"Two thousand twenty Democrats in early voting states this weekend, both of them responding to the scandals plaguing Democrats in Virginia many of them calling for Lieutenant governor Justin Fairfax to resign. Fairfax says he isn't going anywhere at least not yet. Let's discuss with our experts here, and you were the former attorney general for the Commonwealth of Virginia. What's going on in your state, top three officials all Democrats under fire? Well in all within a week all of these things exploding and literally almost two day increments. Starting with the governor, of course, with his black face pictures. Was what took this national? It isn't what it started it in Virginia. And then Justin Fairfax only two days later with the first sexual assault allegation. And you saw two twenty twenty democrat contenders their reference the second alligators. But when the first one came out, he immediately came out and was shooting at the accuser rhetorically speaking, of course, in the Washington and using the Washington Post as a shield, and they immediately called him out on that. So he is really violated rule number one when you're in a hole, stop digging. And now he's saying I'm not going anywhere. But tomorrow, I expect Democrats to submit a resolution of impeachment in Virginia. And that will begin a process that has not been used in Virginia in our lifetimes. Are you worried at all congresswoman about the effect? This is having on the twenty twenty candidates on the Democratic Party. On anything having to do with with the agenda that you want to put forward. Well, we need Virginians to have somebody who could lead in that position. And that's my concern. And we're going into his contempt were life is contempt more people of color, and then now we're gone into the Lieutenant governor this is just a which is actually a criminal accusation. So they really got to just wipe everything clean start all over. So that we can we can govern. Can I just want to? What the congresswoman saying this is not just about people Cutler, I'm gonna folks understands this is anti blackness. So let's make this clear. This is anti blackness black face in the mid to late nineteenth century eighteen hundreds was about mocking black people are humanity. Our beauty our culture what we mean to this country. So this ain't a conversation about people of color. This is a conversation about anti black racism white supremacy in the United States of America. So governor up north came out of hiding and gave an interview to the Washington Post saying that he wants to focus on racial inequality during the rest of the time as governor. Here's what he said, quote, their ongoing inequities to access to things like education, healthcare mortgages capital. Entrepreneurship I want to heal that pain, and I wanna make sure that Aldridge Indians have equal opportunity. And I think I'm the person that can do that for Virginia little too late. No credibility. And I actually I'm fended by that. It's almost like let me let me fix what's going on here. So I, you know, let me go and focus on something else. So that people can stop focusing on the things that I did when I was twenty five and he wants to have his repentance as the governor of Virginia. Look you resign, and you go get your own repentance, and you let us continue on in Virginia with actual governance by people who legitimately ought to be in the off. Let me ask you a question congresswoman as elected democrat at the table. If all three of them resign. Then I believe the Republican speaker of the house of delegates becomes governor? You don't want that now? But we need to think about doing what's right, and what's right for Ganz. And what's right overall? I mean look at the race issue in today's day and age with the president at the helm who has been one of the most divisive presidents, and frankly racist himself is a conversation. We do need to have. But looking at the line of order and say, no, we're not going to do that. Because of the consequences is not the right way to do this. And so for me, I would I do think we need to have this conversation, and we should continue to have this conversation. But it has to be fun and Senator, and we can't forget about the person who is inviting us, and who himself is injecting this in to the country to live up again and coming out again. And we haven't seen it be this bad in recent time till the president has really made this race issue. Whether it's about African Americans, certainly. He's doing it all over the board with immigrants, but we need to have this conversation. I cannot. I just can't. About racism in the United States of America, congresswoman, I hear you. But on this. We not blaming President Trump. He hasn't has. Let me let me just say this. He is using. I am not going to let continue to let politicians use. This man is the excuse to deal with racism in this country. It's been going on for far too long in the United States of America. We need a real truth Reconsiliation. Yes. President Donald Trump is a racist. There's no doubt about it. I want to know who's a humanitarian I wanna know who's gonna stand up the people's lives starting with black lives because when you take care of black labs. Let's discuss first of all Senator Turner, you work for Bernie Sanders in two thousand sixteen is he running do you want him to run again? Or are you still feeling the Vernon? I'm still