"Right now a real fan favorite whenever we speak with us in the fall I get such a huge reaction and rightly so always has been that way but since he took up the case of one lieutenant general Mike Flynn at site even doubled so city Paul thanks for joining us today thank you for having me where it's always a pleasure where do we begin you've got a brand new book out today it's called conviction machine standing up to federal prosecutorial abuse you wrote it with your co author Harvey a silver glade and I think I want to start there I do want to get an update on the Flynn case because we start with your book because it's so important sure yeah Harvey road three felonies a day probably about the same time our license to lie and we didn't know each other and then when you started this project he called me to ask if I would join him and not the tech yeah this makes the ultimate sense because we need to start composing some solutions for the things we know are wrong in our criminal justice system that could be easily fixed and the plan K. actually kind of demonstrates everything that's wrong with our criminal justice system from the fact that it's such a crushing machine that innocent people will be led to plead guilty you're forced to plead guilty to the FBI agents not recording interviews and making up statements that somebody didn't say yeah and then and then losing the written documentation that support what they claim that person said which brings us back to the story right it cannot be lost if the three oh two is put in the Sentinel system and that would have been on it cannot be lost and if it was destroyed there's a lecture on a trail of how that was done so they've just been sitting on it or somebody affirmatively destroyed it in which case but I mean that should be obstruction of justice all right I gotta get regarding diving you back into the Flynn case but I do want to focus on the book for a moment what I love about it is first of all it's a very quick and easy read I like that you also have action items for criminal justice reform real criminal justice reform not just emptying out prisons and I want to get to that as well as all the sources I mean this is really well sourced really well annotated there's great footnotes let's go to the the central premise here you hear legal analyst on cable news and broadcast news throwing out this statement all the time then a federal prosecutor with the grand jury can indict a ham sandwich and everyone chuckles and moves on but hold on that's an incredible acknowledgment of abuse of power is it not yes it is and it's happened multiple times in the Muller investigation but one of them is the Russian troll farm case that they just moved to dismiss the indictment against Concord the company that showed up to contest the charges and the case was concocted from the beginning just like the Flynn case was it was smoke tied with bailing wire you could tell by reading the indictment there is no crime alleged but the judge didn't have the fortitude to throw it out and not on coincidently probably she is the wife of Matthew Friedrich is one of the lead Billington licensed ally and a good friend of Andrew Weissmann hi Andrew Weissmann of course was the the chief lead prosecutor investigator in the Muller investigation now an MSNBC contributor and yeah he's pretty much the start of your book licensed the life yeah I'm in you you have a great chapter here that I I want to skip forward to and that is where have all the judges gone because judges have a huge role in this white why don't they assert their authority more in court why do they differ stole much to federal prosecutors I wish I knew the real answer to that one judge friend told me that every District Court judge sees himself as an appellate judge and every appellate judge sees himself as being on the print court and that doesn't happen without the approval of the department of justice yeah and it is it is it really just for their political ambitions that is soon as you're on the phone or you think you've got your next step or no I don't really think that I think a lot of it has to do with the tendency just to put far too much trust in the government officials to appear before the court it used to be at least when I was practicing in regularly and in central court in the western district of Texas I mean my my judges I used to call my judges need me and I knew I would sooner stick a sharp stick in my job and I would tell them anything that wasn't right including sometimes reining them in because we had some judges that were far too pro government and they would do things that were wrong but apparently prosecutors don't look at it that way anymore they don't seek justice they seek convictions which is exactly the opposite of what they're supposed to do and the judges have just been either walled into this false sense of belief or or not paying enough attention or just in their own biases and of course people don't like to reverse criminal convictions because they assume people are guilty but that's a far more innocent people are being conducted then should be no innocent person should be convicted and it's happening on a fairly regular basis thank you city of how one of the challenges in this topic is the you know I consider myself a political conservative a philosophical conservatives so I and and conservatives tend to be a little bit more law and order you know they they they they tend to lean more towards the police certainly the local police and and support our police and support prosecutors on a local basis so we need to sort of set that aside when we look at what the federal government is doing through the justice department and there is a distinction there is they're not yes there is an internal part of the problem is nobody wants to believe that a police officer sitting on the witness stand line nobody wants to believe that nobody wants to believe that an FBI agent was sitting on the witness stand line but unfortunately they do and that's why we suggest that they be required to record all interviews and that any interview be warned and and recorded preferably on video before any false statement allegation