitching it, it's not quite right..

Lots of data, lots of information, and I've had people say when I do a review, they'll be like, I didn't understand this joke. Therefore, the joke is bad. And I'm like, no, that's literally not the way it is. The number of things that I read or watch where I don't understand it is quite high, that's how we learn. We don't learn by just I mean, I could turn something into the most basic this game good. But who wants that? I mean, I just don't know. Maybe some of us do. Who knows? Dead Z 64 says, get your beards in your beanies. It's character Friday. Exactly. Beards and beanies. I have another beard under my beanie. It's crazy. So what books do I like? Did Bill Gates Seriously Short TSLA Stock
"Robbed our here and today we're going to be talking about bill gates response to on musk's claims the oregon podcast a couple of weeks. Back that get heard. That bill gates had been shorting stock. We've also got some news on the broader electric vehicle automotive market an interesting response from yvonne on an article from the washington post. And of course. We've gotta talk about tesla stock. It's about wild couple of days. We had the interview yesterday with alex rotter so we didn't get a chance to talk about it. But of course yesterday. Tuesday february twenty. Third tesla dropped to a low of six hundred nineteen dollars per share. That was down more than thirteen percent from the prior. Close then of course. We saw us swift recovery in the market. And from tesla tesla finishing down just two percent yesterday on the biggest volume day that we've seen in over a month and a half with sixty six million shares trading hands yesterday. So i talked about on monday and we briefly talked about yesterday in the interview as well. A lot of this is tied to expectation on interest rates. So yesterday fed chairman. Jerome powell made comments to congress. Indicating the current monetary policy is expected to continue for some time as economic uncertainty remains so not to get too deep into that. We've talked about that. Of course in the past but as far as tussles yesterday certainly was not isolated to tesla. Those sort of concerns were broadly extended to high growth. Stocks tussle obviously falls in that category. And i think the volatility there serves as a nice quarterly reminder that you have to be very very careful with stop losses on a volatile stock like tussle as for today tesla continue to rebound finishing up six point two percent to seven hundred and forty dollars two cents. That compared to the nasdaq up one percent. All right so i up today. I want to continue a conversation that we began a couple of weeks back after yvonne. Musk went on joe. Rogan's podcast for the third time and said that he had heard from people he believes would know that bill gates had shorted tesla. Yvonne brought that up in response to a question from joe rogan on the tesla semi citing that bill gates in a blog. Post a few months back had said that eighteen wheel electric semi is probably would never work so allen's claim here understand. Okay so he says he doesn't want to talk about his investments but then he in response to another question talks about his investments in impossible foods beyond me quantum scape and then how does investments are doing and that i'll have more money to then go on an invest in other stuff. I mean how much more could you talk about your investments. And he uses the first person tense. You're saying i invested. He's asked about bitcoin and he says quote. I don't own bitcoin. I'm not short bitcoin. So i've taken a neutral view and quote so for bitcoin. Perfectly fine to say i'm not short bitcoin. Same question for tesla. oh. I don't want to talk about my investments that we just spent a bunch of time talking about. If you're not going to answer the question at least come up with a better non answer. That doesn't immediately contradict yourself. He has to have known that he'll be asked about that and yet seems completely content guard answer so that was last week if there was any doubt left after that because he did start off. The company in terms of liquidity in terms of the demand deposits. The you had to put it in front to the exchanges. What led to this sure and let me let me explain exactly how this works. At the direction of a market maker or hedge fund or anyone we row to or other market participants. The reason we did it was because Robin a brokerage firm. We have lots of financial requirements including sec net capital requirements and clearinghouse deposits. So that's money that we have to deposit burying clearing-houses so some of these requirements fluctuate bid based on volatility in the markets and they can be substantial in the current environment where there's a lot of volatility and a lot of concentrated activity in In these names that have been going viral on social media so we're really in unprecedented times and in order to protect the firm in protect our customers. We had to limit by in these in these stocks in to be absolutely. It's ahead but it sounds to me though that you're suggesting that there was a liquidity problem inside the firm and my question about that then raises all sorts of new questions about whether there's a systemic issue underneath the system and underneath the company unto itself. No there was no liquidity problem and to be clear this was done preemptively so we did this. Proactively in thousands of whether securities remain tradable on the platform customers that held these positions. Were able to seldom in. "Stop the video game retailer. Stock has rallied over six hundred eighty percent this month and in the last couple of days the stocks volatility has pretty much everyone talking. So what's going on. First of all game stop is for the average mall going consumer dying brand a relic of simpler times when we used to have to physically go to the store and wait in line for the newest call of duty or for the latest harry potter book. So it's no surprise. That game stop has been a target for wall street shortsellers its demise has been foregone conclusion. So short and game stop. That is betting that game stop would continue to. Depreciate could have been a good bet except short-selling is risky and your losses if you lose that bad or basically limitless since there's no cap on how valuable the company has bet against could become so even riskier if stock you've shorted starts going up. You can essentially cut your losses without getting too in the weeds market mechanics here. When a lot of short seller's designed to cut their losses on a shorted stock. That's now suddenly going up it triggers. What's called a short squeeze. Demand goes up. Supply goes down. Price goes up more shortsellers. Try to cut their losses. It's a vicious cycle and one that can result in massive losses for their shortsellers and giant prophets for those who've invested in the stock on the way up which is when a popular reddit. Nicole kidman and javier bardem. I guess this is amazing but also it seems kind of terrible as as ideas go. What was your reaction to this news. My first reaction is. I'm just glad that nicole kidman and gets to have a little bit of just the tiniest bit of fine. Did you ever happened to catch the prom. Was the ryan murphy. Film version of a broadway musical speaking of things. We'll be discussing later on this podcast. I sure did. And