filling the barn. I mean, he's seriously thinking about it. I mean, all that. He has said he is not totally made up his mind. But I think he's probably one of the very few in that makes who would say steel looking to see who might be the best person to actually do this job. I think the Democrats and the and the country can expect there's lots of variety in twenty twenty on the democratic side variety is often said to be the spice of life spice it up in twenty twenty on the democratic side. A lot of spice thirty five. Well, at least twenty and twenty twenty we know that for sure or more, but we didn't have that in two thousand sixteen and so although I am very supportive of Senator Sanders. I am also supportive of anybody who wants to run should get out. There is there anyone you like anyone looking at one of the people that I totally love dropped out this week who has developed Patrick I was hoping that he would do it because I want somebody who can cause our hearts to soar and who has experienced and grounded. What the country needs right now after the polarizing politics of Donald Trump. Yeah. I think the country needs unifying voices period. I mean, I think the country's unbelievably divided. It's frightening to me. I would monitor the president on some of that as well say, hey, I better rhetoric to unite people the thing I think with the Democratic Party in two twenty twenty is they're gonna end up with a far left candidate right now, you see even the leadership Nancy Pelosi. They're begging for their far left. They're turning to the far left. It's not going to be a centrist party was a centrist party. I think they'd put somebody up like Joe Biden. And unlike Senator Santorum, actually, Biden would be a really tough candidate. But if you go far farther to the laugh. Well, let me tell you something wanting a fifteen dollars an hour. Minimum wage wanting to make sure that if twenty five trillion for all the same. To the military industrial complex there there. There is no far less. I don't paint and others. This is the thing as far as higher. You know, people being tired appreciate that as far as people being tire. When is it appropriate to let my boys nine seven and six year old that there's no future for them. Not sure this is a willing winning platform. But you beat you for forgetting Don juniors part of this second. What do you think of the idea of the future is female the future is intersectional? I think. I definitely think this midterm shows that women rose up in incredible numbers, but we're still not half of congress. We're still not half of the supreme court. We still we hold up half the sky and more than half the votes, but we're still not represented. So I think it is time for a woman to be on the ticket. I disagree with that him that the agenda is is going to be as important the far left. I think they're all far left. But I think what we saw from the governor's race in Georgia. We saw from from the governor's race in Florida. We saw from the Senate race in Texas. With beta is they were all ran far left. They were unapologetically broad, and they almost want and some really tough states. It's it's the messenger. The best communicator wins, Donald Trump is a great communicate. You might not like him. "Two presidents to Florida recounts two very different tones. Let's dive right in and talk about with our panel congresswoman, I'll start with you President Trump going full-throatedly against what's going on in Florida. You saw the difference with President Clinton who that was a presidential one. And it was his vice president who was on the ballot there. What's your take? Well, he ought to have proof for when he says that seems to be something that's been thrown out the window. But if you're going to say something is there's criminal behavior or there's unethical behavior or there's corruption to have proof. He doesn't have any proof of that senior your guests at we're on just a little bit ago every vote count. That's what matters getting to the truth. Whether it's an investigation. Whether it's vote recounts, whatever it is just getting to the truth matters. We talked a little bit ago. I'm a former journalist I'm a former investigative journalists. And what always guided us in journalism, and I don't believe this. Journalists are the enemy of the people. I believe there. Essential to our democracy that getting to the truth is what should matter we should count every vote, and we ought to have every attempt to do that. And we should note also that the election officials in Florida, Broward County and Palm Beach county should be transparent with the process and open up these rooms to the journalists down there, Florida has excellent local journalists, and that's part of this process as well. Big thing. I mean, we have we know that they have violated the law court came down and said that pump Palm Beach county violated terms of transparency in terms of when they filed the votes. Well, that's sort of important. I mean, it's very. But I'm just saying it's not fraudulent. But where does fraud happen? It happens when people are watching, and there is no transparency and people aren't following procedures procedures are in place to stop fraud. They are not following procedures. Therefore, and they're keeping it. There's no transparency that raises a big concern that there might be fraud going on because if there wasn't why wouldn't you be