can be made as a result of what happened in that interview because even the well and even the most well intentioned people might hear something differently than the person meant it and it certainly gets written down differently than somebody Minton and just think about intonation how important information is just one word really can be a question or an affirmative declaration yeah yep that's true I've learned in in this business even when you say what you know you said and what you meant when you say it it's what people here that matters more than certainly that would be the case what it said investigator giving an interview right and it's just not fair to people to accuse them of false statements when they don't even they didn't even make the statement right and there's no record of it other than what somebody who is already in a minute liar has has said about it it is you know there's another trope that we hear all the time which is you know the federal federal prosecutors will not bring an indictment and less they're sure they can get a conviction they have this huge incredible conviction right well there's a reason for that right it has to do with the jury system it has to do with grand juries it has to do with the way they as you put it stacked indictments are stacked charges explain that to me well they can there so many federal offenses now then you can pop along multiple charges against somebody for what is essentially amounts to one of fancy and that forces innocent people to plead guilty because they're looking at twenty twenty five years in prison for something insignificant but is blown out of proportion by virtue of the sentencing guidelines and the stacked on charges Lynch defendants in license to life the government was trying to blame them for forty two million dollar loss to Enron when Enron had made millions of dollars on the deal I forgot how many millions but it was a profitable transaction and they they just twist things and that was the same characters that are involved in the molar pro primarily Andrew Weissman and so we have this whole host of people who end up pleading guilty because they're facing such an up hill climb just to defend themselves and also that also brings us to the concerned about many of these juries where they don't feel like they're getting a fair jury pool here certainly here in Washington DC right now they're gonna have to be more arrangements made for people to get trials in places that are not obviously prejudiced no and none of the Enron defendant should have been tried in Houston and then she went to the Supreme Court and the only thing the only three judges recognize that principle boasting on just a sort of my order and Ginsburg and I forgot who the third one lives but there was such **** I mean abject **** in Houston that nobody related to the Enron case could get a fair trial in Houston that was obvious to anybody that was willing to look at the truth of the matter and what the judge says can't overcome that deep level of betrayal and violation that everyone that sent on that jury felt and has a hundred and ten count indictment nobody can defend against a hundred and ten count indictment the book is called conviction machines standing up the federal prosecutorial abuse the author of one of the authors is Sidney Powell who were speaking with now her co authors Harvey a silver plate our justice department are prosecutors judged and thereby rewarded over the course of their career based on their number of convictions and is that a problem as well yes apparently that is more true than it ever was when I was in the department of justice or the U. S. attorneys offices yeah all the prosecutors unlicensed ally got the attorney general's award for excellence and then came to run most of the Obama administration has longest serving White House counsel Weisman became deputy director general counsel of the FBI Lisa Monaco became this ticket counter terrorism adviser Leslie Caldwell came back in the DOJ for Loretta Lynch and brought Andrew Weissmann back in winter thank you they just cycle yeah and they all got the attorney general's award for excellence when every case they actually took the trial was reversed on appeal in whole or in part Anderson was reversed unanimously by the Supreme Court after the company eighty five thousand jobs were destroyed for absolutely nothing except their power play and now they get promoted and rewarded right at the get most people hearing that's in the process okay are they gonna face disciplinary action if not if not criminal actions because it's an abuse of the federal justice system and and the justice department's power but instead they forget about any repercussions they were rewarded for it and continue to be rewarded for it exactly and and that's I think that's what frustrates people Milton latest incidents of this is what's continuing to go on with the investigation of James Comey and the FBI and the justice department under Loretta Lynch during the Obama administration that you are now wrapped up in in your defense of lieutenant general Mike Flynn will we ever see anybody actually odd odd pay a price for their what appears certainly to be abused by we know they falsified FISA warrants why is there not somebody right now facing criminal charges for that I wish I knew the answer to that Larry because I think what they did is obstruction of justice and making false statements to court is completely unacceptable it's just a total violation of everything they're supposed to do all right and it does not amount to obstruction of justice one of the through lines here in this book seems to keep coming back to this thing called the Brady rule briefly because you're you're facing that right now with with Mike Flynn wanted to briefly explain what the Brady will rule is and how it plays into your book conviction machine Sidney Powell it comes from a Supreme Court case Brady versus Maryland which held that because the prosecutors hold all the cards they have a constitutional legal and ethical obligation to provide the evidence to the defense is favorable to the defense or mitigates punishment or impeach is any of the government's