i was not a fan nor was i. The only thing that i could say is like when they let nicole kidman do something which was very rare in this. She seemed to be having the time of her life and she was like. I don't have to have a breakdown. Like on a courtroom stand and talk about like really grim things while being filmed for once. And i'm flying free and so you know i assume this. Is i think this project in one form or another. I think errands has been trying to do this for a while. If you google. They're kind of like mentions of this project. "Many from people in this room, people saying, Hey, I want you to know this. Here's an idea for a story. Here's an issue that I'd love to see you get into the West Wing because it's an intelligent dialogue that is educating people is inspiring people. It is changing, not just the way people think about the process, but I think the way people think about people who are participating. In the process, and that's a wonderful thing. I don't want to overemphasize it because at the end of the day, it is still a television show, but I think it's doing some good. It's not just entertaining us. It is educating us and inspiring us. The show aired for seven seasons on NBC, 1999 to 2006 during the George W. Bush presidency. This essay is about the power of television. So what are your critiques? Well, gosh, dp Myers said that West Wing went on TV at the time of the impeachment, and she she's actually underrating that Aaron Sorkin has said in interviews that the moment he pressed finished on the pilot script was, you know, within 24 hours of the Monica Lewinsky story breaking So, in fact, when he pitched the show to NBC, they sat on it for a year because they said, We can't go on with this now because nobody wants to show watch a show about, you know, White House staffers. During the Lewinsky impeachment nonsense, and I have my own personal sense of the timeline of the West Wing because I am exactly the right age that my peers are people. You know, the people that I knew in the hail political union went into politics because they watched the West Wing You're the Washington High school and decided this is what I wanna do with my life on guys Think living in Washington, DC, where I do now There are an awful lot of people of whom that is true. I don't know if that's disturbing to the rest of America to know that they're being ruled by a ruling class that chose their particular careers because of the TV show, But it's true. The tragic irony of that is that Aaron Sorkin is not himself and especially political person s O. That's the substance of my critique is that he has said over and over again that he didn't make the West Wing because he cares so much about politics. He's just He just likes the sound of smart people debating start people talking to each other that Radha tat tat dialogue, and it just seemed like politics would be a good then you for having smart people talk to each other. So he was almost a pied piper to my generation, drawing people into politics without himself, carrying all that much about it one way or the other. So that sounds like a good thing drawing people into politics. Where's the problem? The problem is that this idealism Is essentially fools, um, that this idea of going into politics because you're going to change the world. The rosy world of the West ring is just very, very different from the nitty gritty of how you actually get things done in Washington. On. Do you get people who are I would almost say naive about politics because their view of what they do was shaped by the West Wing. If you watch the show, you will notice that there are many ripped from the headlines. Examples And indeed, the Myers was a consultant on the show, and so were a lot of other Clinton veterans and they fed Sorkin. Stories from their own times, so you'll be able to recognize Oh, you know, that particular story line is based on something that happened in 1996. But the more of those stories you notice, the more it becomes clear that Sorkin change the ending sort and took Thies stories from the Clinton years and gave them a happy ending. You know, there was an instance where we'll Ah, funny story from the Clinton years is that a phrase from the Communist Manifesto was dropped in a state of the Union address. And it went through nine different drafts before an intern finally pointed it out and said, Are you quite sure we want to be quoting Karl Marts in the state of the union, I think might get in trouble for that. Where is in the West Wing? You know, they catch the quote right away, So he altered history in order to make it all come out right in the end, But the truth is that in real politics, things don't don't always come out right in the end. And the noble idealists don't always win. And if you go in thinking that they will, you're going to make some mistakes. And would you say as a whole, The people who were inspired to go into politics as a result of the West Wing were like minded in their ideology, or does it cross political ideologies? I really want to be fair to Aaron Sorkin. He did his very best to not make the West Wing on exclusively liberal show he brought in. Conservative Republican consultants. Veterans of Bush one on he tried to write Republican characters who were noble on Justus, high minded as his liberal democratic character, so he really tried to be fair. The truth is that if you watch the show, it just didn't come off because so many of the people may I mean, it's Hollywood. It does have a liberal slant s O. Despite his best efforts to make it high minded, I don't think he quite succeeded on C SPAN radio. This is Q and day. Our guest this week is Helen Andrews on her book. Rumors. I couldn't help but think when I was reading that chapter that it was NBC who gave us the West Wing, but starting in 2005, they also gave us the Apprentice starting Donald Trump. Esso. Here's another program that ended up having a pretty big impact on politics. You have any thoughts about that? I think it's really a If you wanted to put a sort of the change in politics in the last 30 years into a sentence, you would say it is become TV ified. It's become a lot more like a reality show on D election of Donald Trump was kind of the apotheosis of that. But I don't think that's a good thing. There's a funny story that Armando Iannucci tells he's the guy who is the creator of deep and he says that when he was researching feet, he went to the Obama White House and looked around to get a sense of how it is in the in the West Wing. And he said that the people who showed him around pointed out little things in terms of the West Wing. You know, they would say, Oh, that's the desk where Josh would work or that's the desk where Donna would work. And you know she was thinking to himself. No, no, Those are fake people. It would be much better for you to say That's the desk where I work, you know, or somebody else works because your real why are you thinking of your own job in terms of this TV show from 1999? But you know when you it's really not very good to think of your job as a TV show if you're working in the West Wing, But as the initial story shows that's that's how people do think of it. Both of these Syriza's aired at a time when television was the dominant entertainment, medium and Americans households today it is a multitude of streaming services and cable networks and lots of choice.