transparent? And why wouldn't you follow the law Senator Turner year from a state where people have alleged voter fraud against Republicans? I'm old enough to remember the two thousand four presidential race where people made all sorts of allegations against the Bush campaign in Ohio without any evidence without any proof just based on a lot of suspicion. Well, I mean, listen, if they broke the rules, the court said that they broke the rules in Palm Beach, and they should be held accountable for that. But we can't complete these two different things between elections officials not doing their job and actually saying that there is voter fraud going on in Florida has a problem. It has had a problem for a very long time. The federal government should step in and the help America vote act. There was funding. These states are underfunded in terms of their voting aparatus, and we need to have a better commitment as a nation towards making sure that every state has what it needs to have the apparatus, but count every vote and let the chips fall where they may. So the president's railing against what's going on in Florida was part of a very aggressive week by the president in which he went after a whole bunch of America institutions house oversight, journalists, elections officials, etc. There's one in particular that I really was curious about your response to it as a former FBI official the president attacking the democratic house majority and their. Desire to do oversight tweeting the morning after the election. If the Democrats think they're going to waste taxpayer money investigating us at the house level, then we will likewise before to consider investigating them for all of the leaks of classified information and much else at the Senate level two can play that game. And then later on he went on at the press conference to talk about how the Trump administration itself would be going after that's not just using the Senate against the house. But that's also potentially using the department of Justice and the FBI against the house. What do you think of that? Obviously that's always the wrong answer in any of these. I do think that the house risks going into becoming the house of investigations throwing subpoenas because they're curious not well-founded that's a risk that that can happen. But I think the president interjecting himself into a process of I will investigate you that that is a form of intimidation that I think is uncalled for at the presidential level, candidly, just like, I think it's wrong. The Democrats are saying we've got a stack of subpoenas that were just curious about to me. That's wrong too. We've got to get back to a normal operation of these house committees and the president needs to just worry about listen, if he would've talked about jobs and the economy, and the things that his administration did do right election could have turned out very very differently. I'm Jake tapper two presidents to Florida recounts two very different tones. Let's dive right in and talk about with our panel congresswoman, I'll start with you President Trump going full-throatedly against what's going on in Florida. You saw the difference with President Clinton who that was the presidential one. And it was his vice president who was on the ballot there. What's your tick? Well, he ought to have proof for when he says that seems to be something that's been thrown out the window. But if you're going to say something is there's criminal behavior or there's unethical behavior or there's corruption to have profe- doesn't have any proof of that look, and I seen your guests at we're on just a little bit ago every vote oughta count. That's what matters getting to the truth. Whether it's an investigation. Whether it's vote recounts, whatever it is just getting to the truth matters. We talked a little bit ago. Look, I mean, we we have we know that they have violated the law court came down and said that pump Palm Beach county violated the terms of transparency and in terms of when they filed the votes. Well, that's sort of important. I mean, it's, but I'm just saying it's not fraudulent votes, but where does fraud happen? It happens when people aren't watching, and there is no transparency and people aren't following procedures procedures are in place to stop fraud. They are not following procedures. Therefore, and they're keeping it. There's no transparency that raises a big concern that there might be fraud going on because if there wasn't why wouldn't you be transparent? And why wouldn't you follow the law Senator Turner year from a state where people have alleged? Voter fraud against Republicans. I'm old enough to remember the two thousand four presidential race where people made all sorts of allegations against the Bush campaign in Ohio without any evidence without any proof just based on a lot of suspicion. Well, I mean, listen, if if they broke the rules, the court said that they broke the rules in Palm Beach, and they should be held accountable for that. But we can't complete these two different things between elections officials not doing their job and actually saying that there is voter fraud going on in state, Florida has a problem and has had a problem for a very long time. The federal government should step in and the help America vote act. There was funding. They are a lot of states are undefended in terms of their voting apparatus. And we need to