witnesses that's hugely important because the defendant does not know what the defendant does not know we've seen it practiced in breach more than being produced to defendants it happens all the time it's been a huge problem in the Flynn case despite judge Sullivan's ninety two page order to the contrary for example we know from a summary given to us by the prosecutors that there was a DOJ memo dated January thirtieth twenty seventeen while Flynn was still in the White House completely exonerating him of anything Russia related and so that's that's sort of what you're facing now sit in power with regard I this is so maddening because any of us we don't have law degrees right we don't practice law we're not federal prosecutors are defenders but we know that you have a right if you're the defendant to see all the evidence that the government has against you you should be able to investigate it you should be able that's that's pretty basic and yet general Flynn right now doesn't have that right no it's been standing with the things that I know existed I cannot get it either because they're hiding behind classification or bot well for example the original F. B. I. report of this interview Mr van practice says it's not in his possession which means is that the F. B. I. somewhere in judge someone didn't even order that to be produced and John Sullivan the judge I've been bragging about for six years as the judicial hero of licensed to lie because he ordered Brady production in the Ted Stevens case right it wound up in a reversal it is this muddled a bit because there is a guilty plea.

B.'s network and again I want to thank our team today I work in working every angle to bring the broadcast to you Graig and alley and Mike and clay and my favorite producer in Pennsylvania Mister Scott for hooking it all up and very exciting Rush Limbaugh will be back tomorrow yes for open line Friday rush returns tomorrow so don't miss it in the meantime I am thrilled to have Sidney Powell on now Sydney is a federal prosecutor and she wrote a book that I got to tell you a license to lie I know you have another book out that I just finished reading but I was so energized reading licensed to lie exposing corruption in the department of justice I wanted to buy copies for everyone welcome to the show thank you so much I really am honored to be on with you I gotta tell you it why why don't we hear more about this in the in the mainstream news media your what you wrote in this books about these both of the books about the abuse of power would be not them it beyond the makings of a great movie I just wonder why you had to go and find this information and no one else could well I lived through a large part of it myself as the represented one of the average consulted on the Arthur Andersen case and then represented one of the Merrill Lynch executives in the Enron prosecution and in the process of doing that I recognized a core group of prosecutors who behave so differently than the way I was raised in the department of justice I found it absolutely appalling I mean they were making up crimes they were hiding evidence every case they actually took the problem the Enron task force was reversed in whole or in part on appeal for one version or another of prosecutorial misconduct and then despite that they were all promoted Andrew Weissmann became general counsel deputy director of the FBI under his buddy Bob Muller and then of course wound up on the leading Mr Muller's special counsel operation Catherine Roemer became Obama's longest serving White House counsel Matthew Friedrich became the bush attorney Jim system AG for the criminal division of the department of justice and then micromanage the prosecution of United States senator Ted Stevens that had to be thrown out after a jury came back with a verdict of guilty eight days before the election but costing his Senate seat is the longest serving Republican in the United States Senate league Leslie Caldwell became a pop up Loretta Lynch's assistant Attorney General in charge of the criminal division she brought Andrew Weissmann back into DOJ to head the fraud section and then he became involved in being briefed by Bruce or and and he and Musleh Ahmad on the back channel communications with Christopher Steele exactly it's funny how it all it Z. the same not always the same with the same attitude in the D. O. J. keeps rearing its ugly head to take down people that are politically unpopular or they want to target it's just I keep recycling this group of prosecutors figured out that they could use a law to destroy people's lives and they did it by making up crimes and hiding evidence that showed they were innocent I think one of the scariest things in this book Sydney we're talking to the author of two incredible books conviction machine standing up to federal prosecutorial abuse and that's of course a co authored by Harvey silver glade who has a ton of experience as well and licensed to lie which that was my first exposure to your work and I was both energized and angry to find out that the F. B. I. can pretty much do whatever they want that really scares me some put up yes and when they interview you they don't always advise you of your rights like general Flynn for example they just ambush interviewed him in the White House after McCabe led him to believe he didn't need counsel and he wasn't the subject of the interview even and they literally plans the scheme than planned and multiple meetings about how to interview him to keep him on guarded and relaxed so that he would not know he was the subject of the interview and then they use that to start a false statements prosecution against him even though the original agent to interviewing came back and repeatedly briefed three different groups of people on how he was honest with them and did not why it's absolutely stunning and it's it's interesting because for people who are new to the process that I think it's called the three oh two the the F. B. I. can pretty much make up its own notes they're not required to tape or video their investigation or their questioning of you and I was shocked by that I thought they would be one agency