Hhs brennan also worked at the civil division of the department of justice brennan. Welcome back to the show. Thanks for having me back on mike. It's our pleasure. Let's start with a high level. Doj enforcement trends doj's false claims act. Recovery's were down last year and in fact it was the first time since two thousand nine that the annual recovery's in healthcare cases dip below two billion dollars but the number of new healthcare false claims act suit filed by whistleblowers was up slightly and the number of new doj initiated cases. More than doubled. What do you make of these trends. I the annual recovery's were almost certainly deflated. Due to the effects of the pandemic. I don't think the dip reflects any disinterest by the government in a healthcare fraud and abuse or a weaker inflow of cases just as many companies experienced operational disruptions due to covid nineteen for a period of time last year the pace of government investigations. I think did slow but it has picked back up as doj has adjusted to a new normal. And i think we'll see the resolution of a number of matters this year that have been stuck in the pipeline second that that spike in doj initiated healthcare cases from fifty seven to one hundred and seventeen is quite notable in public remarks senior doj officials have recently acknowledged that the department has increasingly turned to running. Its own sophisticated. Data analytics on medicare billing and claims data with the goal of identifying outliers or troubling patterns. In my mind this is one of the most consequential developments in the enforcement space for healthcare providers in the past decade until recently. Doj has used data. But it's generally been in a way that's been reactive a whistleblower files a complaint and doj crunches some numbers to see if the claims data are consistent with the allegations or defendants during settlement negotiations presents. An estimate of damages and doj presents its own counter estimate but this is a whole new frontier and it really underscores the importance of providers. Having robust data driven compliance programs providers should be analyzing their own data for outliers trends to try and resolve issues internally before they are resolved through a government investigation..

She was like okay first of all. They're people who we're going to tell you that the civil war had nothing to do with slavery that is a lie. It absolutely had something. Maybe they're gonna talk. They're going to blame it on states rights to blame it on heritage. That is not true absolutely had something to do with slavery. I remember to sitting there being like like like. Why is he talking about. It was decades decades but it was a wild later until i finally heard about this thing called. The loss caused the last. 'cause myth is this idea that the civil war at least from the point of view of the south had nothing to do with slavery that it was about state's rights that southerners were just trying to protect their way of life that they fought honorably and righteously. They were trying to protect their families from this war of northern aggression and that robbie lee who was the head general for the confederate army's was seamus perfect. Gentlemen he didn't even want to fight the civil war in it. Tore him up inside to be doing this. And oh by the way sleigh. Wasn't even that bad. And enslaved people in the south were treated well by their masters and there were loyal to their masters. and that they even fought alongside the confederates. It's a way of buffing and smoothing out all these ugly realities of what slavery actually is into the glossy gone with the wind myth. It's like that's easier to believe right. Yeah that's easier to believe than to think like such horrible horrible. Inhumanity happened right. And you know i've been thinking about the last 'cause lately because on january six we saw confederate flags in the capital in that was truly shocking and then a couple of weeks later i was growing on twitter and i was really struck by this video as we continue our focus on most interesting new books. Cbs navien this guy named ty sidley. He had been in the military for about thirty years. He taught history at west point and he had just retired so we can finally speak his mind in full. And he's talking about how he grew up in the south and had grown up believing in the loss kaz and how robert e lee was his hero until one day he had this revelation that robert e lee was a confederate trader. He was a cruel and someone who believed deeply firmly and really is entire life that human enslavement was the best social system for the south. The result of that work. His new book robert l. e. n. Me and how old was he when he had this revelation. Did you get a sense. He was like forty years old and had a phd in history. So why did you want to talk to so many people like talking about disinformation right now. And whether it's cunanan whether it's believing like the president really won the election you know all these like we're conspiracy theories and we talk about it in this way like it's it's a new thing but you know the loss. 'cause myth is nothing if not like a huge disinformation campaign. And so we've been here before and we also know that it's really hard to have a functioning democracy when like significant portions of the country. Like can't even agree on basic facts and like one of the most basic facts is like. Why did we fight the civil war. And so like if that's the case then like we have to get a lot of people white people to like wake up and just admit. The civil war was fought because of slavery. How did we get white people to dislike. Get on the same page and here was a white person who went through. The problem has done it. Yeah

I've been talking to Christopher offer Bloomberg law team leader for the business of law about a court order, forcing some of Donald Trump's former tax lawyers to give thousands of documents to investigators. So Chris what's the line for attorneys in advising their clients? My understanding is that there is certainly some gray area and some wiggle room here and that attorney should be allowed to their clients. Full throated advice. And if you know, it turns out down the road that the ire Esther the FCC or A judge maybe disagrees with the legal conclusions that the attorney reached. That's not necessarily going to get the attorney in hot water and left. The advice was just so reckless or off base. But where attorneys can run into trouble are in these situations where either they are putting their stamp of approval knowingly on some sort of unlawful behavior, or if they're just carrying their heads in the fans and Pretending like it's not going on in the week seen that in some high profile cases over the course of the last decade or so, where attorneys may face even criminal penalties, and in one situation where attacks firm because of the civil penalties that they face wrapped up in one of those cases that wound up going out of business. So a lot of times, a lawyer will give advice and it pushes the envelope on the client says. Let's go for It is that kind of advice? You're testing the limits of the law is that kind of advice criminal? I'm had nothing to say that it criminal, But it certainly moving into that gray area where there could be some problems. I'm certain that the investigators are trying to dig in there and get a better sense of who was making the calls on these things. Who who knew what was going on? I take it because you mentioned a few cases in your story that there aren't that many cases that have been brought against lawyers in tax matters. That's right. I mean, the ones that you see are the ones where both they're really caught red handed there, you know whether it's been communications or or they admit to it in court or two investigators where lawyers are knowingly Violating the law to assist their clients. And though they're the sort of open and closed case is, um and better easier to prosecute, I would assume and you could see why investigators because there's so much gray area here. May not devote resources to those cases. Where is unclear? Um you know what legal advice and what's criminal activity? Has any lawyer gone to prison over this? Yeah. Um, there was a lawyer. I believe you that Sidley Austin and he was sentenced to 6.5 years prison poor writing letters that authorized A tax shelters that KPMG had created for various wealthy customers. So he did six years in jail on the firm. Sidley was forced they More than $39 million in a civil penalty to the IRA. Tell us about the timing here.
