"The right answer? I think it is. Yeah. Found guilty for 11 charts. I'm not celebrating it until she's in there for more than two years. This is kind of stuff that I'm used to seeing where the rich continue to get richer or to rich continue to find a way to weasel out of their punishment. Talk to me in a couple years. If she goes to jail, it's a country club jail anyway. Exactly. You know, that's not punishment. Come on. Any jail, any loss of liberty is a significant deprivation. We shouldn't be too glib about. Sorry. Do you want to tackle the U.S. question? I've heard explanation but you're a counsel. Why did you go between the investors got screwed over, but not the users? I don't know the answer to the question. It's not exactly my type of law and I didn't follow the trial closely. But basically, one of the things that might inform it is every charge has elements and different things that you'd have to prove and it may just be that. Some of the counts that she was charged on were easier to prove up than other ones. I don't know if that is the explanation I have seen something on Twitter that suggested that might be what happened and I heard was intent mattered that it was easier to prove in this case that she was trying to defraud the investors, it was hard to say that she was for whatever the evidence there was. Explicitly try to defraud the users of the technology. That could well be. For many criminal charges intent is a really important factor that needs to be proven up and it may have been easier for some of these counts than others. Three counts of wire fraud against specific investors. One count of conspiracy to commit wire fraud, the other charges dropped or not guilty. Do you think she entered this attempt with the fraudulent tent or did it go bad after a while? Who knows? I guess we don't know. Well, that's cool. I think some more interesting question was there's a Twitter fight happening surrounding a tweet by Benedict Evans. Where I think he is taking the other way. Somebody had tweeted that basically, oh, this is Silicon Valley ethos. And it finally got caught. He's like, no, that wasn't. This isn't Silicon Valley ethos. This is more particular. And I think there's an open question of whether to what extent because we talked about this earlier with innovators and followers that at a certain point, I think there's just such a gold rush mentality tours. Well, this thing worked. So let's all have one. And if that happens, you get a lot of snake oil sales that keep getting offered. And was this a snake oil sales that went bad? Was it bad in any particular way? Or is this kind of what tends to happen and only this person got caught? And I don't know the answer to that question, but I do know there's a lot of snake oil and people probably lose money chasing it. Evans was responding to a tweet by fais siddiqui who tweeted the Elizabeth Holmes case was perhaps the highest profile test of whether the Silicon Valley ethos taken to the extreme could withstand legal scrutiny. Now she makes history as the first Silicon Valley CEO to be convicted of a white collar crime to which evidence responds. I can't be bothered to go into this again, but no, telling lies is not the Silicon Valley. Ethos, tolerance for failure. Yes, bootstrapping yes, unrealistic ambition, yes. Lying no, this is like claiming that Jason Blair was an indictment of the journalism ethos. Okay, that's fair enough. I think as usual Ben's right, like Kathy, she's usually right in beds usually right. But I think that there's a desire to say that this exhibits something about all of Silicon Valley and all the technology. It's enron. It's a fraudulent company. However, it got there. It ends up being a fraudulent country or Lehman Brothers or whatever, that went overboard and it's not tied to technology. It's an eternal story. Actually, I love the mistake. I love his subsequent tweet that he says, the interesting Silicon Valley angle on theranos is that founders did not really participate in the Silicon Valley system, but sold, quote, Silicon Valley, disruption to east coast investors who didn't know anything about tech or bio. I think that's what was on the board. Henry Kissinger, George Schultz. General mad dog Mattis. Yeah. It was all easterners. Not Silicon Valley types. Which is sort of interesting because they, in theory, should be sophisticated and investors and yet they were defrauded. It's kind of an interesting. Well, that's why they were perfect. Because they could be fooled, but they had credibility. Just exactly what you want. Although Sarah David also points out Tim Draper, Donald Lucas Dixon doll all invested in theranos, including Larry Ellison. So there was Silicon Valley money. What's the point of that as well? So it's fascinating, actually. Anyway, it's a great story. If you haven't read the book, absolutely must read and I think the story. Well, it's not quite over because sunny gets tried next. Although his strategy might change because it was apparently home strategy or homes attorney strategy to blame sunny for it. Actually, maybe it'll work even better now, sunny can blame her and say see? I told you, it wasn't my idea. I guess we can do a little inside baseball. Ben Smith, the esteemed media columnist at The New York Times leaves The New York Times to join is it Justin Smith? Justin Smith, yep, who is a no relation. No, has a great track record. Smith and Jones. Great track record. TV reference for you. Yeah. Boy, there's an old one. Don't worry about that. Yeah, no. I got nothing. Yeah. So tell us about Jeff justice. It's about his just and I know and respect greatly. Justin was the guy who brought the weak