that would have to cross the tease and dot the I's oh absolutely not in fact Mr Miller testified in front of Congress against vigorously against any suggestion that the FBI record their interviews in any fashion audio or video because it was just going to be too much for them to handle that yeah that is unfathomable to me it would be a lot easier to just turn it in to have a transcript made up the recording of the interview then it would be to sit there and take notes that are never going to be completely accurate no matter how good you are and and then have to generate a risk take the time and generate your own written report of what happened the gets manipulated as in Flynn's case for multiple weeks they manipulate that three oh two until finally Andrew McCabe approves the way it's written which included statements that Flynn did not make in the interview and left out statements he did and this is what drives me crazy said name we're talking to Sydney Powell author of conviction machine why no one people should be outraged over this because there are protest and and candlelight vigils and TV specials and Netflix documentaries on wrongly accused young men in particular and they've been railroaded and it's despicable and they get freed after so many years but for some reason if you are not in a certain gender or race or class no one really cares if your getting railroaded and I think O. J. keeps rearing its ugly head to take down people that are politically unpopular or they want to target it's just I keep recycling this group of prosecutors figured out that they could use a law to destroy people's lives and they did it by making up crimes and hiding evidence that showed they were innocent I think one of the scariest things in this book Sydney we're talking to the author of two incredible books conviction machine standing up to federal prosecutorial abuse and that's of course a co authored by Harvey silver glade who has a ton of experience as well and the license to lie which that was my first exposure to your work and I was both energized and angry to find out that the F. B. I. you can pretty much do whatever they want that really scares me bump it up yes and when they interview you they don't always advise you of your rights like with general Flynn for example they just ambush interviewed him in the White House after McCabe led him to believe he didn't need counseling he wasn't the subject of the interview even and they literally plans the scheme than planned and multiple meetings about how to interview him to keep him on guarded and relaxed so that he would not know he was the subject of the interview and then they use that to start a false statements prosecution against him even though the original agent to interviewing came back and repeatedly briefed three different groups of people on how he was honest with them and if not why it's absolutely stunning and it's it's interesting because for people who are new to the process that I think it's called the three oh two the F. B. I. can pretty much make up its own notes they're not required to tape or video their investigation or their questioning of you and I was shocked by that I thought they would be one agency that would have to cross the tease and dot the I's oh absolutely not in fact Mr Muller testified in front of Congress against vigorously against any suggestion that the FBI record their interviews in any fashion audio or video because it was just going to be too much for them to handle that yeah that is unfathomable to me it would be a lot easier to just turning on to have a transcript made up the recording of the interview then it would be to sit there and take notes that are never going to be completely accurate no matter how good you are and and then have to generate a risk take the time and generate your own written report of what happened the gets manipulated as in Flynn's case for multiple weeks they manipulate that three oh two until finally Andrew McCabe approves the way it's written which included statements that Flynn did not make in the interview and left out statements he did and this is what drives me crazy said name we're talking to Sydney Powell author of conviction machine why no one people should be outraged over this because there are protest and and candlelight vigils and TV specials and Netflix documentaries on wrongly accused young men in particular and they've been O. J. keeps rearing its ugly head to take down people that are politically unpopular or they want to target it's just I keep recycling this group of prosecutors figured out that they could use a law to destroy people's lives and they did it by making up crimes and hiding evidence that showed they were innocent I think one of the scariest things in this book Sydney we're talking to the author of two incredible books conviction machine standing up to federal prosecutorial abuse and that's of course a co authored by Harvey silver glade who has a ton of experience as well and licensed to lie which that was my first exposure to your work and I was both energized and angry to find out that the FBI can pretty much do whatever they want that really scares me some put up yes and when they interview you they don't always advise you of your rights like general Flynn for example they just ambush interviewed him in the White House after McCabe led him to believe he didn't need counsel and he wasn't the subject of the interview even and they literally plans the scheme than planned and multiple meetings about how to interview him to keep him on guarded and relaxed so that he would not know he was the subject of the interview and then they use that to start a false statements prosecution against him even though the original agent to interviewing came back and repeatedly briefed three different groups of people on how he was honest with them and did not why it's absolutely stunning and it's it's interesting because for people who are new to the process that I think it's called the three oh two the the F. B. I. can pretty much make up its own notes they're not required to tape or video their investigation or their questioning of you and I was shocked by that I thought they