have a better commitment as a nation towards making sure that every state has what it needs to have the apparatus, but count every vote and let the chips fall where they may. I'm Ana Cabrera in New York and tonight, we have new questions about who's actually pulling the strings when it comes to the FBI's one week inquiry into the sexual assault allegations against supreme court nominee, Brad Kavanagh. Now, remember the president claimed just yesterday the FBI had free reign. He called this investigation. A blessing in disguise but sources tell C N N White House counsel, Don Mcgann is working with Senate Republicans behind the scenes to narrow the investigations scope as much as possible. And here's what we have just learned as of right now, neither Cavanaugh nor Christine Wasi Ford. The woman who testified cavenaugh pinned her to a bed groped her and tried to take off her clothes in nineteen eighty-two is expected to be interviewed by the FBI is part of this reopen background check. Now, we also know the investigation will not include Kavanagh's overall drinking history, which has come up in these allegations an agent. Who take their direction from the White House will not be making any conclusion about witnesses witnesses actually say instead, the White House will get the results, and they will decide how to proceed no guarantee. The investigation will be made public for more. I want to bring in former federal prosecutor Ellie Hannigan Elliott. Sorry, Hoenig is your last name. I wanted to get your quick reaction to this new information that forty Cavanaugh may not even be interviewed. Yeah. That's surprising. And I think it's problematic. I think any limitations that the White House or any politician places on this investigation is seriously problematic for two reasons. First of all, we need all the facts. And when we start policing, artificial limitations, you can't go here. You can't go here. We're not going to get the the the entire story. The second thing is legitimacy the American public needs to see this investigation and believe that it's real and true and legitimate and hasn't been influenced by politicians. Let me go through a piece you just wrote for CNN dot com because you say this investigation really at the. The very least needs to focus on three key things. We start with interview with Mark judge who is the person that Ford says was the other man in the room when she alleges this assault happened. Judges the obvious starting point he's he's the third person as you said all we have from judge to this point is these letters from from judge lawyer and judge himself one pagers to the Senate Judiciary committee where he says I do not recall the events described. That's not really an answer. Cavenaugh tried to stretch that in his hearing and say, it's a refutation of Dr Ford, it's really not in fact could be consistent with Dr Ford because we know that judge has an addiction problem and has long had that and if he was intoxicated that night to the point of memory loss. It's not only not inconsistent with what Dr Ford said it actually could support her account of the story because she says they were both really drunk. And so the one page statement doesn't get you anywhere. He needs to sit face to face with the FBI. They need a chance to go deeper than one page and ask him questions about his own drinking and about Kavanagh's drinking Kavanagh's drinking is. Credibly important here. Because again, if it's established that he was a heavy drinker to the point of memory loss. It supports Dr Ford's testimony and seriously undermines Kavanagh's defense, and he could have committed perjury. You know, there was the famous exchange with Senator klobuchar where she asked him do you ever drink to the point of blackout? And when you see someone invade like the way that that Cavanaugh evaded that is a flashing red light that he's hiding something. He's a smart guy. He's a judge. He's been in that question answer scenario, usually he's the one asking the questions. Borrow Cavanaugh was the other thing that I read in your piece in which Mark judge could be asked is that referring to break. Yeah. They asked caveat at the Senate. He said what do I do? I didn't write it, but ask judge, and I don't know how gets out of that. It's not break Cavanaugh. It's a mighty fine coincidence, apparently Bart Ocalan threw up in somebody's car and passed out according to Mark judges account. You also say up next they need to interview witnesses to Ford's prior statement explained. So this is this is really important. Dr Ford told people five different people three friends, her husband and her therapist about this attack as far back as twenty twelve up to twenty seventeen. And so the question is in what we call this. A prior consistent statement, and it has a lot a lot of probative value. The question that the logical question is why on earth would she make this up six years ago and start telling people in serious settings? What happens so the FBI should speak with each of these people corroborate or disprove it. See if they stand. Why are there any notes were there any emails because if in fact, doctor for did tell these people that's powerful corroboration for her? And if she did not where it doesn't stand up, then you have to ask why does she submit this in the first place. Okay. Number three, then you point to have enough calendar entry, this is from July. First