magazine to the U.S. for Felix Dennis and did a brilliant and very unusual launch of the magazine. No news stands, for example. And he made it work and he gave it a brand and it's really quite amazing. And then he went to the Atlantic where he brought it back from death. He was at the door, knocking on hell's door, and he brought it back and made it into the tremendous brand that it is and also started courts with some help. By the way, I think COVID helps Atlantic a lot. Well, that's true when I think atlantics, but I actually think the Atlantic does too many takes now, but that's not a story. And then Justin what's Bloomberg for the last I think 8 years where he sat directly across from Michael Bloomberg, I went to visit Justin more than once. And the open space directly across from him and his job was to take the free parts of blueberry. Bloomberg you know is the really expensive terminal. That's what Bloomberg loves. The person. But to take business week, which they bought and the web and all this stuff and turn it into a business and he did. He turned into a major source of revenue. So now he and Ben Smith are going to start something new and before we were on the air, Leo and I were comparing notes about a New Yorker interview with Ben Smith and which, like a Sphinx, he said, absolutely nothing to value. It was actually quite enjoyable, Claire, Claire Malone writing in New Yorker. Ben Smith can't say what his new media venture is. She leads by saying Ben Smith at a 144 unread text messages when we talked for a sometimes digitally distracted 16 minutes, Jeff just afternoon yesterday 15 minutes after we hung up, he responded to an email I'd sent asking if he'd like to talk. Obviously, very busy..

"Have more value than than than d. Lineman right now and that's been the thought bill ballot check has done a good job with building up the secondary But i i'm telling you. I maybe i'll just go to my grave as an old school soul on this. Give me. give me four horses and we'll figure out the rest Giving gaza front. Because it's so much easier to cover of guys on the back when you guys that can get to if if we had the choose it debate that we we often have a pass. Rusher the corner. I'm gonna go to pass rusher all day because russia can allow me to play with more of an average corner behind him. If i have an average bashar my elite corner is still going to have problems because the quarterback has so much time. It's just hard to cover for so long yet. Lasting on the niners too. Is that defense. If healthy in bosa was just doing individual wasn't doing anything else he should be out there. You've got some cyborgs men when you look out there and you see boasts so the way he's put together. Then you see eric armstead. And then you look at fred warner and how how long ranging athletic he is at the second level trade. Green laws are really good player. It kind of. It's a little bit of that willis and bowman at linebacker position. And you go back to what they had. With all smith and justice smith justin smith like that is kind of all coming together for that group and again you say it's all thirty two teams the salary cap. You have the same approach and all that kind of stuff sometimes just simply play harder than others and when you watch them run around. You're like okay. that's different you look at. It is anything to i. Can't wait to see what d'amico ryan's ads. What the foundation was under robert. Saw because d'amico ryan has a different path. He's been exposed to some different coaching and some different things. And you know. He's going to put his own wrinkle.

"All right so we're back okay. So we decided to or actually before we get into what we're gonna talk about a little bit today We had some very very sad news within the empire this week. Former niner tight end. Greg clark has passed away From what i've been able to discover it was a suicide streaming sad man. I it's so sad like i remember greg clark. You know. I remember the two sounds. He had against the walkers in the playoff game and ninety eight. Ninety nine depending on how you look at it but definitely sad to see and Don't want please people you know if you ever feeling down playing. Let's say hit me up because you know who am i but find somebody because you know probably simplest way this was put to me and you know we'll get off the subject after this is that suicide is a permanent solution to a temporary problem so i don't know what mr carcass going through. How am i going to say that when he was going to temporary. But you know. I really wish that didn't happen. And that really sucks but as always an awkward transition from real life news to to football but i aside we'll go ahead and i'm kinda just giving give my thoughts on where the twenty nineteen niners rank amongst teams throughout nine or history. That didn't win the super bowl and you know i. It's ultimately year year to say okay. Well look at the two teams. That didn't win the super bowl. Twenty twelve and two thousand nineteen wishing was better on paper. I'm out to give it to the twenty twelve team. Just because oh will they do it this way. Let's break it down Position group opposition group. Okay so obviously if we go defense twenty twelve versus twenty nineteen. I mean you you gotta start with the d. lie and you know all the smith justin smith you know braille franklin rarely pringle was team is acceptable ouaga. You know it's it's hard to compare because you know then we are three four defense and our four three defense so it. It's you know the d. lines were a little different but yeah you might be able to look at strictly numbers. I wanna look at it. Strictly numbers I wanna