would be one agency that would have to cross the tease and dot the I's oh absolutely not in fact Mr Mauler testified in front of Congress against vigorously against any suggestion that the FBI record their interviews in any fashion audio or video because it was just going to be too much for them to handle that yeah that is unfathomable to me it would be a lot easier to just turning in to have a transcript made of the recording of the interview then it would be to sit there and take notes that are never going to be completely accurate no matter how good you are and and then have to generate a risk take the time and generate your own written report of what happened the gets manipulated as in Flynn's case for multiple weeks they manipulate that three oh two until finally Andrew McCabe approves the way it's written which included statements that Flynn did not make in the interview and left out statements he did and this is what drives me crazy said name we're talking to Sydney Powell author of conviction machine why no one people should be outraged over this because there are protest and and candlelight vigils and TV specials and Netflix documentaries on wrongly accused young men in particular and they've been railroaded and it's despicable and they get freed after so many years but for some reason if you are not in a certain gender or race or class no one really cares if your getting railroaded and I think that's unfair it is unfair and what it also shows deals if they want you no matter who you are they can get you so if they can do it to someone who's led an absolutely stellar an exemplary life like general Flynn have imagine what they can do to people in other situations that don't have the resources the community support the unblemished history the social connections or anything else they can do it to anybody do you find that the majority of people you talk to that are not familiar with the book yet do they understand that they brought in general Flynn's son and they threatened the general you better plead to something or we're going after your son and he was a he was a new dad any did you know just started his career what have you and they said look if do they even understand that it was this this game of leverage and pressure they're starting to understand that since I've taken over the defense of the Flynn case because it really wasn't brought out and exposed before that other than a few of articles in the media that didn't have the backup that they needed but a lot of one of the things I've been doing and I've posted many of the briefs on my website at Sydney pal dot com with the exhibits so people can see the altered three oh two at least to the extent we have it because the we still don't have the original three oh two Mr van cracked the prosecutor says it's not to I forgot to mention and I didn't know if you're officially are you officially lieutenant general Flynn's attorney at this point yes I've been in okay councils since June nothing okay I just wanted number two he doesn't fit the narrative the media doesn't care if if a hard working businessman or a decorated a member of the military is getting railroaded no different than setting up a kid in the ghetto by planting drugs in his car exactly it's completely set up and completely framed they made up the case the foreign agent registration act alleged false statements they forced into his statement of offense are themselves faults when you compare it to the registration and the true facts and then the alleged false statements and to the FBI that the supposed actual offense are not supported by the agents notes or the even the three oh two which was materially altered but we've gotten no traction with judge Sullivan on these issues even though he was the judge who lauded in J. keeps rearing its ugly head to take down people that are politically unpopular or they want to target it's just I keep recycling this group of prosecutors figured out that they could use a law to destroy people's lives and they did it by making up crimes and hiding evidence that showed they were innocent I think one of the scariest things in this book Sydney we're talking to the author of two incredible books conviction machine standing up to federal prosecutorial abuse and that's of course a co authored by Harvey silver glade who has a ton of experience as well and licensed to lie which that was my first exposure to your work and I was both energized and angry to find out that the F. B. I. you can pretty much do whatever they want that really scares me some put up yes and when they interview you they don't always advise you of your rights like what general Flynn for example they just ambush interviewed him in the White House after McCabe leading to believe he didn't need counseling he wasn't the subject of the interview even and they literally plans the scheme than planned in multiple meetings about how to interview him to keep him on guarded and relaxed so that he would not know he was the subject of the interview and then they use that to start a false statements prosecution against him even though the original agent to interviewing came back and repeatedly briefed three different groups of people on how he was honest with them and if not why it's absolutely stunning and it's it's interesting because for people who are new to the process that I think it's called the three oh two the F. B. I. can pretty much make up its own notes they're not required to tape or video their investigation or their questioning of you and I was shocked by that I thought they would be one agency that would have to cross the tease and dot the I's oh absolutely not in fact Mr Mauler testified in front of Congress against they currently against any suggestion that the FBI record their interviews in any fashion audio or video because it was just going to be too much for them to handle that yeah that is unfathomable to me it would be a lot easier to just turn it in to have a transcript made of the recording of the interview then it would be to sit there and take notes that are never going to be completely accurate no matter how good you are and and then have to generate a room take the time