nineteen eighty two which reads to Timmy's for skis with judge. Tom PJ, Bernie squeak tell us more about that. This is as close to a Perry. Mason moment as we might have a Rachel Mitchell who was the hired outside. Prosecutor started to go down this road with cavenaugh and she sort of pulled up and then they pulled her. She never asked another question after that. But this calendar entries matches to a large extent, non highly. But it matches Dr Ford's testimony. She said the people at the party were cavenaugh judge PJ and a fourth person whose name I don't remember. There's a couple more Senator Grassley said it's not the right number of people. But remember, Dr Ford said this was pre gathering so other people could have come after so FBI needs to drill down. They can find Timmy's house. They already know where it is. It's fairly close to that country club. They can look at the layout. See if it matches up with Dr. Testimony. And if so that's powerful corroboration for her. How he Hoenig such interesting conversation. Thank you for your insight and expertise joining us now CNN political commentator, Scott Jennings. He worked with cavenaugh during the Bush administration and also with us CNN political commentator, Nina Turner, she's a former democratic state Senator from Ohio. So Scott, the fact that cabinet and four may not be interviewed the fact that they're not looking at his drinking history. When this investigation is over are the American people going to have faith in this investigation. Will they should have faith in the investigation. Because this is what the Democrats demanded. I don't know. Whether they're going to interview for you, Kevin is soon, they will they both said they would cooperate with an investigation. I think we'll let the FBI decide how best to conduct this supplemental background check everything that guy. You just had on said. I'll let me translate it for you. It's I want delay. I want this to last as long as possible. So we can get past the election. Maybe win the election and hold this thing open for two years. This is not an investigation that is designed to dig into everything that he wants to dig into. This is a supplemental background check demanded by the Democrats acquiesce to in my opinion, a wrongly by the Republican women. Results based should be looking into a supplemental background check which right? When you when you said what he just laid out is unrealistic. I it shouldn't even go there. Where shouldn't they go in terms of what he just laid out? There's nothing partisan there, isn't he was just talking about. What could help give us the truth? No. The truth here is whether or not brick Kevin all in the form of a of an F B I background check or this supplemental background check is a suitable nominee. They don't draw conclusions about uncorroborated allegations. They don't draw conclusions. They're not going to resolve this in Kavanagh's favor Orrin, Dr Ford's favorite they're gonna offer a report on whether any additional investigation in the process of a background. Check changes. You know, what people might think they don't draw conclusions? And I think people want them to draw conclusions. But that is not the result of a process like this. Which is why of course, Democrats are already trashing what they demanded. They wanted an FBI investigation. And they're already trashing it because they don't want the results. They just want delay. Let me read President Trump's tweet to that point. He writes, wow, just starting to hear the Democrats who are only thinking obstruct. And delay are starting to put out the word that the time and scope of FBI looking in judge cabin on witnesses is not enough for them. It will never be enough. Stay tuned. And watch your response. Good guy. Nobody's asking for delay. People are asking for Justice. Dr for has leveled a very strong allegation. We know that what she said her testimony certainly triggered millions of people across this country. Both men and women to think in a deeper way about what has not only happened to her. But what has happened to countless women across the ages across generations. So just the trivial is this like Scott is doing is really shameful. The fact of the matter is is that the FBI should be allowed to conduct an investigation and let the chips fall where they may. And you would think that the judge would want this to happen. So that the FBI can dig deeper and either clear him or not clear here in terms of those allegations. But to limit the scope to limit the numbers of people who are who are interviewed is absolutely wrong. So this is not this should not necessarily be seen through a purely partisan lands. Thank god. God that Senator flake had the courage to say, let's pull this back a little bit and let the FBI do its job. It should have been done even before it got to this point. So let's listen to Senator Jeff flake who again was sort of the person who made this investigation happen. His last minute demand who to have this investigation. He sat down with an interview with Chris coons democratic colleagues in the Senate. This was for sixty minutes. Let's listen. I was really struck that. I thought his anger got the best of him. And he made a partisan argument that would have been best left to be made for his advocates and defenders on the committee made you wonder about his suitability in my case. Yes, it made me wonder about his suitability