get you know player. Basis like okay. Hey who had the more talent. And i have to give to twenty twelve like. It's very hard because it's like okay. You had nick both I mean talent. Wise that by one of the best talented allies dider history. Just 'cause deforest buckner air armstead. You know. Nick boasts a and d ford. All first round picks for believe so is very difficult to look at the g. Line and and compare it to that but i mean i just i have to get the twenty twelve because all the smith like that was probably prime older smith. Both i believe is the overall better all around better player like all. This smith was just freak of nature. And it wasn't until i went and did a little research and watch a little highlights is out of twenty seven over again just really realized like while all was played a part time role and have fourteen year by. That's crazy to think it. A part time roles somebody got fourteen sacks you know nick bosa playing every game got nine now. I understand that you know you can't always go by numbers. But i take if you if you could tell me you can get arguments smith with his head on straight or nick bosa stinking. All in smith like i. I'm sorry i would love to have either. But i think i'm gonna take golden smith and if you'll get here like i said if you're looking at here pass rush peer pressure. I'm taking on the smith Just because i feel that. I feel that he's just better passer but if i'm looking around by every greed down player although it become that his second year i'm significant just because i feel that nick boast is better than the run game you know. There's a better overall player. But on smith is a better pass rush at injustice smith. I'm sorry yeah. Ford you know deforest buckner. But i'm not taking any of those players over the cowboy cowboy tonight love So i'm i'm sorry. I've been taking justice smith over everybody and then so i mean would you take you know dj jones. I guess we'll be the closest. We have the nose tackle now so you. Dj jones or isaac soap water. I guess you could say i take. Dj over over this. Oh man you know. But honestly i. I'm gonna give it the twenty twelve just because i think the tandem of other smith adjusted smith. You know the smith brothers. I'm sorry i just don't think that the niners twenty nine thousand nine hundred anything quite to that level They had a overall defensive dominant defensive wine but twenty twelve i. It was pretty much all smith injustice. You know brooks did his thing you know but navarre would blitz but that that was ultimately and i'm sorry that might be the best deal just as far as working off each other and everything that that i may have. I have ever seen maybe besides. Py and dana stubblefield so linebackers. I mean come on. I if not even close you gotta go twenty twelve. I'm patrick was to devolve. Did their prize look. I love everybody who watches. This show knows how much i love. Fred warner big degree fan. I do think that he might be slightly hyped up. But i do believe that. He's a solid starter in the league. And you can do a lot worse than drinking law especially on a rookie contract. So yeah i mean but you've got probably the best linebacker do nfl history. Plus you know ahmad brooks and all the smith although he would be an end in our defense now as smith and and Mark brooks ain't no slot and so although they probably both the end so you can't get better than than P dobbin and bo. So yeah you gotta give it to the linebackers and twenty nine thousand nine hundred twenty twelve versus twenty nine thousand nine Secondary now. This is where i think that the twenty nine hundred nineteen can make a little bit of case. You know we are yet college. Rogers tremaine brook trout brown.

"Wrong and thinking that about the Seattle Seahawks, because, sure enough, there is some sort of discord up in Seattle. And quite frankly, we'll hear the sound of moment. I kind of agree with Will's all right, Let's get to it. It all started there. With Dan Patrick asking him about the number of times he's been sacked. We'll let you hear the sound of the paranormal. React to it here. Here's Russell Wilson on the Dan Patrick show. Look, I'm worried about the these numbers. You've been sacked 394 times in your career, you're going to be the most sacked quarterback in the history of the game. Why? Well, I think that you know, sometimes sometimes you hold on to a little bit, You know, just because you're looking for that play, you find you find those guys but also somebody so many times in terms of the touchdowns Do you never want to be sacked? That many times? You know, 400 times, basically is Is way too many 400 too many, You know, so I think that's a big big thing that we gotta fix. That's got to be fixed, you know has to be okay. So carry the report on this than I initially seemed like the headline on this quote from Russell Wilson was Russell Wilson sort of calls out the Seahawks because he's getting sacked too much. He was asked the question. I agree with him. He does get sacked the whole lot. Also, look at the division he has played in since he got to the NFL. He had to see that that John Harbaugh, uh, you know three trips to the NFC Championship defense. Of Alden Smith, Justin Smith. Now he's got Aaron Donald and his division he's dealing with with Buddha Baker and some of the monsters on the Arizona Cardinals. He's also got to deal with with now Nick Bosa and other guys on the 40 Niner roster. What do you make you his comments here? He's been sacked too many times. Well, first off what struck me most about this was not anything that Russell Wilson said. It was Dan Patrick pretending to express genuine concern over how often.