and generate your own written report of what happened the gets manipulated as in Flynn's case for multiple weeks thing manipulate that three oh two until finally Andrew McCabe approves the way it's written which included statements that Flynn did not make in the interview and left out statements he did and this is what drives me crazy Sydney we're talking to Sydney Powell author of conviction machine why no one people should be outraged over this because there are protest and and candlelight vigils and TV specials and Netflix documentaries on wrongly accused young men in particular and they've been railroaded and it's despicable and they get freed after so many years but for some reason if you are not in a certain gender or race or class no one really cares if your getting railroaded and I think that's unfair it is unfair and what it also shows is if they want you no matter who you are they can get you so if they can do it to someone who's led an absolutely stellar an exemplary life like general Flynn hands imagine what they can do to people in other situations that don't have the resources the community support the unblemished history the social connections or anything else they can do it to anybody do you find that the majority of people you talk to that are not familiar with the book yet do they understand that they brought in general Flynn's son and they threatened the general you better plead to something or we're going after your son and he was a he was a new dad any did you know just started his career what have you and they said look if do they even understand that it was this this game of leverage and pressure they're starting to understand that since I've taken over the defense of the Flynn case because it really wasn't brought out and exposed before that other than a few articles in the media that didn't have the backup that they needed but a lot of one of the things I've been doing and I've posted many of the briefs on my website at Sydney pal dot com with the exhibits so people can see the altered three oh two at least to the extent we have it because the we still don't have the original three oh two Mr van cracked the prosecutor says it's not quote in his possession and quote which means that somewhere in the government but not in his back pocket and the judge just said oh well things happen you know it reminds me of and by the way I want to like I forgot to mention and I didn't know if you're officially are you officially lieutenant general Flynn's attorney at this point yes I've been in okay councils since June nothing okay I just wanted to make sure that so this is good so they eat they you are fighting for him as someone should and but because the media is so biased and so tainted and general Flynn number one was an ally of trump number two he doesn't fit the narrative the media doesn't care if if a hard working businessman or a decorated a member of the military is getting railroaded no different than setting up a kid in the ghetto by planting drugs in his car exactly he was completely set up and completely framed they made up the case the foreign agent registration act alleged false statements they forced into his statement of offense are themselves faults when you compare it to the registration and the true facts and then the alleged false statements and to the FBI that the supposed actual fans are not supported by the agents notes or the even the three oh two which was materially altered but we've gotten no traction with judge Sullivan on these issues even though he was the judge who lauded in license to lie in fact I've called in the judicial hero of license the license twenty thirteen I noticed that he would judge so you know when I stopped when I read conviction machine I just finished the other day and I write I said you know when this started of Solomon was a hero I'm I think it is this a different Sullivan may because that's a pretty common name is the same judge but unfortunately it feels like a very different judge Sullivan I mean he slammed us in nineteen ninety two page decision denying us even the original three oh two nine nothing document we know exists and the department of justice dated January thirty twenty seventeen while general Flynn was still in the White House that completely exonerates him of all things Russia he did not us all evidence of the briefings the general Flynn gave on all his foreign contacts to the defense intelligence agency with whom he was still working even after he quote officially left the agency and for judge someone to do that it's absolutely inexplicable I mean he bragged on him for years as being the Brady judge and he had a breakout were entered in this case that he should have been forced to surrender does Brady order absolutely meaningless if you don't enforce it you might as well not happen will be I will be back in a moment can you say one more segment here I'd love to well wrap up S. attorney for the Southern District of New York in the five o'clock hour talk about the Muller investigation and the fact that does some of those indictments were dropped very quietly by the justice department those indictments against some Russians and also we'll check in with immigrant kind of public schools find out what you should be doing with regard to getting your kids instructions at home all that coming up right now a real fan favorite whenever we speak with Sidney Powell I get such a huge reaction and rightly so always has been that way but since you took up the case of one lieutenant general Mike Flynn adds even doubled so city Paul thanks for joining us today thank you for having me where it's always a pleasure where do we begin you've got a brand new book out today it's called conviction machine standing up to federal prosecutorial abuse you wrote it with your co author Harvey a silver glade and I think I want to start there I do want to get an update on the Flynn case because we start with your book because it's so important sure yeah Harvey road three felonies a day probably about the same time I wrote licensed ally and we didn't know each other and then when you started this project he called me to ask if I would join him and that's