to serve on the bench. But Senator flake, you dinovite with it, you you understood the par-three talked about the mention of the Clintons. I didn't like either did seem partisan, but boy to put myself in that spot. I think you give a little leeway there. Scott when you heard Cavanaugh stay the allegations were revenge on the half of the Clintons. Did that sound like someone who had the temperament of a supreme court Justice? Will it sounded like someone to me? It was pretty darn upset about being called a rapist and attempted murderer a gang rapist running some gang rape rain in highschool it sounded like someone to me who was up there to defend his honor. And let's be honest. It is about revenge. I'm not sure it's about revenge for the Clintons with it's about revenge for Merrick garland. Protecting Roe versus Wade. And I'm not going to respond to Senator Turner's. It's. Ad hominem. But I am going to tell you what is shameful Dianne Feinstein sitting on this for two months and then forty treating her so shabbily. Behavior. Not been on the part of cabinet or the Republicans. It's been the Senate Democrats who have absolutely been shameful and their behavior in this whole confirmation. It's been utterly ridiculous. Give me up. I mean, the same the same party that sit up there and denied President Obama the ability to have even his nominee have a hearing with the Senate. Listen, some people might be playing political games with this. But others are not in the Mexican people deserve better than what they have gotten up into this point. And to trivial is a woman's testimony about what happened to her. Doctor four said it happened to her the judges saying that he wasn't the one that did. You know, you have Senator Schumer saying the FBI isn't bias. It's professional. He can do the soberly effectively indiscreetly to recruit saying four days delay should be enough now already starting to say, wait a minute. Actually, we think that they're not going to be doing this completely. Let's let's not buy into the FBI is only for delay here. I think it'll be good to have everyone. There were a lot of senators who said, we're still not quite settled until we hear the from it. I think we're gonna hear the lot of these witnesses and they're already starting to come out with repeating the testimony. Lynn Kaiser, Dr Ford's, longtime friend who says I still support, but I also still don't remember the events that she described. So again, we're gonna see this same. The same kind of the result here at the end of the day, people will be maybe have more confidence because they the involved and then we'll move forward to a vote. So moving forward to a vote. Millions of Americans, tens of millions of Americans are going to look at this process, and I have to wonder what she Justice. John Roberts thinks about this process also is somebody who cares deeply about the integrity of the court and not wanting it to be political. Tens of millions of Americans are gonna look at Justice cavenaugh as somebody who got away with it as they did Clarence Thomas. This is a rohrschack test. And I mean, this process was so badly bungled by both sides in the minute. These allegations came out, I said, get the f. b. i. out again and do an investigation that should have been done actually before the hearing. I think it's unfortunate that it happened here. That is what's normally done. I went through not at kids ations of sexual assault, hobbies that I went through active stations against me when I was up for secretary of labor. And by the time I got off the telephone and drove home, the FBI was practically on my doorstep, waiting to reenter view me at Rian. If you other people had this process taken the right form. It had not been politic. Sized. I think we would have a lot more confident and I, it isn't just not coming up with corroborating evidence. I want questions act of Dr. Ford is. Well, we can't live in a society in which accusations of this kind of activity are enough. One question you wanna ask her. I want to know she has a very clear recollection of going down the stairs in going outside. This was a woman who didn't drive somebody drove her home. We didn't have cell phones. We didn't have Ubers. There are other people who need to be questioned, and I can remember as a fifteen year old who used to drive me not to every single event, but there were just, you know, handful of people who drove when I went to parties and my father. And so I mean, I do think more questions, this idea that we have to believe Dr for just because she testified about what happened in that room. Obviously, one of these people's does have one of these people does have a faulting and Senator Turner. Let me ask you because this is. Is it's, it has in many ways on one level, it's about Cavanaugh and professor Ford. On another level. I went to a party last night and heard women telling me stories about their experience, and we heard Killian Conway this morning just a couple of days ago and you did it as well if you days ago on my show, and, but let's run a little bit of from Kellyanne Conway, we can't, because that was a remarkable moment. I was not expecting just minutes ago. I feel very empathetic, frankly, for victims of sexual assault, sexual harassment, and rape that. I'm a victim of sexual assault. I don't expect judge Cavagnaud or Jake tapper or Jeff flake or anybody to be held responsible for that..