not the tech yeah makes the ultimate fans because we need to start composing some solutions for the things we know are wrong in our criminal justice system that could be easily fixed and the plan K. actually kind of demonstrates everything that's wrong with our criminal justice system from the fact of such a crushing machine that innocent people will be led to plead guilty or forced to plead guilty to the F. B. I. agents not recording interviews and making up statements that somebody didn't say yeah and then and then losing the written documentation that support what they claim that person said which brings us back to the story right it cannot be lost if the three oh two is put in the Sentinel system and that would have been on it cannot be lost and if it was destroyed there is a lot like tronic trail of how that was done so they've just been sitting on it or somebody affirmatively destroyed it in which case that I mean that should be obstruction of justice white again again regarding diving you back into the Flynn case but I do want to focus on the book for a moment what I love about it is first of all it's a very quick and easy read I like that you also have action items for criminal justice reform real criminal justice reform not just emptying out prisons and I want to get to that as well as all the sources I mean this is really well sourced really well annotated there's great footnotes let's go to the the central premise here you hear legal analyst on cable news and broadcast news throwing out this statement all the time that a federal prosecutor with the grand jury can indict a ham sandwich and everyone chuckles and moves on but hold on that's an incredible acknowledgment of abuse of power is it not so yes it is and it's happened multiple times in the Muller investigation I'm sure N. deal speak to that later but one of them is the Russian troll farm case that they just moved to dismiss the indictment against Concord the company that showed up to contest the charges and the case was concocted from the beginning just like the Flynn case was it was smoke tied with bailing wire you could tell by reading the indictment there is no crime alleged but the judge didn't have the fortitude to throw it out and not uncle incidently probably she is the wife of Matthew Friedrich is one of the lead Billington licensed ally and a good friend of Andrew Weissmann I Andrew Weissmann of course was the the chief lead prosecutor investigator in the Muller investigation now an MSNBC contributor and yet he's pretty much the star of your book license the line yeah I'm in you you have a great chapter here that I I want to skip forward to and that is where have all the judges gone because judges have a huge role in this white why don't they assert their authority more in court why did they dispersed soul much to federal prosecutors I wish I knew the real answer to that one judge friend told me that every District Court judge sees himself as an appellate judge and every appellate judge sees himself as being on the print court and that doesn't happen without the approval of the department of justice yeah and it is it is it really just for their political ambitions that is going to run the federal or you think you've got your next step or no I don't really think that I think a lot of it has to do with the tendency just to put far too much trust in the government officials to appear before the court it used to be at least when I was practicing in regularly and and central court in the western district of Texas I mean my my judges I used to call my judges need me and I knew I would sooner stick a sharp stick in Montana would tell them anything that wasn't right including sometimes reining them in because we had some judges that were far too pro government and they would do things that were wrong but apparently prosecutors don't look at it that way anymore they don't seek justice they seek convictions which is exactly the opposite of what they're supposed to do and the judges have just been either walled into this false sense of belief or not paying enough attention or just in their own biases and of course people don't like to reverse criminal convictions because they assume people are guilty but that far more innocent people are being convicted then should be no innocent person should be convicted and it's happening on a fairly regular basis thank you city PA one of the challenges in this topic is that you know I consider myself a political conservative a philosophical conservatives so I and and get conservatives tend to be a little bit more law and order you know they they they they tend to lean more towards the police certainly the local police and and support our police and support prosecutors on a local basis so we need to sort of set that aside when we look at what the federal government is doing through the justice department and there is a distinction there is they're not yeah there is an inherent part of the problem is nobody wants to believe that a police officer sitting on the witness stand line nobody wants to believe that nobody wants to believe that an FBI agent is sitting on the witness stand line but unfortunately they do and that's why we suggest that they be required to record all interviews and that any interview be warned and and recorded preferably on video before any false statement allegation can be made as a result of what happened in that interview because even the well and even the most well intentioned people might hear something differently than the person meant it and it certainly gets written down differently than somebody mentioned just think about intonation how important information is just one word really can be a question or an affirmative declaration yeah yep that's true I've learned in in this business even when you say what you know you said and what you meant when you say it it's what people here that matters more than certainly that would be the case would have said investigator giving interview right and it's just not fair to people to accuse them of false statements when they don't even they didn't even make the statement right and there's no record of it other than what somebody who is already in a minute liar has has said about it it is you know I there's another trope that we hear all the time which is you know the federal federal prosecutors will not bring an indictment and less they're sure they can get a conviction they have this huge incredible conviction right well there's a reason for that right it has to do with the jury system it has to do with grand juries it has to do with the way they as you put it back indictments are stacked charges explain that to me well they can there so many federal offenses now that you can pile on multiple charges against somebody for one of sensually amounts to one of fancy and that forces innocent people to plead guilty because they're looking at twenty twenty five years in prison for something insignificant but it's blown out of proportion by virtue of the sentencing guidelines and the stacked on charges the Merrill Lynch defendants in license to life the government is trying to blame them for forty two million dollar loss to Enron when Enron had made millions of dollars on the deal I forgot how many millions but it was a profitable transaction and they they just twist things and that was the same characters that are involved in the molar pro primarily Andrew Weissman and so we have this whole host of people who end up pleading guilty because they're facing such an up hill climb just to defend themselves and also that also brings us to the concerned about many of these juries where they don't feel like they're getting a fair jury pool here certainly here in Washington DC right now they're gonna have to be more changements made for people to get trials in places that are not obviously prejudiced no and none of the Enron defendant should have been tried in Houston and then she went to the Supreme Court and the only I think only three judges recognize that principle boasting a justice center my or and Ginsburg and I forgot who the third one was but there was such rancor I mean abject **** in Houston that nobody related to the Enron case could get a fair trial in Houston that was obvious to anybody that was willing to look at the truth of the matter and what the judge says can't overcome that deep level of betrayal and violation that everyone that sent on that jury felt and has a hundred and ten count indictment nobody can defend against a hundred and ten count indictment the book is called conviction machines standing up to federal prosecutorial abuse the author one of the authors is Sidney Powell who were speaking with now her co author is hardly a silver glade our justice department are prosecutors judged and thereby rewarded over the course of their career based on their number of convictions and is that a problem as well yes apparently that is more true than it ever was when I was in the department of justice or the U. S. attorneys offices yeah all the prosecutors unlicensed ally got the attorney general's award for excellence and then came to run most of the Obama administration has longest serving White House counsel Weiss McCain deputy director general counsel of the FBI Lisa Monaco became this ticket counter terrorism adviser Leslie Caldwell came back in the DOJ for Loretta Lynch and brought Andrew Weissmann back in winter they just cycle yeah and they all got the attorney general's award for excellence when every case they actually took the trial was reversed on appeal in whole or in part Anderson was reversed unanimously by the Supreme Court after the company eighty five thousand jobs were destroyed for absolutely nothing except their power play and now they get promoted and rewarded right I think that it did most people hearing that's in the process okay are they going to face disciplinary action if not if not criminal actions because it's an abuse of the federal justice system and and the justice department's power but instead they forget about any repercussions they were rewarded for it and continue to be rewarded for it exactly and and that's I think that's what frustrates people in the latest incidents of this is what's continuing to go on with the investigation of James Comey and the FBI and the justice department under Loretta Lynch during the Obama administration that you are now wrapped up in in your defense of lieutenant general Mike Flynn will we ever see anybody actually odd odd pay a price for their what appears certainly to be abused by we know they falsified FISA warrants why is there not somebody right now facing criminal charges for that I wish I knew the answer to that Larry because I think what they did is obstruction of justice and making false statements to court is completely unacceptable it's just a total violation of everything they're supposed to do and it does does amount to obstruction of justice one of the through lines here in this book seems to keep coming back to this thing called the Brady rule briefly because you're you're facing that right now with with my client wanted to briefly explain what the Brady will rule is and how it plays into your book conviction machine Sidney Powell it comes from a Supreme Court case Brady versus Maryland which held that because the prosecutors hold all the cards they have a constitutional legal and ethical obligation to provide the evidence to the defense is favorable to the defense or mitigate punishment or impeach is any of the government's witnesses that's hugely important because the defendant does not know what the defendant does not know we've seen that practiced in breach more than being produced to defendants it happens all the time it's been a huge problem in the Flynn case despite judge Sullivan's ninety two page order to the contrary for example we know from a summary given to us by the prosecutors that there was a DOJ memo dated January thirtieth twenty seventeen while Flynn was still in the White House completely exonerating him of anything Russia related and so that's that's sort of what you're facing now city PA with regard I this is so maddening because any of us we don't have law degrees right we don't practice law we're not federal prosecutors are defenders but we know that you have a right if you're the defendant to see all the evidence that the.
